REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA
October 13, 1980
The regular meeting of the City Council of the City of West Covina was called
to order by Mayor Pro Tem Shearer at 7:30 PM in the City Hall Council Chambers,
1444 W. Garvey Avenue, !lest Covina. The Pledge of Allegiance was led by
Councilman Tice and the invocation was given by Rev. Lawrence Cole, Community
Presbyterian Church.

RESIGNATION Mayor Pro Tem Shearer read a resignation letter submitted
by Mayor Browne effective October 13, 1980, and stated
council reorganization would be discussed later in the
meeting.
Motion by Tice, seconded by Chappell, and unanimously
carried to reluctently accept h"ayor Browne's resignation.
APPROVAL OF MINUTES Motion by Tice,.seconded by Tennant, and unanimously carried
to accept the Minutes of the regular meeting of September
22, 1980.
PRESENTATION Mayor Pro Tem presented Ray Miller a Certificate of Com-
mendation for his twenty-five years in the Fire Department.
He retired as a Captain.

Beatrice Uribe Beatrice Uribe, 1121 E. Greenville Drive, 4.C., spoke
of Mayor Browne's dedication as a Mayor and Councilman and
expressed appreciation for all that he had done for Nest
Covina.
Howard Pomerantz Howard Pomerantz, 2349 Lynn Court, W.C., read a letter
addressed to the City Council from Supervisor Baxter hard.

Lee Oldham, 2M4.Leanna.Drive, 14.C., presented a
petition calling for the revocation of the Unclassified
Use Permit issued to the B. K. K•. Landfill and, the closure
of the landfill. The petition was signed by 7,532 residents
throughout West Covina and several other areas.
Mayor Pro Tem Shearer stated that at.the:-�next regular
Council meeting of October 27, 1980, representatives from
various state and county agencies will be present to dis-
cuss problems of waste management with Council. Written
questions from the audience will be accepted.
Rev. Fred Landsberg, 2424 Nogales Street`,,W.C., read
his letter to Council urging the revocation of the UUP
'and closure of the landfill.
Bob Welemin, 184.0 Nelson Avenue, #67, 14.C., expressed
fear that the landfill would turn into a similar disaster
to the problems at Love Canal.
Al Labrador, 17350 E. Temple, Valinda, spoke of his
son who had contracted aplastic enemia, a disease caused
by chemical poisoning, and died in August, 1980. He stated
that the doctors did not know where the boy had come in
contact with the disease, but Mr. Labrador felt that the .
City of West Covina shoul d- hbt: take-'the:::'r.i•sk=- t-h'at'..th`e,
landfill might have been the cause.
Leslie Cooke, 272n.Miranda,,W.C., questioned the
validity of the USC Odor Mitigation Report with various
comments.
Betty Joyce, 1509 Delhaven., 1.4.C., spoke in reference
to the vacancy,on the City Council created by Nevin Browne's
resignation. She stated in her opinion she would be the
apppropriate appointee to the position. She noted Council's
past appointments.
Shearer corrected Joyce's account of the Council's past
appointments and then stated that ORAL COMMUNICATIONS would
close for the scheduled public hearing and then re -open. .

the General Partners, addressed Council. with.a rendering
�of the proposed plan. He stated he was available to
answer any questions.

Betty Joyce asked.if;'a traffic study had been performed.
r Planning Director Diaz stated a traffic study had been
conducted and found that the surrounding streets could
adequately handle the predicted increase in traffic flow.

Mayor Pro Tem Shearer called a recess at 8:50 PM.. Council
reconvened at 9:00 PM.
Paul Breit Paul Breit, 2701 Miranda St., W.C., president of
Hearthstone Homeowners.Association, expressed disappoint=
ment that the City Council was not immediately respondinq
to.the petition demanding the closure of the landfill.
Mayor Pro Tem Shearer Shearer stated the City Attorney would evaluate the
petition and report back to the City Council.
Louis Gilbert Louis Gilbert, Fer.nwood Street, W.C., felt the Council
was missing the.point to the whole issue of the BKK landfill.
He stated that the Council must listen to the voices in the
community and that they just do not want the BKK open any
longer.
Michael Lynhart Michael Lynhart, resident in the area of BKK. and a
chemical mixer,by trade, alleged the handling of chemicals
at the landfill:.i.s improper for economic reasons.

Report regarding sources of odors leading, to odor complaints.
Royal Brown, 2153 Aroma Drive, asked if the entrance.
to the Galster Park was permanently closed at Aroma Drive.
Shearer answered that every effort would be made to
re -open the park.
Tom Messman 3417 Peggy Court, was impressed with the
organization of the audience as'a whole. He spoke in sup-
port of the City Council's actions thusfar and felt the
•citi,zens should try harder to work with the Council instead
of against the.Council.
Fill Mandeville, past president of the Summerwood Home-
owners Association, feared the tankers driving the streets
-were a hazard to the neighborhoods.
1. Rose Ann Rainer, 3428 Bernadette,'pointed out,that
women and children are the ones subjected to the odors
all -the 'time, as most men leave in the morning for work.
Oliver Wiggins, Rowland Avenue, a realtor in the area
of West Covina, expressed concern that the community was
a dumping ground for all,of the western United States. He
felt Council should clarify their position.
Bonnie -Morse., 1901 Amar Road, suggested that the wastes
be taken to the desert for dumping.
Mike Hernandez, 2609.Mira Court,'referred to the phsical
effects of the odor problem.
Ray Rodriquez, 2104 Lorraine, inquired into the vacancy
created by the resignation of.Mayor Browne and asked about
recall procedures.
Carol Oldham, 2104 Leanna Drive, stated the.residents
don't -need an expert to tell them :the landfill stinks. She
suggested Council close the landfill until the next council
meeting.
John Kennedy, 450 E. Allgrove, Covina, felt the com-
munity is paying the price of`the BKK Corporation profits.
Dagmar Miller, 2422.Magdalena, related the story of
-her dog that had contacted a rare cancer disease caused
bv.toxic chemicals.
Bob Welemin, 1840 Nelson, Apt. 67, stated an air vent
in the middle of the sidewalk on the west side of Azusa
Avenue, between Francisquito and Autumn, i,s causing�� "
a hazard. The matter was.referred to.staff to investigate.

fill and the legal ramifications involved. He said that
this was a complex legal issue and the City Council does
not -have the authority to close the landfill without fol-
lowinq the due process of -law.,

the slope repairs were on public property.

project and authorized the City Engineer to call for
bids.
7) PROJECT PP-81024 - FRIENDSHIP PARK WOOD FENCE
PP-81024 Location: Friendship Park.
Friendship Park wood fence Council reviewed Engineer's Report. Council discussed
the possibility of other mediums for the fence. Motion
by Shearer, seconded by Chappell, and unanimously car-
ried to refer back to staff for evaluation of other
fence materials and contact with the community.

ORDINANCE NO. .1499 - AN ORDINANCE OF. THE CITY COUNCIL
OF THE CITY OF !%!EST COVINA, CALIFORNIA, AMENDING THE
14EST COVINA MUNICIPAL CODE BY AMENDING CHAPTER 26,
ARTICLE XI, SECTION.26-602 AND 26-604 RELATING TO
TEMPORARY USE PERMITS AND CHRISTMAS TREE SALES
(Amendment No. 164)
Motion by Tennant, seconded by Chappell, and unani-
mously carried io`waive further reading of the ordi-
nance. Motion by Tennant, seconded by Chappell to
adopt the ordinance. Motion carried by roll call vote:
AYES: Tennant, Tice, Chappell, Shearer

2) Motion by Chappell, seconded by Tice, and unanimously
carried to authorize the City Attorney to name the
City of !lest Covina as amicus curiae in behalf of the
City of Chula Vista in connection with pending liti-
gation regarding the definition of "family" in zoning
ordinances which effects all cities statewide.
Mayor Pro Tem Shearer called a recess at 9:55 PM in order
to convene the Redevelopment Agency meeting. Council
reconvened at 9:57 PM.
LEAGUE OF CALIFORNIA CITIES ANNUAL RESOLUTIONS
Council reviewed staff's report. Motion by Chappell,
seconded by Tice, and unanimously carried to approve
the annual resolutions as submitted by the League of
California Cities with the final determination of the
/vote by the designated 11,.r.epresentative of the City
to be made at the Annual League.
2) City Attorney presented:
RESOLUTION NO. 6208 - A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF !'WEST COVINA, CALIFORNIA,
AUTHORIZING AGREEMENTS BETWEEN THE POLICE DEPARTMENT
OF WEST COVINA AND THE STATE OF CALIFORNIA DEPARTMENT
OF CALIFORNIA HIGHWAY PATROL
Motion by Tice, seconded -by Tennant, and unanimously
carried to waive further reading of the resolution and
to adopt.

Motion by Chappell, seconded by Tennant, and unani-
mously carried to approve the following appointments:

4) The voting delegates to the League<of California
League Conference
Cities Annual Conference required a change due to
the resignation of Mayor Browne. Motion by Chappell,
seconded by Tice, and unanimously carried to approve
Shearer as the delegate and Tice as the alternate.
5) Mayor Pro Tom Shearer conducted the reorganization of
the Council for•the election of a Mayor and Mayor Pro
Tem.

he would be able to seek the mayorship in April, 1981,

Mayor Shearer stated that the vacancy created by'
the resignation of Mayor Browne requires Council to
either appoint a councilmember in thirty days or a
special --election will. automatically be held to fill
that position.

Mayor Shearer called a recess at 11:34 PM in order to
convene an Executive Session. Council reconvened at
12:35 PM.
Upon returning to the Council meeting the following motion
was made:
Motion by Chappell, seconded by Tice, and unanimously
carried to receive and file the letter from Barrett and
Associates dated September 29, 1980.. City Attorney was
instructed to respond in writing to Barrett and Associates
and to send a copy of his response to the City Council.
Motion by Chappell, seconded by Tice, and unanimously
carried to adjourn the meeting at 12:38 A'M to October
.24, 1980 at 6:00 PM in the City Hall Council Chambers.
