The regular meeting of the City Council was called to order by Mayor
Nichols at 7:40 T.M. in the West Covina City Hallo Councilman Jett
led the Pledge of Allegiance,, Mr. Flotten gave the invocation.

if it were taken.by the Council on those other properties to the east,
specifically I am thinking of Mr, Brutoca6'sand Mr, Galster's property?
City Attorney, Mr, Williams: Primarily Mr, Brutocao and
primarily Mr, Galster, Mr,.
Brutocao's property would be adjacent to Azusa anyway but Mr. Galster
would have to cross a portion.of Mr, Brutocao'•,s property in order to
reach a public street, The right to access to a public street is a
property right, In my opinion, leaving.him a 30-foot access is not
depriving him of that property right but to take the entire 60-foot
strip away and vacate it would deprive him of the property right,
namely the right of access of his property to a public street,
Councilman Krieger: Am I also correct that in
voicing his protest on behalf
of Mr, Galster, Mr, Garvey directed his remarks to the consideration of
the vacation of a 60-foot strip and did not at any time direct his
comments only to the vacation of'a 30-foot strip?

Councilman Jett:. I am concerned about the vacating
of 30 feet of this 60-foot street,
that it.will mean that the property owner will be forced at a later
date to give the entire 60 feet off of his property, which, in my
opinion, will work'a hardship on that property owner. I have.not been
assurred at any time that there would be another way that he would
have access to this piece of property. He would have to go over
another piece of property that is not developed and there are not any
plans indicating that there would be access to this property. I cannot
• go along with this resolution,.
City Attorney, Mr, Williams: Perhaps.it should be said for the
sake;of having it in the record
that the revised agreement between the City and Mr, and Mrs. Oschin
and Mr, and Mrs. Glikbarg,has been signed which agrees that.if this
half is vacated they will dedicate.a full 100-foot width for the re-

Mr, Horace Barrow The Planning Commission turned our
1359 Villa Place. compromise plan down, (Presented
renderings to the Council and
explained same,) We are asking for an addition to that reader board,
56 square feet, This sign will be attached to the building, no higher
than six feet above the roof sign, This sign would not protrude any
higher than 16 feet or the.State Farm sign, which is next door to us,
I think I should be treated equally at least with the Orange Julius
existing in this City:on Citrus, I have another alternative, if the
Council still feels we are asking for too much, which contains 67,8
square feet. We are permitted 48 square feet under the existing code.
This sign would be attachedand run up through the roof of the building,.
If you have any questions, I will be happy to answer them,
Mr, Fred Hikke Mr, Barrow bought this franchise
Orange Julius and he bought a package deal,
9601 Wilshire The sign came with it, The
Beverly Hills Orange Julius is sold basically
on impulse buying. A person can
increase his business by at least 75 to 80o with a sign and this is
based mainly on the fact that it is impulse buying,. Unless Mr, Barrow

applicant or the Planning Director explain this to me? One shows a
round standard "Orange Julius" emblem and the other has a rectangular
"Orange Julius",, What are we considering here?

type Orange Julius sign,, This
round circular Orange Julius is an alternative if the Council feels we
are asking for too much,,
Councilman Heath: We are a large City now and we
are now getting into our City
businesses which are universal all over California and in some cases
all over the United States and with these businesses there are standard
signs and people become accustomed to these signs,, Our ordinance
permits us to cut these signs down to change the standard signs to
get the minimum reading, and forces the owner of the business to
Lose this identification of uniformity. I believe there should be
restrictions on signs but I.think that when we realize that all over
the United States these signs are acceptable, I still don't see why
• we should be a left foot. I think where there are businesses which have
definite standard signs that are used all over we should acknowledge
this fact..in the granting of a variance and in meeting the requirements
of a variance take into consideration not the immediate store right next
to the applicant or within 50 feet of the applicant or a hundred feet
of the applicant but keep in mind that this hardship can be worked on
the owners if they are not granted the same provisions as other people
in their same identical business regardless of where they are located,,
Councilman Jett: I feel that in this case that
this proponent has definitely
proven he is entitled to a variance because he has proven that in the
immediate vicinity there are other signs similar that have been
granted by variance and they are business houses, one of them that is
competitive to this particular business was granted a variance for a
sign,, I think there is a hardship in this particular case because the
property is situated on the street in such a manner that traffic coming
from the north going south is unable to make a'left turn into this
property because there are double lines in the street and a left turn
is illegal. Coming from the south, it is impossible to see the
building until you are on top of it. Being a small building, I think
he is entitled to enjoy some kind of identification that a larger
company or a larger building would enjoy. In my opinion, he has
certainly proven grounds for a variance
Councilman Krieger: I don't believe the applicant
• showed the grounds when he
appeared before us the last time,, I don't think he has shown the
grounds this time,, If we were to take this record of comments by the
Council tonight on this request for a variance, we would ruin entirely
our sign ordinance,, It is great for us to pontificate on the hardship
that our sign ordinance imposes on individuals,, This is without
question,, I can't remember one instance,where a variance was requested
by an applicant where he has not contended, and often with some justi-
fication, that this application of our sign ordinance imposes a.
hardship upon him. But, fortunately, it imposes the same requirements

to simply sit up here and think for a moment that we can treat this
applicant as an isolated instance, we are kidding ourselves because
we know for a fact that what happens on this application will be argued
before us next week on the very next variance coming before us and
this will perpetuate itself until a time you will not have a record
to substantiate your action,, You will have to continue,, You will not
have an ordinance because it has been violated by the very people who
suggested it, This man must show that he is being deprived or denied
a privilege given to others, Councilman Jett commented on a variance
that was granted and the variance was the South Hills Cafe, The
report calls to our attention that the reason this variance was granted
was because the South Hills.Cafe was set back from the building line
of the structure immediately to the.south We know for a fact as well
as from the pictures before us.that there is no setback here of this
particular building, If a prupose of a sign is to call attention to the
establishment of a business to the fact that it is in business, I assume
that a sign within the requirements of our code can be constructed
upon these premises to do.just that, This is an operation that.has been
going for four or five months without any sign at all. Obviously
there is a problem created here but it is a problem that it has been
within the power of the applicant to meet,
Councilman Jett- We have approved some 85
• variances for signs. This in
itself certainly indicates that there is a need for overhauling of our
sign ordinance. This is the reason we have all these requests. How
are you going to prove that the four conditions necessary for a
variance are present? One of the means of proving that is to go back
and show the signs that have been approved by .variance, In this case
there is no question in my mind that you would deny this party something
that is being given to someone else in the immediate vicinity. The
reason he hasn't put up a sign is because he has been before this City
for quite some time trying to get a variance to put up a sign, I don't
see how you could deny this man to put up a sign with a variance along
with.just a little human justice in helping one of our businessmen,
Councilman Krieger: Scoa was before us three or four
weeks ago and asked to put a
sign on the north side of their building and a majority of the Council
said "No". Are we discriminating against the small man in this
community by that type of action? We have never looked at their balance
sheets We have never been concerned with their financial statement.
We are concerned with what our responsibilities are, Sure, they are
nice people. We would like to do them a favor, but that is not the
test,, We have a job to do and an ordinance to live by,
Councilman Snyder. The Planning Department states
that a review of the commercially
• zoned land discloses that only one variance has been granted in this
area, The Planning Commission report says that in Paragraph 3, This
is since 1960, The others are illegal and probably will have to be

a variance use .for the whole piece of property and this was not
available at the time of the last City Council meeting so no action could
be taken at that time. We just want to put a convalescent home on this

Council. The applicant requested
R-3 zoning because the City ordinance requires a R-3 zone for a rest
home, This Council turned down the R-3 zoning indicating at that time
that it would not create the zone that would enable these gentlemen to
build a rest home. They have now come back before the Council to seek
a variance to allow the current zone to remain unchanged but to allow
this development. I have seen a.number of times since I have been
on.the Council where someone came before the Council and asked for a
zone change and implied a certain use or showed a very pretty drawing
and this Council granted that zoning and the use did not develop and
the land was then either marketed or put to a use less desirable thdn
what was projected before the Council. It was my strong feeling
probably that was the basis for my vote last time, the reason I voted
against the multiple type zoning because of some of these unfortunate
experiences, and I would not be a party to creating a multiple zone
in that area with the remote possibility that some multiple housing
development could legally come in there. I personally would agree with
Dr, Snyder's statement that this type of use should be similar to our
nursery schools where it should be allowed in the community on an
unclassified use permit, I feel that ethically and morally this type
of use is a justifiable use in any part of the community where it is
appropriate to.develop that and I personally favor this application.

Councilman Snyder: Since the passage of Medicare,
there will be a rush to build
rest homes and convalesceont homes since they are the ones that will
benefit. As far as our own City goes,.I am concerned that the State
standards and State controls'of these things is very poor, the
availability of qualified personnel to staff as many as probably will
be built is very poor, and I certainly don't want to see a lot of
substandard nursing homes and rest homes built in West Covina, and I
think some consideration should be given to a resolution requesting
the State to upgrade the standards and definitions of rest homes and
nursing homes is in order.
Councilman Krieger: I would like to.bring up a point
that came up before us in May
of 1964 in the DMJM report, and that is that this is a classic case
of a problem that is raised in our zoning structure in this community
and probably most other communities. There was some thought given in
that report to a planned development concept. I concede that the
thought was on a larger scale than probably the property that is in front
of us but since reading that report I have always been concerned and
somewhat anxious to see the subject matter pursued because basically
in this area I think we are presented with a problem where if we
grant a zoning.such as an R-3 then we take a calculated risk that
anything that is a permitted use within that R-3 will sooner or later
come before us and not necessarily the specific use the applicant would
like to direct our attention to. We have to approach a zoning appli-
cation strictly on its own merits as to.the permitted uses within that
zone. These remarks are not to be construed as any reflection of any
opinion on the application before us but merely reflection on the
quandry that sometimes are present in applications for the higher use.
It seems to me that the planned development might well give us some
avenue of approach whereby we can tie in the zoning application with
a precise plan development in conjunction with that use. I remember
vaguely some of the comments made by various people in the City at the
time that concept was broached but I would hope and I intend to bring this
up again before the Council in the form of a motion at some later date
that we give consideration to the subject matter of a planned
development type of ordinance where we in passing on zoning questions
do exert some type of control over the total development, not just
from the aspect of a blanket zoning, but a precise use and a precise
development.

arbitrary and rather harsh and I am not ready to adopt this tonight,

points that need to be amended, that we could recommend a modification

code that trailers were illegal because Pepsi Cola was being mixed in
the trailer and being sold and they said this was food preparation,

really have any objections to some of these but some of them seem
arbitrary,

HOME RULE
City Attorney, Mr, Williams: Various people in the City have re-
ceived some conflicting informa-
tion from Warren Dorn's office concerning a._,proposed initiative
amendment relating to home rule.. There has now been sent out.this
literature which includes the copy of the initiative petition, This
is not Senator Radigan's bill at all, but is the bill which the League
of.California Cities and I think everyone who has studied.this subject
opposes because this bill is limited to enabling cities to pass
legislation in addition to the State regulation, In other words, this
has to do with pre-emption of the field by the State in these
ennumerated fields only -- prostitution and other criminal aspects of
sexual activity, lewd or dissolute conduct, indecent public exposure,
veneral diseases or the protection of persons from molestation. By
doing this implies.that every other subject that the State legislates
on is pre-empted, so the implication in the original letter that an
initiative measure would be circulated along the lines of Senator
Radigan's bill is not true and this particular initiative is not only
in my opinion but in the expressed opinion of the League, both the
State League and Los Angeles Division, very dangerous, Senator Radigan's
bill applies to all local legislation, It isn't limited to these,
..There is no initiative out on Senator Radigan's bill, I think you
should.back the League's effort to get this through the legislature as
a.Constitutional. amendment,
Councilman Snyder: In wanting home rule, we don'.t
want local option,. Local option
is a. dangerous thing,

to bring up.are rushed through, I wonder if the.agenda couldn't be so

in the meeting,

POLICE BUILDING ADDITION
City Manager, Mr, Aiassa:. We have made a report both on
the existing facility, the
remodeling, the proposed and future use of the structure, and also a
funding of receipts, The staff has worked with Chief Sill on this,
(Renderings were submitted and Mr. Aiassa gave a brief summary of
this matter,)
Councilman Krieger: Even if the bond program had
passed there would not be very
much. difference between the bond time schedule and what we, are proceeding
on, at least at the present time,
Councilman Heath: What you have there you could
easily tear down and you would
be ahead. You could build new facilities. I can't see patching up
something.like this,. All you would have at best would be second-rate
construction in appearance and design,
City Manager, Mr, Aiassa:
This design will harmonize with
the structures we now have,
Councilman Jett: This.is not going to be wasted
if we build it, I think one of
the first things we should do is to tear down the old house where
the Street Department is,
Councilman Heath: Tear down the building you have
now for the Street Department
and build a facility at that point that the Police Department can use
and after the headquarters are built there you can put the Street
Department in this police building. I feel the people on the staff are
not aware of what it is going to cost to patch this thing up and build
it the way it is shown. If they really analyze what additions to
buildings cost, they would find out it would be cheaper to go to a
new building,

from.several builders who gave
us actual cost figures,

Councilman Krieger: I think it is still a matter of
philosophy, I don't believe
there is any member of this Council that says we have an adequate
police facility. I don't like the psychology of going in from one
patch job to another as an excuse for further delaying a structure
that we should have, I don't think you would run a business that way,
I don't think you would run your private home that way, and I don't
think you should run a city that way, These men deserve a better
facility, My comments don't go to the fact that they should live
irrevocably in the facility they have, If you patch it I think you
might delay permanent construction,
Councilman Jett: 'It is at least a two-year program
to build anything you want to
,build in the way of City facilities, This improvement is needed
before two years go by. It is not going to be wasted because it will
.be used by the City, Chief Sill, will this suffice for the time being?
Chief Sill: I believe what we have.proposed
here is about all we could
pflssibly put on this building and it would serve our needs at the
present time to a minimum standard,
Councilman Jett: For how long would you say?
• Chief Sill:, We have made the existing building
stand in use for six and a half
years, I think we can make this other one do for a couple,
Councilman Krieger: I am opposed to the recommendation.
I at in favor of this Council and
the staff moving as rapidly as possible along the line to accomplish
a new facility from the ground up and I can't help but feel any other
direction we take will be a direction that will ultimately delay the
accomplishment of this objective,
Councilman Jett: On this lease purchase, until
you have gone back to the people
of this City and given them an.opportunity to vote on a bond issue,
I will do everything I can to stop it, -However,, I think this is something
that would not be lost even if we granted it now. It is needed now,
Councilman Snyder: Even if we were to go along the
lines of the lease purchase
and we move as fast as possible, how long would it be before we
had a new police building?
City Manager, Mr, Aiassa: If we timed it really tight,
it would be at least 18 months,
• I made a request in 1963 for an addition for this building. We
tabled this because we were going to do this and that. Now we've
increased the staff every year and one year the Council added six
additional men. Now we are right up against it. If we are going to
do any more personnel changes; we ;are .going to,�be,~bbxed,-ilke .we .-were in
the. old :.:Po!lice, beiIding"nArth of,; the t:Freeway-,back in 1958; 'and when' police
officets.:.going,:;off Shift had to get out of the -building, so that the new
shift could go in.

would like to hold this over to the next regular meeting to go down
and look at it,,
Councilman Krieger: Looking at it will tell you it
is a miserable second-rate
facility,,
Councilman Heath: If we could find you a facility
away from this location for
storing your evidence and you turn the garage into office quarters'
• . and speed construction on the civic center as fast as.we could, would
that help?
Chief Sill: I have given that some thought
but it is very difficult:
The nature of this building is that it doesn't lend itself particularly
well to remodeling because it is difficult to move one of these
walls but we have worked this over to a point where I think we can
.get something out of the building,, If I thought this proposed
addition would jeopardize the construction of a new facility, I would
ask that my recommendation be withdrawn. But if we were given this
and since it can be used-at'a later time, this could be a lot more
Liveable and workable as far as we are concerned,,

be considerably delayed as a result of the route the Council has taken,,
Therefore, the denial of these additions will force our Police
Department into an intolerable situation,
Councilman Krieger: I am not convinced that the people
of this City who voted for
Proposition One did not know what they were doing,,

POWER POLE REMOVAL

City Manager, Mr. Aiassa: The staff has been working with
the Edison Company and.there
is a written report where we have now worked out a procedure whereby
we can remove those wooden poles.

followed and to authorize the expenditure not to exceed $1,400.00

Council. I have negotiated
with the Edison Company with the possibility of removing the poles on
Glendora Avenue from San Bernardino Freeway to Valinda. This is just
for your information. You will get this report on the 27th.
CHAMBER OF COMMERCE FIRST QUARTER REPORT
Motion by Councilman Heath, seconded by Councilman Krieger, and carried,
that the Chamber of Commerce First Quarter Report be accepted and placed
on file.
Mayor,Nichols: I am not satisfied with these
reports. We have entered into
a headquarters agreement with the Chamber and I do not see enough
information furnished to me to even make a remote determination that.
this City is getting its money worth out of this contract. It is
very brief; it is very sketchy; it tells us very little except some
information in generalities. I would hope that subsequent reports
from the Chamber would give us a little more detail of what we are
getting for the thousands of dollars we are budgeting, perhaps
completely with justification, but it certainly isn't demonstrated
in this report.

Councilman Krieger; The East San Gabriel Valley
Planning Committee after our
joint meeting with the Covina City Council has constituted an ad hoc
committee under the chairmanship of the City Engineer of Azusa, This
ad hoc committee constitutes all the cities on this side of Kellogg
Hill that belong to the East San Gabriel Valley Planning Committee,
This committee is supposed to give a report to the parent committee
in January on this subject to see whether or not all of the cities
on this side of the Kellogg Hill can recommend some kind of attitudes
toward the existence of the Huntington Beach Freeway and about the
best location from the standpoint of all the cities, if it is possible
.to arrive at such a consensus. I would suggest that if such a
consensus can be drawn on the basic question of the existence and
location, this presents the best opportunity we have to have whatever
decision we arrive at as far as the State is concerned,

Civic Center Study, I would like.a meeting on the 20th on this,

forward.with all energies that.we have, Mr. Aiassa has advised.us
he is going to have a meeting tomorrow with someone concerning the
financing, I feel that the progress of this civic center is important
enough that we should call a special meeting almost immediately,

don't I poll the Council and
advise you of the result and see if I can get a date for all of you?

Purchase on January 3, The well purchase at Cortez Park on January 3,
Police After Duty Hours -- the report is on the 27th and the proposal
for freeway landscaping where I would like to have a study session.
We can set it sometime in January, I have to have a meeting with
the City Limits sign committee with Councilmen Snyder and Jett
before the 27th, if possible. I will set up a meeting for this.
The dump site operation agreement report is coming from the staff,..
The freeway east study and the report from the Planning Commission
will be back to the Council soon,

City Manager, Mr. Aiassa: We have an item involving
$53,000 and some odd dollars.
This is matching funds. This is a report from Mr. Pontow. How much
money will we receive and what will it be used for?
Public Services Director, Mr. Fast: Their wording of the State law
when it first came out, they
kind of rescinded it but there are generally a few more additional funds.
POLICE CHIEF
Councilman Jett: I would like to call attention to
the letter addressed to the Chief
of Police. I think this is an honor that comes to our City and I think
we should do something for this.
Mayor Nichols: I think the letter should be given
to the press. We passed a resolu-
tion on the Council commending the Chief for his election.
WATER COMPANY
Councilman Jett:
This money that is being used by
Monrovia for paying their water
bill, with M. W. D.?
City Manager, Mr. Aiassa: The City of Monrovia owns their
own water company, and they are
using earnings of the water company to reduce taxes to pay for the
M. W. D. assessment. We could also, if we owned the water company.
Councilman Jett:

This could only be if we own the
water company?
Yes. That is earnings from the
water company.
Councilman Jett: We have a letter from Mrs. D. J.
Slattery, 429 Emerald Avenue,
West Covina, in which she expresses herself quite clearly in opposition
to the City going ahead with this lease purchase program. I have a
copy of that letter for each of you and you have each received'an edi-
torial that appeared in the Daily Tribune. I would like these items
placed in the letter. Along with the editorial, I would like the
written statements underneath included:

letter addressed to the City Council, dated October 6, 1965, from
Mrs, D. J. Slattery:
"I am writing to say that I
certainly do not feel that the city of West Covina should go
ahead and make arrangements for the Lease -Purchase plan for
the City Hall and Police facilities,
"I feel that it should be
put on the ballot.on the Nov, election,
"Everyone that I talk to
seems to feel this same way about it, and I feel that with
a little extra effort it could be passed,
"Someone told me that the
City Hall plans call for a cost of 26.00 per square foot,"
The following is the
Editorial from the Daily Tribune:
"Despite protestations, it
seems evident that the reason elected officals go around the
voter in order to finance capital building projects is that
they won't take 'no' for an answer,
"Los Angeles County Supervisors,.
in reply to grand jury criticism of their use of county employee
retirement funds for various county building projects, put
the blame on the voters.. They say that past bond issue failures
forced them to resort to lease -purchase arrangements with
county employees.
"Likewise, one council of.
a San Gabriel Valley city is now contemplating a similar lease -
purchase plan to finance a city hall.building that was turned
down by the voters,
"In our opinion, public
officials are obligated to respect the wishes of the voters,
not to circumvent them, when it comes to long-term financial
obligations,
"If the voters say 'no', then
elected officials should see that the decision is heeded. No
public building, in our opinion, is so vital that it takes
precedence over the wishes of the people who will be called
upon to pay for it,"
The following is the handwritten
comment on the bottom of the page containing a copy of the editorial
from the Daily Tribune:
"The voters in West Covina
appreciated your stand on this matter -- and are happy this
editorial does not apply to you!"

Councilman Jett; This is going to be coming'up
at the Independent Cities for
discussion and this is in reference to the entire City Public Safety
Agreement but this is a letter that I had requested from Ray Windsor
on whether or not we had any signed agreements of reciprocal aide
We have none. This is going to be discussed quite clearly at the
meeting. I would like your feelings on it.
Mayor Nichols: I would like to have more
information on this.
Councilman Heath: I would hope we are not
repeating or duplicating the
efforts of this mutual aid study group in Los Angeles,

B224. Motion passed on roll call as follows:

by Councilman Heath, and carried, that this meeting be adjourned to
