CITY OF WEST COVINA, CALIFORNIA
March 22, 1965
The regular meeting of the City Council was called to order by Mayor
Snyder at 7:45 P.M. in the West Covina City Hall. -Councilman Jett
led the Pledge of Allegiance. The invocation .was given by Mr, Robert
Flotter; City Clerk.

Sister City Commissioners in making the decision regarding the street
name change that a possible mall in the future civic center would be

also that the Council direct the City Manager to work with the archi-
tect and see if an appropriate area as outlined in this area can be
designated in the Civic Center.

As far as taking a part of the civic center and calling it Toluca Square
I hardly understand how this can be done because it will then be an
imaginary line and be lost in the identity of the civic center,,` Let
Center be Toluca and let it run from Glendora up through the old center'
to the new center and back on the frontage road,, What more of an asset
could we have to show our respect to our sister city? There is a
possibility here that someone' is making folly out of this sister city
program,, This.is something which is a worth while program and I think
we should treat it as such,,

is an unimportant street, It leads
directly into the civic center, Because we can't be definite as to
location we can't specify a mall area in the civic center tonight to
be named in the future for Toluca but I am in favor of it and the City
Manager will work with the architect and make recommendations regarding
it, I think if the Council agrees we can say that we will name such
a place in our civic center if feasible,

Walnut Creek Parkway and when it gets to Glendora it swings down into
Valinda Avenue, This might be a possibility. There is also a short
section of street between Glendora and Vincent Avenue which is not
named Walnut Creek Parkway, the name of which is going-t,o. have to be
removed,

Councilman Krieger: If I understand correctly what
we went through the last time
there has to be a screening of the shops or businesses or residents
along a proposed street, does there not'?
City Attorney, Mr, Williams: This isn't a law; it is a policy
established by the Engineering
Department.
Councilman Heath: Along Walnut Creek Parkway there
are very few residences: However,
there is this one street between Vincent and Glendora which is
now called Walnut Creek Parkway and it is a duplicate street, At
the present time the Citrus Bank is on that street and no other develop-
ment but it is a much better street I would say than Richland,
Councilman Jett: I think that is a good idea for
Walnut Creek Parkway going from
Glendora and following it around the wash over to Service Avenue,
This would allow the present Walnut Creek Parkway to stop at Vincent
Avenue.
Mayor Snyder: The staff came up with the recom-

Mr. A. M. Gilmore My objection to the entire weed
835 South Orange Avenue abatement program is that it is
West Covina a weed cultivation program, If
you take a look at Dr. Gordon?s
property at Garvey and Orange and all the way westward to the City
limits you will find that they go in and really they cultivate it
because you have two crops, First the wild mustard that comes up
earlier in the year and then after that you will have the tumble weeks
and then you will have a clearance of that and you will give them
permits to burn. I think there are plenty of chemicals to retard
growth,
Mayor Snyder: Mr, Aiassa, is this permissible?
City Manager, Mr, Aiassa: The only cities I know using
it is in restricted areas, Any
time you use chemicals there are alternate effects. There are people
who have allergies to them and you destroy other plant life, I will give
you a report on using chemicals to take care of these weeds but there
are other hazards not outlined now when you start using these strong
weed control elements,

anything about it this year
but staff should look into this and give us information about it,

City Clerk, Mr. Flotten: The notice of this public hearing
appeared in the West Covina
Tribune on March 11, 1965 and 22 notices were mailed to property owners
in the area. (Read Planning Commission Resolution No,, 1766.)
Mayor Snyder:

This is the time and place for the
public hearing.
Mr. Leonard Jones I have a plan indicating that the
2326 Coronet Court City has on its priority list the
Covina desire and program to put a half
street through our property known
as the Merced Alignment. By this proposal they are asking for two little
pieces of our property with the understanding that they will pave the
half -street on the opposite side of our property. This is the reason I
am here. This is not satisfactory to us. I don't feel a half -street
being put in will solve the traffic problem in this area. When the
zoning was granted at the time there was some question about this and
they left the property back here in three lots. This represents some
329000 square feet. The street does not come in directly and there is
only room for about three ingresses and egresses here. The curb and
gutter is already in. If we cut that curb and gutter for three
ingresses and egresses there will be no room for off-street parking.
Mr. Paresi, Mrs. Thyberg, who lives across the street, Mrs. Leone, who
lives next door., have all told me that this is not satisfactory to
them. We are asking for a straight line and for this lot split to be
made., The lot we are asking for would conform to the other lots in
the area being exactly the same size as the one immediately to the
east. We have the feeling this is not asking too much in view of the
fact the City is asking for 34,840 square feet to be given to them.
Inasmuch as we have offered to pay for the curb and the gutter and six
feet of the paving as well as the giving of that land which over three,
years ago was appraised at over $24,000, and inasmuch as we are giving-,
this amount of land, we feel it only fair for us to have some compensation
and we felt this was a reasonable request.

My neighbor Mr, Shaub and I had
an oral and written agreement after the property was sold to him,
After a full disclosure of the problem that we would cooperate with
each other in putting in the street and the half street is not satisfactory
to either of us, There probably would be a saving of somewhere between
fifty and seventy -thousand dollars to the City -- there is severence
damage involved; there is a house there we rent and the street if put
in comes within four feet of it,
I would like to read a few
remarks made by Mr, Vern Cox, a licensed real estate appraiser, This
appraisal was made over three years ago, "The property zoning would
compensate for the loss of 'value to the property owners in severence
damage. Due to shape impairment at the south end of this property it
was estimated March 27, 1963 that approximately 2100 square .feet would
be unusable because of dimentions that were caused by the alignment of
the proposed Merced Avenue, There is indicated a possible saving to
the City of 5259075 which represents the value of the land for the
street, The minimum saving would be based on the dedication of the
I and with the City paying for the cost of the street. The land is
zoned R-A residential -agricultural which obviously is not one of the
highest and best uses for this land, It is the opinion of your
appraiser that a compromise between commercial and residential should
be made. The northeasterly remainder should all be R-P,o' This was
made over three years ago and surely the evaluations on the land that
we are discussing are far more than that day,
We are willing, to give the land
and pay for the curbs and the gutters and six feet of the paving and
all we are asking is to split off that one lot which is exactly the same
size as the lot to the east. We are asking that you put the remainder
into the R-P. We are making a statement that the half -street is not
acceptable to either of us and we are morally and legally bound to
each other to not dedicate a half -street to the City,
There being no further public testimony, the hearing was closed,
Councilman Heath: I think you will find the one lot
Mr. Jones is asking to remain R-A
would have a full frontage on the street. If we try to add another lot
that second lot would have an access of 20 or 25 feet on the street;
there would be no place to park,
Councilman Jett: I feel this property is certainly
residential, The rest of this
property has been zoned for approximately three years and no develop-
ment whatsoever has taken place on this property. I think if you
extended this now you. .would be going against your Planning Commission,
your General Plan and the D,M,J,M, report and in my opinion, against
good planning,

Councilman Nichols; I have tried to look at this
• parcel quite fairly,, The thing
that disturbs me here is that I am not satisfied that zoning this major
parcel into R-P is proper zoning. On the other hand, the alternatives
suggested by our own staff don't seem to me as being the answer, either.
They talk about two or three additional lots on Wescove Place when even
by making the so-called knuckle in there if you come in with even two
lots you have substandard frontage, you have a parking problem,on a
very narrow street which is a problem street anyway from a traffic
access and control standpoint so I think neither the applicant nor our
staff have provided us with an answer to this parcel. From that stand-
point I do not favor this zoning request,, I think somewhere there is
a better answer than we have seen here this evening
Mayor Snyder: If we squared the area off it
would perhaps discourage further
encroachment to the east,,
Councilman Krieger- I would personally be in favor of
holding this matter over with
the hearing closed to the next regular meeting of the Council which
would be April 12 to explore somewhat further the possible consequences
of this type of development and what alternatives, if any, there are
on this situation,,

Councilman Heath: If you have a staff report they
are submitting additional
evidence,, I think the thing to do would be to reopen the hearing and
hold it open until the end of the next meeting,,
City Attorney, Mr,, Williams- I think you would have to,, I
don't see how you could consider
any factors that haven't been presented tonight unless you hold the
hearing open.

carried, that Zone Change No,, 336 be held over to the meeting of
April 12, 1965 with the hearing held open and with the staff directed
to consider the possible alternatives of development and recommendations
to submit them to us at that time,,

one parcel of R-1 which lies north
of the subject property requested that it also be zoned R-P, as a matter
of law you would have to grant it,,

that he could but we have no precise plan and we are not on the market,
There being no further public testimony, the hearing was closed.

amended before it could go through,
City Manager, Mr, Aiassa: We have had this case postponed
until April,
City Attorney, Mr, Williams: You can proceed with the zoning
but the annexation may.never take
place, The reason is you cannot annex a parcel which'is more than 300
feet long.unless it is more than 200 feet wide,, This is not more than
200 feet wide and it is more than 300 feet long, This property is
1.10 feet wide,

Councilman Nichols: It would seem to me if these
people are desirous of coming
in knowing they have to have a larger parcel to annex to the City that
it would have been in their interest to provide that parcel to the City
and not to this Council to provide the zoning in advance on that.
Councilman Krieger:
I don't see anything wrong with
the R-1 zone there.
Mayor Snyder: I am in favor of the R-1 zone.
I think, however, the convalescent
home is a pretty heavy usage for that property.
Planning Director, Mr. Joseph: There is one directly across the
street from it.
Councilman Heath: Can we hold this over for a while
and find out if the owner of the
property is going to come up with more land? Unless he does, what we
are doing tonight means nothing.

What about the date certain on this?
City Attorney, Mr. Williams: Once introduced you can pass it
ten years from now. It will keep
appearing unless a motion is adopted to deny this rezoning or approve
this rezoning. You can set it -to a specific date but until you either
pass the ordinance or adopt a resolution denying the zoning the matter
is still pending before you. If you have a motion that ties the holding
of this proceeding over in with a study of facts to be presented to you
in order to enable you to determine th outcome of this proceeding you
will have to hold a new public hearing or else disregard the study and
act on this before the study.
Councilman Krieger.- My intent obviously would be
better stated by stating it in
two motions. I will withdraw my first motion. Mr. Joseph, what would
you anticipate as far as time is concerned in such a study?
Planning Director, Mr. Joseph.- It would take us six months.
The Planning Commission has
given us a certain amount of work which will take a while to perform.
We are in the midst of this now including the Huntington Beach
Freeway, including the large annexation study, and several other things
on the priority list. For us to place this on the list we would have
to receive the concurrence of the Planning Commission and I would
suggest honestly that we could not hope to finish a report in less than
six months.
Councilman Krieger: Is there any time limitation
as to the amount of time we can
hold a matter like this over?
City Attorney, Mr. Williams.- Well, there is a provision in
the code that you shall decide
within 40 days after the closing of the hearing but it is directory
only and unless a writ of mandate is brought against you you can
still decide it at any time. They could only mandate you to act so
in effect there is no time Limit, Even though it says you shall act
within 40 days if you act after the 40 days it is legal.
Councilman. Krieger:
Is there a limitation to the time
we can table it?
City Attorney, Mr. Williams: No, except the one I mentioned
which is a directive provision
to decide a case within 40 days but it isn't jurisdictional.

PLANNING COMMISSION
RECOMMENDATION REGARDING STANFORD
RESEARCH INSTITUTE REPORT ON AUDITORIUM
Councilman Jett: I think the Planning Commission's
recommendation was that we proceed. -
with the Stanford report and request the Stanford Research group to
begin the second phase of this study. My question is do we still want
to pursue the regional auditorium at this time with the advent of this
theater coming in?
Mayor Snyder., I think the first phase of the
report indicated that the theater -
in -the -round coming in would have some effect on the regional auditorium
but would have no effect on helping the need for a conventional type
center and other uses. There will. be limited public use of the theater -
in -the -round but there won't be enough nights available for all the
uses that a regional auditorium indicates.
Councilman Krieger., In the first phase they recom-
mended holding final decision of
the regional auditorium until they could determine the full impact of
the theater -in -the -round. They recommended in the interim the exhibit
space be enlarged over that which they might otherwise recommend to us.
My feelings are on that that I would prefer to see the Council defer
any action on initiating the second phase until such time we are able
to determine the responsibility to our present bond'issue.

• BUDGET ANALYST POSITION ABOLISHMENT
City Manager, Mr. Aiassa: The Personnel Board has made a
recommendation that in view of
the recent recruitment that Budget Analysist position be abolished
and Assistant Finance Director, salary range 29, be authorized.
Councilman Krieger: It seems like a strange reason
for creating a higher paid
position than that which is being abolished. Why didn't we go for
an Assistant Finance Director to begin with?
City Manager, Mr. Aiassa: We tried to fill the position as
it was almost five years ago.
Gold stressed the point that the position should be upgraded because
of the responsibility involved.
Councilman Krieger: This man has added responsibility,
not just added pay with a new
title?
City Manager, Mr. Aiassa- Yes,
Councilman Nichols: Wouldn't it be more appropriate
to try to readvertise and hire
an analyst and then if he works out and turns out to be a good man
and he is doing the job then to abolish the position and create the new
one and in effect advance him?
City Manager, Mr. Aiassa: I want to create a position of
City Comptroller where=,th:e City
finances will be controlled in one department. I also want to divide
some of the responsibility of the Finance Department to the Assistant
Director of Finance. We are going into data processing, centralized

COUNCIL COMMITTEE REPORTS
COMMITTEE OF MAYORS MEETING
Councilman Heath: I went to the Cgmmittee of Mayors
meeting today, We had someone
from the League talk about the pending bills. We had Preston
Hodgekiss, Chairman of the Formation Commission, give a speech. He
wants to make clear that this propaganda about accusing this Commission
of trying to make a power grab is absolutely ridiculous, All they want
to do is ask the Legislature to provide an alternate for the Supervisors
in case one of the Supervisors is absent. They have handled 430 annexa-
tions in 18 months and two incorporations and one sanitation annexation,
Mayor Snyder: It seems to me they might need a
board for each district.
AGENDA
Councilman Heath: I would like to point out here
a condition which we have tonight.
We have eight pages on this agenda. The paper doesn't cost very much
but the labor and work that goes into this is ridiculous. After each
item we have a space for the action taken which takes type typing it
up and I don't think anyone except Mr. Flotten uses that part of it
except to doodle on, I was wondering why does the paragraph entitled
"Action" have to be there? I think it is a waste of paper and these
things should be cut down to nothing but headings and that's it,

• but you will not cut it down
more than one page so they are still going to have to collate and
staple and you will still have about the same length of agenda,
Councilman Krieger: The benefit I get is when I read
the Minutes. I read them with
this agenda in my hand and frankly I can't remember 50 items on this
agenda,
Councilman Heath: I still think it is a waste of
time and the few people that
use that for notes can write in the margin,
WATER
Councilman Krieger: I met with the Board of Directors
of the Upper San Gabriel Valley
Municipal Water District at their office last week and I was concerned
with two specific items, We are getting a little closer to where we
want to go and it seems appropriate to discuss with them the subject
of directorships and the subject of their back taxes.
On directorships, by law they
have five directors and my concern was that if and when West Covina
becomes part of this district that it not be gerrymandered between
other districts so that as much as possible we can retain the political
entity of West Covina when we come to vote for the director that would
represent this area and contiguous areas. As a matter of procedure
it is impossible to make a legal commitment in this area prior to the
annexation but there was a statement made for the record and voted upon
by the Directors that within their ability at the time that West
Covina becomes a part of the district that they will try to maintain
consistent with their past policies the political integrity of each of
the communities and specifically the City of West Covina and I indicated
to these gentlemen that I expect to be back to see them at such time
as this annexation goes througn to remind them of this particular stand
so that when the districting does come about that this City is not
cut down the middle. In looking at their map I saw in most instances
the cities themselves were preserved within the district. It is going
to represent somewhat of a jigsaw puzzle at the time it comes back
before them and I think we should recognize it to do this job and there
may be a little peripheral problem but in substance I trust when this
action must be taken it will be taken in consistence with their
indication of maintaining the political integrity of this area,
The second point had to do
with the subject of back taxes. I found myself in somewhat of an
incongruous position. In appearing before the Water Problems
Committee of the Metropolitan Water District I argued with interest
on our investment in the State Water Contract, In appearing before
the Board of Directors of the Upper District I argued against
interest on the back taxes and I was unsuccessful in convincing them
if we spread we should not pay interest on that portion which is
deferred, 'It was a somewhat incongruous position to take particularly
inasmuch as most of the men had been at the Water Problems Committee and
were well armed in advance for this particular argument. It was openly

and frankly discussed and at one point there was almost an air of
• optimism about it. The back taxes for the Upper District amount to
eight cents. Using our present valuation assessed, it comes out to
6.4 cents. It was my feeling and there was reluctance on this point
by a great number of the directors, but they finally concurred in it
that it would be unrealistic for us to have to come up with the entire
back taxes in one year and it was therefore on that basis that I
approached them with two thoughts in mind -- the interest which I have
already discussed as being waived which they would not agree to do
but they did agree to spread this back taxes over a period of three
years which in my opinion is a lot more realistic as far as what our
tax payers should be faced with.
Mayor Snyder: It seems to me a good argument
why we shouldn't pay interest
is if we didn't go into the district --
Councilman Krieger: We are buying into an investment,

Councilman Jett: Next Wednesday night I won't
be able to be at the Planning
Commission meeting. My alternate will have to take over,
City Manager, Mr. Aiassa: I'll take care of that,
