OCTOBER 18, 1965
The adjourned regular meeting of the City Council -was called"to-order by
Mayor Nichols -at 7:35 P.M. in the'West Covina City Hall; Councilmani
Krieger led the Pledge of Allegiance. Mayor Nichols gave the invocation.

tract that has come up with the City with Mr. Thompson regularly and
if there were no changes in the contract this year as opposed to'the
contract that has been approved in the last few years, there is no
reason why it coul'dii't be approved tonight. As for your particular
question, I don't have an answer to that. If you wish, we can hold
this over.
Councilman Krieger: I would like some further ex-
planation of these figures.
I understood the recommendations but when I got to the breakdown
in the figures I just don't follow them.

that this matter be held over for further report from the staff and the
City Attorney to the next regular meeting of the City Council.

Councilman Heath: I am highly in favor of putting •
curbs and gutters in on both
streets and putting whatever paving in that is necessary to cover up
the mud. We don't know when Robindale will be completed and I feel
that we should put in the curbs and gutters at the present time and
cover up the mud with blacktop. This report says we are going to de-
fer any work on Robindaleo Am I correct in assuming this?

Public Services Director, Mr: Fast: Only partially. We plan -to -put
•in on this project the -improve-
ment of Glendora, the curb returns at Robindale back-through'an-alley
type gutter across Robindale on the northwest side of Glendora but we
are not anticipating and making some sort of a juncture with the ex-
isting alley.paving that is there at this time. We don't have dedi-
cation yet in this alley on the southerly side and therefore we are
proposing that no improvements be put in at this time.
Councilman Heath: Is it a condition of the precise
plan that the man put in the curb

Mayor Nichols: Hearing no objections, we will

Councilman Krieger: Included among the recommendations
is that certain costs be rempved
from the applicant and these costs, as I understand it, would total
$3,040. I don't find justification for the removal of the responsi-
bility from the applicant. What is the justification for the recom-
mendation?
City Manager, Mr. Aiassa: Part of the justification is from
the staff. We have in the past
participated on a major highway in
• helping that along.
Public Services Director, Mr. Fast: Glendora being a major highway
we have in the past contributed
two lanes on one side of the center line. The calculation in the
staff report is that balance remaining, which would be provided by
the applicant. In this parcel the applicant's principal frontage and
access to a public street is on Glendora° The City of West Covina has
established through a block study a future street which we are now

• calling Robindale, which was intended to open up the property to the
rear around the corner and over to the Rm2, We felt based on the need
of the street and what it was to serve that it was an excessive
requirement from the standpoint of this applicant to provide a full
half street improvements, especially when most likely.the City, when
they get dedication on the other half of the street, is only going
to be able to do so in the event we expect a lot.of resistance to
having these improved properties along here participate at all on
their part of the street, Thirdly, Duff Avenue is somewhat dissimilar
to what we ran into in the Alscot property wherein Duff serving only
two R®1 properties essentially terminates not even on the parcel
.under consideration and we felt there was no point in improving Duff
at.this time, especially at the expense of this applicant,
Councilman Krieger: I can understand the
explanation having to do
.with Duff and I suppose even the explanation having to do with
Glendora, but I don't understand the recommendation as it pertains
to Robindale, It seems to me that this explanation which was
certainly applicable to Glendora Avenue being such a heavily travelled
..street would benefit other properties immediately, but when we talk
about Robindale, until the rest of the improvements are implemented
it would seem to me that Robindale benefits the applicant's property
and nothing else,
• Public Services Director, Mr, Fast: The City has required a one -
foot lot along the 17-foot
parkway, property line so legally we could put a barricade along
there,
Mayor Nichols: His property does abut the
street and the easement you
are.talking about is an easement across the one -foot lot that the
City of West Covina has?
Public Services Director, Mr, Fast: No, He can get an easement
from.his adjacent property
owners or they dedicate to the City and we declare it a street for
public uses and then he can use Robindale,
Councilman Heath: You are going to have circular
traffic through that parking
lot and Robindale will possibly take at least the use of every car
that goes into the parking lot?
Public Services Director, Mr, Fast: Assuming his neighbors are
agreeable, yes,
Mayor Nichols: What about not putting any
• improvements in on Robindale
at.the present time except that the City takes dedication to it? If
we don't have dedication on the other half, if it is immaterial to his
use, then let's save the money on both parties and just not develop
it right now,
Councilman Krieger: The cost estimate is $75-0 and
when and if it comes about,
and it seems logical that it will come about and it would have to be
City participation and at that point I believe it would be beneficial
most directly to the applicant's property and ought to be imposed upon
him at this time,

provement of Duff Avenue as imposed upon the applicant in Precise'Plan
of Design No. 464 be deleted in accordance with the"staff report and
recommendation of October 15, 1965; but that the requirement with re-
spect to the cost of Robindale Street be retained by the applicant;
that the resolution be adopted on this basis.
Councilman Heath: The recommendation is that the City
approve two lanes of traffic on each
side of the center line leaving the applicant to improve six feet
immediately adjacent to the curb. Doesn't your motion read that that
is deleted?
Councilman Krieger:

that does not include what you

Who pays for the improvements
on the alley?
City Manager, Mr, Aiassa: The City has accepted over two-
thirds of this responsibility
and this alley has never been put to City standards as far as improve-
ments are concerned. Most of the improvements in there have been a
piecemeal development by the owners and we have been gradually accep-
ting the right-of-way because.we need that for public utilities and
other reasons. I would say the City eventually will have to force a
street improvement act to get this alley up to standard or spend pub-
lic funds to do it.

need the improvements and it is to the City's advantage to improve

I don't know how you justify
it when you have made other

Councilman Heath: If you go in to buy this right-
of-way from the people it will
cost two, three, four thousands dollars for the right-of-way. The
people in the City are going to have to pay for that. In this case,
they give the right-of-way and the City puts in a nominal amount for
the paving,
Councilman Snyder: It seems inconsistent to me.
Mayor Nichols: I agree with you. I think
there -is an ethical and moral
inconsistency when any municipal jurisdiction has someone pay because
you have leverage against them and then someone else you don't have
the leverage against them so you compromise your position and share
the costs in order to get it done. It has been done again and again*
and like everyone else I feel we need these areas improved -and so-1
will join with the great massive immorality occurring and go along with

I don't see how we can approve this agreement until all parts of
that agreement are fulfilled. In other words, until we abandon the
old Azusa Avenue we are not meeting the requirements of this agreement
so how can we approve the agreement?
Councilman Snyder:
We have a recommendation to
hold this over.
Mayor Nichols:
I think it would be acceptable
if we held this item over.
Councilman Krieger:
Am I incorrect in assuming
it is the County that is going
to award the contracts for the construction of the improvements?
Public Services Director, Mr. Fast:
That is correct.
Councilman Krieger:
I would think perhaps the
language of this agreement is
inappropriate when it talks about the
City being the grantee awarding
the contract for the construction of the improvements.

I discussed this with Mr.
Williams. He has not had a
chance to read this agreement.

As far as the rest home as the
plan shows, I am not too much against that, but I don't feel the land
in back of my property should be R-3 and used for apartments. I
feel when zoning is granted there should be a time limit rather than
having to fight this thing every two or three years,. If they went
unopposed I would be faced with a problem of maybe this plan would
fold up and two or three years from now somebody would put in apartments
and my property value would be destroyed,
There being no further testimony, the public portion of this hearing
was closed,
Councilman Snyder: There isn't any way to put a
time limit on zoning,
Mayor Nichols: The Council has in the past
year directed the staff where
zoning has been granted that at the termination of a two-year period
the staff is directed to review such zoning and notify the Council
of the status of that land in order that the Council may review the
zoning in light of the current zoning needs of the City, but there is
no legal basis for a restriction on zoning in the sense.that it
would expire in.a given length of time if it were not utilized,
• Councilman Krieger: In our consideration of the
zoning, we are just looking
at the property puce and simple and recognizing if we grant R-3 we
lose all control what uses may go in there. Any use permitted by
R-3 could be put in there,

. Councilman Snyder: The State Department of Social
Welfare has certain standards
for rest homes and nursing homes. Are these incorporated in the City
code or do you depend upon the State to enforce their own standards?
.Planning Director, Mr, Joseph: The conclusion of the Planning
Commission was that the controls
imposed by the State would apply here in the City,
Assistant City Attorney, Mr, Terzian: I would doubt if the City had
the authority to legislate
that,
Councilman Snyder: With the passage of medicare,
we are going to have a rash
of nursing and convalescent homes, The State standards need upgrading.
It seems to me their standards could be improved upon, particularly
with regard to rest homes and I am positive we are going to have
requests for many of these,
Assistant City Attorney, Mr, Terzian: You can legislate in an area
where there is a certain
minimum of beds, but above that the State takes jurisdiction as far
as I know, If we grant R-39 eventually they could put up an apartment
. building right next to that R-1,

The justification of the extension
of the R-3 zoning to the south is the real issue as I see it, and the
justification seems to be that we have R-3 to the north,

Also, this is a secondary highway. It was felt there was justification
for rezoning this property to multiple family due to the configuration

of discussion concerning
this small, portion at the rear as the possibility of zoning it to
no lesser use than R-lo I do not think this Council would want to
recommend a zone on a piece of property that cannot be used or developed.
I would like to make a motion
that the staff make a rough layout of this piece of property on how
it could be laid out with R-1 by a simple few lines so we can deter-
mine in our mind whether or not this can be used as R-1,

to convey that this land could
or could not be used as R-1 land, I was only voting on a request for
R-3 zoning against R-1'property.
Councilman Heath: I:think the applicant is
entitled to one thing, and
that is to get an indication from us on why.it is not good for R-3
and I don't think he can get it from the Minutes. I think he is also
entitled to get an indication of what zoning might be applied for
here and I don't think we can expect him to apply every week for a
different zone until he happens to be lucky enough to hit the one
we think is right. This is not a game of surprise. It is a game of
us developing the City. I don't think our Minutes will tell this man
why this couldn't be developed R-3, nor have we indicated anything
except R-1. R-2 and R-3 might go on this land,
Mayor Nichols: You have indicated rather
strongly that you tend to
favor this application by your vote, Councilman Snyder indicated
for the record that he did not object per se to a convalescent type
use in that area, but he would not advocate R-3 zoning, I would
concur with his thinking in that respect, for the record. If that
is not enough information that the applicant may determine for
• himself how he wishes to proceed from this point, then I don't care
to comment further.

"West Covina Beautiful has expressed interest-in'helping on such a
project and a:letter has'been received from the,West Covina Womeri's
Club Jrs, offering their assistance; Commissioner Whitcher inquired
about the possibility of the staff preparing`A list of desirable
trees in order to choose from. These trees could be from the approved
street tree list. Commissioner Plesko stated that it would seem that
this should be a contest open to the public'. It was stated that if a
tree was picked from_.the apprpved,.list, it could be used in the park-
ways to greater advantage. Chairman Johnson -stated that if West Covina
Beautiful and other groups were involved, a committee would lay the
ground rules, including a representative from the Commission."

Councilman Heath: On the item concerning stop signs on
private property, I feel that this is
not a requirement of the City and as it states here, I can't see any unique
characteristic of these subject driveways. (Read portion of the report-.)
This is private property coming out to a well exposed street and I feel that
we are setting a precedent by going onto private property and putting stop
signs. Secondly, I think this is a responsibility of the property owner to
put stop signs there. I would not agree with the recommendation.
Councilman Krieger: With respect to going onto private
property, my understanding is that
it was requested that we install these signs. We didn't volunteer to go
out and put them up. I would think it is a highly unique area. It is
• heavily trafficked and would not compare with the normal private driveway.
City Manager, Mr. Aiassa: If the stop sign is put in
by the City„ they are legal
according to the Code.

traffic situation we have
down there and it is up to us to provide some remedy for it.

September 27, 1965
Councilman Heath: I would like to ask the staff
a question. There was a
precise plan on.Mr. DePietro's property a few years ago. At that
time there were certain parking requirements and he met the require-
ments at that time. Now, he wants to make an addition on the building.
If I remember the past precedent, we will maintain the ratio that
was in effect then?
Planning Director, Mr. Joseph; Correct, and impose the new
ratio on the new revision.
Councilman Heath; But if there is a revision
in the precise plan we will
apply the standards that are in effect at the time of the revision
for the whole plan? In 1956 there was a precise plan for a medical
building and an office building. Two years ago the precise plan
was changed and when it was changed two years ago and as of this
month when it is changed, any requirement concerning parking ratio,
concerning streets, sidewalks, sewers, et cetera, must apply to that
precise plan and the property must be changed to agree with the
standards as of today.
Planning Director, Mr. Joseph: You are talking about the
improvements, not the parking
ratio. If he had approval years ago based upon then existing
ordinances we would not make him go back and update to -present day
requirements in terms of off-street parking that which was approved
eight, nine years ago. Today there are requirements for sidewalks,
whereas in 1956 that requirement was not imposed. Then they had

• requirements for off-street parking. We are not saying that he has
to do today what we didn't make him do before even though there was
no ordinance in effect. We are saying today the ordinances controlling
the activity on the property have changed. The improvement standards
have changed so we do go ahead and ask for sidewalks, which does not
penalize him for any improvements he has made on the property before
but only brings it up to present-day standards.
Councilman Heath: If you require him to bring
up improvements he also
should bring up the parking ratio standards,
Mayor Nichols: Relative to the parking
which is applied to a
structure which exists there which has been in use under your.
thesis. If you had a building sitting on a 10 acre lot and someone
came in and wanted to build a second building next to it and if the
first building no longer met your current code requirements for
wiring, et cetera, under your thesis, philosophically you say before
you can build the next building you want him to completely remodel
the first one.

Freeway report and it is
a preliminary report done by the staff. I would like to have the

tremendous honor for our own Chief of Police. I would like to have
the editorial in full in the Minutes. The article is dated
October 16, 1965, I would speak on behalf of the Council and would
request that the City Manager convey from all of us on the Council
our appreciation to Chief Sill for his service and our congratulations
on his election to that office,

week did not show an item listed in our Parks and Recreation Commission
Minutes, Tomorrow evening at 7:30 there was supposedly a film
scheduled to be shown at which Councilmen were invited. The film is
on the portable swimming pools. This is just a reminder if you want
to add that to your agenda for tomorrow night, It will be shown at
7:30 P.M, in the Council chambers,
RETIREMENT OF GARDENA OFFICIAL
Mayor Nichols: We received a letter late
today announcing that a Mrs,
Lucille Randolph has recently retired from office in Gardena,
suggesting some of us might want to attend a special dinner. I have
taken the liberty of asking the Administrative Aide to the Council
to direct a letter from,the Mayor offering our congratulations on
her retirement,

• AMBULANCE SERVICE
Mayor Nichols: All of us are in possession
of a letter and a petition
from a group of people who are concerned about the ambulance service,
Mr. Windsor has investigated the matter and has some information that
was copied with these letters. I feel we do not really have exact
information as to precisely what the arrangement is between the County
and the ambulance services for service and I would like to see the
Council direct staff formally to request a report from the County
concerning the current ambulance services agreement and status
and coverage that would involve the City of West Covina,
Councilman Snyder: It is quite possible that the
ambulance in this case or
all the ambulances by this company were otherwise disposed at the
time of this call, Secondly, I can think as a doctor of very few
instances where a matter of minutes on the part of the ambulance
has any effect on the outcome of the life of a patient. Laymen
don't understand this and I understand that they don't understand this,
Councilman Heath: I am interested in.the com-
munication from Mr, Windsor,
• I happened to be on the committee that formulated this contract with
the County at the time we terminated our services with Means, and
at that time this was not the condition that Crippen be the only
one, The condition at that time as told to us by the County and
agreed to was they would dispatch from either one of these units,
Covina, Baldwin Park, La Puente, depending on the location,
Councilman Snyder: They do that now,
FIRST AID EQUIPMENT
Mayor.Nichols: Mr, Aiassa, tonight I received
a call from a citizen, a
Mr, Holmes, who stated he was attending first aid courses with the
Covina Adult School, The instructor's' name_ was a Mr, Butterbough,
During the course of this first aid refresher course, a film was
shown by,.I believe, the Covina Fire Department, which involved
resuscitation and during the course of this, public statements were
made by some persons present that a resuscitator had been offered
to the City of West Covina and it had been turned down. That was
the only comment made. This gentleman is a citizen and felt that
it reflected as it was created rather .poor feelings,
City Manager, Mr, Aiassa: It was turned down about
• five years ago and the reason
it was turned down was there were conditions attached to it,
Mayor Nichols: I think it would be appropriate
if a member of our staff would
contact Mr. Butterbough, the teacher, and ask him to clarify for that
class the circumstances so that 70 or 80 individuals, most of whom
are teachers in this area, would have factual information,

Mayor Nichols: I was informed recently that
there is a stretch about 150
feet on the west side of Hollencrest Street south of Cortez that
was without sidewalk whereas a substantial -remaining portion on the
route down to one of the schools was sidewalked and I could not find
my own report and I wondered, Mr. Fast, if you could remember whether
that was on our master plan?
Public Services Director, Mr. Fast:

I can't recall, but I will
look it up for you.
Councilman Heath: I received a story which I
hope and I know is grossly
exaggerated from a person in the Pickering Tract and I will get more
information on it sooner or later. The man was standing in his front
room and saw someone stripping his car and called the police station
and was told it would take twenty minutes before someone could get
down there. I will find more details on it. However, in talking
with some of the Police Department members, they are admitting that
the reception in the Pickering Tract is practically nil. Where do
we stand on this radio transmitter which was authorized for the top
of the ridge?
City Manager, Mr. Aiassa: The only thing that held us
up was the site from Home
Savings and Loan and they have agreed now to give us the site.
Mayor Nichols: Would you give us a report
of the status and a time
schedule as to when you would anticipate improving that service down
in that area?
City Manager, Mr. Aiassa:
All right.
Councilman Heath: I think we should go on record
that this project should
receive A-1 priority because it is that important in my estimation.

Councilman Heath: I think this League meeting
in San Francisco was one of
best I ever attended. There was a tremendous turnout this time and
there was a real good program,
FREEWAY FENCE
'Councilman Snyder: There was a good point made
by the Tribune the other day
regarding cables in the wire fence along the side of the freeway.
There are cables in the center divider but now since they are widening
the freeway the freeway comes right out to the frontage road and
there are no cables in that fence there which means cars can come
through there and hit cars on the frontage road. Has there been
any discussion with the State why they don't put cables in there?
City Manager_, Mr, Aiassa: Right now you don't have very
much.between the frontage
road and the shoulder -of the off -ramp, We will make a request to them,
Councilman Snyder: It seems to me it is just as
necessary as it is in the
center,
Mayor Nichols: I think that is a fine idea,
