APRIL 11, 1966
The regular meeting of the City Council was called to order by Mayor
Nichols at 7:30 P,M, in the West Covina City Hall. Councilman Heath -
led the Pledge of Allegiance. The invocation was given by Rev. Miles
Acker of the West Covina Methodist Church.

ENFORCEMENT OF SPEED LIMIT ON EAST
FRANCISQUITO AVENUE
Mayor Nichols- The City Manager has

that the letter from John A, Gierke dated April 19 1966 be referred to
the staff for report and that when a reply is made to Mr. Gierke it might
be pointed out to him that the Police Department in the City of West
Covina does not belong to the City Council but it belongs to him as a
citizen of West Covina,
Councilman Heath; Francisquito Avenue at a number of
spots in this location are in the
County and I feel that we should contact the Sheriff's Department to
make a joint study of that area in addition to our own Police Department,
Motion by Councilman Heath, seconded by Councilman Krieger, and carried,
that the staff be instructed to contact the Sheriff's Department in a
joint effort to curb the speeding on Francisquito Avenue as a,greater
percentage of Francisquito Avenue is in the County,
FIVE COUNTY REGIONAL PLANNING
AND DEVELOPMENT ASSOCIATION
Councilman Heath: This request covers a lot more than the
East San Gabriel Valley and I think it
is more closely related to the opinion of each individual city, I don't
see how I could possibly vote for that if I were to be on the Council at
the time it came before the Council,
(Councilman Snyder entered the chambers at 7:50 P,M,)
Councilman Heaths It seems we are doing nothing
more than creating large areas into
complex and complicated plans, I feel that each city should know how
they want to develop. I don't see where a commission of this type would
be protecting the individual cities, If we want home rule, I think we
should.stick to our own plans and forget about the,big commissions and
overall studies,
Councilman Krieger: I have a limited acquaintence of this
letter from Mr, Nesvig of April 1, 1966
and the outline for the suggested five county and cities regional planning
and development association, I was struck by the same point Councilman
Heath has raised. I am rather acquainted with the conversations in the
East San Gabriel Valley Planning Committee and I might anticipate perhap's
unnecessarily or inaccurately that the Committee might not look at this
any more favorably than your comments suggest you do, I would like to
still know more about this as it is supposed to be conceived to see
whether or not there are some aspects of it that aren't very well brought
out in this outline,

'FIVE COUNTY REGIONAL PLANNING AND DEVELOPMENT ASS CTATION Continued
City Attorney, Mr, Williams, The City Manager attended the seminar
last Wednesday on SCAG. This matter
was discussed and it was indicated by the county representative, Mr.
Golden, that this letter to the cities was somewhat deceptive. The
proposal was suggested as an alternative to SCAGq more,or less. It was
the vote of Warren Dorn that made the three -to -two vote to study this and
he.explained in voting for it that he.was not proposing any withdrawal
from SCAG; that he had no objection to studying anything,, The County
itself is not in favor of the thing.
Motion by Councilman Heath, seconded by Councilman Jett, that this matter
be tabled until called up by some member of the Council. Action failed.

that this matter be referred to the Planning Commission with a recommenda-
tion that they refer it on for additional study by the East San Gabriel
Valley Planning Committee for a report back to the Council through the
Planning Commission. (Councilmen Jett and Heath voted "No".)

$109000 approximate very broad, this is true, However, from the standpoint
of award, the award will still be made on the basis of the bid presented,
I will have to report back to you on the $7,000,

ments,, What is the lowering of the
water line going to cost?
Acting City Manager, Mr, Fasts That was awarded when we approved
the project on a previous meeting.
The water line will be lowered by the water company and they handle this
directly with their own competitive bidding. We just order it out,
Councilman Heaths Don't you think we should know? We
give them a blank check to lower this
water line, It is possible we could get a lower bid on lowering this
water line or at least we are''entitled to see the bids the water company
gets,
Acting City Manager, Mr. Fast: I don't recall the exact figures, but
• the figure in the budget, I believe,
was around $8,300 which was an estimate from the water company, Apparently
we have issued an order to the water company for $8,513, This was
authorized on March 7th,

lower it and the circumstances are such that they have a prior right,
we would have to pay them their expenses of lowering it, I think we
would not have to go to bid because we are demanding that they lower
their own line which we don't have a right to do but.we would have.a
right to know what their cost is before we proceed,:if you wish.to,.

that work that is done by some of the
water companies in the area is ordered to be done by one of their

subsidiary which is not required to bid and the:price of this could be

obtain prior to issuing this order or do we just take a blank order
because the water company says they will take this much?

mit three bids but we are entitled to solicit as many quotations or bids
or information as we wish as to what the proper charge should be; that
we scrutinize the bills submitted to us and if the bill is not fair then
we don't recognize it,

and paving were going to be put in.
If this is so, why do we need redwood headers in here?

access from the rear. There is a driveline in the front but the
major access is from the rear,, There are many occasions .in the City
now where access is from the rear of the property leaving the front
free and clear for landscaping and building,,
Councilman Snyder; I feel they should have their
access directly from Garvey, I
think the Planning Commission should at least take a look at it,,
Councilman Krieger, The.parking entrance in the rear
is creating a secondary street out
of an alleyway,,
Councilman Snyder; People not familiar with the property
would be confused by the parking
in the back with no immediate visible access to the parking. I
think you would find that people not familiar with the area would be
parking in Robert Hall's parking lot and walking over.to this property,
The students will know the parking lot is in the back and will park
back there,

7607 North Glendora Avenue a question raised by Mr Gleckman on
the address being on Juniper,, The
valid objections,,in my opinion, were additional traffic on Juniper,,
In order to resolve that, after conference with your engineering
staff, the driveway for entrance purposes only on Garvey will for all
intents and purposes reverse the frontage of this house,, I am only
interested in using this location as a real estate office,, My
activities run from Chicago to Miami and actual flow is very small
as far as volume of traffic is concerned. If you have any questions,.
I will be happy to answer them,,

Councilman Snyder; What is the width of the frontage
road directly in front of this
property in that area?

Councilman Snyder; I believe at their request there
was a study by the Planning Depart-
ment demonstrating how the property to the east of this could be
developed, from Juniper east along Garvey, with the idea in mind
that whatever you did here might set a pattern,,
Planning Director, Mr. Josephs The report of the staff, which was

is noted. That stated that the propertyewith generallyby thelng theCsamession,
characteristics across the street was zoned and used the same way
and that the zoning was consistent with usage in the,area
Councilman Snyder. It seems to me in granting any
heavier zoning than already granted
• here the burden is on the applicant to demonstrate that the zoning
he is asking for is not going to set a pattern; or, if it is going to
set a pattern similar to his zoning, something h4s to be done to
handle the congestion that will occur on a 32-foot.street,,
Councilman Heath. I would think that the statement
regarding the widening of the freeway
belongs in this report because it scares you as soon as you seethe
Possibility of some of this property being condemned. I think during,
past years that I have been on the Council I have noticed that along the

freeway we are definitely making changes to other zones than R-1.
I think C-1 is too heavy ,a use for this property but I can readily
see where this can be rezoned for office use, be a good use of the
property, and be an advantage to the City,
Councilman Krieger: Mr.* Anderson, in your presentation
you commented you saw two valid
objections raised at the Planning Commission level. One.was traffic
flow and I never did hear the second one,
Mr, Ray Anderson-.
The matter of signs and that
would go along with C-1 use,
Councilman Krieger; Mr, Perryman, you have prepared and
presented your case, which I think
is much better prepared and presented than most cases we get. You have
40 instances, I believe, of this type of zoning in the City as
precedent,

a commercial zone abutting the
residential zone,
Councilman Krieger: My question is: On any of your
examples or illustrations, do you
have such an abutment where the proposed zone change faces onto a
residential .street'

I didn't investigate it from that
angle,
Councilman.Snydera I think.this is a toorly placed
piece of property by itself to

applicant how he can solve the traffic problem to his own area as
well would throw a different light on this, Certainly there is no..
shortage of R-P property in the City for somebody to put a real
estate office on,, I think we need to come to the end of the time -
when we just grant somebody zoning because they have a certain piece
of property which suits them, This is how a lot of our poor zoning
patterns got started, I think this does nothing to enhance the overall
neighborhood involved here and increases the density of use,
Councilman Heath; We have a large parcel across
from the Queen of the Valley
Hospital which was zoned R-P which faces R-1 and is contiguous and
backs.up to R-l. We have the property at the corner of. Merced and
Glendora which backs up to Rml. We have recently zoned the whole
west side of Glendora Avenue R-P which backs up to R-1 and faces R-1,
Councilman Krieger,. Each of.the.illustrations you have
given suggests that the frontage
of those properties if they were in an improved state was on a
secondary or well travelled street rather than -.a residential street.
I was looking for illustrations where we have an improved piece of
property where the frontage is on a residential street. where we have
granted a zone change from R-1 to'R-P,.

validity, I think the concern relative to the possible widening of
the"' freeway and a lessening of the size -of that property would be a
concern, However, this is -obviously a risk of the property owner,, I
have taken the personal philosophic answer in attempting to justify
the votes I take on the Council that those properties that front
right on -the freeway, if there are any properties in the City that
are inclined to justify a usage'other than R-1, certainly those
properties are. I tend to feel this request is reasonable, I can't
see at that location with the freeway coming right off in his front
yard and on the frontage road, I can't see an objection to it,' The
people in the area are not here to object.:to this application,

2247 East Evergreen Azusa to a new tenant., The House of
West Covina Charm, They want.to get.a grand
opening sign and the Planning
Commission was very helpful and said to apply to the Building Department
for the bu-ild-ing permit, The Building Department.said they were
sorry but because of the antiquated sign ordinance we have. here -- and
"antiquated". is my own word --.that they couldn't have -the sign, I feel
the sign ordinance should be revised as soon ,as possible and I feel the
City staff should ask.for comments from the businessmen and developers
as to the way it should be revised. I wish the staff, would send out
a. brochure or letter to the businessmen asking for suggestions, I don't
think the staff helps the:developers with the. -.signs right now and I
would suggest. -they -try to revise the sign ordinance with help from the
citizenry,

going into effect once you have passed one, No city had any knowledge
as to whether or not this bill would be passed or not,
PALM SPRINGS MEETING REPORT
City Attorney, Mr, Williams-. There is a resolution proposed in lieu
tax on telephone companies, one
per cent, Bud Carpenter suggests that the cities do not adopt this
proposed resolution, It cannot pass,
A,B,128 would permit the retirement
of police officers under the State Employment Retirement System at age
50, This would be quite costly for the Cit�,� and should. be" opposed,
A,B, 1149 library aid, would force
Cities into joint library systems and there would be on1v four libraries
in the State of California that would qualify, In the opinion of the
.League, this bill should be opposed,

Attorney has concurred in the interpretation and'I have heard .from
the State Highway Department today that they were senaing out a
longer letter explaining what they meant,, It has nothing to do with
the State hearings on the freeways at all but rather local jurisdiction
only,, I also confirmed in this report the approximate scheduling of
the Huntington Beach Freeway hearings,,
TEMPERATURE READINGS ON GASOLINE
DELIVERIES
Acting, City Manager, Mr,, Fast. We have a brief informational report
as far as this is concerned,, We
have taken a look at our gas consumption and we feel after perhaps
166 or '67 fiscal budget we will insert an item for a 109000 gasoline
tank to be installed at the City Yard that will give us a bulk rate
diferential and at that time we can demand temperature readings,,
Councilman Heath.
I spoke with the City Manager
concerning this item this afternoon,,
I think we have enough engineers in:our staff to realize that gasoline
has a coefficient of expansion,, I do know that gasoline stations
and service stations can either make money or go brake depending on
the temperature of the gasoline they receive and due to the expansion
and contraction of the gasoline after delivery,, The City Manager told
me we are getting partial shipments; by that I mean a half -truckload at a
time and led me to believe that we are also getting the bottom half
of the tank,, I know more about gasoline delivery than this because
if they are going to come out with a load of gas and they stop
here -and you might get the top off.' the truck or you might be getting
the bottom,, If we are getting the bottom, it is quite possible and
quite probable that the temperature of the bottom -gasoline is.hotter
than what would be there if we had a full tank,, Mr. Aiassa advised
me that they are going to consider a 109000 gallon tank in the next
budget and I feel that this would be again erroneous planning because
at the present time we get a delivery twice a month and I think in
this way we are keeping fresh gas and getting our money's worth out
of the gas we use,, I would like to explore every possibility of
leaving the present half -tank shipment twice a month rather than one
shipment a month and that the temperature be taken on that tank load
whether it be a half tank, quarter -tank, or full tank,, It means this
much to the City,,

bring it back at a future time.

• Councilman Snyder: Is there any provision at the present

tions where if a proprietor should be found to be operating illegally

City Attorney, Mr, Williams: It is legal to provide for the
revocation of a business license
for good cause and requires notice and a public hearing, I don't think
our code has that procedure, The Courts have held whether the code
contains such a provision or not, due process of law requires that to
revoke a man's.right to do business you must have a just cause and
you must follow due process, which means give him notice and an
opportunity to be heard in public.,
