This is the time and place for the public hearing. Mr. William M. Martin No external changes, no additional 1132 East Vine buildings, no partitions, no visible West Covina changes from the external modifications whatsoever of the building are required. It is desired to use one of the interior rooms for an instruction class in real estate only. If it is modifiable, I think the choice of "business school" was not right. It®s much too broad. It should have been a real estate license school. Unless there is a sign in the front, no one would ever know there is one going on in there. I believe we do need a sign. There have been variances already granted in this building. This is an internal use of one of the rooms. You can put any modifications on it you want such as,no change, no increase in size, limited naturally to the number of students the Fire Commissioner would allow, et cetera. The parking space for.the building is 18 cars with a 2mcar slab. The maximum as we estimate it that we can use in the room is 20 people. Every use that is there now has an average of at least ten a day. This particular use would be two.nights a week for a period of two and a half hours. There is adequate parking. It comes at a time different from the day uses of the tenants. I believe a school of this kind with the conditions you can put on it are not really a trade school in the sense that you have the term classified in your zoning ordinance. I feel there should be another classification of a business license school. I think it does properly belong in an R®P zone. The room will be Room P. a 20 by 20 foot, 400 square foot room and we submit that we would be having a totalthen of 40 people, 20 people twice a week, which is nowhere the use that any other use gets. They are a dignified, quiet bunch; they are ambitious; they have paid for something; they want their money's worth. I submit to you that there has not been proper cognizance taken by the Planning Commission on the fact that this is a purely internal use of an existing building without change or modification. It doesn°t add to the pressure for change of zone because nobody would ever know there is a school there unless there is a sign in front saying this is a real estate school, and you have control of that sign. The building is 49000 square feet, nine offices. We will be using 400 feet in the back part of that building if this use is granted. The interest to the applicant is seller of the major.interest of the Hubbard Schools to Mr. Hanich. Mr,, Mike Hanich I was in the hospital when this 2222 West Garvey came up before the Planning West Covina Commission and I am sorry we didn't have a chance to present it the way I thought it could have been presented so the Commission could have understood it. The history of the property, although it's R-1 now, used to be Cml. There used to be a market there. The Planning Director at that time after the freeway went in initiated a general plan because fruit stands and guys would park a truck at the back end of Cml property and sell bananas and oranges, -17- C, C, 6/27/66 'VARIANCE NO, 591 Continued Page Eighteen • et cetera, This is the reason all of the property that was C®1 alongside the freeway became R®1. That created a whole lot of hardship properties, I think I have as nice a looking building there as possible and there hasn't been enough guidance furnished to the neighbors to develop the area, The uses we have proposed,, there won't be anything additional to what is already there, I paid for the alley; I paid for the curbs and gutters; the fire lines going in; the street lines, (Read prior Minutes and records relating to this property and its use,) I don't think you have -had any exceptional complaints from my property. I hope you will allow us to use this property for the school, I don't think allowing the sign would be detrimental, INOPPOSITION Mr, Kurk F°ib.iger I am here in opposition of this 1020 South Willow ..because.I.am more interested in West Covina what the sign would be, Mr. Hanich has run a very good business. since he has been there, I am adjacent property owner,, first house to the south, I don't like to see any signs that may be lighted,, something Of the flashing type,, anything along that line,. If I could get more information -as to signs, then my opposition might not be so strong REBUTTAL • Mr, Mike Hanich: replace one that we have would be a plastic front until ten o'clock in the The sign that.we propose would be four -by -ten that would either or we would like to put it adjacent to, It with a neon back.to_.it to be lit somewhere evening until the school closes, There being no further public testimony,, the public portion of the -hearing was closed, Councilman Nichols. - Mr,, Mike Hanich.- Councilman Nichols. - Planning Director,, Mr, Joseph. - Councilman Nichols: Are your present signs lighted at night? No,, they are not, Mr, Joseph, what is the existing variance on the property? R®1 zone to permit R-P uses and R®P signs, R-P uses normally do not include instructional schools? Planning Director,, Mr, Joseph: Trade schools are permitted by right in a C®3 zone, The •Planning Commission made the interpretation that trade schools are permissive uses in the C®3 zone but if the graduates from a school would then be placed in professional office buildings,, the question therd'had to do with law, real estate,, bookkeeping,, this type of activity,, then that type of school was permissive in a Cml zone, Councilman Nichols: Mr, Hanich,, would you enumerate the precise uses that are going on in your building at this time? i Ca C, 6/27/66 VARIANCE NO.,, 691 Continued Page Nineteen Mr, Mike Hanich-, The County Agricultural Construction Office, loan company, fire ... extinguisher company, insurance adjuster, two real estate offices, cigarette sales office, the property management division of the Veterans? Administration, Councilman Nichols° All those in the opinion of the Planning Department are R®P uses? Planning Director, Mr, Joseph-. If they were purely office usest of an administrative, business, or professional service, they would be permitted in that building, Councilman Nichols-. My own feelings about this are that where the change is in an internal sense and where it is a use that truly might be considered to be borderline relative to the current variance and have no exterior effect, I certainly personally would not have objection to it but I would have a very strong personal objection to the establishment of any type of signage and lighting of signage that would create a change in the exterior appearance of the neighborhood, I believe a night lighted neon sign would definitely do that, Councilman Snyder-. Mr, Joseph, do.you know the reasoning behind putting a school of this type in C®1? Is it because of the amount of parti- cipants and the parking? Planning Director, Mr, Joseph-. I really can't answer that, The Planning Commission was asked to make a determination a couple of years ago and they so determined. Councilman Snyder: Are you going to replace one of these signs with this sign? Which would you replace if you did this? Mr, Mike_Hanich-. The one saying "Offices", Councilman Snyder-. Certainly this is an over -signed building and if they are going to replace one of them with the minimum of words, perhaps the others could be renovated, Councilman Gleckman; I am concerned not so much as the usage for the use that is being asked for here but whether the setting of a precedent is in order, First, there is no doubt in my mind that the area in which Mr. Hanich has his building is and has been a problem area in the City, but I am concerned with setting a precedent of a --real estate school in an improper zone as I am concerned with Mr, Haniches referral to his existing signs being given by variance and therefore an additional sign should also be allowed, if I interpreted his remarks correctly, I feel that it may .hot have been a mistake on the part of the past Commissions to allow such signage, but I do feel that this is over-signage on this property, As far as the usages concerned internally, I cant. -see where it would have an adverse effect on anything -in the City, but I am wondering as to whether the unique location of' this property is adequate grounds for us not setting a precedent in allowing this, I also would like to see the hours as stated by Judge Martin be specified in this application so that if this use is granted that it be restricted to the ®19m Co C,, 6/27/66 VARIANCE NO, 591 m Continued Page Twenty • hours that were commented on so that it does not become a usage that we would.allow9 if -allowed, full time. Mr, Joseph, how much signage would you say is on this property? Planning Director, Mr,, Joseph-, I think there are two forty --square® foot signs in front and the address, Councilman Cleckman-, What is normally called upon for this piece of property if it would come in today? Planning Director, Mr, Joseph-, Based upon interpretation of the Planning Commission, they could have two -for -one along Garvey and twomfor®one per frontage toward the parking lot, The frontage is 80 feet, The R-P sign regulations limit frontage signs to 75 square feet, Councilman Gleckman-, I would not object to this use if would so state that I would not object it were on a limited basis, I to this use because of the location of this particular property in the City, Mayor Krieger-, What in this application for a •variance suggests that it is Limited? Is there anything in this application for a variance that suggests what the extent of the business school use will be? Planning Director, Mr, Joseph-, In the application itself, Mayor Krieger-, At any time has there been anything presented to the Planning Department or the Planning Commission, to your knowledge, that defines that it may be interpreted by us as to, where or to what limitations this business school will be utilized on the property? Planning Director, Mr, Joseph; No, Councilman Gleckman-, Mr, Williams, would it be in order if we so desire to request removal and redesign of a sign with the amount of square footage being included in the application'if-.,this particular use would be approved? City Attorney, Mr, Williams-, If you approve this -usage and grant this variance, you can impose conditions not only with reference to the sign pertaining to this usage but you can impose any conditions that you want to with reference to any signs on the building, Councilman Snyder-, I personally would find it difficult to turn down the usage, I don't find .it difficult to at least make them trade one of the other signs for this sign and clean up the signs there now, Councilman Nichols.- This is the way that I feel, -20- C, C, 6/27/66 Page Twenty -One VARIANCE NO 591 Continued • Councilman Gleckmano Move that Variance No, 591, Mike Hanich Realty, be approved subject to the following conditions.- (1) That limited usage for a business school to be approved for a maximum of two and a half hours per night,, two nights a weeks, a total of five hours in all,- (2) That all signage conform to the R-P. zoningo Mayor Krieger: The motion dies for lack of a second, Councilman Snyder: Is the amount of hours suggested in that motion adequate? Mr, William M, Martin: I would suggest that overall we plan to use this two years before we plan to move, Our iht,6i66ed use would be two nights a week, two and a half hours a night, We have a hope of success and if this does develop, we would without trying to petition for it be allowed to have an afternoon class, two days a week, two and a half hours, maximum five hours a week; five hours during the afternoon at a later date, However, it must be borne in mind when we say two and a half hours, this is lecture time, There is a little delay in getting them in and out, • Councilman Snyder: Move that this variance be granted with the following restrictions: (1) That the time under which this school would be allowed would be a maximum of six hours at night and six hours in the afternoon; (2) That the business school use be limited to real estate school only, (3) That the portion regarding this variance regarding the sign be held over allowing the applicants to submit signs to the Planning Department mm I will strike the last part of that motion om that it just be approved as stated without the condition No, 3, I will withdraw that motion, Councilman Nichols: If the use is right, it would be immaterial to me whether they meet there 24 hours a day as long as they did not disturb anyone else and conform to all -the other conditions, The room itself is limited, I would make the motion that the variance as requested be approved by the Council and that the variance be conditioned on the approval of the total signage of the total structure.by the Planning Department of the City of West Covina,, Councilman Snyder: • Mayor Krieger: I will second the motion, Is there any description of the 20mbym20 room?
