MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL.
CITY OF WEST COVINA, CALIFORNIA
February 21, 1966
The adjourned regular meeting of the City Council was called to order by Mayor
Pro Tem Krieger at 7:30 P.M. in the West Covina City Hall. Councilman Jett led
the Pledge of Allegiance.
ROLL CALL

ORANGE AVENUE STORM DRAIN
• Motion by Councilman Jett, seconded by Councilman Heath, and carried, that the
Council rescind its prior action of January 24, 1966 regarding holding harmless the
State freeway in the event Orange Avenue is used as the off ramp in the alignment
of the sewers.
(Councilman Snyder entered the chambes at 7:32 P.M.)
Motion by Councilman Heath, seconded by Councilman Jett, and carried, that the
Flood. Control District would be held harmless, from the extra cost of the
construction in the. event Orange Avenue is used as the off ram.pr in the, alignment
of the sewers .
Motion by Councilman Heath, seconded by Councilman Jett, and carried, that the
recommendation contained in the letter of February 17, 1966 which has to do with
four specific items to implement the prior motion be approved. The recommenda-
tion of the staff is that the engineering fee of $7, 367.76 to Harold Johnson be
approved for this re -design work, authorize the appropriation of funds from
Surplus Account No. 124 Flood Control, that upon receipt of the plans the staff
be authorized to obtain an approval from the Flood Control District for
immediate construction of the drain and that the Council approve an extension
of time of three months for which the consulting firm can re -design the project.
CIVIC CENTER COMMUNICATIONS CONSULTANT
Motion by Councilman Heath, seconded by Councilman Jett, and carried, that
'the Mayor and City Clerk be authorized to sign the agreement dated the list
day of February, 1966 between the City of West Covina and Messinger
Consultants in the amount of $6, 500.00.

. STREET IMPROVEMENTS
CHAMBER OF COMMERCE RECOMMENDATIONS.
Mayor Pro Tem Krieger: The Chamber originally submitted
certain recommendations to the City
through .their. Traffic Advisory Committee. It went to the staff of the
Planning Department; the -Staff of the Planning Department made their report to
the Planning. Commission,.. and the Planning .Commission,, in turn, made its report
to us and subsequent to .that report there were certain comments made by the
staff in a memo dated. February 10. and.in a_.memo dated _February 18.
. Councilman. Heath:, .We are .talking here about an east and
westroad north of the freeway and south
of the freeway. Under.. Item 3 it says .".Walnut. Creek. -Parkway Extension". (Read
said section. re .this. matter-.:). What construction ordevelopment would be coming
along on the 'Walnut Creek .Parkway. which .would ..permit us to extend to a
84-foot width? :What. I am trying to say is this street is fined with houses at the
present time and. if we. are thinking. of waiting until these houses fall down before
we can -widen. and then when a new development goes on these',.properties we
widen the street,..I think we will be waiting for .a long time. The same remark will
apply to the Workman Avenue recommendation. I don't think this is. -putting
the finger solidly enough on when and how this street will be implemented..
Mayor Pro Tem Krieger: .We have a_fairl.y Oroad and compre-
hensive report involving a number of

the next Council. I think we should
either final iz.e..this .amendment before the election or hold it over until after
the election.
Councilman- Jett: I would think as one member of the
committee who met to resolve this.,
....we had two members of the Planning Commission and two members of the
Council and...there- was _..unanimous,-. agreement on the three or four points and.
substantially they were the same ..s:u,ggestions that were made by Councilman
Snyder when he made the motion that we have this -committee meeting.. I think
the only area in which there was misinterpretation was the time., the 30 days.
-We also felt there should be no change at this .time; that there .should be no
deposit . We .felt they :should come .in. and..,get a. permit... If . it . got to . a point
where it -was :becoming. .an expense to the City by so .many coming in and
asking for_.this, then the Council would determine a fee or come back for a
fee.
..Councilman Snyder: I do think 30 days is pretty short.

Councilman Snyder: The committee said not to exceed
30 days. I personally feel that
should not be exceed 60 days.
Councilman Jett: I concur with that.
Councilman Heath: Does -this mean 60 days, that at
...the end of .that .time the man can
take them .down. for .an hour and then .put .them up for another 60 days? That
• would be continuous installation
Councilman Jett: That would be. left to..the discretion
of .the staff. I -don't think anybody
is going to try to do this-,. keep -it up. continually -
Councilman Heath: I do.

• _.-Mayor Pro.Tem..:Krieger.: We have in our promotional
events ordinance a .maximum
limitat-ion,-dur-;ing..a.calendar year. If this is what you .desire to do, it
may be well to .place some kind of maximum limitation during any calendar
period.
Councilman Snyder: What I -didn't .want to do is there
are certain shopping centers that use
them for decorative: -purposes only.. I think in these cases they are decorative
and they do ,make .the City look better. I don't want -to ,prohibit any of them from
having decorative banners the year around. If you limit it to 60 days, at
least they have..to come in..and..either make sure their banners are clean and of
quality to last another 60 days -or replace.them.. ..
Councilman.. Heath:
When is a -banner clean and when
isn't it clean? You will leave this
to the judgment of one individual.
Mayor Pro- TemKrieger: Was it the committee's recommenda-
tion`on philosophy that banners
should be permitted the year around?
Councilman Snyder: Yes.. It was also our feeling that the
wording -on them should be restricted.
Councilman Heath: I think you lose the effectiveness if
you have year-round banners.
-Banners -are -worse to aesthetics. than a flashing sign. True, banners can be used as
an asset, but if they are there all the time,, you are losing the effectiveness.
Councilman Snyder.: That is the point of the 60 days.
--Mayor-.Pro Tem Krieger: I -agree. I think the recommenda-
tion if implemented would be we
totally anasculate. any control over the. existence., not the .appearance, but the
existence of ..banners. I think -we are more. stringent in a field that is more
critical -to the business --community and that-is..promotional sales and yet we limit
them quite firmly -during the course of any year and yet in terms of banners,
--which I think are probably less- critical to them,..we adopt a different approach.
I a.m-opposed .also -to the .unrestricted,_._the. -possible unrestricted use of banners
-throughout the year. Unless we can resolve .this basic question, we have no place
else to go- until we have a firm majority on the Council..
Councilman Heath: I would say for two weeks .prior to
any .promotional event the banners
would be allowed. This should be a .promoti.onal event in an entire center. I would
propose that banners .be ,permitted two weeks.. prior. to anypromotional sale where
this sale...i.s...in..a..:shoppin.g.ncomplex-and.the sale is common to the entire complex
or to the individual.,businessman.not ..in.a center -may. have -banners for.two weeks
prior to the. ..sale,...but. in, no event more than, six times a. year..
Councilman -Snyder: I think it's too restrictive.
Councilman Heath:
We will change it .that Christmas
decorations will be allowed for
six weeks prior..

we have a limitation there as to how
many promotional sales they may have during.the year.
Planning Director, Mr.. Joseph: The.limitation is that you may have
....o.utdoor_display and sale of merchan-
dise once a: year not to exceed three consecutive. days. Thisis. for -.a .shopping
center or.,department.store -as-defined.. Texhporary carnivalsand circuses may be
permitted for a -per- iod. of ten days in .any calendar year with no such activity being
conducted for longer than five cco.nsecutive' days at one .time. Promotional. events
of an educational,, civic or cultural nature may be permitted without time
restrictions except as fixed in the conditions of. -approval. The sale of fireworks
than R-A or--R 1 not o exceeds even days in any calendar year. The

Councilman Snyder: What I had in mind was allowing
decorative banners and pen,nan:ts .
The banners and pennants will --be permitted for decorative .purposes. These
-shall-be. witho.ut.: warding.,exce.pt werds .,pertaining to seasonal or holiday greetings
and. special .public events. We .can.add pemnis .and .banners.,advertising .special sales
and special events will be permitted- along -the lines suggested..by_Councilman Heath.
Mayor Pro. Tem Krieger.: I think the direction of.that thought
is more in line with what I was
thinking... -I. .think the,:point of .distinction should be between advertising banners
and ..decorative -banners .and;,:seasonal...greetings - would not be considered as
advertising... You have mentioned time limitations on this and time limitations
on adwrtising:.banners:.-
Councilman Heath's .motion

In the beginning you said "decorative"
What is the time limit on the
decorative ones?
60 days.
The way the motion is stated, he
doesn't distinguish between decora-
tive and seasonal.
They require a .permit. They can come
in at the end of 60 days and get a new
permit.
I think we will need a full Council
for this matter.
Councilman Krieger-: My own .particular point of view is
that even though it is decorative or
seasonal and even .though you allow them 60 days, which I don't take exception to,
I think there ought .to be a .maximum. usage during .a calendar year during which time
they can.display_these flagsor banners.
Councilman Snyder: How- about if we add these will be
permitted for a period of 60. days but
shall not remain up in excess of 120 days?

Councilman Heath: If we need banners or pennant,s:. for
decorative reasons I think we
should include them in the ordinance as a requirement and necessity for the
development of a- precise plan if they are so essential.

Mr. Phil Wax: I attended an International
Shopping Centers Association
meeting. They allowed all the different medias of advertising to be expressed on
dnational basis and there is a Mr. Ed Foley and they allowed him equal time to
demonstrate what banners, et cetera, could do for shopping. ..centers.. If you
would like to see what I am speaking. about as far as the Plaza is concerned, I
will try to contact Mr. Foley and see if he will bring the slides to you and
demonstrate the type he is using and what he is trying to sell in the shopping
centers.
Mayor Pro Tern. Krieger.: It is the consensus of the Council
that we would have no objection
to extending -an invitation to the West Covina Plaza Merchants Association to
appear at the study meeting of March 7th and they will be allowed the opportunity
to make a_presentation at that study session.

DEPARTMENT OF EMPLOYMENT OFFICE OCCUPANCY
.......Mayor Pro Tem Krieger: There..ar..e two reports,, each. dated
February.2lst with regard to this
matter. This is the State Employment Building at 933 South Glendora Avenue..
Public Services Director, Mr. Fast: The State Department of employment
called the City on Friday indicating
that their_ lease was :expiring. on..the 2.8th after an extension of the basic lease. They
have notified'all: of. their customers to report to the City of West Covina starting
Monday -morning,.._the 28th, :.and we were informed late Friday that the City staff
had been infoxmed that the ymust...compl.ete.:all .of.their...precise_.plan and .building
plan and special .requirements. priorto moving.in. After .taking a look at .the
situation of what remained yet to be. done, the staff felt it would be desirous and
almost mandatory .that the California Department of Employment should have as a
minimums the -.:parking: lot and. the sidewalk. complete. so that the public area would
be complete;.. -and secondly, ., that -all .:thesepeople will -be :in there Monday, estimated
500;- would have .a ,place to .park,_ -We -felt .perhaps it would behoove us .to allow them
on' any of the other .items .they -couldn't .quite finish by the 28th to allow them to carry
it -over if-.ahe-y-,would„post- a-,-bond.with. the .0 ty:,to.,guarantee .the completion of those
other -items. The bond would be the face value of whatever remained as of
Thursday night:.: We would re-evaluate it at _ that time.

the owner and the contractor have
assured us .they- will. do .ever_ything they. can and .they .feel .they will be able to make the
date on the. parking.-lo.t.In the event .they do :not and it..has. happened, I believe staff
should perhaps_..have _some .direction in regard to which direction they want us to .go
on this- because.:h,under-.stand„a,good.,perc.entage-.of .these..people ..show up .and find
the- -door s.,are-locked.,and.nobody.,there. wouldn.'t, be-.too.happy. There .are several
alternatives and.the only::practical one .that I know of and that is we face the

VALENCIA ,HEIGHT$ WATER COMPANY LEASE:

from. Ed Howard. The Valencia
Water-Company,So.ard-has,. approved the.extension of our lease as .per. -agreement
and they are ..now. in the. -process of .drafting .the lease and it will be forwaded to
us. We hope to have it by the 28th. This is for your information only.

annexation areas seem to have positive
features except. one which had some.:rilar.ginal areas. Would it.be impractical for
the Council: --to: suggest .active solicitation in these areas rather than combatting
Covina, .t.o.take the initiative so that .the people in these areas would have.the oppor-
tunity to anie-x -to -West Covina? The.only.:thing the .Council has. done over there is the
-same thing._..w. e__do..here..-.Wo.uld .we..be..willing_to...see annexational action held in..that
area? I .think :rather ,than be: the..antagonis.t .we should be .the ..pr.ot.a.gonist
and come in with our own act- of annexation campaigns..

those areas highly recommended in. the. annexation report; that .the staff .do this

Sanitation District where if there

downstream so .that .the sewage can drain down into that stream. I fought this
but I was overruled.
Councilman. Snyder I don't know how they could make
that stick.

Agency Formation Committee has ever .been.bound by this .policy in.making their

Councilman, Snyder: From..a...public relations .standpoint
and from a -public safety standpoint
it makes Little .sense to give a ticket in a case like this where a man has a stop light
out.
City Manager,.,.Mr_._. Aiassa.: The Division of Highways ' concept
is that if you only give them a
warning, .9,9%..of them don't bother fixing..it..... .
Councilman... Snyder: They have to report in.
City-Manager.,,.Mr_. Aiassa: You ._can_give .them a faulty equipment
citation..and..it requires a certificate
that that item has been repaired. I will check on this with Chief Sill.
