Assistant City Engineer, Mr, Zimmerman-. There are 44 palm trees actually in existence to be moved and the estimated cost should be $150 per tree, The figure in the report is incorrect. Action on Councilman Snyder's motion-, Motion carried, SANITARY SEWER DISTRICT A'11®59m1 LOCATION; South Garvey and ASSESSMENT PAYMENT Merced Avenues, BOND NO, 9-17 Gross 6 Company, Inc, Review Engineer's report regarding APPROVED assessment, Staff recommends that the Finance Officer be authorized "b pay this assessment in the amount of $307,15, Mayor Krieger: When the assessment roll was first formulated for this particular project, why wasn't it picked up as to the State owning this property? Public Services Director, Mr, Fast: The only think we can get from the record is that in 1959 when the assessment roll was made out, it was an error, City Attorney, Mr, Williams: Sometimes the record ownership changes after the assessment roll and if we rely on the assessment roll, we are not always sure of a change of ownership that has occurred quite recently, It is possible that this is nobody's fault, The State acquired it but the assessment roll showed it as private property, We get caught in this every once in a while. Public Services Director, Mr,, Fast: I can give it to you approximately,, There was a small triangular •piece of land that the City attempted to obtain so they could put two lanes through to Sunset approximately 100 feet long and perhaps six feet deep,, As I recall, the judgment was that the entire right- of-way on the Walnut Creek or Service Avenue side must be obtained,, In other words, the ten feet immediately behind it,, Then subsequently as part of the settlement, an amount was settled with our attorney which would give us the ten feet on Sunset Avenue as well,, Councilman Nichols: What was the cost to the City for that parcel? The Chair has which I would like to read into "The land valuation has been confirmed on the assessment roles as $2579920.00 as reproted at the meeting of June 27th. There is required legally for protests 50% or more of this figure in order for the protest to be sufficient. 50% of the land valuation is $128,960.00. At the meeting of June 27th the City Clerk advised the Council that written protests amounting to $79150.00 had been received. Legal objection is that the •courts have held that once a matter is passed from the Planning Commission with a favorable recommendation to it, the Planning Com- mission has no jurisdiction. If it is sent back, it would have to readvertise to hold further hearings. Also, there is the legal objection that the Council holds a trial de novo, a new trial, completely independent of what was heard in front of the Planning Commission and not rejecting anything which would be prejudicial and proper to the proponent. This may thwart what the State law says. The practical objection is that if you have to send to the Planning - Commission any case where new evidence is offered, it would offer the opponents the opportunity to always offer new evidence, thereby delaying the conclusion of the case, making the Planning Commissio-n. hear it twice, having it come back to you, you hear it twice, and what's to prevent it happening a third time and a fourth time and a fifth time? Then we grant authorization -to negotiate with...the..s.cheol district pertaining to their particular portion of the project, They play a major role in the percentage of the total improvements, -22- • • • C, C, 7/'11/66 Page Twenty -Three I�ARIC EL LEN IMPROVEMENT ®Continued Councilman Nichols-, There is an element in this that concerns me o -If-we go on to a given section such as we did earlier in this evening where private property owners at their own expense improved a majority of the area and a minority of property owners remaining have not improved it, I can see the justification in my own mind for the use of the 191.1 Act in that it is the will of the majority speaking, But it seems to me in an instance of this sort where we are utilizing the great majority of people that is public property that some different implication attaches itself to creating a district and improving a district which in effect gives no possibility whatsoever that the residents in that area could, in fact, protest it out of .existence, It seems to me it is more a device and I'would suspect -m Councilman Gleckmano I see where those remarks -have a lot of merit, It is just unfortunate that we are talking about this area first and not some other area, I think the job should. be done and 1911 Act is the only way we are ever going to get it accomplished, I feel that in this particular instance with the City and the school district owning the majority of the land, the City might pay for the sidewalks, which is usually recommended near the schools as recommended in No, 4 and the right-of-way, but the curbs and gutters should be paid by the property owners, Councilman Nichols-, Councilman Snyder-, lines -of -Recommendation No,,-4 will pay for walks, pavement be charged under the 1911 Act acquisition, Mayor Krieger-, That is -in -keeping with my thinking. From the very beginning many many months ago when the matter of development of the Civic Center came up and the initial discussion following the defeat of the Civic Center Bond Issue revolved around lease -purchase, •I took the position -in opposition to that and took the position that the Council should return first to the voters. In the -long months after that -have -intervened since then the City Council has been constantly-f.aced.with gravely increasing pressures -for housingour police facilities, our City Hall facilities and in fact, we are spending thousands and thousands of dollars to,try-to provide. temporary facilities Subsequent to the time I took the position that I did, the Legislature of the State of -California passed an enabling ac-t-that provides for a city to participate -with other powers in joint authority projects. Since that vehicle first -became available, I have studied the matter carefully and I have determined for myself two important points-, One, that the cost of financing a development under a joint powers agreement would be identical --with or closely identified with the cost of acquiring facilities under. the traditional bonding approach. Page Thirty Is.there any Councilman desiring to have that City Council parking area preserved?. I think it is senseless. The staff will be directed to remove that sign on their way out tonight. You have authorized me to go ahead on the Civic Center and the Annexation. We had 54 responses as first preference on the Civic Center and 11 for miscellaneous. This would make 65 people. This may be an unwieldy committee but we wanted everybody interested in finding out about this subject matter to work with it and on it and to have the opportunity, at least9 so the strategy is to have two orientation meetings and I believe they are the 19th and the following Wednesday, the 27th. They will be held at the City Hall. The lx,zr pose of these orientation meetings will be to indicate the function of a citizens' blue ribbon committees to provide them with some back- ground on the Civic Center, to provide a guided tour of the City Hall and the Police facilities that we presently have, and some indication to them as to.the time requirementif their participation is going to be forthcoming on this particular matter. From this we intend to poll the people attending these orientation meetings for those that seriously desire the appointment to the committee. All those who indicate the desire after the orientation meeting will be appointed to the committee. I am going to ask Councilmen to serve as Council liaison on these committees. Councilman Gillum already has one, the Central Business District,, The Civic Center I am going to ask Councilman Snyder to be Council, liakson. On Annexation Committees, we have 16 affirmative responses of people interested' in this. All 16 will be appointed to this committee, and assuming that their interest is still in existence and we are going to ask Councilman Gleckman if he will act as Council liaisDn with that committee. There will be staff assistance available. COUNCIL COMMITTEE REPORTS CENTRAL BUSINESS DISTRICT Councilman Gilliam. Representatives of the City have met with different large firms and discussed what the City has to offer. We are stall in the process of contacting these people and getting their feelings and trying to determine the direction. At the moment, it is somewhat of'a standstill because we are investigating different areas in which to approach on new businesses, things .of this type. I asked this evening one of the people involved in the protest why he was against the City as far as annexation,, Actually he first commented that he was not in agreement in the type of literature or information being given by the annexation against to the City of West Covina and.he would so state at his next committee meeting, within that group that he belonged,, But, he did state that personally he feels he would not like to annex to this City because he felt that the City was not progressive enough and that some of the other cities surrounding the City of West Covina were much more progressive in that they have a new city hall, et cetera,, PUBLIC RELATIONS Councilman Snyder-. It has been brought to my attention that perhaps in the area of public relations that the news media could perhaps write more objective stories if they had access to more background material other than what they can glean out of the Minutes and sitting .here.
