Garvey Avenue, !Jest Covina, California. The Pledge of Allegiance was led by Councilmember Bacon and the invocation was given by Dr. Myrus Knutson of Christ Lutheran Church, !.,test Covina. Motion carried by roll call vote': AYES: Tennant, Chappell, Tice, Shearer NOES: None ABSTAIN: Bacon` ORAL COMMUNICATIONS Emma Fishbeck, 1137 Auburn Drive; president of blest Covina Beautiful, informed Council that Clean-Up,.Paint-It, Fix -It Week was progressing very smoothly. She noted that 60 vol- Emma Fishbeck unteers were working six days a week from 9-5 in the office. She.suggested a letter of recognition:.*be sent to each par- ticipating organization. Mayor Shearer requested she submit a list of those organizations and a letter would be sent out from his office. In connection with the clean-up week, she stated the State Department of Transportation had approved the anti -litter • poster to be erected at the off -ramps into Nest Covina. The poster was created by David Miller during the anit- litter poster contest for 7th through 12th graders. Lollie Bergman Lillie Bergman, 426 South Leaf, addressed Council re the BKK landfill issue. She felt Council has handled the BKK matter very thoroughly and was upset that comments from the residents around the landfill have Droqressed to personal -2- CITY COUNCIL MINUTES May 11, 1981 Pape Three attacks on the.Council and staff: She contacted nineteen . families and found that they concurred with her own feelings in that most of the citizens in West Covina are either mis- informed, don't understand, or don't care about the B KK issue. She told Council that she is starting a committee to express a different view point of the issue. The issue, as she sees it,.is not the danger but the -smell -and the prospect of de- clininq property values, as well as the loss of revenue to the city. She suggested Council limit debates on the issue unless scheduled on the Agenda, review current actions already taken (esoec-ially placing the initiative ordinance on the November ballot), and.the need for unifying efforts to qet action from the State departments. Beatrice Uribe Beatrice Uribe, 1121 E. Greenville Drive, appreciated Council listening to the general public and thought it would -be,a mistake to limit comments`to'hearinn items only. Louis Gilbert Louis Gilbert, 428 S. Fernwood Street, felt it was the right. of.each citizen to be able to address Council on any matter. He also.felt the emergency ordinance adopted by Council was drawn up in such a way that it wouldn't hold up in .court. Mayor Shearer invited.anyone to submit language for a. better ordinance. • .�OP,AL COMMUNICATIONS was halted to conduct the scheduled-'pub- 1-ic hearings. Council asked questions re Negative Declaration sidewalks within the development and if the schoolchildren would be riding the bus.; Public Testimony Mayor Shearer.opened. the hearing for public comments. IN.FAVOR Betty Joyce, 1509 Del Haven, requested a clarification of the sidewalks. Richard Chylinski, 1550 F, Puente Avenue, the appli- cant, stated that sidewalks were planned for the southerly side of the private street and the public streets around the tract. IN OPPOSITION No one spoke in.opposition to the development. Public .Testimony Closed Mayor Shearer closed the public.portion of the hearing. Council comments favored the development. Extension of Street Motion by Tice, seconded by Chappell to grant R.F. Dickson Sweeping Contract Company, Inc. a contract extension with a $750 per month R.F. As you are aware that ordinance has been legally challenged by Mola Development Company,, BKK and the State of California through the Attorney General and we are presently awaiting the outcome of a hearing on application for preliminary injunction to be held on Tuesday May 12, 1981 in Department 88 of Los Angeles Superior Court. Among the many issues before the court is the ques- tion of whether there was any legal justification to sup- port an urgency ordinance under the provisions of the Government Code. The City maintains that there was ample reason and justification under the circumstances supporting the urgency adoption. In addition, however, I recommend second reading of the ordinance you introduced at your last council meeting which ordinance will then take effect 30 days after you adopt it. Such an ordinance would then be free from the collateral and procedural` issue of "urgency" under the Government Code. Motion by Chappell, seconded by Tice, and unanimously carried to review Commission compensation during the bud- get review. 4) REQUEST FOR STUDY SESSION Study session set for City Manager Fast requested Council to schedule a study 6/l/81 at 6:00.PM session to discuss project planning issues, such as the senior citizens center, street deficiencies, reflection pool, etc. Council concurred that June 1, 1981, at 6:00 PM would be convenient for the study session. Senior Citizens Center Councilmember Bacon expressed concern about the size possible future of the senior citizens center in the future. He felt expansion the building would be inadequate for future needs. Motion by Bacon, seconded by Chappell to appropriate $1500 from the Unappropriate Balance for the architects to prepare preliminary plans to allow for future expansion of the building.
