The invocation was given by Mr. Robert Flotten, City Clerk. Sullivan_ The signs.in.question are a very 1.26 South Glendora important factor to.the success West Covina of my business known.as the Center Market, We did not know at the beginning of the construction _oo.the building that a permit was required for this type.of.sign.o The reason for this type of sign being placed on -the exterior part of the building was that the construction of: the -building made.it mandatory to do so, Our competitors have modern buildings and windows on which to pla.c.e signs, The granting of the.var..iance..in..no way will be detrimental to the public welfare or injurious to property or improvements to the surrounding vicinity or conflicting with the General Plan, IN OPPOSITION None There being no further public testimony, the public portion 6f the hearing was closed, Councilman Nichols In the Planning Commission's comments on this matter a statement was made to the effect that studies made by the Commission or on its behalf indicated that no other like business in like area has been afforded this privilege, Gentlemen, we are talking about the ability of businesses to advertise by signage, As our sign ordinace is presently created, if a store has a solid glass wall'it can have a solid glass wall of signage, If a store happened to be an older store, if the present owner had no type of control over the type of wall, this owner can put no sign on the exterior wall in excess of the normal signage limitations, This market has a few very high windows that are virtually unusable for this purpose, Right down the street within a block of this market is another market with low glass windows and specials and advertising signage all over those windows, I feel this man is being discriminated against when we tell him he cannot place -his signs on the exterior of -his building to compete with like businesses in similar area who can do so through their large glass wall, I feel he is entitled _t--_o this variance and this relief and I shall vote for it, Councilman Gillum. - What type of material are these signs made of? Mr, William J, Sullivan.- It°s a water base, Councilman Gillum.- The front of the store has an overhang which would protect the signs but on Dalewood what happens to that sign when it rains? I.agree that this man is some- what handicapped if you would compare _ this. ...with._.any ...other.._market .in the.. community... Councilman Snyder-, This. is a.particularly dis- turbing request.because I believe in the principle.and the provi.s.ions.of the sign or_dinance_. However, it demonstrates one thing; the inability to write a.sign ordinance that covers every s.ituation9.a.ndg secondly, if -you are to interpret the inflexibility,, -the Lack of pro.vis..ion.s...in the _sign...ordinance to allow these.. possi.bl.y...nec.es.sary... slight. ..changes...that....wo.uld__meet the needs and ..the_.pur.po_ses...o.f__the... sign-. o.rdinanc.e... ..There. is.. no doubt that. the s.e.....signs...as._.propos.ed.....are_not.according.. to the sign ordinance. However., he could have them behind those windows and perhaps they wouldn't look.as well -as the ones he has up. I am wondering if the Planning.Depar.tment in their.study of the sign ordinance couldn't take into account this need of grocery,stores and similar type establishments to use this kind of signage and make provisions for it. If we don't approve this -:variance for a term of one or two years subject to the final findings of the Planning Department, have it submitted before us at that time if it is still illegal. I would say he should take the ones down on Dalewood. Mayor Krieger- What is the legal effect on •this plan°s rights if the requested. variance was held over to a date sometime in the future commensurate with the return of a report that this Council has ordered? What would be his legal standing in the interim? City Attorney, Mr. Williams-, If the hearing is kept open. the matter would still be pending and while there is nothing written in the books to this effect, it has.been a precedent that while a matter is pending no prosecution ensues, Mayor Krieger-, What is the significance of the hearing being either opened or closed as long as the matter was still pending before the Council? City Attorney, Mr, Williams.- If it is closed there pan be no further evidence in7roduced or anyone heard on either side of this matter. Mayor Krieger.- The'Council-could at some subsequent date always reopen the hearing on its own motion. City Attorney, Mr. Williams-, You would have to readvertise it. • Mayor Krieger.- I feel constrained by the law of this community as represented. by our sign ordinance in respects and particulars I mad not necessarily agree with but I don°t think it is a subjective considera- tion. I think it has to be an objective finding what the ordinance is. Once having determined whet the"law is, I think this Council as well as its successors and individual members are bound by them. I think it would be appropriate if this Council -were -to consider the adoption of resolutions to the co- chairmen of this commitee and some type.of certificate to the individuals who served as citizen representatives on the committee. Councilman Nichols-, Probably this need will come up several times in the future and I think it might be appropriate if we would direct the staff to see what they might be able to design in the way of a standard certificate for participation in the levels where it would require other than a resolution.
