The regular meeting of the City Council was called to order by Mayor
Snyder at 7:35 P.M. in the West Covina City Hallo Councilman Nichols
led the Pledge of Allegiance. The invocation was given by Rev. Byron
Scherer of Christ Lutheran Church.

REQUEST TO CHANGE NAME OF STREET LOCATION, Center Street from
Center Street to Toluca Street California to State
Review engineer's Report. Authorize City Engineer to proceed in accor-
cance with Council°s policy established May 8, 1961. Staff recommends
authorization per policy.
City Clerk, Mr. Flotten� Read report re this matter from
• Ro Ea Pontow, City Engineer dated
March 4, 1965 as follows,
"In response to City Council directive of February 15, 1965, we have
initiated procedures to change the name of Center Street to Toluca
Street. We have implemented Step 2 (a) of the City policy relative
to street name changes which we referenced in our report of February
19, 1965 to the City Council. The affected property owners and/or
occupants on Center Street have been notified that this matter will
be heard at Council meeting of March 8, 1965, at which time anyone
desiring to comment on the proposal will be heard. Since we under-
stand that the West Covina Plaza Merchants Association is also in-
terested in this matter, we have notified the president of that Asso-
ciation of this agenda item.
This street name change would involve a cost to the City of approx-
imately $60.00 for new street signs, map revisions and related work.
The cost involved to existing businesse's should not be prohibitive
inasmuch as there is only one business (Union Oil Station) having a
Center Street address. Finally, we don't foresee any problem. in
this name change insofar as conflicting with any like or similar
names within the San Gabriel Valley area.
RECOMMENDATION,.
That,.should the Council authorize changing the name of Center
Street to Toluca Street, the attached Resolution be adopted and
the City Engineer be authorized to proceed with the street name
change including the purchase of street signs, map revisions and
related work.
The name change can be effective on March 19, 1965 providing the
Council approval is granted at the March 8, 1965 meeting.',

to authorize the City Engineer to proceed with the Council policy estab-
lished on May 8, 1961 concerning the changing of Center Street to Toluca
Street to be heard at the Council meeting of March 8, 1965.

the essence of the Planning Department recommendations were "Let us delay
this until we have further time to study it because we are not sure
yet whether or not this is the way in which we are going to go" and

• "We are just not sure what we are going to do," Anyway you look at
it it comes down to these two facts, It is also set .forth in the
Planning report that C®3 in the present ordinance is equivalent to
highway commercial under the General Plan, The General Plan has
not planned highway commercial but in general they have designated
it only where they found it, (Gave brief summary of the highway
commercial areas in the City of West Covina and the uses thereon,)
To the south of our property
is a C®3 usage and to the north of the property we have a golf course
which used to be a C®3 usage and then we have Zody's and Ralph's.
I would like you to look
at the comparative highway volume, We have a relatively low volume
of traffic along the service road between Barranca and Citrus,
Up Citrus we have about 19,000 cars a day, On Azusa we have about
a 28,000 car use and up in front of the property in question we
have 32,000, On a traffic density situation it seems these two are
the most heavily travelled blocks in the City of West Covina with
the exception of the freeway,
Across the street we have
a few single family homes abutting on this and we have short streets
of single family homes, We have real estate offices and commercial
and professional offices in here',
The General Plan has been
in effect for over two years and has provided a definite concept of
commercial and perhaps residential, In that period of time the City
has not taken the trouble to catch up with its own General Plan,
Last year you extensively went through the residential and reclassi-
fied it but you have not gone back and examined existing facts as
to where the zones are now, The Planning Department recommends
delay and further study, I have been in the City of Covina for ten
years and associated with zoning for about nine and a half years,
The first time I appeared before this Council was in connection with
a zoning matter on North Azusa Avenue and at that time I was asked
to delay it and at that time the street was two lanes wide but it
already carried the zone marks which are the growth of traffic, The
people who lived where Ralph's and Zody's is at the present time
tried to get their property changed, Since October 14, 1953, not
counting two zone requests and one heard by the Planning Commission
at the same time of this, there have been 28 separate zone change
requests in the area between the Freeway and the City Limit, In all
that time the City has not firmed up a plan by any study, Everybody
up there has developed as a result of individual property owners from
time to time convincing the Council that the facts as they existed
have changed,
The block we are talking
•about is the heaviest travelled street we have in the City.
Certainly a block heavily travelled has already depreciated any
residential zoning to any extent that it is going to be depreciated,
With respect to the school
behind the C®3 type use, we have a precedent for that at the east
end of town at Eastland, a C®3 sitting in a C®2 zone, I submit
the evidence with respect to traffic and with respect to the growth
of the plan and the phases of the General Plan itself would indicate
these are not intended to be firm boundaries but are generally -

indicative of area boundaries are to be considered as indicative
of places where these could goo
There is no pressing problem
to extend this zoning up above, The depth of this property is
compatible with all the other property developed in the area,
I request you reverse the
decision of the Planning Commission and grant Cm3 zoning to the
entire property,
Mr, C, H. Beattie, Jr, I represent the property
1750 East Rowland Avenue owners to the southwest corner
West Covina of Rowland and Azusa Avenues,
We don't object to a change
in zone classification on this particular piece of property to permit
the location of a carwash for the following two reasons: One, we
don't believe such a use would be detrimental or injurious to our
property, Twoo this land has been zoned C®1 for over nine years,
We feel it should be put to some use that will benefit the property
owners and also the City,
'IN OPPOSITION
• Mr, Joseph N, Renner I represent Mr, and Mrs, Todd
Attorney at Law Keck living at 1808 Pioneer
3935 East Huntington Drive which is directly across the
Pasadena street from the property in
question, We are concerned
primarily with the area directly across the street from this property,
An elementary school, a junior high school and a high school are in
this area and much foot traffic by the children is going back and
forth,
It appears that Mr. Garvey
has made his point welly 32,000 cars up and down in front of this
area ®® the busiest street in town and now we are going to build a
traffic snarl by putting in a service that calls for cars to cut
across from the right-hand lane across the left-hand lane and back
and forth, in and out of this area, crossing the sidewalk in two
places,
I have here petitions signed
by some 60 residents of the area and I realize that these petitions
have no legal standing, This is a spot zoning, I think the City
Council and the Planning Commission have done their very best to
bring some order out of chaos, Certainly it is advantageous to delay
and study the problem thoroughly so it is not necessary to have spot
zoning,
Mr, Garvey mentions that the
Eastland Shopping Center has a car wash next to an elementary school
so the precedent has been set, May I only say that two wrongs do not
make aright. If you have seen the traffic pulling in and out of the
car washes you would agree the danger is there,
If Mr, Garvey and his clients
would spend as much time looking over the available C-1 usages the
Council and the Planning Commission would not have denied a commercial
usage of this property; it is merely this type of C-3 usage, If they

• would spend the time searching through the C-1 usages which run
almost through the alphabet they would find some other lucrative
economic enterprise they could use on this property, I don't believe
they are being denied any property right,
REBUTTAL
Mr, Francis J, Garvey: Counsel put up an excellent
argument but I did not hear
any facts put forth, The petition by the 60 residents is an expression
of opinion; it is not a fact, Eastland is not a bad precedent; it
is merely a place to which we can look to see what happened where this
type of installation went in near a school, In the six or more:
years it has been there there has been no problem that I know of,
The school situation there, I believe, would be improved to the extent
that anyone on the other side of Azusa would be using the elementary
school to the west of Azusa and there would be sidewalks put in the
length of this property by reason of its development, sidewalks which
do not'exist at the present time beyond the Ralph's - Zodyas development,
Traffic already exists, Any additional use put there would be there
because its use would be highway in nature and this is a highway and
therefore the logic of the thing is that it bp znnpd to represent
what exists and not what might have been had on some other planned
development,
There being no further public testimony, the hearing was closed,

Planning Director, Mr, Joseph: The way the application reads
it is for all or part of this
property, They describe the whole piece of property but the applicant
said you can take all or part of the property,
Councilman Heath: We then can give whatever
part of that we think would be
worth of rezoning?
City Attorney, Mr, Williams: Yes,
Councilman Nichols: Mr, Garvey, what corner is the
car wash you cite as a precedent
located on?
Mr, Francis J. Garvey:
On the southwest corner of
Barranca and Workman Avenue,
Councilman Nichols: And where would students be
coming from who would pass
this location on the way to the school in that area?
Mr, Francis J. Garvey: They would be coming from
several directions, They
come generally out of the subdivision past ABC to the north,
Councilman Nichols: Have you consulted with the
school authorities as to whether
they have considered a car wash a problem of any sort?

Mr, Francis J, Garvey. No, At the time the car wash
went in the home owners in the
area objected to it and asked the school for help and they did not
consider it at that time, They did not object to it,
Councilman Krieger. The first time this came before
us on a variance I suggested
to the Council as well as to the applicant that we consider these
matters of zoning as zoning and not zone changes by variance and I
would hope that the Council tonight would not consider this zone change
matter by precise plan, I don't believe we should consider as a

parcel, I think what is really before us is whether or not this
entire parcel or some portion of that can in the future have a C®3

student traffic by this parcel originating from the property to the

Councilman Nichols.- Oftentimes when a zoning matter
comes up we have a natural
inclination to haul the kiddies out to certify something is dangerous
or should not be there because of the children, I am speaking as a
school principal who works with children all the time and who is
concerned with their safety and their access to school, I don't think
we have in this matter a problem that is primarily one that says this
is a poor development or a poor request because it is dangerous
to the children, With thousands of cars already going up and down
the street with even many, many C®1 uses that would go on that property
I think we would probably find just about as many vehicles crossing
through driveways than we have, I can't accept that as an argument but
really we are talking about zoning per se and is this the highest
and best use for this property, I think that is the whole question and
I am cognizant of the fact that Mr. Garvey has attempted to create
a concept that we have nothing but a hodge-podge of zoning anyway on
Azusa Avenue and therefore we should just perpetuate the errors of
the past and allow most anything else to come in there, I don't
concur with that, In my judgement a Cm3 use in that area is not in
the highest and best sense a good usage for that property and that is
what I have based my feeling on,
Mayor Snyder.- How much C®3 zoning is there
in the City which is undeveloped?
Planning Director, Mr, Joseph.- South of State Street, this area
in here is generally vacant,
Down on Valley Boulevard you have land between Sentous and Nogales which
is zoned C®3, On Nogales and Valley a shopping center is developing
occupying a portion of that property. I believe that is it as far
as Cm3 zoning in the City, I would guess we have about 40, 45 acres
of C-3 undeveloped in the City,
Councilman Heath.- I feel we have a very heavily
travelled street here, It
is going to get heavier travelled as time goes by., This is exactly
the location where I would say it should be considered Cm3 zoning,
The property to the south, the gas station, is actually a C-3 use and
I think Zodys and Ralphs constitute in my opinion a Cm3 heavy use
also, I feel if we granted this zoning it would be granting a
uniform zoning for one full block, I don't say I would like to go the
full depth of the property for C®3 because I think it is too much,
I think good planning could be achieved by taking the front of that
property and rezoning it to C-3 and leaving the back of it C®1 so
it can be used as a buffer between the heavy C-3 use and the uses
in the rear,
As far as the noise of this
use in this area, I will not discuss the car wash at this time but
I would say any noise that would originate on this property would have
quite an intensity to overcome the traffic of 32,000 cars and there
will be a heavier use in the future of this street, I don't like to
see a strip of C-1 uses lining the sides of the street as we have on
part of Azusa Avenue, I think it would make a much better use both to
the City and to the land owners and the properties around it if this
was developed in one unit as you have shown before rather than put a
strip of small stores with different owners for the entire length of
this property,

How is the street turning into
a highway commercial street? Actually this is a statement which can
be answered in two ways,, First, we tried to indicate by quoting the
page on the General Plan report what it takes to be a highway
commercial street, what are the components of a highway commercial
street and we showed that in certain respects North Azusa Avenue has
certain of these characteristics, It also has certain uses such as
automobile dealerships and major stores. We indicated there was
and there could be the idea that by looking at the street you could
consider this to be containing certain trends that would lead to a
highway commercial street,, We stated we didn't think it was a
highway commercial street right now even though it has several of
the symptoms, We still think the General Plan was a study and if the
General Plan is found wanting then we should pursue more studies,

just a part of this to C-3. I think if you are going to get a usable
C®3 you should zone a big parcel, as big as possible,, I feel good
reason has been shown for this to be changed from.C-1 to C-3 and I
think it is in definite harmony with the General Plan,, I don't see
how this zone will in any way increase congestion on Azusa Avenue,,

zoning one piece of land on
Azusa Avenue to a C-3 where there is no such usage zoned during the
entire length of Azusa Avenue in the City of West Covina and doing it
on a one parcel basis without looking at this matter in depth and
getting a specific recommendation from our Planning Department and
our staff and our Planning Commission which has unanimously recommended
that this zoning request not be granted,,
Councilman Jett. To give this piece of property
a C-3 zoning in my opinion
would make it possible to develop or to build certain types of uses
in there that in my opinion would be objectionable,, I would prefer
to approve something of this nature which would be a single use by
variance rather than by giving it a wide open zoning,, I think C-3
is too heavy for that particular area or for that street,,

these developments and plans
and the review of these plans, the present implim ntation of this
program that is going to bid now, did the citizens, the businessmen

seeing what these plans are and what these plans were?

where these plans were shown
before we had any studies with Victor Gruen and they have had adequate

on Glendora Avenue where we had a group of merchants there and the
interchange was gone into and the merchants have met here under the
direction of the leaders of this Association and these plans have been
put before them and discussed,,
Councilman Nichols: The ultimate question is why
if all of this has gone on,
all of these many hearings have been held and everybody involved knew
all about its why do we come up to a period of time within days of the
awarding of the contract and it suddenly becomes a matter of urgency that
was not apparent up until now?

different merchant groups,
particularly the old Center and the Plaza, a difference of opinion
in what"they wanted here and the Council in the past had to pick a
road that they felt would best serve the City and by the time we had
any recommendations from Victor Gruen the existing plans for the
Vincent Avenue Interchange had already been approved by the State
and the City so his recommendations involved changing course plus
the condemnation on Center Street had been started which we couldn't
back out of xery well, At that time there was a large body of merchants
that would not hear of abandoning Center Street,.
Councilman Krieger. I requested this report from
the staff and I would like to
see the Council review this for the benefit of the present Council
so that this matter doesn't fester in people's minds here in West
Covina and so we can see what alternatives are available and go from
there, I think the Council should take a 1965 look at the situation
to see where we stand and where we are going to go, I think there
is a certain amount of unanimity that the impl6 mentation of the State
program is going to well serve the State's purpose but is not necessarily
and probably will not serve our internal traffic flow situation so I
think it is well we consider what we can do in conjunction with the
State or independently, complimentary to what the State is doing, if
. possible, to ameliorate the situation,
Mayor Snyder. I would like to include in the
report that the recommendations
of the staff having to do with Center Street are going to improve
this situation as outlined today such as the widening of the left®
\` turn slots, et cetera. I think if you see these you may be less
apprehensive about this whole thing,

SUBDIVISION DEDICATION PROBLEM
City Attorney, Mr, Williams. I would like to inform you of
something I took the liberty
of doing, The City of Fremont got involved in a suit over a subdi-
vision, They required the dedication of certain streets as nearly
always is done in case of subdivisions, The Subdivision Map Act
provides a remedy for a person agrieved by a required improvement or
dedication, namely an appeal to the Superior Court as to the
reasonableness, This is an administrative remedy, In this case
this was not done, They deeded the streets, dedicated them to the
City, completed the subdivision and then sued the City in inverse
•condemnation, that they took their property for a public street and
the City lost, There is now a petition for review of this by a
higher court, Fremont wants all other cities that will join to do
so, The cost is nothing, I have added the name of the City of West
Covina to the list <'f those who would oppose this decision. I just
hope you have no objection, I am sure we don't want to find
ourselves in that position,

concept and I observed the play period today personally with the pilot
group in action and any objections that I expressed previously have
been removed so that I no longer would raise any objection,,

kinds of experience but I still am at a loss to know how one person

every precise plan adopted by the Planning Commission, They added
a condition No, 12 that said that unless construction is commenced
on this precise plan within a twelvemonth period the precise plan
becomes void and the Planning Commission just accepted this as one of
the conditions and every time you consent to a Planning Commission
action I suppose the Council is giving its consent to this condition,
too, The matter of zoning is a Council matter that the Planning
Commission.did not get into, whether or not you want to take away
zoning you granted or any other policy the Council sees fit to impose,
Councilman Heath- For an extension I don't see
why this can't be handled
by writing a letter and just getting an extension, One of the
conditions of the extension would be you put the new restrictions on
it. I think you are a little short on the one year on the first
go -around,
Planning Director, Mr, Joseph- I believe there would be cause
for leeway here, The Planning
Director under 567 has the right to grant minor modifications to
the conditions imposed by the Planning Commission, I would think a
valid request for continuance would be under that provision,

Mayor Snyder: A Councilman is supposed to
review these on the basis of
merit and all this would do is calendar it,
Councilman Krieger: It is always within the
jurisdiction of the Council
at any time to review a zoning matter and to initiate a change on
the initiation of the Council, Where does this impose any additional
burden on a property owner? The Council at any time could have initiated
a zone change on anyone's property, All this states is what for the
record is in fact the law,
Councilman Jett: I think I would be opposed
to this,
Councilman Krieger: You are doing an applicant
more of a favor by advising
him at the time that the Council grants a zoning that the Council
at some future time is going to exercise the jurisdiction it has by
law so if the Council at some future time without so advising him
were to do so in the latter instance it would come as a shock to him
• than in the first instance where it would come upon due notice given
at the time you first consider it,
Councilman Heath: There has been zoning given
which has caused considerable
aggravation to some members of the Council and I have seen where these
persons who would love to get the chance to snap that back to the
original zoning purely because they lost being on the minority side
and this is what we are talking about,
Mayor Snyder: I understand what you are
saying if the political
fortunes changed,
Councilman Krieger: That could happen anyway,
Councilman Nichols: Until such time we determine
because of a development of
circumstance in this City that something is improperly zoned we
should leave the zoning alone, That is my opinion,

relative to the reconstruction of the
• Azusa ^:venue Bridge at Walnut Creek Wash. (Read report re this matter
Fated February 19, 1965 from John Q. Adams, Public Service Director as
follows:)
"Attached are copies of an Agreement and a sample Resolution which
provide for the addition of the subject work to the F.A.S.U.E. Pro-
ject heretofore approved and funded by the California Highway Com-
mission for the improvement of Azusa Avenue between Francisquito
Avenue and Amar Road.

This change in the scope of work as outlined in the original
project has been made at our request in order to qualify the
reconstruction of the Azusa Avenue Bridge for F.A,>S,U.E. funds.
This work was budgeted in our 1964-65 Capital Improvement. Pro-
jects Budget for financing from our share of Section 186.1 gas
tax monies. Assuming that this amendment to the original Azusa
Avenue.Project will be approved by the California Highway Com-
mission, we in fact realize a saving of approximately $80,000.
in our gas tax funds which can be applied to other badly needed
projects, This sum represents approximately 38%® of our projec-
tion of 186.1 monies for fiscal. year 1964-1965,
RECOMMENDATION:
to That the attached Agreement be approved and the Mayor and
City Clerk be authorized
to execute same.

ASSEMBLY BILL NO. 57
Councilman Krieger. I don't know how many of you have read
the League°s Digest of pending legisla-
tion but there is one particular element that will be in the hopper that I
think is of interest to us and that would be an amendment to the Elections
Code which would provide that a person who has not filed the required cam-
paign statement when he was a candidate in a previous election shall not
be allowed to file nomination papers until such a statement is filed.
This makes a lot more sense and is certainly a lot more enforceable than
the law presently is.
Councilman Nichols. I think that is a good modification.

• Mayor Snyder. We made a motion authorizing the
City Attorney to draft an ordin-
ance, He sent a memo back stating that under Section 6236 and Sec-
tion 6237 persons who wish to conduct this type of business must
first apply for a license directly to the Council and must have its
approval before establishing a practice. Do we want to judge each
one of these on their merits or do we want to have an ordinance?
I personally think this would be satisfactory.

dues to the Upper San Gabriel Water Association in the amount of

Mayor Snyder: Regarding this Mayors' meeting
Thursday night, Mr, Nichols is
going. They are going to bring up the question of splitting cities,
the. suggestion of their own district, I was wondering if perhaps Mr,
Nichols and Mr, Aiassa shouldn't contact the League of California
Cities and see if they have any recommendations on this,

TELEPHONE DIALING AREA
Mayor Snyder: We had a letter from Mr.
Cameron regarding the problem
of the telephone dialing area and I have answered him stating we will
be glad to state it to him if he calls us,
Councilman Heath: I was on that today, The
City staff determined that was
not the hearing concerning our problem and reconfirmed the statement
when they do have our hearing they will give us notice,
I feel that some of the members
of the Council are not fully acquainted with this telephone company
• proposal and I believe that the Council should be made aware of what
this proposal consists of, It does permit the people in the Galaxie
Tract to call the City of West Covina without a toll charge but the
area does not include all of West Covina, It cuts off the other side
of the Broadway so anything this side of the City cannot call down
to the Pickering Tract, It cuts off City Hall, I think it is very
important that the City speak up on this matter before the Public
Utilities and I think it behooves us to authorize the City Attorney
to represent us at the public hearing when the public hearing comes
up to point out these facts to see if we can't eliminate this splitting
of the City,

Motion by Councilman Heath, seconded by Councilman Jett, and carried,
to instruct the City Attorney to prepare himself by furnishing himself
with any information and expert personnel that he will need and that
the City staff be instructed to prepare any information necessary for
the presentation of our case before the Public Utilities Commission
concerning the General Telephone Company proposal whereby our City
is not divided in the boundaries such as proposed by the General
Telephone Company,
COUNCIL COMMITTEE REPORTS
ART CENTER
Councilman Heath: I have been contacted by Carl
Smith of the Carl Smith Camera
Store who states he has had a proposal from a Mr. Pravitz in the City,
The proposal consists of an offer to the City for a means of .instituting
an art center in the City, It is in the very preliminary stage but
Mr. Pravitz would like to know whether or not to proceed further on
these general terms, If he came up with a plan for an art center with
construction drawings estimated costs and firm committments from
organizations for the financing would the City contribute the necessary
land to achieve this project? These terms are really general. What he
is trying to determine is this: If the Council feels they don°t want
an art center even though he is guraranteeing the financing or the
City will give the necessary ground he will then not pursue it because
it takes considerable time and study to complete this, On the other
hand, if the City would indicate and not give a firm commitment, but
would indicate that under conditions similar to these we would give
it serious thought he would continue on with his program,
Mayor Snyder-, Why don't you have him submit
a letter along that line. It
sounds good but I would like to know more about it,
Councilman Heath-, All right, I will get him to
write a letter to this effect,
City Manager, Mr, Aiassa-, It should be referred to the
Park and Recreation Department,
SISTER CITY
Councilman Jett-, On the Sister City program, as
I understand it the Mayor of
Toluca and possibly a party will be visiting our City pretty soon and
I am not too familiar with what all is being planned for him but I
would think our Mayor would probably have to entertain this dignitary
to some extent. Should we approve an appropriation or something like
that?
Mayor Snyder-, They will have their agenda,
They can tell you what they
are going to do, I think they arrive on a Saturday and they are going
to have a Council reception for them by invitation only Saturday night

where possibly about 150 people will be invited and from there they
will go to Stark's for dinner.and the next day we will go to church
and they will have a music festival at South Hills High School,
Monday I think the Lions will entertain them and they will tour the
City and the schools, et cetera, This is the end of the Easter
vacation,
WATER
Councilman Krieger. As you know we afforded to the
Metropolitan and Upper San
Gabriel group a copy of our resolution, The Upper people have asked
to meet with me and discuss the mechanics of this procedure, I don't
want the responsibility unless I have the authority to act in this
field, I am not asking for a blank check from the Council but I would
like the authority to meet with these people and arrive at what
immediate decisions must be made in the field and to bring back to
the Council such decisions as may await your pleasure. I am sure
because of the time committments involved there are going to be
decisions I will have to make on the spot or in the course of meetings
and I don't want to have to come hat in hand and ask for a special
meeting of the Council in order to take action,
I discussed with Mr. Jensen
the subject of our contract and I believe we can negotiate with the
Metropolitan Water District not only the assignment of the contract
and the assumption of the contract but a reimbursement to the City of
everything that we have invested in the contract plus interest,
Mayor Snyder: You really can't commit the
Council anyway without coming
back, We have adopted the policy of going along with you so I think
we all agree we will let you speak for us,
DEMANDS
Motion by Councilman Krieger, seconded by Councilman Jett, to approve
demands totalling $223,734,13 as listed on demand sheets B1.86, payroll,
and C435 through C437, This total includes fund transfers of $172,819,31,
