MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
TUESDAY, JULY 6, 1965
The adjourned regular meeting of the City Council was called to order
by Mayor Nichols at 7°35 P.M. in the West Covina City'Hal:lo''Councilman
Heath led the Pledge of Allegiance. The invocation was given by Mr.
Robert Flotten, City Clerk.

AMENDMENT TO AGREEMENT WITH
AZUS-A VALLEY WATER COMPANY
City Clerk, Mr. Flotten: This amendment contains the
change in the agreement with
the water company. We request permission for the Mayor and the City
Clerk to sign this, This raises the hydrant rental to $2.50.
Motion by Councilman Heath, seconded by Councilman Krieger, and carried,
that the Mayor and the City Clerk be authorized to sign the amendment to
the agreement with the Azusa Valley Water Company.
City Manager,'Mr. Aiassa: This is the only water company we
have an agreement with, I would

to look this over.

from Mrs. Tyler with a request
for a small strip of property on the south side of Badillo.

carried, that the City Manager look into this matter and if the
property in question belongs to the County forward this letter to
the Los Angeles County Flood Control and if not report back to the
Council at the next meeting.
Councilman Heaths In that letter it requests
permission to have driveway
openings onto Badillo should they be able to obtain this land.
I think the City should be concerned with the number of openings
on Badillo, If we are referring this to the County I think we should
so state that we have certain objections to too many openings onto
Badillo,
Mayor Nichols:
I would hope the staff report
would come through with a staff
recommendation on that.
Councilman Krieger: Why don't we get a report back
from the staff either way --
whether it is in our City or not -- withhold a response to anybody
until we get a report back from the staff?

ECONOMIC STUDY
City Manager, Mr. Aiassa.- We have a letter from the Chamber
of Commerce on an economic study.
They are going -to give us an oral report tonight.
Mr. Stan Seeds We are here to present a proposal to
• President you for an item we think is of
West Covina Chamber paramount significance at this
of Commerce particular time. This concerns the
possibility of a base economic
study and the establishment of a data bank which is proposed as a
Chamber project for the coming year. (Presented various charts and
explained same.) I would be happy to answer any questions that you
may have. We are very hopeful that you will see fit to vote "yes"
on this.
Councilman Heath;

up the difference in cash,
whatever it turns out to be,, and we estimated what the combination of
what we can negotiate in hard work statements plus supplementary cash
outlay. The cash outlay would maybe run two to four thousand and
the rest would come out of volunteer help and hard work,statements.

Mr, Stan Seeds. The same people that are working
in the committees now,, We have
some 70 or 80 people and of those you will always find 10 to 15 who
are the key people pulling the wagon and we -rely on those people
predominantly but a`lot of other help as well in the Chamber,,
Councilman Krieger.
You are just not talking about
your staff people?
Mr,, Stan Seeds. No,, The staff people will be
involved as well ®m the staff,
the Chamber members,, We are working on the establishment of a women°s
division which would provide clerical assistance in the computation and
tabulation of information, the mailing of questions and forms,,
Councilman Krieger.
Who is the work product actually
delivered to?
Mr,, Stan Seeds. It would result in about 50
reports, a comprehensive report
of the original economic base study which would be reproduced into 50
copies and made available to the City officials, the key people in
the Chamber and, of course, the information goes into the data bank.
I would propose there be some controls put on between the City and
the Chamber so the information is used to benefit,,
Councilman Krieger. These people with whom your pro-
pose to enter into contracts
for these studies and the data bank, to whom are they going to be
primarily responsible?
Mr. Stan Seeds. We would assume the responsibility
of contracting with them and -they
would be primarily responsible to the Chamber on the proposed plan we
have outlined,,
Councilman Krieger. Disregarding the merits of the
proposal for the moment,, what
would be the advantage of the City handling it in this way rather than
doing it directly?
Mr,, Stan Seeds. Economics,, We feel the free help
and the additional financial
assistance provided by the Chamber would result in an equal product
for less money,, Secondly, we believe we can get better information
if it were a Chamber project mainly by reason of the source of the
questions,, The third reason is that generally speaking if you give
somebody the responsibility to do a job and they have a direct stake
in the result of that job they are going to do a bang-up project of it,,
I`think it would belogical that the Chamber do it as a project for
the City. We will both share in the results from it,,
Councilman Krieger. What controls do you suggest to
us that the City would be

that a definitive contract be
worked out which would spell out a statement of work, what the result
is that is desired, and that it be set up on some sort of a progress
payment basis whereby you are seeing the result before you laid out all
your money.

Councilman Krieger: I am somewhat concerned as to
a tendency on the rest of the

wondering what specific programs the Chamber has in mind in the meantime
within the other headquarter city committees,

specific action plans they are
working on, Their work in these areas would go on, I would expect
the activity of the commercial committee would probably lean more this
way than the present work they are doing,
Councilman Snyder: We had some discussion the other
day with the City of Industry
about this but they have expressed an interest at our request of
joining into this study whereby we could possibly put out joint
information whereas we would help sell industry for the City of
Industry and they would help sell retail and residential for our City.
Their response was favorable but they didn't give us a final answer
yet, They said they preferred not to seek electronic or clean type
industry down there. They would even refer that sort of thing up here,
City Manager, Mr, Aiassa: The main thing the joint pact will
provide is it will enhance the
data bank,
Mr, Stan Seeds: We haven't had too much opportunity
to explore the industry thing at
great depth. There are parts of it that indicate that teaming with them
on an economic base study would make a much larger program out of it
because then you get into factory employees which is coming from a
wider circle than our economic base circle,
Councilman Snyder: I personally think this study is
five years overdue and really if
it is accomplished it is accomplishing one of the things I became a
Councilman to accomplish, I think in spite of the criticism of such
studies in the past when they are done they do pay off, The Stanford
Research study paid off for a cost of $3,000 in having two theaters -
in -the -round competing to come to West Covina, This is the kind of
material that in the past we have only had opinions on but now we will

have concrete data, When you look at the cost you need to realize
that our hope for lowering the taxes of the people of West Covina lies
in more sales tax and in a larger tax bas'eo- We can only accomplish
this now by going out on a hard -sell basis because we have several,
communities competing with us, particularly for the regional type
developments and we are going to have to fight for them and we *ill
have to have the tools to fight for them and this is the kind of a tool
we need,
Regarding the misgivings about
whether you get your money's worth, the contract can be written that
the payments are not made until the reports come up to the standards
indicated here, I think along with the headquarter city committees
and the blue ribbon committee that was going to be set up, this can
do a great deal moving West Covina forward again into the actual
headquarter city of the valley. If this is not done I would feel a
great deal of everything I have worked for on this Council has come
to naught,
Councilman Heath- I think this is a tremendous
proposal, For the past few years
.I have been very much amazed at the quality and quantity of work our
Chamber has put out, I can't help but think that they.would do just
as good a job on a report such as this. I feel this is a first-class
approach to our problem, I think it is something that is definitely
needed, It might be pretty much advanced over some of the people that
would use it but I still think it is a necessity. I think we should
have it,
There is one question on the amount
of money and where we can get that money from, If there is any place
where we can get the money I think we should, I think we will get more
than this amount returned, I have seen other reports made for the City
at such higher prices which, in my estimation, have turned out useless
but I think a report of this type would be well worthwhile and would
be a real asset to the City,
I don't quite agree with the
data bank, however, This I would like to learn more about,
Councilman Snyder: Does the consultant provide the
computer for the data bank on a
contract basis?
Mr, Stan Seeds: We have reviewed several companies
and the two we are inclined to
are Real Estate Research for the base study itself and Informatics
for the data bank, Informatics was the original developer of this
concept and have installed similar systems for many cities,

City Manager, Mr. Aiassa-. I think Mr. Seeds' outline is
something we have always been in
need of,, I think we have paid for three economic studies since I have
been here,, We had a joint public meeting with one of the groups down
in the old center and I think it would be very interesting to see what
a computer and the data factor we would have to show the exact picture
that exists in that area,, We couldn't do it because of'thelimited--

City Manager, Mr,, Aiassao We have about $191,700 to be
returned to us from the State
on this water contract program and I would like to see this money
tied into this project,, The rest we will have to make up,,
• Mayor Nichols-. I would be reticent to see this
Council give out this money on
the assumption of a State water contract based on a successful
election,,
City Manager, Mr,, Aiassa° If they are going to instigate
this program right away this
would -give us a stand-by t:ime ' and . by next December we" should have
everything pretty well evaluated as far as our receipts and revenues
are concerned and dollarwise we can.give the Council an accurate
report and pinpoint the actual receipts of the City,,
Councilman Krieger-.
Mr. Joseph, from the Planning
Department's point of view, how
do you look at this?
Planning Director, Mr,, Joseph-. I have been privileged to briefly
discuss this and I am familiar
with some of the data that could be expected from this survey,, I would
say that this kind of program would assist.not.only the Planning
Department every day in such a way to repay in salaries that are paid
to staff people for retrieving information for every zoning case we
do, for every study that we make, more than $25,000. I am speaking
just for the Planning Department. We are very much impressed with the
program,,

about the data bank,, In my opinion, the data bank is the first step,
the accumulation of information which is fed into a means of easy
retractability which can be kept up to date and used time after time
after time because the data bank could be kept up-to-date weekly and
constant up-to-date information about your City is available to us,,
From the data that is accumulated the report on what is the structure
of this community now, let's analyze the data we have been accumulating,.

and have the economic report presented to us in such a way that it can

The General Plan itself stated in -
the written tenet that it is most proper to consider this kind of an'ap-
proacho This would be in conformance with the recommendation of the
General Plano

We all are aware and in the new
task list we will submit to the Planning Commission tomorrow night we -
mote that a review of the General Plan is needed. We have gone through
three plus years, The General Plan calls for constant review and up�--
datingo If we had this community resources inventory then the alloca-
tion of the community resources can be translated physically by means
of a general plan and I think wheat we are talking about here is some-
thing that is needed for every planning project as well as a review'of
the General Plano I am very enthusiastic about this. I feel the cost
of this would certainly be returned to the City in kind, quickly.
Councilman Krieger: Assuming a pessimistic point of
view and that is for one reason
or another such funds are not available through reimbursement from
the State, would you be impossibly pressed within the budget that has
been approved by the Council to raise these monies?
City Manager, Mr. Aiassa: I have raised money before for
major projects in prior years.
It will. probably require a cutback in maybe some of the items we have
now projected into the budget but I think financially the.Council"will
gain dollar for dollar if two things.could be resolved from this study.
One is we definitely need a study for a'commercial high rise complex.
I think Dr. Ming has developed the first complex. The second thing I
feel is going to be critical from this report we will get from this
study is,that we develop a new commercial catalyst. There are three
majors still looking for new areas to be established. I think we
should iet a compact presentation to promote those two major items
and I think if we are successful in getting a new commercial catalyst
it.will triple many dollars back to us that we are now investing.
Councilman Snyder: With the increasing national in-
dustries in the City of Industry
and the increasing use of the Ontario Airport there will be a need
for firms to develop a home office space and the City of Industry has
indicated they are not interested again in that type of development
down there and the natural place for them to come is here. Who owns
the data bank once it is developed? The Chamber or the City?
Mr. Stan Seeds: We would extend full rights to the
City. It would be your property.
We would ask for access to it to get information we need to carry on
our program but the whole contract is to develop this for the City and
the Chamber together.
Councilman Snyder: To retrieve information, would
that cost us anything or just
the computer time?
Mr. Stan Seeds: Computer time; that's all.

Mayor Nichols,, I do not look upon these proposals
with disfavor,, In fact, the
opposite is true. I think we are only fooling ourselves or we are being
fooled if we can talk about making a statement of intent when we don't
even know where the money is coming from. We have been working with
a budget for a number of weeks which shows it to be in imbalance, which
shows it to require a property tax increase in order to support it.
We have taken certain tentative decisions which involve the postponement
of the hiring of City personnel where clear need has been demonstrated,,
We have taken any number of streets that clearly confirm we are in a
bind financially in this City. For us to sit up here now and say
we will declare our intent to provide $25,000 for this study I think
this is not being very erudite in its approach,, I would like to have
from our City Manager specific recommendations as to where this money
will come from; will it involve a request for an increase in a property
tax rate of two and a half cents; would it involve the reduction or
postponement or cancellation of some other program; where is the money
coming from,, I could not vote an intent on the nebulous concept that
we will find it somewhere,,
Councilman Snyder,, We will be in an increasing bind
unless we take steps like this,,
The bulk of the taxes in this City are carried through commercial
interests,, To prevent that bind from getting tighter, this is a
costly and painful step but it is a necessary one to reverse the
trend,,
Mayor Nichols; I agree,, I -think we have an
obligation to determine.where
we are going to get our revenue to pay for it before we agree to.go into
the program.
City Manager, Mr,, Aiassao We did not earmark the $19,700
that was predicated on a possible
refund,, By the time this request will become due the detailed revenues

but I would suggest if this is essential and the Council feels it is
critical for the preservation"of the downtowri area of your community
paying the large percentage of your taxes then this is a decision of
policy,, I think if the Council wants me to find money and they feel
the project is critical and necessary, we will find it and do it,,
Councilman Heath: I do feel this project is that
critical,, I feel there is some
place in the budget where this will come to us as of December. I
feel we should adopt this flan with the condition that as soon as
possible and by no later than December 1st we should have hard and
firm facts of where this money is coming from,, We should prepare
ourselves to go ahead with this study at this time so when this informa-
tion does come through, if it is favorable we should proceed with the

we are going to get returned to us at that time, at that time the
program can be authorized and immediately proceed but they should lay
the groundwork until we have definitely been informed where we are
getting this money from.
Councilman Krieger: I don't think there has been any
dispute or disagreement within
the Council itself as to the importance of this proposal,, It seems
to resolve itself more as to a question of timingo With respect to
that, although a city unlike other governmental entities cannot engage
in deficit financing I think we should take cognizance -.of the informa-
tion of timing hereo A city, like a business, is actually engaged in
competition. Our competition are other communities. We may decide
to bide our time but that is only an invitation to the competition to
increase their activitieso I can think that there are a number of
revenue producing sources that we discussed during the time of our
budget consideration that in a conservative approach we deferred an
allocation of such funds until there was a firming up of those sources.
I think the City Manager has presented only one possible source for
the funding of thiso I would like to think that that alone would be
sufficient but in any event I would be predisposed to proceed with
this matter recognizing that it is ultimately going.to evolve upon
the staff to see that such funds are.available from.the budget that
the Council has indicated it is'prepared to authorizeo
Councilman Snyder.- I would like to suggest that a
hotel/motel tax offers a means
of paying this. As I recall the last study on this would have brought
us in the area of $19,000 and 'that was before we had the new motels going
in now.

regular meeting of the Council on July 12, 1965, during which time
the City Manager is to come up with a recommendation of where this
money can or will come from and at that time if we.g.et a satisfactory

into a brief personnel session
to discuss possible appointees to the Sister City Foundation, a
request that has been before us and we are overdue in that action.

Councilman Snyder- On the Vine Creek Drain, has
there been any final decision
on that yet?

Public Services Director, Mr. Fast- We have had a tremendous amount
of reaction at the public meeting
we held and have heard nothing since except one letter indicating that
they wanted it to stay where it was.
Councilman Snyder- What will determine the final
decision?
Public Services Director, Mr. Fast- . We were going to contact this
week the committee that was formed
that night, the spokesman of that committee, and determine whether
any action is anticipated and if there is none we will make a report
to the Council, and if one is forthcoming we will make a report in
any event.
LEASE PURCHASE
Councilman Snyder- A study session on the municipal
financial consultants for lease
purchase was supposed to be held with budget sessions or, by motion
of the Council. What are we going to do on that?

City Manager, Mr,, Aiassa-, I would like permission of the
Council to make a trip to Fresno,,
The City Manager, Mr. Hunter, has taken over the job from Mr. Klein
and they have developed there.a public authority and he suggested I --
make personal contact with the people who actually put this together,,
This public authority is an important factor because it has powers
that the lease optional purchase doesn't have and it has the advantage
-hat it does not become a tax factor. I was planning to go next week
if it is convenient for the Council,,
Motion by Councilman Snyder, seconded by Councilman Heath, and
carried, that the City Manager be authorized to go to Fresno to
look into their public authority,,
LETTER FROM COUNCILMAN HEATH
TO COUNCILMAN KRIEGER
Councilman Krieger-, I received a communication from
Councilman Heath and I understand
copies have been sent to the other members of the City Council,, I
have sent to the City Clerk a.letter addressed to the Council with a
copy to Mr,, Heath,, Mr,, Heath's letter to me is dated June 25 and
• inquires as to the financing of the recent bond election,, My letter
to the City Clerk is dated June 26 and I attached as an enclosure to
the letter a list of bond election contributors Copies of this
letter were sent to Mr,, Heath and to the co -treasurers of the citizens'
committee, Mr. Carr and Mr,, Wax.,, I asked that it be placed on the
Council agenda in case any member of the City Council had any questions
to pose to me in a public meeting with reference to the list of names
and amounts of contributions made by participating parties to the
recent bond election,, I would like to make the position clear that
I was not the Finance Officer for this project; that I was not the
Chairman appointed by the Council and I don°t believe this was a
Council project,, All I did was to volunteer my efforts as a private
citizen in this undertaking. As a courtesy to the Council and to the
Councilman directing the inquiry, I have filed this list, the original
of which is in the possession of the treasurers for this election
campaign. Such information has always been a matter of public
information to anybody interested in obtaining it. If there is any
additional information requested of me by the Council I would be happy
to respond to it,, If there is any additional information requested
of the committee I am sure that the co -treasurers would be happy to
respond to it,, I don't feel any individual responsibility in this
matter to any individual Councilman. The results of the bond election
were disappointing,, I don't believe that this becomes the individual
responsibility of anyone within the community,, I trust that this
letter was not intended to be a suggestion to this effect. I am
somewhat curious as to the actual purpose that this letter. was to
serve but notwithstanding my reservations in that regard I was com-
pelled by conscience and duty to respond to it, which I have done.
If the City Council as a Council has any questions to pose to me I
would be happy to respond in kind,,

• Councilman Heath.- I wrote the letter to Mr. Krieger
requesting information as a
Councilman from something that I think should be a published report
for certain reasons that I don't care to discuss at the present time.
I have not seen the list. I got a copy of a letter which said there
was a list enclosed and I still have not seen this. After I see this
list then I will reserve the right to make more comment,,
Councilman Krieger.- I would like to read the letter
into the record at this time.
This is dated June 26, 1965 on the stationery of my office addressed
to the West Covina City Council, City Hall, 1444 West Garvey
Avenues Attention Mr. Flotten, City Clerk.-
"Gentlemen. -
"In today's mail I received a
letters a Xerox copy of which is enclosed herewith for your
informations from Councilman Robert N,, Heath requesting a
elist of names and amounts of contributions made by
participating parties of donations of $100 or more° to the
recent".bond.- election campaign in West Covina,,
'In his letters Mr,, Heath
• makes a number of incorrect assumptions, including I was
the 'finance officer' for this project, that I was the
'chairman' appointed by the Council, and that this was
a 'Council project',,
"Nevertheless, I am gratified
by his sincere but belated interest in the finances of this
campaign. For the immediate information of any Councilman
that may still not be aware of the facts the "Vote Yes For
Bonds' Committee", in addition to its general chairman,
campaign coordinator,'executive committees and steering
committees all composed of private citizens,, was co -treasured
by Messrs,, Frank Carr and Phil Wax.
"Whiles properly, Mr. Heath's
inquiry should have been directed to these gentlemen, I shall
save him any additional effort by making -available to the
entire Council the names, addresses and amounts of contributions
from all donors,,
"The only responsibility I
have, if any, in this matter is to account to the Council
itself, and not to any individual Councilman, albeit
questionable his motivation or the remarkable coincidence
in the timing of his request,, Therefore, I render to the
Council at this time the enclosed list entitled 'List of
�. Bond Election Contributors" and submit to Mr,, Heath a
copy of this letter,,
"At the same time I request
that the City Clerk place this matter on the City Council's
agenda for the regular meeting to be held on Monday, June 28,
1965,,"

Councilman Heath: I received a copy of this letter
.but it is quite a coincidence
that the list was not enclosed with my copy. Since I received a
copy of the letter I imagined I would have received a copy of the
list,, Mr. Mayor, I sent a simple letter requesting some information
which should be available to any Councilman or any citizen of the
City to Mr. Krieger for reasons which I have, I regret very much
that Mr,, Krieger has immediately taken the defensive on this. It
leads me to believe that something must be wrong whenever a man jumps
to the defense as Mr. Krieger has. I don't see where there is any-
thing to hide here or what there is to hide. I asked for a simple
copy and if you read my letter it says 'it does not have to be a final
form, rough.notes are satisfactory, et cetera. If that. sn,!t a
simple request I don't know.what it is but evidently Mr./Krieger is
afraid oft,.something and immediately has put up his defense and is
on the defensive. I would appreciate very much if this list would
be forwarded to me by the City Clerk or someone because I feel that
I would like to see the information,, '
Councilman Snyder-. I would like to comment on
your letter although you say you
are asking a simple copy you said in a form "reproducable". I
would like to go on and say that there seems to be some implication
here that this list might reveal detrimental information and I would
like to further say.that I know this is not the case, that the amount
and number of contributors on this list constitutes really a badge
of honor for the City of West Covina and indicates that the sincere
feeling of all those people that participated in this, their sincere
feeling in the value of -'this bond election,, I think again that this
is a list of honor and nobody should hesitate about having it revealed.
I think the defeat was not a reflection on Mr. Krieger; the defeat.
was a reflection on the City of West Covina and the people therein.

Councilman Snyder: The fact that you wrote the letter.
The list could have been obtained'.
I am sure, by just asking Mr. Krieger for it or the finance officer.
The point that it had to be formally asked for .in a letter somehow
puts a formal connotation on it that makes you think all is not well.
Councilman Krieger: Mr. Heath, you did not ask me this
as a private citizen, You dictated
this letter to a member of the City staff; it was written on City
stationery; and it was signed by you and the fact remains that as an
individual Councilman I have no responsibility to you. I have a
responsibility, if any, to the entire City Council. The day, the
very day I received your letter I wrote a letter to this City Council
in response to your letter and sent a copy of it to you. I admit it
is a simple letter but I place a little different connotation on the
adjective.
Councilman Heath: Vhy? Because you are on the
defensive or what is wrong?
Councilman Krieger: There is nothing defensive in
the letter I wrote or the list
of contributors. This information has been available since May 11.
Councilman Heath: I think this meeting has gone on
long enough. I have requested
a copy of the letter from the City Clerk and at that time I would
talk further on this. At this time I think we are doing a lot of
talking and I think it is not --
Councilman Snyder: I hope this will not reduce
itself where it will be a
reflection on those good citizens that gave unselfishly in this
campaign in the interests of West Covina and I would not want to see
this brought down to that level.

concerned, Councilman Heath, that acting as a Councilman in your
capacity as Councilman you make a request for information arid -`then
deny to the Council knowledge of your motivation.
Councilman Heath:,, _I will expose this at the right
time but until I get this list
there is no reason for me to make a commento I would also.say
this and from what you have said and the statement that Mr. Krieger
has said just a few minutes ago that a Councilman cannot, or can he
speak as an individual while he is a Councilman?

Yes. You made the point you
were speaking as a Councilman.
Councilman Heath: I wanted to get this clarified
that you now finally agree with
me that I can go out on the street and be an ordinary citizen and that
I am not a Councilman if I speak out on the street here.
Councilman Krieger: As, long as the line isn't drawn
where it represents either a
pecuniary or a moral conflict of interests with this City's government.
Councilman Heath: I would like to make sure that
that last part of that sentence
is put in the Minutes because that is very important.
Councilman Snyder:
As long as you act on the Council
not as an individual but as a
representative of the people.
There being no further business, Motion by Councilman Heath, seconded
by Councilman Krieger, and carried, that this meeting'be-adjourned at
10:20 P.M.
