08-12-1963 - Regular Meeting - Minutes0 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL CITY OF WEST COVINA, CALIFORNIA AUGUST 12, 1963 The regular meeting of the City Council was called to order by Mayor Barnes at 7:40 P.M. in the West Covina City Hall. Councilman Towner led the Pledge of Allegiance. Rev. Miles Acker of the West Covina Methodist Church gave the invocation. ROLL CALL Present: Mayor Barnes, Councilmen Towner, Heath, Snyder (from 7:45 P.M.) Others Present: Mr. Robert Flotten, City Clerk Mr. Harry C. Williams, City Attorney (from 7:50 P.M.) Mr. Thomas J. Dosh, Public Services Director Mr. Harold Joseph, Planning Director (from 7:52 P.M'.)' AWARDS Absent: Councilman Jett Mr. George Aiassa, City Manager • Mayor Barnes: Before we start our agenda, I contacted Sgt. Anderson and he and the boys from the Ho-Tyes Club would like to make presentations here tonight. Sgt. Kenneth Anderson: In behalf of the Associated Car Clubs of West Covina and the sponsoring group we would like at this time to present the City Council with a letter of recognition for their support morally and verbally and working with the youth in our City and allowing the Police Department to assist and work with these boys. (Councilman Snyder entered the chambers at 7:45 P.M.) Sgt. Kenneth Anderson: We present the same letter of recognition to Mr. Aiassa, the City Manager. Mayor Barnes: (Accepted awards.) We have had good reports on the run you boys went on and I would like to accept this award for the City Council and Mr. Aiassa. Thank you very much. Mr. Ron Jenson: I want to present this award to the West Covina Employees' Association. Public Services Director, Mr. Dosh: (Accepted award.) On behalf of the Association, we thank you. Mr. Ron Jenson: We have a presentation to Councilman Heath. This is for going on the run and helping us and just making everything possible. -1- C. Mayor Barnes: CALIFORNIA AVENUE SPEED LAWS Thank you very much boys for coming down tonight. Councilman Heath: I would like to ask the Council if they would request the Police • Department to patrol California Avenue north of Merced. I have received a number of complaints that there have been speeds up to 55 miles an hour and so forth. Mayor Barnes: Chief Allan Sill: APPROVAL OF MINUTES Chief Sill is here and will probably take care of this. We will take care of it. There is a big hole there outside of the meter box covered over by a piece of plywood, Mr, Dosh can check this. If it is a utility problem.they will have to repair it, Public Services Director, Mr, Dosh: The staff inspection I think was completed last week, They should be aware of this, (Planning Director Mr, Joseph entered the chambers at 7:52 P,M,) Councilman Towner: If the staff checked it out they are aware of the problem involved so we can release this as far as this particular property owner is concerned. Councilman Heath: We are being asked for informa- tion on storm drain deficiencies, Public Services Director, Mr. Dosh: The Storm Drain District has asked us to define our deficiencies. We divided them into critical and needed to develop areas and needed for future expansion. Councilman Heath: I am questioning the wording • here. Public Services Director, Mr. Dosh: They want us to tell them what our deficiences are. If you approve this report we will send copies to Flood Control tomorrow. Councilman Snyder: In deficiency reports where you have drainage problems near our border, this is taken into account? Public Services Director, Mr. Dosh: Yes, it is. -5- • • • Co C, 8/12/63 STORM DRAIN DEFICIENCIES - Continued Mayor Barnes: Page Six I didn't see the portion of Badillo drain as being completed on this maps Public Services Director, Mr, Dosh: We have included the Badillo drain in the estimate. We have shown all except that section west of Orange which probably should be shown. Mayor Barnes: I think it should be, Public Services Director, Mr, Dosh: We'll change that. This, as you know, is our recommendation to the Los Angeles County Flood Control District, "The relocated Palm trees will be very close to the irri- gation line, but it is our opinion that we can achieve the relocation without seriously affecting the waste water line. City Clerk, Mr. Flotten: (Read letter dated July 30, 1963, directed to the City Council re this matter requesting withdrawal of the request for an appeal and signed by James L. Allen and Albert L. Snell.) City Attorney, Mr. Williams: It says, "We wish to withdraw without prejudice the hearing requested". If they mean to say they want their appeal to remain in effect but to be subject to a later hearing this would be one thing. "Without prejudice" normally means that they have the right to do this again. You can't appeal again if they withdraw the appeal. If it means they withdraw their appeal that means the Planning Commission action is final. I am not certain what they mean by the letter. Councilman Snyder: The safe thing would be to continue it to the next meeting and find out. Planning Director, Mr. Joseph: When I heard from the City Clerk's Office that they had • withdrawn their appeal, I saw Mr. Snell in the City Hall and asked him if he was withdrawing his appeal and he said he was because the deal that they had on the property fell through. According to the word he gave me they wish to withdraw their appeal. ME C. City Attorney, Mr, Williams: I talked to Mr. Lockhart about a week ago and he repeated the general understanding that when the annexation is completed the suit on the other one will be withdrawn. The timing on this would be that at your next regular meeting or any other meeting more than five days from this meeting you can pass this ordinance. It takes effect 30 days after it is passed and upon its being filed with the Secretary of State. I presume that at that time or before Home Savings can be approached about the lawsuit. They will have to get the consent of the Attorney General to dismiss it. C. 8/12/63 Page Twelve RESOLUTION N0. 2717 - Continued Councilman Heath: At the south end the County has given us a certain amount of money for road improvements south of Cortez. At the present time the developer is in there putting in street improvements out to the present paving and evidently -- I am assuming that he is going to put in his development -- when he is done we will tear out the rest of it and put our improvements in. Public Services Director, Mr. Dosh: Yes, We waited three months for the school district to approve the agreement. They did that last Monday. We are now taking bids. Mayor Barnes: If the contract could have been held up a few months and the whole street could have gone in as one bid, it would have.been Peneficial to both the school and the developer and-the:street would --have een nicer. Public Services Director, Mr. Dosh: We have held him off as long as we dared and he .won't wait any longer. You can require that the present contractor to put in headers but he doesn't have to under his present plan. Councilman Snyder: I am not against R-4 in the whole package but I.am against it alone without the rest of the package. Councilman Towner: I vote against this on the same grounds. I think it is an over-all study of the apartment house zoning and was presented to us as a package deal. Councilman Heath: After going over this thing I am about to throw the thing out completely; not even study the package. I think this R-4 is not what we are trying to bring into the City. The more I think about it, the more I think I will rescind my motion. • • Mayor Barnes: Mr, Williams, there will be no action on this. City Attorney, Mr, Williams: Any Councilman who wants to can introduce this. Councilman Towner: If you take off any restrictions which I understand is the direction you're probably moving, you are going to find that property develops clear out to the edges and is jammed with buildings and will do away with parking and landscaping and all these,things and what we will have is a city of tenements, and this is the thing we are trying to avoid, I think the ordinance as drafted and taken into consideration in all of its aspects simplifies the restrictions that currently apply to apartment house zoning and make it easier to develop and this has been the plea of our administrators that they have zoning restrictions now that are difficult to develop because there are complexities. I certainly don't think we ought to abandon the reasonable setback provisions or other provisions provided for in this new type of zoning. Councilman Heath: Originally I was in favor of this ordinance change, As I went on I realized the deficiencies in it. If two of the Councilmen feel it is real good -- I don't think it's good -- I don't know why it is related to the balance of the zoning. Not passing it is not going to force me to review the R-1, 2, and 3 any faster. From what I have seen of the R-3 I would like -to knock that out, too. Councilman Snyder: All these multiple zones are related and you can't pass one without relating the R-3 and the R-2 to it. They should work together to give us a real zoning tool to design things as we wish; design things as they should goo Mayor Barnes: Many cities have architectural controls. If they come in with a plan good enough to suit the Planning Commission and the City Council,_it is approved. Otherwise the land isn't zoned. Councilman Snyder: would wish to, The time has not come jam buildings together, Councilman,Heath: I think an architect can design within setbacks and I think he populationwise when we have to This is giving you a percentage of ground cover which relates the amount you can put in there, Planning Director, Mr, Joseph: We talked this out last Monday night for about two and a half hours and I expressed myself. Our.whole intent and purpose behind the amendments was to make them easier to administer and get rid of a lot of language and a lot of restrictions that are not necessary, C. C. ' 8/12/63 Page Nineteen R-4 ORDINANCE INTRODUCTION - Continued I think„our reports to you indicated how much we were accomplishing along these lines° Mr, Heath brought up some points last week which may be trouble spots. I am not as concerned with it as he is but I am not saying he is wrong. What we are attempting to do is write something that we think will work. If it doesn't work, experienced developers and builders come to us and tell .us it is not working out.; and we will be the first onea to come back with our comments on this. Anything we could do to simplify the structure of our multiple family ordinance is worthwhile. That is why we have come to you with three multiple family zones instead of five multiple family zones, We think we can accomplish the same thing by it, Councilman Snyder: I, myself, would consider some reconsideration of side yard setbacks and back yard setbacks but I do feel very strongly about front yard setbacks and about a definite percentage of ground cover. If we can take this and look at it again from that viewpoint I would be willing to reconsider the whole package. How are we going to arrive at an answer? We are going to have to accept pretty much the recommendation of our staff whether we can agree in total or not, Mayor Barnes: Several months ago we asked the Planning Commission and the Planning Department to study high rise only. I don't recall • anything or any comment from anyone on this Council asking for a complete study of the R zoning in West Covina, Councilman Snyder: When they got into their study of high rise they realized there were many things in the multiple zoning ordinances that were un- necessary and confusing'and they saw a definite need for changes here@ I think they should be commended if, in their opinion, they thought this should be improved, Councilman Towner: I don't think you should criticize the staff or the Planning Commission for doing something that is beneficial to the City, We asked for a study of high rise and they determined in their studies that it was better not to isolate it but to relate it to; other things and keep it in character with the City. This is what we are attempting to do, If you isolate it and set it aside you create more of a hodge-podge instead of less, I think your criticism is not only unwarranted but I think it is completely out of line, It may not have been in the motion but in order to give us a reasonable study of high rise they studied all of the residential zones. I think the push here is to do away with as much in the way of restrictions as you can a:ld I think it is probably that this is aimed at:some particular development that you people have in mind, Mayor Barnes: Councilman Towner: Mayor Barnes: We were studying the Brutoco development. I don't think that is the.,thing affecting the study at this time. The only thing I remember asking for, or the Council asking for was a high rise ordinance. We asked for a study on high rise because Mr,, Brutoco was before us at the time. This high rise was in the terms of R-4o This study has been made. The study has been presented before so now we can't get the thing through, Maybe the criticism is not with the Planning Commission but with the Council in the fact that now they won't pass something we urgently need. Councilman Towner- I am ready to pass it. I am somewhat astonished that when this ordinance came up before us you selected out the R-4 zoning and in effect rushed it through over our objection and over the objection that this was a part of the overall study. Now apparently you have gotten the message that this isn't what they wanted; they want something else, Councilman Heath- Who? Councilman Towner- Whoever you have in mind. During the course of this dis- cussion it was mentioned by one of the Council -- I believe, Mr. Jett -- that it was intended that this ordinance be applied to the property out to the east of the City. I mentioned at the time that this ordinance was not designed to apply to any particular property. Councilman Heath- This was originally requested for Bi-iutoco Councilman Snyder- We do not have a high rise application before us and we have never had a high rise application before us for apartments in the Brutoco development, He never applied for it. He could have applied under a variance for it. He could have applied for it under a variance if he wanted. Councilman Towner: Councilman Heath: Planning Director, Mr. Joseph: Councilman Heath - Mayor Barnes - If I recall there is an appli- cation filed for this on the Darby property. I don't think that is high rise. The application reads for R-3 or R-4o I would like to look at the R-4 further. We'll hold it then. Councilman Towner- First of all I don't think particular zoning ordinances should be designed with particular developers in mind and it appears to me that this might be what is happening here. The only application that is pending that I know of is that application on the Darby property. Secondly, I think that the presentation that has been made to the Council has been by an organized group who is economically interested in the outcome of this ordinance and these people have presented very adequately the economic problems involved -20- C. Ca 8/12/63 Page Twenty -One R-4 ORDINANCE INTRODUCTION ® Continued • which we should consider seriously but I think there is an un- organized group in the City which we also represent and these are the people who live here, who will live in the apartments that are built here and the people who have an interest in the community that it retains its present character. These are the people that I intend to represent and I think you should represent. Planning Director, Mr© Joseph: We have a report from the staff that will be given to the Planning Commission that will be a true high rise overlay ordinance, The staff will suggest ways to increase the height even above the five stories now approved. This will be written in such a way so as to be universally applied, Councilman Snyder: It is obvious that the last remaining developed land outside of Annexation No, 158, the push is for all of it to go R®3 and I think it is mandatory that we reconsider this Amendment No, 59 in total because it has been pointed out over and over that obviously many of these apartments are built by outside developers who have no interest in the City or maintaining the character of the City; they build a development, sell it, and get out and I think if we are going to maintain the character of our City it is mandatory that we revise • this ordinance as recommended by the staff in order to maintain the character and the quality of the City, City Attorney, Mr, Williams: We have a R-4 zone now' This merely changes the R-4 zone, I think if you would get together as to what your objectives are you will find that they are not very far apart. There are presently five multiple zones in the City -- R®2, R®3, Rm3A, R®3B and R-4. If you add another one, there are six. Your reason and judgment tells you this is too much. Not only does judgment tell you this is too many but they are not segregated property. Three out of the six all accomplish the same thing, In effect I think what you have been saying here, what the Planning Commission and the Planning Department have been saying, you need a distinguishable kind of R-3 from the run of the mill.R®3 that we have had in this City and everything. One of the particular kinds you need is a kind that can blend with single family without effecting it adversely, I think you all want a zone which when you apply in an area next to R-1 you know it is going to protect it, They are not going to go high. They will not have a high density, You want, I presume, to retain .the same average kind of R-3 that we have had all along which is just the plain, average R-3 where it is substantially a Rm3 neighborhood; and thirdly you want to permit the type of high rise development that is going on all around us where you will allow a structure to rise higher when you find it is in a right location and at the same - time to be able to control the quality, prevent too great a coverage • and too great a density, Basically I think you're talking about density and the height you're going to go, Then it is a matter of judgment which one should go where, Mayor Barnes: I think what they are trying to do may be good but I don't know whether we have the right answer from them, City Attorney, Mr, Williams: They don't know, either, until they find out what you want. I think you will find that you're not too far apart. This is pertaining to the Traffic Authority, City Attorney, Mr. Williams: This does not require Council. action in many cases. I think some of the cases are where the Authority could act before now require Council approval but not in all cases. For example, designating a one-way street requires Council approval whereas the installation of yield right of way signs does not require Council approval. This ordinance is substantially a reflexion of an ordinance that you would find in any city with a population of seventy or eighty thousand upward, You may wish to study this. You will have a pretty adequate budgetary control over some of these things, Councilman Towner: Since this is only introduction and we are furnished with copies to read, we can introduce it and read it in the meantime. Councilman Heath: We budget the money; we set aside a fund for them; they can shift the money from one place to another. I feel we do not have budgetary control except in the very very large capital expenditures. Mayor Barnes: Mr. Dosh, I want a copy of the League of California Cities model traffic ordinance, Public Services Director, Mr. Dosh: All right. City Attorney, Mr. Williams: Our ordinance was drawn up by the Traffic Engineers. I am sorry they didn't follow the League model laws. The Chief of Police, the engineers and the Traffic Engineer drew this up, Councilman Towner: Public Services Director, Mr. Dosh: Can all of us have copies of the League model laws? PROPOSED AGREEMENT WITH THE CHAMBER OF COMMERCE City Attorney, Mr. Williams: Some of the sections as to what the Chamber is to do are re- worded slightly. The thing that worries me is this trying to draw an agreement that goes year after year, the same agreement, I think in the long run it is not any agreement at all because it says that the consideration to be paid by the City shall be whatever the City budgets so there is nothing binding on the City. There is nothing binding on the City; therefore there is nothing binding on the m23® C. C. 8/12/63 Page Twenty -Four PROPOSED AGREEMENT WITH THE CHAMBER OF COMMERCE - Continued • Chamber because it is only a contract if it is mutually binding. Also, some of the sections are rather amended to fit the same end. (Read portions of the proposed agreement.) This isn't an agreement; this is just a kind of a shaking of hands. It seems to me the City would be better off to simply continue the annual preparation of an agreement, changing the date, put in the amount. All that appears to me that you can gain from one of these things that might continue year after year is that you save the labor of writing this one and a half pages once a year. You have to determine the amount of money anyway so you don't save that. Councilman Snyder: City Attorney, Mr. Williams: Councilman Snyder: The relationship is so nebulous that it is difficult to spell out everything. It is a little nebulous but that is no reason to make it more nebulous. Their job for us is really promotional and it is pretty hard to spell out. Councilman Heath: I think the revision is not as • good as what we had before so let's stick with what we had before or else improve it. Councilman Snyder: I am for going along with the old agreement. Motion by Councilman Heath, seconded by Councilman Towner, and carried, that the City Attorney be instructed to write a contract the same as last year changing the amount of money to $10,000.00 as budgeted, and change the date. HYDRANT CONTRACT WITH"COUNTY PICKERING TRACT City Attorney, Mr. Williams: I have this. I have not com- completed the drafting of this thing which is somewhat difficult. It has not been authorized for execution. You could authorize it rather than wait for it. Mayor Barnes: • EXPENSE REPORTS I think we authorized the execution of it. Councilman Heath: Every,month we fill out a paper for expenses. Where do we stand as far as income tax is concerned because I believe I have heard you do not put down blanket expenses that you have to itemize each..item. -24- C. C. 8/12/63 EXPENSE REPORTS - Continued Page Twenty -Five City Attorney, Mr. Williams: Until last year the law was rather lenient. If you received an expense account you were okay if you didn't charge your expenses as deductions and didn't charge your reimbursement as income; they washed each other out. This year in order to take deductions you must itemize them and must give the place and who was present. I think the law is still the same in this regard -- that reimbursed expenses are neither a deduction nor are they 'income. If you spend five dollars for a dinner which is a legitimate business expense and the City gives you the five dollars back you don't have to report it one way ..or the other. If you take the deduction and don't show that you received it you may be in trouble. The thing you are doing is you are making a sworn statement that by a whole lot of little expenses that always amount to at least this amount a month and rather than detail these things. It is my understanding this is still washed out; it is a reimbursed expense." The W-2 form doesn't show that at all. COUNCILMANIC REPORTS WATER REPORT Councilman Heath: Last week Mr. Aiassa, Mr. Williams, Mr. Jett and myself met with Mr. Valentine and the attorney from the State Water Resources Board and went over the contract. Mr. Valentine made it very clear that if we have intentions of joining Metropolitan that they do not want us to apply for an allocation of water, the reason being that the water is all allocated and if we come in with others and ask for water there will be a re -allocation. They feel Metropolitan has all the water they should have. If we go in and ask for a contract and on the basis of our contract there is a re -allocation they go through all the expense and trouble and turmoil and fighting to re -allocate to get us our water; then we turn around and join MWD and transfer our allotment to MWD who already has enough water and they are not in favor of something of this type. City Attorney, Mr, Williams: There is quite a lot of confusion whether MWD's allotment from the State includes the San Gabriel Valley or does not include the San Gabriel Valley. Councilman Heath: MWD told Mr. Jett and me there was an allocation in their allotment and they have told other agencies there is no amount in there. We got into quite a discussion concerning the east fork. It . seems it will be built. Then the question came where West Covina would pick up the State water and how we would get it here and it was readily admitted that the four cities can't get enough unity among their directors to vote a tax rate much less get together to vote for a bond issue to pay for a water duct from Cedar Springs over to us. Sierra Madre cannot wait any longer and they are going toward someway getting water from MWD. Monterey Park 1 iup in arms and about to join MWD. On the same afternoon Mr. Jett and I were in E1 Monte talking to the Upper San Gabriel Valley District. They said they would be glad to have us come in and they -25- Ca C, 8/12/63 WATER PROBLEM - Continued Page Twenty -Six • hadn't been doing anything because they wanted a formal application from us. I told them we had to know the conditions, As a consequence of the meeting it was decided that the directors of the Upper San Gabriel Valley District would have an informal meeting with MWD to finalize in an informal way what the conditions of joining would be. They then would bring this information back and pass the information on to our Council, If at that time we are in agreement with these conditions we will then make a formal application to the Upper San Gabriel Valley District for annexation under these conditions. They want a representative to receive from Mr. Jensen and the Upper San Gabriel Valley Directors' Board to receive this information. This is on September 3, Until that time there is nothing we can do; Mayor Barnes: Today I received a letter from Carl Fossett, Secretary of the Upper San Gabriel Valley District inviting representatives of the Council to attend this meeting on September 3, Councilman Heath: It is going to take sixty days for the State to re -allocate and arrange for water for us so that any contract with the State should be presented approximately three months before the end of the year which means that it should be in by October lst, • Mayor Barnes: I feel if we can get in under the historical formula it might be wise to go to the MWD, I hate to see us trying to bring water in from some point over near San Bernardino, Councilman Snyder: If they don't come up with conditons by September 3, I think we should plan to apply right now to go ahead and apply to the State no matter what it does to the works, I think we should demand conditions by September 3, Councilman Heath: I sense a feeling that there is a feeling that I have been dragging my feet on this water problem and as a result I would like to ask if I may withdraw from the Water Committee and I would like Mr. Jett appointed in my place. Also, on September 3 I will not be available to go to this meeting in E1 Monte, Mayor Barnes: Councilman Heath, I think you may have had remarks that you were dragging your feet. I know this isn't so. I.don't want to see you resign from it. You have followed it all through the years and know probably as much about this as anyone else. I don't mind if Councilman Jett would be your alternate but I would like to see you • on this Water Board, Councilman Heath: In May of last year Mr. Montgomery started a report for us and we could do nothing until that report was completed, Before it was completed I went to Pomona Valley to try to get from them a condition of annexation, Pomona stalled us and refused to even talk to us and through MWD and Pomona we have been told to not do anything. For the past year and a half we have been stalled through no action of mine. MWD has tied us up since last October even though we wanted to continue. It wouldn't take very long to fill out the form of the agreement, I wouldn't be surprised if MWD will delay their answer beyond the 3rd. Their purpose will be to delay any answer untill the State time expires. I think it has been their purpose all along. Councilman Towner: Could we state a deadline, that unless we get a firm answer on September 3 that we will go-ahead and go to the State? City Attorney, Mr, Williams: The four cities are getting another report from Harvey Banks which will state that it would be cheaper to go the State route. I think the one affirmative thing that could be done between now and the 3rd of September if you would care to do it is contact the other four cities and determine whether or not there could be any change in that district in the thinking, particularly of Monterey' Park, If West Covina joined the four cities, if the five cities joined with the State contract it seems quite practicable. At the moment it seems highly problematical. The State contract calls for the commencement of payments immediately when you sign, These payments increase and the first one would be due in 1964, the first of July. You pay your proportionate share whether you ever get water or not. This lasts for 75 years. To get water you pick it up at a designated outlet. The outlet indicated to us is Devil's Canyon, The cost of a pipe line of course diminishes as its quantity increases so it would be something of an engineering problem as to what it would amount to if this city alone had to build a pipe line from Devil's Canyon to bring water here and until you build a pipe line you pay not the fluxuating charges but you pay the capital charges. Also that the City contracts that its boundaries will remain unchanged from the date you sign the contract forward, In other words no more annexations unless the State consents. Also, until you get water and can raise money by the sale of water you can only pay your cost to the State by the levy of taxes, taxes by constituional provision must be uniform; therefore, you must take the areas that are already in MWD in order to pay for the rest of the City getting,State water® Councilman Snyder: You had better contact the four cities, City Attorney, Mr. Williams: If the City of West Covina contracts with the State it is city-wide even though some of the city is MWD. If you annex to the • four cities you would only annex the part of West Covina that is not already in MWD, Mayor Barnes: I think first we have to contact the four cities and then on September 3 if we like what we hear then it is up to us to determine which way to go, -27- • C Ca C, 8/12/63 COUNCILMANIC REPORTS - Continued FOREST LAWN Page Twenty -Eight Councilman Snyder: We were supposed to get continued reports on the Forest Lawn situation, I am wondering if the Council has any inclination to re- evaluate the Covina Ranch and the Forest Lawn situation now. Councilman Heath: I think we should, Councilman Snyder: Are you willing to have a meeting with Mr. Blalock at this time? Councilman Heath: Yes, City Attorney, Mr, Williams: We have nullified the previous decision; it stands at naught, Neither side has won. It is not proof we are going to win. At least we are still in contention. While we are in contention is the time if you're going to talk to Forest Lawn to talk to them, If we go up there and lose it again we are worse off, Councilman Snyder: Mayor Barnes: City Attorney, Mr, Williams: Councilman Heath: I am ready to meet with Mr, Blalock, I can't see it, myself, All you need to do is determine at this stage whether you are interested in annexing the Ranch, If they keep it over at the far end where it is I will go along with you on it, Councilman Towner: I feel the same way. "As per our oral conversation of August 8th, I am submitting herewith preliminary plans on a proposal of Vincent Avenue • Interchange modification. This was prepared by Victor Gruen Associates who are acting in a consulting capacity with the City of West Covina, We have been advised and we feel that there is an urgent need for east -west circulation of traffic, and as you will note, this interchange proposal puts a strong emphasis to provide circulation on the Frontage Road for a large volume of traffic which is being generated between the two shopping centers. "Before the City Council can recommend such an interchange, we would appreciate your agency reviewing the various aspects of it and submitting your findings on the acceptablility on the State level as well as the Bureau of Roads. i.e. What would be permissable under your standards, etc, "Thank you for all your cooperation." Mayor Barnes: There is a meeting with the Heath Company who are doing a study on the West Covina Shopping Center traffic flow, parking and store front modification. This will be at eight in the morning here in the Council chambers on the 21st, Councilman Jett represented the Council before on this and I would like to have Councilman Jett notified of this meeting, Councilman Snyder: Councilman Towner: Councilman Heath: I might come. I can't be there, I don't think I'll be here unless you need me. Public Services Director, Mr, Dosh: I understand what you mean, MINNEAPOLIS-HONEYWELL Councilman Snyder: Mr, Seeds from Minneapolis - Honeywell told me today informally that they would be willing to provide the water for the center strip on Badillo if the shrubs were planted there.' He didn't say.they would provide the pipes. My motion would be that the staff be authorized to contact him and find out in detail what he has to offer, Councilman Towner: Mayor Barnes: Councilman Snyder: Second the motion. I think we should also find out how elaborate moneywise he wants these plans and shrubbry. It depends on whether or not they want to open with the sign. Councilman Heath: They want to open with the sign and apply for a variance in the meantime, Councilman Snyder: This brings up a point. This is our biggest variance. They put up a sign that is too big and they know it is too big and they hope that since it is up they think they can get their variance through. I am positive in my own mind that some of the people who do this, do know; at least the sign company does, Councilman Towner: I think it is true about the sign companies and I think they take advantage of the businesses by doing this. Councilman Heath: As I heard it they want to have a grand opening within a week and it would take them a long time to get a variance through. They have filed or are going to file a variance for the sign. Actually they should not have a sign if they want to open. This sign was made back east, I believe, and is the standard sign. Councilman Snyder: Since they are going to open, allow them to keep the sign up for their opening but they still have to apply fora variance with the understanding if the variance is not approved they have to take the sign down. City Attorney, Mr. Williams: The building inspector should give them a certificate of occupancy but expressly state on it that this does not include the sign. I don't know how they can get electricity.
