February 9, 1981
The City Council of the City of West Covina convened in the City Manager's
Conference Room at 6:00 PM for the purpose of conducting an Executive Ses-
sion to discuss litigation matters. At 7:30 PM Mayor Shearer called the
meeting to order in the City Hall Council Chambers, 1444 W. Garvey Avenue,
West Covina, California. The Pledge of Allegiance was led by Councilman
Bacon and the invocation was given by Councilman Tennant.

REPORT FROM EUTEK; INC. REGARDING ODOR CONDITIONS AT THE
BKK SANITARY LANDFILL
Council reviewed staff's report.
Motion by Tice, seconded by Tennant, and unanimously
carried to receive and file the•"BKK Landfill Odor Study,
Second Interim Report."

Shearer:.. At this time we will have Council discussion with regard to the con-
text of the report and any action that the Council wishes to take. on
the basis of that. I think because of the significance of the item
we are going to be discussing I would like the City Clerk to prepare
a verbatim transcript of this matter as part of the Minutes.
—Tice: As far as the context of the interim report, I have no comment at this
time until I see the final report. There is some indications of some
progress. However, I would like to expound a little bit here on the
options available to this Council, if you have no objections.
The way I see it, there are probably five options available to the
Council regarding the operation of the BKK landfill.
The first option is to determine that the odor mitigation measures
taken so far by the BKK Corporation have shown to be sufficient in the
way of improvement and odor conditions and, thus, no :further'
action would be taken by the Council at this time.
The second option is to extend the ninety -day deadline for com-
pliance with the Unclassified Use Permit based on implementing the
additional mitigation measures recommended in the Interim Eutek Study
Report.
. Number three is to continue any further action on this matter until
a judicial decision can be obtained regarding the City's authority to
fully control the operation of the landfill, including a determination
to revoke the UUP in closing the landfill.
The fourth option is direct the City Attorney to file a complaint
. in the courts and obtain a stay to close the landfill temporarily.
The fifth option is to determine that the BKK Corporation is in
violation of the Unclassified Use Permit with regards to the odor
problem and direct the City Manager to issue a notice of violation to
the BKK Corporation. Then, direct the Planning Commission to start
the proceedings to conduct public hearings on the revocation, sus-
pension or amendment of the UUP and at the same time, concurrently,.
.determine the need for an environmental impact report.
From my own observation, I believe that the BKK Corporation has
made a dedicated effort to mitigate the odor problem based on the
present state of the art and implementing the recommendations of the

USC and Eutek studies. However, I feel -that the -operation of the land-
fill -still has aways to go to significantly mitigate the odor problem.
And as such, I am recommending the following motion:
Authorize the City Manager to issue a notice of vio-
lation of the OUP relating to odors. Two, direct
and authorize the Planning Commission to conduct
public hearings as soon as possible on the revoca-
tion, suspension, or amendment of the UUP, and at
the same time determine the necessity of preparing
an environmental impact report.
These actions, preparing the environmental impact report and preparing
for the public hearing, are to be concurrent. That's my recommendation..
Mr. Mayor.
Shearer: Thank you, Mayor Pro Tem Tice. Any other member of the Council
wish to have -the floor.
Tennant: I I think for those of you who are citizens of West Covina, I think
you are well aware of my stands regarding the BKK landfill. Despite
the Eutek odor study -and I think:they've done a good study and I think
'they give us some ways perhaps to improve odors at the landfill - but
the fact remains that despite these recent improvements, a significant
proportion of citizens in West Covina -still consider the BKK landfill
to be a nuisance. They still feel there are odors and they are still
• complaining. And because of this - if it was up to me,individually,I
live a long way from the landfill, it's not a nuisance to me - but I
am going to go along with those great proportion of citizens who con-
sider it to be a nuisance and concur with Mayor Pro Tem Tice's recom-
mendation that we should move to open up the public hearings by the
Planning Commission.
Shearer: Councilman Bacon, do you have any comments you would like to make.
Bacon: Yes, Mr. Mayor. As most of you know', I am new to the Council,
however, I am not new to the problem of the BKK landfill. I was
appointed.to the Planning. Commission in West Covina back in about
1973 and the first thing we had before the'Planning Commission in 1973
was the revocation of the BKK permit because of complaints by the
citizens because of odors. We went through many hours of public
hearings.
To prepare for tonight's meeting, I went through and read all the
Minutes of those prior meetings, .reviewed everything that BKK promised
the citizens back in 1973, and all the things we did. Back in 1973,
the BKK Corporation said that this landfill would not be a health
hazard. And they said this landfill would not produce odors. I believe
that they have established that, the evidence is really overwhelming,
it is not presently a health hazard. All the people who have testi-
fied here before us - I was here at the meeting back in November.
Although I.wasn't on the. Council at that time,vI attended and listened
to all the testimony - I think it's clear that it's not a health
• hazard. But I also think it's abundantly clear that it creates an
odor.
Very interestingly, back in 1962 when BKK first asked for the
permit in this case, they made a promise right in the permit appli-
cation that.they would not produce odors - flat-out. In 1976 that
was amended. And now the wording of the amendment is that they will
not produce odors that constitute a nuisance - rather a different
thing between.the two. However, their testimony back in 1976 - their
attorney, everybody else who came in 1974 and 1976 - was that they
can operate an odor free landfill. .

People have said that the landfill does not belong in 1-lest Covina
and I. think everybody.in West Covina would like to have the landfill
not in West.Covina. However, I think it is also very clear that -our
society depends on having ability to dispose of the waste. We create
them. We have to do something with them. And the idea that we could
dispose of our waste by sending them up to Kettleman 400 miles away
I think shows that that is simply not a viable alternative.
The Palos Verdes Landfill closed the other day. They have to
track their waste now many miles more.. They upped their rates because
of that by eight dollars., That's about.a forty mile round trip that
their trucks have to make nowadays. 'If it has a four hundred mile
round trip, possibly.,,the fee for taking your trash away from you each
month will go up to $$O or: whatever the amount might be, if you have
that kind.of a trip. So -you have to have someplace and that someplace,
-unfortunately, because of the fact that we have put this landfill here,
is,. right for now, West Covina. But I, think the citizens who live in
the area are entitled to' -have' BKK live up, to their promise that is to
-have an odor free.landfill.
I believe the Eutek report indicates that we have a possibility
of achieving that result. I think the Eutek report shows that the.v
can take the -steps within,'a reasonable foreseeable future which
will reduce' most of the,odors..by some 97% of what they are now. That
would 'get us down.to.maybe two or maybe three to five days of,odors
per year. And I -'think" that that might be an acceptable level. I'm
not.sure. But at least we would get to a point where it is possible
for us to basically resol.ve this problem.,
Because,of these beliefs, I think that we should take the action
that has been suggested by Mayor Pro Tem Tice. I believe this matter
should no back to the. Planning Commission. And the Planning Commission
should look into how they should either revoke, suspend or modify the
permit so as to assure that we have an odor free operation, so far as.
BKK. If they can't provide us with an odor free operation, it should
'be closed.
Thank you, Councilman Bacon. Councilman Chappell, do you wish
to make'some comments.
I've been -on the Council some thirteen years. I was not one of
the councilmen that voted to put this landfill in existence, as has
been reported in the newspapar and I think that ought to be cleared
up at this time._
Through these thirteen years as a councilman, my.fellow council-
men and I have continually ,turned the screws on this landfill to hope-
fully clear up the odor problem. A little over three years ago, after
meetina with the management and ownership of BKK and.seeing the pro-
gress they were obtaining and the results that I felt they were giving,
I move? within far, far closer than many of you in the audience to
BKK. I was really under the impression that.this could be solved.
an(, so if y .family and I , bought a home very close to the landfill. So
I too are a person who is smelling that landfill from time to time.
e were - the City Council - we.were putting some handles on
the landfill until the disastrous Calabasas situation, until Palos
Verdes closed down, until several- other land sites and landfills
that could handle this refuse were closed, and 4dest Covina became
the fecal point of the whole County, part of Arizona,and part of.
Neva,a. I went to the City Attorney when this happened and asked
him to draw up an ordinance to ban Arizona,.Nevada, San Diego, Orange
County, San Bernardino County, from using our landfill. -This was
found to be illegal and we could.not do it.
We have really put the pressure on BKK - this Council has...tale
are certainly sympathetic`with'the.smell, and I far more sympathetic
to'it than many of you in this audience that it hasn't happened.

And I'm sorry for that,'becaa'se these are fine gentlemen that operate
• this landfill. Anything this Council has suggested, they have sent
their people allover the world. I know of Germany, Israel, and a few
other places they have sent their technical experts to try to figure
out a handle on the landfill. It hasn't happened, so I, too, am in a
position this evening to support the motion that Mayor Pro Tem Tice
has put on the floor and hopefully this will accomplish what all of
us are.looking for in this community.
Shearer: The statement that I would .like to deliver at this time is, in
essence, in concurrence with the comments of my colleagues.
In reviewing all the available data there appears to have been
progress made in reducing the level of odors from the landfill. How-
ever, the City continues to receive odor complaints from the residents
who believe the odors are a nuisance. I believe to continue the matter
as we have been would only result in lengthy rhetoric without direction.
It is my opinion that the City must begin the process to determine if
the Unclassified Use Permit should be revoked, suspended, or amended.
This will begin by the Council instructing staff and the Planning Com-
mission to conduct public hearings.with appropriate notices, pursuant
to the provisions of the Unclassified Use Permit No. 71, the City's
Municipal Code, as well as -applicable state law.
Just a brief expansion on the term "state law." It appears to
me that under the Environmental Quality Act, the closing of the land-
fill will require an EIR. The City can either recognize this.up front
• or we can bury our heads in the sand and wait. It is my desire to
bring this issue.to a head as soon as possible. Therefore, I believe
we should instruct the Planning Commission to make a determination as
to the necessity of an EIR. And if one is needed, to order its prep-
aration. If we proceed without this step, I am afraid it will ulti-
mately result in a much longer time frame. There's a lot at stake
here. We will be closely scrutinized by many actors as this play un-
folds. At any time the interest of anyone. who i-s best served,
we can find ourselves in court.
Recently the City closed Gemini Street, a street some may never. -
have heard of, many of you have. It's in an area where most of our
complaints come from and I.think many of you citizens are aware of the
attempt by the City Council to respond to an interest and desire on the
part of the citizens to improve the safety in' the area, and a wall was
constructed that cut off Gemini, Street. There were some in the com-
munity, not necessarily within the city limits of West Covina, who
disagreed with that decision, and since no EIR had been prepared, went
to court on that very issue. The court ordered us to start all over
again - do an EIR, conduct hearings, etc. Using this as an example
of what probably would happen, I believe we must face reality in face
of none.
It is my opinion that this matter must be pursued as expeditously
as possible, recognizing all applicable laws, as well as the addage
"haste makes waste." I would like to see any motion by the Council
tostate that.this is our policy. At this time I can only guess where
this will all really end, and I am keeping my guesses to myself. The
• only commitment I am making is to do my best to expedite the matter
and to continue to act in the best interest of all the citizens of
West Covina.
Are there any other comments on the part of any member of the
Council at this time..
Tice: Mr. .Mayor, I request that under the circumstances and the deci-
sions of this Council that the City Attorney read the resolution,
which has'been;prepared in draft form, in its entirety rather than
just a heading.

Shearer: Motion carries five in the affirmative. We trust that this action
will move ahead as we indicated. Where it will end,'I-think, is any-
one's guess at this point. We could speculate all night as'to what
the ultimate outcome will be. This is at least a positive step that
will move in a direction that will force the matter to be resolved
one way or the other.
�,Tennant: Just one quick comment: I see many people in the audience who
for the past one, two or three years have advocated that this step
be taken, and I think you should know that it's to a great extent due
to,your.efforts that this process has finally ended up going in your
favor, and that's called the democratic process in America.
Shearer: I want to say one thing and I sometimes.have been accused by my
.number one fan who isn't here this evening, my wife, for getting car-
ried away. But I want to make sure that no one in the audience - we
have. -had some positive reaction, that's nice to hear - those leaving
here tonight thinking that all of a sudden it's going to be closed.
We have in our country something called due process. And that
involves the EIR and a whole lot of other things that this City has
to follQt� to make sure -that -we don't, as I say, haste makes waste.
Sometimes this due process may get in the way of getting things done.
But.I.really think if we reflect on that, we really wouldn't want to
trade that for some sort.of a totalitarian system that allows a dicta-
tor'to make a snap decision and implement it right -a -way, because
sometimes those decisions involve one's head or some other factor.
All I'm saying is that don't expect a solution to this situation over-
night. I have no way of knowing how, long it will go. I am hoping
aid will do my best, and I'm sure,my colleagues agree, to see to it
that it;,moves along as expeditiously as possible.

PATRIOTISM WEEK
2) Letter from Southern California Association of Govern-
ments re an appointment to the Hazardous haste Policy
Advisory Committee.
Mayor Shearer recommended the Mayor be appointed
Appointments to Hazardous to the committee and Mike Miller be appointed the
Waste Policy Advisory Com. alternate member. Motion was seconded by Tice.
Mayor Shearer, Councilman Councilman Chappell volunteered to be the alternate
Chappell and Mike Miller and suggested Mike Miller attend each meeting with
the councilmember.
Motion by Chappell, seconded by Tice, and unani-
mously carried to approve the amendment to the first
motion and appoint Chappell as the alternate member.
Motion by Chappell, seconded by Bacon, and unani-
mously carried to appoint the Mayoras the appointee.
3) Mayor She reminded Council of their joint meeting
with the.Covina City Council scheduled for February
10 at 6:00 PM.
COUNCILMEN'S COMMENTS/REPORTS'; Councilman .Chappell commented on the Governor's nro-
posed reduction in bailout funds. Council concurred
to wait until more information is available before
taking any action.
APPROVAL OF DEMANDS Motion by Tice, seconded by Chappell to approve Demands
otaling $1_,596,371.75_as listed on UCB 83978 & 84224.
