04-26-1982 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING OF THE CITY COUNCIL CITY OF WEST COVINA, CALIFORNIA April 26, 1982 • The regular meeting of the City Council of the City of West Covina was called to order by Mayor Tice at 7:30 PM in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, California. The invocation was given by George Johnstone of the Salvation Army and the Pledge of Allegiance was led by Councilmember Shearer. HEARINGS 1) VARIANCE NO. 823 SWK ENTERPRISES Variance No. 823 Location: Northeast'corner of Aroma and Azusa Avenues SWK Enterprises This hearing was continued from the regular meeting of March 22, 1982.=,C:oune, :1 -postponed the- hdATing_ afi that time gpon_reque5;t, of _the applicant City Clerk Mooney verified the affidavit of publication. Environmental Services Director Mike Miller presented the staff report. Testimony Mayorg.;=Tice opened the hearing for public testimony. In Favor Mr. Bill Cardona, representingthe developer, spoke in Bill Cardona favor of the variance. He noted that they have a uni- form sign program for the shopping center. He also said that'it is very difficult to lease office space without signs, and he'was not aware that the current City code dd:not`allow signs for second story offices. The signs p.roposed-by the developer would be visible only from • the parking lot, to aid patrons. Ira Smedra Mr. Ira Smedra, also with SWK., noted that leasing of the second,floor has begun, but that tenants are holding back to see if they in fact will be allowed a sign. In Opposition No one addressed Council in opposition to the variance request and Mayor Tice closed the public portion of the None hearing. Council Discussion Councilmember Shearer pointed out that Council would be considering a change in the Municipal Code in July regarding signs for second story offices. He felt that since Council would probably favor signs for second story offices and they have a means to grant the request through the variance process, the applicant should be granted permission to erect the proposed signs. Most council comments following Shearer's opinion supported the request; however, Councilmember Bacon felt that since the language in the Code has clearly stated no signs for..second story offices, the requested variance should not be granted. He felt the grounds for a variance had not been met. Motion Motion by Shearer, seconded by Tennant to direct staff to report back to Council at the next regular meeting with the conditions.of the variance so that Council can vote it. Motion carried by the following vote: • AYES: Tennant, Shearer, Chappell, Tice NOES: Bacon HEARING 2) TENTATIVE PARCEL MAP NO. 8647 (Mulhearn) Mulhearn Location: 225 Plateau Drive This hearing was continued from March 8, 1982. He noted that the meeting between the developer and neighboring residents was held on April 6', 1982, and a new tentative map was devised to include the suggestions that came out of that meeting. Mr. Miller felt that meeting to be positive and that both parties would be agreeable to the recommendations of staff. Councilmember Bacon expressed some reservation to staff's recommendation in that the proposed homes will not match the existing homes in the area. However, he felt that since the tract map technically complies with all conditions, it must be approved. Resolution 6514 - approving Tent. Motion by Shearer, seconded by Chappell, and unani- mously carried to direct staff to a) prepare an amend- ment to the Municipal Code reclassifying the properties abutting Plateau Drive and Vanderhoof Drive from Citrus Street to its easterly terminus from R-1 and R-A, Area District III (14,440 square feet minimum lot size), to R-1, A.D. IV (20,000 square feet minimum lot size), and b) refer the prohibition of parking on the west side of Plateau Drive to the Traffic Committee for recommenda— tion to the -City Council. ZONE CHANGE NO. 566 CITY OF WEST COVINA Location: Northeast corner of Merced and Garvey Aves. City Clerk Mooney verified the affidavit of publi- cation.. Mayor Tice opened the hearing on this matter. Environmental Services Director Mike Miller pre- sented the staff report. He indicated that the City of Baldwin Park and the property owner were in agree- ment regarding.the zone change. Mayor Tice asked if anyone desired to address Council, either in favor of or in opposition to the zone change. No one spoke and Mayor Tice closed.the public portion of the hearing. Mayor Tice opened the hearing regarding this matter. The staff report was presented by City Engineer Harry Thomas who indicated that this was the first time residential properties would be included in such a project. Motion by Chappell, seconded by Tennant, and unanimously carried to receive and file the Engineer's Report. Public A estimony Mayor Tice asked if anyone desired to address Council either in favor of or in opposition to the utility dis- trict. Oliver Riggins Oliver Riggins,, 1239 Rowland Avenue, was concerned about the city picking up the conversion.costs or could they be borne at the time of transfer. Patrick Rossetti Assessment Engineer Patrick Rossetti answered that cities generally pick up the costs.. He noted that it was not feasible to go through a bond issue on this type of district. Glenn Bashore Glenn Bashore, Southern California Edison, stated that an allocation of $400,000 has been granted by SCE to West Covina.for 1983, which covers the first phase. Mayor Tice opened the hearing regarding this matter and the staff report was presented by the City Treasurer, Yvonne Calmes. Public Testimony The applicant, Victor Strauss, 1831 W. Foster Avenue, In Favor addressed Council regarding his application. In answer Victor Strauss to Council's questions, he stated he would be charging $25.00 per hour for the rental of his limousine, a 1937 Cadillac. Ed Smith Ed Smith, owner of Kwik Kab Company, asked questions regarding code requirements. • Public Testimony closed There being no others to address Council, the public portion of the hearing was closed.. ORAL COMMUNICATIONS (CONT) Mr. Dan Merritt stated that he had worked with the City Dan Merritt Council of La Verne in support of the bilateral nuclear freeze. Lillian Fine Mrs. Lillian Fine, 1210 S. Robin Road, also .supported the bilateral nuclear weapons freeze. Council discussed the bilateral nuclear weapons freeze in length. Mayor '.-Herb h-Tice-.. '. wished the resolution also included chemical and biological warfare as well. Motion to support Motion by Shearer, seconded by Tennant, and unanimously bilateral freeze carried to support the resolution as presented. Louis Gilbert MAYOR'S REPORTS Council liaison appointments Proclamations Mr. Louis Gilbert, 428 Fernwood Street, addressed Council regarding the status of Social Security and how.it effects senior citizens, as he sees it. Mayor Tice thanked Gilbert for his remarks and began a discussion on Social Security. Bacon Council concurred with his suggestion. Tennant Councilman Tennant-,;... distributed a report to the other members .from the Independent Cities Association on methods for saving money and a list of lawsuits that have'stopped the effective- ness of local government. He noted that Independent Cities now has a lobbyist in Sacramento. Chappell Councilmember Chappell stated that he would be working with the League of California Cities Board on the budget. He also complimented the Explorer Scouts of West Covina and Covina for their help at the March of Dimes walkathon.
