04-12-1982 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING OF THE CITY COUNCIL CITY OF WEST COVINA, CALIFORNIA April 12, 1982 • The regular meeting of the City Council of the City of West Covina was called to order at 7:30 PM by Mayor Chester Shearer in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, California. The Pledge of Allegiance was led by Councilmember Bacon and the invocation was given by Pastor Larry Cole of the Community Presbyterian Church. ROLL CALL Present: Mayor Shearer, Mayor Pro Tem Tice, Councilmembers Chappell, Tennant, Bacon Others Present: Mooney, Calmes, Fast, Lenard, Thomas, Miller, Eliot, Salazar, Fry, Meacham, McClelland, Southard, Pryor, Holmes, Keating, Berry APPROVAL OF MINUTES Motion by Tice, seconded by Bacon, and unanimously carried to approve the minutes of the regular meeting held March 22, 1982, and the adjourned regular meeting of March 30, 1982. PRESENTATIONS Mayor Shearer presented a Resolution of Commendation to James Clopton in grateful appreciation for his dedicated service on the Recreation and. Parks Commission. Mr. Clopton had recently resigned from the commission as he moved out • of the area. Mayor Shearer proclaimed PRIVATE PROPERTY WEEK (4/18 - 4/24) and presented the proclamation to representatives of the Covina Valley Board of Realtors. Mayor Shearer proclaimed NATIONAL LIBRARY WEEK (4/18 - 4/24) and presented the proclamation to Mrs. Miller, the Head Librarian at the West Covina Branch County Library. CONSENT CALENDAR "Written Communications Compliance Inspection Report for BKK Class I Landfill . Water Quality Control received from the California Regional Water Quality Control Board Board,!Los Angeles Region. (receive and file) Galaxy Little League Request for a parade permit received from the Galaxy Little League for an opening day parade on April 17, 1982. (approve subject to standard conditions) West Covina Lion's Club Request fora parade permit received from the West Covina Lion's Club to conduct a 5 and 10K run on May 16, 1982. CONSENT CALENDAR MOTION Motion by Bacon, seconded by Tice to approve all items listed on the Agenda, except Item A-ld. Motion carried by roll call vote: AYES: Bacon, Tennant, Chappell, Tice, Shearer NOES: None Item A-ld A recommendation was received from the Board of Directors of the West Covina Chamber of Commerce that the City of West Covina contract with the Boys Club of San Gabriel Valley for purposes of graffiti removal, prevention and aftercare. (refer to staff) Councilmember Tennant suggested staff prepare an ordinance for graffiti removal on private property. He • made a motion to that effect, it was seconded by Bacon, and unanimously carried. Motion by Chappell, seconded by Bacon, and unanimously carried to approve staff's recommendation to refer the item END CONSENT CALENDAR to staff. ORAL COMMUNICATIONS Bella Grattis, 1846 Broadmoor Avenue, addressed Council re her letter to Council requesting'a hearing on the 26th of April for Council to consider supporting the Alliance for Bella Grattis Survival. The subject matter would be a bilateral nuclear weapons freeze. Mayor Shearer indicated that the matter was already scheduled for th.e April 26th meeting. Leslie Cook Leslie Cook, 2724 Miranda Street, answered his own comments re city policies and sat down. Milfred Walker Milfred Walker, 1201 Durness Street, spoke against the use and sale of fireworks within the.City boundaries. He asked why Council hadn't passed on ordinance to that effect. Oliver Riggins. Oliver Riggins, 1239 Rowland Avenue, spoke about political and campaign matters. He requested Council to take a stand on one of the recent campaign.publications. Louis Gilbert Louis Gilbert, 428 Fernwood Street,..supported the statements • made earlier banning fireworks in the City of West Covina. Tom Whisenhunt William T. Whisenhunt, 2132 Kings Crest Drive, asked if Council had certified the results of the March 23 election. Mayor Shearer answered in the.affirmative, pursuant -to the Elections Code. There being no others addressing Council, Mayor Shearer closed Oral.Communications and the -following remarks were made in.response to the comments raised during Oral Communications:. - 2 - CITY COUNCIL MINUTES April 12, 1982 Page Three City Manager Fast indicated that a comprehensive report from the County regarding fireworks has been scheduled for Council's review the first meeting in May. Mayor Shearer responded to Riggins' questions re cam- paign literature by noting that the Fair'Political Practices Commission is the agency to enforce rules and regulations regarding campaign literature and disclosures. Councilmember Bacon disclaimed any association with the campaign publication mentioned by Biggins. In answer to a request by Louis Gilbert, the Mayor indicated that Council would discuss Social Security at END - ORAL COM. the next regular meeting. HEARINGS MARKS-FORAN RESIDENTIAL REHABILITATION PROGRAM City Clerk Mooney verified the affidavit of publication. Marks-Foran Mayor Shearer opened the hearing and Gus Salazar, Director of Human Resources Department, presented the staff report. He introduced Rod Gunn who was available to answer questions. Hearing opened Mayor Shearer opened the hearing for public input. No , No testimony one addressed Council either favoring or opposing the pro - Hearing closed gram. The public portion of the hearing was closed. Council comments ensued.' It was suggested by Council - member Bacon that the definition of "average area purchase price" should be included. And that "final payment should be limited to not less than 15% of purchase price" also be included. Council questioned further about income limits, types of improvements, length of residence status • of applicants, etc. Mayor Shearer felt there should be some limit on ability to turnover a loan. • City Attorney presented: Resolution 6509 - RESOLUTION NO.. 6509 - A RESOLUTION OF THE CITY COUNCIL approving Marks-Foran OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE JOINT program with Baldwin WEST COVINA/BALDWIN PARK COMPREHENSIVE RESIDENTIAL REHABILI- Park TATION FINANCING PROGRAM Motion by Tice, seconded by Chappell, and unanimously carried to waive further reading of the resolution and to adopt.. Increase in reimbursement Motion by Tennant, seconded by Bacon, and unanimously to J&R LANDSCAPE MAINT. carried to grant J & R LANDSCAPE MAINTENANCE a 10.3% increase in their Maintenance District No. 4 contract, effective April 25, 1982, and authorized the Mayor and City Clerk to execute the contract. 2) SP 80050 - PLANS & SPECIFICATIONS APPROVAL - VINCENT AVENUE/SAN BERNARDINO FREEWAY INTERCHANGE MODIFICATIONS Location: Vincent and San Bernardino Freeway Council reviewed Engineer's Report. SP 80050 - plans & specs Motion by Tice, seconded by Tennant, and unanimously approved carried to approve the plans and specifications for city project SP 80050 and authorized the City Engineer to call for bids. 3) DESIGN SERVICES FOR JOINT PUMP STATION CITY OF WEST COVINA & SUBURBAN WATER SYSTEMS Location: Azusa and Puente Avenues Council reviewed Engineer's Report. Design of pump station - Motion by Tennant, seconded by Tice, and unanimously .PERLITER & INGALSBE carried to a) authorize the establishment of project account WP 83119 and transfer $55,000 from the un- appropriated water fund balance, and b)_ accept the proposal of PERLITER & III?GALSBE CONSULTING ENGINEERS of Glendale in the amount of $50,500 for design of the pump station. 4) ACCEPT COVENANT AND AGREEMENT TO HOLD PROPERTY AS ONE PARCEL: ARKENBERG AND BALL, INC. (McDonald's Corp) Location: Southwest"corner of Azusa and Amar Council reviewed Engineer's Report. City Attorney presented: Resolution 6510 - RESOLUTION NO. 6510 - A RESOLUTION OF THE CITY approving a covenant & COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, agreement - Arkenberg & APPROVING A COVENANT AND AGREEMENT TO HOLD PROPERTY Ball, Inc. ORDINANCE FOR ADOPTION City Attorney presented: ORDINANCE NO. 1543 -AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY ADDING SECTION 15-5 RELATIVE TO CONSUMING ALCOHOLIC BEVERAGES IN PUBLIC PLACES Motion by Tice, seconded by Bacon, and unanimously carried to waive further reading of the ordinance. Motion by Tennant, seconded by Tice to adopt the ordinance.
