Councilman Towner.- I feel that the City staff has done an excellent job in making improvements in the plans and specifications as presented. I believe the recommendations made in their memo of April 10 should be.accepted. Move that the understandings reached between the City and the State Division of Highways as - referred to above be accepted as meeting the conditions of approval given by the City Council at its meeting of April 61 1964; further that the Lark Ellen Draing Project No. SD-6320 be included as an integral part of the Vincent Avenue Interchange Project and the staff be authorized to furnish City plans and specifications to the State for such purpose,, Councilman Jett: I.think there are people here tonight who are interested in this, I think it would be pertinent to see that these gentlemen get a copy of this or that this be read into the Minutes. (The following is a memorandum directed to George Aiassa, City Manager from John Q. Adamsq Public Service Director re Vincent Avenue Interchange and dated April 100 1964,) "The City Council at its meeting of April 6, 1964t approved preliminary plans submitted by the State Division of Highways for the Vincent Avenue Interchange improvementssubjeict to certain changes recommended by the Staff. The Staff was directed to review these changes with the State and to report to the Council on April 13, 1964 -2- CO CO 4/13/64 Page Three 'VINCENT AVENUE INTERCHANGE-,Cohtinued, as to the results of these discussions and with a final recom- mendation in this matter. "The changes as recommended by the Staff and which are listed on the attachment have been reviewed with the State Division,of Highways. Results of these meetings are summarized in the comments, made on the attachment under'the applicable recommended change, "In summary, the State Division of Highways were considerate of the changes requested by the City of West Covina, in those facets of design and construction where the local office is not restricted in the action it could take by design criteria and, policy established by the Bureau of Public Roads, as well as by its own organization, the proposals made by the City were, in generalg agreed to,, In other areas, the State is now aware of our concern with certain features' of theinterchange design and have advised us that if problems I do develop after completion of construction, corrective action will be taken by the State,, "During the review of the interchange plans, the State indicated they would agree to include the City's plans and specifications for construction of,the Lark Ellen Drain from the San Bernardino Freeway to the Walnut Creek Wash (Project SD-6320) as part of the interchange contract, 'The State will also handle adminis- trative matters relating to this project which involve the Bureau of Public Roads. This action will effect considerable saving in time and money for the City of West Covina.and will not extend the construction time for completing the interchange work, "Recommendation: "That the understandings reached between the City and the State Division of Highways As referred to above be accepted as meeting the conditions of approval given by the City Council at its meeting of April 6. 1964. ""It is further recommended that the Lark Ellen Drain, Project No,, SD-6320, be included as an integral part of the Vincent Avenue Interchange Project and the Staff be authorized to furnish City Plans and specifications to the State for such purpose." (The following is theattachment to the above memorandum entitled "Vincent Avenue Interchange Construction Plansti.) "City of West Covina recommended plat changes, additions or deletions: "l) Construct concrete stairs and/or ramp*in the southeast and northwest areas of the Interchange to the bus ramps, -3- 4 CO Ce 4/13/64 P&ge Four VINCENT AVENUE INTERCHANGE Continued "The asphaltic concrete rampq a portion of which now exists9 as- shown on preliminary plans is the standard used by the State Division of Highways,, In additiong State policy'is not to replace existinglacilities, such as this ramp, which are in good condition and would not be affected by new construction. ThepedestriAn. ramp and walkway will therefore be constructed as shown on the preliminary plans, "2) Provide a pedestrian over -crossing (separation) to the bus ramp on the east side of the Interchange. "A separation had previously been proposed by the State and submitted to its Headquarters in Sacramento for approval on several different occasions. This concept was disapproved on the basis that a painted cross -walk will suffice. No further action on this matter is proposed by the State at this time. "3) Complete traffic signal -- system at the intersection of Vincent Avenue and Center Street, 'I Has been recommended by District VII to its Headquarters in Sacramento, A decision has not been madeq however indications are that this work will be approved, "4) That the City of West Covina salvage the existing signal system at Vincent and the South Frontage Road. Councilman Jett: this read into the Minutes. State proposed, Practically these as being the items that Comments under Item #14 We did not get any additonal items, This is why I wanted This substantially is exactly what the all the way through here it refers to the State was going to do regardless. Mr. Aiassa: We met with Mr. Schaeffer and it might be pointed out to the Council that contrary to us reviewing this and making this available we did not delay any progress as far as the plans were concerned because the resolution signed by Mr. Heath is the only official action necessary and the only other signature required is that if the City Engineer and we have executed all our actions. This was a courtesy extended to us (State Highway Staff) that we could re- view these items of improvement we felt were pertinent. Some of these will not be recommended and approved subject to the Bureau of Roads. You are only accepting plans, not specifications. The only power we have here as far as the staff is concerned is to direct the City Engineer to sign these plans. Councilman Jett: This is not what I am talking about. What I am talking about is these 15 items, that were to be sent,to them and this is the reason I voted against the motion because we approved the plans subject to their acceptance of these recommendations. Now these recommendations, most all of themwere already in the plans the State approved. They weren't something new. Each item brought back here by Mr. Adams so states. Mr. Aiassa: The reason why this should be filed with the State Highway was at a later date if something comes up not acceptable we are officially on file that we didn't think what they are proposing was satisfactory. You would not have this right later if we hadn't proposed this and so advised them. so Ca Cc 4/13/64 VINCENT AVENUE INTERCHANGE - Continued Councilman Jett: Page Seven What you sent in was exactly what they proposed. Councilman Towner: There is,, I think, this one major item which has come out as a result of this and should be brought to the public attention which is included in the memorandum received by us and during this review of the interchange plans the.State agreed to include the Lark.Ellen Drain in this;project. Not only that, they handle these things on one contract and the end result of it is that the City of West Covina w ill save considerable time and money,, I think that is i a major achievement, Councilman Jetto. The signalization at Center and Vincent has been proposed by the State and I will bring the letter to this effect to the next meeting, On March 17, 1964, Traffic Signalsq Various Locations -- Vincent Avenue and Center Street -- "Plans for the reconstruciton of the Vincent Avenue Interchange by the State include the extension of Center Street to serve as the south Frontage Road between Vincent Avenue and State Street, It is anticipated that traffic signals will be required immediately upon completion of the construction to establish effective right of way control," City Manager, Mr, Aiassa: There is nothing in that letter stating that the State will do it. Public Services Director, Mr. Adams: The State is participating in the Lark Ellen Drain because it would require connection with the eventual freeway improvement and they are contributing to the amount of $22,000.00. We were going to put out a contract and administer it. We had serious considerations how this would work out so the State has agreed to accept this as part of the interchange contract,, We are sure we can effect considerable time and saving by having them do it,, Councilman Heath. - Even though I am not in favor of the Vincent Avenue plans, I will second the motion,, Action on Councilman Towner's Motion: Motion carried. Request to permit C-3 use in C-2 zone (Billiard Parlor) denied by Planning Commission Resolution No. 1554,, Appealed by Louis A,, Mohnike on March 18, 1964. City Clerk, Mr,, Flotten: Notice of this public hearing appeared in the West Covina Tribune on April 29 1964 and 17 notices were mailed to property owners in the area. (Read Planning Commission Resolution No. 1554.) Mayor Barnes: IN FAVOR This is the time and place.for the -public hearing. Mr, Robert 0, Young , Mr,, Osborne has entered into 1502 West Service Avenue a six -year lease of the West Covina premises at 636 South Sunset, He intends to invest some $209000 in refurni ' shing the interior and exterior of the building,, The plan -of operation for this billiard center will be according to the family billiard center operation about which there has been considerable publicity, Mr., Osborne requests that if this variance is approved that it be'subject to the controls in the sample ordinance,, There will be'no alcoholic beverages sold in this building. me I Cc Cc 4/13/64 VARIANCE NO, 490 - Continued IN OPPOSITION Page Nine Mra Boyd Caldwell I am management representative, Coldwell Banker Co,, with Broadway Department Stores, We appeared previously at the Planning Commission meeting at which time this application was dis- approvedc Our thought at that time was that this type of operation does not upgrade the City of West Covina nor does it upgrade the Civic Centerc On investigation in various operations of so-called family billiard parlors there has been a definite policing problem brought up, We feel it does not upgrade the Center and it bring's forth problems. Mro Leonard McCdrvell 1723,South Sunset West Covina the street from it and ' if they are that is a bad environment for them. feet of this property,, REBUTTAL I own a building next to this - place and there is a bar there, There is a bar next door to it; there is a bar right across going to. have a family pool hall, There are three bars within 200 Mro Robert 0,, Young: I would underscore Item 6 of the Operation Controls -- alcoholic beverages stating they shall not be sold, -dispensed or allowed on the premises except in those cases where the billiard room is an auxiliary use to a bowling alley, which is not the case hereo Insofar as the Civic Center type use is concerned, I suppose there is no private business which would be a civic center use ' . The use we are proposing will be a high-class use certainly consonent with the civic center plans and any use that could be conceived in my judgement. There being no further public testimony, the hearing was closedc, Councilman Heath-. In reading the resolution of the Planning Commission I get an opinion here that the main reason this was turned down was the fact they did hot think that the grounds for a variance had been met and "also the Con='jssJ6n noted the necessity for adequate ordinance controls for this type of use" and suggested that the ordinance be amended rather than have the necessity of granting use variances. Do I gather that the Planning Commission recommended that the ordi- nance be amended to allow this use in a__C-1 ra7ther than have variances? Planning Director, Mr. Joseph: No. The Planning,Commission felt that if there is a weakness exposed or an area within the ordinance which should be explored further with an eye to amending the ordinance this should be done.. This is being done constantly. If a particular use' -come to us and it is now set forth in one of the other zones and it is proposed. to ask to be placed in another, zone,'to maintain the integrity of the ordinance the Planning Commission believes we should explore the possibility of seeing whether or not this use should stay in its present zone or be put in another zone.' The' Commission's concensus is because,a particular use is asking a particular location and the ordinance doe's not permit it in itself is no reason to approve the use,, !M C11 Ce 4/13/64 Page Ten VARIANCE NO, 490 - Continued Councilman Heath: It says that the Planning Commission suggested that the ordinance be amended rather than having the necessity of granting use variances, This would lead me to believe they are in favor of this establishment going in here but their hands were tied by the fact that a variance was used and it couldn't be justified, Planning Director, Mr. Joseph: I don't believe they expressed themselves one way or another- about.this particular application in that,fashi6n.: Councilman Jett: I donitsee the similarity of this location with the one we granted in another areao I think there we were in an area where . there were family uses and lots of children in that area attracted to that area because of the entertainment and I think in my opinion this was one of the reasons we felt that would fit into that area. Taking a look at this area, three bars in that area and there is no other usage that I know of that would bring children to that particular area; it is dark around there; I think there is certainly a lot of difference between the two areas as far as the uses are concerned. Councilman Towner: In the absence of any other information I would have to say that the showing for a variance has not been met. It may, exist but it hasn't been shown, I think this ordinance change is under con- sideration and may have some good solutions coming out of the Planning Commission hearings. The picture.here so far as presented to us tonight is certainly different than it was on the other appli- cation, I can't see that we are in a position to grant this particular request,, Councilman Snyder.- I would agree essentially with what has been said. I don't think we are being inconsistent with our granting of the. other request, either,, Councilman Heath: I think we are being incon- sistent in the fact that it was pointed out there were three bars in this area. In the location we granted the other billiard parlor I think there are as many alcoholic beverage establishments as there are in this area. I feel there is a similarity in this location with the one exception and that is the amount of light on the outside of the building. If'the outside of this building was lighted so it could be patrolled, I think you would have the same conditions and environment that you have at the place we granted a similar request last time. Mayor Barnes: I cantt see any real justifi- cation for a variance here. I don't think the area particularly lends itself for this use. I quite agree with the Planning Comm' i issiona Motion by Councilman Jettq seconded by Councilman Snyders and carried',' that Variance No,, 490 be denied _10- I Cd C, 4/13/64 PUBLIC HEARINGS - Continued -- UNCLASSIFIED USE PERMIT NO,, 87 John T,, Aston (Foursquare Church) DENIED Page Eleven LOCATION: 1305 Walnut Creek Pa ' rkway between Batelaan and Sunset. We don't want to bust up saloons; we want to worship God as guaranteed to us under the Constitution, We don't want to bother anybody,i.,Allwe want to-do is get established and gather people and that isn't easy to do when you are starting from scratch and opposition makes it that much harder,, A great deal has been made of upgrading the Civic Center. ' A church would;make it a respectable areao We hope you willgrant the permit, IN OPPOSITION Mro James Lotito I am not an atheist and I am a 648 South Sunset church -going man. According West Covina to'the Alcoholic Beverage Control none can be sold within the radius of 600 feet from any church or schoolo Therefores since alcohol is being sold closer than 600 feet, a church does have the right to come in our area. We are fighting the right when our licenses are renewed at'the end of the year that they may be opposed by anybody in this community. Having a church within the radius of 600 feet itself is not in our favor' to establish our business here after then, This should be considered Very carefully, Co Co 4/13/64 Page Twelve UNCLASSIFIED USE PERMIT NO, 87 Continued Mro McCarvell I own the building right next 1723 South Sunse t to this place, If they put West Covina this church in there and the license goes for transfer they can put in a protest at the Alcoholic Beverage Control Board and they will back it upo REBUTTAL Revo John To Astonc, In regards to the license, we wouldn't have any control over that but we wouldnOt fight that at all, We have no fight with anyone about their licenseo They are in business before we came here.. We certainly won't oppose them about their license, There being no further public testimony, the hearing was closed. Councilman Jett-. I made the statement I didn't think a pool hall should go in here because our youth would be coming into this area, It is dark and I think that the type of youth and people who would be attending this church would be somewhat subjected to the same problems that the youth would be subjected too I can't help but think there are much better areas in which to establish a churcho We feel if the businessman is in there and he is established regardless of whether it is liquor or whatever it happens to be I feel he is entitled to be protected as much as any new use coming in. I think I would need further proof that this would be the location for a church before I could go along with it, Councilman Towner: I would like to have clarified for'the record here the conditions under which unclassified use permits may be granted. Planning Director, Mr. Joseph. It indicates that certain uses Dossess certain characteristics to make it impracticaa,_-_their being included automatically in any zone of the ordinance, It says such, permit shall be denied where it is found that the proposed use at the proposed -location would adversely effect the. public health, welfare of the area or the community. Councilman Towner-, Secondly, I would -like to say this: -We have to make these findings that placing a church here would advers,ely._effect the public peaceg health, safety or public welfare, Further,,I think we should distinguish the variance request on the -'prior -hearing where the conditions for a variance had not been established' on the record and in this case an unclassified use permit where youlhave a different situation where this use may be granted provided it is not adverse to these public matters, It appears to me that a church normally -is. considered an asset to a community and a benefit to the public peace and welfare, It seems to me that this particular proposed location.. is one that faces in a different direction from'the opposing stores, one that has a parking lot on the'other side and doesnt have much interrelation between the two uses, I don't think there is any direct conflict, The fears of the people who are running the liquor establishments nearby I think are not justified in'a case where a temporary permit is granted to the church and the church comes in -12- 0 0 cc CIO 4/13/64 Page Thirteen UNCLASSIFIED USE PERMIT NOO 87 -'Continu'ed after their businesses are established. No licenses could be revoked or'taken away on that basis,, It certainly would prevent additional liquor establishments which I think we should in this area which I think would be of benefit to the area,, In my opinion, the request of the church is reasonable and I think the unanimous opinion of the Commission verifies that and I think*we should permit this church to come in on this temporary'basiso Councilman Snyder-. I would agree. I think that the findings for an unclassified use permit are here and that since the liquor stores or bars were there prior that the church could not present any valid argument to prevent any change of license in the liquor businesses. Councilman Heath - We acknowledge the fact that there are these liquor con- sumption areas close by and yet we say a church is permitted in this installationo The sum and substance looks to me this way: That this area is not good'for a family type billiard hall because of the environment but it is for the church, Gentlemen, I cant go along with.; I can't follow the reasoning and I don't thinkAt is right, Councilman Snyder-, The church is'a temporary permit and the billiard parlor would have been permanent,, Councilman Heath: A while back we have had the well known discussion here at the Council where on Glendora Avenue there has been a church established on a yearly basis and in the middle of a commercial zone and a man came in and asked for a liquor sales in the commercial area and this man was not permitted to open a liquor store. In other words, the commercial area was deprived of useful commercial enterprise because there was a church established in an improper zo ' neo Here we have a similar case,, You are moving a church in the middle of established commercial on a year-to-year basis; you are creating the same condition where you are going to deprive again a commercial use of its just use because of the fact that they are moving in a church, Councilman Snyder: The one on Glendora Avenue was not similar. The Chief Of Police report did not object because there was a church next to it* the police*pointed out that the church was on a temporary basis; he objected because of the amount of other b ' arsO' To say the other was turned down because of a temporary church there is not SOO They had,the right to protest to the liquor control and whether they considered this I do not know but the City did'not protest on the basis of the churchO Councilman Jett-, I would like to call attention here to one thing, If a church is established a bar or whatever wants to come within 600 feet of itg,the law specifically states this is forbidden,, The law does not say that if there is a liquor store there and a church wants to come in within 600 feet or 100 feet that this is not permissible, There is nothing spelled out there at all so it looks like it is a one-way streeto In all fairness to everybody, I am sure that a year from now when these liquor stores have to renew their licenses there might be a different minister here, a new group in the church who.might oppose. It could easily result in these gentlemen losing their licenseso -13- cc C, 41/13/64 Page Fourteen UNCLASSIFIED USE PERMIT NO,, 87 - Continued Councilman Snyder. We operate under City ordi inances and not the State Liquor Law and our concern should be with what our ordinance states and these people have shown just cause under our ordinance,, You have had to reach outside of our Ordinance to the*liquor laws to find a justi- fication for not granting them'this and it seems to me that is where the reasoning should lie and that is what I base mine on, Mayor Barnes: We locate churches even in our R-1,, We did have a case of a church in a commercial area and this did cause some of the businessmen trouble. I'don't think the church'is wrong as a temporary use in a commercial, area but I feel it might more or less become permanent if they can't get a location and they don't have the funds to build and this happens in many cases,, Motion by Councilman Heath, seconded by Councilman Jett, that Unclassified Use Permit No, 87 be denied because of the fact that it is in the improper zoning area and in close proximinty to three liquor sales and it is felt there are other places available that would be better for t.he.church and would alleviate this problem of a church in a commercial zone,, Councilman Towner.- If I understand your reasoning, it is that -no church could be located in any commercial zone in the City of West Covina, This appears.to be the basis of your motion,, Is this the understanding that the three of you have? Mayor Barnes: It is not my basis, Councilman.Jett: It is not my understanding, Councilman Towner.- It was the statement of Mr, Barnesq however, and Mr. Heath that Mr, Heath expressly states in the motion that this is improper zoning and it is the motion you are voting on, Mayor Barnes-. I think close proximity to other uses such as bars and the general area where we have had trouble with the two before I think this might go on from year to year. I would grant an unclassified use permit.for one year and it isn't in excess until they find a new home but there is a possibility of not finding a home within a year and this could go on and on and I can see problems coming out of this. Councilman Heath: The Council in the past when there have been motions made there have been drawn put discussions, debates, which is healthy, but I think some of it is uncalled for and I think it is trying to put words ' in other people's mouths,, I think in this case the motion is clear and I would like to call for a vote,, Councilman Snyder: The motion says that the use is improper in a commercial area b,ut.I would like to point out some of the finest churches in the country are in a commercial area. -14- cc cc 4/13/64 Page Fifteen 'UNCLASSIFIED USE PERMIT NO. 07 - Continued Councilman Towner: There is another point that I think should be made clear and these are the conditions for granting an unclassified use permit; it is necessary for -you to find that this church is adverse to the - public peaceg welfare, safety and morals and I don't find in your motion that you have made these findings. Councilman Jett: I am sure this would not be a compatable use as far as the bars are concerned. City Attorney, Mr. Williams-. What I was going to write into the resolution is this and I would like to know if these are the grounds: That it would adversely effect the general welfare on the ground it would jeopardize the continued existence of presently existing businesses in the same vicinity, Councilman Heath.- Present and future businesses, Councilman Towner: I think you should be specific and not just call it businesses -- call it liquor establishments because this is all that you could mean, Action on Councilman Heath's motion: Towner and Snyder.voted "No",,) CITY CLERK'S REPORTS (Continued) i VINCENT AVENUE STREET IMPROVEMENT 80GAN PROPERTY FRONTAGE APPROVED Motion carried,, (Councilmen LOCATION: West side Vincent,, south of Walnut Creek Wash. Councilman Heath, It states in -here t I he Chairman can call ameeting at any time informally which I think is illegalo City Attorney, Mr. Williams: It is to the extent it would violate the Brown Act. The .Brown Act would prevail over the rules anyway. Page Nineteen I have a letter dated April 10 signed by Mr,, Merle Matzenbacher (Read letter re this matter.) City Attorneyq Mro Williams.- The question is just what the Council mea- nt to incorporate, You may remember that when the motion was made approving this variance it was made subject to the operating conditions and development conditions as set forth in the proposed ordinance furnished by the Planning Departmentc, You have to look at the proposed ordinance furnished by the Planning re'artment to determine the question and p the answer. The question relates to this.- Does the code provision determining the amount of off-street parking apply and there is no code division that relates specifically to billiard parlors'or pool halls or does a reference in.here apply and this simply depends on what you meant to appl.vo I don't know what you meant, There is a reference in.here and its -exact location is rather'significapt. Planning.Director, Mr. Josephg The City Council adopted the definitions and the development controls and the operation controls and going on the last page under Operative Controls it says in addition to the above amendment the parking section regarding billiard parlors is two per table plus one per employeeo If you meant to include this in your conditions then the applicants would be restricted to less tables than they want to put in, Does theCity Council also include this section? City Attorney, Mr. Williams: which is one space for every 150 to substitute for that provision spaces for every table installed. intention. The code requirement on parking would be the miscellaneous square feet but if the Council meant this.j,it would require two parking The question is simply what was your Councilman Jett: My thinking at the time is I dont remember the parking being discussed. I think the general feeling was that that entire parking area would be available to this,, My thinking was that this parking area would be available,, .May . or Barn . es: Do you see any problems with this amount of parking? Planning Director, Mr. Joseph.- My concern is this: I told them that we honestly believe that the parking ratio we came up with is correct, We did not know what the City Council's intent was in this particular case We have to consider what we are going to be telling'people in the futureq also., as to the intent of the City regarding off-street parking. It wouldn't break our'heart if you chose this one"way or the other tonight just as long as we clear the air,, Councilman Snyder.- The C-1 usage determines the parking, 'not what is in it.. _19- Cl cc 4/13/64 Page Twenty VARIANCE NO, 484 (BILLIARDS) - Continued City Attorneyq Mr, Williams. The code only requires the 17 8 parking spaces that they have but under this ordinance it would require 21 because there are two for .each table and it would' . require 20 for the 10 tables plus the one for the.one employee there,, Mayor Barnes.- If these people move out and another use comes in our requirements are fine, As long as we established a ratio of parking for the building itself I can't see that this is so important,, City Attorney, Mr,, Williams-, Mayor Barnes: Parking is not.by zoning; it is by use,, The parking require- ments are related to use,, But you can't change them every time you rent to a different business,, Councilman Towner-. Heretofore on a billiard parlor if it were granted would only have the requirement of one parking space for every 150 square feet. City Attorney, Mr. Williams: That is all that is required of a standard pool hall because they are automatically permitted in C-3 and they only require one parking stall for every 150 square feet. Councilman Heath: I made the motion and it was not my intent to 'increase the parking spaces, Councilman Snyder: I think we sort of overlooked it, City Attorney, Mr. Williamsg. I think you should have a motion declaring what the intent is in the former resolution to set this straight, Councilman Towner: I think what happened is we didn't think about it and we assumed the existing ordinance requirements would apply without the amendment. City Attorney, Mr. Williams: I think you could take Mr,, Heath9s motion but I suggest instead of stating that the last paragraph of the suggested ordinance relating to parking be stricken say that the last paragraph of the suggested ordinance was not intended to be incorporated as a condition in the resolution approving the variance. Motion by Councilman Heath$ seconded by Councilman Snyder, and carried that regarding Variance No. 484 the standard ratio of parking should apply in this case and that the last paragraph of the suggested ordinance on family -type billiards was not intended to be incorporated as a condition in the resolution approving the variance. -20- C, C, 4/13/64 Page Twenty- I One WRITTEN COMMUNICATIONS Continued PERSONNEL CONSULTANT (SALARY SURVEY) City Clerk, Mr,, Flotten: Ilhave a letter dated April 10 directed to the City -Manager from Mr,,,A, Robert Cole, Chairman, City af West Covina Personnel Boardo I think you have copies of this. Councilman Heatbg I attended this personnel meeting where the Personnel Board interviewed some consultants and I thought one of the major points we wanted.clarified was to determine whether we were going to use 12, 21 or 100 cities in making our comparison. I tiink what we wanted to know is what we are going to use for a measuring stick,, The consultants came in and.were asked to study 12 positions and integrate them into the present jobs which we have and it was -more apparent -as it came along as stated in the second page that quite likely if you, study only 12 positions and th ' en try to integrate them into the present structure that some of the present structure will be effected and youmight just as well go over and review every one of these positions,, It would be very nice if we could have Mr,, Ledermann come back who established the present positions and let him use the same measuring d6vices in establishing these 12 positions but -unfortunately Mr,,,Ledermann is not in the business any more so what we have been confronted with is a relationship of job to job established by a consultant and that consultant is not available now and now we are going to have to askappther consultant to evaluate 12 different positions and integrate them, Thi6 involves complications. It is the feeling of the Personnel Board that they would hire Gold, Thompson.and Cog Incorporated to review all job classifications,, Mayor Barnes-. I would like toihear the Personnel Board's feelings on this,, City Manager, Mr,, Aiassa-. Another suggestion would be a joint meeting with the Personnel Board. Councilman Heath.- Budgets are coming up soono The Gold and Thompson, Inc. I believe wanted four months and came down to three months and almost rebelled when it came to two months, The approval of the Council should be prior to July lst which means if we are going to have a survey at all that it is going to have to be done immediately,, Councilman Towner: In looking over Mr..Zoellels motion it says the consuitant is to perform the reclassification study, establish the criteria for salary surveys and make a survey,, Did the,Personnel Board consider that to include among the criteria the cities that were to be used or just the benchmark classifications? Councilman Heath.- use, industry and cities of,like way of . establishing a criteria be established first, maybe b' y the Council and the employees. Association and the approval of the Personnel Board and the City Council,, After'that is established to move ahead on his survey,, Is this what you mean? Councilman Heath: Yes, This is most likely what we will have to end up with, There is something I would rather have and that was to go to Mr,' Ledermann who is now in some other business and see if they couldn't work an arrangement for him to do this survey in his spare time or on Saturdays or something,, If we can't have that then the answer to your question before is yes, we would give it to the man, let him start making the study, let him come up with the criteria and let him go on from there,, Councilman Towner: Without having all the details of it it appears to me they Are asking this professional consulting concern to establish criteria for salary surveys as part of a three-phase study and we would consider that as part of a separate phAse,, I think in view of the time situation involved and the recommendations' of the Personnel Board that perhaps we should authorize that they go ahead with this and the consul'tant will have the opportunity to review this phase. oflit as it comes up. City Manager, Mr. Aiassa: I would suggest to direct us to proceed with a proposed written contract and in this written contract we will specifically state the things you want done, I would,,like to suggest that if we go along with their recommendation that A specific written contract be made and these questions that the Council are now raising should' be written into this contract subject to the approval of the City Attorney and your approval and then you will know what you are getting for the contract, Councilman Snyder: When we hired Ledermann, we thought we were getting a new type of -internal survey that would give us the tool to use from here on out, that we wouldn't have to keep using these surveys. It should still be good,, The tools he used should be usable now by our Personnel Department in re-evaluating, I don't see how for $49000 an outsid * e agency could come in and tell us what cities we should use,, It is our responsibility plus the Personnel Board to decide what the cities are that we will use for comparison. City Manager, Mr,, Aiassa- I would like to have the Council accept the Personnel Board's recommendation and refer it to the City Manager to negotiate with Gold And Thomas Company, Inc,, or contact Mr. Ledermann for this, I doubt if Mr. Ledermann would come back. Councilman Snyder-, Does private industry do this sort of thing or do they use their own personnel staff to arrive at these.decisions? Board and discuss'this because I doubt the value of.this. Councilman Heath: If we are going to go ahead we have to go ahead tonight and form up the contracto Councilman Towner: I think the Personnel Board's recommendation. should be accepted, It appears to me the thing we need to do at*this time is accomplish our purpose,, Motion by Councilman Towner, seconded by Councilman Snyder, and carried, to accept, the recommendation of the,Personnel Board and adopt it as Council action and authorize the City Manager to negotiate with Gold and Thompson Company, Inc. the written contract; that in addition' thereto that the Personnel Board and the City Council arrange a joint meeting to discuss the carryi . ng out of this motion,, Councilman Heath: Would the City Manager talk to the, representative of the City Personnel and ask them if they would agree to abide by whatever criteria the Gold and Thompson Company come up with? City Manager, Mr. Aiassa: We don't want to do this and have the Employees'.Association say thumbs down,, I will get this rough draft worked out and we will have a meeting with the representatives from the AssocIation.
