MINUTES OF THE REGULAR MEETING CF THE CITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
August 24, 1964
The regular meeting -of the City Council was called to order by Mayor
Pro Tem Nichols at 7,35 P.M. in the West Covina City Hall, Councilman
Krieger led the Pledge of Allegiance. The invocation was given by
Councilman Heath.

receive bids, By phone we will communicate with all bidders who have

Councilman Heath- I don't see the advantage of
informal bids except to save
time and I don't think time is that important, I feel formal bids,
sealed bids, are much fairer and''can be criticized less than if we
have informal bids, It is quite possible to be accused of all kinds
of finagling on an informal bid where one person knows what the other
is bidding,
Mayor Pro Tem Nichols- I concur with the • philosophy that is behind your thesis but
if you followed that to its conclusion then every purchase by the
City down to a couple of pencils then should be let by bid rather
than informal bid so there must be at some point a cut-off, It ,
seems to me that $29500,00 is a fairly substantial sum of money yet
there are other ways you might seek formal bids for the expenditure
of funds,
Councilman Heath- I see the point,
Councilman Jett- I, too, feel a formal bid
would be correct procedure;
however, in smaller amounts, it is somewhat of a practice in business
that you ask for a quote on materials or a job and after receiving
the quote you can say "I can get a better deal; I can get a better
bid", et cetera, Is this practical or is this a practice in this
case?

formality and pretension a certain amount of competitiveness which
we will achieve in the informal bid,

Orangewood & Del Norte Parks Picnic Pavilions
This memo rescinds our report of August 7, 1964.
One bid was received and subsequently opened by the City Clerk
in the Council Chambers on August 6, 1964, at 10-00 A.M. The
bid was reviewed by the Engineering Department, and determined
to be a valid bid.
This project was advertised in "Daily Construction", "South-
west Builders and ContractorsT4 and the Green Sheet, Nine
building contractors were contacted by telephone in order to
inform them of the project. This is the second time the pro-
ject has been submitted for bid. Only one bid was received
each time.
RECOMMENDATION -
Since only one bid was received on this project, it is our
recommendation that all bids be rejected and that the City
Engineer be authorized to call for bids at a later date. We
have reason to believe that a more favorable response will
be attained from bidders on this project if the work can be
done during the winter months during a slack time in the
construction field. We will attempt to relax some of the
restrictions in timing of the construction, which we believe
will encourage more bidders on the project."

Councilman Heath- I think the staff should review
this design to make sure this
is what we want, These are very expensive and I doubt if you will get
a much better bid in the winter, Even if you do, it is still a lot
of money to pay for the pavilion,
Councilman Krieger- This matter was discussed at
the last Council meeting, It
was my feelingat that time that the bid should be rejected
outright and I still have that feeling,
Move that the one bid
received on Project C,O, 6303 be rejected,
Councilman Jett -
This was approved two years ago
and I thought we could expect
it to be done,
Mayor Pro Tem Nichols: My understanding was at the
time you approved it before
and the Council expressed that sentiment that an amount of
approximately $14,000 was set aside and it was felt it would be ample
to build at least two such units and the bid came in at $10,000
for just one unit and it was felt that it was an unfavorable time,
it was an unique structure and the combination of those factors
resulted for the bid being excessive, The rejection of this bid
here would not, in my mind, negate our desire to move ahead with
trying to achieve the same end, The issue as to whether we will or
will not will have to stand on its own merits at a later time,
Action on Councilman Krieger's motion,- Seconded by Councilman Heath,

after that you can readvertise,
If you wish to do the work by day labor and buy the materials on the
open market, you must reject by a roll call vote carried by a
four -fifths vote of the Council,

particular matter,

President submitted a proposal to the
Shawn Construction Company Council to build the two
pavilions for around $11,500,
• It was rejected because there was only one bid, We feel at this time
that we could still build the two pavilions for approximately
$15,000 as they are now designed-, We would like to submit a
negotiated price at the next Council meeting based on our present
drawing and specifications, .
City Manager, Mr, Aiassa- The reason he was rejected was
the City Attorney at that time
directed the staff and the'Council that we would have to go for
formal bids and this is why we went to an architect and had drawings,
plans and specifications,

Mayor Pro Tem Nichols: My reaction is that this is an
area of high density; it is
already zoned Rm3 and CG1 and the request is to increase the residential
use and remove the commercial use in that location, The off-street
parking matter was of concern to me and I believe it has been
resolved somewhat in my mind at this time,
Councilman Krieger-, Mr, Green, I was present at the
Planning Commission meeting
•and I have heard your presentation tonight and we have R-3 there now,
What are the economic factors that cause you to come before the Council
and ask for an increase in the density at this particular time?
Mr, Paul Green-, To go in with the amount of
units for the usage in there
and for the service usage in there, we are asking 37 units under
the Rm4 as it is now, To make it feasible with this type of land,
where this land is located, we have.to gain these amounts of units,
Councilman Krieger-, Our R-3 in the City permits up
to 25 and our Rm4 goes to 45,
This is approximately three and a half acres so we are talking about
a difference in density in a R-3 of approximately 57 and in R®4
it can go up to 135,
Mr, Paul Green: We are building 120 units there,
Our precise plan has been
held over because we submitted the precise plan and it went to your
various departments and questions came up, Your Engineering
Department wanted us to relocate 250 feet of curb to widen Sunset,
In order to do this, we had to go to a consulting engineer to get
plans to rework this and submit our precise plans, There were other
things that other departments wanted on this precise plan and at the
meeting of the Planning Commission we told the Planning Commissioners
this: That if we could have more time we could work out every
request that the Planning Commission wanted us to do and so far I think
the biggest share of this has to be done. We have retained National
Engineering to work over the street in the widening of it and this is
why the precise plan was held over, to comply with the requests of
the City,
Councilman Krieger: Would the applicant have any
objection to the Council holding
over the zoning until such time the Planning Commission has passed
on your precise plan?

Council for a zone change and I heard no evidence presented to the
Planning Commission except conclusions and conjecture and I have heard
no evidence presented to the Council except conclusions and conjecture
as to why the density of this land should be increased,, I was suggesting
perhaps there might be something provided during the course of later
hearings even before the Planning Commission that might suggest
justification,,

How long has this R-3 been
on this piece of property?
Before I came to West Covina,,
Before I came on the Council
and that is seven years,,
Councilman Jett-. At the time the RG3 was put on
that piece of property you could
build up to 60 units per acre,, Actually it has been because of the
actions of this Council that this has been reduced from 60 to 25 in
the R-3,, In my opinions 45 units for this particular area is.not too
high a density,, The C-1 presently on there I think is the wrong
zoning for that piece of propt�rty because of the accessibility,,
Apparently the general thinking of everything in the area is that this
is probably a good use for this property or there would have been
more objection,,
Mayor Pro Tem Nichols-. I do not feel that I have the
right to impose personal
subjective feelings on this type of development,, We have a R-4
zoning ordinance and in certain sections of our City Rm4 developments
are allowed,, The theory of zoning is the closer to the City center
you come, the higher the amount of density would be allowed,, If
this particular parcel gets any closer it is going to be hit by a
truck,, I know oB no existing parcel in West Covina at the present
time that would be more justified and suitable for the maximum
density that we allow,,

This is in the Planning
Commission resolution, not
the notice. I don't think that would
have any legal. significance,
Mr, William Martino I am proposing a zone change
and a use change on the
northwest corner of Badillo and Irwindale in your City, In my
opinion this is in the best interests of the City of West Covina,
I wish to point out, anticipating some opposition, I wish to challenge
that any opposition given will be based on the opposite approachi
they will not offer any argument in the best interest of West Covina;
they will offer only selfish, personal, individual arguments,

Council and explained same,) I contend that when completed that
Badillo will be the main east -west street, It is the only area that
will run clear through from the Temple City area through San Dimas
when completed, The proposed zone change and use is also on a main
north -south intersection, running from Foothill -to Valley and the
only one that does this for several miles in each direction to my
knowledge. I have been apprised there are future vague projected
plans for the improvement of Azusa and Grand, Anybody who built a
residence along Irwindale hardly expected to be picking a remote

commercial, R-3, gas stations, and a great variety of other uses,
They are sheltered by a wide road and a service road,

This is to illustrate specifically by schematic plan only the.
heterogenous development of the entire west side of Irwindale,
You have everything there but manufacturing, I suggest there is no
master plan for the west side of Irwindale, It is developed along the
designs of a principal highway, Immediately to the west of the vacant
lot concerned is a church, That particular church is buffered by
100 feet of vacant area between its building and the property line,
There are a dcoan churehas in that area that don't enjoy half that space
between them and a gasoline station, The residential area cross the
way, they bought on a main highway; they certainly cannot expect to
live in a farm area, They bought along side existing gas stations,
apartment houses, shopping centers, and they have the advantage
over most of them in having a service road buffer in addition to the
100®foot highway between them, There is no residential area to be
protected, As far as I can see there is no use to be protected at
all.
I refer you to Exhibit C,
I believe by way of background what actually happened here is
that you should not consider this is a spot zoning request, I say
to you you have spot zoning now, This has worked out to be a reverse
spot zoning situation, Economically this is unfeasible for high
density, If you try to have a C®1 use there, the parking requirements
will put you down so it is not feasible from an economic standpoint,
I refer you to Exhibit D,
I don't think Union Oil would move out here unless they were sure,
You see that the use made of the corner is predominantly gas stations
and it couldn't be coincidental; that is the economic feasibility
of the situation, This is true throughout your City, You have need for
a gas station on this particular corner,
I refer you to Exhibit E,.
Going north on Irwindale we can't say we don't have enough gas
stations, There is one on an average of every half mile. However,
from Orange to Third Avenue in Covina along Badillo as it is projected,
nearly four miles go and you don't have one gas station so you can't
say we are arguing about glutting the market with gas stations along
Badillo,
I refer you to Exhibit F°,
Although this is not a complete survey with respect to -churches, I
believe it is quite complete, These seem to have been built and go
together like ham and eggs as far as I can find out, There is no
detrimental use, The .exhibit speaks for itslef, Repeatedly we find
. rest homes and hospitals with several gas stations around them, We
find churches with gas stations around them, This City recently
granted a new convalescent home use right next to an existing gas
station, I am surprised at the convalescent home here involved.
I think it is only fair to state in your assessing their motivation
for this, they have tried to acquire this corner, They want to
stick the side of their convalescent home on the corner, I don't
believe their objection constitutes two-thirds of the partnership
there, This is a three -couple ownership, I can't see why they want

the landscaping, Union Oil has planned walls and landscaping
which will hit the only window on the convalescent homea Their setback
on the property line as respects the convalescent home is 40 feet,,
On the other side they have a 40®foot setback from the church line
but that is bolstered by an additional 100 feet of the setback of the
church,, They bought there seeing the commercial and the R-4 and the
gasoline prospects and existing development,, They knew exactly what
they were doing,, I don't think their short-sighted, selfish,
misguided interests should block what is clearly the proper use and
the proper zoning for this particular corner of the two, main highway
intersections of West Covina,, .If you don°t want and need another
gas station in the City of West Covina you don't want any more cars
or any more traffic or any more commercial in this City,,
I respectfully and sincerely
suggest to you that this is the most appropriate and most needed use
you can possibly make on this corner and it is entirely in the best
interests of West Covina,,

ambulatory patients,, This is a very beautiful convalescent hospital
and I believe it is the only one in West Covina,, We do object to
the gas station because of the noise and because we think it will
be unattractive,,

4414 Irwindale Avenue gas station,, I think there
_ are other possibilities for
that corner,, I don't think it is in the best interests for the City
of West Covina what is in the best interests of Judge Martin and
John Bauchanan,, When I bought the property across the street
at that time I would never anticipate we would need another gas
station because we are surrounded by them. I don't think the gas
station would be compatable with the hospital,,

stations now, We don't feel it would be any advantage to us to have
a service station on that corner, I think it would be a detriment
to the hospital right there,

planning, It is about the worse corner in West Covina to put a
service station, His arguments from a City planning point of view

locality, there is a rest home next door, You know service stations
make noise, I think this is a very bad application,

Mr, William Martino With respect to the convalescent
home, again they did not meet
the anticipated objection, Where are the other two-thirds of the
partnership? I don't think she speaks for theme I have been told she
doesn't, The majority are not here in opposition, Where is the church
next door? They haven't come in to.object, Where have the arguments
been met? I don't think the residential people, although I don't
question their sincerity, I don't believe they are going to be hurt
in the slightest, I think their claim of detriment is a bugaboo, I
think the claim of the convalescent home is a bugaboo and I think it
is their desire to have that corner, at least the one-third partnership
that is speaking, What specific claims have they made about the
distancing and intervals of gas stations along Badillo? I acknowledge
we are somewhat full along Irwindale, I do say for virtually four
miles along Badillo you don't have one gas station, They haven't
met the argument that this is a completely heterogenous use, I don't
believe the opposition has offered anythin-g but misguided, self-
interest arguments, I.don°t think they have offered one point in
favor of the General Plan of West Covina, and this is planning, not
hindsight, You are planning ahead, You are planning with Badillo,
There being no further public testimony, the hearing was .closed,
Councilman Jett- I remember when there was a
request to zone this piece
of property about two years ago at the time the convalescent home
was approved, At that time there was a proposal to annex quite
a strip along there to the City of West Covina provided the .City
would go along with a type of zoning that would benefit the
proponents, At that time there was a proposed service station in this
very site. At that time they were asking for the convalescent hospital,.
Both annexations to the City were contingent upon these uses being
granted. At that time the proponents of'the convalescent home were
very happy to'go along with the idea of obtaining the zoning for the
service station apparently because they were anxious to get the use
they were seeking, At that time, and I still feel that the proper
location for this type of use, a service station, belongs where the
greatest need is and the greatest need for a service station certainly
is on those heavily travelled arteries, I think this service station
is a proper use for that corner,
Councilman Krieger- I note the Planning Department
at the time this was presented
to them felt that it was spot zoning, I find some credence to that
belief; however, it has been my opinion that the burden is upon the
applicant when he appears before the Planning Commission or the City
Council to prove to the Planning Commission or the City Council that
his application is justified on the weight of the evidence he brings
•before either the Planning Commission or the City Council, There is
a certain amount of persuasion in Judge Martin's presentation that
I will not detract from in the slightest and I will discount that,
There is a certain amount of sympathy that is engendered by the
neighboring owners coming before us to present their point of that
and I will discount that, I tend to think that our responsibility
is to the City as a whole, I must confess, Councilman Jett, that
I probably do belong to the school of thought in this City that we do
have a surplus of gas stations; however, I am going to discount that,
too, because I don't believe that is a relevant consideration for

determination of a particular parcel of property, I am left with the
consideration of the evidence on the northwest corner of Sunset, or
Irwindale, and Badillo, The proponents in justification for this
application have submitted to us that this is the east -west proposed
thoroughfare,' I don't believe we have heard evidence to refute that
contention, We do have the fact and evidence before us that right-.
now that property is R®4, Therefore, in weighing this application,
I must necessarily weigh the desirability of a development on that
corner for, R®4 purposes as against what the applicant proposes to
do with that corner, I cannot conceive nor would I accept to the' -
extent of my ability a R®4 development on that corner, Therefore,
I am faced with the decision as to whether or not this is a more
desirable type of development for this particular corner than what we
now have on that corner, In weighing that evidence I must necessarily
take into consideration the elements that the applicant has brought
to our attention in the form of his exhibits and oral presentation as
against these arguments in favor no matter how sympathetic they may
be or how individualistic they may be supported in terms of the issue
before us they bespeak only the sentiments of the individual
contiguous or non-contiguous property owner and I can't justifiably
base a decision on those grounds and those grounds alone,
The evidence that has been
presented to this Council tonight and the evidence heard before the
Planning Commission suggests to me that this is a better use for the
property than we now have projected for the property, I can°t help
but feel that if we had a precise plan presented to the Planning
Commission for the development of that property as Rm4 that the
opponents here tonight would appear in opposition to that precise
plan and I believewith much greater justification and much greater
detriment to their interests as they now exist and as presented by
this application, However, that is not a basis for our decision,

what you termed the.uneconomic basis for the development of this

record, that this lot 150 by 1409 21,000 square feet has a land cost
of $73,000 or $3,50 a square foot, It would be in my mind a matter
of truth that the only justification for an applicant claiming
economic hardship for development would be if his investment in that
property were in that amount or somewhere in an amount approximating
that, I wonder if you would care. to comment on that,

permit, a variance, or any particular use of property as opposed to
its current provided use., is partly based on need; that is, is this
use needed in a given.area, There is a great deal of.comment and
conversation tonight about Badillo Street and Sunset Street, That is
not the fact.today, Badillo Street does not even come through,
There has been no evidence given here -tonight as to when this use
will be created, as to when Badillo will come through, This is all
conjecture on the part of anyone here tonight. Therefore, the use which
has only been justified in the concept that Badillo will be coming
through, even the applicant has stated that he did not attempt to
justify it on Sunset Avenue, so we are being asked to grant a
change and a use based upon a demand that does not presently exist
and I would like the Council to consider this and keep it in mind,
I personally do not have any doubt in my mind that that corner
sooner or later is going to develop in some fashion in that line,
It is too valuable,. I don't think there is any remote question
about it, My question is whether now is the appropriate time for that
development to be permitted by the City of West Covina, That would be
the only comment I would make at this time,

we place this under the jurisdiction of the City and they are taxpayers
and receive the same benefits as other citizens of our City.

relating to this is obscure,
I don't think it has been determined whether the map is presented at
the meeting when you first see it or whether it is presented when
it is filed with the City or when the Planning Commission acts on it,
Since this is in an annexation I don't think there is any difficulty,
• If you receive the report only when you meet and I think it is a
reasonable contention, then you have received it now, You must act'
on it within ten days or at your next regular meeting after receipt,
Some cities if they are not certain that the receipt by the City
Council is the time that the Council meets'and sees it but when
anything is presented to the City Clerk it is received by the Council
as the clerk of the Council, If this were the view upheld by court
you would have to.act at this time,

and reporting on tentative
maps and speed in this article may be extended by mutual consent of
the subdivider and governing body,, If no action is taken within
these time limits the tentative map as filed shall be deemed to be
approved, I think in this instance there is no particular danger
because it is contingent.upon an annexation so the subdivider in
practical effect has to approve it but in some instances I would be
a little leery about this,

Mrs, Jeffrey Hewlett I feel that in the progress of
315 North Hollow this City it has become old
West Covina enough that now the areas that
were the first developments
are beginning to become just a little shabby, The type of running
down which particularly concerns me, I can't force people to water
their lawns and paint their homes, No one can do that, However, I
do not think it is part of our right to make an unsightly nuisance
of trailers and boats parked on the lawn perhaps to the extent of
five and six vehicles being stored in the front yard of a premises,
Then we have two and three cars and a young man with a hotrod and the
streets become cluttered, There are times on Hollow Avenue that if
there was a fire at the Del Norte Schools you would have a hard time
getting up Hollow, I feel if ordinances were passed, I understand
there is something in the zoning code which prohibits cluttering front
yards upon specific complaint, I feel if we had an ordinance with
a little more teeth in it, something could be done, I am getting
at an excess of this type of vehicle being stored without regard to
aesthetic value, I thought'my solution to this problem was to move
from this neighborhood, I went to a real estate many had my property
evaluated and proceeded to look at other properties in the City of

West Covina,, I found one on Barbara,, We saw a bus with surf boards
on top of it and it is there a lot of the time,, Perhaps if we had
an off -the -street parking ordinance and something in the nature of
storage of these unsightly vehicles from front yards, I think it
might eliminate some of this,, It would protect the careful from the
careless,,

working on this problem now,,
Councilman Jett. This has been something we --
have studied for some time,,
This has been before the Council and the Planning Commission before
.and we are very much concerned about it,, What can' you do because
you find a home that has a garage that is built in connection with
the house and it is just 25 feet from the garage out to the street,
somebody has two cars and their garage is full of other things
and they can only get one car in or maybe they have one car and a
boat,, They are unable to get this boat in the back yard,, What
are you going to do about it? We have given consideration to this
but I sure don't know the answer,,
Mayor Pro Tem Nichols. The Planning Commission is
looking at this,, I know the
exaggerated conditions of which Mrs,, Hewlett is speaking, the
modified junk yards that exist. I think we are even going beyond
a camper or a boat being in a driveway; we are talking about in
some places boats that won't float and campers that won't camp that
have been in driveways and have been there indefinitely,, I think in
some sections of our City we are tending to get debris situations,,
STREET' SIGNS
Mr,, Joseph M,, Bloom I was on the way to the store
229 South Myrtlewood Street and I saw broken glass in this
West Covina intersection,, It is an
intersection of two streets
but there are no street signs,, It is off of Hollyoak in an intersection
which would run into Stuart Avenue, There is a name on Azusa on
the southerly curb is a street sign saying "Hollyoak Driven' and that
is the only sign until you go all the way around the curve to
Homerest. There are a number of occasions where I have seen broken
glass there and the reason may be that there are no signs there, I
ask that you look into the possibility of putting street signs there,

City Clerk, Mr, Flotten: We are having quite a time with
these temporary use permits,
This is an application by the Eastland Businessmen's Association,
(Read application,) This is from September 8 to September 129 from
two to eight, and Saturdays from eleven to five, Eastland Businessmen's
Association has gone overboard on the number of days they have used
this year if you count all the different displays they have had, We
directed the Planning Commission to inaugurate a study on this
situation. They are right in the midst of this study at this
particular time,
Mr, James Charter.- We set our promotional calendar
up in January, This is just
part of it, We have more events to come before Christmas and we have
a Christmas promotion, The ordinance was enacted in 1960. In 1961
and 1962 and 1963 we have been carrying out our promotional projects
the same as we have until this time,
�Cvuncilman Heath.- If this privilege was extended
to Scoa just recently I donut see
Why we cannat extend it to these people and in the meantime I think
it would behoove us to get this study underway by the Planning

Planning Director, Mr, Joseph.- It is -coming up at the next
meeting of the Commission,
Mayor Pro Tem Nichols.- When the Scoa matter came
before the Council I voted
no, It certainly wasn't because I don't want our local businesses
to be competitive but it seems to me we have a law on the books, an
ordinance on the books,.and that it is appearing increasingly
defective in its functional application in the community in 1964
and that our answer is not one of constantly leaving a law there
and accepting it every time someone comes before us but'in
urging upon ourselves a decision on this matter, I would certainly
second the points that have been made so far about getting this matter
definitely settled, I have one question. It was stated that insurance
is carried at fifty, one hundred thousand dollars for the train ride,
Do you have the knowledge of whether that insurance is per each
accident or per each individual that might be involved in any accident
being carried by this train?
Mr, James Charter.- I am not sure, This is a
standard procedure for Tinker -
town. We have our own insurance, howevers if there are any problems,

He is still complying and
meeting the time as far as the ordinance is concerned,
Councilman Jett: I was under the impression
that they had all had an
opportunity to appear before the Personnel Board when we passed
this salary schedule,
City Manager, Mr, Aiassa: The main question is the actual
job classification description,
their duties, and their responsibilities,
Councilman Krieger: There is a report sent out tc
the Council the meeting of
the subject service people on July 24, 1964 and under Item No, 6,
Salary Survey, the following comment appears, Mr, Joseph stated
the Planning Department personnel at all levels is very dissatisfied
in the way the salary survey has been conducted, He felt such a
minimal amount of time was spent with the personnel in his
Department that it was not worthwhile, He said the attitude toward
personnel in his department had disrupted the morale of the
department, Other of the department heads present concurred and
felt that the result to the survey as presented to the Council and
the City Manager might not be valid representations,

Planning Director, Mr, Joseph: There was a problem and that is
the reason it was brought up
in the meeting, I cannot say that the problem has been resolved,
I do think that the idea of Mr. Gold°s coming back was a good one,
Mr, Gold will be here again on Wednesday, I had the opportunity to
chat with him last Friday about certain specific points that the
staff raised, I advised the people in my department who wanted to
talk to Mr, Gold to take their time and go see him and discuss this,
Whether or not anything will come of their discussions is something
I cant comment on, I think the fact that explanations to them
may be worthwhile, If Mr, Gold can explain to the staff how he
arrived at some of the decisions, perhaps this will satisfy them,
Councilman Krieger: The representatives of the
Employees' Association who
appeared before the Council, do they not speak for the Employees'
Association?
City Manager, Mr, Aiassa.- These people are not attending
Employees' Association meetings
when these matters are being reviewed and discussed, Some of these
people complaining had the opportunity to be..present at those meetings,

Subject> Classification and Pay Survey
The presentation of draft class specifications to employees
and department heads, and the holding of individual review
conferences with anyone who has a question, is requiring
more time than originally anticipated - partly because of
vacation schedules and partly because we are not cutting any
meetings short. In fact we are holding two or three with the
same group if it appears to be desirable to answer all ques-
tions.
We will therefore have the Final Report in your hands for
distribution to the City Council not later than September
109 1964, for consideration at your next City Council
meeting on September 14tho
Would you please call this matter to the attention of the
Mayor and Councilmen, so that they will understand exactly
what we are doing. The important point is that this proce-
dure will eliminate most gripes or protests when the Report
is received. All employees and department heads will have
• a chance to be heard in an informal atmosphere, and no "sur-
prise -type" questions raised at the Council meeting. Our
Final Report can then be full and complete for the Council°s
action - even pointing out any lingering areas of lack of
agreement.
•
SPECIAL NOTE
The City Council should take one specific action tonight,
to insert the existing class of Administrative Analyst,
presently at Range #24, recommended by our Second Report
at Range #25-a ($631-767)o This was inadvertently omitted
from the Resolution passed on August 10, 1964.
Please note also that a typographical error on Equipment
Operator, showed the wrong present range, but the correct
recommended range. While this has no practical effect on
the pay of these incumbents made effective August 1, 1964
by the City Council, the record should be correct. The
present range for Equipment Operator, as shown on page 13,
should read "Range #18 - ($568)0"

The report was made to the Council and I think it should have been
made at the lower level so the staff could have seen it prior to
what he had recommended and proposed directly to City,Council.
Councilman Krieger: I believe some of the employees
then have been caught in their
own petard in this whole situation.
City Manager, Mr, Aiassa: The employees agreed that the
employees would be working
with the Association. These people do not attend meetings like they
are supposed to. This was prevalent when -the complaints began to
float up.
Councilman Krieger: I trust these people representing
the Association, elected
officers, are representing each and every element of the employees'
group and not that particular department from which they come even
though it may be the major employment department in the City.
Mayor Pro Tem Nichols: In the public schools we
run into the same type of
problem. We have a board of trustees, an administration, and an
employees' association. This is not a body constituted itself in
employee -employer relationship and when the Council takes action,
and when the City Manager follows through on Council policy when
a survey is contracted, any participation that comes as a result of
the Employees' Association is a voluntary type of participations
thereis nothing mandatory about it and no employee need be required
to attend Employees' Association meetings in order to obtain a
knowledge sufficient to meet reasonable demands as an employee of
the City. We always hope that employees will participate in their
professional or semi-professional organizations and thereby be kept
informed. I don't think we rightfully from a standpoint of what is
correct can say "you didn't attend an employee meeting and you didn't
get any information and therefore you are negligent." I think we
should follow the City administration and institute some kind of a
double -catch procedure.
Councilman Krieger: How much of this responsibility
is vested to the Council and
how much is their responsibility as individuals as well as employees
of the City to exercise certain initiative and responsibility on
their part?
kayor Pro Tem Nichols: The line.of communication if
it goes through the Council to
management and then to the employee only by way of the Employees'
Association, that employee has, in fact, had no legal notice or
rightful notice of an action of his employer and therefore I.think
are splitting hairs.
Councilman Krieger: I am beginning to think that
some of the Councilmen who
brought up the question of the time schedule at the beginning of
this whole thing were very wise.

you would have had other,
consultant firms that could have done equal or just as good jobs
but they all fought a time factor. This is thereason Gold said
they would be willing to do it within the time element,
Councilman Krieger -. I think part of the incentive
to make a commitment to that
time factor was the intensive encouragement of the Employees'
Association and we are right back where we started from,
City Manager, Mr, Aiassa; I think in the future if you
are going to make a surveys

REPRESENTATION AT STATE WATER
CONTRACTORS' MEETING IN RIVERSIDE
City Manager, Mr, Aiassa: We had a representative but he
has not been able to finish
his report so we will have it for you in a few days,
Councilman Heath: I would like to call to the
attention of the Council an
article in the paper a few days ago concerning the dropping of the
wells in the entire valley. The fact that the other cities are having
to buy water from Metropolitan to start to replenish the basin and.
West Covina is sitting here all alone or tentatively hooking up with
the four cities who I can't see how they can get water in before 1975,
With this water table dropping the way it is and the four cities doing
absolutely nothing to bring water in I think we are on a dead horse.
These four cities, including West Covina if we go with them, are
going to have to condemn property and contract and install a water
line of about 96-inch diameter, from here to Cedar Springs, which is
the other side of Cajon Pass, The water will be there in eight years,
. If we go at the speed we are going now the water will be there and
gone before we even start to condemn property, I don't think our
water line will be available to accept water in 1972, I think we
should be back with Metropolitan,
Councilman Jett: I think you can read reports
like this, at least one a
week. I still haven't had any information brought to my
attention that would alter my original opinion or recommendation to
this Council one bit, If somebody can prove to my satisfaction that
I am wrong I would be more than happy to change but I just can't see
it, I have been to too many meetings and heard too much information,

AZUSA AVENUE EXTENSION REPORT

a few of the people up in that
area, I have talked to Mr, Templin and Mr, Bonellies office and it
is urgent that we start this, Mr, Oschin will be a stumbling block
because it is the biggest portion of the property involved, What do
you want to do on this? I need somebody to represent the City to meet
with the Oschins to see what we can do on this, If we have to condemn
right-of-way we had better know it now,

giving us some statistics to work with, Neptune and Thomas will
be here on August 31st, The time will be eight o'clock,,

on this additional acre feet
of water, I checked San Gabriel `21leY Municipal Water District and
Mr, Valentine and also Leeds, Hill and Jewett and Mr, Montgomery and
they are suggesting that we add this at the end of our contract so
none will be due and payable until the end of the contract, This
would be the time you would need it and would not be burdened with
any expense but would have the firm commitment that the water would
be guaranteed to us, I will work with the City Attorney and we can
do it in the legal form and it will tie in with our..permanent
contract, This is what I will do,

Wash is being designed by the Los Angeles County Road
Department, Preliminary bridge plans have been received and
approved by our Engineering Department, The County has indi-
cated that plans and specifications will be completed by
mid -Sept, 1964,
11Street design for the
extension of Valinda Avenue between Glendora Avenue and
Vincent Avenue is being done by our -Engineering Department,
Plans are approximately 95% complete and will be finished by
mid -September 1964,

plans have been completed for the intersection of Valinda

Fund was submitted for consideration in the 1964-65 City Budget,
The estimated cost of this work was $22000, Although this
item was not included in the budget as adopted, it is our
recommendation that we should proceed with this work as an
integral part of the overall improvement and -that the City
Council and City Manager again reconsider the funding of this
installation when plans and specifications are submitted
for approval,.

this project'could be advertised, bids received, and an award
made by the City Council late in October 1964,

There has been an exchange
of property on Azusa Avenue,,
The Azusa Bridge was delayed twice,, The Corps of Engineers was
able to execute the wall of the new channel and missed our wall
so they won't replace the bridge we have now and Suburban has an
exclusive on a well that is within 35 feet of the new bridge,,
The property has been sold but the people who bought it did not get
the well. We have to do some negotiating on this particular location,,
We either have to buy the well,and sand it in or build a hydraulic
understructure so the well can operate from below the surface of
the street,, I would like permission for a detailed study as to the
various feasibilities that we could go to insure the possibility of
acquiring that right-of-way so we can develop the final bridge
design for that area,,

took it ono We have naw processed to notify all persons involved
with this particular type of problem.
Councilman Heath- After this report came out I
had it set up at the Public
Utilities Commission in Los Angeles and the telephone company and
I would get together and take it to the pertinent bodies to get
their opinion and if.we couldn't come to a conclusion then we would
take it to the Public Utilities Committee at the legislative level.
City Manager, Mr. Aiassa- Dr. Snyder did call a meeting
of the representatives of the
home owners and they were completely against it. He mentioned you
suggested this to them that after the fall out with the people down
there what's the use of going that route,, I think the telephone
company should break those arbitrary lines.
Councilman Heath-- Should I carry on with this
or will the Mayor do it?
Mayor Pro Tem Nichols- I can't say. If any develop-
ments occur in the interim
you should act for us and when he returns resolve whatever approach you
should make from that time. ,.

they are not suitable for confinement of minors under the age of

them is their interest. __I am concerned about the trends that are
evident toward suggestions for levying of additional taxes without
