01-12-1981 - Regular Meeting - Minutes• M I N U T E S REGULAR MEETING OF THE CITY COUNCIL CITY OF WEST COVINA January 12,1981 The regular meeting of the City Council of the City of West Covina, California, was called to order by Mayor Shearer at 7:30 PM in the City Hall Council Cham- bers,'1444 W. Garvey Avenue, West Covina. The Pledge of Allegiance was led by Councilman Tice and the invocation was given by Rev. Don Helsel of the Shepherd of the Valley Lutheran Church. ROLL CALL Present: Mayor Shearer, Mayor Pro Tem Tice, Councilman Tennant Absent: Councilman Chappell was absent due to illness. Councilman Bacon was out of -town. PRESENTATION Mayor Shearer presented Congressman Jim Lloyd a permaplaqued Resolution of Commendation. Jim Lloyd had been a councilman • for West Covina before being elected to Congress in 1974. Motion carried by,.ro,ll.call-vote: AYES: Tennant, Tice, Shearer NOES: None ABSENT: Bacon, Chappell Mayor Shearer stated that Item A-3 was a Summary of Minutes for the Human Resources Commission and as such would not be read verbatim,; however copies were available to the public upon request. He also mentioned that a public hearing scheduled before Council:this evening concerns the same topic that was considered before the Human Resouces Com- mission and there will be opportunity to address Council at that time. Mr. John Rushing, Presi dent . of `..the' :!lest Covi na " Ameri can Little League, addressed Council re the letter to Council listed under Written Communications. Mayor Shearer stated the recommendations for the two above items were "accept and file" for Item A-3 and "refer to staff" for Item A -lc. Motion by Tice, seconded by Tennant to approve staff's recommendation. Motion carried by roll call vote: AYES: Tennant, Tice, Shearer NOES: None ABSENT: Bacon, Chappell Mrs. Sally Bianco, 3220 Montelano, Hacienda Heights, addressed Council re her letter to Council seeking support in the renaming of Otterbein Park to Peter F. Schabarum Regional Park. The park is located at the south end of Azusa Avenue approximately four miles from West Covina. Questions were asked of Mrs. Bianco re the history of the naming of Otterbein Park. She stated that there is not much information re the history, but would leave some newspaper arti:.cles and a list of endorsers with the City Clerk for distribution to the councilmembers. Louis Gilbert, 428 Fernwood Street, suggested the park be renamed Jim Lloyd Park. Loren Wendt of the Southern California Gas Company addressed Council. on two items: 1) an update of the natural gas situation and 2) support of the COPE Program. Emma Fischbeck of Nest Covina Beautiful invited Council, staff, and residents of !-lest Covina to participate in the celebration of the City's 58th birthday. The party will be held at'the Elk's Lodge, Merced and Glendora Avenue, on February 6,�1981. There will be a buffet dinner and dancing until midnight. Bob Jackson; President of San Jose Little League, ex- pressed concern that the ballfields to be used by the little league at Shadow Oak Park have not been constructed yet. City Engineer Thomas stated that adjacent slopes are scheduled for repair work within the next couple of weeks, which must be completed before construction can begin on the ballfields. - 2 - CITY -COUNCIL MINUTES January 12, 1981 Page Three Mayor Shearer closed Oral Communications for the purpose of conducting the scheduled public hearings with the in- • tention of reopening Oral Communications afterwards. HEARINGS 1) PRECISE PLAN NO. 750 VARIANCE NO. 810 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT Precise Plan 750 Applicant: Larry Sade Variance No. 810 Location: Southwest corner of Azusa Avenue and Garvey Avenue South. (formerly Norma Avenue) Mayor Shearer explained that the matter had been called before the City Council for consideration by a member of the City Council. City Clerk Mooney verified the Affidavit of Pub- lication and Mailing. Ken Hunter presented the staff report. Public testimony Mr. Larry Sade, the applicant, spoke in favor and support of the Planning Commission findings and recom- mendations. Those findings, among others, were: a) wire each office for burglary alarms, b) leave the existing ivy hedge per the request of the adjacent property owners, and c) forego the installation of security gates. End of public testimony No one spoke in opposition. • Council discussion Mayor Pro Tem Tice expressed satisfaction: with the Planning Commission recommendations and felt that security gates could be­.install'ed at a future date, if need be. Councilman Tennant -was concerned with setting a precedent requiring all future office buildings'to install security gates. He felt it was unnecessary to begin such a requirement at this time. Mayor Shearer addressed the safety aspects of security gates noting that it may cost some money to install them, but in view of the..l ocati on .'of- the _ � - building i.n'a high crime area, the money would be well spent. Mr. George Strachan, Manager of the !lest Covina Chamber of.Commerce, spoke in support of the amendment. He stated that'the Chamber concurred'wi:th'the recommenda- tions before the Council. Emma Fischbeck, 1137 Auburn Street, asked if the ordinance covered toy balloons filled with helium. She suggested a size limitation be established for pre- cautionary measures. Council discussed the conditions and regulations outlined in the ordinance'. City Attorney presented for.introduction: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING CHAPTER 26, ARTICLE XI, SECTIONS 26- 609, 26-339, 26-304 AND 26-307 RELATING TO TETHERED BALLOONS AND PROMOTIONAL EVENTS (Amendment No. 163) Motion by Tennant, seconded by Tice, and unanimously carried to waive further reading of the ordinance. Motion by Tennant, seconded by Tice, and unanimously carried to introduce the ordinance. 3) 1981-82 COMMUNITY DEVELOPMENT PROGRAM ENVIRONMENTAL IMPACT REPORT City Clerk Mooney verified the Affidavit of Publication. Human Resources Director Gus Salazar presented the staff report, outlining the proposed projects. Mayor Shearer opened the hearing for public testi- mony stating that no conclusions would be drawn after- wards as Council would be receiving testimony at the next Council meeting as well. Sally Rader, 2824 Sunset Hill, a realtor in the area for nineteen years, spoke in onnosition to the senior citizens center. She said there is a housing shortage and would prefer to see the money go towards affordable housing procarams. Phyllis Wittenberg, speaking in behalf of the League of Women Voters, supported the proposed•housi:ng•develop- ment program and the concept of financial assistance to encourage housing rehabilitation. She submitted a copy of the LWV statement t'o:-the•-Ci•ty.Clerk. Thelma Schaffer, 904 E. Alwood Street, the'repre- sentati:ve fromlone of West Covina,':§ senior ci.tizens''• groups; spoke -in behalf•: of the construction of a senior citizens:* She stated that they are not opposed to the fair housing program at all and is sure compromises could be made.in regards to allocating the grant funds. Sally Graves, 2135 Aroma Drive, stated that she had not heard any of the testimony given at the Human. Resources Commission's public hearing re this matter reviewed aloud before Council. Playor Shearer stated they received a synopsis of that hearing and will be continuing to receive input through the next Council meeting. - 4 - CITY COUNCIL MINUTES January.12, 1981 Page Five PubTi`c Hearing re 1981-82 Community Development Program (font) • Betty Joyce Betty Joyce, 1509 Delhaven, spoke in favor of con- structing a senior citizens'center. She requested a clari- fication of the location and possession of the grant monies,,' at the present time. Salazar answered that the funds re- main with the Federal government until such time'as-the City actually requires it. Louis Gilbert Louis Gilbert, 428 Fernwood Street, stated: that nothing would be more tragic than to start an economy drive at the expense of the helpless in our City. The senior citizens should be provided with a center and have programs:to improve the quality of their lives. Royal Brown Royal Brown, 2153 Aroma Drive, presented an alternate to the whole HUD,grant:.program. He expressed displeasure for°grant-programs_�with strings attached and federal regu- lations,governing the City. He said if the City can't have any control, over the program, it should be totally abolished William Whisenhunt, Jr. William Whisenhunt, Kingscrest Drive, spoke in depth about the following five areas re HUD grant programs: 1) history of HUD, 2) objectives of HUD lost'by`local�:commun- ities of their autonomy'n.their dealings with HUD, 3) the threat of civil suits, by grant conditions and legal requirements, 4). block.grants, 5) solutions to meeting the requirements and/or to avoid using HUD funds. Mayor Shearer asked Whisenhunt if,,he could.assure`,the.: City!.Council:7that ::if"the Ci.ty,.tarnedrdown HUD funds, no one from the federal government could charge -West Covina for violations in some other area of discrimination. lJhisen- hunt said ,he could not give Shearer that assurance. Bill Crawford Bill Crawford, 15320 Mickenhill Drive, Hacienda Heights, spoke..as'a.'repr.esentative of the Lions Club. He reminded Council to plan,for the blind and other handicapped persons as well as the senior citizens. Oliver Riggins Oliver Riggins,.Rowland Avenue, asked how the figure:.. of $700,000.00 was arrived at., Salazar answered that it was based on a°HUDformula considering various factors, such as population, overcrowding. etc. Riggins stated. that .in.:•.his-,opiniorn asl.:a 'real -tor, in•= clusionary zoning is a.monster to manage and hopes the City would;s,tay away from such.'.an`idea. Mayor Shearer thanked the audience for their comments and participation and stated that the hearing would be con- tinued at the January 26th meeting. ORAL COMMUNICATIONS REOPENED • Louis Gilbert, 428 Fernwood Street, addressed Council Louis Gilbert re the possibility of implementing a Neighborhood Justice Center, funded by the. United States Department of Justice. Councilman Tennant noted that th'attype of_program was not affiliated with ,local governments, but was sponsored through: private citizens. Marsha Fuerst Marsha,,Fuerst, 2808--Cortez, addressed. -Council as the Executive Director of North-14est College of'Medical and:. Dental Assistants. She submitted a packet of information supporting the alle.nations made by Jerry Miller against the E.S.G.+l. Consortium. Consortium and suggested to Mrs. Fuerst that her information be submitted to the County Auditor. Tom Walsh, 2205 Peseo Tepic, addressed Council regarding iiieeting .concerning the reopening of Galster Park. He said at that'meeting a member of;the.Galster Foundation stated if the City of West -,Covina would submit a letter to the Galster Foundation, they would supply the reopening fees of $44,000 over a period of time. Walsh then asked if the City had forwarded that letter. Mr. !4alsh requested a copy of the Minutes of the Human Resources Commission held December 18, 1980. He aiso.._rien- mentioned:"that•:the. audience at the November Human Resources Commission meeting were not treated well by some of the commissioners. In answer to.his.question re Galster Park reopening funds, City Manager Fast stated that the request for a letter from the City was included in a total report -being prepared for'Counci'l's consideration in the near future. MAYOR'S REPORTS Mayor Shearer proclaimed the year of 1981 as the "75th Anniversary of Vons Grocery Company." Walter H. Laband Walter H. Laband retired from the Los Angeles County/ West .Covina Civic Center Authority and Mayor Shearer suggested Council to come to the next Council meeting with recommendations for his replacement. Mayor Pro Tem Ticesuggested Mr. John Mordoff. City Manager Fast was requested to advise Councilmen Bacon and Chappell to listen to the tape re the Community Develo- rent Hearing so that they can participate fully at the continued hearing next council meeting. COUNCILMEN'S COMMENTS/REPORTS Councilman Tennant requested staff to check with BKK Landfill lifespa'n estimate to check if the lifespan estimate of the landfill has changed due to the increase of dumping. He also mentioned that he had received a complaint from one of the Consortium'E contractors and that perhaps Council should take a more practical stance,in this matter. Fund raising activities Mayor Pro Tem Tice stated he would like to see.fund • raising activities be expanded to three sales a year, two days at a time. He requested a report by staff at the next Council meeting. CaFast stated this is an item that would need to go through the Planning Com- mission. He suggested a joint study meeting with the Plan- ning.Commission.
