Hearing no objections., we will waive further reading of the body of the resolution. - Motion by Councilman Krieger., seconded by Councilman Jett, that said resolution be adopted; Motion passed on roll call as follows; Ayes; Councilmen Jett, Krieger, Mayor Pro Tem Nichols Noes; None Absent; Councilman Heath, Mayor Snyder Said resolution was given No, 2979, PROJECT NO, S,P,6306 LOCATION; Cameron Avenue between APPROVE PLANS AND SPECIFICATIONS California and Glendora, STREET IMPROVEMENTS APPROVED Approve plans and specifications, Authorize City Engineer to call for bids subject to approval by Division of Highways, Staff recommends approval, Councilman Jett; This is something I think we should take a look at because there was a question in my mind about the alignment of Cameron, I was the one who brought a problem at the intersection to the attention of the,Council, the southeast corner, I came up with the proposal that if the Council would entertain paving a portion of Glendora that I felt I'could get the owner of the property to dedicate 20 feet of his property and pay for the curb and gutter, The Council went along with this. As part of our discussion with the owner, Mr, Barker, we discussed the possibility of realigning Cameron in order to make a right-angle intersection there, I donat think the final is quite as exaggerated as indicated on the map. As a result of this, the Council agreed that we would realign this in this manner; that that little portion there would be abandoned and go back to the original property owner and that he would dedicate this 20 feet for the full length of his property, He did dedicate, gave us a check for $652,00 and our -2- C, C, 7/27/64 PROJECT NO,, S,,P,,6306 Continued Page Three •Public Works Department did a nice job of coordinating,, I am a little concerned about the final alignment,, It doesn't seem to go along with what I thought it would be,, It has been pointed out it is not as bad as I thought it would be,, Public Services Director, Mr,, Adams: This will be signalized and we have provided a small island for the signal,, Councilman Jett: Quite conceivably as this develops there could be considerable foot traffic in there,, If there is a free right-hand turn how are you going to get those people across there? Public Services Director, Mr,, Adams: We can have the signal which would show a right -turn arrow, City Manager, Mr,, Aiassa: We would post the property that the free right turn movement would be allowable only if there are no pedestrians in the crosswalk,, If it doesn't work, they will have to come to a full stop,, Councilman Krieger: We are talking about alignment right now, not signalization,, •I think the alignment is more gradual than the proposed Merced alignment,, It seems to me to be a good alignment,, (A diagram was presented and Mr,, Adams explained same,,,) Councilman Jett: This diagram I think is much better,, The other map had me concerned,, Motion by Councilman Krieger, seconded by Councilman Jett, and carried, to approve the plans and specifications for Project No,, S,,P,,6306 and authorize the City Engineer to call for bids subject to the approval by the State Division of Highways,, FUTURE SIDEWALK PROGRAM FOR LOCATION: In accordance with CITY OF WEST COVINA Master Plan of Sidewalks Engineer's report - review map m estimate of cost for 1964-65 budget program - estimate of cost to complete sidewalks on Master Plan, City Clerk, Mr,, Flotten: We have a memo directed to the City Manager and the Council from Mr. Pontow re this matter,, You have copies of that report There is no action required on this matter,, City Manager, Mr,, Aiassa: We would like to have the Council approve this priority project so we can immediately start with the plans,, -3- C. RUE C. C. 7/27/64 FUTURE. SIDEWALK PROGRAM - Continued City Manager & City Council Page Four -A July 24,1964 FROM: R. E. Pontow, City Engineer SUBJECT: Proposed Sidewalk Construction Program for Fiscal Year 1964-65 The 1964-65 City Budget has provided $40,000 in the Capital Outlay Fund for continuation of a proposed three-year sidewalk construction program. Attached is a map showing,'in red, proposed locations for sidewalk construction that the staff recommends for consideration in this second year of the three-year program. Work has recently been completed on an approximately $40,000 sidewalk construction program which was funded by Capital Out- lay in Fiscal Year 1963-6.4. Priority was given to installing. walks along one side of high -volume traffic streets which are used by children walking to and from schools; This program was well received by the citizens and numerous inquires have been received with respect to continuation of the program. The locations shown on the enclosed map have been identified as those which meet the criteria we used in developing the first year program, i.e., walks would alleviate potential traffic hazards to children who use these streets in walking to and•from schools, parks, and other public places. Repre- • sentat'ives from 'the school districts have again participated in developing this program and their assistance is appreciated. The estimated cost for construction of sidewalks shown on the attached map is $38,000. The staff has also estimated the cost to construct sidewalks on both sides of all major, secondary and heavily travelled collector streets where walks do not now exist. Such a program is the type that would possibly be considered in a bond funded.Capital Improvement Program. The estimated.cost of this work is $412,000. This estimate includes walks along those undeveloped properties where we may obtain sidewalk by subdivisions and precise plan requirements. The figure would be considerably reduced if such properties develop prior to initiation of such a program or if we choose to delete these areas from those proposed to be City funded. A more detailed map showing existing sidewalks, -those proposed for 1964-65, and the areas where walks would be required to provide such facilities on all major, secondary and heavily travelled collector streets will be presented for Council re- view at the meeting of July 27,1964. The bid is only $28.20 higher than Graybar Electric. Mayor Snyder: This is the time and place for the public hearing, Mr, Michael Murphy I am all for street lights, The 636 East Herring Avenue only thing I question is in the West Covina circular that was notice of hearing the street lights mentioned were 25,000, 10,000 209000 lumen, I question why the 79000 and 119000 lumen mercury vapor weren't included, In the 11,000 lumen mercury vapor as opposed to 109000, you get 10% more light for $3,54 less per year, I think we should use the newer type of street lights that are available, The Edison Company installes them and it wouldn't cost any more to the taxpayers, City Manager, Mr, Aiassa: The mercury vapor has a rather strong effect in the residential areas and I would rather have an incandescent light burning in my front yard, At major intersections we use the mercury vapor, Mayor Snyder: Mr, Murphy, if you would contact the City Manager some time in the future and discuss this with him perhaps they can tell you why we use incandescent instead of mercury vapor, That is not a part of this hearing, Councilman Nichols: I am sure the City Manager will be happy to discus-_ this with you, If you have any areas that will save us money a year per installation we will be happy to hear about it, Mr, Munch At the present time I have 1611 East Puente Avenue no objection to the lights, West Covina My interest is one of information, I haven't been able to find where these so-called things will be located, Back in 1953 when I moved to the home. I am in we were one of six houses at which time there were electric poles at the front end of the property servicing both the electric and the telephone needs of the residents in the area, In 1957 the City came along ,and asked us to agree to taking off the electric and telephone lines in order that they may install telephone poles at the back of the property with the understanding that the telephone poles at the front end would be removed, We all agreed, Although the electric lines feeding my house came from the poles about 50 feet, by moving the poles to the back of the property I have a span of wire 175 feet with the result that during the summer •time those wires stretch and 'hang over the roof of the garage, I found that they didn't intend to move the poles at the front and street lights were erected on those poles, These new poles you are speaking of, where will they be located on Puente Avenue? City Manager, Mr, Aiassa: You can call Mr. Adams and he will tell you where these poles will be located, There being no further public testimony, the hearing was closed, • 0 C, C, 7/27/64 STREET LIGHTING ASSESSMENT DISTRICT 64-66 - Continued Councilman Krieger: owners are involved in this district? Mr, Rosetti: Councilman Krieger. - Page Ten Do we have any figures as to approximately how many residential Approximately 12,000 in this district,, ' We only received three letters of protest in 12,000? Mr, Rosetti; Yes, Councilman Nichols: I think when a governmental body establishes a district of any kind and has it inherently so large that sometimes we frighten away people who might want to register protests and perhaps it might behoove us to restrict the size of new assessment districts to a level where those participating in them feel more a part of that district individually as well as collectively, Mayor Snyder.* City Manager, Mr,, Aiassa.* sac streets were rather short and bright, Wasn't a postcard questionnaire sent out to all the people in the district? Yes, I think the basic item was they felt some of the cul-de- too many lights would make it too Mayor Snyder: The majority opinion of engineers, law enforcement officers, city administrators nationwide is that city street lights are beneficial and something to be desired, Councilman Jett: In reference to the remark made about the savings of some three dollars, was this in reference to one unit per year? Mr, Michael Murphy.* Yes, sir, Councilman Jett: If this amounts to a substantial savings to the City I think it behooves us to give it serious consideration, I think we should have a report from the staff unless you are in a position to tell us more about it, Mr, Rosetti: We don't have a count of the particular lights he is talking about, We have studies made, The Lighting Engineer of the City confers with Edison Electric and they set up a program and study the area and come up with what they feel is proper lighting for the area, • You can't put mercury vapor lights in a residential area, City Manager, Mr, Aiassa: We are analyzing mercury vapor versus incandescent, There is a lumen unit cost that is cheaper with mercury vapor and there is less maintenance upkeep,, If you are going to use these they have to be spotted carefully, -10- Co C. 7/27/64 Page Eleven STREET LIGHTING ASSESSMENT,DISTRICT 64-66 Continued • Councilman Nichols- We are just establishing a district this evening,; Will the City Council have an opportunity to review the proposals for specific installation at a later date? City Manager, Mr, Aiassa- Councilman Nichols: Mayor Snyder- Councilman Nichols- hereby establish Street Lighting City Attorney, Mr, Williams- this will approve the whole plan City Manager, Mr, Aiassa- That's right, I think we could establish the district tonight. The staff could furnish us a report, Move that the protests that have been received be overruled and Assessment District No, 64-66, This approval is more than establishing the district; as submitted, It states "lumens" not whether they are incandescent or mercury vapor? 0 Mr, Rosetti--' That's right, City Attorney, Mr, Williams- This does more than create the district; it approves the degree of light, the location and so forth of the standards throughout the district, Councilman Nichols- Relative to the issue raised here this evening, the possi- bility of substitution of one type of light for another, my understanding is that it is rat ruled out by the creation of this district, is this correct? City Manager, Mr, Aiassa: I think so, City Attorney, Mr, Williams- If the plans indicate which it is and it is approved, I don't know whether or not the plans indicate this, City Manager, Mr, Aiassa- Councilman Krieger- 0 Mayor Snyder: only used on main thoroughfares, Perhaps we should hold this over to the first meeting in August and we can check all this out, I would prefer to proceed at this time. We own about 196,1 feet, How is he going to be assessed for this sewer? There being no further public testimony, the hearing was closed, Mr, Rosettio When I made my statement of $7,75 I said "assessable front foot", That automatically takes in an adjustment that wherever the property is not completely available to the sewer adjustments are made and we allow credit for an area, If a man has a right-of-way for 20'feet and then he has an acre in the back which is serviceable, he is not going to pay just 20 feet because his frontage is 20 feet, Only where your lot, block and tract and the property is in a rectangular shape; about 50% of this is acreage, large parcels and some of these have washes running through them and low spots which is going to present quite a problem to the property owner, Once we establish a sewer district and make a charge in this area, we have to serve every piece of property and this is the only charge we make, Mayor Snyder: The assessment will be made on a front -foot factor and acreage basis and will be determined on the usable lot, not what fronts on the street, What fall is the City required to give them? • Mr, Rosettio That is a peculiar problem because this is the only sewer that will be available to this area, We will not develop another sewer, Sometimes the fall may be 10 feet, If there is any possi- bility of using it we give them a nominal charge because there is some availability, Public Services Director, Mr, Adams: There is some 12 feet of fall between their floor finish elevation and the sewer so there is more than adequate fall, I know of no area in this particular district where we have problems as far as having pumps and so forth, Mr, Rosettio I have worked out the problem with Mr, Erickson, He feels from the front line of his property to the developable rear he doesn't have the full length of 150 feet, Regarding Mr, Sherman's property, he has a triangle, He won°t receive 'the full frontage of all sides because he happens to be a triangle, He would be getting a comparable assessable front foot charge on that, Mayor Snyder-. There will be another hearing where if they don't feel they •get an equitable front footage they can come back and protest, They will be notified of the assessable front footage and the amount. Mr. Gold is here to report to the Council. -16- Ca Ca 7/27/64 PERSONNEL SURVEY m Continued Page Seventeen Mr, Robert Gold We have completed the second step Gold9 Thompson 6 Company on the salary survey and position 1810 Fairoaks reclassification plane The first South Pasadena step'was the presentation to you of criteria for cities and methods for collecting the pay data which after approved by the Council formed a basis for our collection of the data and the document which you have just had distributed to you now summarizes by present class title the recommended salary ranges and for ready reference the maximum or fifth step of each range and in addition shows you the present range and last step and some brief codings which show which positions were benchmarked classes9 which,are vacancies and which have certain reclassification matters pending on them, The number of reclassifications is not large in relation to the number of,employees that you have. However,, there are some reclassifications pending which might effect as many as 20 or 25 employees, Beginning on Page 8 is the meat of this information which is listed on the subsequent six pages under several groupings, The net effect of these recommendations if they were accepted as they are would cost approximately 4% of the total payroll of the City, The subsequent reclassifications might involve another lf2% to 1% so perhaps the total amount will be somewhere • between 4 % and 5%, The manner in which the survey was prepared follcars as nearly as humanly possible exactly the method we described in our criteria, There were 10 corresponding cities and we collected data for comparable classes in those cities, A high and a low range was calculated and certain of the cities in this group have not completely finalized all of their 1964-65 pay plans, These recommendations would be completely equitable in our opinion for the year 164-65, This can be made fully effective for this year by action on the resolution and if there is any question on procedure or technique we will certainly try 'to answer it. We are dealing with existing class titles and classifications and the asterisks in this reference code column of theieport refer to one or more positions in any given class which might come under a reclassification within the next few weeks as the survey finalizes, Mayor Snyder: a few that show a cut, This concerns this was made purely on a comperative •of the employees worth to us. I don't to make a decision, I notice that the majority of these show a raise. There are me because I am wondering if basis with other cities instead think it is quite all we need Mr, Robert Gold-. I don't believe it is, On the other hands there are certain limits of an employee's worth to you which is a management or Council prerogative because only you in the City would be able to make that sort of adjustment, We have a factor in our wage comparisons which we call a qualitative factor of the job, In police and fire, in the ®17® C, Ca 7/27/64 PERSONNEL SURVEY - Continued Page Eighteen •comparable cities which we used, your basic statistics were on area and population and with approximately the average of the 10 cities but in those two departments you have perhaps as much as 30% less personnel in uniform and other services of the police and fire departments which means you are performing.a service for the City with substantially lower number of positions and a -substantially smaller total salary outputs To us this indicated in fire you have a rather unique regularized daily patrol procedure for inspections which is unique in the service that a qualitative difference factor does exist. I think it would be stretching a point that at the firemen level this qualitative difference exists although it might exist in a measurable way by management,, We have taken into account these quality differences to the extent that we can m- Mayor Snyder; The ones I noted were supervisoral positions, Mr,, Robert Gold:. You have six classes in your C range,, This is police and fire,, Our survey does not suggest that you change your present merit pay plan for these C range administrative positions,, I think it has a great many merits about it,, This is only given to you as a guide to m anagement and Council policy as to where those positions are being paid including some of the quality differences we have been able to evaluate for the job but not including the individual performances • on the job which only your staff and people can do,, Mayor Snyder: On Page 9 for the Director of Finance you show a cut,, Mr, Robert Gold: This has an asterisk by it for possible reclassification,, This is the one that I think taxes a survey of ours most is because the Police Chief and Fire Chief are very standardized and the Director of Finance is not a standardized class. You have operating in your Finance Department better and newer innovations which are not yet part of some city operations. On the financial side of this things three of the cities didn't have anything which would be roughly comparable so they weren't included at all. Three or four of them had varying forms and did not include budget analysis which is something your Department does, Although I believe this is accurate from the standpoint of present arithmetic that the reclassification of the job will show it is a heavier job here than it is in other cities,, Mayor Snyder: Mr,,_Robert Gold: advisory,. we would be in favor to retain your C range setup as guidance to the Manager and the Mayor Snyder: If this survey is adopted9 would you not argue too strongly about changing that? City Attorney, Mr, Williams.- No, 3, effective July lst, is simply a statement that 1 and 2 would be effective as of July 1st, If you didn't adopt 1 and 2 there would be no change, Councilman Krieger.- Could this matter be subject to the final action of the Council effective as of July lst without the adoption of the resolution substantially in this form? In other words, is this the only way we can go about it? City Attorney, Mr, Williams.- The courts have determined that you cannot make salary changes retroactive beyond the current salary period you are in; otherwise if it is an increase it is a gift since the service performed has already been fully paid for. You cannot simply say you will make salary changes and tell how much they will be next August or September. If you pin it to a mathmatically ascertainable thing you could make them effective now but the amount could not be computed until a later event, You cannot say "We will grant a salary increase which will be whatever the salary report recommends01 because that would be doubly harmful, Councilman Nichols-. In the State of California the. public school districts in issuing their terms of employment to certificated employees are often .caught with this same problem, They are required to issue the firm contract of employment before they often know what their financial resources will be and in each of these contracts there is a statement of reservation that the Board of Trustees of the schools reserve the right to reissue you another contract and often times aftev the contract year is underway these contracts are reissued, Where is the difference legally in the position of the City of West Covina and in the position of the school district? ®20® Co Co 7/27/64 PERSONNEL SURVEY m Continued Page Twenty -One City Attorney, Mr, Williams: I don't know anything about the school districts. We don't issue a contract of employment, for one thing. That may be the difference,, The school districts are not subject, so far as I know, to Section 4 of Article 31 against the gift of public funds,, Since I don't know what applies to the school districts I can't answer, It has been determined that a retroactive increase in pay after the pay period has been completed and the pay has been out is a violation of that Constitutional provision:' Councilman Nichols: If I understand what you are saying is that in order for this Council to grant any salary adjustments to City employees effective July 1st we, in effect, must adopt the recommendations in this report here tonight,.subject to piecemeal revisions that we might undertake at some later time? City Attorney, Mr,, Williams: I am very doubtful about the legality of the piecemeal revisions, Mayor Snyder: Can we accept it tonight but direct that those underlined items will go under the old salary schedule until the study is completed? . • City Attorney, Mr, Williams: This table that is attached does put them under the existing salary stages, Councilman Nichols: I have been laboring under the illusion that we could, -by some mysterious act, achieve retroactivity,, In light of what has been said here I could not possibly vote for this resolution. This has nothing to do whatsoever with my attitude about the recommendations. It is simply that I have not had a chance to absorb them and the Personnel Board of the City of West Covina has not had the chance and if we pass a resolution which does, in effect, accept these subject to revision it seems to me we are going beyond that which we should go, Mayor Snyder: I think we are being pushed into something, City Manager, Mr, Aiassa: You are basically working on the benchmarks. There has been a definite.discrepancy or problem in the two positions of the Public Safety Department, If you look over this survey, and the Personnel Board has gone along with the consultant and the staff has been working with him, that some of these positions unless they are completely out of kilter are pretty well set and I don't think the Council will have many changes except in certain catagories where . you are particularly concerned about, Councilman Krieger: Either the Council has the prerogative in this situation or doesn't have it and if it is going to exercise the prerogative I say let's exercise it intelligently. I don't know what we are talking about here other than the fact that as I understand it if the resolution were adopted we are going into a system that we may or may not, upon .review, find acceptable and may or may not have to backtrack from, -21- C o C o 7/27/64 Page Twenty -Two PERSONNEL SURVEY - Continued Councilman Nichols, If we adopt this on a range basis, the employees of this' -City will be paid for a portion of this month and will be placed on steps in actor dance with this range. I am sure in my mind that'it is an excellent re • ort and -that I would havver few g putting"some- thing y points of disagreement but I am e ted to represent the Cityof West Covina and I cannot see me - thing into being that even in the mind of our City Attorney may not be legal. Mayor Snyder: Could we have a study meeting this week and an adjourned meeting Thurs- day night? [ �_l City Manager, Mr. Aiassa: The reason this resolution -is proposed is to give you 60 days to analyze this thing in thorough detail rather than rush it. The only thing this resolu= tion is doing is to provide the Council with the possibility of an addi- tional 60 days so that you can thoroughly digest this, Mayor Snyder: There is one other factor here. Prior to this year we considered salaries at the beginning of the year in January and it was just by majority action of the Council that we changed the salary consideration period to July which caught the staff shorthanded. I Councilman Krieger: I am a little upset with this proposed scheduling. If I remember correctly the City employees urged the execution of the contract with Gold and_Thomp- son so we would have this report back as soon as possible. I know we had discussion on the Council level as to whether or not it could -be properly prepared and submitted within that time schedule and some of us felt we would like to give the benefit of the doubt to the expert in the field and give it to the City employees and get the report to us as soon as possible. When discussing that motion for the adoption of the contract within these time limitations, I understood we were going to have it presented to us on a night with the suggestion we then go ahead even in tentative form with the resolution of adoption for even a limited period of time or be'faced with a situation that within the balance of the month to take action on it. I think it is unfortunate. Councilman Nichols-. me or anybody snowed me but I think the Council is placed in a situation ting this and any subsequent changes that framework and pulling them out to see it. I didn't want to infer that I was trying to say that the staff snowed the unfortunate result here is that where we in effect are really adop- are pinpointing individuals within of it. I just haven't had a chance Mr. Alassa: We discussed this and I think the Council was cognizant of that plan, that you were closing a very tight period. We did have a meeting last Monday and we had so many employees to cover. We had the report out. It is feasible to get this adopted by the end of July. I say also that we did make some changes in some basic plans in Personnel that has existed for three or four years, that Mayor Snyder pointed out. We take these things up in July if we don't get snowed in here with the budget and every- thing else, then try to complete the survey all on a time basis because during the time the salary survey was being made under the new arrangement is the time the department heads and the City Council was discussing the budget. Mayor Snyder: Would it be possible if we didn't act tonight to raise the average factor say, 4 1/8% to compensate for the loss of July? Now this is just a summary report of what those findings were. Are we being facetious on this last statement • 0 Mayor Snyder: In the main there is a variable"raise_,. throughout this and -there are some cuts and people getting cuts are going to ask for justification of those cuts. It is true we hired a consultant to bring us in a recommendation and the chances are we would change very few of these in the study. City Manager, Mr, Aiassa: That's why we are trying to give you some extra time, so you can hear these things out. Councilman Jett: I think in view of the remarks by -the City Attorney and the fact that we - have only received this tonight and as many people who will be effected by whatever is adopted, in all fairness to everybody, I don't think I -could vote on this without an opportunity to really study it and have the benefit of the review by the Personnel Board as well. Mayor Snyder: Does the Council feel this is urgent enough to have a joint meeting this week and an adjourned meeting this week to reach a decision before the 31st? This is the big problem, At one time the merchants agreed to assess themselves for whatever the cost to put in the landscaping was according to what the City wanted to do. These were informal and then we dropped them, It seems to me to understand each other and the City you have to have these sessions. Is there any way of accomplishing this within the law? City Attorney, Mr, Williams: You can get decisions that say almost anything on the subject of the Brown Act, The Brown Act says you may not meet in other than open and regular session, If you deliberate the courts have more or less decided "deliberation" means something more than just receiving information; it means discussing what you are going to do about something but if you discuss what you are going to do about it, it is a regular session, The Attorney General has said even receiving information is deliberating but the courts so far haven't said that, It is perfectly proper to have the sessions but I think they should be held in public, Mayor Snyder: I have no objection to the public being in the session but some place that is not as formal an atmosphere, I do think that sessions of this type where you are not in a formal atmosphere and you can give and take on some of these items would be beneficial, City Attorney, Mr, Williams: I think so, too, Councilman Jett: I thoroughly agree with this. On the other hand, I think legislative bodies have an obligation in those areas where they do exercise control to demonstrate that their leadership,is morally constructed and so I think one area where we do exercise control, where we are not imposing on anyone else's personal rights is in the area of City employment and I would just toss out that I don't think the City of West Covina would be hurting itself at all to go on record overtly in indicating to the community at large that its employment practices are on an abolutely nondiscriminatory basis. Councilman Jett-, You are not suggesting that we have been discriminating in the past' Councilman Nichols: No,, I just said that I do not feel we have been,, Mayor Snyder: I think your remarks are well put,, I am not too conversant with what the Fair Employment Act provides,, If the intent is to say we don't discriminate in hiring, I believe you're right, that many • people of minority races will fail to apply in areas just because they feel "what's the use?" and then I think such a statement might show our intentions,, This does.not in any way infer that we would not intend to hire on the basis of merit and ability,, Councilman Nichols-, We have already stated in resolution that it is the intent of this City Council that there be no discrimination based upon race, religion or natir,I. origin F;racticed in this community, All I am saying is that perhaps that mig�-it be one area where we do have public contact, communication to direct City employment, where we might go regularly on record with a simple statement at the close of each employment listing that ours is a fair employment practices community,, That doesn't recommend directly -to the Fair Employment Practices Law but simply :indicates that this is a non-discriminatory City in its own employment practices,, I think this is the kind of leadership we can offer without infringing in the private sector,, Councilman Jett: You are going to call attention 'fro the fact that there has been an area of discussion or discriminat4..o'n here and I 'think you have a division in the City right now of those who would take objection to anything like this, either for and there would be those against, I think you are just asking for trouble when you start something like • this,, We are not discriminating; we are not, in my opinion, attempting to attract into the City deliberately those elements that might be controversial and I don't understand why you would want to publicilze something like this,, Mayor Snyder; If there are people of minority groups who fail -to apply because of their attitude of "what's the use?", if a statement like this would stimulate their application, I am all for it,, You are not going to hire them just because they are minority race over anybody else, you a,e going to still hire on ability but you don't want them no-;: applying because they think they don't have a chance,, -44- C, C, 7/27/64 Page Forty -Five EMPLOYMENT NOTICES ® Continued Councilman Jett: They know that fair employment • practices is a law of the State, If they can qualify for these positions I can't understand why you want to make an extra effort to attract those people here. I don't get the reasoning, Councilman Krieger: My interest lies in perhaps a different phase and that is this: Is there some precedent to -which you can points, Councilman Nichols' in the governmental field where this is part of the literature of advertising? Councilman Nichols: Nos but I do know employers who in the private sector who do business with the Federal Government are required in their employment statements to state their compliance with the law, That law is not directly applicable to a public body as such, We are already on record$ of course, I have no desire to go out and seek any particular group of people of any particular nature whatsoever at the expense of others but I do believe and I think it is true, I can't demonstrate it here, but I think it is true that many minority group people will not apply in an area where they do not see others of their kind already employed because they have been so often rebuffed, All I say is it is an area where a City can exert moral leadership without infringing on the private sector, I think it is •an area where the City can exert moral leadership, Actually, it might be more appropriate to seek a survey to see how many appli- cations come from people who are representative of minority groups in relation to City employment, Maybe I am way off but I had this feeling and I wanted to express it here, If there is not a strong consensus of sympathy I certainly won't push it, Mayor Snyder: I would be for it after con- sideration, I would like to take it under consideration, Councilman Nichols: By all means, Councilman Jett: My first reaction is I would be opposed because I would feel that we are now making an effort to discriminate against the people living in the City by making a direct effort to bring in minority groups, Mayor Snyder: That is not the intent, Mr. Nichols is saying he wishes to convey we don't hire on the basis of discrimination; we hire on the basis of merit, Councilman Krieger: There are a lot of things we do and don't do in this City that isn't part of our soliciting literature and that is what concerns me, the necessity of picking out this one item and incorporating it within our literature, I think a city gives moral leadership in what it does rather than what it says it does, I am wondering if it might not have a ricochet point, Councilman Nichols: That is quite possible, Councilman Krieger: I would like to study it a little bit, -45- C, C. 7/27/64 Page Forty -Six DEMANDS • Motion by Councilman Gilman KrieRers seconded by Councilman Jett, to approve demands totalling $1379319,55 as listed on demand sheets B172 through, B174 and C397, This total includes fund transfers of $27g454,89, Motion passed on roll call as follows. - Ayes: Councilmen Jett, Krieger, Nichols, Mayor Snyder Noes.
