Work has been acceptable. 19Ev.en though our investigation indicates that the low bidder has not performed a job of the magnitude of A111-62-1 and that the quality of some of their work in the past has been questioned, we have not in our opinion discovered sufficient evidence to disqualify the'City Construction Company. t4It is therefore recommended that Your Honorable Body accept the bids as corrected, adopts, the Resolution of Award, awarding the contract to the City Construction Company on. the basis of their low bid in the amount of $279,988.65 and the City Engineer be instructed to return the bid bonds to the unsuccessful bidders. "/s,` R.E.Pontow, City Engineer '°/s/Thomas J. Dosh, Public 'Service; Director" Mr. Williams,. The law is you must award to the lowest responsible bidder. You would have to find upon circumstances that would justify that this bidder is not responsible. it would appear to me, particularly since this is a 1911 Act proceeding and you make a mistake that even though this contrac- tor has had some experience that hasn't been entirely satisfactory that there isn't enough here to determine that he is not a responsible bidder and you would have to be able to find that in order to disregard this bid and go to the next one especially when there is a considerable difference between .the bids, V m afraid you would wind up in a lawsuit and a ques- tion of the validity of the bonds. It's a rather risky thing on the evi- dence before you, in my opinion, to determine that this is not a respon- sible bidder. Mr. Dosh: We have made further checks since the report just read. This is the final segment of Amendment No,, 59.which completes the R zones,, The Planning Commission's recommendation'to the City Council does the following things. It adds a significant number of new types of administrative, business and professional offices rather than the six or eight uses that were limited in the past,, We now have about 18 different uses specifically set forth and the.Commission further wishes to allow similar type uses when they are deemed to be as the ones already allowed,, They are not limiting it to .Zrcchit(OCtRq engineers, accountants, attorneys, and doctors, but all types of service professional,, They have deleted from the R®P real estate •offices and residential uses,, The height has been expanded from 35 feet to 50 feet which would permit taller office buildings; the front yard has been expanded from 15 feet to 20 feet,, The side yards are pretty much the same as they were,, The rear yard has been expanded from 15 to 20 and the off-street parking remains the same,, This is what the Planning Commission has recommended to the City Council,, • C Co 6/10/63 PROPOSED AMENDMENT.NO. 59 - Continued Councilman Heath; Page Eleven If this is a residential pro- fessional zone, why do we de- lete residential uses? Mr. Joseph. The Planning Commission -felt that this was to be a compat- able transition type zone which would be closely associated with residential type uses and although they felt that the -type of zoning which is permitted could be associated with residential they did not want residential in here. As the R-P is presently written every -use permitted in the R-3 is allowed and because of our step-down type of zoning that means that you may put in single family homes next to office buildings and commercial parking lots, and the Planning Com- mission felt that this was not, something that they wanted to recom- mend to the City Council. Councilman Heath. This is a sneaky move on the part of the Commission, on the part of the Planning Commissioners, changed the name from commercial profes- sional, left it residential professional and gave it back to -us with a different heading on it. They have also decided to eliminate resi- dential uses when this is a residential zoning and eliminate real es- tate offices and I am sure they are going to put them in commercial zoning, It is a fairly sneaky move in my way of looking at it to try and pull a conniving trick to try to move real estate offices into a commercial zone and they know that commercial zoning is tough to get in this City. I can't see this zoning whatsoever and I would fight this zoning completely. Mr. Joseph. At your joint meeting back in October of 1962, we went over the General Plan and we listed a whole slew of things that were proposed to be allowed in this C-P zone. when the City Council in- dicated that they did not want commercial professional, the staff de- leted all the commercial aspects of it and kept it only to the office use in its statement to the Plarna,ng Commission for their consideration prior to the Planning Commission making its final recommendation to you. Mayor Pro Tem Jett., Mr, John Hiatt 322 Campana Flores Drive West Covina get office space. I don°t see why be taken out of it. This is the time and place for the public hearing. I don't know why this portion of the ordinance should be against real estate. It's tough to get commercial zoning and tough to one profession was singled out to There being no further public testimony, the hearing was closed. Councilman Towner. I, too, am interest in the reasons the Planning Commission deleted real estate offices from this amendment and I would like, in order to compare it with the other uses, have that list of uses read to use -11- C,, C. 6/10/63 PROPOSED AMENDMENT NO. 59 - Continued Page Twelve Planning Director- Mr,, Joseph., The uses area Accountants - attorneys; doctors, dentists,, and so on; engineers; architects; licensed real estate, insurance brokers or escrow agents,, plus the R-3,, The uses proposed in the new ordinance areo Administrative business and professional offices of the following type., Accountants, advertising agencies; appraisers; architects; drafting services; attorneys; bookkeepers; stocks,, bonds, collection agencies; counselor services; doctors, and so ono employment agencies; engineers, escrow; research- surveying- telephone answering services; travel agencies; similar uses providing administrative, business and professional services,, plus public parking areas subject to the Planning Commission's review,, Councilman Towner.- I don't recall reading the Planning Commission Minutes,, Did they in this discussion point out why they considered real estate offices any different than the other uses in R-P? Planning Director- Mr,, Joseph., There was a lot of discussion on this,, On May 23,, 19639 I sent a letter to the Planning Commission before the resolution was typed up.- "Attached is the staffs draft of Amendment No,, 59,, Please •review this very carefully and call me if you have any questions regarding any of the text." I wanted to make sure the ordinance was in keeping with the Commission thinking before the final draft was typed and submitted to the City Council,, As far as the actual reasons are concerned, I would have to go back and pull them out for you,, extract them from the Minutes,, Councilman Snyder., You say there is an additional provision in here that would provide for like services which aren't necessarily named.in this list? They apparently do not consider real estate a like service for some reason,, Planning Directors Mr,, Joseph.- They didn't include it in the list,, Councilman Snyder.- It is true that in the joint session with the Planning Com- mission that we in effect decided to drop the C®P zoning classification but they were clearly told and I recall this very clearly, to go ahead and study revisions of the R-P ordinances which is what has been done. I don't believe that this was done on any sneaky motives of the Planning Commission; I think it was done on good faith to an attempt to improve the R-P ordinances as they were directed to do,, I can • understand why they left out R®3 because we have that zone and I think their attempt was to make this a transitional zone between R-1 and commercial,, Is too, am wondering why they left out real estate because it does seem like a like service,, I would certainly consider adding it to this list of uses if this is approved,, I think this is a good ordinance if we resolve this problem of real estate offices,, I do believe in leaving out the residential uses because I think that was one of the main things they were attempting to correct in improving this ordinance,, -12- Co C o 6/10/63 PROPOSED AMENDMENT NO. 59 - Continued Councilman Heath - Page 'thirteen If this is passed, what zone will permit real estate offices? Mr. Joseph; If this ordinance is adopted exactly as written, it will be C-1. Councilman Heath. The title is residential professional zone. If we are going to"knock out residential, why not change the title to other than residential?' If we change it to other than residential we come back to the commercial pro- fessional zone. Mr. Josephz If they knocked out all the com- mercial applications except for the service type stores, the name really is insignificanto You could call it administrative professional, office professional, service pro- fessional or any other name. Councilman Heath - Where do these titles differ from what was originally presented as commercial professional? Mr. Joseph. All the commercial type of uses; coffee shops, stationery stores, office supply stores, the sale of merchandise in a retail type of activity, tobacco stores, anything that would tend, to fit in with the commercial.; were deleted by the Commission° • Councilman Heath. My feeling is that a real estate office is as much of a residen- tial professional use as time others, travel agencies, telephone an- swering services. It is well evident and has been that the.Planning Commission has a majority, not conclusively, who have no use for real estate people, don't feel they should be either on the Council or the Planning Commission, and I think if they have got something in their craw concerning real estate people„ real estate offices or anything related to real, estate they ought to be man enough to stand up and say it instead of trying to put it on a sneaky action. I can't help but think this is exactly what they are; trying to do because there is no justification for taking something out of this zone here where there are other uses in here which are more commercial' than real estate offices and then putting them into a commercial zone where all they have to do is sit back and say "we have enough commercial and we don°t need any more and therefore you can't have a real estate officeo94 It is obviouso Let's put the stuff on a line and be honest about it. Councilman Towner- I think possibly Mro heath is seeing ghosts in his own closet. I agree that there has not been shown to us any reason for deleting real estate offices out of the changed zone and I think the residential should go out and leave it as a transitional zoned I think if we adopt the or- dinance as proposed except to add the use of real estate offices we will have a satisfactory amendment to this R-P zone. Councilman Snyder. I can see one other problem and that is pharmacies in medical buildings. Mr. Joseph. This has been included. -13- Co Co 6/10/63 Page Fourteen PROPOSED AMENDMENT NOo 59 - Continued Councilman Beath: What is the reason for increasing the back yard setback? Planning. Directors Mr. .Joseph. The staff recommended this feeling_ that if it were to be a transitional zone there will be many times when the use will either back up to or' side onto single family residential uses. The idea was to advise'devel- opers that we would like them to set back a distance significant enough to separate the commercial from the non commercial. Right now single- family have to be set back 25 feet. Normally this is going to work out, fine because in almost every instance I am familiar with newer develop- ments going in they will put parking in the rear anyway. Councilman Heath, In a residential professional zones I would say it°s-a'zone which might be placed upon a residential structure which exists. If this be the case, suppose ,you have a house where you have the' standard R-1 setback, chances are if you move into an existing resi- dential home and install one of these professions that that residen- tial home will have a greater sideyard and a greater backyard set- back than is required under this zone? Planning Director, Mr. Joseph. Yes. Councilman heaths What I am trying to get at is this: That you would move one of these professions into an existing residence and the fact that •the sideyard or the backyard setback is not quite as much as speci- fied here, it requires a man to come in for a variance at extra cost and so forth. Planning Director, Mr. .Joseph: If a use is zoned for a particular purpose or if it is allowed by variance in an existing structure there would be no further require- ment for him to build in or rip out any of the additional structure because he would have what is called a non -conforming use in a con- forming building, There would be no additional requirements on the man moving anything except for the off-street parking. Councilman Snyder: City Attorney, Mr. Williams: What would happen to the present R-P? This zone would be R-Po You would just be changing the uses permitted in the zone. Any use which is there and which is deleted by the amendment would become a non. -conforming use but it would remain there° Councilman Snyder: What about precise plans which aren't built? City Attorneys Mr. Williams: The law is that any use which is actually commenced by the owner by the outlay of money and reliance upon the code at its commencement of work may continue. I feel this is a good upgrading of the zoning if we change the name to administrative professional and add real estate offices and allied fields back into the list, I feel we should restrict residential uses from this zone, Councilman Towner-. City Attorneys Mr, Williams-. Is this an amendment to the existing R-P zone or a new section in the code? I think it would become an amendment to the existing RmP even if you change the name, Mayor Pro Tem Jett-. Would you find the section in the Minutes of the joint meeting where we discussed the Planning Commission dropping this study on the R-P zoning? I have neard no complaints about our R-P zone, I don't know who is pushing this but there is something sinister in it, Councilman Snyder-. This expands the uses of the professional zone. It is less restrictive than it was under this except that you can't use residential, • Mayor Pro Tem Jett-. This may be true but I do know that there are several properties in the City that are zoned potential R-P zoning, The owners of this property since 1955 have been led to believe that if they made an application and brought in an acceptable precise plan that they would be given RmP zoning, The Los Angeles County Tax Assessor has recognized this R-P potential zoning and accordingly has increased the tax rate for professional property, As a result these owners of these properties have had to pay a premium in taxes on the basis.of potential zoning, Now, would you read those Minutes., Mr, Joseph? Planning Director, Mr, Joseph-. (Read portions of Minutes from the Joint Meeting, 10/31/62.) Councilman Towner-. I was not present at the meeting where this was discussed and in a subsequent Planning Commission meeting I was asked my view of it and I said I didn't know what went on but I thought the Planning Commission had a duty to review zoning ordinances with a view to perfecting them or improving them; in other words, a continuous study process, It seems to me that what has happened is certainly in accord with what was studied at the Council -Planning Commission meeting and particularly in view of the comments made by Mayor Barnes and Councilman Snyder and later on by me; I think the Planning Commission has acted very justifiably, Further, I think the Planning Commission has come up with something that is acceptable to all of us, I don't think I would expect any disagreement from Mayor Barnes that we accept the proposed amendments to the ordinance with the exception regarding real estate offices and put them back into it and then we have, I think, a good workable ordinance, I don't see any particular need to change the name of it because I consider the designation residential pro- fessional as indicating not that residential is included in it but that it is a transitional zone, -15- im C, C, 6/10/63 Page Sixteen PROPOSED AMENDMENT NO, 59 —Continued Councilman Heath- The preceding two paragraphs of these Minutes of the joint meeting I think should have been read by Mro Joseph, (Read from Page 13 of the Minutes of the Joint Meeting of 10/31/62,) This was the evening that the Commissioners Hall, Bartlett and Fast, and Chairman Renwick walked out on the City Council, I think there is a relationship in knocking out the real estate and the Commission walking out Just to prevent one Councilman from speaking on this, Councilman Snyder- If we put realtors back in here, what objection could you have to this ordinance change? Councilman Heath - I don't think I would have any although I would question why we have travel agencies in here, Councilman Snyder- I question that, too, It might be a good idea to hold this until Mayor Barnes gets back, I°m sure he will have something to say about this, Motion by Councilman Snyder, seconded by Councilman Heath, and carried, that Proposed Amendment No, 59 be held over to the next regular meeting of the City Council and be placed back on Ghe agenda for • consideration, PROPOSED AMENDMENT NO, 62 Request to amend the text and map City Initiated of the zoning ordinance in West HELD OVER Covina to provide that all potential zones now shown on the zoning map shall be eliminated and that all property which is now covered by potential zoning shall be zoned according to its present zoning and the potential zone shall be deleted, approved by Planning Commission Resolution No, 1394, Held over from meeting of May 13, 1963, to this date, Councilman Heath- I think Mr. Barnes would like to be in on this, If you open the hearing I think you should hold it open or else possibly not open it tonight and wait until he is back, City Attorney, Mr, Williams- I would suggest you open the meeting, take no evidence if no one is interested in it tonight, and then continue the hearing open, Councilman Heath- I have thought of a number of things I would like to bring •forward where in the past the Council has granted zoning due to the fact that it was potential zoning. There are a lot of people who have bought land due to the fact that it has potential zoning and they have.p;aid potential prices for it because they regarded that this would go to that zone, Councilman Snyder- I was at the Planning Commission when this was considered and it was not only publicized, but they had, discussion with practically all the owners of potentially zoned property in the City and most of them didn't even know what they were talking about and no one had any objections at the Planning Commission level, ®16m C. If you do continue this hearing to the next meeting I think it would be desirable to have the staff give you at the time of the hearing the location of every piece of property in the City that still has potential zoning on,, There are not too many, I think the language here, that it will revert to its original basic zone without the potential, is the thing that is the most damaging here,, I think if at the same time you consider this and you consider that you will eliminate the potential, you don't have to take the other; you can initiate the zone change to firm up the potential but I do think that you are going to find that this is a bastard zone; there isn't any such thing as potential zoning,, There is nothing like this on the Master Plan; there isn't any such zone. It was a poor concept when it was doneo It hasn't been used since 1955,, There are only a few left and the only thing you may differ with is that it should stay R-A instead of becoming C®1,, If you feel that "it shouldn't revert at -the same time you eliminate this, initiate the rezoning,, I am suggesting that if you postpone this two weeks you may wish to ask the staff with respect to each one of these whether they would agree to instead of •reverting it to R®A or whatever it is to take the opposite, firm up the potential,, I would guess that there would be some that would go one way and some the other,, I don't think the vision in 1955 was near as good as your vision is today and they have made mistakes,, Councilman Heath-, as potential and your opinion is move — _C.it_v Attorney_,_ _Mro _Williams I say we should move it all up to the zone which is indicated up certain ones,, And the Planning Deparment, don't T 1-1-4. - lr C,, C,, 6/10/63 PROPOSED AMENDMENT NO,, 62 ® Continued Page Eighteen contrary to the State law which says that zoning can only be changed by certain hearings and by the adoption of an ordinance You don't have potential zones any more anyway because already the automatic amendment by a precise plan is deleted,, You still have to hold the hearings and make the zone -change exactly as if it were R®A and didn't have the potential on it,, The only thing _I think you Ire dis— agreeing with is the statement that when you take the potential off it remains zoned as it was originally zoned without the potential,, This is true,, When you take the potential off, momentarily that is the way it is zoned but on any piece and if it is true of every piece, then every piece, the moment you do this initiate the hearings to determine whether it should be zoned the thing the potential says,, Determine on each one whether or not it should be firmed up,, Councilman Heath,. "SUBJECT- Larkwood and other streets Sanitary Sewer District A°11-62-2a "RECOMMENDATION- It is respectfully recommended that sanitary sewers be installed in this district. "ANALYSIS-, This Department has made an investigation of the Larkwood and other streets Sanitary Sewer District A111-62-2, City of West Covina as shown on the attached map. During the course of this investigation, 128 house -to -Mouse calls were made. Of this number, 46 occupants were not at home or did not answer the door° Of the 82 prop- erty owners or tenants actually contacted, 51 or 62.1% reported having experienced trouble with their individual subsurface sewage disposal systems. They complained of the seepage pits filling up causing raw sewage to back up into they house plumbing fixtures or to overflow onto the surface of the ground. Also that frequent pumping and cleaning out of the seepage pits or the installation of new pits was necessary. The soil within the area of this proposed sanitary sewer district varies. In some sections it is mostly clay. In other localities it varies from loam to sandy loam or fine sand. These types of soil are not too con- ducive to the proper functioning of any type of individual subsurface sewage disposal system. Clay soil has poor leaching qualities. Loam and sandy loam is more suitable but still does not provide the best leaching action. In those areas, where fine sand prevails, the seepage pits silt up or cave in and cease to function properly. "In view of our survey, I, the undersigned Health Officer of the County of Los Ang6l.es.having been officially designated by the City Council of the City of West Covina to perform public health services for the City of West Covina, do hereby recommend that proceedings be instituted at once for the installation of sanitary sewers in the Larkwood and other streets Sanitary Sewer District;, A11.1-62-2, City of West Covina. As far as the golf course is concerned, I don't know how many acres that would cover but that land at the present time has an offer on it for $35,000 an acre and I would imagine if you had a golf course the size of that light green area you would be talking about at least.ten, twelve. -acres, and that is a lot of money and I don't see how we could afford it,, Councilman Towner.- I don't either unless we can finance it out of the revenue we get from the property,, I think, too, we need other parks.in other parts of the City,, The advantage of this is using:it as a par three course in this particular spot, it is accessible to all.over the valley and would be more apt to be assured of financial success because of that location,, Councilman Heath.- To say that the man can't develop because some day we are going to buy it, I don't think that will hold water,, City Attorney, Mr,, Williams,. by inverse condemnation,, No. If we say that too, loud maybe we have already taken it Councilman Towner-, What we are concerned with is if the man comes in with plans, building permits and things like that,, Until they do that, we have room to move,, Councilman Heath-, They already have it in for zoning,, Councilman Snyder-, Why don't we make a motion suggesting that the Parks and Recreation Commission immediately look into the feasibility of a municipally operated either by concession, lease or municipally run par three golf course in that area? I think we should appeal to the Supreme Court. Can we drop an appeal if we change our mind? City Attorneyo Mr. Williams, The expense is incurred once we prepare the brief and petition the Supreme Court. You can wait until next week before you decide whether or not you want to appeal. Councilman Heath, I would like to wait. Councilman Snyder, I think we need to know is it too late for West Covina to form any agreement with Forest Lawn,, Secondly, you know the thinking of the Council and whether any of you gentlemen have changed your mind. Mayor Pro Tem Jett, I'll call Mr. Blalock tomorrow. Councilman Towner, I think we ought to let them know that there may still be some possibility with the City of West Covina. The cost for putting in crushed rock would be nominal, The ditch is full of water now, If we were to grade the shoulders again and threw in crushed rock it means he wouldn't have a mud hole, he . would have crushed rock at the bottom of running water.
