Discussion January 24, 1966 ) on Minutes of January 24, 1966 as January 31, 1966 - ) follows: City Clerk, Mr. Flotten: On Page 38 of the Minutes of Jan- uary 24 at the top of the page, we would like to rephrase the motion by Councilman Jett. It would re- flect the same information but the wording should be different. The wording now reads, "Motion by Councilman Jett, seconded by Councilman Snyder, and carried, that the staff be authorized to sign the agreement .holding the State Freeway from any additional expense in the event Orange is used in the off ramp. . .". The motion should read as follows: "Motion by Councilman Jett, seconded by Councilman Snyder, and carried, that the staff be authorized to sign the agreement holding the Los Angeles County Flood Control District free from any additional expense due to storlri drain realignment caused by possible freeway interchange interference." Councilman Jett: If I understand correctly, it is the County Flood Control who were objecting to this additional dost and not the Highway Department. - Public Services Director, Mr. Fast: It is not an objection so much as the fact that the Flood Control District can only pay on that which was voted on in the 1964 bond issue which was a straight alignment which would go through a possible inter- change. • Councilman Jett: I will go along with the change in this motion. Councilman Krieger: I don't think properly this is a correction to the Minutes. The motion was correctly reflected in the Minutes but the staff is not desirous -1- C, C. 2/14/66 APPROVAL OF MINUTES - Continued in having the motion phrased in the manner upon it. I would suggest that the Minutes a subsequent action of the Council be taken a motion properly phrased, Page Two in which the Council acted be approved as submitted and at this meeting to effect Motion by Councilman Krieger, seconded by Councilman Heath, and carried, that the Minutes of January 10, 1966, January 24, 1966, and January 31, 1966 be approved as submitted, CITY CLERK'S REPORTS PROJECT C-139 LOCATION: Lark Ellen Avenue, San ACCEPT .STREET IMPROVEMENTS Bernardino Freeway to F, W, Richter Construction Puente Avenue, APPROVED Accept street improvements and authorize release of United States Fidelity and Guaranty Company bond No, 14322-12-2918-65 in the amount of $87,101,36, Staff recommends acceptance, • Motion by Councilman Heath, seconded by Councilman Krieger, and carried, to accept the street improvements in Project C-139 and authorize release of the bond, PROJECT CO-6516-2 LOCATION: Communitv Youth Center APPROVE PLANS & SPECIFICATIONS at Cameron Park, ON SITE CONCRETE WORK APPROVED Authorize City Engineer to call for bids. Staff recommends approval. Motion by Councilman Heath,'seconded by Councilman Krieger, and carried, to authorize the City Engineer to call for bids on Project CO-6516-2 and to approve the plans and specifications for said project, PROJECT FBP-6407 LOCATION: Azusa Avenue bridge at PEDESTRIAN FOOT BRIDGE Walnut Creek Parkway, AZUSA AVENUE BRIDGE APPROVED Review Engineer's report, Approve appropriation to extend rental period of pedestrian foot bridge for approximately one year. Staff recommends approval, • Motion by Councilman Heath, seconded by Councilman 9 , Krieger, to rove g approve the appropriation to extend the rental period of the pedestrian foot bridge for approximately one year as set forth in Project FBP-6407 as recommended in the staff report, Councilman Krieger: We have a suit on file against our insurance carrier on this particular matter, don't we, as for coverage? -2- C, C, 2/14/66 Page Three PROJECT FBP-6407 - Continued City Attorney, Mr, (,Williams: Yes. Councilman Krieger: I think it would be helpful if the Council adopts this action that Mr, Terzian be made available of these additional damages accruing to the City by virtue of the extension of this lease, Action on Councilman Heath's motion: Motion carried. Motion by Councilman Krieger, seconded by Councilman Heath, and carried, that the staff be directed to prepare a letter and submit it to the City Attorney for the damages that have been suffered and sustained by the City regarding the Azusa Avenue Vehicle and Foot Bridge, including the extension of the lease on the foot bridge, PROJECT TS-6431 APPROVE SUPPLEMENTAL AGREEMENT WITH DIVISION OF HIGHWAYS FOR LOCATION: Azusa Avenue at Puente, Rowland and Workman. TRAFFIC SIGNALS ON AZUSA AVENUE Review Engineer's report, Approve APPROVED supplemental agreement with Division of Highways for estimated • increase in cost of traffic signals, Authorize Mayor and City Clerk to execute agreement. Staff recommends approval. Councilman Heath:. It was my understanding the State would reject all bids and go out for new bids, City Manager, Mr. Aiassa: The City processing a re -bid and from the figures given percentage, excessive the estimates they are on the other bid so they (Mr, Joseph entered the chambers at 7:45 P,M.) of. Covina protested the bid and they are now using, I presume, are are raising everybody's Motion by Councilman Krieger, seconded by Councilman Jett, to approve the supplemental agreement with the Division of Highways for traffic signals on Azusa Avenue as set forth in Project TS-6431 and authorize the Mayor and City Clerk to execute the agreement. Staff recommends approval. Councilman Heath: It says on the resolution that it includes those portions of Azusa Avenue between 630 feet northerly of Francisquito Avenue and Amar Road and between 300 feet northerly of Walnut Creek Parkwayo Does that mean northerly of Francisquito Avenue and Amar Road as it says? Qity Manager, Mr, Aiassa,: I think it simply establishes a policy and we will set the need as the nuisance arises. Mayor Nichols: The question I would have would involve the memo of January 10 which outlines the schedule for this abatement and which evidently proposes to include all of the washes, The question I would have would be is the staff intending to create abatement districts through all of the washes in the City or will the initial abatement district be limited to the problem area which was the blackberry bush area? -6 r� CJ C, C, 2/14/66 Page Seven RESOLUTION NO, 3320 - Continued City Manager, Mr, Aiassa: We would like to do the first one, If that is successful then we will gradually progress through the other areas because we will have to do them 411 eventually: anyway, Action on Councilman Heath's motion: Motion passed on roll call as follows: Ayes: Councilmen Jett, Krieger, Snyder, Heath, Mayor Nichols Noes: None Absent: None Said resolution was given No, 3320, Councilman Krieger: In the report of January 20 I notice we encompass the Vine Creek Drain, This is the very same area we had under consideration having to do with the Flood Control Channel, When we get to this I wonder as to the wisdom of imposing such a district in this area when we are immediately contemplating the installation of a Flood Control system through there, City Manager, Mr, Aiassa: SCHEDULED MATTERS None PLANNING COMMISSION SOUTHERLY ANNEXATION NO, 193 (Held from 1/24/66) We would probably not include this one, (Read portion of report re this matter,) see page 7-A. Councilman Krieger: I am somewhat fascinated by the arithmetic on this report, How are we able to be so finite on what it is going_, to cost under polices for example, to service this area? Planning Director, Mr, Joseph: The police costs are based on a head -count cost average throughout the City of West Covina, In our opinion, this is a very high figure, We feel the revenue anticipated is lower and the cost expected is higher than is going to be shown in this report dated February 99 1966, However, the Fire Department anticipates no additional fire stations or manpower to serve this location, There is now a facility in the Galaxy Tract, (Gave brief summary of report,) Councilman Jett: Would this have any affect on our insurance rate over-all or even in that area by adding this additional land to the City? -7- n 0 C . C . 2/14/66 SOUTHERLY ANNEXATION NO. 193 - Continued Page Eight City Manager, Mr. Aiassa: That will be determined on a re- evaluation of the entire city by the National or Pacific Board of Fire Underwriters, Every little portion will add something to the city's over-all rating one way or the other. Normally the underwriters will come in and give limited rating to small separate districts. This wouldn't materially affect our rate. Councilman Jett:. I think going along with the report here sales tax -- you do not give them credit for any sales tax. A lot of these people are spending money here so in reality they should be balanced off. Councilman Krieger: I consider it an interesting report and something, at least since I have been on the Council, is something that hasn't been sub- mitted to us in these annexations and I think these are interesting statistics for us to keep in mind on all our annexations as they pertain to each annexation. Councilman Heath: I feel the staff deserves recog- nition on the report. However, I must say I don't agree with it in many instances. I can't help but think of driving through the area and trying to visualize in my own mind how that area could be an asset to the City and I still don't see it. With all due respect to the report, I don't think it gives a true picture. I don't think the annexation will be an asset. Councilman Snyder: ., I feel if we are going to upgrade the standards of these areas instead of discouraging them, in light of this favorable report that we would make an error not to go ahead with these annexation proceed- ings. Certainly this area is practically an island. It is going to have to be in the City some day. IMPROVEMENTS AT DEL NORTE AND CAMERON PARKS (Concession Stands) Councilman Heath, and carried, Entranceway and Donorts Motion by Councilman Krieger, seconded by Councilman Heath, and carried, to approve the installation -of permanent concession stands at Cameron and Del Norte Parks in agreement with the report of the Recreation and Parks Department, CHAMBER OF COMMERCE STREET IMPROVEMENT RECOMMENDATIONS (Held from 1/24/66) Motion by Councilman Jett, seconded by Councilman Krieger, and carried, to accept both the.'Planning Commission recommendation and the staff report and also the Chamber of;Commerce letter re this matter and place those communicAtions on file, Motion by Councilman Krieger, seconded by Councilman Heath, and carried, that this matter be set for a study item for the study meeting of February 21, 1966,' CARAVAN INN PARKING Motion by Councilman Heath, seconded by Councilman Krieger, that the City staff be instructed to take whatever steps are to see that the Caravan Inn either complies with the present takes steps to.alleviate the problem; that the February 3rd the Planning Commission be accepted and placed on file, AMENDMENT NO, 72 (Flags 6 Banners) and carried, necessary code or report of Mayor Nichols: Staff is requesting that this now be received by the Council and that we direct the preparation of the appropriate ordinance and direct the staff to prepare a schedule of fees, deposit fees for use in the enforcement of the amendment to return these to the Council for action, -9- Co Co. 2/14/66 AMENDMENT NO, 72 — Continued Page Ten • Councilman Jett: At our committee meetingit was definite that -we were to set no fee for this, UAE become5a problem„ Councilman Snyder: That is the way I understood it. Of course, they had the right to come back with recommendations, Councilman Krieger: May I ask for an interpretation of this -report of February 3, paragraph one. I don't understand it: "Banners and pennants" without wording erected for the purpose of advertising special events and special sales will be permitted for a period not to exceed thirty days except wording of a non -advertising nature concerning seasonal or holiday greetings 'and special public events," Councilman Snyder: Banners and pennants without wording may be allowed without restriction to size except wording may be added in the case of special events and special sales as well as wording concerning seasonal and holiday greetings and special public events, Councilman Heath: It says here that they are rot • to exceed 30 days, ?Does this mean that every thirty days they take it down or take it down for one day and put it -back up and they can have the banners and penants up for a long time? Councilman Snyder It means if they are still in and get an extension of thirty days, good shape they merely come in Councilman Heath: This would lead to banners and pennants ,being a permanent installation, Councilman Snyder: Only if they are granted an. extension, Councilman Heath: I would like to have this sent back to the staff, Mayor Nichols: I think in practice what is going to happen is ifa situation develops where there is an overt condition and it is noticed by the public and the staff that a notation will be made on that and when that individual comes in and seeks an extension on his penants, he wouldn't get that extension -and that's the way to abate the condition • that is a nuisance, Councilman Krieger: I would rather see us approach this on the same basis we approach promotional sales which is a maximum limitation during,any, calendar year, Mayor Nichols: May I suggest that we hold this item off and place it on the agenda of the study session of'the 21st where we can discuss in -detail, this matter? City Manager, Mr, Aiassa: This is the alternate. We originally recommended Cameron • Avenue, After May 26 we will be in possession of the Japanese property and we will be able to extend the parkway to its full width,which will give us a free connection to Service Ave, to Walnut Creek Parkway, Public Services Director, Mr, Fast: This was generally mentioned in your first hearing, The basic difference between the sketch here and the one approved is a second choice which was of the frontage road because we didn't know the State's requirements insofar as tight interchanges were concerned, (Presented map and explained same,) Councilman Jett- Looking at this realistically, I don't think we would have a chance of getting that, The State has already put an underpass and overpass at Cameron Avenue, Public Services Director, Mr, Fast- The State has seen a letter of transmittal in regard to Freeway West where Cameron was indicated as a first choice and Pacific/Service indicated as a second choice, When they saw Service, they seemed to like that better than the first choice, I would feel the State would be looking favorably at Pacific/Service as a replacement for Cameron and therefore therewould be no additional charge at all to the City, Councilman Krieger- When we first had this before us, Cameron was the unanimous . choice and there was quite a bit of discussion on Pacific/Service. It was the second choice of the Council, I voted against Service/ Pacific even as a second choice because I was opposed to the loss of as much civic center land as we would under the original configura- tion. But, the present proposal by the Staff I consider completely acceptable, I think it advantageous to be our first choice from the attitude that the State has expressed concerning that location and, more importantly, I am concerned with the the traffic flow into that service road, The traffic flow into the service road which would. lead into our civic center would be facilitated much better under the Service/Pacific configuration than it would under the Cameron Avenue, -14® C, CQ 2/14/66 Page Fifteen FREEWAY RECOMMENDATIONS Continued Councilman Heath: I don't think we are in any position to make a recommendation of our first choice to the Highway Department. As has been shown, the more the staff looks into the matter and the more the State looks into the matter the more changes they come up with and the better plan they come up with,, I don't think we are in a position yet to make a recommendation. These interchanges are going to be with us for a long time and I think we should do them right,, If we send this information through as outlined here to the State we are saying that we recommend these as the first choice of what should be instituted and in my opinion as we have done on the Vincent Avenue Interbhange we have said thatwe know it isn't the best but it is the best we have on record so let's use it,, I am not in favor of these plans at all,, I am in favor of more study to arrive at a final approval to study,, Councilman Snyder: Vincent Avenue was a little different,, These are merely proposed interchanges and are a working point from which to start from,, Councilman Krieger: When we met with the State, Mr,, Hoy said they needed to know now,, Mr,, Schaeffer said they need a definite recommendation from the City now that is worthy of serious consideration,, I think the more we • delay this situation the more seriously we are going to prejudice our case from the standpoint of alternatives,, I think it is necessary for us to come in and say that these are our choices and then the State and the Federal Bureau of Roads can come up with their comments and observations,, Frankly, the staff's recommendation isn't my first choice,, I have come more and more to the point of view that my first choice is closing down freeway interchanges but I don't think that will be the first choice of the majority of the Council so I am perfectly willing to go along with the recommendation as it is presently embodied in this report,, I hope at the same time the Council will give consideration to a second choice which involves closing down some of these interchanges and putting in a main street,, Councilman Snyder: Mr,, Aiassa, is there any way to adopt this recommendation but leave it open to further alternatives that we might send in? City Manager, Mr,, Aiassa: If you adopt these as your proposals, you still have to negotiate an agreement with the State,, At that time when you formulate that freeway agreement is the time that the dye is cast,, Councilman Snyder: Can we adopt these recommenda- tions but include in our cover letter that we are presently studying a plan which would involve fewer interchanges which will be forwarded to them at such time as it is finalized as an alternate? Councilman Heath: You could say to the this is a suggested we would like them to use as a basis for the beginning of our staff and the State to come up with a final plan. In you state that it is a suggested plan and a basis to start then would know that there are going to be changes made,, State that plan that work between this way if with, they ®15® C. C. 2/14/66 Page Sixteen FREEWAY RECOMMENDATIONS - Continued Councilman Jett: We have to consider the Huntington Beach Freeway Interchange where it intersects with the San Bernardino Freeway. I feel we have to get moving. The State has talked to our consultants, reviewed this with the staff; they are aware of what we have talked about in the past. I think it behooves us now to move this on and approve it and get it on the way. If we want to make changes later on, we can. Councilman Snyder: Move that the recommendation of Mr. Fast dated February 11 evidenced by this Exhibit A be accepted and transmitted to the State as our first suggestion of interchange modifications but that we would like to reserve the right to submit such alternates that should possibly seem feasible. Mayor Nichols: What we are trying to do is send this report through but to say to the State in effect that if they would be willing to consider more extensive interchange revisions in turn for the off -ramp structure through the City we would like to have the opportunity to review it further with them. Councilman Snyder: I think I will withdraw my motion. Motion by Councilman Krieger, seconded by Councilman Snyder, that the • City Council adopt a motion that we transmit to .the State Division of Highways that strip drawing No. 728 dated January 20, 1966, represent- ing in the opinion of the City Council a basis for the design features of the interchanges along the San Bernardino Freeway encompassed within that drawing. Councilman Heath: I think it is a good motion and it certainly serves the purpose very well. We did discuss the other day and I would like to emphasize again the fact that if we do not state to the State Highway Department the primary importance of what we want to do I think we are losing sight of the entire project. We should say to the State Highway Depart- ment considering that they are going to redesign this that the first thing we want to do is get people off the Freeway into the shopping center, or we want to get the traffic off the Freeway onto our north and south streets, or we want to get the people across town better. I think it behooves us to tell the State that we want them to revise these plans as Mr. Krieger has pointed out in his motion. I think it should be stipulated what our primary objective is in these inter- changes. Councilman Snyder: Could you add that such designs appear to us to facilitate best movement of traffic into our shopping centers and off the Freeway to the north and south as well as to least hinder east and west traffic? Motion by Councilman Snyder,, seconded by Councilman Heath, and carried, that a covering letter be sent to the State saying that it is the feeling of the Council that design features regarding the widening of the Freeway as well as the modification.of interchanges include in principle (1) facilitation of movement of traffic into our shopping centers; (2) facilitation of movement of traffic on the north/south arteries off the Freeway; and (3) the least hindering of east/west internal traffic of the City, in that order. Motion by Councilman Heath, seconded by Councilman Jett, and carried, to accept the auditor's report and place it on file,, INFORMATION REPORT ON BID PRICES FOR CONTRACTS AWARDED OVER LAST TWO YEARS Motion by Councilman Krieger, seconded by Councilman Heath, and carried, that this matter be accepted and placed on file,, -21- • 0 LJ C, C, 2/14/66 CITY MANAGER - Continued SUNSET AVENUE PROJECT STATUS City Manager, Mro Aiassa: Page Twenty -Two (Gave brief summary of this matter, ) (See Page 22-A) Councilman Heath: The proposal of this lowering of the water line in front of Sunset School came before the Board of Education last week and I attended as the City Council directed, Mr, Eastman put the 'proposal before the Board the way the City had proposed it and that was that the City would take care of everything but the sidewalks, curbs, gutters' and the lowering of the line, His recommendation to the Board was that the School District do not pay for the lowering of the line- There was considerable discussion, Finally it was asked of me what would happen if the school district made the finding that they would put in the sidewalks, curbs and gutters and would not lower the line. I said the City would have two choices, They could pave up to the line and no further and not put all the improvements in or they could change their past policy, which has always been that the property owners would lower the line. At that point the staff was advised to contact our City staff to see what could be negotiated, I'feel right now that it is up to this Council to make a policy to instruct our staff so that when they start negotiations with the school district staff they know what they can negotiate, It was my comment, recommendation and still is that the school district has a budget; they have funds; and they can spend funds for things just as well as we can, <,,,!e have in the past used the policy whereby the property.owners would pay for the lowering of a water line in front of their property, My recommendation was that we regard the school the same as any other property owner and r require them to pay for the lowering of this waterline, My further recommendation is that the City adopt this policy firmly and if the School Board does not go along with footing the bill for the lowering of the water line that we pave up to the water line and let it go at that, Move that this City Council adopt the policy in regard to the improvements in front of the Sunset School that the school district will be responsible for the cost of the sidewalks and curb and gutter and the lowering of the water line and that the City will pay for the rest of the expense and should the school district refuse this arrangement that the City pave up to the location of the water line, leave the water line where it is, and just pave up to it, Councilman Jett: Councilman Krieger: Public Services Director, Mr, Fast: Councilman Krieger: Public Services Director, Mr, Fast: I will second that motion, Mr. Fast, the figure was a little over $10,000 as I remember it for the whole project, The entire project is $22,.000, The curbs, gutter, sidewalk and lowering the water line is what? $109000, -22- Herman R. This policy was to be referred to the school district staff via City staff.` City Council action was forwarded to the school district staff and they in turn recommended to the School Board that the district participate only to the extent of curb, gutter and sidewalk. The School Hoard took no action, but rather tabled the item "in order that the administrative staff could have the opportunity to further investigate this matter, " City staff will work with the school district in regard to this matter and will issue a further report as developments occur. He was asked to make a preliminary investigation concerning the merits of calling the Mayor's conference of representatives of the various shopping centers, In his report he suggested to the Council that he felt that the greatest possibility of fruitful results existed in the area of the Plaza at the present time and urged that the Mayor call such a Mayor's conference, Motion by Councilman Heath, seconded by Councilman Krieger, and carried, that the Mayor be authorized to work with the staff and implement the recommendation of the Mayor Pro Tem re this matter, Councilman Krieger: The report also suggests that although the Center from the property owners' standpoint and from the merchants' standpoint is less organized than the Plaza, that it would certainly warrant some effort in this direction and I would hope that along the same vein that the Mayor through the staff will encourage the property owners in this area to organize themselves and delegate representation so that • a similar conference can move ahead with reference to those property owners, Mayor Nichols: COUNCIL COMMITTEE.REPORTS LARK HILL DRIVE We will follow up in that vein, Councilman Snyder:.
