MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
April '27, 1964
The regular meeting of the City Council was called to order by Mayor
Snyder at 7.,30 P.M. in the West Covina City Hall. Councilman Krieger
led the Pledge of Allegiance. The invocation was given by Rev. Lauren
Egdahl of Mt. Calvary Lutheran Church.

meeting when the assessments were being spread there was a condition
made where certain laterals would be flagged and charges for those
laterals would not be made until they were used,, At that time I
think you recall that I said I think someone had gone lateral crazy
on that plan and put in many more laterals than needed,, It was my
concern on the Ammer property and DePietro property that there was
an injustice and that is why I voted against the spreading of the
assessment,, I do believe that the intent of our meeting that night
was to flag one lateral on Mr,,Ammer's property and three laterals
on Mr,, DePietro's property as is borne out in the letter by our
staff,, This is in accordance with the way the assessment is spread
.and I would move we adopt it,,
Councilman Nichols: I will second the motion,,

the intent included three

Councilman Nichols-. It seems to me that this is
a matter that has been hanging
fire for quite some time, I think the study to be made would not
have particular implications for this particular application, We
have sent notices to many people, some of whom are here this evening
and to prolong this still further I think we would be doing a disservice
to them, I think notification on the evening of a particular hearing
is not fitting to this particular situation this evening,
Mayor Snyder-. As a matter of courtesy, in
the past when this has occurred
we have continued the hearings as a rule,
Councilman Krieger-. I believe some courtesy is
owed to the members of the
Council who spend hours reviewing these things before the Council
meetings and to the people who come down to these hearings and
certainly if courtesy is in order I think it is in order both ways,
Councilman Heath-. I don't think we are justified
in holding this over, I don't
think a motion to proceed with the hearing tonight is necessary,
Councilman Nichols-. The applicant has communicated
with the Council tonight and
requested that it be held over and I think the record should show
those of us who felt the hearing should continue, I will second the

I have had an opportunity to
go over the property. At the
other hearings it was stated
the terrain was not fit for R-1 and I have found that most of that
property is level and most of it or a good portion of it is below
freeway level, The only portion I can see where the terrain might
be difficult is a two -acre parcel that is under option from a lady
who owns the home there, I think this is spot zoning,
The area in question does not
have adequate streets, water facilities; it will overcrowd the
school set-up, It is inconsistent with the current zoning,

I don't think he can put expensive apartments up there because it
is too noisy,,

directive the Planning Com-
mission had a study session,, It is the intent of the Planning
Commission to hold more study sessions. The matter of the General
Plan review has been on the Planning Commission agenda ever since
the directive was submitted by the City Council,, The matter was
expressed by the Chairman at the last Planning Commission meeting
that the Commission is now proceeding in this further analysis of
the General Plan and we have taken into account the directive of the
City Council as to the problems of multiple family uses as well as
other types of uses,,

has been stated by the
opponents here that it is noisy, not good zoning for apartments, In
that respect9 it certainly would not be good zoning for Rml, -'I
think obviously that multiple if you can find no alternate use, is
the use desired here-, Originally I was concerned whether Rm2 would
be developed, After seeing some of the.new precise plans coming
in under the R-2 ordinance as they are now being developed, I believe
it can be developed economically as R-2 and therefore I think one
of the criteria for how much multiple is how you can service it and
we are rather void in services in the east end of the City and
density should be held to a minimum. I would agree that R®2 is the
zoning at this time,

When the original zoning
matter was taken up there was

Councilman Krieger-. I would be inclined to review
this matter at the time we
have before us the precise plan for this property.
Councilman Heath-, I think that is a logical
request and I think a motion
would be .in order to hold the hearing open until we have the precise
plan before us.
Councilman Nichols-, Is it generally the case with
these types of zoning matters
where there is a project in mind that the precise plan is normally
submitted concurrently with the request for zone charge?
Planning Director, Mr. Joseph-, I don't believe there is any
normalcy. There is no
requirement for a precise plan to be filed at the same time the
zone is requesting to be changed. It is sometimes done to show
that it cart be developed for the way it is being requested to be
rezoned.
Mayor Snyder- We can't require a precise plan
to act.on this but when one
is in the workings or soon available, it sometimes helps in determining
whether or not the property can be developed according to the zoning
they are asking for.
City Attorney, Mro Williams-. The precise plan may become
evidence to show that the
zoning is appropriate.
Councilman Heath-. On second thought, I would just
. as soon go ahead on the zoning
and review the precise plan on its own merits. I don't know what
• else the property could be used for other than R-4.
Councilman Nichols-. This was the -thinking basically
I had, although I have some
mixed feelings. I think this particular parcel fronting on the
freeway in an areain my opinion that is almost impossible for
development in any other fashion, that the request for the zoning is
a proper request and that the precise plan would be a separate
consideration entirely. Where I might not particularly approve of
a particular precise plan I would, none the less consider this zoning
as being appropriate. I wouldn't object to holding this over, however.

months ago that we rezoned
the parcel to the west of this one to wholesale commercial,, I think
we might be liable permitting a zoning in there and telling the
man he can't use it because there is not enough water. I feel when
a man applies for zoning with his application it should be the
responsibility of that applicant to include with his application
a statement from the water company that there will be so much water
available and a certain volume,, This is done in the County and it
is the obligation of the applicant to get this information and
present it with his application so that when they go over the zoning
they know whether or not there would be water in the area,,

when he comes in with his

"Bob Gingrich of your staff and myself'representing the
school district developed a proposal for the installation
of lights for 3 tennis courts at Edgewood High'School.
This is to be the first of joint ventures between the
City and the school district.
The proposal for a school district contribution of 60%
of the initial cost and 40% by the City was approved
by the Council. However, it is the feeling
g of,the Board
of Education that a 50/50 ratio would be better and more
justifiable for this particular,.proje ' ct. Theyfeel that
the use of the lights for school purposes would not ex-
ceed 50% and that probably At least 50% of the night
lighting would be for recreational purposes.
The Board of.Education respectfully requests that the'

City Council reconsider this aspect of the total, proposal
and accept a 50% responsibility for the installation of
these lights. The balance of the proposal is acceptable
to the school, district.
• The Board of Education further expressed the opinion that
• the percentage of participation for each,project should be
considered on its specific merits and that no precedent is

dispute in the Pickering Tract.' In that period of time, we have had

area that they intend to go on doing nothing abbut"'this boundary
change. I represent the people living in the GalaXie Tract.
On the 5th of May, assuming -
that the current budget session is over, it is believed that they
will have a meeting in regard to this and other boundary disputes
involved throughout the State. I was invited by Assemblyman Soto
and I intend on goring and representing the people in the Pickering
Tract. I would like to have some member of the staff of the City
to go up there with us and take a firm standwithus.:

Company is involved in and I think our procedure would be to make a
formal complaint to the P.U.C. and use whatever legislative pressure
we can through our representatives to bring it to a head. This has
to be a joint force between us and the Council to direct someone to
carry the burden for the City in support of this.

Mr, Buck Burton; I am here to plead a specific
issue,, that being the
intersection of Glendora with Vincent. I would like to make it clear
that I myself and some of my colleagues consider this issue only a
part of a general issue that we feel we have and we intend to bring
before the Council for a hearing, The Businessmen's Committee in
that area has long been formed but quite disorganized but are
gradually getting organized, Every three months we are down here
with a handful of petitions and we are always here defending
ourselves against being blockaded by the City of West Covina,
By "blockaded" I mean the traffic pattern in this City has been
designing if not deliberately then it has been a beautiful job
of inadvertently designing to take the traffic away from our area
down there and the people in the area have survived God only knows
how, We want a general hearing before this Council to ask you
gentlemen if you would like us to be de -annexed .from this City
because I would like to yield this microphone for five minutes for
any of you on the Council or all of you to explain to us what has
been done for the old center in the City that has paid literally
hundreds of thousands of dollars into taxes, Also, we would like
to know why nothing has been done for it and what the intention of
the City is toward the area, There is several million dollars worth
of property down there, That will be the issue we would like to
• bring before you later and I hope we will have a hearing on it,
Mayor Snyder. My feeling is that the City
will grant you this hearing
and these things will be taken up at that time,
Mr, Buck Burton- The request is that Glendora
not be detoured to Vincent
Avenue and back to Glendora and that the east side of Glendora Avenue
going north not be restricted to two 11-foot lanes with the truck
route included in it, The last traffic count was taken on a Monday
and you took one on a Friday. The comparison is very unfair,
Specifically. we feel that our traffic has been reduced down there
by quite a bit which is the same old story,
Mayor Snyder- This seems to be a long and
involved matter. Wouldn't
it be better if these things were submitted in a study session or to
the staff so they can give us a report on your request? We cannot
consider this with just your half of the information, I think you
should understand right now that the goal of this Council has to be
to move traffic from the Vincent Interchange, To say that there
should not be a smooth flow between Vincent and Glendora does not
make sense to me, The goal of this Council is to improve the traffic
situation in the old center as well as the new and between them both,
• To say this Council has not had this as a goal is not'a statement of
fact, I know no one on this Council who has anything specifically
against the old center,
Councilman Heath- Some of these things which
have been done in the past have
not been conducive with good relations with the center, The fact
we just paid $20,000 for the prime purpose of getting traffic into
and out of all of our shopping centers and I was very much disappointed

in the fact the man brought up a report that was useless because the
heart of'it was a plan that the State would not accept, As far as
this intersection is concerned, I have never had as much public
sentiment brought out on any item I have had before me as on this
intersection, Evidently there are quite a few people who think this
is a rather poor design, The previous Council has committed this
City to an interchange �t Vincent and the freeway which I have
consistently voted against and if you think -you have a mess in the
City now, when this new interchange is put in you will have a double
or triple mess, Evidently there is a justification for complaint
on this intersection, These people have met with the staff and
evidently they have received no .results and I think they should have
another meeting and this time with Council representation to see if
we can9t get some of these problems resolved,
Mayor Snyder, I think this is not the time
to debate this. If they have
met with the staff, the staff obviously does not have their full
report ready,
Councilman Krieger, It is inconceivable to me how
we are going to resolve
anything on this issue piecemeal. This has come before the Council
under Oral Communications, As I understand she procedure of this
Council, upon the request of any member of the Council any such
• matter may be referred to the proper official or to a committee of
the Council appointed by the Mayor for investigation before any
action shall be taken thereon by the Council as a whole,

FOREST LAWN CASE DISPOSITION
Mr, Hal Marron- I would like a report on the
results of the court case on
the annexation of the Forest Lawn property, I understand there is
a decision,
City Attorney, Mr, Williams, The Supreme Court reversed
the decision opposed to the
City and sent it back to the Superior Court to enter a judgment
in accordance with the Supreme Court, On April 2, the Superior
Court did enter a judgment, We think it is not in accordance with
the Supreme Court decision because the judgment entered is to make
a determination using the 1963-1964 assessment roll, This was an
action in mandate which sounds technical but a mandate is to compel
the performance of a duty that existed at the time it was filed.
It was filed even before there was a 1963=64 assessment roll, I
think the error in this new judgment is manifest, We have 60 days
to file a Notice of Appeal, We have a new owner or a proposed new
owner in escrow who has asked for permission to discuss the dis-
position of the matter and maybe drop the annexation altogether,
We propose not to file the Notice of Appeal until close to the
expiration of time in order to determine whether the matter might
be disposed of and the lawsuit dropped before the time of appeal
expires. I have talked to the new man and he said as soon as the
new Council was seated he would approach us again,

property in question is bordered
on the east by the Rancho Estates group who are opposed to this
zoning; bordered on the north by the Country Club also opposing
this zoning; bordered also on the north by the South Hills Park
group opposing this zoning; and bordered on the west by our
organization also opposing this zoning, We collectively have been
opposing..this zoning for the last three years and have appeared
before the County Planning Commission and the County Board of
Supervisors and in both instances they have upheld us in this matter,
We are holding out for a minimum zoning of R-20000.. Crux of the
problem is that this is hillside property and under R-20000 in the
County these properties could be reduced in size to approximately
11,250 square feet and this is on hillside property and this is
also less than anything that we have in the City of West Covina
that adjoins this property,
In 1962 the Planning Commission
wrote a letter to the Los Angeles Regional Planning Commission
supporting us in this matter, We request that.you gentlemen write

flexible policy in the County which permits a certain percent of
the lots to go down a certain percent, In our own ordinance in
West Covina we have an open end general statement which allows the
Planning Commission and the City Council to Look at these hillside
subdivisions and work with topography,

420 of your property can be
700 or less, provided the average
is 17,500,
Mayor Snyder: Our responsibility is to protect
the people we have brought
into the City bordering that and the majority of them are in
Area District III and Area District IV, It is Area District IV
that has the same terrain and it is our responsibility to protect
them,
Councilman Heath: I think we would have a good
case of sending a complaint
to. the County if our lots are.large, I would hate to send a
protest to the County on what is proposed here and have them come
back and say BOlook what you did next door", If it is true that
Larkin -McKim is 20,000 I think this complaint is justified,
Councilman Krieger,. There is an article that
appeared in tonight's Tribune
with reference to Mr. Englander's plan for the development of the
property southwesterly of the end of Citrus and south of the Country
Club stating he will apply for R-1 zoning with 10,000 square foot
minimum lots. This is illustrative of what will happen in this area
unless this Council takes some action stating our opinion.

rezoning of this property rather than R-1-20,000 and that this be
expected to reach Supervisor Bonelli in time for this hearing,

Bill 180, We have been advised today they deleted portions of this
new bill but they didn't take all of it out, (Read memo re this
matter,) I think basically this bill is not good because it can
eventually be used against the independent cities, I would suggest
we reaffirm our stand supporting the San Gabriel Valley Municipal
Water District that will go up again and protest the same case,

the bill has certain features to it that are not desirable and if
it becomes necessary that we do have staff representation at this
hearing at 1230 and thirdly we support the San Gabriel Valley
Municipal Water District stand who have the same stand as we have,,

is called so we can at least get the groundwork started.

resigning as chairman of the
Water Committee and I can't hardly accept the resignation but I would
like to appoint Mr. Krieger to serve on this committee with Mr. Jett
and the staff until such time as we can talk to Mr. Jett about this

Oroville - May 7, 1964
City Managers Mr, Aiassa, There was a suggestion that the
new Councilmen might want to
make this meeting at Oroville, Perhaps Mr, Krieger should be .
authorized to attend this meeting if it is possible, I think what
they are proposing to do at this meeting is give them a complete
picture of the planned water development of California and the
Oroville Dam will play a major role in this proposal and they thought
• it would be a good chance to expose the people under the contract
with the State Water Resources to see the whole picture,
Councilman Heath,. I would not oppose anyone going
if they care to go but I
question whether this is going to give us a better insight into
what we are or aren't in for,
Councilman: Krieger,. With respect to that, I have
looked over the report of the
Bakersfield meeting and Mr, Jett attended it and the meeting took
one hour and one half which was devoted to one speaker for a trip
that exceeded twice that amount of time, I would tend to agree that
such meetings at this stage are just informative in nature and are
not justified,

SALARY SURVEY AND STUDY
City Manager, Mr, Aiassa-, The Council requested a copy
of the agreement with the
salary study and survey work. I have made copies available. If
there are any comments I would appreciate receiving these by phone,
Councilman Heath-, Meeting the deadline that has
been set of July 1st to have
this report done to put this in has put this on a crash program. I
think it behooves us to ask our City employees if they would consider
a one -month or two -month extension rather than rush into this report
and come out with a poor report. I think it would be to their
advantage to permit or allow or request the Council to take another
• month or two in studying this report, letting Mr, Gold make his report,
I feel in all fairness that every employee should be interviewed and
to expect a man to interview 10 people per day and assimilate the
information, I don't think we are going to get a fair consideration
for the employees,

and study it for next Monday,
Councilman Heath-, Should we ask the City Manager
to ask the City employees if
they would consider something like this?
Councilman Krieger-, I would have no thoughts on
it at this point,

the firm who has the contract
to so do it because it is listed in black and white here and I have
provided enough requirements that 'the Council is protected. I will
ask the employees, I would rather proceed on the crash basis and if
we need an additional month or two we can ask the employees to O.K.
the extension.
Councilman Nichols-, I think Councilman Heath has
a good point, however, and
perhaps the City Manager might take that into consideration in the
event there is an indication that time pressures are building up, that
these gentlemen can be assured that we might be receptive to an
extension of time at that point rather than get an inferior report,

Thomas. They want to bring up their
final report. This is on the West Covina Civic Center Project. (Read
letter dated April 27, J1.964 as follows-)
"Our current appraisal of the status of the West Covina Civic Cen-tei.
Project indicates several pertinent items which we feel should be re-7
viewed at this time.
We have been working on a time schedule Which cAlled-for-certain*
phases of our work to be completed during the month of April. "We"
have progressed upo4,this s-chedule'"to the limit,,-,, of'dur ability"to
Flo so based upon all,, of the necessary iInformation AvailabI6 to you
at, 'this time. However, until any studies and decisions' regarding

the size of the Auditori,um'are completed, we will be unable to'bring
this phase of our work to a fi.nish.. It is our understanding that- -
the City is considering having an independent Feasibility Study made
for the Auditorium and Cultural Center portion of the project. The
results of such studies will be incorporated in our design for 'the
Civic Center.
Should the decision be made to go ahead ' with the Regional type of
Auditorium and -the necessary parking structure requ'il 'ed by such an
Audi.tioium and the Cultural Center, it will., of course, be necessary
that our - Contract with the City be amended to conform to this change
in scope. If it is the desire of the City to do so, we will pre-*
• pare a rough draft of the Amendment and submit it for your review,
We have been working with your Director of Civil Defense*�on faci.1-
ities which will be built in conjunction with the Police Facilities
Building, and feel. we are near a, mutually satisfactory solution for
this portion of work.
Our time schedule for the completion of the Preliminary presentation
outlined in our Contract with the City will have to be altered to take
into account the above -mentioned change in scope. Following is our

"This is a total; of 14 weeks time required from the completion
of the Auditorium Feasibility Study until our Preliminary Presen-
tation is 100% completed.
Our contract with the City calls for payment of 12% of the basic'
rate upon completion of Step§ 1, 11, I'll and IV of the Preliminary
Presentation. Due to the proposed changes mentioned above, we
have hot been able to quite complete all of the work described
in Step IV (Analysis of Project Building and Site Needs),'howdver,
we haVe advanced considerably beyond that point in other phases of
our work, as evidenced in the percentages of completion for the
different steps noted above. Since we have been working on the
Project for over two years without submitting a Statement of Pay-
ment, we request that in view of the above circumstances we be
al.lowEd to receive a payment of 1-27o of the basic rate at this time.
Such a payment would be less than is warranted for the actual work
performed to this date.
We will continue working on all phases of this Project possible
for us to, push without the information which will be forthcoming
from a Feasibility Study and assure you that we are progressing
as rapidly as possible and will bring the Preliminary Presentation
of the work to completion as soon as we can."
Mr. Aiassa. We are also having a meeting on
Wednesday with the Representa-
tive from American Managers Auditorium Association and Mr. Allen
'happens to be president.
Mayor Snyder-, Could Neptune and Thomas have two
alternates of a local and a
regional?
Mr. Aiassa.- No. The regional would be such a
drain and demand on parking it would
be phenominal and the type of structure would be quite different.
Mayor Snyder,, We can't go very far until we have
at least the preliminary feasibility
study. Mr. Bonelli indicated there might be funds available for such a
study from grants in our preliminary discussion with him.

the Ford Foundation is out.

Mayor Sny der ° I have a letter from the Teen -
Kan. --Teen dated. April 14th, 1964
regarding fund raising program by painting house numbers on curbs.
I sere no objection to them working with; the youth, (Mr. Flotten
read letter as follows
"Correspondence of the date of March 1.2, 1.964,, under the signa-
ture of Mr. Robert; S. Gingrich, Director of Recreation and.
Parks, of our City, advises that the City Council granted per-
mission to the Teens -Kan -Teem Foundation to conduct a fund raising
programs by painting house numbers on curbs within- the City limits,
provided the Foundation can obtain a ?Local, independent youth
group (s) to assume the project responsibility and return pro-
ceeds to the Community Youth uth Center construction fund.
If it is within the wishes, and keeping of the Cou ncil's
intent, the Foundation would :;pike to solicit interested youth
organizations to participate in, this venture on a, percentage
basis, It is our thcught, that an outstanding opportunity
exists for youth groups to enhance the dollar value of their
sawn treasur:a. nr s, as well, as 'to assist the bul.1d ng of the youth
facility in Cameron mark, Summer trips, youth conventions and
missionary field projects do require an outlay of capital.
Considering the proposed 'procedure as outlined above, it is
requested that the Foundation be advised if such is acceptable
to the City Council. If our proposal is confirmed,, we shall
then proceed to contact car clubs, church youth groups, and
on campus, school. clubs to commence and complete the .house
number project;.
The members of the Foundation are grateful to our City Council
for this opportunity and will abide by the decision thereof."

Councilman Nichols-, I am in accord with the program
and I think it was an excellent
suggestion. and I would like to see it implemented,
Motion by Councilman Nichols, seconded by Councilman Krieger, and carried,
that the., Council direct the City- Clerk to notify the youth center of the
Council's approval. of the program under their auspices to number the
houses on the streets of West Covina as per their letters.
JOINT MEETINGS
Mayor Snyder° I think as soon as possible we should
have joint meetings with all our com-
missions to acquaint them with the new Council and possibly the policy
of the new Council and also to work out our joint problems and misunder-
standings. I think the one with the Planning Commission should be as .
soon as possible as well. as the Recreation and Parks Commission, Person-
nel Board, and the Executive Committee of the Chamber of Commerce.
Councilman Heath. That is a good idea.

EAST SAN GABRIEL PLANNING COMMITTEE
Councilman Krieger, On this East San Gabriel Planning
Committee which met last Thursday
at the Golden Spur, I was joined in attendance by Commissioner Gleckman
and Mr. Joseph. This was a most interesting group of people representing
12 local communities and I thought a number of comments made by the
recreational specilist were applicable to our area. He indicates amazing
figures that we may anticipate an increase of 75%® by 1,975 in this area.
The recreational, business is turning into a big business. He made a
point of suggesting tQ planners and Councils that they stop planning
and start implementing, take the citizens into partnership into
nto these
projects. Facilities are disappearing at an alarming rate within the
Ccunty of Los Angeles in which to implement these recreational facil-
ities. The meeting adjouirned at 9,00 o'clock. The finances of the
East San, Gabriel Planning Committee is $230.65 and elections will take
place next month,
PARKS & RECREATION
Mayor Snyder, I put myself as representative to
the Parks and Recreation Commission
and unofficially I would like to direct them that we are in sympathy
with their going ahead with a program we could implement in some way
in the near future if the Council has no objections,
