October.12, 1981 The regular meeting of the City Council of the City of West Covina was called to order by Mayor Shearer at 7:30 PM in the City Hall Council Chambers, 1444 W. Garvey Avenue, West .Covina,.California. The Pledge of Allegiance was led by Councilmember Bacon and the invocation was given by Rev-.. Norris Barnes of the West Covina United Methodist Church. Motion carried by roll call vote: AYES: Bacon, Tennant, Chappell, Tice, Shearer NOES; None. • OPAL COMMUNICATIONS Bill Traynor, 2522 Walnut.Creek Parkway, complained that the tree trimming crews were cutting the trees along Walnut Creek Parkway back too severely. Bill Traynor Mayor Shearer referred the matter to staff to investigate. - 1 - CITY COUNCIL MINUTES October 12, 1981 Page Two Tom Drossman for Tom Drossman, 2750 Bellflower, Long Beach, attorney • McCoy's Market- representing McCoy's Market, requested Council to recon- sider a UUP for exterior light on Badillo. Mayor Shearer pointed out that the.Planning Commission was directed to research the matter of exterior lighting and if there was a need to update the Municipal Code book. :Motion by Chappell, seconded by Tice, and unanimously carried to instruct the City Attorney to advice the Dis- trict Attorney that the general subject matter was being considered by the Planning Commission and may or may not effect the McCoy Market situation and to hold off on any prosecution.. Royal Brown Royal Brown, 2153 Aroma Drive, addressed Council re Agenda Item E-5, the selection of a consultant for the maintenance department work management study. He felt that the firm recommended by staff did not have any ex- pertise in the area of developing a work management system. Mayor Shearer stated that Council would consider his comments when they reviewed the subject later in the meeting, Betty Joyce Betty Joyce, 1509 Delhaven, questioned Council on Agenda Items D<2 and D-5. She suggested the City could save money by buying vehicles without AM/FM radios or air conditioning, A.J, Esposito A.J.. Esposito, 3450 San Joaquin Drive, Covina, addressed Council on behalf of West Covina -Beautiful, He stated the • organization cleaned and removed litter and weeds from the freeway offramp at Azusa Avenue. He noted that West Covina Beautiful would be removing litter the first Saturday of every month. ORAL COMM. MP 80012-1 Motion by Chappell, seconded by Tennant, and unanimously drainage corrections carried to a) authorize,the-transfer.of $10,000 from SLATER CONSTRUCTION CO. Project SP 79011 and $6,500 from MP 80039 to MP 80012-1 and b) accept the bid of Slater Construction Company from Upland in the amount,of $28,360 and authorize the Mayor and City Clerk to execute the agreement., 2) QUOTATION NO. 82--71 TO PROVIDE ANEW CURRENT MODEL HALF -TON PICKUP TRUCK -WITH FACTORY -INSTALLED AIR CONDITIONER ANDA/M RADIO', Quotation No. 82-71 Council reviewed staff.'`s.repo.rt, . Motion by Tennant, seconded by Chappell, and unani- mously carried to award the bid for a combination high pressure.water cleaning and vacuum truck to HAAKER EQUIPMENT COMPANY in.the amount of $95,359.72, including tax.. 4) QUOTATION NO, 82-=70 -'CURRENT MODEL ONE -TON TRUCK Council reviewed staff"s report, City Manager Fast corrected the recommendation to indicate Reynolds Buick rather than Leo Hoffman Chevrolet. The correction was based on the 1% de- duction of sales tax, which changes the low bidder.. Motion by Chappell, seconded by Tice, and unanimously carried to award the bid for a one -ton truck to REYNOLDS BUICK, West Covina-, for $12,356.98, including tax. The.hour of 8;00 PM having arrived, Mayor Shearer stated it was time to conduct the scheduled 8:00 hearings.. HEARINGS ;. 1). APPEAL OF TENTATIVE PARCEL MAP NO. 8647 m (Held over 'froiii 'September '28- 1981) APPEAL OF TENT. PARCEL Location: 225 Plateau Drive MAP NO. 8647 Applicant: Bruce Mulhearn Environmental Director Miller presented the staff report. Public Testimony Mayor Shearer opened the Bearing for public testi- mony. In Favor Bob Hill, 16911 Bellflower Blvd,, Bellflower, represented the applicant. He stated that he had met Bob Hill with some of the homeowners near the parcel in question and was not opposed to receiving input re the house designs from them.. He stated that Mr. Mulhearn wanted the four lots that had previously been approved by the Planning Commission, but that he was also open to house design comments. In Opposition Frank Anzalone,_2836 Vanderhoof Drive, stated that the meeting with the applicant was of little benefit. Frank Anzalone He thought perhaps the intended front house with a narrow lot frontage of 80 feet should not be,constructed, Council discussion Mayor Shearer noted that the lot split request of the'applicant.actually effects the lower level of the lot. The front house that the neighbors are concerned about could be constructed right now. That means if Council were -,to deny the,subdivision of the lot, the front house could be built..but the one on the lower rear portion could not and that house is not causing the concern with the neighbors. Council discussed drainage for the lower lots, access to the lower lots, and the possibility for an EIR rather than.the Negative Declaration of Environ- mental Impact, - 3 - CITY COUNCIL MINUTES October 12, 1981 Page Four • Motion by Bacon, seconded by Tice, and unanimously carried to refer back to the Planning Commission for an EIR in light of new testimony re questions of traffic, drainage, etc,, since the preparation of the Negative Declaration in 1978. HEARING 2) ZONE CHANCE NO. 564 (City Init'idted) ' Location: South of Garvey Avenue, east of Grand to the City limits Zone Change No. 564. Mayor Shearer opened the hearing, City Clerk Mooney verified the affidavits of publication and mailing., The staff report was pre- sented by Mike Miller; Environmental Services Director. Public testimony In F_avo_r Harold Smith, 309 N. Bender Avenue, Covina, spoke Harold Smith as a member of the 7th Day Adventist Church. Lillian Smith, 309 N. Bender, also spoke in favor Lillian Smith of the zone change. Alfred Moses Alfred Moses, 3440 E. Holt, felt the zone change would result in an upgrade of the area. Don Stottler Don Stottler, pastor of the Adventist Church, spoke in favor. • In Opposition Steven Miller, 3534 Holt Avenue, noted that the Steven Miller zone change covered 50 acres and would like to see a portion of that area excluded from the -zone change. Ann Lee Ann Lee, 3542 Holt Avenue, felt only the vacant Fredrick Steiner portions of land should be rezoned. Fredrick Steiner,3536 Holt Avenue, opposed the entire zone change, He felt the one acre parcels should be retained, Rebuttal Alfred Moses, 3440 E. Holt Avenue, stated that to develop one acre lots would be too expensive. Public testimony closed Mayor Shearer closed the public portion. Council discussion Council discussed the lot sizes and properties in and around the proposed zone change, Shearer stated he could support a zone change for the unde- veloped property.. Tennant and Tice expressed sup- port of rezoning 11 acres only. Motion by Chappell, seconded by Tice, and unani- mously carried to refer the matter back to the Planning Commission for reconsideration of Council's wishes to Back to Planning Commission rezone only the origina1:11 acres; Recess Mayor Shearer called a recess at 8t50 PM. Council reviewed Engineer's Report. Maintenance Department City Manager answered the comment brought forth under Management Study - Oral Communications re this subject. He noted that ECONOMIC RESEARCH ASSO`. the City had gone through one year of initial investi- gation and a management study committee formed six months ago to review similar programs in other cities. Four consultants were invited to submit proposals and the committee evaluated each. Motion by Chappell, seconded by Tice, and unani- mously carried to a) transfer $8,000 from Project Account MP 80039 to Account No, 737.81 and b) accept the proposal of ECONOMIC RESEARCH ASSOCIATES in the amount of $61,688.00 for preparation of a Maintenance Department Work Management Study and authorize the Mayor and City Clerk to execute the agreement. ENVIRONMENTAL SERVICES DIVISION ENVIRONMENTAL SERVICES 1)' SLOPE MAINTENANCE OF WEST SIDE OF AZUSA AVENUE Location: West side of Azusa Avenue, north and south of Grenoble Avenue Slope Maintenance Council reviewed staff's report. Councilmember Bacon West side of Azusa Ave.. felt that another solution to the problem could be to plant the slopes with.low maintenance plants.. Mayor Shearer'.fe,lt the ow ers.might find a better solution to the slope. -maintenance than falling back on govern- ment ,to do it for them.. Motion by Tice, seconded by Tennant to authorize the Mayor to send a letter to the -affected property owners expressing the City''s concern for the proper maintenance of the slopes, particularly along the west side of Azusa Avenue, bearing in mind that lack of maintenance can be considered to be a violation of the Municipal Code.. Shearer asked Council if there were any sug- gestions or questions on'the resolutions that will be considered by the League at the annual conference. League of California Councilmember Bacon suggested that an item 6 be Cities resolutions added to the resolve portion of Resolution No.. 41: 'By.developing programs for*the orderly closing of all hazardous waste landfills located in urban areas at the earliest possible date.." MAYOR'S REPORTS Mayor Shearer proclaimed: NATIONAL BUSINESS WOMEN'S WEEK (October 18 - 24, 1981) TOASTMASTERS C01414UNICATIONS MONTH (October, 1980 Mayor Shearer noted that a Resolution of Commendation had Bemoll retiring been presented to Bemoll. He suggested that the resolution school principal be retrieved to be permaplaqued,, Motion by Tice, seconded by Tennant, and unanimously carried to support the mayor's suggestion.. Mayor Shearer read a statement on the removal of hazardous waste from Kelloge Terrace to.BKK. The City has opposed the transfer and asked the State for proper certification before sending the waste to BKK.. COUNCILMEMBERS` REPORTS Councilmember Bacon expressed enthusiasm for the Mt, SAC Urban Tree Program., Councilmember Tennant asked when thepublic hearings would be held regarding heavy vehicles parking on front yards.. Miller answered that the matter was scheduled for the middle of November, Councilmember Tennant stated he had received complaints • re people living in trailers on front and rear yards. City Manager no that staff was already investigating the enforceability of the Municipal Code,relating to the problem., Councilmember Tennant shared with Council an.article from the.L,A.. Councilmember Chappell stated that the Governor had signed a bill expanding LAFCO''s membership. Mayor Pro Tem Tice requested staff to check into the formation of a Citizens Committee to review.and suggest ideas in conjunction with CATV.
