AMENDMENT NO,, 77 • CITY INITIATED (Abatement of Nuisances) APPROVED Request .for amendment to Municipal Code concerning the abatement of certain nuisances in residential zones approved by Planning Commission Resolution No,, 1930,, Hearing closed November 28, 1966; held over for report from City Attorney and staff,, Councilman Snyder, I would say that "A" has been improved enough to make it acceptable, but "B", particularly with regard to play equipment, I can see perhaps on some cul-de-sac streets or side -on lots where play equipment could conceivably be put there, however, not under this section,, Councilman Nichols, On the other areas that were corrected they substantially reflect the thinking of the Council,, I don9t think much was said about Section B,, I thought that there is still a statement in "B" .that tends to equivocate, in my opinion, leaving it open to difficulty of enforcement even if they tried to be fair,, City Attorney, Mr,, Williams, Courts have been very lenient as lone as you set forth some administrative guide,, Where you have enumerated certain things and say "and similar", almost universally the courts have approved that,, I think legally it is a sufficient administrative guide,, • Councilman Nichols: I am not quite certain that I would go along with banning recreational type of equipment from yards,, I approve of "A", "C", and I'D" without any equivocation at,.__a11., __..,'PB" I am skeptical about,, Councilman'Snyder, I tend to`;Agree,, m7® f, • C� C, Co 12/12/66 AMENDMENT NO, 77 - Continued Page Eight Mayor Krieger. In SubSection C the words that bothered me were "such as", I was concerned that we are limiting the items by that choice of words, Might not we be better served by saying "including but not limited to"? City Attorney, Mr, Williams. I think it means the same thing, I think the "such as" includes most the things intended by the Planning Commission to be prohibited, If you wish to make it more embracive, I think your suggestion would be a good one, Mayor Krieger: If this is what the Planning Commission was talking about, I think this is what we ought to use, But, if the Planning Commission was talking about something broader and used them only as illustrations, I don't like the language, City Attorney, Mr, Williams. I think the point is well taken, If there are other specific objects you wish to prohibit, I think they ought to be enumerated, Mayor Krieger. What would the Council think of taking "A", deleting "B", taking "C" with the semicolon after "equipment", and taking "Do'? Councilman Nichols. I would support that, Councilman Snyder. I would 'go along with that, Councilman Gillum. I would support that, also, City Attorney, Mr, Williams. The wording in the first paragraph as I have written the ordinance simply has reversed the 24®hour provision to a different place, I think the meaning is precisely the same though the wording is a little bit reversed, Councilman Nichols. "State of repair; disrepair". That bothers me, City Attorney, Mr, Williams; My ordinance is a little different than that; "Any automobile, motorcycle, boat or other conveyance in a state of being repaired, dismantled, immovable, assembled or disassembled, , is the way I have it, ORDINANCE INTRODUCTION Code Section 4135 City Attorney, Mr, Williams: The City Attorney presented. Parking Lot dated December 7th, 1966, Mayor Krieger; The question is does this Council have any jurisdiction over a school parking lot as far as lighting or bumper stops are concerned? City Attorney, Mr, Williams: We have an ordinance that requires of all persons certain lighting and bumper stops that would apply to the school district if it is reasonable, and they have the right to appeal if it is not reasonable, Mayor Krieger: This is an objection by a citizen asking that this Council take action to install speed bumps and additional lighting on a school parking lot, City Attorney, Mr, Williams: I would say that it is entirely inappropriate, It should be addressed to the school district, Motion by Councilman Snyder, seconded by Councilman Gleckman, that this letter be referred to the West Covina Unified School District and that the writer be informed that we have done so and that this is not within our jurisdiction, Councilman Gleckman: I would also like to request some information coming back to us from the school district so we know what the disposition of this matter was, Councilman Nichols: Mr, Aiassa, was -that particular parking area, which is unique to any school in the City in that it is a continuation, in effect, of a dedicated street, was that parking lot ever dedicated to the City? City Attorney, Mr, Williams: I don't think that is intentional, Mayor Krieger: I don't understand this 8119, The proposal, as I understand it, is to retain the first paragraph of the existing ordinance, City Attorney, Mr, Williams: Yes, The purpose has been to include in 8118 certain provisions that formerly were in 8119, 8119 .formerly exempted public swimming pools and swimming pools on premises of hotels, motels, or apartment houses, If the City Council approves the proposal, the requirement of fencing would be made to apply to swimming pools on the premises of hotels, motels, and apartment houses which now are exempted, Councilman Snyder: I think in an inner court that the walls of the apartment building should constitute a fencing providing there are adequate gates at the opening, Councilman Nichols: Councilman Snyder: I will withdraw my motion, I will withdraw my second, Motion by Councilman Snyder, seconded by Councilman Gillum, and carried, that this matter be referred back to staff for explanation of the recommendations given; secondly, that swimming pools on inner courts on apartment houses, hotels, or motels, that the staff consider strongly not requiring, fencing there. City Manager, Mr, Aiassa: If you do, we had better have sufficient data to substantiate our stand, The P,U,C,'s job is to determine rate increases or rate standards, City Attorney, Mr, Williams: We can request that we be furnished with a transcript of that which takes place at these hearings, We would have to pay for it, The staff of the P,U,C, represents the consumer, They would represent the same thing normally that the City would represent, Mayor Krieger: I think we would be better served • to get a report from the staff as to the type of deliberations they engaged in Wednesday and then make our determination whether we want a transcript or not, Councilman Gillum: City Attorney, Mr, Williams: Perhaps we could use our tape to tape these meetings, That would be up to the presiding officer, -16- 1-1 0 C, C, 12/12/66 WATER.
