the City Council was called to order by Mayor Shearer
at 7:36 PM in the City
Hall Council Chambers, 1.4441W. Garvey Avenue, blest

Motion.by Tice, seconded -by Chappell, and unanimously carried
to approve the Minutes of the regular meeting held May 26th
and the adjourned regular meeting of June 1, 1981.
PRESENTATION
Mayor Shearer presented a Resolution of Commendation to Mr.
James Thynne who was retiring as principal of Edgewood High
School after twenty-five years of dedicated service.

Item IV of the Traffic Committee Minutes of May 19, 1981
Median opening on Request by applicant to make a presentation to the City
Nogales at Amar Rd. Council that a median opening be provided at approximately
CANYON CREST DEVELOPERS 400 feet west of Nogales on Amar Road.
The Traffic Committee recommendation was that the request
be denied with consideration to be given at the June 8, 1981
City Council meeting for the.requestee.

Item A-7 Mr. Mark Douglas, the developer of Canyon Crest Villas
and Canyon Center, addressed Council re different alternatives
of median openings into the center located on the corner of
Amar and Nogales. He then introduced Mr. Rill Darnell of
Newport Beach who had conducted a traffic survey for Canyon
Crest Villas developers.
Much discussion followed with questions regarding the pros
and cons of various alternatives to the access of the center.
Motion by Tennant, seconded by Tice to refer the matter
back to staff to work out a compromise with the developers.
Motion.carried by the following.vote:
AYES: Tennant, Chappell, Tice, Shearer
NOES: None
ABSTAIN: Bacon
Item A-2 Mayor Pro Tem Tice stated that he wanted Council to consider
Unclassified Use Permit No. 235 (Delhaven Community Center)

Jack Zukerman Mayor Shearer stated that this hearing was continued from
May 26. The public hearing portion was finished at the
meeting of the 26th. The matter was continued until this

development. He also suggested that the full assessment
shculd be raised in each year, rather than the.developer

Tom Welsh, the developer of the Larwin tract, stated
'his agreement to the alternate method suggested by Shearer.

portion of the area in question would be in the assessment
district o.r.be dedicated to the City. City Engineer
answered that, all of the common open space areas would be
dedicated to the'City for open space purposes and the
maintenance of the areas -would-be funded throua_h the assess-
ment•district.
Oliver Riggins, Rowland Avenue, asked if the property
dedicated to the city would cause an increase in the City's
liability: City Attorney Lennard answered that there
would not be any increased liability. The City would
assume the same liability that it does with any land that
is deeded to the City in fee simple.
No one else addressed Council. Motion by Chappell,
seconded by Tice, and unanimously carried to close the

The next item is a staff report from Environmental Services, the one
that was addressed under Oral Communications, in regards to a possible
contract with Eutek for an additional odor study related to our current
ongoing efforts in the area of.odors, control, alleged violations,
environmental impact report, etc. We have a staff report. Any ques-
tions, comments,'
Bacon:
First, I have a question.. What "period did our'last report cover, what
date did that start.
Miller:
It was the first two weeks of December and the middle part of January.
Bacon:
Based on what Mr. Brown indicated tonight, it would seem to me that
rather than - apparently there is maybe some weather change which
occurs during that part of the year'whi.ch causes the odors to be at

their worst and that somehow or other they are dissipated by ordinary
-
processes. the rest of the year - I believe we should have the study
done at a relatively similar time.'.I would suggest that we start it in
November and do November, December -
Miller:
This is a six -weeks program only and I might point that there are two
sets -of circumstances here that influence the time that we are going
by. -,Number one is the fact that we need input into the draft environ-
mental -impact report as it relates to the allegations on odor viola-
tions and the potential action on the unclassified use permit. 'Ne

required BKK to install certain items to correct the odors and address
the odors that had been identified and this is an attempt to try and
quantify that. Secondly, thi.s follow-up odor study involves micro -
meteorology as well as tracer anayl.sis to determine the emission rate
from the deck of the landfill. In other words, they will be measuring
the exact quantities being released from the deck of the landfill and -
comparing it to the quantities released in January and December, and
making adjustments for the micrometeorology that variations to hope-
fully make it at least a Washington apple and a Pippin apple instead
of a Washington apple and an orange. Ideally, it should be in Octo-
ber, November and December. I don't doubt that. It would be the
direct comparison and requires the least manual adjustments for minor
modifications. However, the time schedule to expedite the draft en-
vironmental report preparation, of which this is a part, would not Der-
mit same..to be held back in November because.it would anticipate we
would be in hearings in September.
Tennant:
Mr.-Mayor;-.JI would like to rake a couple of comments.
Shearer:
Councilman Tennant.
Tennant-.
First, I_would like to respond to something Mr. Miller said. If I had
known that.part of the E.I.R., of which we are spending - I'm losing
track, we've had so many studies I forget which one was 120, which
one was 75, I've got them all mixed up. But, nevertheless, if I known
that the F..I.R. contract with Ultrasystems was contingent upon another
�.
$87,000 on top of that-, I wouldn't have voted for that one.
I am going to vote this down tonight and I'll tell you why. Number one,
I'm tired of spending money on people who live down around the landfill
who haven't appreciated it. So I decided to call some of them this
weekend and find out how much they would appreciate me not voting on
it. And -much to my surprise, I didn't get a single one of them who
wanted tospend the money on it. And so, I can't find anybody who
feels we need this and I'd be willing to reconsider this in the fall
after we have settled all issues of authority, after we have settled
hearings, after we have settled initiative elections and recalls, and
all that -sort of thing I'd be willing to consider it, but I am going
to vote NO on this.
Tice:
Mr. Mayor.
Shearer:
Councilman Tice.
Tice:
I've got mixed emotions on this particular study. We have spent a heck
of a lot of money in the whole area. The question I have for Mr. Miller
is there any way that not having this information would jeopardize the
validity of the E.I.R. Is there any way of getting this information
without going through this kind of a $85,000 study.
Miller:
To rely on just the odor complaints being called in'would not be a valid
measure of whether or not the activities have actually helped mitigate
the odor conditions down there. And the only way of being able to pro-
vide that input and that evaluation is to conduct an odor study that
measures the air emissions, make the minor modifications for the micro -
meteorology, and at least.it is as scientific a measurement as you pos-
sibly can get instead of being a point and bone of contention possibly
at the time we go into the public hearings on the draft environmental
impact report on, of all things, alleged odor violations.;. If we don't
have.any quantified anaylsis to compare to previous considerations, it
is left to the interpretation of any member of the public or staff, or
Planning Commission as to whether or not an improvement has been made
or no improvement has been made.

What's the latest we could push this down to the November/December

Miller:
The E.I.R. input draft will be to .the City staff, inourhands, by
August 20th in order to be able to*complete the process within the
.32 month time schedule and start the public hearings in September.
Tice:
Are the odor complaints - refresh my memory - higher during the summer
months-.
Miller:
:--The-odor complaints are generally higher during the winter months.
And the exception that would take place is when you get into a heavy
inversion layer situation, such as we did last fall in October for
about ten days -straight in.which case you absolutely had no wind move-
ment, no air movement, no mixing, and the odors would not disperse.
So it generally starts in the fall about late September and really
peaks out.i.n November, December and January.
Tice:
Do you think if we did not have this, there would be some question
on the E..I.R.
Miller:
It would be staff's opinion.there would be some question.
Fast:
Mr. Mayor; council will recall that the basis.on which they referred
the subject to the Planning Commission for hearing had to do with the
nuisances caused by odor. Council will, also recall that the Eutek
study was a result of wanting to measure the effect of the mitigating
measures installed as a result of the USC study. It -appears to me that
.the evidence that' the Planning Commission is going to'have to have if
in fact it's -going to have a valid hearing at all in the area'of nui-
sances caused by odors', that we have to :have some sort of ability to
quantify it. In fact, the Council made that a firm stipulation in
terms of evaluating the USC study- Consequently, it would appear to
me that the hearing process at some point -in time should have this sort
of information folded into it. It could happen at a later date; how-
ever, you.will also recall that the Council instructed staff to accel-
erate to the greatest amount possible the hearing process. So, it was
With this .i'n.mind that this is before you this evening.
Tice:
Could this -be a separate item by itself, as an addendum to the E.I.R.
later on., Mr. Fast. What I am thinking about is pushing this down
closer to the time that we -.took. -the original study.
Miller:
Mr._Mayor and Council, it could be an addendum. However, coming as an
addendum -late in the game, doesn't allow you to make the adjustments
in the draft environmental impact report when that draft is being_ pre-
pared so that.ail people have the information at that time. And
secondly, to.- as I say, we anticipate being in hearings by September -
to wait until November or late October it would really be too late to
complete the study to'be useful..
Fast:
We do have some hope of cost sharing on this one as compared with the
previous one, from the Environmental Protection Agency. They -have at
staff level given us a hint, and in fact staff was prepared to person-
ally .go to their regional headquarters 'of EPA to personally lobby
for them to participate heavily inthis study.
Tice:
Ply concern was to try to. -get it_as close.to:the:iier.iod of the original
study -and we can't do it.
Shearer:
There .is a. way to do it.
Tice:
Well, we could postpone the hearing...I don't want to.do that.
Shearer:
Well, that's - there i.s a way to do it, .if we want the best of both
worlds and unfortunately sometimes we can't.

Chappell: Yes. We have committed ourselves, though, to this thing.
• Shearer: I may be a little confused, partly by the hour and partly by other things.
The issue of whether or not there has been an improvement in the emission
from the landfill - is that really the purpose of the E.I.R. Or is the
E.I.R. to address the environmental impacts of suspension, revocation,
amendment. It would seem to me that whether or not there has been an
improvement, or elimination perhaps, would really be a matter for evi-
dence when the Planning Commission and possibly the City Council ulti-
mately has a hearing, not on the draft E�I.R., but on the actual O.K.,
now, -:.we have.an E.I.R. that says these are the impacts and this is what's
going to happen, so forth and so on. Now, with that information, what
do you want to do with the unclassified use permit. It would seem to
me that that's '.when:.- the results of the study of this type is more
urgent. Now, I'm not in the business of writing E.I.R.'s, but from what
little I know about them', -that's more the time frame, that information
of this type would be more appropriate rather than in the preparation
of the E.I.R. Could staff respond to that.
Fast: I'd like to comment briefly, and I think the City Attorney has a comment
as well. With respect to the third alternate of those three potential
actions'by the City, and that.is the amendment of the UUP. The amend-
ment would apply to change, conditions by the City Council which would
most likely be addressing further mitigating measures. And I believe
that very likely those mitigating measures would have to tie into the
types of things that Eutek had recommended and that, in fact, have
occurred in the past that the Planning Commission would then want to
• add as additional conditions in the event they were considering amend-
ment.as compared to the other two alternatives. So, in terms of an
E.I.R. commenting on impacts, they would have to be presupposing certain
amendments under the one alternative and these amendments would be
changed operating conditions, additional conditions to the UUP, many
of which would undoubtedly tie into the recommendations of Eutek or USC
which. have pone beyond the requirements of the City.and have never been
incorporated into UUP.
Shearer: I would like to comment, also, a little bit•6n.what• Councilman Tennant
mentioned. With all due respect, I really wouldn't expect a phone call
to the people in Woodside Village who have already polarized in one cer-
tain position to ask them if they want Council to spend any more money
studying the problem, why I think the obvious answer of anything less
than 100%.NO would be very surprising. I think the answer there they
have already decided they want the landfill closed, period, pure and
simple, at least as it relates to toxic wastes. I really -don't know
if that is significant. They.have already taken action on recalls,
taken action on an initiative petition. So, it's obvious their minds
are made up. I'm not saying whether itt's right•or. wrong. I think
that's obvious I don't agree with it.:,Hhat I find is, if we want to
have a good basis for making a decision, and let's say the vote is to
revoke the UUP, and it's not on the basis of any kind of study, we're
in court. On the other hand, if we go the other direction and say there
has been improvement in the absence of substantial evidence, the other
side is on court. And I'm sure the court would rule 1,1hat's the basis
• of your decision. Did you have any evidence?" And in the absence of
evidence, decisions are generally thrown out and reversed. I don't want
to spend any more money either. And I don't live in Noodside Village
and I'm not on that side of the issue. I don't want to spend any more
money or any more time on the matter, but I'm not sure how to get out
without spending more money. So,.I think, the lesser of two evils,
I'm .going to support the staff report.

Tice: I have to go along with it, -much as I hate to spend the $85,000.
Tennant: Let me just -say another side of that coin, though. Even Eutek has made
the comment to us that their best instruments aren't as good as the
human nose.- .A,nd.,therefore, I seriously question what this study will
tell us,�whether it will mean anything, and whether anyone will pay any
attention to it. And regardless of the outcome; I think it will be so
challenged.'I think it's a waste a money. So, I have not bought any of
the arguments I have heard here tonight, so - I've had it with spending
money on..more studies involving the landfill at this time. Later on,
after a lot of things have settled down, I'd be glad to reconsider it,
but I would not at this time.
Bacon Mr. Nayor..I believe that Mr, Miller answered the one question that I've
raised, and which Mr. Brown had referred to earlier this evening, as to
weather conditions would materially effect the readings. But, he has
indicated that they have the capabilities.of taking the readings at the
site, measure the emissions -coming from there, at'ground level, and they
can compare to see that we have an improvement -or we have no improvement
or that this process is working or this one is:not working, I think we
will have some evidence. And contrary to what Councilman Tennant has
indicated, I think that no matter whether you make the people happy or
unhappy you do need to have. the evidence upon which to make your deci-
sion. Only intelligent decisions can be made when you have materials.
And based upon the representation that,,I assume that in the_Eutek con-
tract that we get from them will very clearly point out that that's
part of the requirement, that they are to give us comparisions of around
level on.the prior test with. the present test, so that we are basically
comparing apples with apples and that we would then have the information
that.we need.
Tice: Only question is, I'm not sure that we're comparing apples and apples.
Bacon; Well, Mr. Millerindicated they may be brands of apples, but at least
it's pretty close to apples.
Chappell; I would say that i.n the summer weather that's coming on now, that the
methane, gas will be more apt to generate in larger volume if they're
measuri.nq:it right at the surface of the landfill, They'll certainly
get some sort of measurements,as well as those four burners are working,
and the other recommendations they have made are working, and when we
have a final hearing whatever decision we come up with at that time we
are going to have to document it, because we have already tried to close
that landfill to abandoned wastes sites that we don't even know what's
in them. The courts have on two occasions now have ruled against us,
so we have really got to document everything we do here and the only way
we can do is to approve this recommendation by the staff and get the
study done. Is there is motion or a resolution.
Lennard: It's a motion.
Shearer: The action is a motion -
Chappell: I move the staff recommendation.*.
Bacon: Second.
Shearer: Any further comments. I'll just say this, and I hope that my colleagues
would join. If you vote to make this study, obviously we can't unequiv-
ocally commit to something. I think what we'd better have in the back
of our minds, that the results of this study, properly in-terpreted, is
just what we said.- evidence.on which we make our decision. And if this
" comes out :` one way.or the other, whether it's the way we might sub=
consciously or consciously hope.that it comes out w,hatever this report
tells us we had better be prepared to be guided, Don't ask a question
if you can't -accept any one of the possible answers. If anyone of our

minds is made up on this matter, then maybe you better not vote for this.
And that's not saying that anyone who votes against it, mind's made up.
I don't mean to imply that. But, if you don't intend to give full con-
si.derati'on to the results of this, let's don't even ask the question

Motion:by Tennant, seconded by Tice, and unanimously carried
to approve staff's recommendation to support SB 305 .(Greene),
AP, 601 (McAlister), SB 500 (Beverly), and oppose ACA 35
(N. Waters), SB 579. (O'Keefe'), SB 863 (O'Keefe), and to
authorize staff to correspond with the appropriate legisla-
tors.
4) EARLY REPLACEMENT OF MAINTENANCE PERSONNEL LOST DUE TO DIS-
CONTINUANCE OF CETA PROGRAM
Council reviewed staff's report.
Replacement of main- Motion by Chappell, seconded by Tennant to authorize the
tenance personnel hiring of six Maintenance Workers as of June 15, 1981, and
appropriate $4,800 to cover the cost of salaries and fringe
benefits. Motion carried by roll call vote:

MAYOR'S REPORTS No reports for this meeting.
COUNCILMEMBERS' REPORTS/COMMENTS
Councilmember Chappell asked what the status was of a joint effort
with the City of Covina re 'grafitti.removal. City Manager Fast
stated it was in limbo at the present time.
Chappell noted that he would be on vacation for a week start-
ing Friday, June 12, 1981.
APPROVAL OF"DEMANDS Motion by Tice, seconded by Chappell to approve Demands totaling
$1,989,547.95 as listed on demand registers 86188 through 86198.
