The regular meeting of the City Council was called to order by Mayor Krieger at 7:30 P.M. in the West. Covina City Hall. Councilman Nichols led the Pledge of Allegiance. The invocation was given by Rev. Robert Bergman. 0 ROLL CALL Present: Mayor Krieger, Councilmen Gillum, Nichols, Snyder (from 7:35 P.M.) It seems to me we have repeatedly seen instances where Planning Commissions and City bodies have registered protests with the Regional Planning Commission and that body in turn rides roughshod �. over those protests and that the only time any sustaining of City. objections occurs is at the Board of Supervisors level, if at all. T am beginning to question the receptivity of the Regional Planning Commissioners to valid complaints, Mr, Joseph, when they do overrule these complaints,.do they give a reason in writing.as to.why they do not consider these complaints? -3- C,, C,, 5/23/66 Page Four 'REGGIONAL PLANNING COMM2SSION ZONING -'CASE .NO.,,_ 5074 ® Continued Planning Director, Mr,, Joseph: • over the signature of the Planning allowed to be read in the record,, letter and give off -hand comments,, advisement and you are only told of reasons at any time they so choose They do not,, As a matter of fact, when a letter is prepared Commission that record is not even You can only paraphrase from the The County takes the matter under the final conclusion without to decide the case,, Mayor Krieger: I was discussing this matter with Mrs,, Baca, who is the Chairwoman of the Regional Planning Commission,, She led me to believe they are most interested in the point of view of the planning commissions and the city councils in the individual jurisdictions within the County of Los Angeles,, Whether or'not they always agree with the recommendation or the position is another thing,, She went out of her way to say they do solicit those comments,, Councilman Snyder: Not only should we support the Planning Commission's protest and enter one of our own, we should also communicate with the City of Covina from the viewpoint that since this land is still County) and is bound to come to one city or the other eventually that it should be the prerogative of the cities to determine the zoning on this matter since it is going to affect us,, • Councilman Nichols: I would certainly concur and particularly it is inconceivable to me that this section of property and this area would remain inthe County and not come ultimately into one or both of the cities. Motion by Councilman Nichols, seconded by Councilman Snyder, and carried, that the City Council of West Covina communicate with the Board of Supervisors and inform them that the Planning Commission of this City previously objected to this particular zoning matter in its hearing before the Regional Planning Commission and that as a result of the action of the Regional Planning Commission the City Council wishes to reiterate that protest and strengthen it and urge that the Board of Supervisors not grant this zoning for the very reasons which were originally ennumerated in the protest by the Planning Commission, and that a copy of this complaint be directed to the City of Covina and that the staff be further authorized to communicate such other information and in such other manner as the staff may deem advisable with the City of Covina relative to this protest,, 'RECREATION .6. 'PARKS ANNIVERSARY DANCE • Mayor Krieger: There is a communication dated May 20, 1966 from the Recreation and Parks Department to the City Manager and the City Council requesting permission to hold a large outdoor anniversary dance at the youth center on June 25, 1966,, dM C, Ca 5/23/66 Page Five ANNIVERSSARY DANCE Continued Motion by Councilman Snyder, seconded by Councilman Gillum, that the • Anniversary Dance be approved for June 25, 1966 but that all pre- cautions be taken to keep the nois.e.level.at a minimum; that the dance shall not continue past 1.1:00 P,M, Councilman Nichols., I don't know how you hold that kind of noise to a minimum or what that minimum is, Action on Councilman Snyder's motion: Motion carried, CCouncilman Nichols voted "NoP°, ) WRITTEN 'COMMUNICATIONS ALSCOT'DEVELOPMENT COMPANY LETTER City Clerk, Mr, Flotten., We have a letter from Alscot Development Company regarding zoning on property located at 825 South Glendora Avenue, City Attorney, Mr, Williams., I have glanced at the letter but I have reviewed the subject because it was brought up between this meeting and the previous meeting, The letter correctly states the fact that there had been a variance granted for an office building and a precise plan approved. After this was done and as I recall it, because of the contention that financing was easier to obtain, there was an application for C®1 zoning but with assurance that it was to be used for this office building, The Council did something that I don't favor personally and that is put a condition =® not a condition upon zoning, but a condition upon the date it would become effective so the ordinance that zones this from R®A to C®1 says it shall become effective or operative when an office building has been built in accordance with the variance, If I remember correctly, that,C®1 does not include the entire property. The rear part, I think, is not included in the C-1 zone, The C-1 extends for a depth of 270 feet leaving 158,5 feet still zoned R®A with a variance of office parking, This is important because this has to do with procedure, There are two.ways they can move, If they wish the entire parcel including the rear 158,5 feet to be Cml and they say they want it for the Cml zone for purposes of sale, there is only one procedure and that is to petition new proceedings for'C®l, However, there is another proceeding that can be followed, They can ask without public hearing since it has already been held on the first frontage back to the 158,5 feet and all that remains is a clause'in an ordinance that affects the operative date, This does not change property from one zone to another nor change the uses permitted in a zone and you may, if you wish, by ordinance delete that provision and this would not.require notice and hearing but it would be permissible to hold them if you want to, It would not have to go to the Planning Commission but you could refer it there if you wanted to, -5- • C, Co 5/23/66 Page Six ALSCOT DEVELOPMENT COMPANY LETTER '® 'Continued Councilman Nichols-. Move that the Council direct the City Attorney to prepare the substance of a letter incorporating the substance of his opinion expressed here for the signature of the Mayor to be redirected to these gentlemen informing them of the two options they have open, It is my feeling that if this Council would take the initiative to take action relative to the one area open to the Council normally to respond to, that is the change in the condition of timing, that this might not totally satisfy the owner and still some additional proceeding would be forthcoming, I think the owner should,be aware of the problems relative to this property, Councilman Snyder; The motion is merely to inform the owner of his options, I will second the motion, Mayor Krieger-. By the motion you are not suggesting any predisposition by the Council itself as to these two alternatives? Councilman Nichols-. No, Mayor Krieger-. the two alternatives which would b the zone change, I assume that the communication from the petitioner; e Assuming that petitioner has some interest in the second of the ordinance route rather than mechanics of it would be another is that it? City Attorney, Mr, Williams-. I presume so, They would request the City Council to adopt an ordinance deleting that condition delaying the effective date so it would become effective immediately but the letter should point out that it would become effective only as the front part of the property described in the ordinance, Councilman Nichols: With the exception of myself, the entire Council is being asked to rule on a provision on which they did not sit on the hearing. In regard to myself, I voted against this zoning and this provision in the first place, I think maybe the conditions surrounding this property that prompted this zoning then do not exist now, it is my own opinion that the public is best protected by a new hearing, Action on Councilman Nichols? motion-. Motion carried unanimously, 'CITY ATTORNEY • ORDINANCE INTRODUCTION Amendment No. 75 The City Attorney presented; "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING CERTAIN SECTIONS OF THE ZONING' CHAPTER OF THE WEST COVINA MUNICIPAL CODE" (Amendment 75) mm C, Co ' 5/23/66 ORDINANCE INTRODUCTION 'Continued Page Seven • City Attorney, Mr, Williams- I wish to point out one change of wording, There was a suggestion for the amending of the paragraphs relating to the Review Board, As the ordinance now stands it sets forth.the means of giving notice by the Review Board, Th the case of an appeal to the Council, it is silent as to whether the Council gives the same type of notice though -in practice that is what we have been doing. This is the time and place for the public hearing, 'IN FAVOR Mr, Don Perryman I think this is an ideal location • 1.5733 East Amar Road for the C®2 zoning, We have no La Puente objections from the property owners that we notified within the area as far as objections to the zone change, There are three service stations that are within the Civic Center area, There is one other similar use at the Broadway store where they have a tire.service center, I think the Shell Service Station is an attractive service station, (Presented photographs and explained same,) C, C, 5/23/66 Page Nine ZONE CHANGE NO, 364 .6 UNCLASSIFIED USE PERMIT NOo `108 Continued The parcel to the south, which • is a Mobil Station, is quite similar to our particular property in that it is almost triangular in shape. Our parcel has 50% more area but we do have similar problems that they had to face on their development. We agree with all conditions including the signage and fire hydrants, et cetera. I have submitted a supplemental plot plan showing how we propose to develop the remaining parcel in addition to the service station. I am sure it would not be just left to weeds-. We anticipate a single story office use. I take exception to the comment where it is found that the proposed use at the proposed location would adversely affect the peace, public welfare of the City. I believe a service station of this type no more affects the general welfare of the City as possibly any other commercial development. My clients owned this property for many years before it was within the Civic Center area. At this time we feel the proposed development is appropriate. Also, I would like to submit to you a drawing showing the original size of this parcel and how much land has been taken away in the way of streets, washes, et cetera. Now we are left with about 50% of the original property. • Mr. Tom Yamashita I am here to speak on behalf of 5004 Glendora Avenue the property owners. We are Covina trying to develop a cultural center in this City and I am sure that with this property when it is developed it will be a credit to your City. In order to develop our cultural center we have to develop our commercial property. We have looked and looked for the best kind of a commercial development to go there and the best thing we had, we feel, is the Shell Oil Company station. Mr. Alfred W. Stowe I am the realtor involved. 15446 Genene Drive (Presented rendering and Whittier explained same.) We believe this project will enhance the area. The decision on the Mobil Gas Station to the south was based on the fact that that property was not suitable for anything else, That property, I am sure, was useful for a service station and could have been used for another type of use as well, If you use the same type of logic in approving the service station to the south here you must also approve this. Mr, Ted Hamachi The importance of this 238 North Walnuthaven Drive development hinges on the West Covina welfare of our children, The development will guarantee • financial foundation for our future needs, There being no further public testimony, the public portion of the hearing was closed. Co Co 5f23/66 Page Ten ZONE CHANGE NO,, 364 .8- UNCLASSIFIED USE 'PERMIT NO,, 108 Continued Councilman Nichols° I detect what seems to me to be somewhat of an inconsistency. We have Cm2 usages up the road from this parcel along Sunset. It doesn't strke me as I drive past that area that those types of uses allowed under C-2 are particularly beneficial or contributory to the concept of the Civic Center area(, On the fact of it,it seems that a. C-2 usage actually is a little heavy for an area within the Civic Center area if this type of use that I see there is indicitive of what we can expect in Cm2 zones(, Was the recommendation of the Planning Commission for C-2 usage on that property solely because C®2 had been granted adjacent to it or because the Planning Commission felt that the ultimate and best use of that parcel of ground now under considera- tion was in fact C®2? Planning Director, Mr(, Joseph- I think it was based primarily on the establishment of the zoning that was on the land at this time and the fact you had Cm2 zoning from Orange to Vincent, between the Wash and Cameron(, Certainly the pattern for C-2 has been established in the area,, As to the type of uses existing at this time, we share with you your concern(, However, the fact that these uses were in existence prior to the establishment of a Civic Center area may have relevancy to your point(, The older structures there that were developed prior to 1960 went in with very little control attached to them ritht across from the Civic Center(, I have been in communication with the property owner, Mr(,Mohnike, of the great deal of that property to the north of this particular site • and he has indicated to me that the leases when they expire perhaps will not be renewed and also he is looking forward to a rejuvenation of the whole area. He owns all the way up to the Alpha Beta Market(, Motion by Councilman Snyder, seconded by Councilman Gillum, and carried, -that Zone Change No,, 364 be approved from Zone R®A to Zone C®2,, Councilman Snyder. It seems to me there are several doubts I have regarding the unclassified use for a service station in this -area(, First, the Planning Commission has indicated it certainly does not lend to the upgrading of the Civic Center area and it is not a necessary or required use contingent to the Civic Center area., Secondly, although they are not using the entire piece of property, the remaining property that they are leaving for as they indicated possible office building is oddly shaped and one wonders how they could put a building of any size and have parking as well,, I think that is my main opposition to the unclassified use permit. I think the Planning Commission has stated it very well and I don't see that they presented any evidence to refute this. Councilman Nichols- I don't feel that a service station use on that property is the highest and best use(, Certainly I can see the desire of the Association to gain a remunerative development there for their . benefits but this Council can in no way predicate either its zoning ...or granting of use permits based on what is financially most beneficial of the property owner but what is, in the judgment of the Council, most beneficial to the community, I can®t believe that a service station use on that site ultimately is the best development and is in the best interests of the City(, m10® .7 C, C, 5/23/66 Page Eleven ZONE CHANGE NO, 364 .8. 'CITY ATTORNEY (Continued) ORDINANCE NO, 968 ADOPTED State retirement The City Attorney presented: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AUTHORIZING A CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF WEST COVINA AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA STATE EMPLOYEES' RETIREMENT SYSTEM" Motion by Councilman Nichols, seconded by Councilman Gillum, and carried, to waive further reading of the body of the ordinance. Mayor Krieger: This has to do with waiver of disability benefits on behalf of any City Employee being asked to sign the waiver. What is the affect of this? As I understand the question that is unanswered, what is the affect of this in the event that the State Retirement System should change in any of its provisions as to the position of any of the City employees who are asked to sign a waiver? City Attorney, Mr, Williams: Mayor Krieger: And who do sign a waiver? And who do sign a waiver as to further amendments of the Act, City Attorney, Mr, Williams: As I understand it, and I'm not really certain, it simply means that the State Employees' Retirement Systems benefits can be changed from time to time by the State Legislature, If a person signs a statement to this effect it means that his benefits would be subject to these future changes, So far I don't believe there has ever been a change that was detrimental to the employee- every change has been beneficial to the employee and costs more to the city, Mayor Krieger: This waiver that is being asked of the employees, as I understand pertains to those benefits that would now be in effect as it may pertain to their present status to the extent that the waiver is specific, Now, to the extent that the Act is later amended by the State Legislature to.broaden the benefits rather than to restrict, in your opinion, if you have an opinion at this time, does this waiver have any prospective application? City Attorney, Mr,, Williams: The only waiver I have any knowledge of and I think Mr, Weeks can straighten me out on this, is a little different than what we appear to be talking about, I think we have been asked to provide a waiver of benefits under the State Act insofar -as those employees who are now drawing disability from Occidental, They will continue to draw the.Occidental benefits and as to this particular disability but not as to prospective d3'sabilities, They waive benefits of the State Act and accept the Occidental benefits. • • E C, Co 5/23/66 Page Twelve 0RDINANCE NO',' '968 Continued Administrative Assistant, Mr,, Weeks: That is correct,, City Attorney, Mro Williams: This applies to the present disability payments they are drawing,, They waive the right to any payments under the State Act and continue to draw the Occidental if they take this choice, Mayor Krieger: If I understood -Councilman Gleckman°s comment, he understood that point,, What he was concerned about, I believe, and the question it then raised in my own mind was to the extent that this waiver of any benefits for existing disability under the State Retirement System would extend into the future if there was some liberalization in the law as it pertains to the State Retirement System in the future,, City Attorney, Mr,, Williams: I think we have waived all benefits under the State Retire- ment System existing, future or otherwise, changed or not as to the existing disability,, Councilman Snyder: Is this waiver required by the state? Could we have negotiated it without this? I would like the waiver provision to be amended. Mr. Weeks has forced about every police officer to sign or if he doesn't sign it he will lose his entire benefits tonight, I would like to get this amended so that at least as far as Occidental is concerned there is no waiver against any legal rights against them. I don't want my lawsuits taken out of court by the waiver the City is forcing down the throats of these gentlemen. I would like you to reconsider and change your waiver provisions. I don't care if they go to the State Retirement System. I think that is fine. I would like to see the waivers changed. June 20th is another study meeting, a salary survey proposal review which we have to get in before the -end of June together with a study meeting on the Huntington Beach Freeway, On June 23rd we can get in our fourth budget meeting so that picks it up there, City Attorney, Mr, Williams: The budget meetings should be adjourned regular meetings of the Council, Mayor Krieger: We did that last year, On July 18th there are three items, fire station acquisition, major storm drain review and what seems to be some controversy, the public education program. I think where there are sidewalks it would be a reasonable request,, Councilman Nichols-, I am personally of the opinion that I would rather do nothing about it,, Mayor Krieger: At least two Councilmen desire not doing anything so we will take no action on this item,, MAYOR'S CONFERENCE Mayor Krieger-, We held the Mayor's Conference with the Central Business District and as a result of that conference further work has been done on the Central Business District Blue Ribbon Committee resulting in a meeting of May 18th,, There is a copy of the Minutes that has been circulated among the Council and the staff has done considerable work with these people as has Councilman Gillum and I will defer the balance of my report to Council Committee reports,, 'COUNCIL 'COMMITTEE REPORTS PLAZA BLUE RIBBON COMMITTEE MEETING OF MAY 189 1966 Councilman Gillum: I was happy to see the turn out of the property owners and business people in the community at the Mayor's Conference,, The meeting was held on a very cordial basis,, I think they know and realize there is a problem and they are going to work towards curing these problems in this area,, The Chairman, Mro Brutocag,asked the merchants and the property owners to send their suggestions, even if they were blue-sky:: conditions, up to consolidate all these.and.dis- cuss them at our next meeting which will be held Wednesday at 9;15,, I am very happy with it and I am sure from the approach that we had last Wednesday that it will be a successful venture by the City and the people in that area,, Mayor Krieger; We will look forward to further information on this,, ®25- Co C',, 5/23/66 'COUNCIL COMMITTEE REPORTS -Continued • CITY MANAGER'S SALARY ADJOURNED MEETING Councilman Snyder: Mayor Krieger: Page Twenty -Six When are we going to have an adjourned meeting? Next Tuesday evening, Councilman Snyder: I would like to place on the agenda of the next regular meeting or adjourned meeting the subject of the City Manager's salary and ask that he submit a comperative list of salaries in like cities plus the history of his own salary schedule to the Council prior to that meeting,, I believe this is a proper discussion for executive session or personnel session,, City Attorney, Mr,, Williams: Your motion is to put on the agenda of an adjourned meeting. Salary is not a proper discussion outside of the public,, Let me read this section to you. It may be worth your while since this is a penal offense to violate this thing,, "Nothing contained in this chapter shall be construed to prevent the legislative body of a local agency from holding executive sessions during a regular or special meeting to consider the appointment, employment, or dismissal of a public officer or employee or to hear complaints or charges brought against such an officer or employee by another public officer, person or employee unless such officer or employee requests a public hearing," Motion by Councilman Snyder, seconded by Mayor Krieger, and carried, that the -matter of the City Manager°s salary be placed on the agenda of the adjourned regular meeting of May 31, 1966,, VALINDA MEETING City Manager, Mr,, Aiassa: I need a volunteer for a meeting on June 26th,, We are going to have a meeting with the Valinda people,, We are trying to postpone it to the 2nd of June. On the 26th there are conflicts with other meetings,, I would like to have a Councilman present with the -staff because I think we do need a little legislative representation, if possible,, Mayor Krieger. - City Manager, Mr,, Aiassa: I would suggest -the staff contact us when you have a firm date,, That would be fine with us.
