.MINUTES OF THE REGULAR MEETING OF THE. CITY COUNCIL
CITY OF WEST 'COVINA, . CALIFORNIA
DECEMBER 11, 1967.
The regular meeting of the City Council was called to order by Mayor Krieger at
7- 32 P.M. , in theWest- Covina City Hall. The Pledge of Allegiance was 'led by
Councilman Snyder. The invocation was given by -the Reverend John .L. Reid, Jr. ,
of Community 'Presbyterian Church.

November 13, 1967 - Approved as corrected.
Councilman Gillum- On .Page 36, second paragraph, 9th.line -
the word "profession" should be "professional.
Councilman Nichols: On Page,37, second paragraph from the bottom,
the word "standard" should read "one person who
stands to profit. "
Mayor Krieger- Page 5, last paragraph the word"read" should be
"rule.. " On Page 26 Mr.. Ebiner's name is mis-
spelled. This correction should be made throughout
the minutes correct spelling "Ebiner. " On Page 34, . statement by proponent
Mr. Garvey, paragraph 3, middle of the paragraph the word "eccentric" should be
°concentric. " On -Page 43,;fifth line -from the top "our own objectivity" should read
"with utmost objectivity. And further down the page, so my ultimate vote will not

47, . Councilman Nichols' motion having to do with the encroachment permit, my

REVIEW ACTION OF DECEMBER 6 1967.
Mr. Menard, Planning Director, called the Council.'s attention to the new format
in the material presented to them and stated if they had any questions pertaining
to the format he would be happy to answer them. Mr.. Menard, then reviewed
orally the action of the Planning Commission on ,December;6, 1967.
Councilman Nichols; I would like to commend the staff for turning to
this format. I assume it is a staff procedure. .It
is very helpful.
Councilman. Gillum- On this Variance No. 614 denied by the Planning
Commission, also the-Precise`Plan. .I was in
attendance at the Planning Commission and .I am
sure in their thinking because of the restriction on parking around this area - was
the reason they denied the request for Variance, but I believe this type of
establishment would be an asset to that area of our: City and I don't know whether
the applicant is going to appeal. .I can tell you gentlemen, honestly, when he
. left he had some very strong feelings towards this .City and felt he could develop
it some other place. .I have seen these restaurants throughout the country and I
think it would add a lot and I would like the Council to give consideration to
reviewing the Variance request and the Precise Plan, because 'I think we need these
type of things especially in that area.
.Mayor Krieger. This would require a majority vote by the Council,
is that intended to be a motion?
Councilman Gillum. Yes it is.

Mayor Krieger: It has been moved and seconded to call Variance
• 'No. 614 and Precise'Plan No. 533 to the.Council
for a -Public Hearing. _Further discussion on the
motion.?
Councilman Snyder: Is there a feeling that all the causes for a
Variance were not shown?
Councilman Gillum: The Planning Director had written a report. showing
we had set a precedent in areas very close to it as
far as parking - there were many factors involved.
As I said .I am not. questioning the judgment of the Planning Commission but I do
feel it would be to our benefit to hear. what these people have to offer to the City
of West Covina.
Mayor Krieger: Two questions. Mr. Menard, what was the staff
recommendation?
Mr. -Menard, Planning. Director: The staff recommended the approval
of the'Variance on the off street park-
ing.
• Mayor Krieger: Was that the only requested
variance ® off street parking?
Mr. Menar.d, :Planning Director: Yes. The applicant had requested a
4 to 1 ratio. In other words one
parking. space for each 4 seats in
lieu of the West Covina ordinance requirements for one parking space for each
three permanent seats.

have one minor area of concern and that is if the Council takes the initiative to
call the matter up, I hope it does not imply to the applicant, who may not have
indicated his own wishes on the rra tter at this time, and: hbwill not_,be
-inordinately disappointed if the Council should reach the same conclusion as the
Planning Commission.

Mayor Krieger: Any discussion or comments on this matter?
Councilman Nichols: I feel this is a matter of primary interest to
the City of Lakewood and its immediate
• environment; and I wouldn't feel it would be
the function of our Council to take any :particular supportive role, so I would
offer the motion to receive and file the communication.

Mayor Krieger- I would make this comment, .I trust that
them purpose in sending it to us might be to
stimulate our thinking as the corridor coming
east affects -us which is presently projected to terminate at the:City of El Monte.

Councilman .Gillum- I think this is coming very rapidly to a con-
clusion and I think the City of West Covina
should involve itself. I don't know whether
. it is through this type of method here but I feel we should give serious considera-
tion. to Rapid Transit, .I think we owe it to the City and the citizens to make every
effort to see if it is possible to extend this. Rapid Transit System to terminate at
the hills behind us, where it actually belongs instead of the City of E1 Monte
Councilman, -Snyder. I might say that the=LoAo .Chapter of the
League of California Cities is doing a study on
this subject and it will come out with some
recommendations
Mayor Krieger: How soon do you anticipate that ?
Councilman Snyder- It will be very soon. . You could hold off
until we got their recommendation
Councilman Gillum: Actually I am not sold on the Rapid Transit
program,. but I think we should study it

Councilman Snyder: I don't know the extent of their study but
• particularly the financing and the corridor.
Mayor Krieger- I am not opposing the motion but I am simply
.-suggesting to the Council that this is
something- I would like to see the Council
keep before us, as it may affect us as the situation of the corridor becomes
more firm.
Councilman Nichols: As the council representative to the 'Rapi:d
Transit I have attempted to digest a
considerable amount of material, -I have not
attempted however to bring the Council into any active consideration of this area
in that all the proposals and discussions at this stage are largely preliminary
in nature. .Even,the matter of proposed alignment is going to be subject to legal
interpretation before it can even .become a firm proposal. .I would think, however,
that when the time comes that decisions are immediately facing the community,
that this Council will indeed have the responsibility. for looking into this entire
matter of Rapid Transit and the method of taxation, and making some sort of
recommendation and at that time 'I would have some views to present to the
Council which I believe would be more suitable during a special study session
covering this general matter.
,.Councilman Gleckman: I wonder if Councilman ..Nichols is aware of
the meeting Thursday. for this particular
corridor in. Ontario?
Councilman Nichols: I co-chaired the one just previous to the
Ontario meeting, here in this Chamber, but
I am not going to be attending that meeting.
I have attended a number of them and found them repetitive in nature. So far,
in my judgment, they have been apparent efforts to sell segments of each
community on the concept of supporting the Rapid Transit specific proposals
rather than the generation of additional specific information because they have
not been able yet to move into specifics.

Councilman Gleckman. The only reason I brought it up I happen to
be on their roles as a representative from this
Council and since you don't feel that it is
important and I can't make the meeting next Thursday - maybe we could send staff.
Councilman Nichols. For two years. I served as the- Council
representative to Rapid Transit and I have not
found it so meritorious.
Mayor Krieger. The motion is on the acceptance and filing of
the letter and resolution. .Further discussion?
Any objections? There being no objections,
so ordered.
Is there any desire to pursue this representa-
tion at the next corridor meeting?
Councilman Gleckman,. They made a special effort and a special
memorandum to this City, as,I suppose they
did to other cities, about the importance of
this meeting. Thursday in Ontario and they made personal contact with the City
Manager's office and I will be unable to attend that meeting because of another
commitment.
Mayor Krieger.
Is there a motion to send staff -representation?

that staff representation be sent to the Rapid Transit meeting in Ontario on
Thursday.

ORDINANCE ® AMENDING CODE RELATING TO COMPENSA-
TION OF MEMBERS OF PLANNING COMMISSION.
Mr. Terzian,. City Attorney. It is the recommendation of our office that this
Ordinance not be adopted. Since the
introduction of the Ordinance we have done
some further. research and thinking about it and we find that there is a State Law
on this subject that would seem to provide ;chat ithe-,authority of- the ;City to pay any

compensation at all to the Planning, Commission is related to the number of meetings
attended. Frankly, the law is notquite clear but we would prefer that the City not
take the chance and make the recommendation on the month to month basis.
Mayor Krieger. Do you want the opportunity to refine your
thinking on this and hold the matter over to a
subsequent meeting. or merely table the
matter?
Mr-Terzian, City.Attorney. We would prefer to have the matter tabled.
Mayor Krieger. :Does this pertain to the recommendation for
the Recreation & Park -Commission and the
Personnel Board?
Mr. Terzian, City Attorney. I don't know for sure but I would suspect
that they were all enacted to have compensate
tion based on a per meeting basis simply to
be consistent at the time those Ordinances were enacted. There is no State -:Law
that would affect Recreation & Park -Commission or the Personnel Board.

that this item be tabled.
Councilman Gillum. I have a questbn. Mr. Terzian, if we were
to enact this Ordinance and after a period of
time it was proven to be not within our rights
to do so, what would be the result?
Mr. Terzian. Itwould be a question of improper expenditure
of public funds, which is one of the reasons
we do not like taking the chance.
Councilman Gleckman. As much as I don't agree with the interpreta-
t.ion, not that it is not- correct, _I would have
to go along with the recommendation by the
City, Attorney . . Therefore, ; I would have to vote for the motion.

them $ 25.. per meeting and not more than ..$ 50 .
per month.
Councilman Snyder: But the intent was where they missed a
regular meeting and attended any adjourned
meetings?
Mayor Krieger. . Doesn't the 'Ordinance say regular adjourned

`STREET IMPROVEMENTS Garvey Avenue.
• :Mrs -Preston, City Clerk-. The bids for City,Project SP-68018 were opened
by the City, Clerk on Wednesday, December 6,
1967. A total of four bids were received and
reviewed. -Al]. bids were checked for errors and were determined to be valid bid
proposals. This project calls for the removal of the drainage structures on the
east side of the street, installation of curb, gutter, -sidewalk, pavement and a
driveway approach. The.dra�ins are no longer needed because of the recently
constructed Orange Avenue storm drai.n.. A total of four bids were received.

agreement with the said .Crowell and Larson for the work.

limp sum bid of Crowell and Larson of Baldwin Park as presented at the bid opening
of. December 6, 1967, in the amount of.$3,.843.41 for Project SPm68018, be
accepted, and that the Mayor and .City Clerk be authorized to execute an agreement
with the said Crowell and Larson for the work.. Motion carried on roll call vote as

Mayor. Krieger,- Madam City. Clerk have you received any
written protests or objections against the
improvement as projected or the proceedings?
Mrs. Preston, City Clerk, I have received one protest that came in this
morning. I call your attention that in the
notice it says "appeals must be filed in
writing prior to December 11, .1967.." This was received today.
-Mayor Krieger, This is a written objection to the quality of
the work ?
Mrs. Preston,, City .Clerk: Yes and the assessment figure.
Mr..Terzian, . City Attorney, The Streets and Highways Code, . Section
5366 requires that the objection be received
prior to the date fixed for the hearing.
• Mayor Krieger, Based upon the ruling of the Assistant City
Attorney, the chair would have to rule the
written protest is out of order being not
timely filed
I don't: see anything on the procedural list
that has been handed to me with regard to the reception of oral protests. .Isn`t
this part of the -procedure?
Mr..Terzian, City Attorney, I don't know of any, Mr. Mayor. The Code
says ® "shall prior to the day fixed for the
gearing on the assessment appeal to the
legislative body be briefly stated in writing "Any objection, appeal or
protest not made at the time and in the manner hereinabove provided shall be
deemed to be waived voluntarily by any person whomight have made such a
protest or objection.,"
Mayor Krieger, So we can only receive in writing -prior to
the date of this hearing?
Mr. Tertian, City. Attorney. I That is my understanding, Mr. Mayor.
.Mayor Krieger, With that statement on the record the chair
will entertain a motion to close the protest

questions ,prior to closing the hearing of any
of the people involved?

.Further discussion on the motion to close the hearing? Any objections to closing
the h.eari.ng? There being no objections, the hearing will be closed.
Now we have the report having to do with this
matter dated December 7, 19 67 , and we have a resolution proposed for adoption
confirming the report of the Superintendent of Streets relative to this assessment:
for work donee are there questions on the report or the improvement.?
Councilman Nichols- The property owners that are listed on the
report would be precisely accurate as of what
date ?
Patrick Rossetti We have been hired by the- City to work with
L. J. Thompson,. Inc. the staff to prepare the reports and spread the
Assessment Engineers assessments and make up the assessment
'Manhattan Beach. California rolls.; for this particular project.
• .In answer, to your question, . Councilman
Nichols, the names and addresses as
stipulated in the law, are those shown in the last County Assessment roll, in the
County of Los Angeles. I believe the date was as of March ,15th.
Councilman Nichols.- -What would be the implication, if any
where a property changed ownership
between the tl me the assessment roll was
created and the time this assessment was established?
Mr. Rossetti- That is a legal question, but if you want my
opinion I will give it. Mr. Thompson
always states that we don't assess property
owners, we assess land, and the person who happens to be moving from that
parcel of land at the time is responsible fa� the assessment. ..We receive the
first names and addresses and then check them out a second time before sending
them out, which was done about a month ago. .As far as we know the names and
addresses are as correct as we can get from any assessment roll that 'the County
has. If property changes hands during the interim period we have no knowledge
of that unless the City Clerk or some members of the staff are notified by the
property owners as to who he is selling it to. If there are two or three changes
then we are not aware of that.
.Councilman Nichols. One final question. This is a matter that
• came up earlier on the weed abatement
program - the problem of one owner not
receiving the benefit of an assessment because of a change of property. I know
of one incident here where at the time the district was established, subsequent
to the establishment of the assessment rolls,, a parcel of land changed owners
and I wondered if there was anyway at all of that new owner having any-, way of
knowing at: the time this assessment district was being created that it was in fact
being created.
Mr. . Rossetti. I believe that if he owned the property after

we went through the first proceeding and we posted the area , then I don't believe
• he would have any knowledge of it unless he was put on notice by the owner or in

506 Gretta Avenue minutes of the Planning Commission.
West Covina, In regard to request No. 1 on area -
actually this could fall under a slight
modification as set forth by the code of
the City of West Covina, however, I was requested to incorporate it in my
variance request by the Planning Department.
Request No. 2 refers to depth. A
similar variance has been given in the past under Variance No. 581 and 339. This
parcel that has been declared surplus by the Flood Control comprises 5731 sq. ft.
to be exacta At the present time this parcel is a definite nuisance, as far as -I am
concerned. The maintenance is very sporadic - the maintenance crews get out there
about twice a year after the weeds are about 4 ° high and the rest of the time the weeds
are just there and it is quite a place for vermin. My lot is in excess of 10, 500 sq. ft.
in an area zoned No. 2 where the ideal lot is stipulated at 9500 sq. ft. However,
directly to the south on Service in the same district area 2 there are 247 lots in that
subdivision which are under 8000 sq. ft. Inasmuch, as I have shown that this is a
detriment as far as I am concerned .and I have shown that similar variances have
been given in the past and I believe this would be a definite benefit as far as the
City is concerned it would return excess property to the tax rolls and as far as the
County it would also return excess property to tax rolls and eliminate what little
maintenance they do. This is on a short street at the end of a cul de sac, it will
in no way affect the well being of the area or the general neighborhood.
IN OPPOSITION
Bernard Golub It seems to me that the criteria of
518 Gaybar representative government is to consider.
West Covina the welfare of the citizens who elected
them and the approval of this variance
in the prescribed, zoning area, I feel and some of my .friends feel, .is in direct
opposition to the welfare and well being of the citizens of West -Covina and the
County of Los Angeles. There are four points I would like to make, they are
aesthetic, moral, legal and financial. In this particular enclave of some 26 homes
the average price is about $23, 000 put up some ten years ago. To duplicate a
similar home in this area of equal quality is far from possible today and to
fragment these areas into smaller parts would detract from the general value of the
homes already in there. Most of the plots as they stand now are below the 9450
sq. ft. as originally prescribed. I know my particular lot runs just under 9000 sq.
ft. This area .- if_ fragmented - would Make the entire area substandard regardless
of what areas would have been set up before. Some may even be down to 7000 sq.
ft. We feel that this particular area should be maintained and have support from
the smaller areas in improving their homes. In the canvass of the area of some

. 26 homes there were 14 against, 9 not contacted, 1 not interested and another was
moving and of course, the petitioner desired to have the variance carried through.
At this point we come to the moral point - why should an area be developed with
the knowledge that there is a sketch plan in the making at this present time that
may take over this area for a park, or possible highway use This is in the sketch
plan of August, 1967. So who would want to buy a piece of property that has been
developed with the thought that maybe someone will come in shortly and say you
have to get out. We also feel L why didn°t the original developer be allowed this
particular variance - he could have put'in another 4 to 6 homes in this area and
developed it properly and uniformly instead of putting a sore thumb sticking out in
Walnut Creek. And what is the sense to spend money for planning .and then move in
a diametrically opposite direction; especially in the light of the planning that has
been going on.. There are a lot of open areas within the City of West Covina
that are crying for development and why should we take some 6000 sq..ft. to push
into the Creek practically and still bring nothing to the City of West Covina.
And what is to be gained or lost -in this particular procedure.. This particular area
if developed would bring to the City of West Covina approximately,$40..00 per
year and should the general sketch plan come into effect and this property -would
have to be reattain.ed from the new owner, it would take at least twenty or thirty
times that of the income from this property to convert it back to the use for the
City itself.. The new parcel would not be of final gain to the City of West Covina..
® If you have to pay twenty to thirty thousand dollars for a piece of property that
brings you back six hundred to eight hundred over a twenty year period the whole
City is losing it is not gaining anything and it is the taxpayer that will pay -for
these items. I believe it is the duty of -the Council to deny this variance for the
good of all the citizens of West Covina. Thank you..

anyone can say -what land will be taken or what land will not be taken. J don;`t
believe that has a bearing at all on my proposal. My opposition has shown
nothing concrete at all, that what I propose to do is illogical or, illegal. .The plan
was submitted to the Planning Department, the Planning Commission, the Building
• Department, the Engineering Department - - they have all met and have endorsed
it. The Planning. Commission voted 5 - 0 in favor of the proposal and actually my
proposal adheres to all requirements under the City Code for a request of a variance.
In other words a variance has been granted and it would be discrimination against
me not .to grant a similar variance... It is entirely .legal and meets all the require-
ments of all the Departments in the City. Thank you.

possibilities of access and what would be

am talking about Parcel A, and also how far on Parcel B the building .would be with
regard to yard requirements, etc. And also the overall coverage of the parcel.

conforms to our subdivision requirements on a

along the Wash? The lots that would back up
to this parcel and the lot that would be across the street?

Councilman Snyder: With regard to the excess flood control land - is
this offered -for public sale or what happens if
there is no buyer?
Mr. Aiassa, City Manager- They normally put it up for public sale and if no
one buys it, they retain it.
Councilman Snyder: Teo they keep it clear of weeds'?
Mr. Aiassai City Manager: Yes they have to maintain it as long. as it is
under their jurisdiction.
Mayor Krieger: You have only. -shown us a tract map of a small
area - we have a great deal of this type of property
in the City.
Mr. Menard, Planning Director- This is correct and some of it is in very small
unusable slivers. In looking at the maps this
particular area seems to have larger parcels
that: could perhaps be reutilized, whereas further to the east there are some
rather small fragmented spaces.. There are some larger spots throughout the
entire Walnut Creek. -Parkway.
Councilman Nichols- Lot 16 has considerably smaller frontage on the
cul de sac than lot `17 .

Councilman Nichols- A question of staff. My understanding that when
surplus property is made available it is offered
to the abutting property owner first, is that correct?
Mr. Aiassa, City Manager- They normally negotiate with the property owner
that the property has the greatest advantage for
utilization. If the property owner doesn't buy it:
they put it up for public bid.
Councilman Nichols. What would happen.if hypothetically speaking this
parcel was developed and then two lots up the
road the property owner took advantage of the offer
and he wanted a piece added to his land what happens to the property that lies
• in between?
Mr. Aiassa, City Manager- Where is normally a provision that anyone that
buys property on -a tax deal sale takes the
responsibility that it has frontage on an
adjoining public street or he wouldn't be entitled to a building permit.
Councilman Nichols- Let's say Lot 7 goes in and he wants to expand
his lot and he has the same basic size and
he goes to the County and says he wants that
parcel - or lot 16 in the middle doesn't want it and the County is stuck with it.
Then how does the County get access ?
Mr. least, Public Service
Director. The County has a road in there. It has 10`.
.Councilman Nichols- My reaction to this -a- is this going to be
harmful to someone else? In all, due respect
to the opposition testimony given and knowing
the quality of construction that has to be built in this City today and knowing
what the cost of 11'00 + sq..ft. would be, I.really cannot believe that the
development of additional property at that location would harm anyone. We have
very many expensive homes.in the.City in cul de sac areas whose footage
doesn't exceed that and due to the topography whose usable lot size does not
exceed this and so I don.'t believe it would be -harmful. I believe our existing
ordinances if we would stick to them in terms of not allowing the footages to
fall below that which is. stipulated in our ordinances, if we do follow the
consistent regulations that are on the books, I think that in itself will determine
what other, lands might. profitably and fairly be developed. So I think the future
in that sense will have to somewhat take care of itself. I btAdeve if an individual
owns land and he can gain a profit in this fashion and does not harm other people
in the process and in fact in my judgment would improve the neighborhood, I would
favor that type of variance

Dr. William De Sol BasicallyI think the matter before the Council is
910 So. Sunset completely covered in the minutes. -As Mr. Menard
West Covina has pointed out the character of this area has
changed considerably in the last 'few years, with
the development of the hospital and the '.Max9_rl Medical Center and subsequently
the MDS Medical Center, there is a concentration of medical facilities in this area.
Consistent with this there is also an increasing need for space on our part and we
propose on annexation of this Parcel 26 and changing the present R-A to R-.P to
conform with the professional useages for which we place the property. A second
part of our proposal applies to the existing 910 So. Sunset medical center in that
the present use of this medical center has bean granted bya use variance since
1962 and consistent with the city's requirements this should be up graded to an
R-P, so essentially we want to change the use variance on our present property and
a change of designation at 1332 Roseway from Rz• A to R-P to permit an expansion
of the facilities.
I would like to point out in .support of our proposal
• that there is a definite tendency on the part of doctors in practice to aggregate
in -the area of the hospital because it allows them more efficient use of their time.
Obviously if the patients in the hospital are close to the. office 'your transportation
time is decreased and sick patients can be attended to more easily. -We don't have
a- house staff resident at the hospital and therefore we have to attend our
patients on an as needed basis. For this reason there is definitely a tendency for the
doctors to associate themselves in proximity to the hospital and furthermore
because. I think it can be shown statistically that the physician to population
ratio is less in our area, any improvement in the utilization of our time would be
to the betterment of the community. For this reason we feel the zoning changes
are consistent with the good of the community. Further, I would like to point out
that in the 3 years I have been located in this area that at no time have we had any
quarrel with our neighbors as far as the present use of the property is concerned
and we would maintain the actual physical aspects. And what we propose for
the area would be in the best interests of the community for this street.

Councilman Nichols: The doctor made one comment .that I would take
some exception too - he has stated that in the
• three years he has been in that area he has never
had any problems with his neighbors and unfortunately I was one of his neighbors
and we did have a few problems with him and he wasn't too happy to see me at
one time, but I am sure he has forgotten about that, so I will forgive him.
I feel that this is a reasonable expectancy for
use and that.it would be appropriate. It'is an area that I believe is justified -
that usage on that lot would inmo. W. harm the adjacent property, in fact I believe
it would be the best type of buffer against- heavier traffic conditions in the area.
I would be in favor, of changing the existing site to a R-P status and R-P for Lot 26.
Councilman Snyder: Is that'lot vacant?
Mayor Krieger: There is a single family residence on it facing
Roseway Street..
Councilman Snyder: I have a question. .Is it proposed to remodel the
single family residence as an office?
Mayor Krieger: You are going beyond the Zone Change but if you
think this will affect your vote on the zone
• change.......
Councilman Snyder: 'It will affect my vote on the zone change.
Mayor Krieger: Again we are going beyond the Zone change but
since you say it will affect your vote .....
Mr..Menard, Planning Director: There is a Precise -Plan approval. There is a
single family residence on, the property that
is proposed as a medical -dental office and if I
may speak further to the issue on the Precise Plan, the wall requirement and the
architectural treatment on the walls, landscaping, etc. , on the existing Queens
Medical Center was conditioned to the point that such landscaping treatment or
wall treatment must be copied on all the addition to it. -It is our understanding
on the Precise Plan that there is a possibility of future expansion in the area
because of anticipated needs as the hospital grows and it is my opinion as a planner
that within several years when additional expansion is required, perhaps on
property alongside this, new construction would take place. At this time the
Precise Plan as approved by the Planning Commission will allow conversion of the
structure to medical -dental offices, of course, under. the requirements of the
Building Director that they meet the building requirements, etc.
Councilman Snyder: I am reluctant to grant zoning which allows the
conversion of homes to offices because - not
• always .- but most always, such conversions
are unattractive. In fact I can't think of -any such conversion -that was attractive.
In my opinion the allowance of such conversion tends to run the quality of the
area down.
Mayor Krieger: Further discussion on the merits of the Zone
change? A motion would be in order.

Mr, Aiassa, City Manager-, We have with the staff°s help and the
consulting firm.that Mr. Rossetti
works for, tried to golve-'some of our off-street
parking problems One of the basic _areas we find that lends itself
very well to a parking district is the one at Sunset and Toluca Avenue,
We have done some basic preliminaries but we have not been given any
specific action on the part of the -Council to proceed into the full
development of a full fledged off-street parking district. We have
done an analysis as far as ownership, etc., as far as the property area
is concerned and we also did the same thing with the Plaza which was
the -earlier concept, but because of the complexity of ownership and
the largness we f-eel that the pilot dav-elopment for off®str-eet parkin
district is the. one I just mentioned and if anyone makes a tour of that
area they would r.e.aliz.e the. cr.itic_al_need fof off-street parking.
Also we feel there is a large site .of vacant property to the west of it
that could be tied in with this off-street parking program which would
give this party a_higher use of his vacant land. if he does .develop it
into a multilevel structure. Also it will provide us with some
medium to stimulate other areas .that .are. -going to have similar parking
problems such as the West Covina Center.

Mr. Aiassa, City Manager: One of our attorneys has seen it.
Actually this agreement was drafted
sometime ago and due to some neglect or
mishap in the County it never got out of the County. We were
authorized to provide 58 car parking stalls and they advanced the money
and we authorized the improvement of $7,042.64 and this will entitle them
to a certain amount of prepaid monthly rental for a lease on the parking
stalls.
Mayor Krieger: This has been approved as to form?
Mr. Aiassa, City Manager: Yes,

Council approve the implementation of the Lease Agreement with the

Mr. Aiassa, City Manager.- The only report I can make is that the
PUC has taken this under advisement.
The question now is ® that the Council
does or doesn't like to take a stand supporting either one or neither
of the water companies. They had their hearing on December 6 and the
PUC has taken it under advisement. They have not accepted the proposal
of the Suburban Water Company,
Councilman Gillum: Mr. Aiassa, would our stand for one or
the other have any bearing or influence
whatsoever on the PUC?
Mr, Aiassa, City Manager.- Surprisingly, it does.
Councilman Gillum: I have mixed emotions. I think one can
serve us better and I am concerned about
the other's financial. I would prefer
myself not to support or condemn -either organization,
Councilman Nichols.- That is my feeling, Mr, Mayor, I think
we have an absolute obligation to obtain
the best and least expensive service and
at this stage I believe the normal processes through the PUC should be
followed.

Councilman Gillumo I have read the report and talked to
the staff and I get from the conversation
and the report that the County is not
even sure what they are trying to tell use I am still concerned that
someplace in here is a tremendous amount of money and it does appear
that even the County can't tell us -where it is coming or going. I am
somewhat at an end here as to where to proceed at this point. I am
not satisfied with the answer but I think the staff has done everything
they can and they are unable to get what I feel I am looking for from
the County on this.
Councilman.Nichols: They indicate they will follow-up,
Councilman Gillum: I know that, but I am just conveying what
I got from the staff, they don't believe
than what they are now. the facts will be anymore informational
Mr. Aiassa, City Manager. I think the only thing we might be able
to do is get other cities interested
and see if we can open up this
procedure of funding, because they are intermixing their apples and
pranged,
Councilman Gillum: As far as I am concerned, I am not
condemning or being critical, but I get
the opinion they are kind of shuffling
things back and.. forth and because we are talking about a considerable,
amount of money I would like to have considerably more drawn lines of
where and why.
Councilman Snyder.. You are asking, what portion of your
County tax
Councilman Gillum: No, it is basically this, Dr, Snyder,
We are assessed so much for water shed
but the more I investigated it, it seems
these funds 9 well everytime they build in a hill it comes off and does
and it is, not.,-., water shed and the assessment has not been reduced in
tkAe amount we originally started to pay the County for this water shed
protection and this fund keeps building and it appears there is a
strong possibility and I have no roof of it that the County is along
these funds and dispersing in other areas and borrowing back and �or h
and it seems to me it is a very large fund they are borrowing back and
forth,
Councilman Snyder. Are they legally restricted?
Councilman Gillum: This I don't know and this is what I am
trying to find out but all the cities
should be concerned. What do we pay

• Mayor Krieger: The mayors of 15 of the Valley communities
acted to initiate an old precedent which
was periodic meetings of the Mayors.
The first meeting was held in E1 Monte at the Santa Fe Inn, hosted by
the Mayor of E1 Monte, The next meeting will be the fourth Wednesday
in February in the City of West Covina, hosted by the City of West Covina,
subject to the following rules: The only ones allowed- in attendance will
either be the Mayor or Vice -Mayor or Mayor Pro,Tem, No substitutes and
no one else. Each of the dinners will start promptly at 7 P.M., and
adjourn promptly at 10 P.,M, The dinner will be a "no host" dinner in
terms of each participant';sharing a pro-rata share of the dinner cost,

The subject material will be any matters that any Mayor, or Vice -Mayor,
or Mayor Pro Tem wishes to bring before the other Mayors for consultation,
consideration or discussion. The two mattersdiscussed at the last
•meeting was the subject matter of the Police_ Commission or Police Public
Relations System, that is being implemented in various communities,
of course, the -City of West Covina has initiated.the CEACE program,
The second item discussed had to do
with the concern of many Mayors there of the spiral caused by the
competitive nature of wage and salary studies by neighboring
communities precipitating in additional_cycle increased in neighboring
communities. The thought and hope was to perhaps bring this out in the
open-and....discuss _.in terms of reporting back to the respective councils
perhaps with the recommendation that may possibly receive favorable
consideration by the councils.
The whole purpose of the Mayors°
Committee is'merely an informal body without formal procedure to get
together at periodic intervals and discuss matters of concern, This
Committee. such.as it is, will meet five times a year starting in
February �968;.April; June; August; and Novembers They will alternate
from various cities. The make-up .of the group - - I.have the
responsibility of following up on this thing - will be open to twenty-
four cities stretching._ from the City of Alhambra eastward to the
Los Angeles County line, encompassing all the thirteen cities in the
East San Gabriel Valley as well as the neighboring eleven cities who
would normally constitute the West San Gabriel Valley, This is a body
that met informally.some years ago and was discontinued for some reason,
• There is no desire to create another level of government, it is merely
an opportunity for Mayors, or Vice -Mayors, or Mayor Pro Tem, to sit
down and discuss these matters. Any questions?
CITIZENS COMMITTEES
Mayor Krieger: The next item is the Citizens
Committees, The Council was polled as
to their preference on bringing the
next Blue Ribbon Committees into existence. Of the original list there
were five committees yet to be created: Capital Improvement•
Municipal Services; Recreation & Parks Improvement; Traffic Flow &
Circulation; and Vehicle, Bicycle and Pedestrian Safety, The two
Committees that received top priority were Municipal Services and
Recreation & Park Improvements, I have asked Councilman Gillum to
act as council liaison on the Municipal Services; and Councilman Gleckman
to serve as council liaison on Recreation & Parks Improvements, This
then leaves Councilman Nichols with the City Charter Committee and
Dr. Snyder with Regional Auditorium, and would complete all but three of
the Committees that we originally conceived.

• & Mocine, on the preliminary schematic -plans for the Central Business
District renovation which was directed bothil the Old Center and the
West Covina Plaza area, Frankly this was one of the most stimulating
discussions I have witnessed in sometime. It was positive, it was new,
it was constructive and it was forward looking, I asked the Planning
Director to bring to this meeting the schematic plans that were
presented by Mr. -Williams to the Planning Commission that night, The
Planning Commission is presently receiving follow-up reports from the
Planning Director as to the,mechanics of a possible implementation
of these programs as far as the City is concerned,

Mr. Menard, Planning Director: There were several points Mr. Williams
brought out. A first point m and I
think it was very significant9was
attempting to revitalize the. present .c.ans.tr.uctio:n .and .layout of the .
buildings. and parking,,in the Old Center ® this is probably a physical
impossibility, The only hope is removal of what exists and re-
construction,, He feels the Plaza area can be revitalized, it is of
better quality construction although it is not what you would call
exactly exciting architecturally, even in new construction. It is not
dynamic,. The Plaza can be revitalized the Old Center cannot,
Another point he made quite strongly was the fact that there was a
tremendous amount of land devoted to streets in this area and that
Serha the b st altern ltives would be deep sur r these
treNs ancd c. ,,.sing hem, vaca ing them and a new streR �altern m a
loop system which has been.proven to be far more successful. I think
the Planning Commiss-ion after taking their trip to Newport Beach, saw
this. very definitely. This was planned from the beginning and consisted
of a very major loop system around the four majors in that Center. This
is not a design scheme in anyway, it is only a conceptional idea at this
time that shows how this might work far more efficiently.
Briefly some of the points he brought
out, we the City have created a design motif by creating dirt burns
in this area and thi-s might be carri-ed through on a similar scale in these
particular areas. By this kind of a.street system we could reorient
the commercial and. instead of towards the Freeway face it towards Walnut
Creek Parkway, which hopefully will be a major street of the City.
This anticipates the addition of a major department store somewhere in
•the ar-ea, the creation of pedestrian malls, the reorientation of off
street parking into a far more functional system and the addition of
considerable landscaping throughout the entire area.
He stressed very strongly the fact
just because Bob's Restaurant or Reliable Savings or some of these did
not show on these plans did not mean they anticipated wiping them out.
These were just uses that were not indicated under any design contract.
He says perhaps, and it is only a thought at this time, a financi?4
center bas-ed on the fact that Home Savings owns a large portion of the
land -and they anticipate construction of a financial tower and perhaps
the addition -rof additional financial kinds of structures would prove to
be economically successful.
He also stressed very strongly the
utilization of every tool at the local government's disposal
to bring this to bear, also stressing the fact this was not a design
concept or a finalized program, that the amount of money they were
contracturally obligated to spend on the Central Business District
was not sufficient to do an indepth study of the economics, the design
considerations and the action or implementation program that would
perhaps create a design_ motif_ throughout_ the.. area.
One interesting point in closing,
there appeared to be some 38 to 40 acres of land in the Old Center
and the Plaza that would perhaps go back on to the tax rolls as
commercially zoned land and would become available for development.
This would happen if Walnut Creek Parkway were built over existing
.Walnut Creek Wash and this would happen if 10% of the land were devoted
to landscaping and a street pattern similar to that seen on the
other drawing. Throwing just a very conservative estimate of today's
dollar value Ave square foot we are immediately talking of that 38 to
40 acres of fimillion dollars of land that is not now being
utilized and which perhaps. could be utilized in the future. And looking
at it from the City's standpoint only on land and improvement assessment
means approximately 4150,000 to 1200,000 additional revenue to the City,

presentation by Mr. Williams and the

is at the end. of a meeting, to bring. this type of subject to your
attention, but I would be Mess than frank with you if I did not
indicate that I was greatly excited with the potential of this type of
develo_pme.nt. No -thing. --has .g-iv.e.n.._me such enthusiasm -since .our. disco
cus.sions on the Civic -Center program. I am sure -I share with the
rest of you the physical r-evulsion and the --embarrassment of our
commercial centers that we claim to represent the "Headquarters City"
of the East San Gabriel Valley.

Secondly, what I liked particularly
about Mr. Williams conc-eption is that it is a fact of life that we turn
oar back on the San Bernardino Free- ay as far as our develo m nt is
concerned. e have always faced ou and looked at it as aia n street
yet it is not a main street and it is an impediment under that
phil.-os.phy to the development of c:ahe.sive -and complimentary commercial
areas., By turning our backs. on that Freeway and turns ourselves.
away from it we have great possibilities and potentialor these areas
that still remain in direct access to the San Bernardino Freeway, but
don't face out to it in terms of their orientation. I don't know
whether the Council is going to share my enthusiasm for this or not,
but I think this program...r-epresent:s the future of this community in a
very vital. area. I would.._ho..e that. the Planning Commission moves
forward with great speed in this particular study and that the City
Council then gives it the most sympathetic consideration.
Councilman Snyders
Perhaps Mr. Mayor m he spoke of the
tools available to local government
if the Council could get started on
these tools while the Planning Commission is finalizing the plans,
because we are going to have to know how we accomplish this since you
are dealing with private ownership. We should at least be informed
on what these tools are.
Councilman Gillum; I think we took a step in that direction
tonight in directing the City Manager
on the parking district.
Councilman Snyder: But I think we should have a package
on this so we know what we can or cannot
do.
Co,unc..ilman Gillum: I agree and I would like to again state
as I did at the Planning. _Commis_sian .
meeting that these things are fine and
I would -dearly love to see them develape.d but again...it gets down to the
point that it will take courage of this Council and future Gouncils and
Planning Commisbions to take the bold steps you have to take to develop
something.of this type. Without it this City is not going to exist.
They will build all around us. It is going. to take bold steps by the
Planning Commission, the Council, and the staff and future Councils,.
I, for one, hope that we have the courage to go forward with a program
of this type, because the only thing that can happen is the City of
West Covina will benefit. I hope to see it in the near future, a start
in this direction.
Councilman Snyder: Well.again it is just a pipe dream unless
we have the tools m and that is where I_am
most concerned and interested ® how can it
be done legally and by what methods?

will he ready for the Planning Commission in 3 to 4 weeks, needless to

predicated on how soon I receive answers to the letters sent out,

Councilman Gillum. -The Planni-ng Director and the Planning
Commission and myself, attended the
East San Gabriel Valley Planning Committee
meeting and we were treated to a delightful film on how great signboards
were for ci-ties. It was the best brainwashing job I have seen anybody
try on planning people. These poor people are really hurting. It was
somewhat comical to hear a gentleman from West Covina somewhat defend
West Covina's sign ordinance, stating our ability to control signs and
set the standards that we have in the East San Gabriel Valley,

unfortunate that the Post Office, will not allow the residents in the area

legal city limits of West Covina, although my mailing address is Valindao
Councilman Nichols: I have one item, a very mundane item.
It is the dog problem within this City,
o We have always contracted for -s-ervice
nd I don't know how much service we are getti , but I know atl over this
ity we have dogs running loose by the scores Nat are no con ained by
a leash and they are not picked up. Every day at the schools we have just
large numbers of animals wandering around. I think that all of the problems
that this creates - the tearing up of flowers, the messing of people's yards,
etc, , is an -area that the. Council _can..and :sho:uld .be cone -erred about and I am
beginfiing to wonder if we are getting the kinds and. types of pound service
and control service that our City is entitled to in this day and age
relative to its size and population. I am not really in any position to
level any criticism at this point, but I would like the indulgence of the
Council while I suggest to the City Manager that he request of the Humane
Society some detailed figures on the amount of hours per week their vehicles
are in the corporate limits of this City, patrolling the streets of this City
to provide the -type of service we are contracted for,
Councilman Gleckman: I go along with that. I would like to
see a report. I have received several
40 complaints regarding that same issue, as well as the renewal of licenses.
There was a time when this was done door to door, and now they don't do
that and it is the responsibility strictly of the owner of the dog to
remember the dates on which to renew the license. I agree with you, I
think the service is atrocious,

service but are we really getting it for a City of 70,000 and how many
thousands of dogs, I don't know. But for those citizens who do contain
their dogs and do go out and buy the license, they are not being treated
fairly when literally hundreds of animals can wander the streets of this
City with absolute immunity unless somebody gets on the phone and calls
for the truck to come and pick up the doge I would like to have the
City Manager follow this up and let us know what he finds out,
Councilman Snyder: The enabling act for a motel -hotel
tax allows you to apply a tax in any
amount, actually there is no limit,
The County is going to raise their motel -hotel tax to 5¢ to be in line
with the sales tax of 5%, and the League of California Cities, Los Angeles
division, is advising that all the cities do so at the sametime. Does
this require an ordinance change?
Mr, Aiassa, City Manager:, Yes,
Councilman Snyder: Their argument for raising it is to keep
it in line with the original intent -
when the sales tax was 4% it was 4¢ and
now that the sales tax has increased they are increasing it to 5¢ and
probably most cities will raise to 5y.

Attorney be directed to amend -the Ordinance to raise the amount to 5zo,.

Constitutional Revision Commission, which I wasn't even aware existed

since 1964 on shortening and clearing up areas of conflict in the
California Constitution. They have been working for 2 years on that
article which deals with Municipal Government and will be making
recommendations for putting them on the ballot sometime within the
next year. He pointed out the advantage of the Constitutional Revision
Commission over the Constitutional Convention which occurred in New York

like to see the Council direct the City
Manag-er to investig to the desirability
and feasibility of the City developing. a Community®wfae Building. Such
a f :c:,if .'cy would be built -by the City o-n City owned land -with the
proviso that the cost of the facility would thereafter be borne by such
organizations as the Red Cross United Way etc,, such other organizations
that have a full-time staff and is now paying for office space, and that
this would be acc.o.mplished by obtaining a long term lease extended over
the period that the development costs are to be amortized and I think
this would be the right direction for this City to start, rather than
waiting for a -land fall to come ..along or .some .private develbper to come
along and -'do this. I would .Like to have the staff take action right
now and investigate the feasibility.

supposed to be a letter to the Council
but the pparty called me-due-,.to.a time
element, and I said if it was that urgent I would request the Council's

Mr. Aiassa, City Manager: I have the letter. The letter
ertains to eleven palm trees located at.
03 So. Sunset Avenue, our future Fire
Station site. Staff made a checkout to see if we would use these eleven
palm trees and we would not be. They made us a flat offer of $250.00 and
the offer expires on Thursday the 14th of December ® it is the Industrial
Turf, Inc.
Councilman Gleckman: From my conversation with him I understand
he had a need for these at _the present
time and also had the crews available
to remove and he wanted to know if we would be interested. I suggested
he make an offer to the staff, have them investigate it and then report

fire station we might remove them
,anyway. There are eleven trees.

Motion by Councilman Gleckman, seconded by Councilman Gillum, that the
City Council approve demands totalling $386,443.96 as listed on Demand
sheets B347 - B351. This total includes -payroll account and time
deposits. Motion carried on roll call vote as follows:

Mr. Aiassa, City Manager: May I have permission to consider two
small items?.
Mayor Krieger: If the person that made -the motion and
the erson that seconded the motion will
withpdraw the motion? I had absolutely
no forewarning of this.

Mr. Aiassa, City Manager: On the 15th of this month the Highway
Commis -Sion is going to come forth with a
recommendation on Grand.Avenue interchange
1 whether or not they are going. to participate in the ri-ght-of -way. In
discussing it with the Mayor I think it might be advisable to have
authorization for a representative to.go up there and be physically
present on the 15th.
Mayor Krieger: Any objection to adding this item to the
agenda? (No obj.ections.) It is the.
suggestion of the City Manager that
someone be authorized to attend the meeting of the Highway Commission in
Sacramento on December 15th and I assume the expenses are not to exceed
$50. 00.

from the Regional Planning Commission on
Zone Change 5286 -.it is coming up
•befor.e the Regional Planning -Commission tomorrow morning. If the Council
wants.me to send staff representation I would like some direction from
Council.
Mayor Krieger: Is there any objection to ad -ding this.
item to the agenda? (No objections.)
The recommendation is that there be
staff authorized to attend and represent the City's stand on this matter,
stating our opposition to this case.
