The regular meeting of the City Council was called to order by Mayor Krieger at 7:30 p.m., in the West Covina City Hall, The Pledge of Allegiance was led by Councilman Gillum. The invocation was given by the Reverend Ralph P.4oe. We at the same time this evening feel extremely fortunate to have with us a man who is now meeting with us for the first time as the newly appointed City Attorney for the City of West Covina, a man whose qualifications speak for him m Mr. Wakefield, on behalf of the City -we -welcome-you -and look --forward t-o a long and productive relationship,P. Menard, Planning Director, stated that the summary of action had been presented to the Council and if there were any questions he would be glad to answer same. No questions were asked, RATIFICATION OF INTERPRETAT.IO.N BY PLANNING. COMMISSION RE. PROPER ZONE CLASSIFICATION FOR A COMBINATION DRIVE-THROUGH/INTERIOR SEATING RESTAURANT Planning. Co 1-8-68 Page Two PLANNING COMMISSION - Continued the Council, Discussion in order. Councilman Gleckmano I was under the impression that the Planning Commission was doing some current study on this particular usage .in a service type zone where a Precise Plan would.have to be approved instead of putting in an actual C-zone. Mr. Menarda The staff is analyzing the intense zones of the Ordinance and one of the considerations will be the disposition of the drive-in and drive -through restaurant and its combination or standing as a separate entity, whichever it might be, I don't think staff, who has not made a recommendation to the Planning Commission yet, are of the opinion that these should be considered as part of the neighborhood commercial or C-1 use. It would be anticipated that they would probably be placed in a new zone which will have a service commercial type of nomenclature - more geared as we know strip commercial zones. Councilman Gleckmano Let me ask this - if this were not adopted by this Council, where would they be able to build a drive -through indoor seating restaurant? Mr. Menardo At the present time the zoning Ordinance specifies the drive-in or drive -through is an allowed use in the C-2 zone. There was a request: of the Planning •Commission for an interpretation almost a year ago that a drive -through restaurant be an allowed use in the C-1 zone. At that time the Planning Commission interpreted that a drive -through is more similar to a drive-in than a typical seating restaurant. Then this request for a combination drive -through seating came through about. 3 or 4 weeks ago. The Commission in so many respects reconfirmed their interpretation of about a year ago, that a drive -through whether it is a combination or not would be first allowed in the C-2 zone or in the general commercial zone. Councilman.Gleckman. Thank you. The reason I bring this to the Council's attention in my discussion with the Planning Director, is that. I feel we right noulare rezoning a lot of parcels in the City of West Covina and I have in mind Cameron and Glendora and I would hate to see a drive -through restaurant be able to be built on the interior side of Cameron and Glendora only because we allowed such usage in that type of zone. . In other words, my feeling, gentlemen, is to eliminate drive-in type restaurants to the extent of where it would have to come before the Council to be approved as far as location within our City. Mayor. Krieger- Of course that isn't precisely the issue we have tonight. We have a drive -through or drive-in as separate uses now permitted within the C-2 , The interpretation of the Planning Com- mission, just as I read it, makes it more stringent as far as the intense use that is re- quired for the combination with the interior seating facility. It: seems to me somebody •is trying to parlay an argument here to get it into a C-1 where it does have interior seat- ing. Until such time as the Planning Commission and City Council can direct its atten- tion to requiring an Unclassified Use Permit for this type of facility rather than a Permit Use within an intense zone, I think we ought to concur in the interpretation of the Planning Commission which at least makes it a more stringent requirement than the lack of an interpretation might suggest, Councilman. RECREATION AND PARKS COMMISSION � REVIEW ACTION OF DECEMBER 26„ 1967. Mayor Krieger: We have the summary of action. Are there any questions on the report of the 26th? Did any member of the Council attend that particular meeting? I; have a ques- tion regarding the tennis court light, Does any member of the Council have information on this ? Mr. Aiassa. We could follow -.up on this and give you a report Ciou.nci.lman.Gleckman. 1 didn't attend the meeting but I did seek out some of the information,, Without giving a full review of the action, I: can only say there was a lighting equipment: company that wanted to come in at certain costs and light up the tennis courts in the City of West. Covina, and they felt just as the report states - that they would not enter into a program as proposed at, the present, time because of the cost Mayor Kri.eg.er. Basically what was proposed was a commercial activity for• the tennis court and not a tennis court lighting • center as the minutes said Motion by Councilman.Gleckman, seconded by Councilman Gillum, and carried that the action of December 26, 1967, be received and filed. ------------- HUMAN RELATIONS COMMISSION REV EW MINUTES OF NOVEMBER. 30 1967. Motion by Counci.lman.Gleckman, seconded by Councilman Gillum, and carried, that Council receive and file PRESENTATION OF CERTIFICATES TO HUNTIN:GTON BEACH FREEWAY BLUE RIBBON COMMITTEE MEMBERS Mayor Krieger. This is another one of the Committees that, has com- pleted its assignment having to do with a very sensitive and complex subject. The City Council. has received the report of the Huntington Beach Freeway Blue Ribbon Committee and for the benefit of those members with us this evening, both the majority report and minority report have been submitted to the Planning Com- mission and they have in turn asked for a staff response both from the Planning Depart- ment and. Engineering Department. Ultimately the Planning Commission will forward its report to the City Council, at which time the City Council will have the responsibility of making a policy decision on this question„ Of the approximately nine Citizens Committees brought: into existence and completed its work, I don't know of any Committee that has undertaken a more difficult task. Councilman Gle.ckman has served. as Council liaison - would you like to comment? Councilman Gleckman. I was pleasantly surprised that the Committee came out with some uniformity on this particular question. Acting as liaison, I would say that I did nothing at. all to help them in anyway other than introduce them to the subject and from that point on the two co-chairmen did an excellent job, as did all the members. As you stated - Mr.. Mayor, it is a very difficult decision they have come to and for their benefit - 3 - C. C. 1-8-68 Page Four PRESENTATION OF CERTIFICATES - Continued and anybody else's wondering what will come of it m it will now go to the Planning Commission for public hearings and their recommendation. The majority report as`well as minority report. I want to thank everybody athat took part in this venture and at the same time I wish we could have had another 65,000 people involved, but they will get their opportunity. I thought the recommendations were very well presented and I think the thought behind those recommendations was of the most importance. I might just close in saying the "go" or "no go" decision that was made I am sure will receive a lot of attention in the future and it is just unfortunate that those making comments in the future regarding the "go" or "no go" will not have the benefit of the information and knowledge that these people.hav'eo I personally want to thank you for a job well done. Councilman Gillum: I think Councilman Gleckman summed it up quite well. It seems to be the topic of conversation in the City. I think it will be a topic of conversation in the City in future years and I think we can rely on the information obtained by the Committee and given to the City for use by this Council and future Councils. I would like to express my thanks also. The credit for the work done of course -goes to the entire Committee, but I think more importantly it is to the staff people that we worked with. In our report we -named them all individually and I am sure that is a matter of record and the subcommittee chairmen in particular - Larry Smith, Pat Kelly, Pete Whitney and their co-chairmen Bob Corsaro, John Domenowske, Jim Hamilton and Sid Braucher. They put in the time and effort. The individual could develop and expand as per that Precise Plano_ When he became aware of this at the Planning Commission meeting he stated this satisfied him aZ long as he could develop his property as he had indicated sometime in the paste and was in favor of the zoning, Councilman Gillum. I Zh7ink the Transportation Committee under Mr. Qasler did a magnificent Job in exploring a number of areas of interest to the community and I am particularly pleased with their efforts having to do with the retention of the Greyhound Terminal here in West Covina, as the results of that Committee. -The Valley Development Committee under Mr. Taylor,- I think you saw an- instanc-e...o.f the- activity on -the. _I-P field here on the f ir-st --heLaring.1-tem-that we. -had_,._t-his__ eve-ning.,_ and. thIa is_ :cen:B_Ist:ent with the recommendation of that Valley 'Development Committee having to do -with_ -the _-expLans-io-n -of this particular type of use within the community. I would hope that under Staff Activities that the staff is successful in this Bowling Congress event having to do with the East San Gabriel Valley as Headquarters. I can't think of a more worth- while activity for the Chamber to be engaged in and for the City of West Covina -to.-ho-st. -as_...._tar._as. ..a -sporting-,actIvity., is c.nna-arned. I was -c-ertainly pleased to read about the efforts of the Chamber in that direction and I hope it will bear fruit. • These comments that I make are not.int.e.nded to be all inclusive as to the report, bit Icertainly think they are illustrative of the type of work that I find most commendable on the part of the Chamber. I may be wrong in saying this but I .d.onPt think the Ordinance Section 6310 reads the way he interpreter but rather the •way we interpret. If it did read the way Dr. Prows points out I would say that anybody living in the City of West Covina belonging to any organization that could prove it was nonprofit, could sell fireworks and we would have the biggest display of fireworks for sale of any community in the United States, I think primarily Section 6310 was set up to avadA__this,., I ...sine ..wish._..Dro .Prows_..wa.s __here-._this__..evening._-this .dis- cuss this, Is 'there a representative here? You said exactly what I thought I was saying with the exception that I am not concerned with what we gave him in July... Larri concerned with what the job should call for and now where we are in relationship to what is being paid and I am not comparing it in anyway, shape or form, as to what we paid him last January or the raise he got last July, because by your own statements if we talk about what happened last January then we have to talk about the year and nine months he didn't get a raise. As far as I am concerned I am ready to discuss the City Manager's salary on the basis of the City Manager's job at this time and not taking into consideration what the City Council did last January. Councilman Nichols- I think that is a valid point,, but perhaps even more of my thinking related to the fact that I have a comparison in front of me and where would a raise place our City Manager in that comparison as compared to the raise of last July. Councilman Gillum- I am inclined to agree with both Councilman Nichols and Councilman Gleckman. If we want to retain the type of City Manager we have and the know- ledge and ability he has, I think we have to be competitive with the surrounding communities. I know some of these communities listed here have a different make-up than the City of West Covina, but I don't believe any of them have had more difficult probleni.s__Ahan we have faced in the past year and I think we should be able to reward - if that is the term used - the efforts of the past year and also be able to be competitive with our surrounding communities. As Mr. Gleckman r4tated, I am not really concerned with the raise given last year. After going back over the past period and seeing that it has been kind of hit or miss over the past years, I think we should establish his salary consideration along with the Department Heads at the first of each year and it can only be judged on what we feel the man himself has given to the City, not on percentage or cost of living, but what his worth to the City would actually. be. Mayor Krieger- I would like to comment on this question of timing. I agree with you in terms of the appropriativeness of the City Manager's salary being considered at the same time as the Department Head salaries.. There is no way legally that this Council can bind future councils by the timing of this matter. But it would certainly seem to me there is every reason to consider it at the same time and no reason not to consider at the same time the other Department Head salaries are being considered as recommended by the City Manager. This has been done for one reason or another and I don't think it is important enough to go back or forth with an on or off again policy. I would hope and with the thought in mind tonight that any adjustments that might be made in the City Manager's salary •tonight is for a 12 month period and is not an item that comes up again on the anniversary date in July, 1968, but is now taken up by this Council in order to bring it back in timing, at least, with the Department Head salaries considered in January of each year.. At budget time there is so many items to be considered and I think it: is a much more appropriate time to study the question with deliberation at the same time and same period of the year along with the Department Heads - at the beginning of the year. So in looking at the salary adjustment I don't think it is too appropriate that we would look at July 1967 to July 1968 but I think. it is highly appropriate that we would look at the period of January 1968 to January 1969 C o C. 1-8-68 Page Seventeen CITY MANAGER'S SALARY - Continued .arid hopefully, if you can establish a precedent by one instance, to have this matter considered in January of each year at the more appropriate time. •We would need a motion in the term of the figure, and this of course would have to be adopted by Resolution establishing the City Manager's salary, Councilman Nichols: In reflecting on the midrange salaries in comparative cities and where the City Manager's salary is placed at the present time, and in trying to determine what one might like to do with what one realistically can do, and accomplish from my own point of view, I have come up with three figures as a possible range just for discussion purposes. I computed 4% and it came out td $80.QO.a month increase- $960 a year; and I computed 4.5% which was roughly $9.0,00 a month and came out to approximately $1080. a year; and I computed 6% which came out at $12'0. a month or $1400. a year. Councilman Gleckman: What are you using for the base? Councilman Nichols: $2000 per month. Councilman Gleckman: I tried to do it on a similar basis but in comparison - to what we have scheduled and that is to cities with a larger population paying more money versus the cities with lower population and paying more money and there are some in both cases and I tried to make it fall somewhere between the two so that we weren't taking the salary range out of range, but at the same time taking it closer to the average. I don't know what $ 2130 . figures out percentagewise Councilman Gillum: It would be a little better than 6%. Councilman Gleckman: I would say then somewhere between the 5 and 5-1/2%. Councilman. Gillum: 5-1/2% figures out to $ 2110 . per month Mayor Krieger: I took the top of the range $2508. and the bottom of the range $1716 . The City Manager is now on the lower side of the middle range and I took the difference between the two and divided by two and I came up with $396. and adding $ 396. to the $1716 comes out to $ 2112 which is extremely close to.the average figure we have in.the report. Councilman Gleckman: I would like to see it go to $2115<_. C. 1-8-68 Page Nineteen MAYOR'S REPORTS - CIGARETTE TAX - Continued Mayor Krieger- I wish Dr. Snyder were present to benefit us with his comments on this next item that I want to dis- cuss with the Council, the Cigarette Tax. I am • sure you all received a copy of the bulletin by the League dated December 9, 1967. I think a very unfortunate thing is beginning to develop among the Cities in this State, some are considering the hiring of a lobbyist and thereby circumventing what the League of California Cities has been attempting to do and that is the cities working together. The bulletin from Mr. Carpenter - indicates that we discuss the proposed formula and indicate to our legislators...at an early date whether this combined , formula which the League has now worked out in attempting to solve the impasse between the "have" and "have nots" has any merit to it. In looking at the City of West Covina's position - first of all _lot me state in San Francisco I took the position officially as faras the City was concerned, that there was an inequity in the legislative bill and that it was unfortunate but probably more by accident than design and the City of West Covina realized this and although we have a high sales tax base and are not really being hurt under this, that there were a number of communities being hurt and we felt unfairly, to the extreme benefit of certain other communities in the State, that could not be so enhanced. Under the new formula that the League is proposing, which I think personally has merit to it, again the City of West Covina is not going to be affected. too drastically. The formula under the present law is supposed to give the City $282, 000. Under the proposed formula it would go up to $288, 671. I don't know whether the rest of the Council has had the chance to investigate or study this thing, but I would hope ultimately that we could take a position in the City to favor the proposed change to reduce the . inequity so as to apply it on the basis of one-half on the sales and one-half on population basis, and so inform our State Legislators and more important I think water down the unilateral effort of certain Cities; which I don't understand at all in this regard. Councilman Nichols- Would you ask for Council action tonight or wait until Councilman Snyder is back? Mayor Krieger- It is immaterial to me. If the Council is prepared to move on this I would like to see our State Senators and our three Assemblymen advised that this Council is taking a position. So moved by Councilman Gleckman, seconded by Councilman Gillum. MayorKrieger'-; Motion has been made and seconded that both Senators and representatives be advised that the City of West Covina supports the compromise position of the League of California Cities as to the apportionment of the cigarette tax as stated in their bulletin of December 9, 1967. Councilman. Gillum- This would be one of the first steps to destroy • the League, if they start off on these individual efforts in tryf ng to defeat something. I think the League has done a great service to all Cities and has done excellent in their efforts and I would hope that the Cities would realize that this is the only way to get something done - is in a group. Mayor Krieger: The Planning Commission on their report had two items, Mr. Menard, Where they are requesting the Planning and Engineering staff to formulate letters having to do with Rapid Transit Line under phase A for West Covina. I assume this will come back on the second meeting of the Planning Commission this month ? Mr. Menard: This is correct. The normal procedure that follows ,in our communication to the Council would be`'a letter drafted by myself and verified by the Chairman for submittal to Council on January 22nd. • Mayor Krieger: I think this is an area that is going to deserve Council discussion when it comes up from the Planning Commission. It is of extreme importance. And being the largest City affected, I think we are ultimately going to take the leadership on it. Mayor Krieger: We have a communication here from the Francisquito-Azusa Neighbors Association that came in today. Mrs. Preston will you be sure this gets on our next agenda. Also a communication received today from the Five Lanterns Restaurant having to do with a license for their Chinese Firer-ra.ckers on the 25 - 26 - 27 of January. This was in my council mail and it has been approved in past years. If we hold it to the next regular meeting it would not be too late to give approval but I don't know as it would be enough time for them to buy their ffrecrackers . Motion by Councilman. Councilman Gleckman: May I also add, if the second will accept it, "and that would apply to all Chinese Restaurants in the City of West Covina that would be so desirous to celebrate the Chinese New Year. PROCLAMATION YOUTH HOCKEY WEEK January 20 - 28, 1968 Mayor Krieger- Are there any objections to this proclamation? Hearing none, it is so proclaimed. COUNCIL COMMITTEE REPORTS Councilman Nichols: Can the City Manager give me more information on our "dog" problem? Councilman Gleckman- I can report on that. The man was at my house Saturday to pick up a license fee. Mr. Aiassa-.... I am shooting for the first meeting in February - Mrs . Coleman is ill. Councilman. Gillum: May I add one thing, Mr. Mayor? The might after we discussed this, unfortunately one of my children were bitten by a dog Councilman. Nichols - Councilman. Gillum: Councilman Nichols: Councilman Gillum: Councilman Nichols: A stray? No, we know who it belongs to. Running loose? Yes. Not on a leash? Councilman. Gillum: No - I just want to state that is three times in the past year that my children have been bitten by dogs in the City. Mayor Krieger: Mr. Aiassa, is there any matter of pressing City business that would cause this council to sit in session next Monday night? Mr. Aiassa: No, I have nothing for that meeting. Mr. Mayor - we do have Mr. Ben Bateman, the new President of the West Covina City Employees' Association with us tonight.
