Councilman Heath led the Pledge of Allegiance. Councilman Jett gave the invocation. ROLT. rAT,T. Adams, Public Services Director Mr, Gerald Klein, Engineering Department Mr. Harold Joseph, Planning Director Absent, Mr. Harry Co Williams, City Attorney CITY MANAGER'S REPORTS GLENDORA AVENUE REPORT DMJM - report Project MP 6432 Councilman Snyder-. I have a question on the matter of procedure. Since this report will probably result in changes in the General Plan, shouldn't this first be presented to the Planning Commission and they hold hearings and then come to the Council? Why are we doing it this way? Mayor Barnes: I talked to Mr. Aiassa about it and he asked that Mr. Byron Barnes be allowed to speak thiseveningand that the Planning Commission be invited to listen to the presentation, I believe the deadline date has passed for presentation of_their report. Councilman Snyder- To effectively make a good change in the General Plan, Mr-. Barnes is only presenting nting his opinion from his viewpoint. It should be pre- sented through the Planning Commission and modified both by public hearing and the Planning Commission before it is brought to the Council. Councilman Jett: I think our contract calls for this report to be back to the City Council on the 30th; however, theywereunable to get it back by that time. I don't recall the motion stating that this was to be referred to the Planning Commission for a report. I understand this is only to be a presentation tonight but no action is to be taken. C,, Ca 4/6/64 GLENDORA AVENUE REPORT (DMJM) - Continued Page Two Mayor Barnes- We may want to refer it to the Planning Commission,, I would like more time to study this report myself. Mr,, Byron E,, Barnes The report is based on an Director of Planning extensive economic analysis of DMJM the general market area of West Covina and a precise analysis of the market potential for Glendora Avenue, particularly that portion of Glendora Avenue extending from the Wash to south of the La Puente City Limits, a linear distance of something over a mile and a half- Our analysis of land uses, the factor of influence that one use has on another, the uses of the existing residential on the nearby vacant land, commercial on other properties, delineated for us a study area of approximately one mile in widtho The results of our economic analysis, our physical analysis of land use quality and analysis of the relative value of the condition of the structures, buildings and uses along Glendora, our analysis of the traffic cir- culation and projections of these economics, planning and traffic into the future has resulted in a series of conclusions,, For example, our analysis of the economic potential for office buildings and construction in the West Covina area indicates that within the next five years there is • a potential for approximately 100,000 square feet of office space,, Our analysis indicates that'Glendora Avenue can capture approximately 40% of this market or approximately 409000 square feet,, For residential development, the market for multiple residential in the West Covina area indicates that there is a market for approximately 2,500 multiple family units in the next five years,, With the provisions of land use control, traffic ways improvement as recommended in our report, the Glendora Avenue area can capture approximately 500 or 20% of this market. The potential uses for strip commercial, service commercial, are considerable along Glendora Avenue,, We cannot justify a market for convenience shopping along Glendora Avenue to a greater extent than the potential expansion in and around the existing convenience shopping center identified by the Von's Market,, We find that Glendora .is a major artery to and from the downtown area of West Covina from the south; that as such it is and could become more of a prestige avenue of a desirable higher economic demand approach to the downtown area and to West Covina itself,, The need for the standards, controls and community improvements to maintain and improve the prestige quality of Glendora Avenue is there,, There is approximately 65 acres of vacant land within the area studied,, There is a market that can be developed for about 35 of these acres in the next five • years,, The remaining acreage it is desired that it be maintained at a recommended zone to make it available for development after that five-year period for a number of reasons, one of which is as the City of West Covina continues to mature there is an increase market for additional institutional uses, churches, social facilities, and the like,, Some of these uses are appropriate on Glendora Avenue and would contribute to its status, its dignity and assist to maintain this prestige quality and element,, -2- C, C, 4/6/64 GLENDORA AVENUE REPORT (DMJM) ® Continued Page Three The additional development of convenience shopping in the area can be adequately satisfied within the Von's Shopping Center area that is capable of considerable expansion, about half again more than the amount of square footage presently existing, There is a considerable amount of Rml fronting along Glendora Avenue, The R-1 near the La Puente City Limits is healthy and we recommend that it remain, The portion of R®1 that is presently existing in this area (indicating) is fronting Glendora, the depth of the lots, the condition of the structures is such that we recommend its gradual change to a R®2 zone or a more intensive residential development, There are a number of changes in land use that we are recommending and I would like to indicate some of these street and traffic recommendations beginning here at the southern end of Glendora near the La Puente boundary where Merced is presently being improved across Glendora with Truman Place presently coming in and cutting back at rather an awkward circulation angle into Glendora, We recommend that this short stretch of Truman Place be abandoned and that Truman Place be turned to intercept Merced at about this median island, be extended also •number of cross have the traffic Quite important in our recom- mendations is the extension of St, Malo Street to extend from its present dedicated stub and that a new street be constructed adjacent to the shopping center through these vacant lands to the west of the shopping center to California, The improved streets will open this vacant land to a desirable use of multiple residential that would support and compliment the other multiple residential presently existing and the increased service that multiple in proximity to a shopping center would receive. The extension of a new street inter- cepting Glendora would open up the market area of residences in this area west of California as convenient patrons of such a shopping center to the extent they would not have to effect a very circuitous route to reach their daily shopping, We recommend Sandyhook Street to intercept Merced for purposes of eliminating the streets that are otherwise needed along Glendora to feed into Merced giving a more valuable frontage, Our recommendations of streets would retain the improvements made on the cul-de-sacs presently stubbed off9 that they not be cut through, They provide a controlled neighborhood without inviting a great deal of through traffic and create a desirable neighborhood, We recommend that the improve- ments on Service Avenue and along the entire strip of Glendora be improved with a median strip, The median strip would be central to a cross section width of 110 feet of right of way necessary to accomodate six full moving lanes of traffic and the six full moving lanes of traffic are most necessary to accomodate the daily traffic count which we can project with quite a deal of surity on the market for the surrounding area, The signalization should be synchronized along Glendora as recommended on our plan and shown by these large dots on the map, We have the additional recommendation of traffic facilities of a signal between the new Towne House m3® C, C, 4/6/64 Page Four GLENDORA AVENUE REPORT '(DMJM) m Continued development and the Catholic school located across Glendora where the traffic access can be unified with the residential on one side and the institutional on the other to provide a more accessible and more easily travelled and used cross through the median strip, The uses proposed on Glendora are shown R®1 near La Puente, multiple on both sides of Merced where it intersects into Glendora, the continuation of the development of the convenience shopping center here at Von°s, and the development of offices within the existing zone across the street, We are recom- mending that multiple residential be developed to surround the convenience shopping (Von°s) with a Rm2 zone as a transition between this multiple residential and the R®1 which would be continued along California, The development shown north of the shopping center is for office development as presently proposed and_a recommendation for a new combined zone of several large parcels presently vacant, a planned development zone. A planned development zone would provide and recommend that the development here should be reviewed with the Planning Commission, that it would allow for residential and office and some commercial provided that the manner of development and the intensity of development was consistent with the economic potential for the area and consistent with good development standards, It would allow for greater flexibility of use and we would recommend an incentive be added to the development of these larger parcels wherein • the parcels are developed consistent with good development practices, an incentive of allowing the density or intensity of dwelling units to be increased within very definite recommended standards from the standard R-3. On the recommended zoning map recommended at Vincent just south of Glendora is a zone of planned development, A planned development zone uniting several individual parcels and is recommended they be developed not all at one time or all at one use but in relationship one to the other so that one group of buildings is planned and developed with the knowledge of what the future buildings or development will be on the adjacent parcels, With such a fore knowledge greater latitude and flexibility can be allowed in the development of these parcels, Without the flexibility we would recommend that this large parcel be developed for R®4. The present zone on the next property of multiple residential, we would recommend that this large parcel also be planned development, zoned allowing for its planned development in combination with the institution immediately adjacent with recognition of what is being proposed and being developed on the opposite corner, planned development with the standards we are recom- mending in our report would allow the combination of multiple residential and professional office provided they were reviewed and found to be in harmony with themselves and with the adjacent development. Other- wise, we would recommend that the development on this very large ,,parcel of approximately 10 acres be developed as R-3, An additional recommendation in zoning is an amendment to the present R®2 zone, The present R-2 zone allows 10 units per acre, The R®2 zone as recommended to be modified in certain locations, we would recommend that the density be increased, that up to perhaps 17 units per minimum lot size is compatable with the thoroughfare, is compatable with its location and the adjacent uses; certainly it is compatable with the, existing market that we can determine, Such an addition or amendment to Rm2 is not recommended to the City on all R®2, -4- C. Page Five We make these recommendations following a review of the full zoning ordinance, following a review of what we feel is compatible and recommended for Glendora, following a review of the standards which we have recognized are being followed in the City but not with the opportunity to reTiew the effect of these standards throughout the City and not with review to these zonings being recommended throughout the City, only where we are able to show them in this rather contained area. The recommendations on zoning for commercial is retain the commercial and professional as:existing on the east side of Glendora opposite the shopping center, make additional recommendations for commercial through to just beyond Merced as being desirable, as being in demand for this type of use and not incompatable at all for the service they could perform and provide to the area. The parcels are identified one by one in the report and each parcel is identified and examined and the market potential for the entire area is related to each of the parcels that are vacant. The planned development is recommended as a zone for your consideration and recommended for all of the larger parcels and are indicated on our recommended zoning plan and a more • full review of the manner of implementing such zoning and continuing and adopting such zoning is given in our limitation section. SThis touches on the major„area of coverage in our report. I, would like to introduce to you the two gentlemen most intimately involved with all aspects of the detail, Mr. Ken Norwood, Project Planner and Mr. James Kubelbeck, Staff Economist for D.M.J.M., both of whom have done a very creditable job. We would be pleased to answer any questions you might have and we are at your service and disposal. Councilman Snyder-. In your determination of ` projected increase of density, was this study made just in relation to Glendora or the entire City and the Valley? Mr,, Byron E. Barnes.- The increase in multiple was made for the entire East San Gabriel Valley,, Councilman Snyder-, In increasing this density did you relate this to the General Plan in whether we are able to service this increased density with parks, schools, and those other functions of a City? Mr. Byron E. Barnes-. The plan was done as a proposed amendment to the General Plan. •We reviewed and analyzed this very thoroughly prior to our making any analysis or recommendations. We did not recommend any additional parks within the limits of the study area between the La Puente City limits north to the Wash. Councilman Snyder-. The recommendations here for. both commercial and multiple family you said you have related to the General Plan; however, does this relate to possible increases in density in other sections of the City? -5- C, C, 4/6/64 Page Six 'GLENDORA AVENUE REPORT (DMJM) - Continued Mr, Byron E. Barnes: The projected population for West Covina within the next six years will be approximately 75$000, This population given the types of residential areas that are available, the increase in multiple apartment development within the City will further develop. Councilman Snyder: In your recommendation for 40,000 square feet of office space$ did this take into consideration that there is at present five high-rise office buildings planned in the City of West Covina? Mr, James Kubelbeck: Yes, it does. The projections as they were stated in here are those that are in addition to what is planned currently in the City. Councilman Heath: I think this is a fine report and you gentlemen have done an excellent job on it, A point of clarification on one of the questions asked by Dr. Snyder. I understood you to make the statement that there is a need for 2,500 more multiple residential units. Does this mean within the boundaries of West Covina or does it mean in the east end of the Valley or within this general location or what? Mr, James Kubelbeck: It is difficult to talk in terms of a political city as an economic entity but when you are talking about 2,500 units •this would be in general the area immediately adjacent to or within the confines of the City of West Covina and assuming that Pomona, Covina, Azusa, Glendora, et cetera, that these areas would be more -- well, this would be 2$500 apartments spread among the areas of the City that have apartments and 20% of this demand could be conceivably sustainable along Glendora Avenue, Councilman Heath: You stated in the beginning that you considered Glendora as a main artery and it is not classified as Route 39. In the very near future Azusa Avenue will be cut through and the designation of Route 39 will be moved to that location. Have you taken this into consideration when you made this study that there is a possibility that the traffic count may be less due to the opening of Azusa Avenue? Mr. Byron E. Barnes: We took into account the pro- posed development of Route 39 and evaluated what the effect would be on Glendora, the effect on the traffic on Glendora. The traffic count will diminish for a time and then climb back up and exceed those days and our -projections are based on taking this into account. Councilman Towner: One of the things we should recognize is that the suggestions and the full benefits of the study as accepted by the City will •materially effect the General Plan and perhaps put a new look on many aspects of our physical development in the City. I think these people have come up with some very interesting and in fact exciting ideas which may be applicable in other parts of the City. I haven't yet read the study to fully comment on it or relish.it or digest it. It is a very thorough report and it will take considerable time to do it, I am very pleased with it. IM C, Co 4/6/64 Page Seven GLENDORA AVENUE REPORT (DMJM) - Continued Mayor Barnes: I also think -the study is very good, On Truman Place, you snow the traffic flow turning into Merced, Do you see any traffic. problem at that point where traffic is coming into a street that is making a curve? Mr, Byron E. Barnes: I do not see a traffic problem there of any consequence. We have certainly taken this specific recommendation which was made by our Traffic Engineers through out other traffic engineering section. It is a more desirable turning radius and traffic radius on the street as proposed, The problem with.it is achieving it, recognizing the fact that these R-1 units are here, The difficulty is while this property is presently vacant, there is a substantial house at this point, a house in good repair, a handsome house, quite old,. which is of no quality judgment at all, just a statement, Provided it were desirable for that house to be used or the property to be used for some other use in the future, this has to be worked out over a period of time and we recommend that the street be closed because the addition of this parcel would make this a much more valuable piece of property, It would better provide and have space and room to provide better development for the proposed use, be it professional, multiple residential, whatever. This cannot be achieved for some time, It does pose a problem in effectuation, not a problem of traffic cir- •culation, Mayor Barnes: You did recommend some additional • R-2, We have a problem at present with people in the R-1 being unable to get out on the street with this terrific amount of traffic. I would wonder why you recommended R-2 for this area when it would more than double this type of hazard on Glendora Avenue, Mr, Byron E, Barnes: We only recommended R-2 where it has an alley backing it and we recommend the traffic access be from the alley, Mayor Barnes: Thank you very much for pre- senting your study, Mr, Byron E, Barnes: I want to thank the staff and the people in West Covina we had an opportunity to work with, We received every consideration and assistance in securing the materials we needed to do the study with, Councilman Heath: You have Planning Commissioners here who might have questions they would like to ask, councilman Snyder: The correct way to amend the General Plan is for this study o be presented again to the Planning Commission in public hearings here the people also have a right to speak on this plan and the Planning Commission can hear all this and either accept it as is or make modifications as they see fit in relation to the whole General Plan, This is not the normal procedure for amending the General Plan, Mayor Barnes: We are not trying to amend the General Plan, We are hearing the report, -7- co C, 4/6/64 Page Eight GLENDORA AVENUE REPORT (DMJM) - Continued mR� Councilman Snyder: I would suggest these men be paid to come back at the public hearing where they can be asked questions not only by the Planning Commission but by the'public, Mayor Barnes: At this time I would like to see if any Commissioners would like to ask questions, Chairman Renwick: I just ran a quick poll across here and basically we would like to express our appreciation for being invited to listen to the presentation tonight but we would like more time to digest what is actually in here and then present our questions at this time because we don't feel we are prepared to ask questions at this moment. Motion by Councilman Towner, seconded by Councilman Heath, and carried, that this proposal from the Daniel, Mann, Johnson, Mendenhall be transmitted to the Planning Commission and that they forthwith make arrangements to hold hearings on the proposed amendment to the General Plan in consideration of these proposals. Mayor Barnes: Do you have a fee that you can • mention at this time? .Mr, Byron E, Barnes: As per our agreement our standard billing rate is on an hourly rate and for the particular professionals involved it is $125.00 per day per man, Mayor Barnes: Thank you very much, City Manager, Mr, Aiassa: According to D,M,J,M,'s contract with the City we were supposed to pay them $20250 as part of this payment with the submission of their report and on completion they were to be paid the additional $20500,00, Motion by Councilman Heath, seconded by Couhcilman Towner, to direct the Finance Officer to pay the $29250.00 to Daniel, Mann, Johnson and Mendenhall and after the meeting with the Planning Commission pay them the next $29500,00, Motion passed on roll call as follows: Ayes: Councilmen Towner, Heath, Snyder, Mayor Barnes Noes: None Absent: None Abstained: Councilman Jett 01 UTURE PARK SITE (STORM DRAIN PROJECT •FC 150) Hollenbeck and Cameron City Manager, Mr, Aiassa: Cameron, You directed me to determining the value of this one for the storm drain right $39000 and they also quoted We have a cost estimate for an apprai- sal -of the park on Hollenbeck and obtain a quote for the services on property. They submitted proposals of way which ranges from $1,500 to on the park, They will give us both Ca Co 4/6/64 FUTURE PARK SITE (STORM DRAIN PROJECT C-150) - Continued Page Nine appraisals for a price ranging from $3,500 to $4,500 if the appraisals are done concurrently. In other words, he will do the easement appraisal and appraise the property for the actual -value of the property if we want to acquire it for park purposes.: This is the bid from Harrison Baker. I.haven't asked any of. the other appraisers to bid. Councilman Heath: Councilman Jett: problems. This is truly a big project. I think the bid is too high. I would like to ask for another bid. I think one of the big problems there is our flood control Councilman Snyder: That is why his costs are high because it involves engineering reports. Councilman Heath: I will withdraw my statement. - I forgot this was seven acres. In reconsideration, I will withdraw my comment. Councilman Towner: It seems to me considering the nature of the problem iinvolved that this probably is a realistic sum. • Motion by Councilman Heath, seconded by Councilman Jett, that we engage Harrison Baker to make an appraisal of the approximate seven acres at the corner of Hollenbeck and Cameron as outlined in his letter of offer dated April 6, 1964. Councilman Snyder: Councilman Heath: Your motion includes the ease- ments that go along with that? Yes, as outlined. Action on Councilman Heath's motion: Motion carried. ACQUISITION OF NEW FIRE STATION NO. 2 Project LA 6413 City Manager, Mr. Aiassa: We do have a firm appraisal for City Project L.A. 6413 for the relocation of Fire Station No. 2 on the east side of Barranca Street. (Read report re this matter.) Motion by Councilman Heath, seconded by Councilman Snyder, and carried, that the City Manager be authorized to meet with the property owner and consult with him on the basis of making him an offer of this pro- posal. City Manager, Mr. Aiassa: I have a payment due to Harrison Baker for $850.00 for this appraisal. It was made back in October of 1963 and it was felt after our moving into our office that he would like to look at more recent sales,, Under no circumstances does he feel there are severance damages. He has come up with an offer of $11,000.00. . City of West Covina, it was indicated to the staff that a pilot area or project should be created with an approximate cost of $100,000,00, The staff was to resubmit its recom- mendation to the Council once the limits of the pilot project had been determined. Because of the large amounts of money being discussed in projects such as this and the limited City funds available for this work, if the City Council desires to participate, we would recommend the following procedure; "1. Major highways (1.00 feet of right of way) .City to participate to the extent of constructing or reconstructing the center 48 feet of pavement, 112, Secondary highways (80 feet of right of way) City to participate to the extent of constructor reconstructing the center 24 feet of pavement, "If the City Council is basically in agreement with what has.been recommended in this report, we would suggest the following procedure be adopted: "l, The City Council approve the proposed Improvement District, "2, The City Council authorize the staff to poll all affected property owners in an attempt to obtain right of way and necessary improvements, "3. Establish two separate projects, the first to include those parcels where it is necessary to condemn the right of way; the second to include those parcels where no right of way is required. If some of the above property owners do decide to dedicate right of way, it may be necessary for the pilot district to be either a district requiring -12- C. "Recommendation° "It is the recommendation of the Engineering Department that the City Council approve and accept this report and authorize the City Engineer to proceed. "If the City Council approves this report it is requested that the indication be given to the staff as to whether they wish to observe this pilot project in an attempt to determine the feasibility of this type of project or whether the staff is to proceed with additional • projects." Councilman Snyder: If you set up a district like this and some of the property owners dedicate right of way and you have to condemn others, how do you make this fair? Mr. Klein: Those who do not wish to dedicate will be in a different project. Councilman Snyder: Under the 1911 Act is the right of way created against their assessment or how is it handled there? Mr. Kleine The right of way acquisition is all chargeable to the district and the assessment is recharged to the property owner. Councilman Snyder; In establishing your priority for this first district, I have had a lot of questions especially recently about Citrus Avenue from the freeway to Cortez. Was this considered in this district or ,are you waiting to put the storm drain in first? Mr. Klein; We originally put in eight or ten streets and Citrus was included. The reason we didn't suggest Citrus at this time was because of the proposed storm drain. Barranca is a little different in that we would have to get together with the County because the intersection of Cortez and Barranca is within the County; Especially with South Hills High School this is a high priority street, Councilman Snyder: It is also obvious that many of these are going to sit for years unless we start projects like this. Motion by Councilman Heath, seconded by Councilman Snyder, to accept the report of the City Engineer concerning the uncurbed and unguttered progress report dated April 6, 1964 and instruct the staff.to proceed with this proposal as a pilot project and attempt to determine the feasibility of this type of project for future City projects, Councilman Towner: Apparently the staff is interested in knowing whether you want this pilot project carried through to completion before they begin any work on any similar projects, I am not so sure we want to delay other projects until this one is carried out unless we have some idea as to how long it will be, Councilman Snyder; It wasn't my intent that we • would delay others, Mayor Barnes: I would like to see the Engineer- ing Department go ahead with other projects that we know are very deficient and that we know should be done possibly following this, Councilman Snyder; I thought you were going to go ahead with a group of districts like this, that this was merely to be the first one, Mayor Barnes; I think it might help if we had a larger district because the price might be more reasonable for everybody, Councilman Heath: The reason for the motion is here we have the plans for a pilot project which is ready to go and I would like to see them continue, I don't think we should use the same type of project on these additional pieces of land until we see how this works out, This does not state that we don't want the staff to go ahead with the plans and specifications. The only thing I am saying is that the formation of a 1911 Act, the discussion of condemnation or no con- demnation, et cetera, is what we should try out on this pilot plan. In the meantime if they want to keep on drawing plans and specifications for these other projects I have no objection to that, Councilman Snyder: I think they should be directed to if they haven't already been, Action on Councilman Heath's motion: Motion carried, -14- C. C. 4/6/64 Page Fifteen CITY MANAGER'S REPORTS - Continued JAMES MON.TGOMERY PROPOSAL Water Rates Mr. Aiassa: It appears by another project that they are doing under their own company that this Azusa Water Company rate will not be feasible for them to come forth and make analysis on this proposed rate increase. You might authorize the City Manager to contact Leeds, Hill and Jewett and let them make an offer to do this study of this increase because Montgomery can't do it. We know what limitation this will incur and the price won't be any higher than it would be from James Montgomery. Councilman Jett: Would this also include the request by Suburban? Mr. Aiassa: They are not involved With this. There is another letter coming on Suburban's:proposal from James Montgomery. This is the one they have an ethical conflict with serving to agencies. Councilman Heath: I expect in the very near future that we are going to be confronted in mass by a number of water companies for an increase in hydrant rental and they are going to do it as a mass movement so in this motion I would like to include this provision. • Move that the City Manager •be instructed to contact James Montgomery and request that he work with Leeds, Hill and Jewett to gather whatever information necessary for a study of water rates in the general area to be used in the public hearing on the request for increased rates and at the same time that a report be furnished us stating the rental hydrant rates of all the water companies in the area. Councilman Snyder: Mr. Aiassa:' Councilman Snyder: Councilman Towner: Mr. Aiassa: Water companines pay no franchise, is that correct? They do but they are long term with no rate increase and low rates. I will second the motion. I understood Montgomery was not available to work in connection with this report. He (James Montgomery) couldn't make the report because of con- flict. Councilman Towner: The information that would come from Montgomery to share with Leeds firm and this is information we already have in our booklets and pamphlets? Mr. Aiassa: Yes, except Leeds, Hill and Jewett would probably like to converse with them as to how they arrived at their data. This appears to be mutually agreeable. S. Johnson, Director, Department of Parks and Recreation of Los Angeles County by Ronald F. Paige, Parks Superintendent re this matter, I would like this spread in full in the Minutes: "Thank you very much for giving this Department the opportunity to assist the City of West Covina in the development of your Galster Wilderness Park, "Since receiving your formal request, we have had a chance to review the material you sent us, Based on this information, we want to make the following proposals: " the City of West Covina with: This Department will furnish • "1, Development Plan This plan will encompass the total area of the park, showing all improvements contemplated, This document will serve, essentially, to establish the kind of proposed improvements, define their location and their approximate sizes, It will also show proposed access to and from the property in question, as well as circulation within the park. Relationships between the various elements and their supporting units will also be established. We further propose to furnish your City with a rendered print of this plan for conference and presentation purposes, 112, Narrative Description This report will more fully describe the functional elements identified on the plan. The additional area for parking evidently is ready to proceed, Mr. Galster asked me to contact Mr. Williams and the two attorneys will get together to settle this additional land for parking area for Galster Park, However, I would also like to make one other suggestion, that when Mr, Paige of Los Angeles County Parks and Recreation Department makes his study along with the Commission and our Parks Director that the Girl Scouts and Boy Scouts be included to give their thoughts on this because I have already received a letter from the Girl Scouts asking and saying they could accept this area and,I am awaiting a letter from the Bov Scouts District for their comments. I am sure it will be along the same line as the Girl Scouts, I think they should be included and I think the Council should be notified so we can have representation from these people at the study meetings, Mr, Robert Gingrich. In our preliminary discussions with Mr, Paige he is quite aware of this and went over a copy of the deed as dedicated to us. He is a head of the planning for the Boy Scout Council so I know he is aware of the fact that there are three acres for each of them to be set aside, City Manager, Mr, Aiassa. Mr, Dosh did submit these new • agreements to the Galsters. We are waiting for one of them to make a decision, • Motion by Councilman Heath, seconded by Councilman Towner, to accept the recommendation of the Parks and Recreation Commission and enter into an agreement with the County for a master plan of the Galster Wilderness Park not to exceed $1,000,00. None JOINT DEVELOPMENT WITH SCHOOL DISTRICT Tennis Courts City Manager, Mr, Aiassa: I have a memorandum from the Parks and Recreation Commission addressed to the City Council re this matter, (Read said memo,) Mr, Veronda After several meetings with the Chairman Unified School District we have Parks & Recreation Commission discussed various areas we could participate in jointly. It was agreed that the administrative staff from the West Covina School District and our Recreation Department would work together to come up with a satisfactory plan that would mutually be of interest to both areas. As a result of their meetings, this is the first of the joint plans to come up and we think it is a very good initial project, a much needed project, and one we feel we can get underway and lead to future developments in the future. The estimated cost for the three tennis courts would be $6,100 and the West Covina Unified School District would support 60a of that. I think we should find the money somewhere and perhaps we should have some further information from the Finance Director or the City Manager as to where it is to be taken from, City Manager, Mr, Aiassa: I think we have to have the City Attorney prepare a formal agreement in conjunction with the County Counselor and the Council must accept this.this type of a proposal of the share of $2,500 to cover 40% and I will have a report for you as to where you will get the money, • Motion by Councilman Towner, seconded by Councilman Snyder, that the provisions of the recommended agreement be approved contingent upon • the School District also approving the agreement and that the City Attorney be directed to prepare the contract and that we appropriate not more than $29500.00 to cover our share of the cost and the City Manager is to report to the Council the source of the funds. Councilman Towner: Move that it is accepted as Council policy that a person that is on industrial disability receive salary for no more than one year subject to credit for temporary disability compensation payments; that this is to continue only during the period the insurance company continues temporary compensation; that upon the expiration of•one -18- • • ClC. 4/6/64 'PERSONNEL RETIREMENT - Continued Page Nineteen year or upon the discontinuance of temporary disability compensation that the employee then be either returned to work or terminated; if he is terminated steps promptly be taken to arrange disability retire- ment in the event the employee.is otherwise eligible; and further move that the Odle case be handled administratively in accordance with this policy. Councilman Snyder: There are some industrial injuries that are not stabilized for two years. When you say terminating the disability but they may again stop the temporary disability payment in awaiting the settlement but still within some time after the end of the year they could return to work. I am thinking of leg fractures that are not really stabilized within a year's time but will stabilize within two years as the maximum stabilization period. Councilman Towner: In those cases we would continue the full salary subject to credit for temporary compensation up to one year. Beyond that date he no longer receives a salary. Councilman Snyder: I can think of some that might return to work after three months after the end of the year, be able to, which really shouldn't be terminated. Councilman Jett: Mayor Barnes: particular case we should settle this one. I think other cases from here on as stat,ed.- by, -Councilman Towner. Councilman Snyder: clarify some of these others later. Couldn't that be handled on a separate basis? We would like to suggest that the City Manager be directed to take these recommendations to the State Division of Highways and meet with them and make the State cognizant of these recommendations, Councilman Jett: I won't go along with that. We asked you to bring a resolution here tonight that would give the final approval of this. This is what we requested that you do, No more of going down and submitting this and submitting that, Councilman Snyder: The only thing is that we want to have Vincent Avenue Inter- change finished but if we can get any improvements to it I don't see how this is going to.hurt anything, Councilman Heath: Why were these things delayed since last June? City Manager, Mr, Aiassa: By an order of the City Council, The motion was we would present these plans to Victor Gruen and he would have them back in seven • working days and that was to the Highway Department last June, We had an interchange we sent in the and meantime we have done nothing and it is almost a year later, Councilman Snyder: You have consistently said you didn't like this inter- change as finalized, -21- I. 0 9 • Co C, 4/6/64 Page Twenty -Two VINCENT AVENUE INTERCHANGE_PLANS AND SPECIFICATIONS Continued Councilman Heath: Don't try to blame one individual for holding up this whole inter- change, Councilman Snyder: I am not accusing you of holding this up, Councilman Heath: I have told you in the beginning that I am not in favor of this design, I have showed the fallacy to a number of people and I am not going to vote for -this, Councilman Snyder: What I meant was you have again said you are not in favor of this, If you are not in favor of it, then why would you object to submitting these recommendations to improve the interchange? Councilman Heath: I didn't say that, Councilman Snyder: If you didn't. I apologize, That was a misunderstanding, Councilman Jett: In a communication to us as of March 17 on Page 2, second paragraph, Vincent Avenue and Center Street -- "Plans for the reconstruction of the Vincent Avenue Interchange by the State includes the extension of Center Street to service the south frontage road between Vincent Avenue and State Street, 1. It is anticipated the traffic signals will be required immediately upon completion of the construction to establish effective right of way control, It is therefore requested that consideration be given to incorporating a signal installation design into construction plans for this intersection and that the State participate finally in this installation," This has been going on and these recommendations are part of this letter and I see no reason to continue this, You told us you would study this plan and come back with a formal resolution for approval. If this is a resolution that you have ready for us tonight, something to go back as a final approval with a suggestion of these recommendations, fine, but not that it be held up or that we hold it any further. I will not go along with holding this any longer, City Manager,.Mr, Aiassa: I have delayed this on behalf of the Council because the Center Street item has not been settled, Councilman Jett: I had no part of delaying this and I want the record to show you did not delay this on my part, Mayor Barnes: I think you have the indication that we want to proceed and we can proceed but with the suggestions that these provisions be included, If Mr, Hoy comes back and has some questions on this I think it should be up to the staff to answer them and resolve them but I think that Vincent Avenue has been held up entirely too long, Councilman Snyder: I like that suggestion, You are suggesting that we approve it but send these recommendations with it, -22- 0 • Ca Co 4/6/64 Page Twenty -Three VINCENT AVENUE INTERCHANGE PLANS AND SPECIFICATIONS Continued Councilman Heath: Mayor Barnes: Councilman Heath: of the Council tonight intersection moving and these changes are major some negotiations. Have you looked over these proposals that you have here? No. I have not. Mr. Aiassa, would you read these? (So read.) We have come up here with a list of conditions. The action is going to approve these plans and get the send along a set of these changes. Some of and some of these things are going to take Councilman Snyder: I think we are wasting a lot of time determining or trying to accuse different people of delaying this interchange. The State was not going to build this interchange until they were ready. They are now ready and due to the fact we attempted to find another way of building this interchange we are a little far behind but everyone here has admitted this is not the best interchange we could get there. What is wrong with holding this as long as we have to rather than accept a substandard interchange as far as our frontage road goes? We can hold it another month or so while we'ask for these conditions that will at least improve this substandard one. Councilman Jett: those plans be approved so that the and the interchange could be ready another letter regarding this. Councilman Snyder: Last May we received a letter from the State requesting that intersection of Center Street to go. Last June we received The point is it would not be built yet. Councilman Jett: This may be true but they cannot be built until the plans have been approved and we keep holding it up and one of these days they will build what they want. We have to get going and get these plans into the State approved. Apparently we are never going to get everybody on this Council to agree on these plans and I say this is a good interchange. It may not be everything we want but it is a good interchange and I am for moving on it. Councilman Snyder: Mr. Aiassa, is it your opinion that requesting their con- sideration of these recommendations would endanger us getting this interchange? City Manager, Mr, Aiassa: No. I think the only thing they would do is evaluate them and if they have merit they will consider them because they have a • few minor changes to approve themselves. Councilman Towner: Move to approve the design and specifications for Vincent Avenue Interchange and direct the City Manager to proceed with the State Division of Highways on that approved interchange and to further negotiate the recommended plan changes, additions or deletions as indicated in the memorandum from the City Engineer of April 6, 1964. -23- C, Co 4/6/64 Page Twenty -Four VINCENT AVENUE INTERCHANGE PLANS AND SPECIFICATIONS ® Continued Councilman Snyder: Is it your opinion, Mr, Aiassa9 that if we approve these plans and specifications will it weaken your ability'to negotiate with the State? Councilman Heath: Wouldn't it be more advisable to approve these plans and, specifications subject to the inclusion of these conditions? Councilman Towner: I thought that was what you didn't want, I would prefer to see it subject to these conditions because -they are all beneficial to the City and it appears to me that the interchange could integrate these things without too much trouble, Mayor Barnes: I can't see us making it subject to because they have told us when they are going to start moving and we don't have this much time. The final trial is on May ll, They want to start work and they are going to go to bid, Councilman Jett: I think the motion as it was made is a good motion and this is approving the plans and substantially every one of these recom- mendations will be a part of the interchange so I don't see any problem, I will second the motion, Councilman Snyder: It is my opinion they won't listen to him, Councilman Towner: I was under the impression that we didn't have a majority that would go along with including these recommended plan changes and if I understand ®- Councilman Snyder: If this is transmitted to Mr, Hoy this week you will certainly get a reaction to it right away. If they just won't do. it with these recommendations as part of the approval then we can back down and remove them as part of the approval next week, A week won't mean that much, Councilman Towner: I will withdraw my motion, Councilman Jett: I will withdraw my second reluctantly because I think you made a good motion, • Councilman Towner: We can approve the interchange subject to these additions . recommended by our staff and that these are to be transmitted forthwith to the State Division of Highways, In the event the State Division of Highways finds this unacceptable the Manager is to notify us immediately and we will take whatever action necessary at the next Council meeting, That will be my motion, -24- C, C, 4/6/64 Page Twenty -Five VINCENT AVENUE INTERCHANGE PLANS AND SPECIFICATIONS Continued Councilman Jett: This is a beautiful way of tying this up again, By the time this gets in there and reviewed and these things are gone over and hashed around, a few months will have gone by, Councilman Snyder; I will second the motion but I do not understand this stampede to approve these plans when you voted against them before. You are -- accepting a substandard interchange without attempting to improve it, Councilman Jett: I would like to make this point. If you are going to make this motion subject to the acceptance by the State of this plan and these conditions you are in effect delaying and you are not approving the plan, Action on Councilman Towneres motion: Motion failed on roll call as follows: Ayes: Councilmen Towner, Snyder Noes: Councilmen Jett, Heath, Mayor Barnes Absent: None Councilman Heath: I have said that I do not like this interchange as much as a year ago myself along with other members of the .Council have said • that they realize that this is not the best interchange and could be improved and in this year there have been no corrections made so therefore I would have to vote no in the approval of these plans and specifications, Councilman Snyder: Charges of delay are without any I don't understand that reasoning when he said by the Council meeting one week from tonight, basis and fact, Councilman Towner: I think it is putting up a smoke screen in an attempt to get a substandard interchange, We should have these recommendations of our staff considered by the State. The reason we have substandard interchanges is because they were put through earlier by the State without adequate recommendation from the City's point of view and this is what we are fighting for now and if we can do this,within one week and give the staff the tools to do it with I think it is the best thing to do, Councilman Jett: Move that these plans be approved and recommended to the State for approval and that the recommendations as proposed by the • staff be submitted along with our approval for consideration, . Councilman Snyder: The staff has had a year but during that year by the action of the Council two other plans have been considered with the possibility of changing this entire plan. The staff has held off because of the Council, not on their own volition and the statement or intimation that the staff has purposely delayed.this is without basis and fact, Mayor Barnes: Motion dies for lack of a second, -25® Ca Ca 4/6/64 Page Twenty -Six VINCENT AVENUE INTERCHANGE PLANS AND SPECIFICATIONS ® Continued Councilman Towner: My second motion that failed will bring this back to us at our April 13th meeting. 'As a representative on this Committee we met in Inglewood last Wednesday night and formulated the proposal and last Thursday night the Committee that I was on presented this to the League at their regular meeting, The'finai action was this: The League realizes that time is very short between now and November.but the motion read that we would ask the Board of Supervisors to instruct the Chief Engineer of the Flood Control to proceed with a storm drain study as fast as possible to the extent of $210001000,00 and with the hopes .- that this bond issue will be put on the ballot in November, However, the League of California Cities realizes there are many problems to be solved before they will finally approve.this bond issue, one being the proper distribution of assessment in relation to the benefit received, whether the storm drain will be of a major diameter pipe or of a minor diameter pipe and whether it would be of a project where it would be appropriated inter -city wide, We hope that the Board of Supervisors will instruct the Chief Engineer to go ahead with the study and by July 1st the League will have gone over these problems and tried to resolve them and if we have resolved those problems around July or so we will then request the Board of Supervisors to proceed and put this bond issue on the ballot, In light of this, there might be some projects in the City that we would like to get in on this plan, We won't know until July whether there is going to be a bond issue put on the ballot, If it doesn't go on this November, it will be two years before it goes on. On some of these drains you might want to take a look-see and see if you want to hold off until July lst and try to get them under this bond issue with the hopes the bond issue will go and if it doesn't go, take another look-see to see if we want to go ahead on our own. We have already sent in a deficiency report and if any of these items are in that report they no doubt would be included in this bond issue, City Manager, Mr, Aiassae We do have these plans available and if there is money available we are in business. COUNCILMANIC REPORTS FRANCISQUITO STREET NUMBERING Councilman Snyder: I made a house call on Francisquito the other night and some sections of it are totally in the City of West Covina, some are totally in the County and some are half on one side of the street in West Covina. The house numbers are horrible. They don't have any City limit signs where it is only half in the City, City Manager, Mr, Aiassa: I'll take care of this. ®30® Ca C, 4/6/64 Page Thirty -One COUNCILMANIC REPORTS - Continued LOTTERY INITIATIVE Councilman Snyder: Has there been any suggestion that we make a resolution against the initiative for a lottery? The initiative proposes that the business be given to a private corporation that will take 130 of the profits and I understand it is about ready to qualify, Councilman Heath: I would not only be against that but against the Government running it because,I have seen some of the County employees operating, I think I would be against the lottery completely, Councilman Snyder: Councilman Jett: Councilman Snyder. - Councilman Jett: SACRAMENTO TRIP I would, too. I would, too, but I don't think we can take a stand against the initiative. You can make a resolution stating you are against it in principle. I think we should wait to see if it goes on the ballot and then take our stand, Councilman Heath: On the 31st of March Mayor Barnes and I went to Sacramento along with some of the select people of the City and it was a very educational day. I met Harvey Johnson, Phil Soto, Mr, Flournoy, I went down to the Assembly floor and watched the operation there, We talked with each of the representatives and Senators. I think everyone of the representatives made it clear and almost to a point of begging to have us come to Sacramento and express our opinions because this is what they have to operate on, I think this Council has been remiss in not sending representatives to Sacramento and I think that the members of the Chamber that are here who went along will vouch for the fact that these representatives in Sacramento almost pleaded to know your feelings, Mayor Barnes: They asked the councils to be more conscientious of projects we have in the making,. I talked with Mr. Reese about the rapid transit authority and he advised me of this bill and the help they received from the League in getting this bill across. It looks like it is going to be on the floor very soon. They would like from us a proposal of all of the monies and how we intend to get Azusa through and what West Covina would like to do. Mr, Reese has offered his services; Mr, Flournoy said he would be glad to help, and Mr, Soto offered to help, I think we should have someone up there especially during the general sessions, They would like to have the Council's support on many items during the general session especially on the review of taxation. -31- Ca C. 4/6/64 SACRAMENTO TRIP e Continued Page Thirty -Two Councilman Snyder-. I agree we should give them support with written letters and informative material, resolutions, et cetera, but I think it is absolutely wrong that we should send a Councilman repeatedly to Sacramento because our Assemblymen are elected to represent us there. Prior Assemblymen from this district took care to visit the city halls of his district very frequently when he was in this area and if these present Assemblymen don't know it is because they haven't taken this care. It is their responsibility to come back here and get this information; it is not our responsibility to take it up there to them. We are not large enough to have our own lobbyist. You are taking over one of the functions of the Assemblymen if you say we are going to send a Councilman up there frequently during Legislative sessions because you are taking over some of the duties of your Assemblymen and they return to this district almost weekly and if they haven't been in this City Hall they are poor Assemblymen. We should continue to inform them with resolutions, letters, et cetera. If they don't read their mail then we had better go up and see them. Councilman Heath: I think the proof of the pudding is investigated and found out how many see how they are operating. I hardly think that other cities operate this way and if you went_ up there and representatives are there and Councilman Towner-. I think the difference of opinion is just a matter of frequency. We would all agree that we are not going to send Councilmen going to Sacramento all the time but where we have a project that is of sufficient magnitude and sufficient importance to the City and requires State help and we can by Council action authorization authorize one of our members to speak on our behalf or some authorized staff member even to go up there and present the full information, the reasons for our position and try to gain support for its I think this certainly is warranted but I agree with Dr. Snyder that frequent trips there are not warranted. Mayor Barnes-. I think you are right on that. Senator Reese has asked that as soon as he comes back to town he would like to visit and go over some of the items with the City Council possibly in our City Hall or at a dinner meeting because he would like to know what we would like to have and I think this is a good idea. City Manager, Mr,, Aiassa-. for Glendora Avenue. At that time we with and now we are divided into three different Assemblymen. VARIANCES Mr. Heath and myself made a trip and we got $42,000 had one Assemblyman to deal Assembly Districts with three Councilman Heath-. I requested a while back a list of variances that have been filed in the past year and I would like to have that information. The purpose of this information is that the City Attorney has even advised us in open Council meeting that our ordinances are way too restrictive and we are requiring everything to go to variances and -32® I Ca C,, 4I6/64 Page Thirty -Three VARIANCES - Continued I would like to find out exactly how many we have had and if it is an exorbitant amount I think we should take a look at our ordinances to see if they are too restrictive. There is a report in our mail from Mr. Bonelli that the Board of Supervisors had a study by the Stanford Research Group who in effect said that Ontario Airport at the present time is not necessary as a second airport,, Ontario is not in Los Angeles County,, The airport is not in Los Angeles County,, Your Board of Supervisors has gone on record as being against this as a third airport,, I think we should follow our own County and own Supervisors in this recom- mendation instead of what happens here,, I can't see how economically this benefits us at all. I would be willing to support it but I think you should go back over that report that came from Mr,, Bonelli,, If then you think it is necessary I might go along with you but I think you should look at that report first,, Councilman Jett,. I think I would be in favor of supporting the growth of the Ontario Airport, Mr,, John Gardner,. I was curious as to whether the report was the Stanford report sponsored by the Los Angeles Chamber of Commerce and the date I think they said Ontario would be considered was 1990 and in the meantime they placed it fifth, They put Compton Airport and things like that as being greater in importance,, It is my belief that Ontario is part of the headquarter city concept because it adds the biggest strength we have locally here, Councilman Snyder,. Mr, Aiassa9 do you have another copy of that report from Mr, Bonelli that could be transported to the Chamber? City Managers Mr, Aiassa,. Yes,, SACRAMENTO TRIP Mr, John Gardner,. On the Sacramento trip you couldn't help getting the feeling that communication between the City and the State is of the greatest importance if we are to develop the way we want to develop. I don't believe we have to go to Sacramento all the time but I think communication is of the greatest importance, I 'J C, C, 4/6/64 SACRAMENTO TRIP - Continued Page Thirty -Four Councilman Snyder: I think it could be improved by asking the Assemblymen to stop by City Hall frequently when they are in the area, too, It is. a two-way street and they are the ones who have been failing recently in keeping up their end'of communication, LOT SPLIT ORDINANCE Councilman Jett- On our lot split ordinance, if a person owns a parcel of land five acres and this property is zoned partly for business purposes and partly for residential purposes and the person wants to sell the business portion and retain the residential area, is it necessary for that person to come in for a lot split? City Manager, Mr, Aiassa- This should be reviewed with Mr. Williams because it is a legal interpretation, Councilman Jett- According to Section 9146 it refers to that the way I •interpret a lot split is that it is for the -benefit of the individual who would like to come and split a small parcel of land in order to • put two residences there. In business property I have.never yet been required to get a lot split, Mr, Klein- The City has in the past and still does split commercial property by precise plan but we have in the past always required a lot split on residential type property, There have been recent developments in this area and I wouldn't care to comment on this, I think Mr. Williams should interpret this. In this case Mr. Williams says that the sale was illegal. It was sold off without a lot split, Councilman Heath- I would like to look into this, too. It doesn't sound right, Councilman Jett: I want the legal interpretation on this, not just an opinion. I don't believe legally we can stop anybody from selling any part of a piece of..land, Councilman Heath: There was a case on Azusa Avenue where there was a parcel of land and it came in for zoning, the rear of it was zoned by our City as R-1 and the front was zoned commercial. Does this require the man to have a lot split? I don't want to discuss this any further but I would like to have an answer on that, -34- C, C, 4/6/64 COUNCILMANIC REPORTS - Continued JUVENILE PROBLEMS Page Thirty -Five Councilman Jett: In Sunday's paper there was an article on the front page entitled "Teenage Gangs Gone Wild", This is quite an article. In that same Sunday edition appearing on the front page of the second section is an article where a teenager had driven his car down a sidewalk9 turned the corner and continued down to the driveway, When he stopped one of our officers came up to the car and tried to stop him and tried to take the keys out of the car and the boy drove off dragging the officer and the officer was injured, I was talking to Mr, Aiassa about this and he has been investigating this and I think we will get a report later on, but what I am getting at is that I think that maybe it would be a good idea for the Council to have an executive personnel session with the City Manager and with the Chief of Police and let him brief us on the problems that they are confronted with with this thought in mind: The possibility of helping them out in maybe sitting down and discussing the problem with the judges; if necessary, talking to our State Assemblymen and attempting to'get stronger laws or whatever is necessary to help out on these things, Our officers put themselves up in a position where there is a possibility of being killed or maimed or injured, I think we are going to have to back up our officers on problems like this and if they need any help that they be given any help they need, City Manager, Mr, Aiassa: The Chief is on vacation. We will have to wait until he gets back, Mayor Barnes: -I think we should put.this on the agenda and we should have a meeting, City Manager, Mr, Aiassa: It might be a good point for the Mayors group of the East San Gabriel Valley to bring this up as a topic and unite our efforts and energies together, Invite the peace officers as a whole so we will have all these cities reporting their particular conditions so we can unite in a stand, We can also have the District Attorney's Office and the Sheriff's Office in on this, At the next Mayors meeting you can invite a joint meeting with the police chiefs and the city managers and sit down and see what we can do, Mayor Barnes: I think the mayors should be invited to the police chiefs' meeting, Councilman Snyder: There is an article in last month's Readers' Digest . about a judge in Montana who had a campaign to change the law and no longer in Montana does a juvenile remain anonymous in court and this has cut the delinquency rate by a great deal. In commenting on this article mentioned by Mr, Jett it should be pointed out that in this article further on the author states that this article is not intended to be a reflection of all the teenagers in this Valley, It is not an article'in depth and he states specifically it merely attempts to point out the.worse cases of behavior and I think in this respect -35- C, C, 4/6/64 Page Thirty -Six JUVENILE PROBLEMS - Cont2nued if you are going to have a meeting on juvenile delinquency the police alone cannot stop juvenile delinquency and we should expand it there to include all the agencies that have something to do with it, the schools, churches, so on.
