Councilman Nichols led the Pledge of Allegiance. The invocation was given by Mr. Flotten, City Clerk. I am speaking in favor of the. 333 North Citrus Avenue variance., I feel this is West Covina entirely in accord with the other uses in our commercial neighbor- hood,, I am here to ask the Council to consider one or two points. If you will look at your map you'will see that on the description given there.was a Parcel 2 which described the property which is owned by Mr, Hughes and then in addition to that there is a Parcel 2 described as a 30-foot easement extending north of which the property line is the center., It also accepts from that easement for mutual use this strip within his property, the westerly 15 feet of the alley. I believe this easement is a thing with which the City Council or the City.Planning Commission is not concerned., We -have had a mutual use of this alley, half of which belongs to three owners of which I am one, The west half belongs to Mr, Hughes, Does the City Council include the whole area described as an easement projecting up into our property there and if it -approves this9.eliminating the part, I am wondering if it might have some effect of a legal cloud on that portion, For that reason, if it is proper for you to do so I would like to ask the Council to delete Parcel 2 and approve the request, Mr, Richard Hughes The property in question is • 1.981.6 Deep View Lane completely surrounded by auto® Covina motive uses, Our objective is to build an automotive service center, Mrs, Samuels has expressed one of our other desires there if this could be accomplished. The precise plan would not impair the alley, As to the matter of whether or not there is an easement, I understand there is not a recorded easement. It is a.question of whether there is an easement by the users and that is a matter between the parties, . Councilman Snyder-, I called this up because of the sign, It is actually an enlargement of an already oversized sign, However, to square this off would be an improvement over the existing sign, Councilman Nichols I notice on the summary of the Planning Department it is stated that the applicant had not provided the City with any definite plan as to where the sign would be placed. Is this.to mean there is no know- ledge on the part of the Planning Department that the sign is being relocated? C. 519/66 • CITYATTORNEY ORDINANCE INTRODUCTION (Retirement) • • Page Ten The City Attorney presented. - "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AUTHORIZING A CONTRACT.BETWEEN THE CITY COUNCIL OF THE CITY OF WEST COVINA AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA STATE EMPLOYEES' RETIREMENT SYSTEM?' City Attorney, Mr. Williams-, (Gave brief summary of this matter.) A question which I raised is there is.a 90®day.period to pay to the State after the effective date which would be July 1st. The full amount of the employees' contributions, Occidental agreed to pay that amount in three equal monthly installments but the letter did not state which day the first installment would fall on. If it comes on July lst there is plenty of -time because there is July 1st, August 1st and September 1st. If it started August 1st we probably would not receive the check.and get into the hands of the State within 90 days because more than 90 days expires, some months having 31 days. It has been verified that Occidental intends to make the first payment July 1st. Therefore, so far as the legal side of the contract is concerned, and I defer to Mr. Church as to those aspects that relate to the acturial or insurance side, I approved the contract and the ordinance and the ordinance is -,-ready to be introduced if and when you are ready. Mayor Krieger: What would be the last date upon which this ordinance could be introduced in order to be effective in time? City Attorney, Mr,, Williams- That would depend on what days you met, but the introduction of the finance can't hurt anything. It's the passage of the ordinance that can do somethidg. The ordinance must be passed before the end of May in order to be'e£fective July,lst. .Mayor Krieger: That mans We have one other regular meeting in May or any aZj.ourned meeting in May in which to adopt an ordinance which we would ,have to previously introduce. In a prior ordinance I had been advised having already sat in judgment on that particular ordinance and even though a new hearing was held before this Council of which I am a new member, it was felt that I should not get involved as far as seconding the motion was concerned, I feel in this particular case I have sat in judgment of this matter at the Planning Commission level, I would have to abstain at this time unless the hearing was reopened and the grounds are that at Planning Commission level I felt proper grounds were not shown for a zone change, At City Council level there was other testimony given that I have read but there are questions I do have regarding that testimony, City Attorney, Mr, Williams Is the tape still available? First, there is some question in my mind as to the equity of the method of taxation and the equity of the method of spreading this bond issue over the district, There is also some question as to the need of a district for these feeder lines at this time plus the indication that was given before our area went into the Metropolitan Water District that at least an implied indication that such a bond issue would not be -required and the argument was used that the additional expense of going to the four cities would have required a bond issue and we are now being asked to vote for probably a bigger one for MWD, I vigorously oppose this resolution, Mayor Krieger: made a representation to 'this not contemplating a bond issue main feeder lines they intend Foothill Feeder Line which wou respect to the allocation for community that is taking serio is<one councilman that I know I don't know of any time that the Metropolitan Water District Council or anyone else that they were to finance feeder lines, One of the to finance with these monies is the ld serve this specific area. The allocation is based upon assessed property valuation and on a dollar basis the City of Los Angeles is paying more for this type of a program than the outlying areas which includes our owns Councilman Snyder: I am aware of that but it makes me wonder if they are capable of' presenting and spreading this fairly, why do they do it this way?
