Strictly a philosophical point of view, but I am increasingly coming.to that.point of view. (Councilman Snyder entered the room at-7:35 P.M.) Mayor Krieger: The motion .brings the Council $2,000 closer to your point of view; it's a reduction. Action on Councilman Gillum's motion. PLANNING COMMISSION .REVIEW OF PLANNING COMMISSION ACTION OF.MARCH 1, 1967 Slight Modification No'. 4.9 Councilman Snyder: As a representative to the Planning Commission, I would like to point out this slight modification involved deep lots of the north side of the freeway, not those on which we had the deep lot study. Obviously there are many.lots here on the north side that are involved just as much on the south side, and nothing ever came, really, of the deep lot study as far as any definitive or final.relief of some of the problems. •The Planning Commission voted to include this as a request to the general planning consultant for, possibly, their comments on solving the problem of the deep lots. With regard to defining.incidehtal use and restaurant use, this came up because one of the motels on the north side was.built by special use permit, or zone variance, in R-3 zone, and I believe they attached the proviso that the door had to open to the inside, although they could have a sign. The only thing .I am concerned about is that, even though it is in R-3 zone and that this is along the freeway, this variance, or interpretation, could be applied to motels in R-3 zones in other areas of the City that are not necessarily along the freeway and could cause difficulty later. I would like to see the Council review this resolution at least to know what is going on here. Mayor Krieger: Interpretations, as I understand the City Attorney's Opinion, must come before the Council to have any binding legal effect and unless an ,interpretation is confirmed by the City Council, it has no binding legal effect; is that correct Mr. Williams? City Attorney, Mr..Williams: Yes. Councilman Snyder: I am not saying that I disagree, but I think the Council should understand why this is so, and perhaps take some steps to prevent this in the future. • Councilman Nichols: I think there can be very little question but that.certain areas of our community are identified very closely with the size.._":, of these Jots and the lots are in a.very serious state of decline. I certainly hope that in the studies that are being made, a great deal of thought will be given to the deep lot areas as to what might be done to them. -3- I C. C. 3/13/67 WRITTEN COMMUNICATIONS - Continued Page Five LETTER FROM WEST COVINA BEAUTIFUL REGARDING REVISIONS IN SIGN ORDI- NANCE Motion by Councilman Nichols,.seconded by Councilman Gleckman, and carried, that the staff prepare an acknowledgment for the Mayor's signature and draft a letter to West Covina Beautiful, regarding revisions in sign ordinance, and that their letter be placed in the active file for consideration by staff and referral to the Planning Commission. REQUEST FROM CITY OF POMONA FOR RESOLUTION IN SUPPORT OF APPLI- CATION TO CIVIL AERONAUTICS BOARD Motion by Councilman Gleckman, seconded by Councilman Gillum, and carried, that a resolution be prepared in support of application to Civil Aeronautics Board for air service from Ontario International Airport to Hawaii and other Pacific Areas. Councilman Nichols: I would go along with anything that would make it more convenient for Councilman Gleckman. Councilman Gleckman: Would you please put that in the .record in case I need his help at any time. • REQUEST FROM CITY OF BALDWIN PARK FOR RESOLUTION SUPPORTING POSITION TAKEN BY CITY OF IRWINDALE OPPOSING OPERATION OF PROPOSED GAMBLING INTERESTS Mayor Krieger: May I comment on this before.the Council takes any action. I discussed this with the Mayor of the City of Irwindale, to deter- mine whether the official body in the City of Irwindale would feel, at this time, that a resolution would be helpful to them or construed as interference in their internal affairs by the poli- tical body of another community. In summary the Mayor indicated that there is not an active pursuit of the matter at this time. The City Council there has taken a stand in opposition to this kind of activity in the City of Irwindale and the Mayor does not feel, at this time, that there is any necessity for political bodies outside the.City of Irwindale to take such steps. My recommendation is that we receive and file the matter at this time. and carried Motion by Councilman Gleckman, seconded by Councilman Snyder/ that the request from the City of Baldwin Park for a resolution support- ing the position taken by the City of Irwindale for opposing the operation of proposed gambling interests in the City of Irwindale be received and filed. •RESOLUTION FROM CITIES OF PASADENA AND HAWTHORNE REGARDING COUNTY -WIDE RAPID TRANSIT EXPRESS SYSTEM. Motion by Councilman Gleckman, seconded by Councilman Gillum, and. carried, that the resolution from the Cities of Pasadena and Hawthorne, regarding a county -wide rapid transit express system be referred to the staff for their report at the next meeting. -5- C. C. 3/13/67 CITY ATTORNEY ORDINANCE INTRODUCTION Trimming `gees and Hedges (Held over from February 27, 1967) City Attorney, Mr. Williams: Page Six The City Attorney presented: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING CERTAIN SECTIONS OF THE WEST COVINA MUNICIPAL CODE RELATING TO OBSTRUC- TION OF VISION AT INTERSECTIONS AND DRIVEWAYS AND TO THE CARE, TRIMMING AND PRUNING OF TREES, SHRUBS, HEDGES,. ETC, IN PARKWAYS AND ON ADJACENT PRIVATE PROPERTY." I believe you have a summary. Councilman Nichols: I have at to digest the ordinance as it is presented here and it seems to me that there are some aspects of the ordinance that may be doing more than the ordinance purports to do, or perhaps it is just that I have not properly assimilated its intent. I would like to bring up a couple of points and get Mr. Williams' reaction, if I may. It seems to me that on the one hand the City is attempting to control, by the use of this ordinance, the destruction or damage to City -installed -plantings in parkways; but, on the other hand, the City is attempting to place the responsibility upon the property.owner to maintain those plantings. In those two areas I believe there is conflict. In Section 7403 it states: • "Except as otherwise required.or expressly permitted by .this Code, no person shall cut, trim,_.prune, plant, remove, injure or interfere with any tree, shrub or plant upon any street, park, parkway or public place of the City ." and then, in Section 7409: No person owning or controlling property abutting upon any public street, parkway, or public place in the City, upon which property are located any hedges, trees, shrubs or plants, shall permit said plantings to encroach upon the sidewalk, parkway, curb or street ." Those two Sections, that is 7403 and 7409 seem to be in perfect harmony, then we come down to Section 741O.Maintenance of Trees,Etc. in Parkways. This Section states: "Every person in possession or control of any property abutting upon any parkway,.whether separated therefrom bya sidewalk or not, shall be responsible for the maintenance and shall maintain said parkway or parkways abutting said property free of trash and debris, shall adequately maintain and care for any tree, hedge ." It seems difficult to me to conceive of one Section telling the public • they are to keep their hands,.in effect, offthe parkway areas by .including the term parkway in that Section 7409 and then move to 7410 and maintain that every citizen shall be responsible for caring for all the parkways in the City. I believe that is a confusing aspect of this ordinance and I would like to get some reaction from the members. C. C. 3/13/67 Page Seven ORDINANCE INTRODUCTION Trimming Trees and Hedges - Continued Councilman Snyder: Conceivably some people do not under- stand.about the parkway. It is conceivable that you.may need to set forth a provision to make people remove hedges, etc. from the parkway, because they do not understand this is City property and not their own. It is also right that they are responsible for the upkeep. Mr. Fast may have a comment.on that, he had in mind a method of enforcement. Public Services Director, Wewere.looking for a method of Mr. Herman R. Fast: enforcement that is simple for the citizen to understand and we drew up a sketch or two when we were attempting to enforce the existing code. Previously the traffic authority decided what the height of.hedges should be. We felt that by putting in a reasonable limitation on the height and supporting it with sketches, would be one way of handling the matter, and the people seem to like this method of administration better. (The wording of the ordinance was further discussed at.length by the members of the Council.) (1966-67 Priority Sidewalk Program) Motion by Councilman Gleckman, seconded by Council Gillum, that the low unit price bid for Project SP-67001 for sidewalk improvements throughout the City, be accepted and that the Mayor and City Clerk be authorized to execute. an agreement with Robert W. Motion by Councilman Snyder,.seconded by Councilman Gillum, and carried, that Mrs. Porter's letter be acknowledged and that a.letter for the Mayor's signature be written, explaining.the reason for this sidewalk and why.it cannot be excluded. Motion by Councilman Gleckman, seconded by Councilman Gillum,,and ca.rried,to accept the Staff Report and recommendation to install sidewalks along the north side of Workman Avenue, frontage east of Burwood .Avenue, and that the Council authorize installation of sidewalk on the south side of Workman Avenue between Vincent and Maplewood Avenues. Motion by Councilman Gleckman, seconded by Councilman Gillum, that the low price bid for Project SP-67009, for street improvements be accepted and that the Mayor and City Clerk be authorized to execute an agreement with Louis S. Lopez in the amount of $3,321.80. Motion carried on roll call as follows: Ayes: Councilmen Gillum, Nichols, Snyder, Gleckman, Mayor Krieger. Noes: None Absent: None PROPOSED SALE OF REAL ESTATE No bids received Mr. Aiassa: LOCATION: East.of Glendora Avenue on the north side of Merced Avenue. I recommend that we take this off the agenda and wait for a more favorable market. C. 3/13/67 ZONE CHANGE NO. 374 - Continued Page Nine Motion by Councilman Gleckman, seconded by Mayor Krieger, and carried, that.the affidavits of publication and mailing be received and placed on .file. (Maps were presented and Mr. Menard gave a brief summary of this matter and read resolution No. 194G.) Mayor Krieger: Is that. the Planning Commission's resolution? Mr. Menard: Yes, it is. Mayor Krieger: Now.is the time and place for the proposed zone change No. 374 - Harold and Irma.W. Barhite. In,accordance with the Municipal Code, having to do with public hearings, for the benefit of any person not familiar with the facts, any person desiring to address the Council on the matter may do so at the time the matter is called, by stepping to the microphone and being sworn by the City Clerk. You must limit your remarks to three minutes unless you are granted additional time. The Chair will entertain a request for additional.time, if you indicate your desire when you step to the microphone and the additional time that you are requesting. The Chair will then obtain an immediate ruling on the time you have requested, otherwise the Chair will hold you to the three minute limit. • We will call upon the proponents . and.opponents, if there are any. The -proponents -will be given -the opportunity for rebuttal if there have been any opponents. Is there anyone present who desires to speak in favor of this zone change,.if so, would you please step to the microphone and give your full name and address. Mr. Lewis K. Uhler I do not request time in expess of Garvey, Ingram & Baker three minutes. I would like, simply, 281 East Workman Avenue to amplify, just for a moment, the Covina statement made by -the Planning Director, Mr. Menard, that the sub- ject property. -is immediately contiguous to existing C-2.property; that.the RA.strip under consideration is the small parcel historically considered to be part of this C-2_zone and apparently was overlooked in the zoning. At that time the subject property was of a relatively odd configuration, not lending itself, necessarily,,to anything other than being part of the overall C-2 package that exists there. As indicated, the zone change is supported both -by -the Department and the Commission. There have been two appearances before the Planning Commission, there being no protests. On the contrary, we presented to the Planning Department and Planning Commission some six or eight petitions favoring this zone change which, hopefully, are avail- able to the Council. Those are the points that I wish to make and commend to your consider- ation for a favorable ruling on this request for C-2. There being no further testimony, the public portion of the hearing was closed. Councilman Gillum: I have a question, Mr. Menard, is this the section that we are turning over to the Baldwin Park High School? (Mr. Menard answered Councilman Gillum's question by referring to the map.) -9- :7 0 • C. C. 3/13/67 ZONE CHANGE NO. 374 - Continued Councilman Snyder: zoned C-2? Does the staff know? Mayor Krieger: Mr. Menard: again, but I wasn't aware.of it. Councilman Snyder: Mr. Menard: Councilman Snyder: build apartments in that area. Mr. Menard: Councilman Snyder: Page Ten Isn't there a.precise plan for apartments on that area already Outside of Badillo. Not .to my knowledge. We looked back through our records. I,could look Is there any precise plan for that? No, the only precise plan I know of is for the service station. I had the impression, at. one time, there was a sign there offering to What -is the frontage on Orange Avenue? 85 feet. What are the main uses in a C-2 zone? What is the purpose of a C-2 zone? Mr. Menard: C-2 - it is indicated as a community shopping center. I could give you a portrayal of typical uses. C-2 is General Commercial, i.e..parking lots, similar retail or wholesale, or service business not involving warehousing, cabaret dancing incidental to thatpermitted a restaurant, automobile sales.agency, drive-inrestaurant, hotel, swimming schools, theaters, open.air gymnasiums, bowling alleys. Councilman Snyder: Laundries? Mr. Menard: That .is C-3, dry cleaning, retail only; this would indicate that that is the first place cleaning would take place. The coin -operated laundry is what you..are referring to; isn't it? Councilman Snyder: No, I was talking about just taking in,laundry and they do the cleaning operation. I mean the plant where they do the cleaning. Mr. Menard: Nothing indicated in C-3; nothing.in C-2. I am assuming this kind of thing is probably.mentioned in the industrial zone and other similar types of zoning. Laundries - M.zone, Industrial Zone. Councilman Snyder: I:b ring this up because of the uses in C-2 or C-3 . The. larger the shopping.center, the more noisy types.of uses in there and obviously we are enlarging the C-2 area next to the R-1 area. The shopping center on the north side has never done very well and perhaps Badillo Avenue will improve it,.going through and making C-2 more desirable, or at. least C-1 on the south side . I am not particularly for C-2 here because I was not in favor of the original C-2 as compared to C-1 or multiple, on -that side. Again C-2 allows usages which are more noisy and more offensive to residents, and I am not sure a six foot block wall is going to solve the problem for the residents to the south. I don't want to compound.the mistake by enlarging the C-2 that is there. -10- C. C. 3/13/67 Page Eleven ZONE CHANGE NO. 374 - Continued Mayor Krieger: Perhaps you could respond:to the question.in regard to this matter. Why.is the applicant desirous of a C-2 zone on this property? • Mr. Uhler: I am awfully glad you asked. I am glad to have the opportunity to respond. The contemplated use of the parcel for one thing will be of economic advantage to the area. I hadn't gone into the use because of the zone change request and the use contemplated is not necessarily part of that. The only reason for C-2 rather than C-1 here, is that within the ordinances of the City, if there are to be any devices, .to -wit: an ice chest where one can make the cubes or a .coke -vending machine outside the confines of the wall, this is situated on the front concrete way of the store and that requires a C-2 zone as contrasted with a C-1. However, in every respect, the quietude of that kind of thing is a C-1 kind of use and I would add that it was with this use in mind that the residents who came down and participated before the Planning Commission felt that this was not the only kind of use that would-be an actual helpful'addition to the community. Mayor Krieger: Thank you, Mr. Uhler. Mr. Menard, would you.place the City.boundaries, please, with reference to this property? (Mr. Menard indicated the City boundaries on the map.) • Mayor Krieger: Any reason we have our City.boundary • of this property? sign approximately 200 feet south (Mr. Fast explained the area to the Mayor, using the map to demonstrate.) Councilman Snyder: It seems to me that being 82 feet on the south side of this service station, this is hardly a,large enough piece unless it is included with the other C-2, to zone C-2. It seems to me that this C-2, by its nature and purposes, should be a:.larger piece of land and that C-1 would adequately serve the purposes of the applicant and the problems involved, unless this were incorporated with C-2 as an entrance or part of the whole development, but C-2 seems to be going too far and C-1 should serve the purpose. Councilman Gillman: I have a question. We have not received any notification of any type of protest from the Baldwin Park School District., have we? Mr. Flotten: Councilman Gleckman: it belong to the ownors . Let me qualify. that so I am curious as to when whether this particular at that time. RN One question of the staff. This particular parcel of property, did of the present existing C-2 zone at any time? that you will understand why I am asking it. C-2.came in for application to the City, .area was offered as a buffer zone to the R-1 Mr. Uhler: I can't,.in all honesty answer that precise question. However, I can answer the previous one.. The property was in the same ownership. The previous owner was Mrs. ,e,rhite's father, who owned.this entire area and then developed.the tract of residences there. She has indicated to me that it is her belief and it appears to her as if this section -11- C. C. 3/13/67 Page Twelve ZONE CHANGE NO. 374 - Continued had been.overlooked from.the legal description viewpoint, at the time the C-2 had been obtained, because the full.length.of that strip there is only 50 feet in width, hardly lending itself to any kind of development. If I may just add a remark, and go -one step further;.it is contemplated.in this Circle K type of market development, that the portion -to .be used will be vnly;that to the indentation there (indicating on the map) there being a cut- off. May I take a moment to describe it? (Mr. Uhler.indicated the portion,to be developed on the map.) Councilman Gillum: Mr. Uhler, one question. You refer to this as a Circle K. Market? Mr. Uhler: It is my understanding that this is the firm -that the person who. has the property.in escrow, pending zoning, is intending to lease the area to. It may be, I understand, a 7--11, but it's going to be one or the other; this type of market, you know. Councilman Snyder: Questionof the staff. Under existing ordinances on C-2, next to R-1, whatis the set back on C-2; and the same question with regard .to C-l?. Mr. Menard: (Reading from the ordinance) C-1 frontage shall be -- Councilman Snyder: Side yard. Mr. Menard: C-1 - no side yard except as may be required by the precise plan or conditional use permit or variance. 15 feet in depth on the rear yard. Councilman Snyder: It may appear logical to make this C-2, since it is connected to C-2, but, if you look at it, it is still a narrow neck between an existing service station to the north and a small piece of property, which, unless it is iigcluded with a.larger piece, does not. lend itself to C-2 uses. best use. Therefore 1 it seems that C-1 is the highest and Councilman Nichols: I agree with Dr. Snyder in all of his comments. A C-2 use could not be developed satisfactorily. Forgetting the zone, C-2 directly abutting R-1 use, I believe, open that area to problems of development that.the City might come eventually,'to regret. I believe C-1 zoning gives greater protection to the property owner. -12- C. SCouncilman Gleckman: I am also sure they can, but I wanted it for the record. Mr. Menard: Bakery, meat markets, delicatessen stores, liquor stores, grocery or fruit stores. Councilman Gleckman: Mr. Uhler, is there any particular reason why C-1 wouldn't suffice for the usage that Mr. and Mrs Barhite would like to put the property. Mr. Uhler: As I indicated before, it is my understanding that the only reason the the C-2 requirement for this,kind of facility is to accomodate the outdoor use of a.ice machine or a coke -vending machine; this kind of thing. Councilman Gleckman: My only comment would be, as a second thought, that the only usage I myself would really object to being there, would be a drive- in type restaurant. Councilman Gillum: I disagree with you on search and seizure, I think it is a very important part of our local government and I would support that part of it. (Councilman Gillum voted "no") Councilman Gillum: definitely feel that I would have As I said previously, I believe we should have this resolution, but I to vote "no" on the new resolution. Mayor Krieger: I don't want any misunderstanding about any statementto this Council, Mr. Gillum, I am in favor of the State Legislature amending a Penal Code on search and seizure, but these are very sophistocated rules of law which would be binding upon our court system. As the West Covina Court, we are part of the large judicial district and part of the larger Superior Court system and even larger system of the courts within our State, and that is why I feel, within this particular area, some '-repugnance of munici- pality talking about evidentiary rules and I don't believe it has direct reflection on municipal operations. Councilman Gillum: Well, do you feel we should or should not, in an area of this type, make our feelings and desires known, or do you feel that we have no right to • get into this? Is that whare you are saying? • Mayor Krieger: I am saying two things, I hope. One is that this is an area I don't believe there should be municipal participation; second, I believe it is a very involved and complicated area of evidentiary law that a City Council is not equipped to discuss or analyze with great definity, and it is even a problem for the State Legislature on their judicial commit- tee and legislative committee to determine these matters. This complaint and summons, filed by Attorney Richard Del Guercio, was brought by the Japanese -American citizens. They are contesting the assessment under the 1911 Act for the improvement of two streets border- ing a piece of property. They are contesting the Act and the way it is applied to them. Ordinarily, you would refer this matter to the City Attorney for appropriate action; an answer, appearance, demurrer or whatever is indicated. Councilman Snyder: Is there a condemnation proceeding? Mr. Williams: No, we put in the sidewalk. Mayor Krieger: Knocked out 10 feet. Mr. Williams: I think Mr. Nichols and I have agreed upon some changes which will clarify the first part of Section 7409. As I said, this section was not amended, but Mr. Nichols stated that it caused him some anxiety and the way it reads now, it is apparently not clear and two different interpretations may be made. The proposal is to amend the section to read: "No person owning or controlling property abutting upon any public street, parkway, or public place in the City, upon which property are located hedges, trees, shrubs or plants, shall permit said plantings to encroach upon or to overhang the sidewal4, parkway, curb or street -(or the branches thereof to overhang said sidewalk, parkway, curb or street) in such manner as to impede or interfere with vehicular or pedestrian traffic . ." I believe the statement at the top, accorded to Councilman Gleckman, "Annexation" and my statement follow- ing, which had to do with the holding over on Annexation 195 for 90 days, was made by Mr. Gleckman. Also, on page 28, when Councilman Gleckman said, "May 8th", the motion was to hold over and not to reopen on May 8th - - to hold over until May 8th. There is a statement further down the page which is attributed to Councilman Gleckman, "If this is the intent of the Council, would it not be better for us to make it at this time?". I believe.the entire statement was with reference to taking action on the motion to hold over with the hearing open to May 8th of 1967. Further down the page, after the vote was recorded, and a motion carried on holding over, where it states, "Mayor Krieger: Other reports? Mr. Nichols, we're having our meeting with our Central. Business District", Mr. Gillum, said, "Mr. Mayor, we are having our meeting", etc. Further down, I am attributed with saying, "Census Committee on swimming pools". This should be Citizens Committee on Swimming Pools". Those are the amendments that I would offer for the minutes of January'16, 1967. -17- C. C. 3/13/67 APPROVAL OF MINUTES - Continued Page Eighteen Motion Councilman Snyder, seconded by Councilman Gillum, and carried, that the minutes of January 16, 1967, be approved with the exception of page 28 which requires corrections. 0 JANUARY 23, 1967 Mayor Krieger: There is a correction on page 10, half way down the page, "Councilman Snyder: May I ask the Attorney, assuming the assessment is made, is there any objection to the three-year pay off of the bond?" Further down, Mr. Fast says, "We haven't gone this far with respect to finances." I gather this was reviewed, but I don't think Mr. Fast wants -this comment attribu- ted to him. Then there is a statement made by Mr. Del Guercio in response to a question by Dr. Snyder. Dr. Snyder clarified his. question and Del Guercio made the comment. Motion made by Councilman Snyder, seconded by Councilman Gleckman, and carried, that..the minutes of January 23,.1967, be approved with the corrections to page.10. JANUARY 30, 1967 Mayor Krieger: On page 3, half way down the page, • the comment attributed to Councilman Nichols, "Would the right of covenant amendment domain be applicable?" I'm sure the statement made would be "Would the right of eminent domain be.applicable?" On page 9.there is a statement attributed to Councilman Snyder in the first paragraph ". . . we could have the whole 140 acres . . ." I think the acreage involved was 1400 rather than 140. Also in that paragraph, on the last line, "tread windmills" should be corrected to "tilt windmills". Motion by Councilman Snyder, seconded by Councilman Gillum, and carried, that the minutes of January 30,.1967, be approved with the corrections on pages 3 and 9. FEBRUARY 14, 1967 Mayor Krieger: Two pages have been inserted, pages 33 and 34. On page 4 there is a motion by.Councilman Gleckman; "that the City Council give tentative approval to the staff to notify the State the money is to come from the Traffic Safety Fund, and formal action is to be taken after receiving the agreement from the Division of Highways." There was a second to the motion which isn't recorded in these minutes and I think the tape ought to be checked to find out who seconded that motion, unless someone remembers. 0 On Resolution 3531, bef ore there was action on the adoption of the resolution, there was a statement to the effect that "Hearing no objections, we will waive further reading..of the body of the resolution." Councilman Snyder: It seems to me, if their trunk lines also include them, it may not be as.big an engineering problem as they -- Mr. Aiassa: The P.U.C. will have some strong ideas . There is also the Staff Report. Councilman Snyder: What additional type of infor- mation are you.going to use in this computer system that we are not already geared.for under the data processing that we have already? Mr. Aiassa: As I remember, the particular area that would be beneficial would be in the police aspect, because this bank then, would be pretty well stacked with information fromthese various systems in that area,and will be eventually available to us. Councilman Snyder: Isn't thathandled by the Sheriff's Department? Mr. Aiassa: Not completely, only certain phases. • Councilman Snyder: Since we still have county areas and some cities use contract • service with the Sheriff's Department,.wouldn't it be better to approach this company,contract basis with the SheriffSs Department, especially since we are leaving out certain county areas and since the county will be involved? Mr. Aiassa: This is the purpose of this analysis and our particular City has not been brought into the phase of the analysis because we have not participated. This gives you.an opportunity, if this program becomes successful and they do develop a good centralized data processing system, we can.buy into it as we did in the Metropolitan Water District set up. Councilman Gillum: Mr. Aiassa: Councilman Snyder: If it is successful; Metropolitan Water was and is. It's debatable The intent is to support the study; not the project. . Councilman Gleckman: If he can get the project, I'd take it. I am not against the participation, and not against the program, but we keep delving into funds in the middle of the fiscal year, $2,000 here and there, and with the budget as tight as it is, it is going to be a problem. I'd like to recom- mend that this matter be considered in the next budget. Councilman Snyder: May I ask, if we don't do this, do we lose benefits? Mr. Aiassa: The City pays. Mayor Krieger: Have the employees been making up the difference? Mr. Aiassa: Difference between a dollar or two, yes. We have four and a half months to go• Mayor Krieger: I am bothered by the timing. We went through this with reserve officers two weeks ago. Here's a recommendation that should, more -21- • 0 • C. Councilman Nichols: I think the City Manager might r-emind the Council, periodically, on items that we might.like to incorporate that we.haven't budgeted for. I think our own employees must be aware that the money doesn't come from a bottomless well and that we do have to budget. I think this matter should be considered concurrently with the budget formation for the next fiscal year with the summary reports from the Gold study. Councilman Snyder: I agree, because previously we agreed to participate to the amount of $8. It was up to the employees to pick out their own insurance company and benefits`: It is partially due to the insurance they are using and I don't think we could or should have anticipated this rate and our action did not indicate that we would go along with A rate increase. If their carrier charged more, they had to pay it. We may change this in the next budget. Motion by Councilman Nichols, seconded by Councilman Gleckman,and carried, that the recom}nendation of the Personnel Board, contained in their report of March 9, 1967, be held over to an appropriate study session during the period when the Council reviews the 1967-1968 budget. Councilman Gleckman: I believe that matters of this type should be discussed in the study session with the Personnel Board so that they will under- stand our obligations to the community as far as the spending of money is concerned. The justification may be all well and good, but I don't think they did take into consideration the budget procedure and yet they have full knowledge of it. I would suggest, on matters pertaining to additional money, where they do not come to us and discuss as to how, where and why, that'they should hold these over and request .a study session. Councilman Gillum: the date when this increase went Mayor Krieger: name and position in the City. Mr. Aiassa, I don't find any place where it is indicated into effect. Councilman Snyder: I'd like to refer to the Traffic Committee consideration of the removal of that crosswalk, plus all mid block crosswalks, because I think they are the most dangerous kind of crosswalk you can have. If there is a way of putting in a temporary crosswalk for the school only, with a guard, I wouldn't object to it, but some of the neighbors tell me there is screeching of brakes there practically every night from people not seeing pedestrians in the middle of the block where it is not to be expected they will be, especially on a busy street. Mr. Aiassa: Would you like to make the recommendation that the Traffic Committee investigate all locations where we have mid block crossings, and report back the number that we have, the location and condition that exists? Councilman Snyder: Notonly review it, but consider this recommendation for removal. CITY/COUNTY PUBLIC AUTHORITY Status (Mr. Aiassa presented his report, advising the Council that a Board had been formed and officers selected; that the mailing address would be 1444 Garvey. Mr. Aiassa gave a summary of the activities of the Board and advised the Council that there would be some incidental expenses.) Councilman Snyder: We have already had a.lot of requests for money for certain matters corresponding to the Civic Center and it seems there should be a special fund. How much do you need? Mr. Aiassa: Councilman Gillum: Mr. Aiassa: regular operation expenses. $300. The County has picked up some expenses. Are we to provide Clerical help? No, my secretary will carry that. C. 3/13/67 Page Twenty -Eight COUNCIL COMMITTEE REPORTS - Continued which is composed of businessmen on Glendora Avenue and we discussed the problem of the pictures that were taken on the previous Sunday and the problems that these people face as far as trash and things of that nature. I asked them if they.could give me suggestions which I would ask the Council to pass on to theappropriate people: I have received a letter from Mr. W. G. Beem., Chairman. It seems that they made a request a few months ago that the sidewalk that was either to be filled in, or something done to it, betaken care of. Apparently they have a problem of dust flying into the stores. It is between the service drives and the street.there. There are some trees planted there, planted by the merchants. Mr. Aiassa: We planted them. Councilman Gillum: I would like to request the Council to give consideration to the suggestion that there be.some type of electrical signal placed at the corner of Glendora and State Streets. During the heavy traffic the cars are backed up and cannot move. I would like to have the Traffic Committee reflect on this. It does create a problem at the corner of State and Glendora. There should also be some type of sign, stop sign, put at the corner of the entrance to the Greyhound Bus of the service road. I would like to make these recommendations for the Traffic Committee's consideration. Motion by Councilman Gillum, seconded by Councilman Gleckman, and carried, that the Council refer to the appropriate staff the following recommendation for consideration and report back to the Council. Additional sidewalk or cement work to the walk way between Glendora and State Streets; consideration for .an electric signal at the corner of Glendora Avenue and State Streets, and also.on Glendora Square, a stop sign at the corner of the entrance to the Greyhound Bus Station service road. Councilman Gillum: We are having a meeting on Thursday evening with the Blue Ribbon Swimming Pool Committee and we have comedown to some.points where we practically all agree. I do not think we are too far away from the Blue Ribbon Committee making their recommendations in a written form and presenting them to the Council. Councilmen Nichols: Nothing to report. Councilman Gleckman: Our meeting Thursday night with the Annexation Committee will be their final scheduled meeting regarding their supplementary report to us and final status of the annexation report.. Apparently, the entourage is much less than originally contemplated. Council Gleckman: accord with supporting going up, but I am not you have received. Mayor Krieger: trip is concerned. The day Azusa Avenue opened, I mentioned to a repre- sentative of Home Savings whether they were still interested in a Municipal golf course in the area and he said that they possibly were.. I am wondering, since this was carried quite far at one time, if we shouldn't contact them again regarding the possibility of a municipal golf course in that area. Mayor Krieger: May be the staff could be requested, if the Council desires to, to pursue this preliminarily and if there appears to be some area of interest to us both, perhaps something can be done.
