Mr, Flotteno (Read Planning Commission Resolution No, 1622,) Mayor Snyder- This is the time and place for the public hearing, IN FAVOR Mr, Al Rossi We are approximately 300 feet General Manager from Glendora Avenue and we have Hudgens Carpet no means of identification, In the last three months we have spent over $15t000 in advertising and people pass by us not knowing where we are, If ,we don't get this sign I think we will have to fold because we don't get the extreme help of our advertising because no identification is on the street, Von's has okayed us to go on their -sign, They are for us 100 . Mr, Gerald Arno2do Regarding this matter of Kunz Sign Company individual signs and shopping Baldwin Park center signs, I have one picture here I would like to show the Council regarding a sign in West Covina where two individual stores have placed a pole sign in front of the store calling attention to their individual stores ®- Zody's and Ralph's, Von's is a grocery store and not a shopping center, In the sign ordinance they"specify a shopping center must be denoted as a shopping center, Von's does not say this is a shopping center and Von°s Market Company in realizing this has offered Hudgens their pole so we could conform with the shopping center standards, There is space allowed for other stores in the center to go on the same pole and announce their presence in the West Covina Shopping Area, We feel every store investing in West Covina has the right to advertise on the street in West Covina to bring business into their stores, I will be happy to answer any questions you may have, There being no further public testimonyg the hearing was closed, Councilman Krieger- Does Hudgens lease their store • from Von's? Who is the lessor on those premises? Mr, Al Rossi° Frank Bowker9 deceased, Councilman Krieger- Are there separate leases entirely there? 0 I C, Ca 7/13/64 'VARIANCE NOo 509 Continued Page Seven Mr, Gerald Arnold- At one time there were two properties involved here and the properties have since been joined and held by one tenant, Mr, Al Rossi, There are two lessors, I believe the other shops are also separate lessors, Councilman Heath.- There is another owner in there, Councilman Krieger.- This is a constant problem apparently facing the Council and the Planning Commission, the subject of signs, Ordinarily I would prefer to relate our consideration to this only, to the specific sign before us but the gentleman in favor of this application brought in the fact of other signs in other locations in the City in apparently an attempt at precedent, I am concerned about precedent in this particular location. If the arguments are accepted as having merit, then what do we do next week when the next tenant comes in and the following week when the following tenant comes in? What I am concerned about most of all is the fact that if we open up this whole area of signs so each store in an area in which the applicant contends that the present identification is not sufficient for his purpose, it seems to me we open up each one of these areas for a contention that each tenant within that area dissatisfied with the primary, identification of the nature of the area can come before us and ask fir an individual sign, Under such circumstances, we will end up with too, many signs, On the Esk o sign, we had before us the fact that they did have two separate signs and that was knocked out, The consideration and the reversal of the City Council of the Planning Commission was based not upon the subsidiary sign, but based on another perpendicular sign that was believed to be an onerous condition, In this situation the main objection is the fact that Von°s itself doesn't connote anything but it was originally intended to, Councilman Heath.- I feel we have definite facts proving that the sign ordinance is entirely too restrictive, one being there were 41 variances on signs filed in the last year, I think the majority of them were granted, This would lead us to believe our sign ordinance is entirely too restrictive, We have just granted an additional sign to the. Sunfran Shopping Center in order to rejuvenate that center; made certain concessions to Esko to rejuvenate that area, Von°s Shopping Area is real sad, Maybe we need signs there to rejuvenate that area, I feel a sign of this type should be permitted because I think the sgn ordinance is too restrictive and I think you need rejuvenation in this area like you have done in other areas, Councilman Nichols.- I think everything said so far has merit, However, I would point out lest the City of West Covina be held completely as the big bad wolf in this situation, the store under discussion here this evening moved into the Vonws area, the building was built there, it was 300 feet from Glendora at the time it was constructed and if the 7 • I C C, C, 7/13/64 VARIANCE NO, 509 ® Continued Page Eight lessee of those premises did not know of West Covinaes sign ordinance it was not the fault of West Covina because the sign ordinance has been a matter of ,public record, Although problems do exist this particular business does not come into the City with closed eyes and it is a business enterprise, If we are restricting the normal use of a business, punishing it unduly by our sign ordinance, I would be the first to suggest we revise that but I would be loath to rush pellmell into the granting of variances upon each and every protest that reached the Council, My concern is with the total sign ordinance and I would hope that this purported inadequacy could be reviewed and brought to the attention of this Council with more specific recommendations very promptly, Mayor Snyder.- We were shown a picture of Ralph's-Zody°s, Is that sign by variance? Planning Directors Mr, Joseph.- Yes,o Mayor Snyder.- We have been using the argument. that the identifying sign for the shopping center is the sign taking precedences in effect, Is there anything in the sign ordinance that says a shopping center must select a name? How do you arrive at the conclusion that this is Von°s Shopping Center with many competing businesses here, Planning Director, Mr, Joseph. - Mayor Snyder, The ordinance does not specifically provide for shopping center identification signs, Was Von's granted this sign without Hudgens Carpet? Planning Director, Mr, Joseph.- They were granted the sign in 1959 and it is proposed to add the sign as shown by means of this variance, Mayor Snyder, It seems to me the ordinance is a little deficient in this matter and that it should be included in the sign ordinance that a shopping center has to select a name and this should take the priority, Councilman Krieger.- If this is the case I suggest we change our sign ordinance and not take these things item by item in the form of variances, Councilman Nichols- I concur, Councilman Krieger- The Sunfran did not have any signs, Councilman Heath - This is before your time, Councilman Krieger- I am talking about Sunfran that was recently before us, Esko originally as it was presented to the Planning Commission did involve just this type of proposal and that was turned down by the Planning Commission and subsequently by the City Council, The objection that the City Council had to the Planning Commission recommendation was their recommendation that one sign be taken down before another sign be put up, 0 • Co Co 7/13/64 VARIANCE NO, 509 - Continued Mayor Snyder-. correcting the ordinance and I ordinance now, I donet think variance here, I do think should be corrected in methods I would way to don't think we they have shown. that portion of naming shopping Page Nine agree with you that the correct this is by can be doing the sign sufficient cause for a the sign ordinance centers, Councilman Krieger-. Not too many meetings back we discussed the subject and criteria, qualifications and requirements for variances and took some time to establish the facts that these were the requirements for a Variance, There has been no showing here that they have been deprived of a substantial right enjoyed by other property owners, Unless each of the four elements can be established I suggest that they have not justified a variance, Councilman Heath° I believe here they are being penalized in the fact that they are requesting a variance,, I think they have met every requirement for a variance because I would use as a reference the Sunfran, the Alpha Beta in this area, the Capri Shopping Center,, Thesepeople are asking the same privilege we have given three shopping centers just mentioned by me,, Councilman Nichols. - Planning Director, Mr, Joseph-. This person has been working full would estimate that the report to available within 30 to 45 days, Councilman Heath-. What is the current status of the sign ordinance? We retained somebody in the Planning Department last week,, time on the sign ordinance and we the Planning Commission will be Do you want to until the sign accomplished? hold this over study has been Councilman Krieger-. I would like to pursue the subject of variance because a variance is necessary for the preservation and enjoyment of sub- stantial property rights possessed by other property in the same vicinity and zone but which is denied to the property in question, There certainly are at least eight or ten stores in that area and they do not have signs out on that street and here is an applicant before us who is asking what I consider a special privilege,, not grounds for a variance, Councilman Heath-. It should be compared with like • shopping centers in the vicinity,, Mayor Snyder-. If you were to grant this then one by one you would have to grant the same thing to every member of the shopping center if they were to come in, Councilman Nichols-. shopping center was Von's Market and time other stores have gone up until When Von's Market opened it was alone at that location, That nothing else,, Subsequent to that it is, in truth, a shopping center,, ''.'- C, C, 7/13/64 VARIANCE N0, 509 ® Continued Page Ten • I am very sympathetic to the problems these gentlemen expressed, I do not believe the answer is to begin allowing each store separately and individually to raise individual signs at the street on Glendora, I would oppose the testimony that one of these gentlemen gave when he said he thought any business should be allowed signs on the streets, The Von's sign there, in effect, is really a non -conforming use at the present time, I think it would be legitimate for that center as a shopping center to have a sign so identifying it and to have it comparable to other centers and if the merchants in that center would be working in concert and come in to this Council with a request for a shopping center sign, this Councilman would be much more receptive but I cannot and will not vote in favor of a variance that would allow this particular type of development and this particular type of precedent, Motion by Councilman Krieger, seconded by Councilman Nichols, and carried, that Variance No, 509 be denied on the ground that there has not been an adequate showing of necessity for the preservation and enjoyment of substantial property right possessed by other property in the same vicinity and to grant such a variance would constitute a special privilege, (Councilmen Jett and Heath voted "No"O Mayor Snyder- I think the Planning Commission should look at this particular. part of the sign ordinances the shopping center sign, Motion by Councilman Krieger, seconded by Councilman Nichols, and carried, that in their study of the sign ordinance the Planning Commission pay particular attention to shopping center signs, ZONE CHANGE NO, 312 Edward La Berge APPROVED and PRECISE PLAN NO, 413 Edward La Berge APPROVED Request for reclassification from Zone Rml to Zone,R-P approved by Planning Commission Resolution No, 1627, Request for approval of precise plan for office building approved by Planning 'Commission Resolution No, 1633 m appealed by applicant as to Item No, 1 of conditions, City Clerk, Mr, Flotten- There were 29 notices mailed to owners of property in the area and notice of.this public hearing appeared in the West Covina Tribune on July 2, 1964, (Read Planning Commission Resolution Nos, 1627 and 1633,) Mayor Snyder- This is the time and place for • the public hearing, IN FAVOR Mr, Edward La Berge I am not going to say anything 20510 Rancho San Jose Drive about the zoning; I think that speaks for itself, I am referring to Item 1, I do think it is a little incongruous to ask me to take out existing blacktop, I did have in mind that we would be shooting for R®P sometime in the future and we would use that for additional turn -around parking, This will not be used for parking, ®10® C, C, 7/13/64 Page Eleven ZONE CHANGE NOo 312 8 PRECISE PLAN N'O,, 413 Continued There will never be more than two cars there at one time. It is a circle drive, (Presented photographs to the Council and explained same,) I hope you will affirm the fact that the blacktop is in and that we should leave it in, We will take very good care of the east side of the property, Mr, Chet Shully In regard to Condition No, 1, 1821 Danes Drive as a neighbor two doors down West Covina from him, I have a lot of people driving into my driveway and going back to the business place, If he can take that pressure off' of me, I would be happy, Originally this was a residential area, It has become a noisy nuisance and it is no longer residential, I think something should be done about changing the zoning, I don't know a neighbor on our side of the street that isn't in favor of multiple zoning, Mrs, Gladys Gordon I am right next door to the 1815 Danes Drive property in question, The West Covina place looks better now than it ever has, There never has been a decent lawn there and. I can't see that lira Le Berge suggestions would do anything but improve the property, As long as there will be a wall between our house and the property next door, it seems to me this would be a step in the right direction, IN OPPOSITION Mr, Howard Gordon I think it would be a good idea 1815 Danes Drive to take out that blacktop, The West Covina rest of the homes there have lawns and I don't see why they canat park in the back, There being no further public testimony,.the hearing was closed, Motion by Councilman Nichols, seconded by Councilman Krieger, and carried, that Zone Change No, 312 be approved, Mayor Snyder. Planning Director, Mr, Joseph-, Is there any ordinance which saysan R®1 home cannot blacktop the whole front lawn? No, Councilman Krieger-, In considering this particular • question of Condition No, 1, which seems to be the onerous one according to the applicant, what is the recommendation of the Planning Department? Planning Director, Mr, Joseph-, That the blacktop be removed, Councilman Krieger-, In consideration during the hearing of this matter before the Planning Commission were any home owners heard in opposition? Planning Director, Mr, Joseph-, I don't recall, -11- • C, C, 7/13/64 Page Twelve ZONE CHANGE NO, 312 & PRECISE PLAN NO, 413 - Continued Mr, Edward La Berge-. There was one objection to the whole thing, This home owner resided further up on the other side of the street, Mayor Snyder-. You said no parking would be allowed in this area? Mr, Edward La Berge-. It would be a circle drive, My tenants would probably park there in the evening, Councilman Nichols-. I think there are several factors involved that in my mind might justify another look at this particular .matter, Actually, the driveway Mr, La Berge describes is more than a driveway at the. present time, The City's recommendation is to make it considerably less than a driveway, to completely remove the asphalt, Because of some conditions that do exist in R-P zone usages in West Covina, I. would personally be very loath to approve a plan to require the applicant to remove all of this blacktop, I find personally no fault with the rest of the precise plan but I am inclined to agree in this particular case with the applicant that 'the precise plan as it is stipulated at the present time would work an undue hardship on him. I would like to refer this, matter back to the Planning Commission for further study to see if.there might be someway to achieve the desirable R®1 appearance without a forced removal of the great mass of the asphalt and the utilization of that as a driveway, That would be my motion, Councilman Heath-. You mean send it back to the Planning Commission to have them design this to make it more of the appearance of residential? If this is the intent I think the only thing they could do is remove a part of the blacktop and I think it would be better to leave the blacktop in than to see a patch of devil grass there, If you put small patches of grass there you are not going to have enough grass to pay attention to, I think you will have crab grass there and I think it will look better with the blacktop left the way it is, Mayor Snyder-. Rml to do this, I do Nichols is suggesting help solve it without The man did this under R-1 and he was perfectly legal under feel it could be improved. I think all Mr, is that the Planning Commission may be able to removing all the blacktop, Mr, Edward La Berge-. I would like to have this taken care of tonight. Rather than have this submitted back to the Planning Commission I would rather have it denied, Councilman Nichols-. I will withdraw my motion, Councilman Heath: Rml is more restrictive zoning than R-P, commercial, or anything else we have, If this is permissible under R-19 why isn't it permissible in other zones? -12- • C,, C,, 7/13/64 Page Thirteen ZONE CHANGE NO,, 312 6 PRECISE PLAN NO,, 413 - Continued Mayor Snyder., I think the Planning Commission's intent here is these seas of asphalt we see,, My solution to this problem would be to approve the precise plan but regarding Item No,, 1 to suggest that some landscaping be required along the curb or between the curb and the blacktop to be worked out mutually between Mr,, La Berge and the Planning Department,, Councilman Heath., I will go along with that,, Motion by Councilman Heath,, seconded by Councilman Jett, that Precise Plan of Design No,, 413 be approved subject to the conditions recom- mended by the Planning Commission with the exclusion of Condition No,, 1; further that this be subject to an agreement between the Planning Department and the applicant whereby that area between the present blacktop and the curb be properly landscaped and sidewalks installed,, Councilman Krieger., As I understand the motion, we are changing the condition and, in effect, changing the precise plan,, Is this in true response to the appeal before the City Council? City Attorneys Mr,, Williams., I think so,, I think the appeal sets the issue at large entirely,, If I understand the motion the condition relates to property that is City property and I don't think it needs to be in part of the precise plan as to what will be done with City property,, I think perhaps the issue before you is not entirely whether this lawn is grass or blacktop and there is no ordinance that says which it shall be, but the location of parking can be designated on the precise plan and it isn't clear to me whether this precise plan designates this area for off- street parking or not and if it does not, it is within your power to permit the blacktop to remain and prohibit parking, if you wish.,, I am not making that suggestion; I am simply saying that I think the motion leaves the question of whether or not parking is to be permitted in this blacktop area unanswered,, Mayor Snyder., I would like to suggest that the landscaped area include five feet back of the City parkway,, It still leaves him plenty of driveway and additional provisions be added of no parking in that area,, Mr,, Edward La Berge., I already have it indicated for parking on my precise plan,, Councilman Heath., If you have a straight driveway or a curved driveway in residential, you are authorized to park in your driveway,, We have authorized this man to put in two curb breaks and now we are saying that he cannot park in his driveway,,, Councilman Jett., I think all that I intended to do by seconding the motion was to approve the precise plan subject to the recommendations of the Planning Commission with the exception of Condition No,, l,, Councilman Nichols- If a precise plan requires the property owner to develop and maintain City owned property, is this enforeceable? ®13® is • 9 C, C, 7/13/64 Page Fourteen ZONE CHANGE NO, 312 6 PRECISE PLAN NO, 413 Continued t 4 City Attorney' Mr, Williams- I think it would be a valid condition if you feel it has a relationship to the use and the development of the property, If it has some reasonable connections it may be imposed, Mayor Snyder - Can you work with the instructions as proposed in this motion? Planning Director' Mr, Joseph- We would like a little more direction from the Council as to what you mean by landscaping, We already have parkway trees, Councilman Heath- What I mean is if you will sit down with Mr, La Berge and specify some kind of plants to make this look a little more attractive, something agreeable between the two of you, City Attorney, Mr, Williams- Parking is prohibited in the required front yard of an -R-P zone, You are not providing a parking space there, If that were the only place you provided to park your car, it would violate the code, We do not enforce the stopping of an automobile in the area but we do prohibit your using this as a parking space, Therefore, the precise plan may not show parking spaces in this area and it does not. It says "parking area", Action on Councilman Heath's motion- Krieger voted "No",) FOUR SQUARE CHURCH REQUEST Motion carried, (Councilman Mayor Snyder- Mr, Jett has submitted a letter to the Council from Rev, Aston, If there is no objection from the rest of the Councils I believe we can take care of this at this time, (No objections voiced,) City Clerk, Mr, Flotten- (Read letter dated July 13, 1964 directed to the City Council requesting a rummage sale and bake sale once a month for the next three months in the building now occupied by the church, the first sale to be on July 22 and July 23, The letter was signed by Rev, John T, Aston and Rev, Eunice Aston,) City Attorney, Mr, Williams- I think this requires a permit but there would be no business license or fee because the ordinance exempts charitable and religious enterprises, There would not be a charge for the permit, Councilman Nichols- This is an indoor activity in a zone C-2. Why does it require permission? City Attorney, Mr, Williams. Planning Director, Mr, Joseph - On temporary activities, does this only apply out of doors? It does not seem fair because the developer does not wish to conform that this will nullify the original plan denying people the proper thoroughfare and landlocking us. I ask that these plans be returned to the Planning Commission for further study. There being no further public testimony, the hearing was closed. Mayor Snyder. We have a plan that divides this up into lots, Planning Director, Mr, Joseph. This is Block Study 41-D approved by the Planning Commission and the City Council a few years ago. This is merely a suggestion, The future street is this (indicating)g which could or could not be accepted by the City as they saw fit and the staff recommendation contemplates using a portion of.it, Councilman Heath. There was a precise plan presented in 1959 showing no street cut through there by Pacific Development Company, I can't see how we could force a developer to permit streets through the middle of his development in order to serve another piece of property, Mr, Walker has, been before us before and I have told the Council before that I believe Mr. Walker's property can be serviced off of Plateau Drive, I also feel that Mr, Walker's.property can be developed and is served right now through a present small roadway coming back to Citrus, I can't see how we can force this man to let traffic from other areas to go through his development. Mayor Snyder. Would you explain why it is necessary to come in for a condominium under a'variance? City Attorney$ Mr, Williams. I don't know that the variance really is necessary, Since the last condominium was approved here a State Law has been adopted and gone into effect, The State Law now provides that in case of a condominium which contains five or more units there must be a subdivision map filed but you need not show the units of the condominium on the map, Therefore, we have a subdivision map that simply shows the whole thing as one lot, This is necessary to comply with the State Law, The State Law also provides that in the case of a condominium it is permissible to record covenants among which would be a covenant designating an agent that has the power in the case the condominium structures are destroyed and abandoned or outlast their usefulness, the agent has the power to sell the entire property, This iS the thing that really bothered us with the last condominium, We required a condition that if any of these things occurred the Title Insurance and Trust Company would have the power to terminate all these individual ownerships without any access to streets, This is now provided in the Civil Code, We have imposed a condition of the Civil Code provision which is permissive, that it shall be complied with. If this is done you don't need a variance, Councilman Jett. Does this have ample access for the fire trucks, et cetera? Mrs, Denise Walker- We are in the end of a little deadend street, We have approximately three acres, We gain access to our property from Plateau Drive, We have a 50®foot frontage on Plateau and that is the only frontage that we have, We cannot reach our bottom property from our present frontage, Councilman Nichols - I thought you said this development would cause you to be landlocked, Mrs, Denise Walker- It will cause our bottom property to be landlocked, The only way we reach it now is to walk down to it from the top, Councilman Nichols- What you are suggesting to the Council is that this Council require the developer to put in a street which would provide access for your use to your property? Mrs, Denise Walker- Yes, At one time the Council did so stipulate when we granted the right to come in for sewers, Councilman Heath- Can't you go through a small lane off,of Citrus to get to your bottom land? Mrs, Denise Walker- There is a bridle path there from wide, If we should ask for zoning Citrus about ten or twelve feet for apartments according to this R-3 you wouldn°.t want people coming into apartments down there using the bridle path which is'what we are referring to, To extend Plateau would force the removal of our garage and cut down both lots to an extent that it would be impossible, It would go over quite.a steep bluff to do it,. -17- Ca Ca 7/13/64 Page Eighteen VARIANCE NO, 510 & PRECISE PLAN NOa 412 ® Continued • Planning Director, Mr,, Joseph- There is a ste P ep bluff there and it was not contemplated by this block study to extend Plateau Drive but to gain other means when the other property is ready to develop,, It would be difficult to extend Plateau Driven Councilman Nichols-. As much as I am sympathetic to this problem I cannot in my own mind justify requiring one developer to put in a street where the ' obvious intent would be to serve another developer whose land is yet to be developed though in truth it may be a hardship. I do not feel this Council should be placed in a position of placing a hardship and an economic loss on one builder to serve the interests of an adjacent land owner at least on the basis of what has been presented here tonight, Councilman Krieger-. Mr, Williams, could you en- lighten me as to the position of the City Council on a subject.matter such as this where we have a precise plan where the sole basis of the appeal is by an opponent requesting a street dedication? I can't see sacrificing some body's piece of land, landloc king it knowingly, just because somebody else who has a piece of property they have been playing around with for four or five years and doing nothing with it, and don't think enough of to speak about it tonight. If they are not that concerned about it, they are certainly not very sure whether they are going to use it or not, Does the Council have any responsibility to a property owner like this to see that they don't get landlocked? City Attorneys Mra Williams-. I don't think it is basically the Council's responsibility, I think it would be an unfairness for a person to be able to buy property which has no access to a street at a reduced price and compel the City to takeaway the property at a higher price to afford access to it, I am not speaking of Mr, and Mrs, Walker, I am speaking in generalities, If the reason the street went through the other property was to serve that property it would not be improper but to require a.street to go through here for the purpose only of unland- locking property that somebody purchased knowing it was landlocked, I think that would be an improper exercise of the police power, Councilman Jett: We have required this piece of property to give us permission or an easement across.their property for serving this plan,, What is the difference? As I interpret this statement it would mean anybody presenting a precise plan when they have firm zoning, this precise plan would be, approved at staff level. Mayor Snyder. Approved or turned down. Councilman Heath, I think if this Council and members of the previous Council look back over the past years I think you will find there has been plenty of controversy at the Council level concerning precise planning. It has been changed over what the Planning Commission has recommended; the Planning Commission has changed over what the staff has recom- mended, and this in itself denotes that the Planning Commission's thinking is entirely different from the staff's thinking and further that the Council's thinking is different from.both of those. Does this mean we are supposed to delegate this work to the staff and then sit back and live with whatever they do or don't pass? Mayor Snyder-, In 1961 I voted for this but I was in the minority; at least I argued for it. There has been much discussion about the wisdom of precise plans anyway. If the ordinance is correctly drawn and the staff has a good framework to work with in precise planst they still have the right of appeal if the applicant does not like what the staff grants him. Most of the controversy on precise plans occur where there is an appeal, which is where the Planning Commission or the staff has worked within the framework of the ordinance and the applicant obviously didn't feel that the ordinance was correct. Councilman Krieger. If the Council will remember, we had a joint meeting with the. Planning Commission. Out of that meeting came a recommendation which was adopted by both the Planning Commission and the City Council that a delegate from each body be appointed to meet with the City Manager and the City Attorney in an attempt to streamline the procedures of both of these groups to weed out these matters that burden our agenda unnecessarily with matters of form rather than matters of substance. I was appointed by the Mayor to serve on this committee and Commissioner Fast was appointed by the Chairman of the Planning Commission to serve on this committee and at the first meeting, which was June 30, at which time not only the City Manager and the City Attorney but also Mr. Adams, Mr. Flotten and Mr. Joseph were present, we took some preliminary steps toward doing just this. One of the items has to do with the resurrection of this recommendation on Amendment 52. This$ to me, is a fairly involved question but the Planning Commission took it up at its hearing of July lst inasmuch as there were three new men on the Planning Commission from the time of the original recommendation. The Planning Commissioners in reviewing Amendment 52 have passed it on with their continued recommendation to this Council. This is just one of many items that this committee intends to bring up to the Council in terms of streamlining our ®21® C, Ca T/13/64 Page Twenty -Two AMENDMENT NO, 52 ®.Continued procedures, I think it would benefit the Council individually as well as collectively if this recommendation particularly with respect .to Amendment 52 were received by the Council at this time.and the matter be tabled for study by the individual Councilmen -so they could become acquainted with this until our next regular meeting at which time I think it would be opportune to discuss in substance and detail this Amendment 52, It is my opinion after that study that it is a very worthwhile mechanism to streamlining with the Planning Commission and the Council agenda with due emphasis to the Mayor's comment that this does not abrogate the rights of appeal or call-up on these matters,o I would suggest that this be received and tabled to.the next meeting for individual study. Councilman Heath. I expect to be out of town for four to six weeks and I wouldn't be able,to get in on it. Councilman Jett. I think this is important enough for.the benefit of the new members of the Council. I happen to be very strenuously opposed to the precise plan,. I am convinced it is an unconstitutional ordinance and if it was ever tried in court I am.convinced we .will be whipped to death on it. I don't believe in five men having the power to sit down and determine how'a man will build a building, et cetera. You have taken away every right the property owner has by the precise plan and I am absolutely 100% against it and I would like to. -see it killed completely. As far as delegating some of this authority to the staff, I am very much in approval with this, I think, this is something that is long overdue. However, on the precise plan, you could never convince me that this is a good thing because I have seen things happen on the precise plan where members of the Planning Commission have looked at a rendering and asked if that is,100%.of what they would see if they stood"across the street and looked at it, There never will be an artist who can paint a, picture of a building and then build the building and have it look exactly the same, Therefore, I am completely opposed to the precise plan concept, Motion by Councilman Krieger, seconded by Councilman Heath, and carried, -:that the matter of Amendment,No. 52 be received and tabled until the.first regular Council meeting in September, 1964, (Councilman Nichols voted "No"(,) Councilman Heath. I would suggest that each individual Council member • talk to Mr, Williams and ask him about how we stand legally on this precise plan and realize if we delegate this to the staff we are delegating to the staff something that might be dynamite, RECREATION 6-PARKS None ®22® . • f Ca Co 7/13/64 GENERAL MATTERS ORAL COMMUNICATIONS Mrsa.Mary Van Dame, Mayor Snyder: Page Twenty -Three Is there something you can do about the districts of the Assessor's office? I think it would be in order to have a directive to the staff to begin an immediate study of bringing our fees and charges more in line with surrounding cities and more in line with reality although they have suggested doing that. This is an operation where all rolling equipment is catagorized into one operation fund and everything is charged in and everything is charged out, It is set up on a fee charge and that equipment is charged against that particular project. The purpose of this is that you immediately set up a capital cost of every piece of equipments how long it.will be used, and base your charge on that. The thinking was a substitution of a year of college work in lieu of one of the years of clerical experience would enable the City to recruit potentially very competent people who had some college training and provide a higher caliber of employee in the long run. This would be the alloca tion for that portion of acre feet which -is not otherwise been subscribed for, We -must have arrived at the 109000 acre feet based on some determination, City Managers Mr, Aiassa. Right now if we go to high rise or condominium it will be impossible to compute acre-feet of water that will be consumed, Mayor Snyder. My recollection was it was more on the conservative side, I think we would be safe in contracting for this extra water, Councilman Heath. We are contracting to buy water by the amount of money we are putting up each month although we are not getting the water; it is the dues or fund we have to pay at the present time to enable us to get water when it comes in 172, In essences we are buying water now and we have no water coming. We are using people's money to buy this water, Suppose we don't get a water company in 1972; the water comes into this area; we are still buying water and possibly have no one to sell it to, Do we have aright to take the people's money and buy something which we don't know that we can use and pay for something that they are getting no benefit from? City Attorney, Mr, Williams. The City has a right to engage in the water business in either or both of the following ways. As a wholesaler of water the City has a right such as San Francisco to go to the High Sierras and bring it to the City or the City of Los Angeles to the Owens Valley, It need not necessarily after having brought the water down be the retailer of the water, This City is not presently in a position to be a retailer, A city can be a retailer and not a wholesaler or it can be both, The reason we are participating in the capital expense is to get the water, Councilman Jett. We are getting ready to buy water, This was why Metropolitan was going to charge us millions of dollars as our share of the construction of the aqueduct, This would have been in arrears, What we are doing now is just paying for our share of building that transmission line down here but we are paying it as we go along, Councilman Heath. In order for us to be a wholesaler or a retailer you must have customers and there is a good chance we can end up without them and without customers we are then spending people's money for some value they will not receive, 0 City Attorney, Mr, Williams. There is a good chance we might run into difficulty before we even get the water to see if we have customers because the State will deliver it to us at Devil's Canyon, Before we can bring it here to look for a customer you have to build an aqueduct with money we don't have, Councilman Nichols. Such services would be performed' -by' the principals and staff of these two'firms under the'direction of•a senior officer of each, normally Harvey Oo Banks. Vice President of Leeds, Hill and Jewett, Inc. and James Mo Moan-.. gomery, Chairman of James Ma Montgomery, Consulting Engineers, Inc. Myron Bo Holburt, Supervising Engineer of Leeds, Hill -and Jewett, Inc. would be designated Engineer -Manager with responsi- bility for carrying out the required studies. The principals and staff of both firms have had many years of experience in the municipal water supply field, particularly with respect 'to appraisals and evaluations of water systems, condemnation actions, feasibility studies, water rights, ground water development, and water treatment and distribution. Both are intimately familiar with the water problems of the San Gabriel Valley, the sources of supplemental water available, and the par- ticular problems facing the City of West Covina in attempting to provide an adequate water supply to its citizens at reasonable rates. Determination of the feasibility of municipal ownership of a water system to serve the City will be unusually complex because seven'sepArate operating entities now distribute water within the City and some'serve contiguous areas outside the City. It is anticipated that it will be time-consuming to obtain the nec- essary information as to the physical features of the present systems, their history, costs, revenues and exvenseso These systems are owned by mutual water companies, public utilities and one public district, Several of these systems were originally designed with agricultural service as the primary objective and have been in existence for many years. The feasibility study, in addition, must encompass the development of basic plans and cost estimates of the means of integrating these separate systems into a single operating network, and'of the additi®ns and betterments required to bring the resulting system to acceptable municipal water works standards. Scope of the Work It is proposed that the studies and report include the items listed below, but that the amount of detail be limited to that necessary for a finding as to the feasibility of municipal owner- ship. It is not contemplated that the studies would be in suf- ficient detail for purposes of any legal action. Q1 An inventory of the assets of all the water service organizations now supplying water within the City limits of West Covina. (5) Analyses of the adequacy 'of the present` systems and'the'physical and functional depreciation of these systems. (6) Evaluation of the costs of acquisition. (7) Determinationofthe costs of paralleling portions of the systems in the event this is found to be in the best interests of the City. A re- port (25 copies) embodying the significant findings will be submitted upon completion of the work. Compensation Due -to the complexity of the problem and the uncertainty of the extent of the necessary work, it is not possible to make an accurate estimate of the cost of the necessary studies. It is therefore proposed that our charges to the City be at the hourly rates listed below for the personnel involved plus reimbursement of direct expenses incurred in the work such as travel expenses, reproduction and printing costs, and long distance communication expenses. It is further proposed that payments for services performed be made monthly on submission of proper invoices, but that the total charges not exceed $35,000 without further authorization by the City. This was to expedite the time of the staff rather than the Planning Commission or the Council. City Attorney, Mr,, Williams- You don't have to amend the code. The code already permits it. The code states that notice in a zoning matter shall be given - by publication and by mailing of notices to people within 300 feet and posting of notice or by either mailing or posting if the hearing body dispenses with one or the other. You always must publish, If you wish to dispense with one or the other you may either post or mail, We have been doing both, The Planning Commission adopted a motion that it'dispenses with posting in all cases unless it otherwise specifically directs. If you adopt such a motion you will not have to post these things any longer that don't stay there anyway until after the first breeze or kid comes along. Councilman Nichols- You can always validly say they failed to see the posting but it is harder for them to say they didn't receive their mail. I can see on an operation such as the rezoning of Glendora Avenue where 603 of these things were pounded into the earth around town that a lot of man hours was taken but I wonder on a single piece of property in a neighborhood where people may live more than 300 feet away and yet have a vital concern with that piece of property if we are taking a wise step in making a provision that would say in effect that unless we so stipulated or designated there would be no notice posted. I don't believe I could in good conscience go along with that, Councilman Jett- My experience with the posting, I would go along with doing away with it, Nobody reads them and they don't stay there very long, Councilman Krieger- The real issue is what is going to be the best type of notice and the Planning Department has indicated to us in this meeting that it does require a considerable amount of work by the Street Department to,prepare the map and where these signs are to be posted so they comply, What we are attempting to do is provide notice to .interested parties and the two most effective means generally accepted are the publication and the mailing so if we can dispense with one and still fall within the notice requirements, I suggest we doso. Councilman Heath - district that doesn't post the field, and more fair way of notification, Councilman Jett - Councilman Nichols: Councilman Jett - I go along with Mr, Nichols 1`00%. I don't know of any I think it is a more effective I think one is enough, myself, How much work is involved in posting one piece of property, one lot? I have had no objection to this contract in the past; however, it has become rather passe as a useful instrument, Is this a contractuntil it is cancelled? City Manager;, Mr, Aiassa. Yes, You have to give him notice, Mayor Snyder. Since we dial not budget any funds for this contract at this time I don't see any purpose incontinuing this, By this I don't mean we shouldn't continue to use Mr. Johnson for engineering services but I see no reason for the contract, Councilman Nichols. We didn't put anything in the budget about this and, therefore we indicated we were nqt going to go on with the contract, Mayor Snyder.
