Barnes at 7:40 P.M. in the West Covina City'Hall Councilmah'To*h6k
led the Pledge of Allegiance. The invocation was* given by Dr. Konrad.

Councilman Towner.- I feel that the City staff has
done an excellent job in making
improvements in the plans and specifications as presented. I believe
the recommendations made in their memo of April 10 should be.accepted.
Move that the understandings
reached between the City and the State Division of Highways as -
referred to above be accepted as meeting the conditions of approval
given by the City Council at its meeting of April 61 1964; further
that the Lark Ellen Draing Project No. SD-6320 be included as an
integral part of the Vincent Avenue Interchange Project and the
staff be authorized to furnish City plans and specifications to
the State for such purpose,,
Councilman Jett: I.think there are people here
tonight who are interested in
this, I think it would be pertinent to see that these gentlemen
get a copy of this or that this be read into the Minutes.
(The following is a memorandum
directed to George Aiassa, City Manager from John Q. Adamsq Public
Service Director re Vincent Avenue Interchange and dated April 100
1964,)
"The City Council at its
meeting of April 6, 1964t approved preliminary plans submitted
by the State Division of Highways for the Vincent Avenue
Interchange improvements�subjeict to certain changes recommended
by the Staff. The Staff was directed to review these changes
with the State and to report to the Council on April 13, 1964

as to the results of these discussions and with a final recom-
mendation in this matter.
"The changes as recommended
by the Staff and which are listed on the attachment have
been reviewed with the State Division,of Highways. Results
of these meetings are summarized in the comments,made on
the attachment under'the applicable recommended change,
"In summary, the State
Division of Highways were considerate of the changes requested
by the City of West Covina, in those facets of design and
construction where the local office is not restricted in
the action it could take by design criteria and,policy
established by the Bureau of Public Roads, as well as by its
own organization, the proposals made by the City were, in
generalg agreed to,, In other areas, the State is now aware
of our concern with certain features' of theinterchange
design and have advised us that if problems I do develop after
completion of construction, corrective action will be taken
by the State,,
"During the review of the
interchange plans, the State indicated they would agree to
include the City's plans and specifications for construction
of,the Lark Ellen Drain from the San Bernardino Freeway to
the Walnut Creek Wash (Project SD-6320) as part of the
interchange contract, 'The State will also handle adminis-
trative matters relating to this project which involve the
Bureau of Public Roads. This action will effect considerable
saving in time and money for the City of West Covina.and will
not extend the construction time for completing the interchange
work,
"Recommendation:
"That the understandings

the Interchange to the bus ramps,

"The asphaltic concrete
rampq a portion of which now exists9 as- shown on preliminary
plans is the standard used by the State Division of Highways,,
In additiong State policy'is not to replace existinglacilities,
such as this ramp, which are in good condition and would
not be affected by new construction. ThepedestriAn. ramp
and walkway will therefore be constructed as shown on the
preliminary plans,
"2) Provide a pedestrian
over -crossing (separation) to the bus ramp on the east side
of the Interchange.
"A separation had previously
been proposed by the State and submitted to its Headquarters
in Sacramento for approval on several different occasions.
This concept was disapproved on the basis that a painted
cross -walk will suffice. No further action on this matter
is proposed by the State at this time.
"3) Complete traffic signal --
system at the intersection of Vincent Avenue and Center Street,
'I Has been recommended by
District VII to its Headquarters in Sacramento, A decision
has not been madeq however indications are that this
work will be approved,
"4) That the City of West
Covina salvage the existing signal system at Vincent and the
South Frontage Road. The contractor to remove and deliver
to City's Corporation Yard at 825 South Sunset Avenue,,
"State's contractor will
remove and stockpile on site. City will pick-up and deliver
to Yard,
"5) That the storm drain
portion of the plans reflect the approved design of West
Covina's 1958.Storm Drain Bond -Issue Project 589-0.
"State has reviewed designs
and found them to be technically in agreement.
"6) That construction of
the Interchange project be coordinated with that.of the storm
drain project, the latter to preceed the former,
"Interchange work will be
coordinated with storm drain construction, City of West.
Covina has an action item to discuss schedules for storm
drain project with the Los Angeles Qounty Flood Control
District for purposes of insuring that they interface properly
with schedules being proposed by �the State.

provide for this.c-onstruction, State also does not permit
sidewalk construction by the City within State-owned right

between Vincent Avenue and California Avenue adjacent to
the Eastbound off -ramp within existing right of way,,

of Public Roads and State Division of Highways criteria. The
State's position is that the lighting.shown on the preliminary
plan meets existing criteria and the cost of additional
lighting if installed as part of this work would be borne
by the City, If problems develop after completion of con-
struction which indicate that the additional lighting -is
requiredt then the lighting would be installed by the State.
"ll) All street lighting
shown�as;future be constructed and energized as a part of
this, -project.
"State is providing for
future installation of lighting at these locations as part
of the work required.to install standard lighting for this
interchange,, This procedure has been followed in other cities
for similar type of improvement. If problems develop after
completion of construction which would indicate a need for
this additional lightings the State will in -stall, otherwise
the City would be expected to pay for installation of the
additional work.

the opportunity to approve the proposed signing of surface
streets and intersections of ramps with surface streets,

transition be provided for joining State Street and the

with a lay -out for the proposed development of,State Street
to its full width. State will tie-in with this proposed
alignment.
14) That the two islands
at the intersection of Vincent Avenue and the ramps be
provided with a sprinkling system and landscaped.
State will provide a color ' ed
rock treatment on the islands, including installation of planter
boxes at the two islands at the Freeway and ramps, Details to be
worked out between City and State Landscape Architect.
15) That the two islands
.at the freeway and the ramps be either landscaped or filled
with decorative rock in lieu of paving.

Mr. Aiassa: We met with Mr. Schaeffer
and it might be pointed out
to the Council that contrary to us reviewing this and making this
available we did not delay any progress as far as the plans were
concerned because the resolution signed by Mr. Heath is the only
official action necessary and the only other signature required is
that if the City Engineer and we have executed all our actions. This
was a courtesy extended to us (State Highway Staff) that we could re-
view these items of improvement we felt were pertinent. Some of these
will not be recommended and approved subject to the Bureau of Roads.
You are only accepting plans, not specifications. The only power we
have here as far as the staff is concerned is to direct the City
Engineer to sign these plans.
Councilman Jett: This is not what I am talking
about. What I am talking about
is these 15 items, that were to be sent,to them and this is the reason
I voted against the motion because we approved the plans subject to
their acceptance of these recommendations. Now these recommendations,
most all of themwere already in the plans the State approved. They
weren't something new. Each item brought back here by Mr. Adams so states.
Mr. Aiassa: The reason why this should be filed
with the State Highway was at a
later date if something comes up not acceptable we are officially on file
that we didn't think what they are proposing was satisfactory. You would
not have this right later if we hadn't proposed this and so advised them.

What you sent in was exactly what
they proposed.
Councilman Towner: There is,, I think, this one
major item which has come out
as a result of this and should be brought to the public attention which
is included in the memorandum received by us and during this review
of the interchange plans the.State agreed to include the Lark.Ellen
Drain in this;project. Not only that, they handle these things on one
contract and the end result of it is that the City of West Covina
w ill save considerable time and money,, I think that is
i a major
achievement,
Councilman Jetto. The signalization at Center
and Vincent has been proposed
by the State and I will bring the letter to this effect to the next
meeting, On March 17, 1964, Traffic Signalsq Various Locations --
Vincent Avenue and Center Street -- "Plans for the reconstruciton
of the Vincent Avenue Interchange by the State include the extension
of Center Street to serve as the south Frontage Road between Vincent
Avenue and State Street, It is anticipated that traffic signals
will be required immediately upon completion of the construction
to establish effective right of way control,"
City Manager, Mr, Aiassa: There is nothing in that letter
stating that the State will do
it.
Public Services Director, Mr. Adams: The State is participating in
the Lark Ellen Drain because
it would require connection with the eventual freeway improvement
and they are contributing to the amount of $22,000.00. We were going
to put out a contract and administer it. We had serious considerations
how this would work out so the State has agreed to accept this as part
of the interchange contract,, We are sure we can effect considerable
time and saving by having them do it,,
Councilman Heath. -
Even though I am not in favor
of the Vincent Avenue plans, I
will second the motion,,

there is no private business which would be a civic center use ' .
The use we are proposing will be a high-class use certainly consonent
with the civic center plans and any use that could be conceived in
my judgement.
There being no further public testimony, the hearing was closedc,
Councilman Heath-. In reading the resolution of
the Planning Commission I get
an opinion here that the main reason this was turned down was the
fact they did hot think that the grounds for a variance had been met
and "also the Con='jssJ6n noted the necessity for adequate ordinance
controls for this type of use" and suggested that the ordinance be
amended rather than have the necessity of granting use variances.
Do I gather that the Planning Commission recommended that the ordi-
nance be amended to allow this use in a__C-1 ra7ther than have variances?
Planning Director, Mr. Joseph: No. The Planning,Commission
felt that if there is a weakness
exposed or an area within the ordinance which should be explored
further with an eye to amending the ordinance this should be done..
This is being done constantly. If a particular use' -come to
us and it is now set forth in one of the other zones and it is
proposed. to ask to be placed in another,zone,'to maintain the
integrity of the ordinance the Planning Commission believes we should
explore the possibility of seeing whether or not this use should stay
in its present zone or be put in another zone.' The' Commission's
concensus is because,a particular use is asking a particular location
and the ordinance doe's not permit it in itself is no reason to approve
the use,,

they expressed

about.this particular application

Councilman Jett: I donit�see the similarity of
this location with the one we
granted in another areao I think there we were in an area where . there
were family uses and lots of children in that area attracted to that
area because of the entertainment and I think in my opinion this was
one of the reasons we felt that would fit into that area. Taking a
look at this area, three bars in that area and there is no other
usage that I know of that would bring children to that particular area;
it is dark around there; I think there is certainly a lot of difference
between the two areas as far as the uses are concerned.
Councilman Towner: In the absence of any other
information I would have to say
that the showing for a variance has not been met. It may,exist but
it hasn't been shown, I think this ordinance change is under con-
sideration and may have some good solutions coming out of the
Planning Commission hearings. The picture.here so far as presented
to us tonight is certainly different than it was on the other appli-
cation, I can't see that we are in a position to grant this particular
request,,
Councilman Snyder.- I would agree essentially with
what has been said. I don't
think we are being inconsistent with our granting of the. other request,
either,,
Councilman Heath: I think we are being incon-
sistent in the fact that it
was pointed out there were three bars in this area. In the location
we granted the other billiard parlor I think there are as many
alcoholic beverage establishments as there are in this area. I feel
there is a similarity in this location with the one exception and
that is the amount of light on the outside of the building. If'the
outside of this building was lighted so it could be patrolled, I think
you would have the same conditions and environment that you have at
the place we granted a similar request last time.
Mayor Barnes: I cantt see any real justifi-
cation for a variance here. I
don't think the area particularly lends itself for this use. I quite

West Covina to'the Alcoholic Beverage Control
none can be sold within the
radius of 600 feet from any church or schoolo Therefores since
alcohol is being sold closer than 600 feet, a church does have the
right to come in our area. We are fighting the right when our
licenses are renewed at'the end of the year that they may be opposed
by anybody in this community. Having a church within the radius of
600 feet itself is not in our favor' to establish our business here

Councilman Jett-. I made the statement I didn't
think a pool hall should go
in here because our youth would be coming into this area, It is dark
and I think that the type of youth and people who would be attending
this church would be somewhat subjected to the same problems that
the youth would be subjected too I can't help but think there are
much better areas in which to establish a churcho We feel if the
businessman is in there and he is established regardless of whether
it is liquor or whatever it happens to be I feel he is entitled to
be protected as much as any new use coming in. I think I would need
further proof that this would be the location for a church before I

where it is found that the proposed use at the proposed -location would
adversely effect the. public health, welfare of the area or the
community.
Councilman Towner-, Secondly, I would -like to say
this: -We have to make these
findings that placing a church here would advers,ely._effect the public
peaceg health, safety or public welfare, Further,,I think we should
distinguish the variance request on the -'prior -hearing where the
conditions for a variance had not been established' on the record
and in this case an unclassified use permit where youlhave a different
situation where this use may be granted provided it is not adverse to
these public matters, It appears to me that a church normally -is.
considered an asset to a community and a benefit to the public peace
and welfare, It seems to me that this particular proposed location..
is one that faces in a different direction from'the opposing stores,
one that has a parking lot on the'other side and doesn�t have much
interrelation between the two uses, I don't think there is any
direct conflict, The fears of the people who are running the liquor
establishments nearby I think are not justified in'a case where a
temporary permit is granted to the church and the church comes in

other words, the commercial area was deprived of useful commercial
enterprise because there was a church established in an improper
zo ' neo Here we have a similar case,, You are moving a church in the
middle of established commercial on a year-to-year basis; you are
creating the same condition where you are going to deprive again
a commercial use of its just use because of the fact that they are
moving in a church,
Councilman Snyder: The one on Glendora Avenue
was not similar. The Chief
Of Police report did not object because there was a church next
to it* the police*�pointed out that the church was on a temporary
basis; he objected because of the amount of other b ' arsO' To say the
other was turned down because of a temporary church there is not
SOO They had,the right to protest to the liquor control and whether
they considered this I do not know but the City did'not protest on
the basis of the churchO
Councilman Jett-, I would like to call attention
here to one thing, If a
church is established a bar or whatever wants to come within 600
feet of itg,the law specifically states this is forbidden,, The law
does not say that if there is a liquor store there and a church
wants to come in within 600 feet or 100 feet that this is not
permissible, There is nothing spelled out there at all so it looks
like it is a one-way streeto In all fairness to everybody, I am
sure that a year from now when these liquor stores have to renew
their licenses there might be a different minister here, a new group
in the church who.might oppose. It could easily result in these
gentlemen losing their licenseso

our R-1,, We did have a case

meeting where the Personnel
Board interviewed some consultants and I thought one of the major
points we wanted.clarified was to determine whether we were going to
use 12, 21 or 100 cities in making our comparison. I tiink what we
wanted to know is what we are going to use for a measuring stick,, The
consultants came in and.were asked to study 12 positions and integrate
them into the present jobs which we have and it was -more apparent -as
it came along as stated in the second page that quite likely if you,
study only 12 positions and th ' en try to integrate them into the
present structure that some of the present structure will be effected
and youmight just as well go over and review every one of these
positions,, It would be very nice if we could have Mr,, Ledermann come
back who established the present positions and let him use the same
measuring d6vices in establishing these 12 positions but -unfortunately
Mr,,,Ledermann is not in the business any more so what we have been
confronted with is a relationship of job to job established by a
consultant and that consultant is not available now and now we are
going to have to askappther consultant to evaluate 12 different
positions and integrate them, Thi6 involves complications. It is
the feeling of the Personnel Board that they would hire Gold,
Thompson.and Cog Incorporated to review all job classifications,,

Personnel Board's feelings on

go on from there,,
Councilman Towner: Without having all the details
of it it appears to me they Are
asking this professional consulting concern to establish criteria
for salary surveys as part of a three-phase study and we would
consider that as part of a separate phAse,, I think in view of the
time situation involved and the recommendations' of the Personnel
Board that perhaps we should authorize that they go ahead with this
and the consul'tant will have the opportunity to review this phase.

written contract and in this written contract we will specifically

go along with their recommendation that A specific written contract

Attorney and your approval and then you will know what you are
getting for the contract,
Councilman Snyder: When we hired Ledermann, we
thought we were getting a new
type of -internal survey that would give us the tool to use from
here on out, that we wouldn't have to keep using these surveys.
It should still be good,, The tools he used should be usable now by
our Personnel Department in re-evaluating, I don't see how for
$49000 an outsid * e agency could come in and tell us what cities we
should use,, It is our responsibility plus the Personnel Board to
decide what the cities are that we will use for comparison.

accept the Personnel Board's
recommendation and refer it to the City Manager to negotiate with

,City Attorney, Mr, Williams.- We have to use the 1963
assessment roll,, This is a
manifest error so it is our intention to appeal,, I have had a call
from Mr,,Yount who is under purchase escrow and indicating that in'
his.opinion it is very likely this can be settled. I have talked to
Omelve'ny and Myers today and if we do arrive at a settlement of some
kind we will jointly ask the judge to set aside this judgment he has
signed, I think even Bill Moore��'thinks it is erroneous and set it
at large again and stipulate it can be held until the settlement is
completed and then we.can ask the judge to sign a settlement.'
Mayor Barnes: Wouldn't it be a good idea to
indicate that we are going to
appeal?
City.Attorney, Mr. Williams: We have already indicated that.
We are.going to appeal but the
timing on this appeal with respect to postponing and whatnot is
important, We have 60 days to appeal and there is no use jumping
off that end yet, If we can get the judgment corrected in the trial
court, once you file the appeal you can�t get back into the trial
court,,
Councilman Snyder: .Mr,Yount called me and I indi-
cated to him to call Mr.
'Williams and that I couldn't give him any answers,,

Motion by Councilman Heatht seconded by Councilman Jett) and carried,
to accept the..action of the Review Board of March 30, 1964 and that
it be placed on file,
SUBSTANDARD BUILDING ORDINANCE
City Manager, Mr,, Aiassa: This ordinance would provide
us with a tremendous tool to
get rid of some of these structures we are now fighting,
City Attorney, Mr� Williams: This is done by giving the
property owner a notice of the
deficiencies and he can either correct them or tear the building
down and if, he doesn't the City can do so and put the cost on the
tax bill,, Azusa has'used this to demolish some 60 structures that
were substandard� The County of Los Angeles has copied our forms
and are using them in San Dimas and a number of other places,
Mayor Barnes: What would this do in effect
to help us with the Ruppert
property? Could we effectively use this? '

getting this ordinance. I am
also suggesting to Bill.Fowler we use thes ' � forms before we have.the
ordinance in effect, The difficulty with 203 is it has,the desi gn to
get rid -of things; it -'does not provide for advance notice and
opportunity to be heard.and therefore in my opinion would I be un-
constitutional so before . u ; sing it we have.a.m.e.nded it to provide for
notice and opportunity to be heardd*l;The County Counsel.followed with
the same amendment in the!County ordinance. I don't think you can
take any action tonight'.,butlindica:te whether or not you are in.favor
of lot so we can pursue it,,
City Manager, Mr. Aiassa.: Instruct the City Attorney to
proceed in preparing the
necessary documents, review and approval of this ordinance.
Mayor Barnes: I think we would all like.to
see this done.

to instruct the City Manager to take the steps necessary to abate
the Ruppert structure under the Azusa procedure.

FIRE ENGINE
Councilman Snyder- Do you remember Pedro Simpkins?
He apparently took over an old
fire engine that they had at the Mexican labor camp and he is house
confined for the rest of his life but he wanted to give it to the
sister city in Mexico. I didn't think that was too practical but I
have to answer him anyway,
Councilman Towner: We would have to clean it up
if we were going to send it
down there,
Councilman Snyder: What is my best way to proceed
with this?
Councilman Towner: If he wants to put it in working
cond-Ltion and restore ff so it
is a suitable gift I think it would be a reasonable gift.
