M. in the West Covina City Hall, Councilman Krieger led the Pledge of Allegiances ROLL CALL Present: Mayor Nichols (to 8:10 P.M.), Councilmen Jetty Snyder Krieger, Heath Others Present: 74r, George Aiassa, City Manger Mr. Robert Flotten, City Clerk & Admin. Assistant Mr, Herman R. Fast, Public Services Director Mr, Harold Joseph, Planning Director Mr, George Zimmerman, Assistant City Engineer Mr, Byron Larson, Traffic Engineer Absent: Mr, Harry C. Williams, City Attorney WORK SESSION WITH NEPTUNE AND THOMAS,.ARCHITECTS (Maps and charts were presented and Mr, Joseph Thomas gave a summary of this matter.) Councilman Heath: Do I understand you to say you are about fifty to sixty percent com- plete? Mr. Joseph Thomas: For the working drawings, Councilman Heath: You will do the other 407o in about one month? Mr, Joseph Thomas: Yes, We always do more work per- centagewise in the last month of the project than we do in two or three months before, We are on schedule. Councilman Heath: What is your reasoning; you have put the staff on the third floor for the benefit of Council Chambers and open space on the first floor, This puts a tremendous load on the elevators where you have three to five hundred employees going up to the third floor to go to work, Wouldn't it have been better for you to put the employees on the ground floor to lessen the use of the elevators and put the chambers on the top? Do you anticipate any problem by putting datatronic machine on the third floor rather than a concrete slab on the ground? Mr, Joseph Thomas: There is no problem there, This is a concrete structure. We anticipate no problem on that. The employees are on the second and third floors. We have tried to develop a concept where the first floor is an open gallery - type thing which we think EFiould lend a great deal to the general C, C. 3/7/•66 Page Two -WORK SESSION WITH NEPTUNE 8 THOMAS, ARCHITECTS - Continued atmosphere of the building and the civic center to have that type of -treatment, It wouldn't be practical to put the chambers up on the top floor because it is a large room and it seems to fit better into a • separate element. We purposely did not try to fit it within the outline of the main building for two reasons: One, it is simp1 r:.' planning; second, we could put it in the proper spot where we felt it should be. Also, it enables us to get what.we think a much more interesting exterior,of our building...by.doing, that, We are trying to make this an unusual type of building. We don't want it to look like anybody else's civic center, Councilman Heath: On the defense facilities, they are gq,, ng to be used by the court building, too? Mr, Joseph,Thomas: Yes, We have a tunnel that connects t-his with the court building, Wo .have two cells plus a holding rioom, Councilman.. -),et: Have you made provisions there for juveniles; a separate room? Mr, Joseph Thomas: We have two separate rooms.for men, and women which could be used for .juveniles, They wotild not be put in the general holding room. This has been roviewed by the Department; of. Corrections which has to review all .facilities of .this type, Closed circuit television is being studied • .for this area, That would be,by far the most practical way to do it, Councilman Heath: Have you made provisions where the City Hall could be heightened at a later date? Mr, Joseph Thomas: No, but we have built in expansion possibilities in the future, We' feel this'is.a much better approach because putting.small additions on any bui angy..esp.ec ally any governmental -type building, usually detracts from it vor;y much, Councilman Krieger.: The rear of the Council chambers seems to be somewhat different. What is your seating capacity in the Council chambers? Mr, Joseph Thomas: 180 fixed and 25 more movable seats, f (Mayor Nichols left the chambers at 8:10 P.M,) Councilman Snyder: In the open galleries of the supporting columns, what is the texture of the columns? Mr, Joseph Thomas: We hope to write this up as an alternate for getting rough texture • :on the concrete, We would like to have a rough texture concrete, If the bide don 'tme in favor4`ble enough, we don't want the door slammed, so the Pro cannot.,go aheado MO.Lyor'Pro`Tem Krieger: Is this strictly an informational meeting or<`is there some action needed? i -2- Page Three • • C. C. 3/7/66 WORK SESSION WITH NEPTUNE & THOMAS City Manager, Mr. Aiassa: Councilman Heath: ARCHITECTS - Continued: No; we wanted you to be aware of what is going on here. There is no action needed tonight. Are you shooting for any particular cost per square foot? Mr. Joseph Thomas: We are shooting for a budget based on cost per square foot. The City Hall we are shooting for $24.00 per square foot. We haven't raised that since the very beginning. It's been about three years since we set that figure. I think the project will come out in this vicinity.. The Police building is $26.00 a square foot, We think ,h,-e can do it. The Police building is more expensive. It has more partitions and more expensive features just by the nature of the building, Mayor Pro Tem Krieger: Mr. Joseph Thomas: CHAMBER OF COMMERCE STREET IMPROVEMENTS RECOMMENDATIONS City Manager, Mr, Aiassa: Mayor Pro Tem Krieger: Thank you, A-11r. Thomas, for coming down and making this presentation. Thank you. We have a report on this. On February 9, there is a memo from the Planning Commission to the Coun- sil regarding this matter. Councilman Heath: I am quite interested in the pro- posal regarding the extension of Walnut Creek Parkway. I think it would be less expensive than you would anticipate. Mr. Zimmerman: We took a quick look at the Parkway today and we've come up with cost based on the same standards as we used on Walnut Creek Parkway just south of here and we came up with right-of-way and all the construction costs roughly to a million and a half dollars from Glendora over to Citrus. This is .some widening and leaving some of it as is. Councilman Heath: Would you hazard a guess what it would tale to re -align and not .widen' the street?.. Mr. Zimmerman: It would save considerable amount of funds. It would cut the right-of-way costs possibly at least in half to $400,000. Councilman Heath: I think this is an excellent report. I was at their meeting when the re- port was presented. The Chamber was very much in favor of the report at that time. I think the City's action is a little bit too conservative. If we are going to progress, I think we should realize we are going to have to spend money. I would agree with the Planning Commission recommen- dation except I don't think they go far or fast enough. -3- Co C, 3/7/66 Page Four CHAMBER OF COMMERCE STREET IMPROVEMENT'RECOMMENDATIONS - Continued • Councilman SnydeY�: At the stop light at Workman and Sunset, was there any thought of putting the northern quadrant lights further away? Public Services Director, Mr, Fast: You are talking about connecting the signal pattern with Workman or signals as they are now installed? The proposal would probably recommend we abandon that intersection._ and make it continuous so we have the Victor Gruen recommendation of a road from the City limits to City limits, Councilman Snyder: Is there any way of including, the western leg of that ;section into the signal? Traffic Engineer, Mr, Larson: We had a choice of signalizing the west leg of Workman Avenue, which made a rather`.wide intersection, or the apartment building driveway and. the opinion'.of the Division of Highways and the City staff was because of the sight distance problem in the crown'in the road that a driveway at.the apartment building would be dangerous and it is impossible to .signalize all three -- the frontage road, the apartment house driveway, and Workman Avenue, That particular movement should be relatively safe now, The only possible conflict would be if they were to proceed. .directly across and someone coming from the frontage road might turn • left at the same time, Councilman Heath: I would say about 800 of the cars coming off the off -ramp turn south on Sunset making a left turn. Quite a few cars coming out of the apartments are turning left and they just line up nicely for a head- on collision, City Manager, Mr, Aiassas We will check that out, Mayor Pro Tem Krieger: Let's go on to.Item.N_o, 2 on the recommendation of the Planning Commission, It appears to be proceeding on an inaccurate hv'Dothesis and that is that the Union Oil Company was considering a modernisation ..project, What is the staff's comment on this? Planning Director, Mr, Joseph: I talked to Byron Larson about this and theEngineering Depart- ment received information that the precise plan was about to be built, Mr. Larson hasn't heard anything more about it, We have not received any amended precise plans, Someone from the Chamber told me that thev had received word that there was not going.to be a precise plan, We have no word on this, Mayor Pro Tem Krieger: Planning Director, Mr, Joseph: I wonder if that would have been the action of the Planning Com- mission i.f. they had information, I don't know, Mayor Pro Tem Krieger: You estiiitate the cost of the right-of®way between fifty and seventy-five thousand dollars for this tip?. -4- C,, Co 3/7/66 Page Five 'CHAMBER OF COMMERCE STREET IMPROVEMENT RECOMMENDATIONS Continued • Public Services Director, Mr, Fast; Yes,, The estimate also includes.. any severance damage the courts might give,, We wouldn't feel there would be any fee title involved,, Mayor Pro Tem Krieger: Public Services Director, Mr,, Fast: Mr,, Zimmerman: to be weighed with the other things in conjunction with the other needs are not sufficient now that the two traffic would not be 'adequate,, What is the sta.f.f's opinion on this based on this information? From a traffic standpoint, do you .feel there is a very high priority? I would say this would be the critical thing,, It would have on the budget and have to be treated in the City,, The traffic volumes lanes which are available to Mayor Pro Tem Krieger: I am afraid the recommendation of the Planning Commission, if accepted by the Council, could cause this to be.side-tracked without ever being re -considered in terms.of evaluation because you would be waiting for something that is apparently never going to happen,, Councilman Jett: On No,, 29 I would hope. if we •acquire that Piece of property and straighten that out that we.would then correct that intersection,, City Manager, Mr, Aiassa.: We can schedule this item for re- study,, Councilman Jett; The suggestion of widening Azusa Avenue at Cameron, I would like to see that scheduled,, Public Services Director, Mr,, Fast; We do have sufficient right=of- way and there is current .in our current project scheduled for this fiscal year plans to widen Azusa,,.,..:.,. between Cameron and the property to the south to a full two lanes similar to South Glendora without having right=of.-wavo Mr, Chris Tambe I haven't seen the most recently Chamber Manager done report by the staff to the Council, but we have had the benefit of what we consider to be the very comprehensive reports by the Engineering and Planning Departments,, At the time this matter was being considered by the Planning Commission, we directed a letter to you since that time" dated February 10 which concerned itself with some comments on the staff's report to the Planning; Commission along with some new information that we had received and specifically we wanted to make it quite clear how we got involved with this particular.project on Glendora Avenue at the Vincent Avenue •Interchange,, We have photostatic copies of grant deed and other matters related to this that I would like to turn over to the staff. The real significance of this new information is that whereas the staf.f's informa- tion at the time indicated that the control of the total property in question was in the hands of whoever occupied the gas station, the information that Donald Casler dug up indicates.that,quite to the contrary, the control of the property is now with the,donut shop and we understand the reason it went this way was he needed more parking,, If ..there is any negotiating to be done, we suggest it be done with the legal owner of record as indicated by these documents,, -5- C. Co 3/7/66 Page Six CHAMBER OF COMMERCE STREET IMPROVEMENT RECOMMENDATIONS Continued A couple of other points: • Regarding the.Azusa Avenue matter, we are surprised and delighted to hear Mr. Fast's answer re'?arding the widening of Azusa south of Cameron, The Planning Department report dated January 18, on page 3 thereof indicates that the widening will be accomplished in 1968 or when the area is developed by the owner, Mayor Pro Tem Krieger: There was an additional report by our staff to the Council dated February 18th and that covers your particular point, Mr, Chris Tambe: Further, we would like to impress upon you as much as we possibly can the importance of what we consider to be involved in items 13 and 14. We refer to the matter in our letter of February 10, If you have any questions, I will be happy to try and answer them, Councilman Snyder: What action are we supposed to take on this? Mayor Pro Tem Krieger: The recommendation of the staff is the concurrence with the recom- mendation of the Planning Commission as recommended in their report to the Council of February 9, 1966, • Councilman Snyder: However, the report of Mr. Pontow of February 18 up -dates some of these items. Motion by Councilman Snyder, seconded by Councilman Jett, that this report of the Planning Commission dated February 9, 1966 and the report of -Mr, Pontow dated February 18, 1966 be accepted and the recommendations be placed on the staff work list for accomplishment with the exception of Item No, 2 in the Planning Commission report of. February 9, 1966, which should be sent back to the Planning Commission for -review, Councilman Heath: these items will cost and have this determined then for the Council to into the staff's program. I think it behooves this Council to determine what each one of project back to us and have the costs set priorities before they put it Councilman Snyder: That is, in effect9 what my motion says, this accepting the report, Just merely accepting the report does not accept the projects, Councilman Heath: I was hoping for a motion to instruct the staff to put a price tag on each item and bring it back to the Council for recommendations as to priority and on those items outside the jurisdiction of the City •that the Council establish a policy concerning the pursuing of the extension of these 'streets, Mayor Pro Tem Krieger: Perhaps what you are suggesting is not a criticism of the motion on the floor, but probably grounds for a subsequent motion as far as costing of it, :7 • C. C, 3/7/66 Page Seven 'CHAMBER OF.COMMERCE STREET IMPROVEMENT RECOMMENDATIONS - Continued Action on Councilman Snyder's motion: Motion carried, Motion by Councilman Heath,.seconded by Councilman Snyder, and carried, that the staff be directed to determine approximate figures on each of these items,in the Planning Commission report of February 9, 1966 and return this information to the Council to permit the Council to assign priorities to the items in light of the costs, Councilman Heath: Move that this Council adopt as a policy the implementation of these access streets on Items 12, 13 and 14 and advise the County or other cities of our concern about the extending of these streets and report back to the Council in sixty days as to the nossibilities'of cooperation from these other jurisdictions for the completion of these streets, Councilman Snyder I might suggest the best approach would be as north/south feeder routes to the freeway, not access routes to the City of West Covina.' ' Councilman Heath: I will.accept that recommendation, on phrasing, Mayor Pro Tem Krieger: -The motion will include: -:a statement that the arterials will be.for the purposes of servicing the north/south and east/west tra:f.fic," Action on Councilman Heath's motion: Seconded by Councilman Snyder, and carried, AMENDMENT N0, 72 Flags and Banners Mayor Pro Tem Krieger: This council and the very four same members discussed this matter on February 21.and we reached no decision, We have a speaker here tonight to speak to the Council on this matter, Mr, Monte Coleman (Presented renderings and Foley Advertising 6 Display materials and gave brief 305 North Lake presentation re this matter,) Burbank, California If you have any questions,.I will try to answer them, Councilman Heath: Do you find much damage to these from wind? Mr, Monte Coleman: On this type installation there is no damage, but things do happen • but we could come out. We are immediately on the spot. We deal with a shopping center group or an individual on a lease or rental basis, We sell nothing outright, Mayor Pro Tem Krieger: Can you leave these displays at the Citv Hall or must you take them with you? -7- Co Co 3/7/66 Page Eight AMENDMENT NO 72 (FLAGS AND BANNERS) - Continued Mr. Monte Coleman; Thev can be left, • Motion by Councilman Snyder, seconded by Councilman Heath, and carried, that this matter be held over to the meeting of March 14, 1966a RECREATION 8 PARKS SUMMER PROGRAM BUDGET Motion by Councilman Jett, seconded.by Councilman Heath, and carried, to approve the Parks and Recreation Summer Program Budget as recommended by the Parks and Recreation Commission and as included in the report dated February 24, 19660 LEAVE OF ABSENCE Captain Jo Co Gaines City Manager, Mr,-Aiassa; Council has copses of'Review Board.'s recommendations. Motion by Councilman Heath, seconded by Councilman Jett, and carried, •to accept the Compensation Review Board's recommendation of February 4, 1966 and permit Captain Jo C. Gaines three months' extension without pay under the conditions outlined in said rerorto CAPITOL TOUR City Manager, Mr, Aiassas The date will be March 22nd and they will be leaving from the Ontario Airport at 8:00 A.M. and you will be back at 9:00 PaM. Motion by Councilman Jett, seconded by Councilman Heath, and carried, that this matter be held to the meeting of March 14, 1966a SOUTHERLY ANNEXATION DISTRICT 195 Motion by Councilman Heath, seconded by Councilman Jett, and carried, to refer Southerly Annexation Districts No. 195 and 196 to the Planning Commission for report and recommendation, EXTENSION OF RETIREMENT DATE Robert Flot ten Motion by Councilman Heath, seconded by Councilman Jett, and carried, that Mr, Robert Flotten be granted an extension of time to June 30 , 1966 or until such time as the Stat- Retirement Plan becomes effective with a maximum of one year from June 30, 1966 as Administrative Assistant. 19:E C. Co 3/7/66 LICENSE FEE FOR REALTORS NOT HAVING A PLACE OF BUSINESS IN WEST COVINA WHO PLACE "FOR SALE" SIGNS ON WEST COVINA PROPERTY Page Nine City Clerk, Mr. Flotten: The report should not read that these gentlemen cleared with their group, They talked with several of their members but they did not clear this with their group. Councilman Heath; I feel that the requirement of a license for this type of business is discrimination and I would think we would do anything we can in order to change the law or at least make provisions where these brokers would not have to get a license. We are in a compact community where there are five cities adjacent to each other and the realtor's work carries him from one city.to another. It could work a terrific hardship on some realtors to the extent where they would be buying five differeilL licenses. Ifwe do charge, I think we should charge every industry that comes into the City. City Manager, Mr. Aiassas We do. Councilman Heath: It's impossible to do it. • Mr. E. T. Lakev I do have a business in [lest 20133 Covina Hills Road Covina at 104 South Glendora, Covina If a doctor has an opportunity to work with a patient in Glendora he certainly doesn't have to pay a license; nor would an attornev representing his client. The question is are we permitted to put signs on property. Since it is a matter of signs, I feel that it is discrimination against these people that are paying a license within the City to conduct their business there. I am more than glad to pay if I have to pay for five licenses to conduct my business, but I'feel there is an invasion to a certain extent from outside brokers into the area that are not.familiar with property values.- I feel as long as Glendora and Covina have taken the stands they have and since I have a license in West Covina, I think the City is entitled to this additional revenue if you are going to place a sign on the property. The matter of policing, I think, could be left up to us and'I think you would get 1OOo cooperation .from our realty board. If you furnish us with people currently paying licenses, that any time a group of [.,Nest Washington Boulevard or South Adams Boulevard or any other area came over here I think that the City should know about it and I think they should be required to pay. Councilman Heath; I agree with quite a bit of. what Mr. Laker says. I look at the United States as based on a proposition where we are going to pay •taxes. I have no objection to taxes if it is an equal tax and if that tax is for something which should be taxed and the proceeds from that tax to be used directly for the benefit received. However, I cannot find and cannot justify" any place in our government where we should pay a tax or buy a license and receive no value in return. If you can show me what value I would receive in return by paving the City of Covina for a license just for me to put a sign on a piece of property -- there is no police action needed; no fire action needed; no street wear and tear needed; no park and recreation needed. I can't see what value I am getting for the taxes I am paving, and I would say again that Co Co 3/7/66 Pape Ten LICENSE FEE (REALTORS) Continued •any time I get a value received I am glad to pay the tax, The install- ation of a sign in that city does not cause that city any hardship or cause services; but it does benefit that city, Councilman Snyder: There is some police action, administrative action required here in that the licensing would tend to limit low quality realtors possibly or unethical realtors in counter distinction to the more ethical high quality realtors coming into the city, it seems to me, and would prevent clusters of the city with signs so there is some benefit from the licensing, Councilman Jett: I have heard this argued in this Council before and I have heard discussions re this on the realty board. I must agree with Councilman Heath and go on record in opposition of this because of my knowledge and experience in the real estate business, I do feel that this is an ordinance that the City of Covina has had on their books and there has been absolutely no effort to enforce it. If there was some way of putting a clause in here that we could police these signs .from areas we feel are too far away, I would go along with an ordinance like that, Mayor Pro Tem Krieger; Historically, the license fee has been justified for the privilege of doing business, I would submit that a real estate company, whether its home base is West Covina or outside of West Covina, is dcinp business in the City the moment it puts the sign on a piece Iof property. This is one of the most effective ways that a realtor does his business, I do see where it is unfair if they want to do business in the Citv of West Covina to impose upon them some type of a license fee as we impose on other businesses who do business in the City of West Covina, As far as reciprocity to neighboring communities, I suppose we could extend it to them if some contract was arrived at and with them where they returned the courtesy to the City of West Covina, I have heard these references to professional men again and again and if a doctor or a lawyer wants to open up an office in Covina or Glendora he will pay a license fee for the office and this is the way that an attorney or a doctor advertises his services, by opening an office and hanging out his shingle. A real estate man or a real estate company I don't think is directly dependent upon having an office, What he needs is communication to the public, The sign represents communication to the public, This is doing business. I just can't quite follow why this is an unreasonable form of taxation upon.somebody who comes to our City and wants to derive a direct financial benefit from the practice of his profession within our City limits, Councilman Heath; I think it comes down to the Point of what is doing business, If you are transacting business from a structure where you have vour records, this would be an office and there is no question about whether or not that needs a license. The next point is what do you constitute as a ibusiness; what action would require a l.cepse other than that? If just putting a sign on the front of a piece of property is constituting a business, then I think we must look a little further and look at every sign board installed in the City because it should pay a business license, -10- C. MOBIL- ECONOMY RUN DAY Proclamation Mayor Pro Tem Krieger: as Mobil. Economy Run Day. LETTER FROM LOS ANCELES CITY COUNCIL RE: SOLUTIONS TO PLANNING, TRAFFIC, RECREATION 6 PARKS, PUBLIC WORKS PROBLEMS (Informational) If there are no objections, I will proclaim March 14, 1966 (No objections voiced.) So proclaimed. Motion by Councilman Heath, seconded by Councilman Jett, and carried, that this letter be accepted and placed on file. SIDEWALKS Cortez 6 Hollenbeck Motion by Councilman Heath, seconded by Councilman Jett, and carried, that the City Staff be authorized to meet with the Trust Department and present them proposal No. 1 as outlined in the report of March 4, 1966. FIRE DEPARTMENT City Clerk, Mr. Flotten: We have been requested .to -'burin down a building at 52.1 S. Glendora Motion by Councilman Snyder, seconded by Councilman Heath, and carried, that the staff be authorized to proceed according to the City procedure in this matter; that the necessary permission be ?ranted. OCCIDENTAL INSURANCE City Manager, Mr. Aiassa: The Mayor received a letter from Occidental Life, acknowledging our letter, This is for your information only. -11- • C. C, 3/7%66 COUNCIL COMMITTEE REPORTS VINCENT 8 WORKMAN TRAFFIC GUARD Page Twelve Councilman Jett: With reference to the letter we got from Mrs. Scalla at Vincent and Workman, do you still have a traffic guard there? City Manager, Mr, Aiassa; Councilman Jett: SALARY RAISE Yes. You will have a staff report on this. I would like the record to show that I requested that the crossing guard be kept there, Councilman Snyder: Regarding this article in the Sunday Times regarding the salary raise, after reading it I became more confused on whether the Legislature intends to take any action which will allow us to rescind our action, City Manager, Mr, Aiassa: I will take care of that, Mr. Williams has set the time on that and we have already discussed that matter, COIN -OPERATED POOL TABLES Councilman Snyder: It has been brought to my attention or I was asked to look into this regarding coin -operated pool tables and this would go further and include any coin -operated game of chance like bowling and shuffle board that are put in bars around town. Most of these areput in on a minimum rental of $25.00 a week and these are five-year leases and these pool tables only cost $500 and if the man goes out of business the total lease amount is a liability against the assets of the company, This has nothing to do with the City, but I was Just pointing out that people who put these in do some rather stupid things financially, It was pointed out that pool tables in beer bars tend to be a police problem. I would like a re-evaluation of the licensing involved here, Secondly, I would like a report by the staff regarding? feasit,ility of prohibiting pool tables in places where alcoholic beverages are sold, City Manager, Mr, Aiassa: MEETING WITH MR. YOUNT We will take care of that, Councilman Jett: Mr, Aiassa and I had a meeting with Mr.Yount in reference to the annexation on the east end of the City the 118 acres in litigation at the present time. -12- • • C C. I would suggest that we wait for the Citv Attorney to be with us at the next meeting and discuss it with him in -private, Councilman Jett: AZUSA TRAFFIC LIGHTS Councilman Heath: Public Services Director, Mr. Fast: POLICE TATTER Fine, How do we stand on the traffic signals on Azusa Avenue?
