03-14-1983 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING OF THE CITY COUNCIL WEST COVINA, CALIFORNIA March 14, 1983 • The regular meeting of the City Council of the City of West Covina was called to order by Mayor Tice at 7:30 PIS? in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, California. The Pledge of Allegiance was led by Mayor Pro Tem Chappell and the invocation was given. by Rev. Robert Burton of Inter -Community Hospital. ROLL CALL Others Present: APPROVAL OF MINUTES PRESENTATIONS West Covina's 60th birthday Beatrice Uribe Urban Forestry volunteers Children's Congress Mayor Tice, Mayor Pro Tem Chappell, Councilmembers Shearer, Tennant (arrived 8:12 PM) and Bacon Calmes, Mooney, Fast, Lennard, Eliot, Thomas, Miller, Salazar, Fry, Meacham, Southard, Keating, Pryor, Penfield, Rogers, Berry Motion by Chappell, seconded by Shearer, and unanimously carried to approve the minutes of the adjourned regular meeting of February 22, 1983 and the regular meeting of February 28, 1983. Mayor Tice received resolutions of recognition from area legis- lators commemorating West Covina's.Sixtieth birthday. Presen- tations were given by the following representatives: Bob Cochran from Assemblyman Bill Lancaster's Office Don Lemon from Assemblyman Frank Hill's Office Frank Schabarum from Supervisor Pete Schabarum's Office A note`of special appreciation was expressed to West Covina Beautiful president Beatrice Uribe for coordinating the Annual West Covina Birthday Ball held in February, 1983. Recreation and Parks Commissioners Louis Reynolds and Ruby Williams assisted the Mayor in presenting Certificates of Recognition to each of the volunteers in the Urban Forestry Renewal Program. Fifth graders, Reed Claxton and Tim Gria, were the recipients of Certificates of Recognition in honor of being chosen as participants in the Children's Congress. Bob'Johnson, LACO Senior Deputy Forester, presented to the City TREE CITY, USA of West Covina in behalf of the National Arbor Day Foundation a flag and plaque as a TREE CITY, USA award. This award was given in recognition of the City's participation in the Urban Forestry Program. Carsey. Amount unknown as of time of filing. On January 6, 1983, a claim for personal injuries amounting to $50,000 was filed with the City Clerk from Rosalind Pinto. On January 27 and January 31, 1983, two applications to file a late claim were received by the City Clerk from Warren Busch amounting to $200,000. On February 3, 1983, a claim for personal injuries was filed with the City Clerk from Mark Henley. Amount unknown as of time of filing. However, he was pleased to learn that the South Eills Drain project was going out to bid and should be completed by November, 1983. MOTION Dept. of Health ti Services Emission, Study i HEAPING • 83/84 Community Devel- opment Flock, Grant Program 1^ Motion by Shearer, seconded by Chappell to approve all items listed on the CONSENT CALENDAR. Motion carried by roll call vote: AYES: Bacon, Shearer, Chappell, Tice NOES: None ABSENT: Tennant Council commented on the recently submitted Emissions Study of the BKK Landfill by the Department of Health Services. There seems to be some ambiguities in the report and Council expressed their anxiousness for the public hearing at which time the DOHS will clarify the report and answer questions. 1) 1983/84 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM City Clerk Mooney verified the affidavit of publication. Mayor Tice opened the hearing and Human Resources Director Salazar presented the staff report. Councilmember Tennant arrived as Mayor Tice asked for public testimony regarding the grant program. Council comments followed. Motion by Shearer, and seconded by Bacon, and unanimously carried to place a.maximum of 25% of the $400,000 to be used for commercial rehabilitation. City Attorney presented: Resolution 6674 - RESOLUTION NO. 6674 - A RESOLUTION OF THE CITY COUNCIL 83/84 CDBG OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING ITS INTENTION TO APPLY FOR GRANT FUNDS PURSUANT TO THE FEDERAL HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1977 AND CERTIFYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT THEREOF Motion by Chappell., seconded by Bacon, and unanimously carried to approve the 1983-84 Community Development Program and authorize staff to apply for the City's entitlement, subject to the amended motion above. AWARD OF BID SP 83110-1 PORTNER STREET RECONSTRUCTION Location: North of Vine, east of Lark Ellen SP 83110-1 Council reviewed staff's report. GENTRY BROTHERS Motion by Shearer, seconded by Bacon, and unanimously carried to accept the bid of GENTRY BROTHERS, INC. of Irwindale in the amount of $32,205 and authorize the Mayor and City Clerk to execute an agreement. Motion carried by roll call vote: AYES: Bacon, Tennant, Shearer, Chappell, Tice NOES: None 0 ORAL COPIMNNICATIONS^ Royal Brown, 2153 Aroma Drive, commented on the Emission Study. �i He questioned the bagging of samples taken at the boundary lines. He suggested the report be sent to Air Quality Management Dis- Royal Brown { trict and the Engineering Department could develop recommenda- tions.to reduce emissions by capping the landfill. Brown felt that the public was not given an opportunity to review the ordinance increasing council salaries before it was adopted. - 4 - CITY COUNCIL MINUTES March 14, 1983 Page Five Betty Joyce Betty Joyce, 1509 Delhaven Street, commented on Council raises. Oliver Riggins Oliver Riggins, 1239 Rowland Avenue, felt that if the County Health Department doesn't take action to correct the emission • problems at BKK, it is then incumbent on the Council to go through whatever avenues are necessary to see that the Depart- ment does take care of the problems. Riggins also mentioned that citizens have an opportunity to address items listed under the Consent Calendar which are considered so rountine that they can all be approved by one action. However, citizens do not have an opportunity to dis- cuss the more important item.s on the Agenda until Council has already taken action, as Oral Common cdt-ions:�fdl-ls., at' the end of the Agenda. • • MAYOR'S REPORTS Mayor Tice closed Oral Communications and the following com- ments were offered by Council: The comments made by Royal Brown regarding the State's Emission Study would be taken under advisement. Council reminded the audience of the routine manner used by all city councils throughout California in adopting ordinances and resolutions. Mayor Tice clarified the raise amounted to five percent which is exactly $19.35..per month. There was some discussion on a nominee for Older Americans' Recognition Day, but no decision was reached. Mayor Tice proclaimed 1983 through 1992 as The Decade of Disabled Persons. Motion by Shearer, seconded by Chappell, and unanimously carried to approve a Resolution of Commendation for presentation to the West Covina Vikings Soccer Team for placing first in the Southern California Division of the Youth Soccer Association. COUNCILMEMBERS' REPORTS Motion by Bacon, seconded by Chappell, and unanimously car- ried to instruct staff to review and report back on the Bacon latest application from Southern California Edison regarding not decreasing prices in utility charges. Bacon also urged the community to support HR58 regarding natural gas rates. Tennant noted that Independent Cities Association is spon- Tennant soring SB747 regarding contract cities. He also mentioned there .-is.:- no concensus in Sacramento re permanent funding for cities. He would also like to see the City Council pub- licly condemn any of the local legislators who do not oppose binding arbitration.
