03-30-1964 - Regular Meeting - Minutes• • MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF WEST COVINA, CALIFORNIA March 30, 1964 The adjourned regular meeting of the City Council was called to'order by Mayor Barnes at 8:05 P.M. in the'West Covina City Hall; 'Councilman Towner led the Pledge`of Allegiance. The invocation was given by Councilman Jett. ROLL CALL Present: Mayor Barnes, Councilmen Towner, Jett, Heath Others Present- Mk. Absent: Councilman Snyder Mr. Harry Co Williams, City Attorney Mr, Harold Joseph, Planning Director RESOLUTION N0, 2892 ADOPTED Mr. Aiassa: Mayor Barnes: The City Manager presented: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA COMMENDING JAMES K. HEDGES FOR HIS SERVICES TO THE CITY OF WEST COVINA AND EXPRESSING SYMPATHY ON HIS UNTIMELY PASSING" He served on the Council from 1934 to 1942, Hearing no objections, we will waive further reading of the body of the resolution. Motion by Councilman Heath, seconded by Councilman Towner, that said resolution be adopted. Motion passed on roll call as follows: Ayes: Councilmen Towner, Jett, Heath, Mayor Barnes Noes: None Absent: Councilman Snyder Said resolution was given No. 2892. GAREIS CASE Mr, Aiassa: We were able to resolve this at 4:30 this afternoon. We have a recommendation from our staff and we have a letter from Mr. Erickson regarding this matter. I would like these included in the Minutes, -1- Ca Co 3/30/64 GAREIS CASE m Continued Page Two (The following is a letter from Mr, Howard Co Erickson, Attorney, dated March 30, 19649 directed to the City Council re Donald R, Gareis,) "Thank you for the opportunity of having a conference with the City Manager and his staff regarding Donald R, Gareis, As we stated in our letter of March 23, 1964, we are requesting that°'ydu extend his pay for an additional three months time,'and we`anticipate and hope that there will be a final determination during that period, "In that connection, Mr, Gareis has authorized me to proceed along the following plane P11, Make application for the additional three months' pay,'which application is before you tonight, in order that Mr, and Mrs, Gareis will be able to live and provide for their family.pending a final settlement, "2. Settle the Industrial Accident case, A settlement figure has been reached with the State Compensation Fund, and request has been made with State Compensation to send us the necessary settlement papers to complete, •• PP3o Make application for retirement, In this connection, Mr. Gareis states that he has already made an application for retirement, which was approved at one time, The only question here is whether Occidental will want any additional papers and as to this, we will immediately take steps to find out what, if any, additional papers they desire, "It is my understanding that should the City grant the three months' additional pay, the City will want credit for any compensation payments that Mr. Gareis receives, or will want to be reimbursed for those three months out of any settlement which he receives from State Compensation, "Your cooperation in this matter will be appreciated by myself and the Gareis family," (The following is a memorandum directed to George Aiassa, City Manager, dated March 30, 1964, from the Compensation Review Board (Allen Sill, Chief of Police; Gerald Weeks, Admin, Ass°t o Personnel; and James Kay, Jr,, Dr, of Finance) re Recommendation For the Final Disposition of the Don Gareis Matter,) "1) You have requested a recommendation concerning the disposition of the Gareis matter from the Chief of Police, the Administrative Assistant of the Personnel Department and the Director of Finance, These persons have formed themselves into a Compensation Review Board in order to make this requested recommendation, -2- Cc Co 3/30/64 GAREIS CASE = Continued Page Three "2) In order to dispose of the .. items specifically before the City Counbil'for action on Monday, March 30, 19649 it is recommended that, "Mr. Gareis be given an additional 90 days of full salary with the proviso that the city be refunded for such payments out of any settlement to be made by Mro Gareis or his authorized representatives with the State Com- pensation Insurance Fundoe Pe3} It is additionally recom- mended that Mr,, Gareis be terminated as a Police Officer effective June 30, 1964, under the provisions of Personnel Rule 16.29 which provides for termination of employees who are physically incapacitated to carry out their assigned duties. "3A In order that a final determination can be achieved in this matter by June 30, 19649 it is recommended that Don Gareis be required to advise the Chief of Police on or before Thursday, April 309 19649 if he intends to contest the termination of employment because of physical reasons. 114) It is further recommended • that if Mr,, Gareis does not wish to terminate his status as a Police Officer that the following action be taken: 'Mr. Gareis be requested to appear before the medical re-evaluation board of the Los Angeles County Board of Medical Examiners for an evaluation of his physical fitness to perform the duties of a Police Officer.' "5) Based on the report of the Los Angeles County Board of Medical Examiners, Mr. Gareis would then be returned to employment, terminated, or placed on authorized leave of absence without pay, as the facts indicate. "6) The above recommendation has been arrived at by a review of medical records on Don Gareis at Workmen's Compensation and comments by our representatives at'Workmen's Compensation regarding Gareis°s present condition and the probability of his improvement." Mr. Howard Erickson Mr. and Mrs. Gareis have had to Attorney at Law make a decision and they have 104 South Glendora made this decision as outlined West Covina in the letter you have before you and I feel we can get this disposed ofo It will take a little time. I think three months would be ample time to complete it and they will have something to live on during that time. I will be happy to answer any questions if you have any. I understand from the recom- mendation of the staff that they want a disposition on Mr. Gareis either for termination or put on absence without pay or go back to work and I think this is a reasonable request that a decision be made on this. We will be working on it and trying to cooperate during that time. -3- • El C, C, 3/30/64 GAREIS CASE - Continued Page Four Councilman Heath-, I think we have had six or seven on-the-job accidents and I feel if a man is entitled to compensation, he is entitled to compensation. I won't fight that at all. I feel everybody should be treated in the same manner, Until I find that they are all treated the same way I can't vote one way or the other on it, On the surface, I would question this reimbursement by Mr, Gareis in case he should collect something from the Accident Commission, I would like to know on these individuals if they have all been treated in the same manner, I am not carrying a torch for any particular one of these but I would like to see everybody treated the same, Have the following persons been given one year of full pay inclusive or exclusive of disabilitys Rund; Odle; Phillips; Danio? Director of Finance, Mr, Kay-, still on injury leave, Mr. Phillips' injury hasn't transpired that long so he is Danio has been terminated because he is physically incapacitated. I doubt if Mr. Danio was ever covered by this particular thing. 'After his injury he returned to. work up until he made the settlement and he applied for retirement. I don't think he came under this, He was a clerk dispatcher and he was working for most of the time after his injury. He did not file request for one-year full payo Mr. Rund did not get one year, Mr, Rund and Mr, Gareis did not come under the original directive so these people's cases have been handled individually with their attorneys, Mr, Rund was extended for a period of six months at one time and it ended there, Mr, Odle has been off on sick leave since his policy was established some time in May and he has been off continuously since then, He is getting full pay now. Mr, Phillips has been off about two or three months. He just got out of the hospital, Councilman Heaths It looks to me as if Mr, Rund was terminated after six months. Councilman Towners These continuations of salary are all contingent upon the continuation of temporary disability compensation. If Mr. Odle has that terminated we would terminate the payments until another agreement was reached. Director of Finance, Mr. Kays we got a check today which dated cases Workmen's Compensation says should not go to work because he administrative problem, Some of terminated, Each of these cases Mr. Phillips has not been paid for about four weeks but then back four weeks. On some of these the case is stabilized but the man is not physically able. We have an these people should clearly be has to be handled individually, a ®4m Cs Ca 3/30/64 GAREIS CASE m Continued Page Five Mrs Howard Erickson-, With reference to Gareis, there are about four different places that this money can come from and not make too much difference which place it comes from as long as the man gets it,,` If the man goes back tJ work then he can get the straight salary,, If he has no other source he can collect it under Rule 13.1 that we are asking for at the present time on behalf of Gareis,, He can get Workmen's Com- pensation payments or he can getretirement payments,, It doesn't make too much differenct to the individual employee which one of these he collects under as far as I can see because he is only going to get it from one place. The reason we are coming in and asking the City to pay a salary for the next three months is only because Gareis isn't getting it from any other place,, He is zntitled to it under Workmen's Compensation; however, the State Compensation Fund isn't paying,, If you gentlemen had the authority to tell State Comp to pay, this would be fine. We don't care, but this is the decision to be made by the Commission; and a hearing date is set for it but even then it is some distance off,, In'this case they stopped paying because they say his condition is permanent and stationary; therefore, they shouldn't pay him temporary disability but permanent disability and they want a decision from the Industrial Accident Commissions While that is pending he doesn't get any pays The others may have and I know nothing about the other cases We figure two to three months is a reasonable estimate to complete the settlement and during that time he needs compensation from some place and you gentlemen can get it back from State Fund as I understand.it under this arrangement,, • Mrs Gareis isn't going to get paid more than once. Councilman Jett-, If we continue his monthly payments for three months then during this period the State Compensation does not pay him anything, is this right? Mr,, Howard Erickson-, This is true but if they do you get it back anyway. In other words,..he is not going to collect from two sources. Councilman Jett. If he does not receive anything from the State Compensation during this period and at the end of this period we no longer will pay him but he gets a settlement say of $5,000, then we would.and can be reimbursed for three months or that portion that we would be liable for? Mrs Howard Erickson. This is the recommendation of the staff and this sounds like a reasonable arrangements Councilman Towner. It is not a full reimbursement; it is a reimbursement for what he receives. It is reimbursement to the extent that he'�receives that compensation payment,, I think in the Gareis case that there is enough indication in the medical file that he may be entitled to temporary disability compensation and there is enough personal need on the part of the family that it is reasonable certainly for us to c ontinue his pay for three more months subject to a credit for any compensation payments that he does receive,, I think we are treating this man in accordance with our established pay which is up to one year's leave of absence with pay with credit for any compensation received,, -5- G C. C. 3/30/64 GAREIS CASE ® Continued Mayor Barnes: Mr, Howard Erickson: Councilman Jett: and this three months will give him City Manager, Mr,, Aiassa: Page Six Are the Gareises in agreement with this? I talked this over with them this afternoon. They are in agreement with this. This conforms to our policy that we established a short time back the' one year? that's right. Mayor Barnes: If we set a policy and establish it at this time, if we have a similar case come up we want them treated in the same manner. I think Mr. Erickson has presented this and the Gareises are in approval. I see no reason why we shouldn°t settle this and any other case in the same manner. Councilman Towner: I think the recommendations made by the staff are agreeable. I think there is only one word of caution. I don't think you can say that this sets a precedent because each case has to stand on its own facts. Director of Finance, Mr. Kay: We have gotten to the point of our entire compensation problem which is that there does have to be a decision made before we go to the end of a year, so you have probably received today in the mail from the staff a suggestion of a policy way in which any of these cases once they have gone 30 days, there will be a sort of compensation review board including the staff and the department head responsible for supervising the man and they will discuss the known facts and make a recommendation and there will be another written recommendation reviewing the case so they don't drag along. You may treat everybody equally by paying one person for a year and paying another person for 90 days.. It depends on the facts of the case. City Manager, Mr. Aiassa: The Council has a statement of policy governing the administration of injury -leave program. We have set this tentatively for 4/20/64 and the State Comp representatives will be here and we will review it with the Council, the staff, and the representatives. Once this goes into effect this is what we want to maintain. We didn't want to do that until we cleared up the straggling cases. Mr. Howard Erickson: If you decide to allow him the extra three months we request it be made April 1 so he can get a payment right away. Director of Finance, Mr. Kay: The next three months should start April 1 and terminate June 30. Motion by Councilman Towner, seconded by Councilman Heath, that Officer Donald Gareis be granted an additional 90 days full salary provided that the City be allowed credit for any compensation payments received and this to be effective April 1, 1964. C, C, 3/30/64 GAREIS CASE m Continued Page Seven Councilman Jett- Would it be necessary to include any of these recommendations such as given to us by the staff? Councilman Towner- These things should be taken one at a time and I wanted to take the salary payment at this time. Action on Councilman Towner's motion- Motion passed on roll call as follows-, Ayes- Councilmen Towner, Noes- None Absent- Councilman Snyder Jett, Heath, Mayor Barnes Councilman Towner- I have read the report of the Compensation Review Board regarding Mr, Gareis and it seems to be in accord with the letter of Mr, Erickson, He has now been granted the additional three months' pay; he still has pending the final settlement or decision on the compensation case which he is moving ahead with and he also intends at this time to apply for retirement, The memorandum of the Compensation Review Board does not clash in any way with Mr, • Erickson's recommendations so I think we should accept these recom- mendations in full and authorize the staff to carry them out, • Councilman Jett- Do I understand then that as of June 30 his employment will be terminated regardless of what settlement is finally made? Councilman Towner- Unless he requests his reinstatement under the provisions of Section 3A at which time he would have to undergo the examination of the County Medical Examiners, Motion by Councilman Towner, seconded by Councilman Jett, and carried, to accept the Compensation Review Board's recommendations of March 30, 1964 re Donald Gareis in full and authorize the staff to carry them out, City Manager, Mr, Aiassa- I would like a statement of policy governing the injury -leave program of the City of West Covina, We would like to have this on the 20th because we would like to notify these people so they can be with us, Councilman Towner- I think we should wait until, -we get our new Council in, Possibly we could work it out to have the apparent new Councilmen, even though they are not actually installed at that time, to appear with us, Councilman Jett-, I think from my own experience in a case like this I would appreciate the action of this Council because of their experience and knowledge of the procedures, the incidents, The new Council will have the prerogative of making changes in the policy if they care to, m7® Co Co 3/30/64 'GAREIS CASE m Continued Page Eight Councilman Towner: The 20th is agreeable with the understanding we could invite the new Council to attend that meeting even though they are not officially installed: City Managerg Mr, Aiassa: All right, ONE YEAR EXTENSION FOR TRACT NO, 28216 City Manager, Mr, Aiassa: I have a report for the Council re this matter, (Read report,) Motion by Councilman Heath, seconded by Councilman Towner, and carriedg that the request for the one-year time extension for final map for Tract No, 28216. be granted. FREEWAY SIGNS City Manager, Mr, Aiassa: Victor Gruen representatives said they would be happy to . Iook over our signs because the signs are going to be playing an important part, This will be at no extra charge, The Council has • had a chance to look at these signs. I would just want action that we go ahead and review this with Victor Gruen representatives and either accept what we now have or make changes that are necessary, Councilman Heath: We don't know we will receive their report or recommendations, I don°t think this has a place on the agenda tonight because I don°t think we are ready for it, Councilman Jett: I would like to see one of those signs that would indicate the downtown business area, Mayor Barnes: We can't review this tonight, We will hold this to the 6th, VINCENT AVENUE INTERCHANGE Plans and Specifications City Manager, Mr, Aiassa: Mr, Dosh did not have time to complete the review and they want to make recommendations and Mr. Klein and I had a meeting today and we would like to hold this to the 6th subject to their final analysis because they would like to make firm recommendations before you accept the plans and specifications, Mayor Barnes: We will hold this over to the 6th, then, NO C, C, 3/30/64 VINCENT AVENUE INTERCHANGE ® Continued Page Nine Councilman Jett-. We had better have a resolution prepared for the next meeting next Monday night and you should have a final recommendation ready for us along with the resolution so we don't have to wait any longer,, VICTOR GRUEN FINAL STUDY City Manager, Mr,, Aiassa-.' Victor Gruen would like to present their final on April 20. We can have them after the State representatives are here,, It could be at nine o'clock,, Mayor Barnes,, I think that is agreeable with the Council,, RALPHS ® ZODYS Truck Circulation City Manager, Mr,, Aiassa: We have come up with a new plan and worked out a good solution • and they are agreeable to this,, It is subject to Richard Ralphs and his organization for their approval,, I think tentatively we have heard no adverse comments on it,, We have to wait until Mr, Ralphs approves this, I think it is going to be a satisfactory solution Mayor Barnes-. When you resolve thisg bring it to the Council, City Manager, Mr,, Aiassa-. Fine, WATER RATES La Puente Co-operative City Manager, Mr,, Aiassa-. We have a report from the staff,, (Read said report,,) There might be a legal problem for Mr. Williams to decide. How extensive do you want me to -investigate this? I think the La Puente Co-operative is the one affecting us in the City, They are providing domestic systems for household use,, Councilman Towner: City Manager, Mr, Aiassa; Mayor Barnes - Councilman Jett: They should be subject to the Public Utilities, They are a mutual. I would like to see Mr,, Williams review this,, I think definitely the City Attorney should review this, ME • C; Ca 3/30/64 Page Ten WATERRATES (LA PUENTE CO-OPERATIVE) - Continued City Manager, Mr, Aiassae The only question that comes to the staffs mind is that if we ever question these rates we had better be pretty sure, We had a perfect case against Suburban, I feel it is sometimes a little inexpensive to get figures on this so you can hit them where it hurts the most, Mayor Barnes: I think Mr, Williams can determine whether we should have a review by Mr, Montgomery and probably would recommend it if he felt we should, City Manager, Mr, Aiassae WATER RATES Azusa Valley Water Company I will discuss it with Mr. Williams and we can go from there, City Manager, Mr, Aiassae They have set a meeting at the Council Chambers at the City Hall in Covina, We authorized subject to the date of hearing May 6th and we will have to move fast if we are going to get a word in, Mayor Barnesa I think we should, SIGNALIZATION (Freeway North and Vincent) City Manager, Mr, Aiassao I have a -report from the District Traffic Engineer and he has agreed to accept half of the cost of the proposed signal and lighting installation at the San Bernardino Freeway North Frontage Road and Vincent Avenue, Councilman Townero City Manager, Mr, Aiassao Is this in our Traffic Signal Program for next year? Yes, Motion by Councilman Heath, seconded by Councilman Jett, and carried, to proceed with the joint participation with the Division of Highways on the traffic signals and safety lighting and channelization on the North Frontage Road at Vincent Avenue, PERSONNEL Disability Cases City Manager, Mr, Aiassao I would like to bring up another disability case on the 6th. I would like to open the case of George Odle,, -10- Co Co 3/30/64 PERSONNEL (DISABILITY CASES) - Continued Councilman Jett: Page Eleven If we settle Mr. Odle's case, where does that put us? Mr. Aiassa: They are all settled except Mr, Phillips. We think his will be settled quickly because he is going to come back to work. I need action on the :Tien who don't appear to be coming back to work, Mayor Barnes: We will hold this to the 6th, PERSONNEL BOARD REPORTS Mr. Aiassa: I would like to hold this over. Part of this report is on disability. PERSONNEL - PSYCHIATRIC ANALYSIS Mr. Aiassa: This is the one I gave you a written report on at the prior meetings The Council wanted to look it over. Are there any objections to engaging Dr., Rankin? Mayor Barnes: I thought we approved him, Mr, Aiassa: And on the staffing of the Police De- partment, by April 15 we should have it completed, Councilman Towner: I think as far as the psychiatrist is concerned, it should be handled admin- istratively unless you feel there is some policy consideration involved. • Mr. Aiassa: The only reason I think the Council should accept this is this man can play a very major role in our eligibility list. Motion by Councilman Towner, seconded by Councilman Heath, and carried, that the Administrative Assistant's report of February 27 be accepted and that Dr. Rankin be engaged to be our psychiatrist. PERSONNEL - COMMISSION SALARY CONSIDERATION Mr. Aiassa: We have a report from the Personnel on the Commission salary consideration. They want a raise. (Read portion of said report.) I have no recommendations because I don't have anything to do with commissions. Recommendation by Personnel Board dated March 30, 1964 as follows: "On March 3, 1964, the Personnel Board recommended that the City Planning Commission, Park & Recreation Commission, and the Personnel Board, receive a $10.00 minimum monthly raise per month. Motion made by Mr. Zoelle, seconded by Mr. Chamleee All in favor: Mr, Cole, Mr. Chamlee, Mr, Zoelle, Mr, Faunce and Mr. Sanborn," -11- • Co Co 3/30/64 PERSONNEL (COMMISSION SALARY CONSIDERATION) - Continued Councilman Jett-. Page Twelve I think we should wait and see what happens at the election,, Councilman Towner-. I do think our commissions are entitled to more pay. These pay steps have been set over a long number of years and costs of living have gone up and even more important, the board work or commission work has increased tremendously,so I think they should be compensated accordingly just the same as the City Council and I do hope the voters do accept the recommendation of the Council and increase the wage of Councilmen,, I don't think we have to wait until the vote,, I think possibly it should have the review of the Finance Department and see whether it fits in our budget and so on,, Councilman Heath; I think you have to wait until after July 1 anyhow because you don't have money in the budget to do it now,, We would take an indication of the way the voters acted toward the Council°s raise as to whether or not they want this salary raised,, Motion by Councilman Heath, seconded by Councilman Jett, and carried, that the report from the Personnel Board re Commission salary con- sideration be accepted and filed and brought onto the agenda one month after the installation of the new Council,, OVERHANGING SIGNS City Manager, Mr,, Aiassa-. We do have a recommendation from the Planning Department regarding overhanging signs,, (Read said recommendation,,) Motion by Councilman Jett, seconded by Councilman Heathy and carried, that this item be taken off the agenda, EMPIRE SAVINGS AND LOAN ANNEXATION Councilman Heath-. In reading the Planning Commission Minutes I notice there was action taken on removing from the agenda the request of Empire Savings on their annexation to the south of the City,, The final action that this Council took was to instruct the Planning Commission to study this area for possible annexation and come back with a recommendation,, Empire Savings is waiting for an answer,, Mayor Barnes; Under our new annexation formula we send this to the staff and the staff then makes a recom- mendation,, City Manager, Mr,, Aiassa; Mr, Joseph advised me today Mr. Oschin orally requested him to hold it off until the 14th of April. I said we wanted it in writing,, Mr, Joseph contacted him today that we want this in writing,, Councilman Heath-. If the applicant has requested this be held, I think this is the right action,, -12- 4 i C. C. 3/30/64 RESOLUTION NO. 2893 ADOPTED Page Thirteen The City Manager presented: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA COMMENDING FRANCIS L. TRIPP FOR HIS SERVICES TO THE CIVIL DEFENSE OF THE CITY OF WEST COVINA" Mr, Aiassa: We had a very active member of our' Civil Defense group, Mr. Francis L. Tripp, who has just passed away. Mrs. Boschoff asked if we would pass this resolution in behalf of Mr. Tripp for the work he has done volun- tarily. He helped train 200 West Covina employees. Mayor Barnes: Hearing no objections, we will waive further reading of the body of the resolution. Motion by Councilman Heath, seconded by Councilman Jett, that said resolution be adopted. RUPERT PROPERTY (Abandoned House) Mr. Aiassa: I have received a lot of phone calls on this Rupert property on 3306 East • Virginia. I think we are going to end up with a petitions The house has been abandoned and it seems to be a nice house for teenagers. There is lewd literature on the walls and the house is a mess. Mayor Barnes: Is there any way we can condemn this? I think this building is more or less a fire trap. Mr. Aiassa: I had our Building Inspector write to the present owner,,Gemite, Inc. (Read 1'etter re this matter.and read report from Chief Wetherbee re this matter.) I would suggest we proceed with the Building Department or the Fire Department and see if we can get permission to burn its Building Report: "PROCEDURES FOR SUBSTANDARD STRUCTURE PROGRAM 1� Set up folder containing: Case No.., Photos, 1st Inspec- tion Report; Legal Description, Name & Address of prop- erty owner, 2. Staff Record File Card containing complete history of case as it progresses. 3. Mail 14-day letter to property owner. 4. Notify Building Inspector of date for 2nd inspection. 5. Report on re -inspection: Building Inspector to check and sign File Card'as to compliance or further action required. 6. If non-compliance, set date for Public Hearing, allowing 40 10 days for notice to be published from date of publica- tion to date of Hearing before City Council, 7. Notify owner of Public Hearing using Form "Notice to Owner of Hearing" certified, return receipt requested. 8o Notify local newspaper of Public Hearing. 9. Newspaper will return "Proof of Publication" which is filed in case folder. 10. Public Hearing before Council. SLIGHT MODIFICATION NO. 21 Mr. Aiassa: The Council has received copies of Slight Modification No. 21, which was passed March 17, 1964. If it is agreeable with the Council we would like • to accept and file the report. • Motion by Councilman Heath, seconded by Councilman Jett, and carried, to accept the Slight Modification No. 21 report, dated March 17, 1964, and that it be placed on file, SP 6333 (Sidewalk Program) Mr. Aiassa: At the request of the Council we have made some proposed estimates for SP 6333 and that is sidewalk improvements on Myrtlewood and Puente. The cost figure on the north and south side is $3,724.00. (Read report re this mat- ter). I would accept their recommendations. We don't know what the bid will be. If it goes over our estimate, we might not have enough. It might be a good possibility it comes under and if it does, they can add this as an extra. The bids will be opened the 9th. Motion by Councilman Towner, seconded by Councilman Jett, and carried, that this be included as an extra provided funds are available after bids are received. PROJECT C-60-1 Vincent and Walnut Creek Bridge Mr. Aiassa: Mr. Heath requested that Project C-60-1 regarding improvements on • Vincent Avenue between Walnut Creek Bridge and the Riding property be . investigated. Councilman Heath: The potential right-of-way is owned by Mr. Hogan. This is tied up and will be tied up as long as the man is alive. If there was a dire need of funds the State could authorize the sale of this property but this man is not in a dire need of funds and therefore it cannot be sold until he eith- er recovers or passes away and no one knows when that will be. The prop- erty is held in trust of some kind. That curb is going to remain and it will be a black and white barricade extending from the bridge out and Mr. Dosh led us to believe it would be extending out into the street about 16 feet. I brought up the question on this piece of property it seemed to me it would be a long time before it develops and we are making an improvement -14- • i Page Fifteen P?IOJEC`i' C--00-1 - Continued: Councilman Heath - Continued: there at the present time and we are creating a traffic hazard and have spent much money on other parts of the City to get rid of these barricades. Mr. Dosh told us what it would take to alleviate this barricade. If I understand this, there is still another six feet of paving we co;,ld put in there and still not be back to the curb. Mr. Klein: If we went right to the property line but you eliminate all drainage shoul- ders and things like that. We could possibly be liable. Counciiiai n heath: We could come over six feet and put in a little berm so the water will be channelized along the street. Councilman Towner: It seems to be reasonable that we should smooth that traffic flow out instead of putting a barricade in that intersection. It seems ,lost reason- able to handle it that way at the time being. I would like the other al- ternative considered as to what it would cost us and how we could go about actually acquiring dedication of the full width. ^..t^ssa: I have no recommendation because this was done while I was away. Mr. Jett: I think we can get Frank Bandy to work with us on this. Cr unc:i_lman Towner: Normally we wait until the owner develops it and we receive the property on dedication without having to condemn it and pay money for it. Councilman Heath: This might be a long while. Cou ncililan Jett: We just did the same thing on the property to the south; we paved the entire area provided he put in the curb and gutter and sidewalk and dedi- cated the property and we put in all the rest of the paving, Councilman Towner: If you can make the same arrangements with these property owners it would seem reasonable. If you can't and we can't get it done within a short period of tame, let's go ahead with the six feet. Councilman Jett: I would agree with that. Councilman Heath: Move that we endeavor to contact the owner of the property or the person having control of the property on the west side of Glendora Avenue south of the bridge to ascertain if we can get a dedication of right of way and possible participation in the improvements. If we are unable to do this that we then proceed with an additional six feet of paving and an asphalt berm acting as a curb or adequate drainage facilities not to exceed $1,500,00 Councilman Towner: I am in agreement with this, with this understanding and I think this is probably what Councilman Heath means: The offer made here in con- nection with this property would be the same and no more than what was done on the property to the south. Mr, Klein-, We have contacted this person and they have expressed the desire to participate with the curb and gutter so we are coming to the Council probably at your next meeting with plans for this.
