02-28-1966 - Regular Meeting - Minutest • MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF WEST COVINA, CALIFORNIA FEBRUARY 28, 1966 The regular meeting of the City Council was called to order by Mayor Nichols at 7:35 P.M. in the West Covina City Hall. Councilman Jett led the Pledge of Allegiance. The invocation was given by Rev. DeWitt J. Brady, Congregational Church of the Good Shepherd. Accept driveway, sidewalk and drainage improvements and authorize release of cash deposit Staff recommends acceptance. Motion by Councilman Krieger, seconded by Councilman Heath,, and carried, to accept the driveway, sidewalk and drainage improvements�in Precise Plan of Design No. 480R and authorize release of the cash deposit in the amount of $1,000.00. PROJECTS MP-6423 (CAMERON; MP-6424 (DEL NORTE); MP-6425 (CORTEZ); MP-6429 (PICKERING) • APPROVE PLANS & SPECIFICATIONS SPRINKLER SYSTEMS FOR CITY PARKS APPROVED LOCATION: Cameron, Del Norte, Cortez and Pickering Parks. Review Engineer's report. Approve plans and specifications. Authorize City Engineer to call for bids. Co 2/28/66 'CITY 'CLERK'S REPORTS - Continued TRACT N0., 28220 EXTEND TIME TO FILE FINAL MAP Southern California Savings and Loan Page Two LOCATION: Southerlv of Hidden Valley Drive, Hollen- crest Drive and Alpine. APPROVED Review Engineer's report. Extend time to file final map of Tract No. 28220 for a period of one year to April 14, 1967. Staff recommends approval. Motion by Councilman Heath, seconded by Councilman Jett, and carried, to authorize the extension of time to file a final map of Tract No. 28220 for a period of one year to April 145 1967. PROJECT SP-6601 LOCATION: North side of Merced EXTENSION OF 1965-66 PRIORITY from Pima to Lark Ellen. SIDEWALK PROGRAM APPROVED Review Engineer's report. Authorize extension of sidewalk program to include north side of. Merced Avenue frot'Pima to Lark Ellen Avenues. Staff recommends approval. Councilman Heath: This authorizes an extension of sidewalks on Merced .from Pima to Lark Ellen. I attended the School Board meeting last Wednesday night as Council representative and at that time it was brought up that there has been considerable concern by parents of the condition of the street and the lack of sidewalks at the northeast corner of Hollenbeck and Cortez. The School Board asked if it wouldn't be possible this year to alleviate that problem. Before we approve something of this type on Merced, I feel that any money which we would spend on this project would be better spent on correcting that condition at the northeast corner of Hollenbeck and Cortez. City Manager, Mr. Aiassa: We don't have the right-of-way at Hollenbeck and Cortez. Mayor Nichols: I am personally very much of the opinion that the point that Councilman Heath raised is a valid one in terms of the need there at Hollenbeck. However, the Mayor has received letters from the people along Merced Avenue and that for well over a year they have been asking for this sidewalk and we have a situation where Merced is being extended through which will further increase traffic. Councilman Krieger: Maybe we can accomodate both by moving ahead on this, which • is apparently timely now, and directing the staff to give priority consideration to Hollenbeck and Cortez. Councilman. Jett: Cortez and Hollenbeck is the only major intersection cross-town that has just a two-way stop. Could we make that a four-way stop? This would help the children out, too. -2- • Co Co 2/28/66 Page Three PROJECT SP-6601 - Continued Motion by Councilman Krieger, seconded by Councilman Heath, that on Project SP-6601 that the Engineer's report be received and accepted and that the extension of the sidewalk program be initiated to include the north side of Merced Avenue from Pima to Lark Ellen Avenues and that $738076 be allocated from the unbudgeted capital outlay fdhd in addition to that presently available as unencumbered balance. Motion by Councilman Krieger, seconded by Councilman Jett, and carried, that Item No, 5 of the report of the Recreation and Parks Commission of their February 23rd meeting be held over to the next study session of the Council on March 7, 1966. Councilman Jett: Move the adoption, Councilman Heaths I feel the $500.00 fee for a full year on a project of this magnitude is not enough revenue for the City. It is necessary to hold a hearing on this ordinance and I have failed to prepare the notice setting.the hearing but I will furnish that to Mr. Flotten. He will have to `.publish this so that this will not come up at the next meeting for passage but you may introduce it tonight. March 149 1966, ROWLAND WATER DISTRICT HYDRANT RENTAL AGREEMENT City Manager, Mr,, Aiassa; Explained points of this matter. Councilman Krieger: Paragraph 8 bothers me in this agreement,, This exonerates the water district from liability for failure of pressure,, Councilman Heath: This is the one we are questioning of the City Attorney. City Attorney, Mr,, Williams: All I can'say is we have had similar contracts `_-before and we can°t force a person to make a contract :`diff.erentthan:what: they are willing to make,, This is what they have said they would make and this is the provision they put in it. We can negotiate further if it is your desire,, All this., is saying is that they don't guarantee that they can do it but if there is a problem, they are liable,, A person cannot escape liability for his own wrong doing by putting a clause in an agreement but he can escape liability as an insurer that the water pressure will remain 'this,, Councilman Krieger: What bothers me is whether or not the City is placing its -elf in a position where we are by inference agreeing to hold the water district harmless from any claim of this particular type,, City.Attorney, Mr,, Williams: I am not particularly concerned about that,, Co Co 2/28/66 Page Twelve ROWLAND WATER DISTRICT (HYDRANT RENTAL AGREEMENT) Continued Councilman Heath- Can we add hereby if any of these lines have to be removed for street purposes that it be done at the expense of the water company? City Attorney, Mr, Williams- This agreement only has to do with hydrants, Councilman Jett- Is there any specified pressure they must maintain at the present time? City Manager, Mr, Aiassa- We.discussed this with the Azusa Water Company and it's prett hard because the minimum pressure I think was fifteen pounds. _- You'd have to run a test on numerous hydrants to be sure that you're maintaining that pressure. Motion by Councilman Krieger, seconded by Councilman Jett, that the Mayor and City Clerk be authorized to execute the fire hydrant rental agreement with the Rowland Area Water District as submitted, Councilman Heath- Section 7 on the first page, comment by Chief Wetherbee, . has that been taken care of? City Manager, Mr, Aiassa: I am presuming the motion of the Council will include the City Attorney's review of the three items outlined, Councilman Krieger- I understood that the Citv Attorney has reviewed this proposed agreement, not Chief Wetherbee's letter, and the agreement as proposed is what the City Attorney has passed on, City Attorney, Mr, Williams- That's what I said, I've talked to Chief Wetherbee about these items. He feels that under the agreement,without the agreement being specific, and it being specific only that the City is responsible for the hydrant risen that he would just as soon leave it without making it more specific,for fear if we got into it they will specify that we are responsible for the valve,and he doesn't want to be responsible for the valve. It gets us into electronic data processing in the easiest way we can with the minimum amount of confusion and the minimum amount of difficulty and the costs are approximately the same as if we went out and replaced our present mechanical bookkeeping machine, Councilman Krieger; Mr, Kay, on Page 2 of your report you stated that the speed and capacity of the basic equipment recommended in this report is geared to accomplish the day-to-day housekeeping tasks of the municipal government in the 60,000 to 80,000 population bracket, Do I infer from that that as long as we stay within that bracket this equipment will be the only equipment needed? Finance Director, Mr, Kay: Almost, Sometime when we get to the 80,000 bracket we would • replace at least one unit of this configuration, probably with -a 407, Councilman Krieger: On Page 5 you say when the City°s population reaches 75,000 to 859000 electronic accounting machine will no longer have the speed. Is that what you are referring to? Finance Director, Mr, Kay: Very definitely relationship to the type of services, We think we will probably move into data processing on one or two fronts, Eventually we will reach out and do some work on a service basis and we are assuming when we say this equipment will last us to 80,000 we are assuming that certain work will be done on a service bureau basis, Councilman Krieger: You will switch over just the replacement of the leased equipment? Finance Director, Mr, Kays Right, We could buy the equipment at about the same cost of leasing but it would take us four and a half years to buy it. I don't think the way the data processing field is going that we would want to retain this equipment for four and,a half years, Councilman Krieger: Are the lease agreements pre- pared such that when you are in need of more sophisticated equipment that you can merely replace the existing leased equipment with the more advanced unit? Finance Director, Mr, Kays Right, This is one of the reasons we selected this par- ticular manufacturer, For all the other manufacturers we would have had to add I,B,M, equipment as we grew, (Drew sketches on the board and explained same,) Councilman Heath; I feel this is a complete and good report, I would accept the recommendation of the staff and move that we proceed in accordance with the recommendations in the data processing report dated February 119 1966 as outlined therein, Councilman Krieger: I would assume that the intent of your motion would be just for the leasing of the first piece of equipment as outlined in the report, is that correct? Co 2/28/66 Page Eighteen CITY MANAGER REPORTS - Continued 0 SUNSET SCHOOL IMPROVEMENTS Mayor Nichols: The action last time was to re -affirm our basic policy relative to the curb and gutter installation but that the Council would be receptive to any additional recommendations that the West Covina School District might come up with. They have come up now with a recommendation which concurs generally with what I think was suggested by Councilman Krieger, that they are willing to budget or provide the cost of approximately $4,300, which is half of the cost of the project. Councilman Heath: I attended the Board meeting as representative of the Council when these things were discussed. I would say that the entire Board was very cooperative in trying to resolve this. They have their problems as far as money is concerned. They did not have enough money in their particular item of the budget for taking care of one-half of the cost of the project but they did move money out of the general funds to make up the difference so they would have enough money to pay for half of the project. I would like to commend the Board of Education for their cooperation on this project. • Motion by Councilman Heath, seconded by Councilman Krieger, that the Mayor and the City Clerk be authorized to sign an agreement with the school district on a fifty-fifty participation for the improve- ments in front of the Sunset School where the school's cost will be one-half of the cost of the improvements in front of the school making allowances for that improvement which has been completed in front of the Maxson Center but that their share should not exceed $4300.00. City Attorney, Mr, Williams: The 6% is fixed by law but I believe there is a means of vary- ing it, Bearing in mind that these ar-e tax-free bonds, the 6' is quite an attractive figure and they go to bond and there is no lack of market for them, If they were not tax-free, your point would be well taken, Being tax-free, there is a big demand for them, -20- • n 0 Co Co 2/28/66 -COUNCI'L COMMITTEE REPORTS EAST SAN GABRIEL VALLEY PLANNING COMMITTEE Page Twenty -One Councilman Krieger; This ties in somewhat with the East San Gabriel Valley Planning Committee,, There was an ad hoc committee appointed some months back on hillside developments under the chairmanship of Councilman Lawing of Pomona,, Councilman Lawing in discussing this situation with various experts in the field also discussed it with Mr,, William Dale over at Cal State Polytechnic College and Mr,, Dale is head of the landscape architecture department and a fairly unique type of symposium is being scheduled for Friday and Saturday of this week and I would like to call the Council's attention to this symposium in the hopes that perhaps one or more members may be able to attend,, I was asked to chair the Saturday conference but unfortunately I am committed to a State bar meeting,, The symposium is entitled, "Man and the Hills" and is under the sponsorship of Cal,, State Polytechnic College at Pomona,, The symposium is open to the various bodies within the area and intends to keynote the subject matter from the standpoint not only of the political entities but from the engineering standpoint, the geologist,'landscape architects, landscape economists, developers, lending agencies, and they -hope to work into this the most.important contribution and that is of the elected officials and executives that comprise the decision making bodies in the area,, It is hoped that from this symposium will begin to develop some broad framework of hillside planning and development,, perhaps something uniform in approach between the communities can be decided upon so that one community isn't off in one direction or off in no direction at all,, We have received two reports now from this group at the East San Gabriel Valley Planning Committee,, There are representa- tives who will be in attendance from our City, including Mr. McCann, who is the Planning Commission Chairman, and Mr. Joseph and Mr,, Gingrich, and Mr,, Zimmerman,, It had been my hope to attend and to chair the Saturday conference but I call this to the Council's attention with the suggestion that if any of you gentlemen are available for either Friday and/or Saturday at Cal,, Poly, that this would be very worthwhile and it is the first of its kind that we know of that has been held on this subject matter, Councilman Heath: I would like and possibly The registration fee of $10,,00 includes luncheons .Saturday. to attend Friday Saturday,, on Friday and Motion by Councilman Heath, seconded by Councilman Jett, and carried, that certain individuals of the staff be authorized to go to this symposium and that these persons be determined by theCity Manager and that the City pay the registration fee and necessary expenses, and that this include the representatives of the Planning Commission and the City Council,, City Manager, Mr,, Aiassa: We will poll the Council to see who will be going, -21- r • • C a C o 2/28/66 COUNCIL COMMITTEE REPORTS - Continued HILLSIDE DEVELOPMENT Page Twenty -Two Councilman Krieger This ties in a little bit with hillside development. I wonder if it is possible for us to develop some type of an ordinance in this City and perhaps this is more for the City Attorney, to handle a situation that appears to be developing in our hillside properties and that is the motorcycle and the go-cart which is becoming more and more of a headache, and I mean that literally, in these areas. City Clerk, Mr. Flotten: that now possibly they are motorcycles. They tell me ordinance that controls it us a copy of it. Councilman Krieger: We have a complaint from the Home Savings and Loan property tearing that whole area to pieces with that the City of Industry does have an and I have asked the City Manager to send Could we also have the comments of the City Attorney on this particular matter? City Attorney, Mr. Williams: One that might help, I believe, was recently adopted by Montebello and I think it is probably similar to the City of Industry ordinance which didn't relate to activity on the street directly but it prohibited hill climbing, hare and hound, games, anything of this kind on private property other than that of the owner by motorized vehicles. You might ask the City of Montebello to send that ordinance to us City Manager, Mr. Aiassa: STATE CAPITOL TOUR I will work on this and give you a report. Councilman Jett: I attended the Chamber of Commerce luncheon the other day as the representative and one item that was brought up that I thought should be mentioned here was the State Capitol Tour coming up on March 22nd. This is similar to what we had last year and we had an appointment with our representatives.
