MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
NOVEMBER 22, 1965
The regular meeting of the City Council was called to order by Mayor'
Nichols at 7:40 P.M. in the West Covina City Hall. Councilman Snyder
led the Pledge of Allegiance. The invocation was given by Mr. Robert
Flotten, City Clerk.

I would like the Secretary and
Treasurer of West Covina Beauti-
ful to stand with me and also
the Vice President and any other
tonight.
It is with a great deal of satis-
faction and a certain amount of pride that we present to the City of
West Covina our check in the amount of $200.00. This money represents
two contributions of $100.00 each which the City Council very generously
made to the West Covina Beautiful in support of the annual City Birthday
Dance in 1963 and 164. However, during most of the existence of West
Covina Beautiful since its founding in 1950, it has been the policy of
our organization to be self-supporting and the only occasion on which_,.
we have solicited funds have been for the purposes of tree planting
and similar purposes. We wish to return this money to the City with
the stipulation that it be used for the purpose of trees or shrubs to
be planted in.the business areas of.,the City. We would like to request
that you advise us as to when and where the trees and shrubs are
planted. In this way with the coopera.tion of the City we hope to
further our primary objective of keeping West Covina beautiful. (Pre-
sented letter and check to the Mayor.)

Motion by Councilman Krieger, seconded by Councilman Heath, and carried,
that the City receive this contribution of $200.00 from West Covina
Beautiful and direct the staff to report to the Council and to West
Covina Beautiful at such'time that these funds are used and the manner
in which they are used for the purpose stated here,
EMPLOYEES' MERIT CERTIFICATES
Mayor Nichols: This is a'pleasure for the
chair and the Council, It
involves the awarding of certificates of merit to a number of our City
employees who have completed a course in supervisory methods. .It -is'
my understanding that the course ran for a periodof eight weeks
during the hours from 4:30 to 5:30 P.M. with a portion of the time
being on the employees' own time and all time involved in the prepara-
tion and requirements for the course on the employees' own time, I
think these people are to be commended, I take pleasure in awarding
these certificates to the following: Norman Yoshihara; Phil Gatch;
George Zimmerman; Donald Russell;Wally Austin; Leonard Eliot,• Jim'Gurr

of conversations with Mr, Oschin
• and Mr, Glikbarg concerning this right-of-way, As was.pointed out
before, 'it.is the intent of both parties to do the''same thing; however,
the wording has not been finalized, I would like to have the City
Attorney advise us if we can go ahead with this agreement and fulfill
all the requirements of that agreement,
City Attorney, Mr, Williams: You will recall that the wording
that was subject to change 'had to
do with this: I think it'was Paragraph 5.in the agreement,' It provided
that.the..City agreed that it would vacate a portion of Azusa Avenue
lying easterly of the Oschin and Glikbarg property, Two things were

wrong with it. The agreement should not decide a matter upon which
a hearing must be held and a determination.made. It should say, "We
will dedicate to you the required portion of the realigned Azusa
Avenue if and when you vacate," The second thing that was wrong.'
with.it, it didn't say the westerly half of Azusa Avenue, which is
all. that the title company indicates would revert to them,
The rewording was done immediately
after your last meeting -and was submitted immediately to the Oschin
and Glikbarg interest, It is my understanding that it has not been..
returned signed. I would recommend that you do not.accept the right-
of-way because if you do,'you may do it on the way they had previously
signed, which would be or could be construed as requiring the vacation
and.reversion to them of all of Azusa Avenue,
Councilman Heath: In conversation with Mr, 0schin
today and his.engineer, Mr;
Sherman, their final statement was this: They will agree to receive
anything which the title company says they should receive. They have
not, to my knowledge, seen a copy of this title insurance report and.
I believe all we need is to send a copy of this title insurance report
to Mr. Oschin and Mr. Glikbarg and they.will immediately agree to.sign
any papers that you need.
Move to hold this over to the
next regular meeting.during which time the staff would supply Mr.
Oschin with a copy of this title insurance report, and that Mr,. Oschin.
sign any paper that the City Attorney requires to clarify the matter,
City.Attorney., Mr; Williams: You can simply have it that they.
sign the agreement submitted to
them. I believe that a copy of this title report has been sent to them
with the new agreement and the request that they sign it; There
may have been some physical difficulty in their signing and getting
acknowledgements upon the new agreement, It happened that the amendment.

.Councilman Heath: The title company has told them
they are entitled to 60 feet
and I said that.is not true because. the title insurance preliminary.
shows they get only 30 feet,. He said whatever the title insurance
cwmpany.says they get they would go with that,

before we make any motion. I
think before we start approving anything or. recommending anything to
be done, let's know what we are doing and what we have in.return

of the agreement prepared by.the City Attorney with particular reference
to Paragraph 5 and submit the draft agreement for execution by Mr.
Oschin and Mr. Glikbarg, together --with a copy of the title report,
Mayor Nichols: At the time of the recent pro-'
posals regarding rezoning of the
Galster property which is very near this property, a number of citizens
raised some question about the nature of the zoning of the property
..that has been discussed here this evening. I would like the Council.
to give some possible consideration to this property.as to whether

ZONE CHANGE NO. 341 LOCATION: Vacant land 170 feet

Mayor Nichols: This is the time and place for
the public hearing?.
. Mr. Leroy Shaub I am with the E. T. Lakey Company
345 East Rowland representing Mr. and Mrs. R. J.
Covina Stinton, owners of the property,
and the applicants, Abbey Rents.
North Azusa Avenue is primarily a commercial street from the San
Bernardino Freeway to the Foothill Boulevard. Abbey Rents wishes to_
bring another major business concern to West Covina. This proposed
location is one which for years has been unable to be developed under
its present zone. Mr; Major from Abbey Rents is here tonight and he
will be happy to answer any questions that the Council might have.

Mayor Nichols: I am personally acquainted with
the applicant in this matter,
Therefore, I believe I will.abstain from any discussion and voting
on this matter before the Council at this time,
Councilman Krieger: We have a report from the Planning
Department dated November 19th
referring to the Calprop Investments, (Read portion of said report,)
How are you going to have an R-4 uniformity on that block if you
already have a C-1 on the corner?
Planning Director, Mr, Joseph: In the report we made the recom-
mendation that the R-4 zoning
be granted for an extension down to Puente, recognizing there are
service stations on the corners,
Councilman Heath: Last Wednesday night the Planning
Commission recommended that a
portion of this side of the street be rezoned to R-4 which would continue
the R-4 further south. How much would be left after that? I am talking
• about the parcel north of the service station,
Planning Director, Mr. Joseph: It is 70 feet wide,
Councilman Heath: If Calprop goes in and develops
their parcel as shown, it will
leave a 70-foot strip between the gas station and this Calprop
property, Do we feel a 70-foot strip can be developed as R-4? I
don't think so. I would think since it is next to commercial it would
only be fitting to make it commercial, On Puente Avenue you have
a small portion of R-P that would be a good buffer,
Planning Director, Mr, Joseph: We don't think 70 feet is too
narrow to develop as R-4,
Councilman Jett: I don't understand why the
Planning Commission or the
Planning Department would write a recommendation of this nature
regarding this property, The hearing on this request was made before
Calprop ever came in for their hearing before the Planning Commission;.
Councilman Krieger: One of the problems the Planning
Commission was faced with was
receiving the Azusa Avenue study at the same time they were passing
on these particular applications so the Azusa Avenue Study never
really was considered by the Planning Commission as such, The Planning
• Commission has yet to hold any public hearings and won't on that
study until the economic base study comes in, I think the purpose
of the Planning Department in submitting this memo of November 19th
was to bring the Council up to date on what is happening in conjunction
with the Azusa Avenue Study by the Planning Commission, I find it
valuable primarily because I wasn't at the Planning Commission hearing
last Wednesday,

Councilman Heath: I think the C-1 would fit into
this very readily and it could
be developed practically immediately. If it goes to R-4 with the
vacancies we have in R-4, it may be quite some time before we develop
it as R-4. I feel that the pattern laid out on that map with the
consideration that the northerly part has been recommended for zone
change to R-4, this property in question would make a good buffer area.
Councilman Snyder: I think it would be desirable
if it could be zoned according
to the study plan but I don't think this application is too detrimental
to the study plan taking into account what is there.
Motion by Councilman. Krieger, seconded by Councilman Jett, and carried,
that Zone Change No. 341 be approved from Zone R-P to Zone C-1.
(Mayor Nichols abstained.)

Mayor Nichols: This is the time and place for
the public hearing.
Mr. Arthur Baldinado In reading the North Azusa
Attorney at Law Avenue Study we note on Page 10
240 West Badillo that the study is making a strong
Covina recommendation that no influential
zone change be adopted until such
time as the market survey is completed. They also speak of additional
significant changes of zoning. We feel that the request for zone change
for these two lots do not represent a significant change or influential
change. We feel that the pattern for the two -lot depth zoning from
Azusa Avenue in.this location has been established and that such
policy statement was developed in connection with Zone Change No. 312,
Laberge.
There being no further public testimony, the public portion of the
hearing was closed.

Councilman Jett: I think this is a pattern that
pretty much goes along with the
rest of the development along there. I would go along with the
• recommendation.

City Attorney, Mr, Williams: The State law was amended and
we don't have all of our
amendments in the code yet. They call what they used to call a lot split
a parcel map now. I don't think it.requires a tentative.and a final.
I think you could approve both the final and tentative at one time if
there are no improvements or bonds required. The only difference is
you now record these parcel maps and formerly if they were less than
a regular subdivision they were not so recorded. Are any improvements
and bonds required in connection with this?

You can approve the tentative
and final at the same time,
Councilman Heath: To the east of this parcel there
is a triangular parcel 4.3 acres,
The people that own that triangular piece requested a zone change to
R-3 and a precise plan approval. There was a big commotion that
at that time the staff was recommending the continuation of Toluca
Street down to meet the first street to the south and the staff was
very insistent, the Planning Commission and the Council were very
insiste.nt that that street be carried on through because the street
to the south was in the form of a cul-de-sac. What has happened to
the plan of that street coming through?
Planning Director, Mr, Joseph: When the Planning Commission and
the City Council rezoned. this to
R-P and this to R-1, this was shown to both bodies. We noted that
the cul-de-sac was approved back in the early sixties along with an
R-1 subdivision that worked. We thought there would be no need to
open up this street since it is now R-1,

and we voted to close it off and

seem to me that the Council should require that as a condition that a
new garage be constructed to replace that one being removed on the

The garage is built in such a
way that it can be moved to the

Mayor Nichols: If the Council sees fit to pass
the stipulation that I have
suggested, it would be to the satisfaction of the current building
requirements.

Planning Commission with a correction to Condition No, 2(e) to add
on to proposed lot line and a two -car garage be moved or erected to
meet the City requirements,

OF NOVEMBER 17, 1965
Motion by Councilman Heath, seconded by Councilman Krieger, and carried,
that the Council hold over the review of the Planning Commission action
of November 17, 1965 to their adjourned meeting of November 29, 1965.

lishment but also is sold for salvage value,

City Attorney, Mr, Williams: Mr, Terzian has sent a letter to
the City regarding methods of
acquiring a right-of-way to extend a street through the Plaza, All
he discussed were methods. He did not discuss costs, There could be
an element of severance damage depending on what the contracts, the
leases, and the like are with respect to the area that would be taken
away and before anything serious would be done I would suggest we get
a condemnation report from the title company before we could adequately
answer a question of that nature,

City Manager, Mr, Aiassa: I have a letter from the Tax
Delinquent Land Sale Series 88A
and the Los Angeles Regional Planning Commission has outlined several
parcels that are part of public interest. I need authorization to go
ahead and see if I can acquire these,
Councilman Heath: I think we should see what they
are,

take us to acquire them.

POLICE BUILDING ADDITION

EMPLOYMENT OF POLICE OFFICERS
BY PRIVATE PARTIES
City Manager, Mr,, Aiassa: Our Finance Officer feels. -if we
. have them pay us and we make out
a check to the employee, this would be the best system,, Otherwise,
the people will have to make out various checks,
Councilman Krieger: Are we renting our officers to
private organizations?
City Manager, Mr,, Aiassa: They work on their off shift.
This is their own time,
Councilman Heath: I am not in favor of this. If
the businessmen want to employ
a City officer while he is off duty, this is all right, but to do it
• in a West Covina Police uniform, I think this is out of the question.
It gives the impression he is acting on behalf of the City,,
Police Chief Sill: I would like to have this passed
for the following reasons: The
Carousel Theater generates a great deal of traffic. We put men out
directing traffic to the Carousel Theater, These men are paid by the
Carousel Theater,, Our police officers are directing this traffic.
At the present time normally it takes three officers each performance
to handle the traffic going in, The Carousel could make out 25, 30 checks
a week to the individual officers. Should an officer be injured it
would be questionable as to whether he was under workmen's compensation
or not and, of course, we want them to be under workmen's compensation
and this is one of the primary reasons I want this system developed.
The man would take orders from us. He is not being paid by us, however,
Councilman Krieger:
Is there any other police department
that operates on this basis?
Police Chief Sill: All police departments operate
this way to my knowledge,
Councilman Krieger: Since the Carousel has been in
operation these traffic officers
who have been directing traffic have been on the payroll of the
• Carousel Theater?
Police Chief Sill: That is correct,,
Councilman Jett: I think this is a good idea,
Councilman Krieger: It strikes me as being odd,
Perhaps it is the only practical
solution but I find something frankly repugnant in it because these
men are wearing the uniform of our Police Department where, in fact,
even though the money may be going through our hands, they are actually

Councilman Heath: We can take them out of the West
Covina Police Department uniform
completely and let them be hired, or let the City supply the services
as part of their duty to the businessmen in the City. If we do have
extra.services to certain businesses, I think there should be some kind
of a tax arranged to pay for these services.
Councilman Jett: There are many instances where
extra police help is needed.
I would like to see our policemen out there. If an emergency happens
they can handle the situation, This does sound to me to be the way
to handle it,
Councilman Krieger: Do we have any idea how much
not being billed would cost our City? these officer overtime services
Police Chief Sill:
The Carousel requires a minimum
of 48 hours a week traffic
directional time,
Councilman Krieger: I would like to see some figures
on this and perhaps some
alternative proposals to fund this. I resent the City acting as an
employment agency, particularly using our uniformed officers as the
commodity, I am not opposed to these men working over time hours,
to getting paid, to being in uniform, to doing a law enforcement job,
but I think they should be on the City's payroll and subject only to
the City authority while they are doing it, If we have to come up
with another solution to it such as special licensing or tax, I think
we should do it,
Police Chief Sill: I think by doing that you are
virtually opening Pandora's Box
because other shopping centers besides Eastland would be requesting
officers to be specifically assigned to their particular location
during the holiday period,

a special license for the prevention of handling this type of
literature? Could we pass a special license for handling this type
of thing?

City Attorney, Mr, Williams: Where you can't regulate, you
can't pass a special license.
You can only impose a special regulatory license or fee where you
have the power of regulation, The State has pre-empted the field,
Mayor Nichols: If you could determine that the
sale of a certain type of
product resulted in calls for additional police calls for service,
could you not then levy a higher license fee because of that unusual
demand for extra services?
City Attorney, Mr, Williams: You could if it is not an area
pre-empted by the State,
.Councilman Krieger: I think in the report on Page 5
there are two interesting
paragraphs which suggest perhaps a less dramatic solution to this
problem,.if there is a solution at all. It states that the problem
in West Covina regarding the amount of available material to a great
extent is less than in other areas of the County, (Read portion of
said report,) I think perhaps informally a lot can be accomplished
that can't be accomplished by legislation and that is if the moral
force of the community as represented by its civic leaders and our
. business community and our law enforcement agencies would informally,
contact these distributors, indicate to them what their feelings are
about this, and I think to bring to bear on this not more legislation
and if the moral conscience is brought to bear in the form that
ultimately the retailer feels he is going to suffer a financial impact,
I think he is much more receptive to it than a piece of legislation
that will go through the courts and finally be ruled unconstitutional,
Councilman Jett: Could we pass a resolution to go
out to the surrounding cities
requesting that we cooperate with each other in working to solve this
problem?
Mayor Nichols: Would you be willing to represent
the Council on a committee and
invite at least abutting cities to West Covina to send representation
and form a panel committee and discuss this and see if there is any
recommendation you can come up with in a joint meeting with these other
cities that would be a recommendation to combat this problem and come
back to each of our councils for a follow through?
Councilman Jett: I would be happy to do that.

to appoint Councilman Jett as representative of this Council to
establish an informal committee among neighboring cities to discuss
this problem.

Councilman Jett: I think as of tomorrow our
committee will be leaving for
Toluca. We have asked the Mayor to represent the City on this trip.
I feel pretty strongly.and I would like to bring to the Council's
attention that he is going down there to officially represent the City
and I think we should pay his expenses. We put this into our budget
this year that we would have $175 for each member of this Council
attending some meeting.
Motion by Councilman Jett, seconded by Councilman Heath, that the
Mayor be given $175.00 to help defray his expenses for the trip to
Toluca.

City Attorney, Mr. Williams: The Sister City Program cannot
be financed out of the City
funds, You cannot send City Councilmen to visit a sister city. You
can go to a convention or conference where you go for the purpose of
acquiring information that will be beneficial to you in administering
affairs of the City. You can, however, engage in what is called Music
and Promotion to the extent you may be promoting the name of the City,
Councilman Jett:
This is really my thinking, that
this money come out of the Music
and Promotion Fund.
