COUNCIL CITY OF WEST COVINA,'CALIF November 10, 1980 The regular meeting of the City Council of the City of West Covina,.California, was called to order by Mayor Shearer at 7:30 PM in the City Hall Council Cham- bers, 1444 W. Garvey Avenue, West Covina. The Pledge of Allegiance was led by Councilman Bacon and the invocation was given by Father Ray Smith of St. Martha's Episcopal- Church. Motion by Chappell, seconded by Tice to approve all items listed on the Consent Calendar. Motion carried by roll call vote: AYES: Bacon,, Tennant, Chappell, Tice, Shearer NOES: -None ORAL COMMUNICATIONS -Mayor Shearer stated that Oral Communications would stop at 8:00 PM in order to conduct the scheduled public hearings and, if need be, would be re -opened at the conclusion of the hearings. Leslie Cooke Leslie Cooke, 2724 Miranda, stated in his opinion the City mailer re the BKK landfill was a waste of money and was written by a mentally ill person. Lol VeBergman -Lolli-eBergman, 426 Leaf Street, requested Council to compile the expenses involved in educating the citizens of West Covina re the landfill. She appreciated the effort expended by the Council.re the landfill and apologized for the citizens berating the Council and City staff. Louis Gilbert Louis Gilbert, Fernwood Street, submitted a resolution for Council's consideration. He stated the City. mai 1 er to be misleading.. Mayor Shearer - Mayor Shearer reminded the audience that Council has listened to citizens' comments at every meeting re BKK and.that the meeting of the.27th was reserved solely for the purpose of listening to the professionalrepresentatives from the .State and'County health agencies. Royal Brown Royal Brown';'., 2153 Aroma Drive, addressed Council re Item.,F-3 on the Agenda - Galster.Park. He submitted his cost.ana'lysis-for the opening and maintenance of Galster Park.' Mayor Shearer thanked him for his calculations and told'him that there will be meetings in the future re the actual costs and other recommendations re the park. Brown-: asked Council if a scrubber had been installed at the landfill"as scheduled. Bob Swartz. Bob Swartz, Vice President'of the Optimist Club, addressed Council're amending the Municipal Code to allow other organizations to sell fireworks in addition to the .veteran groups` now authorized. Mayor Shearer referred the matter to.staff for a report back at the next Council meeting. . HEARINGS 1) -SLOPE AREA VACATION - AZUSA AVENUE - PROTEST HEARING Location: Westerly of -Azusa Avenue, between Autumn Drive and Francisquito Avenue. City Engineer Harry Thomas presented the staff report. The City Clerk stated no written protests had been received. Council comments followed re the responsibility of maintaining the slope being shifted to the property owners, the condition of -the slope before development and after the proposed vacation, and the type.of vege- tation on the slope. Marci Lomeli introduced Alisa'Pang, an intern from - 4 - CITY COUNCIL MINUTES November 10, 1980 Page Five Cal Poly, Pomona, who designed the feasibility of de- leting proposed tennis courts and adding a senior citizens recreation facility. She explained the regu- lations and restrictions adhered to in designing the amended plan. Council asked questions re adequate parking with the amendment. Favoring Mayor Shearer opened the hearing for public input. Those speaking in favor of the amendment were: Thelma Shaffer ,Vice President of Senior Citizens, ::..:. Inc,spoke in behalf of the organization with comments favoring'the senior citizens facility. Louis Gilbert - asked if there would be areas for reading or watching movies. Mrs. Bergman favored the concept, but was fearful the City would be doing too little too late. She sug.gested a drive up area for loading and unloading cars and an adequate kitchen area. Derrick Oldbrey stated he was a tennis player and would hate to see tennis courts be deleted. He also questioned the fundin,q for the project. The staff report was presented by Planning Director Ramon Diaz. Council asked questions re island annexation and 'current'regulations re two and two and -a -half stories within the -City of Hest.Covina. Mayor -Shearer opened the hearing for public input. • Favoring Those speaking in favor were: Curt Evans of Sand Dollar Development stated he was available to answer questions. He mentioned that the corporation had met with the homeowners in the area and appreciated their concerns and recommendations. Lee Thomas, Pastor of South Hills baptist Church, stated his staff had worked with Sand Dollar and supports the project entirely. - 5 CITY COUNCIL MINUTES November 10, 1980 Page Six GENERAL PLAN AMENDMENT NO. 1980-2 (cont) Opposing Lee Oldham, 2401 Leanna Drive, inquired if the site was within 2000 feet of the BKK Landfill. He mentioned a law 'going into effect in January, 1981, restricting construc- tion within a certain distance,of toxic waste sites. He .•suggested the prospective buyers have a different Awareness 'Packet than the one he had received. Mayor Shearer stated that.the City would definitely word the packet.so as to avoid similiar problems that the other. packets'-invb.lve.d. Derrick Oldbrey, Aroma Drive, stated he lives within a quarter of a mile of the site and did not receive a Notice re the General Plan Amendment. He pleaded for more s open spaces,•not-more developments. Royal Brown, 2135 Aroma Drive, felt that a 200 unit condominium complex requires more than one swimming pool. Rebuttal Curt Evans stated that the development site is located more than a mile"fro!n'the landfill and as far as recreation goes, the development includes two swimming pools, sand volleyball courts, park course and recreational building. Evans.mentioned that notified all residents within 300 feet of the development site, as required by law. Public portion closed Mayor Shearer closed the public portion of the hearing. Betty Joyce, 1509 Delhaven, requested a:response to a question she had asked at a preceding -meeting re the Deed to the Galster Park property. Mayor Shearer answered that terms stated in the Deed have been met. Fred Landsberg,2424 Nogales, was dissatisfied with the City mailer and the Drier mailer re the BKK Landfill. He also stated that he had not received any call backs from the City in regard to any of his odor complaints. Mayor Shearer ;instructed staff to explain.the call-back procedure to Mr. Landsberg. Sally Graves, 2135 Aroma Drive, advocated an opening date of December 1, 1980, based on Royal Brown's proposal for Galster Park. Kathy Miller, 1304 Peppertree Circle, noted that three developments were stating'incorrect information re the proximity of the landfill. Mayor Shearer stated that the City does all it can to inform prospective buyers, but to get the salespeople to tell the truth or get correct infor- mation is like trying to enforce a car salesman to tell the truth. He said it is an.ongoing problem. Oliver Wiggins, member -of the Covina Valley Board of Realtors, spoke in depth of`the Code of Ethics that most realtors follow; He stated that there.are stringent re- quirements incumbent on realtors and anyrrealtor�in the` .- arealcan be brought before the Board if a complaint has been filed with the Board. Mayor Pro Tem Tice also stated that a citizen could direct a.complaint to the State Real Estate Commission. Richard Callahan, 2115 Aroma Drive, thanked the Council for the traffic signal at Azusa Avenue and Aroma Drive. Louis Gilbert, who had submitted a resolution earlier to Council, inquired what was Council going to do with his resolution. Mayor Shearer assured Gilbert that the council- men would review the resolution and any one of them could take further action if they so choose. City Attorney stated in.answer to a question by Council, that Council could amend the language in the Homeowners Awareness Packets if they found the language was not adequate. Shearer requested a copy of -all past and current Homeowners Awareness Packets be presented.to Council for their review and comments. Tice requested the City Attorney to comment on the law re building within 2000 feet of a landfill that will be going into effect in January, 1981. City Attorney responded that the 2000-foot Bill,': effective January 1, 1981, does not prevent the building or development of residential units within 2000 feet of the landfill. The Bill, which is quite lengthy, specifically requires that in the event that the finding is made by State Department of Health Services, after a-nurnber•of hearings, the l andf.i l l . Planning Commission Council directed staff to prepare a press release soliciting vacancy applications for the vacancy on the Planning Commission created by the appointment of Robert Bacon to the City Council. COUNCILMEN'S REPORTS/COMMENTS Councilman Tennant related a talk he had'wi'th the newly elected Congressman Dreier.
