The regular meeting of the City Council was called to order by Mayor
Krieger at 7:30 o'clock P.M. in the West Covina City Hallo Councilman
Snyder led the Pledge of Allegiance, The invocation was given by Mro

Mayor Krieger; I notice the participation as out-
lined in the memorandum of June 23
suggests that west Covina's share of this is $239790,00, Covina's
share is $129440.00, Ir appreciate the fact we have three of the six
intersections, but whaf is 'the jurisdiction over the other three
intersections?
Public Services Director, Mr, Fast; The map between your reports shows
the ones is "X" that do not fall
in the City and I believe these are on San Bernardino -- Badillo is
essentially a County portion signal all the way around. Going up to
San Bernardino, it is most likely 1000 of Covina, I believe the one
on Cypress has partial County participation and Covina,
Mayor. Krieger: So the only intersection that solely
and exclusively is within the
responsibility of Covina is one at San Bernardino and Azusa?

the annual report on status of sanitary sewer reimbursement agreement
be accepted and approve payment of reimbursement funds,
Mayor Krieger: The period encompassed within this
agreement is March 1, 1965 to
May 31, 1966, Do we have a total on this reimbursement?

attached to my information,
Mr. City Manager, the resolution
that is cited on Page 1 at the top of the page, Resolution No. 3273
adopted on December 13, 1965, was that the resolution that directed
the staff to combine our various zones into one assessment distridt?
City Manager, Mr. Aiassa: Yes,,
Councilman Nichols: Was there also the direction to
install additional fixtures or
bring new areas -into the lighting district?
City Manager, Mr. Aiassa: One resolution was to pay for
the electrical energy and
maintenance and also the installation. This is the district that
encompasses the entire City of West Covina.

be relative to the benefits.. I
don't understand the AFF, an abbreviation that appears here.

• Mayor Kriegers It is my understanding that in the
matter of annexation of inhabited
areas protests are made on the basis of land valuation only; no considera-
tion is given to improvement valuations,, Land values, as I understand
it, in this annexation is $2579920,,00,, Therefore, it would require
protests amounting to 50% of $257,920,,00, or $.128,960000
Any person owning real property
within said territory so proposed to be annexed and having any objection
to the proposed annexation may appear, before the City Council and show
cause in writing why such territory should not be annexed,, Such
protests must be in writing and shall state the name or names of the
owners of the property affected by such annexation and the location
and the area,, If at this hearing protests have been filed which are
insufficient to terminate further proceedings, which means protests
totaling $1289960,00, the meeting shall be recessed for a period of not

any normal piece of property and this is a water company pumping
station on there and a certain amount of pipe lines through there
plus also a chlorine storage area where they have to maintain access,
there are only.certain parts of the property that can be used, By the
time the City gets their setbacks and the State theirs,, the property
i.s limited'for what it can be used for, (Presented copy of the

explained same,) We have provided the driveway entrance on Azusa
which has been approved by the State; we have an encroachment permit
from the State on that, I certainly feel something like this would

Thirdly, before when this property came in for C-1 zoning, we discussed
the usages being too great as far as traffic is concerned and'I would
say in a display area of this type you will draw more traffic than you
would any type of place that would be doing some selling,, You would be
drawing lookers stopping on Azusa Avenue, which is one of the fastest
• travelled streets we have in this City,, I agree that the display would
be an improvement on the property but I disagree with the usage and
what it would bring,,

I would add, however, that they haven't met the grounds for a variance,,

the merits of the particular
display, under the law there is no showing here for a variance except
as it might uniquely apply to the owners of the land themselves,, This
is not a use that is being proposed by the owner for their own
purposes for their own property but rather a use to increase the
productivity of the property,, I don't think the way to relieve this
property is to ask for a variance under Rml,, If the use is justified,
the justification is in the zoning that should be on the property,
not on the hardship that has been imposed on the owner of that property,,

This is the time and place for
the public hearing.
Mr. William M. Martin No external changes, no additional
1132 East Vine buildings, no partitions, no visible
West Covina changes from the external
modifications whatsoever of the
building are required. It is desired to use one of the interior rooms
for an instruction class in real estate only. If it is modifiable, I
think the choice of "business school" was not right. It®s much too
broad. It should have been a real estate license school. Unless
there is a sign in the front, no one would ever know there is one going
on in there. I believe we do need a sign. There have been variances
already granted in this building. This is an internal use of one of the
rooms. You can put any modifications on it you want such as,no change, no
increase in size, limited naturally to the number of students the
Fire Commissioner would allow, et cetera. The parking space for.the
building is 18 cars with a 2mcar slab. The maximum as we estimate it
that we can use in the room is 20 people. Every use that is there now
has an average of at least ten a day. This particular use would be
two.nights a week for a period of two and a half hours. There is
adequate parking. It comes at a time different from the day uses of
the tenants. I believe a school of this kind with the conditions you
can put on it are not really a trade school in the sense that you have
the term classified in your zoning ordinance. I feel there should be
another classification of a business license school. I think it does
properly belong in an R®P zone. The room will be Room P. a 20 by 20
foot, 400 square foot room and we submit that we would be having a
totalthen of 40 people, 20 people twice a week, which is nowhere the
use that any other use gets. They are a dignified, quiet bunch; they
are ambitious; they have paid for something; they want their money's
worth. I submit to you that there has not been proper cognizance
taken by the Planning Commission on the fact that this is a purely
internal use of an existing building without change or modification.
It doesn°t add to the pressure for change of zone because nobody would
ever know there is a school there unless there is a sign in front
saying this is a real estate school, and you have control of that
sign. The building is 49000 square feet, nine offices. We will be
using 400 feet in the back part of that building if this use is
granted. The interest to the applicant is seller of the major.interest
of the Hubbard Schools to Mr. Hanich.
Mr,, Mike Hanich I was in the hospital when this
2222 West Garvey came up before the Planning
West Covina Commission and I am sorry we didn't
have a chance to present it the
way I thought it could have been presented so the Commission could
have understood it.
The history of the property,
although it's R-1 now, used to be Cml. There used to be a market
there. The Planning Director at that time after the freeway went in
initiated a general plan because fruit stands and guys would park a
truck at the back end of Cml property and sell bananas and oranges,

• et cetera, This is the reason all of the property that was C®1 alongside
the freeway became R®1. That created a whole lot of hardship properties,
I think I have as nice a looking building there as possible and there
hasn't been enough guidance furnished to the neighbors to develop the
area, The uses we have proposed,, there won't be anything additional to
what is already there, I paid for the alley; I paid for the curbs and
gutters; the fire lines going in; the street lines, (Read prior Minutes
and records relating to this property and its use,) I don't think you
have -had any exceptional complaints from my property. I hope you will
allow us to use this property for the school, I don't think allowing
the sign would be detrimental,

internal sense and where it is a use that truly might be considered
to be borderline relative to the current variance and have no exterior
effect, I certainly personally would not have objection to it but I
would have a very strong personal objection to the establishment of any
type of signage and lighting of signage that would create a change in
the exterior appearance of the neighborhood, I believe a night lighted
neon sign would definitely do that,

reasoning behind putting a
school of this type in C®1? Is it because of the amount of parti-
cipants and the parking?

Planning Commission was asked
to make a determination a couple of years ago and they so determined.

asked for here but whether the setting of a precedent is in order,
First, there is no doubt in my mind that the area in which Mr. Hanich
has his building is and has been a problem area in the City, but I am
concerned with setting a precedent of a --real estate school in an
improper zone as I am concerned with Mr, Haniches referral to his
existing signs being given by variance and therefore an additional sign
should also be allowed, if I interpreted his remarks correctly, I feel
that it may .hot have been a mistake on the part of the past Commissions
to allow such signage, but I do feel that this is over-signage on this
property, As far as the usages concerned internally, I cant. -see
where it would have an adverse effect on anything -in the City, but I am
wondering as to whether the unique location of' this property is adequate
grounds for us not setting a precedent in allowing this, I also would
like to see the hours as stated by Judge Martin be specified in this
application so that if this use is granted that it be restricted to the

south side has to be a -truck route because it is Highway 39, but I am
concerned about the frontage road being designated a truck route in some
of these locations,, What was the reasoning in putting a truck route
from Azusa to Citrus on the south side?

are available to the City this
would only reinforce the Planning Commission's decision to go ahead
and recommend that it be an in-house project,, I don't see that the
availability of,a consultant may not have been discussed in detail
and I don't feel that would change the Commission's feelings,, I
feel very strongly that this should be a basically in-house project
with outside assistance, so I will vote "No" on the motion,,

Mr, Fred Shrader: I would like to request you to'meet
jointly with the Human Relations
Commission at the earliest possible time to discuss problem's of mutual
concerno (Gave brief summary of this Commission's work in the past.)
Mayor Krieger. There is scheduled for Wednesday
of this week, the 29th, a joint
meeting with the Personnel Board having to do with the salary survey.
I have been advised this evening that the Personnel Board will not be
able to formulate their firm recommendations by Wednesday and have
asked instead that the joint meeting of the City Council and the
Personnel Board be held over to Tuesday, July 5, 1966 and it has been
represented to us that there,will be no further requests for -continuances
by the Personnel. Board with respect to their recommendations,
I would suggest that we may
possibly consider scheduling a joint meeting on the same evening
following our meeting with the Personnel Board with the members of
the Human Relations Commission,,

things it does is change the
compensation from -ten ten.., '.to a_en fifty, which is supposed to be an
average of the change of .all employees, which is what I requested,, The
second change is the changes from a retainer where there has been no
reduction made by the City to a salary, where there would be deduction
of social security and this is at the request of the State Employees'
Retirement System because they insist that it be ona salary basis. If
you wish to hold this over, you may,, It still specifies that any
special services we do such as assessment districts or litigation
which are billed separately would be treated on a contractural basis,"
which is the way it is now,, You may employ us or any other attorneys,,
