MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
OCTOBER 249 1966
The regular meeting of. the City Council was called to.order by Mayor
Krieger at 7:30 o'clock P.M. in the West Covina City Hallo Councilman
Nichols led the Pledge of Allegiance. The invocation was given by
Mr. Robert Flotten, City Clerk.

Mayor Krieger: On Page 5 in the middle of the
page the motion by Councilman
Snyder and seconded by Councilman Gillum, and carried,, to°accept the
recommendation of the Planning Commission which is to leave it as it
is now and reconsider it when the interchange is in at Pacific
Avenue and this should indicate this was the Planning Commission's
recommendation on Item No, 1.
Then on Page 22 at tjig bottom
of the page having to do with the League meeting and the motion for
appropriation, I believe the word "each" should follow the figure
$1.25.00 so that the motion reads: `o. . . and their expenses to be
reimbursed not to exceed $125000 1each.

being placed on -the exterior part of the building was that the

competitors have modern buildings and windows on which to pla.c.e signs,

public welfare or injurious to property or improvements to the
surrounding vicinity or conflicting with the General Plan,

comments on this matter a
statement was made to the effect that studies made by the Commission
or on its behalf indicated that no other like business in like area
has been afforded this privilege, Gentlemen, we are talking about
the ability of businesses to advertise by signage, As our sign ordinace
is presently created, if a store has a solid glass wall'it can have
a solid glass wall of signage, If a store happened to be an older
store, if the present owner had no type of control over the type of
wall, this owner can put no sign on the exterior wall in excess of
the normal signage limitations, This market has a few very high
windows that are virtually unusable for this purpose, Right down
the street within a block of this market is another market with low
glass windows and specials and advertising signage all over those
windows, I feel this man is being discriminated against when we
tell him he cannot place -his signs on the exterior of -his building
to compete with like businesses in similar area who can do so through
their large glass wall, I feel he is entitled _t--_o this variance and
this relief and I shall vote for it,

signs made of?

Councilman Gillum.- The front of the store has an
overhang which would protect
the signs but on Dalewood what happens to that sign when it rains?

on that side of the street in comparison to the front,

what handicapped if you would

Councilman Snyder-, This. is a.particularly dis-
turbing request.because I believe
in the principle.and the provi.s.ions.of the sign or_dinance_. However,
it demonstrates one thing; the inability to write a.sign ordinance
that covers every s.ituation9.a.ndg secondly, if -you are to interpret
the inflexibility,, -the Lack of pro.vis..ion.s...in the _sign...ordinance to
allow these.. possi.bl.y...nec.es.sary... slight. ..changes...that....wo.uld__meet
the needs and ..the_.pur.po_ses...o.f__the... sign-. o.rdinanc.e... ..There. is.. no
doubt that. the s.e.....signs...as._.propos.ed.....are_not.according.. to the sign
ordinance. However., he could have them behind those windows and
perhaps they wouldn't look.as well -as the ones he has up. I am
wondering if the Planning.Depar.tment in their.study of the sign
ordinance couldn't take into account this need of grocery,stores
and similar type establishments to use this kind of signage and make
provisions for it. If we don't approve this -:variance for a term of
one or two years subject to the final findings of the Planning
Department, have it submitted before us at that time if it is still
illegal. I would say he should take the ones down on Dalewood.
Mayor Krieger- What is the legal effect on

requested. variance was held over to a date sometime in the future
commensurate with the return of a report that this Council has ordered?
What would be his legal standing in the interim?

the matter would still be
pending and while there is nothing written in the books to this
effect, it has.been a precedent that while a matter is pending no
prosecution ensues,
Mayor Krieger-, What is the significance of the
hearing being either opened
or closed as long as the matter was still pending before the
Council?
City Attorney, Mr, Williams.- If it is closed there pan be
no further evidence in7roduced
or anyone heard on either side of this matter.
Mayor Krieger.- The'Council-could at some
subsequent date always reopen
the hearing on its own motion.
City Attorney, Mr. Williams-, You would have to readvertise it.
• Mayor Krieger.- I feel constrained by the law
of this community as represented.
by our sign ordinance in respects and particulars I mad not
necessarily agree with but I don°t think it is a subjective considera-
tion. I think it has to be an objective finding what the ordinance
is. Once having determined whet the"law is, I think this Council as
well as its successors and individual members are bound by them.
I don't find the required showing to indicate that this property
being in. -the C-1 zone as it is enjoying the sign priviliges as it is;
stated in the Planning Commission's report has been granted to any

I have no interest in the property, Mr, Nelson had that machine ordered
for another piece of property, The escrow did not go through and the
manufacturer had to get this out of the plant, Mr, Nelson bought this
property since it was C=1 and placed the machine on the property until
he could process his precise plan, This property and the hot dog
property had to be paved at the same 'time because of the drainage,
This is the chance he has taken, This is a vending machine, It
does not manufacture ice, It stores ice, The ice is cut up and
put on belts, There is no manufacture of ice at all,

Cml zone, I don°t have too much feeling about that one way or the other..

ordinance doesn't set any limits on what a vending machine is by

but not as a matter of right, which in my opinion can delay the
• thing forever, if somebody indicates that they want to say something
the Chair may permita comment upon something that may have been..
said here that did lead to an erroneous conclusion, If 'it is a
matter of right, who has the last word? I think in every judicial
proceeding there has to be a termination date,
Mayor Krieger; Having sat on the Council where
we had gone into the late
hours of the morning following procedural rules that were open as far
as people joining in to the Council's portion of the discussion with
the. power being vested in the Chair to determine when such a privilege
could be exercised, not as a matter of right but as a matter of
privilege, I have not felt either as the presiding officer of this
Council nor as one of the Councilmen when I sat on this Council that
this was something that lent itself to the handling df.the business
of this City, There are many matters that appear on the non -hearing
portion of this Council which are quite important, as important to
this City and to.the 63000 people who are not here as some matters

I will withhold appointments to this committee until the first regular

SISTER CITY APPOINTEES
Mayor Krieger- We received a communication from
Mrs,, Hazenbush having to do with
the appointments but there was a statement having to do with the
position of our present appointees Mrs,, Cordon and Mr,, Rogers,, I
took it upon myself to contact both Mr,, Rogers and Mrs,, Gordon to
find out if their position was that they did not desire appointment
again to the Sister City or whether.or not they were not seeking
reappointment,, I think there is a difference,, I was advised by both
Mr,, Rogers -and Mrs,, Gordon that they were not actively seeking re-
appointment but that if the Council felt a desire to reappoint them
that they would accept such reappointment,,
Councilman"Nichols- It is my understanding that there
is a possibility that there may
be some conflict between the existing internal leadership of the Sister
City Group -and one or more of the two appointees this Council has had
representing theme It would seem to me if there is any possibility
that this is true that we would be defeating our own purposes by making
any appointments that would perpetuate any conflict that might exist,,
Therefore, I think that I would
move that the Council hold this matter over again to its next regular
m..eeting and that in the interim the Mayor be directed to communicate
with Mrs,, Hazenbush to inquire into this area in a suitable fashion
in order that this factor may be clarified,,
Councilman Gillum- Second the motion,,
Mayor Krieger- I am judging Mr,, Rogers and Mrs.
Gordon on their performance
and their responsibility to this Council,, I have been more than
satisfied with them participation in the Foundation and in the
completeness of their reportso- I hope there is not any type.of
internal problem that has existed -in the -past,, I think this Council
must make its appointments based on the qualifications of the people
we have before us,, I feel these people have by their last work
merited reappointment to this Foundation and it is up to the Foundation
to work out its internal problems, not us, if such problems exist,,

CITIZENS COMMITTEES
Mayor. Krieger-, We received the report of the
citizens' committee on the
Civic Center two weeks ago. I think it would be appropriate if this
Council -were -to consider the adoption of resolutions to the co-
chairmen of this commitee and some type.of certificate to the
individuals who served as citizen representatives on the committee.
Councilman Nichols-, Probably this need will come
up several times in the future
and I think it might be appropriate if we would direct the staff
to see what they might be able to design in the way of a standard
certificate for participation in the levels where it would require
other than a resolution.

carried, that the -Council direct -the City Clerk to prepare
resolutions of appreciation to the chairman and co-chairmen and any
others designated -by -the -Mayor -among -those who served on the
Civic Center Committee; and that --the Council further direct staff
to investigate -the possibility of the preparation of certificates
for awarding to other members of that committee and other committees
in the future.

Councilman Gillum-, I received a call this past week
from a woman by the name of
Mrs,, Johnson who was quite upset,, She is served by one of the water
companies in the community,, I am opposed to municipally owned water
companies but I do feel there are areas that we have an obligation
to the community,, She is paying somewhere as much as five to six
times a month as normal rate within the City,, (Gave summary of
this matter,,) . I.would like for the staff, if they could, to give
us a report on the variance in rates throughout the community of
West Covina served by the different water companies so we may be
better informed as to the diff.erence.in rates and, if possible, get
some explanation as to the difference in .rates throughout the City,,

Covina Beautiful to have the
