The regular meeting of the City Council was called to order by Mayor°
Pro Tem Jett at 7 A5 Po Ma in the West Covina City Hallo Councilman
Towner led the Pledge of. Allegiance. Councilman Heath gave the invo-

"All bids have been examined and corrected as shown. All legal
requirements for advertising, receiving and opening the bids have

"Two bids were received by Special Delivery about 45 minutes
after the bid opening, but on the advice of the City Attorney
botch bids were returned to the respective bidders unopened.
"In our investigation of the low Bidder, the City Construction
Company, we have been advised of the following from-,

The above company has done some 1911 Act improvement work
and cash contract jobs ranging in price from $2,600.00 to
$70, 000. 00. In some cases they have had difficulty in com-
pleting on time and have had liquidated damages assessed

The City Construction Company has done nothing where
the County itself is concerned, but have done small private
Contract jobs in the County. The inspectors feel they have
to spend more time with this company than with other companies.

"This company has done small jobs only in the $12,000.00
range. Work has been acceptable.
19Ev.en though our investigation indicates that the low bidder has not
performed a job of the magnitude of A111-62-1 and that the quality
of some of their work in the past has been questioned, we have not
in our opinion discovered sufficient evidence to disqualify the'City
Construction Company.
t4It is therefore recommended that Your Honorable Body accept the bids
as corrected, adopts, the Resolution of Award, awarding the contract
to the City Construction Company on. the basis of their low bid in the
amount of $279,988.65 and the City Engineer be instructed to return
the bid bonds to the unsuccessful bidders.

Mr. Williams,. The law is you must award to the
lowest responsible bidder. You
would have to find upon circumstances that would justify that this bidder
is not responsible. it would appear to me, particularly since this is a
1911 Act proceeding and you make a mistake that even though this contrac-
tor has had some experience that hasn't been entirely satisfactory that
there isn't enough here to determine that he is not a responsible bidder
and you would have to be able to find that in order to disregard this bid
and go to the next one especially when there is a considerable difference
between .the bids, V m afraid you would wind up in a lawsuit and a ques-
tion of the validity of the bonds. It's a rather risky thing on the evi-
dence before you, in my opinion, to determine that this is not a respon-
sible bidder.
Mr. Dosh:
We have made further checks since
the report just read. They have
a high rating elsewhere. Appar-
ently they are all right.

• bid for District A111-62-1 Sanitary Sewer District to the City Construc-
tion Company as the lowest responsible bidder in the amount of $279,988.65,
and that all, bid bonds be: returned to the unsuccessful bidders. Motion

to you the R-A, R-19 E-29 R-3 and R-4.
This is the final segment of Amendment No,, 59.which completes the R
zones,, The Planning Commission's recommendation'to the City Council
does the following things. It adds a significant number of new types
of administrative, business and professional offices rather than the
six or eight uses that were limited in the past,, We now have about 18
different uses specifically set forth and the.Commission further wishes
to allow similar type uses when they are deemed to be as the ones
already allowed,, They are not limiting it to .Zrcchit(OCtRq
engineers, accountants, attorneys, and doctors, but all types of
service professional,, They have deleted from the R®P real estate
•offices and residential uses,, The height has been expanded from 35
feet to 50 feet which would permit taller office buildings; the front
yard has been expanded from 15 feet to 20 feet,, The side yards are
pretty much the same as they were,, The rear yard has been expanded
from 15 to 20 and the off-street parking remains the same,, This is
what the Planning Commission has recommended to the City Council,,

If this is a residential pro-
fessional zone, why do we de-
lete residential uses?
Mr. Joseph. The Planning Commission -felt
that this was to be a compat-
able transition type zone which would be closely associated with
residential type uses and although they felt that the -type of zoning
which is permitted could be associated with residential they did not
want residential in here. As the R-P is presently written every -use
permitted in the R-3 is allowed and because of our step-down type of
zoning that means that you may put in single family homes next to
office buildings and commercial parking lots, and the Planning Com-
mission felt that this was not, something that they wanted to recom-
mend to the City Council.
Councilman Heath. This is a sneaky move on the part
of the Commission, on the part of
the Planning Commissioners, changed the name from commercial profes-
sional, left it residential professional and gave it back to -us with
a different heading on it. They have also decided to eliminate resi-
dential uses when this is a residential zoning and eliminate real es-
tate offices and I am sure they are going to put them in commercial
zoning, It is a fairly sneaky move in my way of looking at it to try
and pull a conniving trick to try to move real estate offices into a
commercial zone and they know that commercial zoning is tough to get
in this City. I can't see this zoning whatsoever and I would fight
this zoning completely.
Mr. Joseph. At your joint meeting back in
October of 1962, we went over
the General Plan and we listed a whole slew of things that were
proposed to be allowed in this C-P zone. when the City Council in-
dicated that they did not want commercial professional, the staff de-
leted all the commercial aspects of it and kept it only to the office
use in its statement to the Plarna,ng Commission for their consideration
prior to the Planning Commission making its final recommendation to you.

done. I don't believe that this was done on any sneaky motives of the
Planning Commission; I think it was done on good faith to an attempt
to improve the R-P ordinances as they were directed to do,, I can
• understand why they left out R®3 because we have that zone and I
think their attempt was to make this a transitional zone between R-1
and commercial,, Is too, am wondering why they left out real estate
because it does seem like a like service,, I would certainly consider
adding it to this list of uses if this is approved,, I think this is

activity, tobacco stores, anything that would tend, to fit in with
the commercial.; were deleted by the Commission°
• Councilman Heath. My feeling is that a real estate
office is as much of a residen-
tial professional use as time others, travel agencies, telephone an-
swering services. It is well evident and has been that the.Planning
Commission has a majority, not conclusively, who have no use for real
estate people, don't feel they should be either on the Council or the
Planning Commission, and I think if they have got something in their
craw concerning real estate people„ real estate offices or anything
related to real, estate they ought to be man enough to stand up and
say it instead of trying to put it on a sneaky action. I can't help
but think this is exactly what they are; trying to do because there is
no justification for taking something out of this zone here where there
are other uses in here which are more commercial' than real estate offices
and then putting them into a commercial zone where all they have to do is
sit back and say "we have enough commercial and we don°t need any more
and therefore you can't have a real estate officeo94 It is obviouso Let's
put the stuff on a line and be honest about it.
Councilman Towner- I think possibly Mro heath is seeing
ghosts in his own closet. I agree
that there has not been shown to us any reason for deleting real estate
offices out of the changed zone and I think the residential should go
out and leave it as a transitional zoned I think if we adopt the or-
dinance as proposed except to add the use of real estate offices we will
have a satisfactory amendment to this R-P zone.
Councilman Snyder. I can see one other problem and
that is pharmacies in medical
buildings.

Councilman Beath: What is the reason for increasing
the back yard setback?
Planning. Directors Mr. .Joseph. The staff recommended this feeling_
that if it were to be a transitional
zone there will be many times when the use will either back up to or'
side onto single family residential uses. The idea was to advise'devel-
opers that we would like them to set back a distance significant enough
to separate the commercial from the non commercial. Right now single-
family have to be set back 25 feet. Normally this is going to work out,
fine because in almost every instance I am familiar with newer develop-
ments going in they will put parking in the rear anyway.
Councilman Heath, In a residential professional
zones I would say it°s-a'zone
which might be placed upon a residential structure which exists.
If this be the case, suppose ,you have a house where you have the'
standard R-1 setback, chances are if you move into an existing resi-
dential home and install one of these professions that that residen-
tial home will have a greater sideyard and a greater backyard set-
back than is required under this zone?
Planning Director, Mr. Joseph. Yes.
Councilman heaths What I am trying to get at is
this: That you would move one
of these professions into an existing residence and the fact that
•the sideyard or the backyard setback is not quite as much as speci-
fied here, it requires a man to come in for a variance at extra cost
and so forth.
Planning Director, Mr. .Joseph: If a use is zoned for a particular
purpose or if it is allowed by
variance in an existing structure there would be no further require-
ment for him to build in or rip out any of the additional structure
because he would have what is called a non -conforming use in a con-
forming building, There would be no additional requirements on the
man moving anything except for the off-street parking.

would just be changing the
uses permitted in the zone. Any use which is there and which is

actually commenced by the owner
by the outlay of money and reliance upon the code at its commencement
of work may continue. As to whether merely getting a precise plan
approved would amount to the commencement of the use, I don't know.

where this was discussed and in
a subsequent Planning Commission meeting I was asked my view of it
and I said I didn't know what went on but I thought the Planning
Commission had a duty to review zoning ordinances with a view to
perfecting them or improving them; in other words, a continuous study
process, It seems to me that what has happened is certainly in accord
with what was studied at the Council -Planning Commission meeting and
particularly in view of the comments made by Mayor Barnes and Councilman
Snyder and later on by me; I think the Planning Commission has acted
very justifiably, Further, I think the Planning Commission has come
up with something that is acceptable to all of us, I don't think I
would expect any disagreement from Mayor Barnes that we accept the
proposed amendments to the ordinance with the exception regarding
real estate offices and put them back into it and then we have, I think,
a good workable ordinance, I don't see any particular need to change
the name of it because I consider the designation residential pro-
fessional as indicating not that residential is included in it but
that it is a transitional zone,

here, that it will revert to its original basic zone without the

the same time you consider this and you consider that you will eliminate
the potential, you don't have to take the other; you can initiate the
zone change to firm up the potential but I do think that you are going
to find that this is a bastard zone; there isn't any such thing as
potential zoning,, There is nothing like this on the Master Plan; there
isn't any such zone. It was a poor concept when it was doneo It
hasn't been used since 1955,, There are only a few left and the only

"RECOMMENDATION- It is respectfully recommended that sanitary sewers
be installed in this district.
"ANALYSIS-, This Department has made an investigation of the Larkwood
and other streets Sanitary Sewer District A111-62-2, City
of West Covina as shown on the attached map. During the course of this
investigation, 128 house -to -Mouse calls were made. Of this number, 46
occupants were not at home or did not answer the door° Of the 82 prop-
erty owners or tenants actually contacted, 51 or 62.1% reported having
experienced trouble with their individual subsurface sewage disposal
systems. They complained of the seepage pits filling up causing raw
sewage to back up into they house plumbing fixtures or to overflow onto
the surface of the ground. Also that frequent pumping and cleaning out
of the seepage pits or the installation of new pits was necessary. The
soil within the area of this proposed sanitary sewer district varies.
In some sections it is mostly clay. In other localities it varies from
loam to sandy loam or fine sand. These types of soil are not too con-
ducive to the proper functioning of any type of individual subsurface
sewage disposal system. Clay soil has poor leaching qualities. Loam
and sandy loam is more suitable but still does not provide the best
leaching action. In those areas, where fine sand prevails, the seepage
pits silt up or cave in and cease to function properly.
"In view of our survey, I, the undersigned Health Officer of the County
of Los Ang6l.es.having been officially designated by the City Council of
the City of West Covina to perform public health services for the City
of West Covina, do hereby recommend that proceedings be instituted at
once for the installation of sanitary sewers in the Larkwood and other

All that area in the valley between the bluff and the wash should be a

to add that I think you can
accomplish this possibly by purchasing the property, including the
existing Ridge Riders and the ball field and the property needed for
a golf course and then running it on a revenue bond basis, leasing out
to a concessioner on the golf course to develop, improve it and run it
and bring in sufficient funds to the City to pay for all the property,,
I don't know whether this is financially possible, but it's certainly
worth considering,,
Councilman Heath.- If you look at the dark green
area that is a tremendous size
park as it is and I think before we expand the park area in that site
we should get parks in the other section of town. As far as the golf
course is concerned, I don't know how many acres that would cover but
that land at the present time has an offer on it for $35,000 an acre
and I would imagine if you had a golf course the size of that light
green area you would be talking about at least.ten, twelve. -acres, and
that is a lot of money and I don't see how we could afford it,,

finance it out of the revenue we
get from the property,, I think, too, we need other parks.in other

reasonable at the time that if within two years the City Council should
decide that Duff Avenue should be extended through the property or
if you should decide that a cul-de-sac should be built into the
property that the company would dedicate the necessary property and
make the improvement with the City Council reserving the right to
decide on or before the expiration whether to require this or not.
Plans have proceeded; the building has been delayed, Are you going
to require a cul-de-sac or street across the rear of the property?
This involves a matter of about three or four thousand square feet
of property. We ask you if you feel that now you have planned the
adjacent area of Glendora and have planned this property and if no
need has been shown for the extension of Duff that the requirement be
not waived but find now if you will the Duff extension or cul-de-sac
is not required so the client can avoid this extra fencing and the
loss of spaces and additional cost,

afternoon from the District Court
of Appeal, The Appellate Court has ruled on Forest Lawn vs, West
Covina and upheld the decision of the Superior Court in favor of
Forest Lawn, If you wish to proceed further, I have read the opinion

• only extremely sketchily but it appears to me it is a vulnerable
opinion,, If you want to go further you can go to the Supreme Court.
I think there is a fair chance in this case.

Mr. Blalock but also the potential owners of the ranch. I think we
should appeal to the Supreme Court. Can we drop an appeal if we
change our mind?

prepare the brief and petition the
Supreme Court. You can wait until next week before you decide whether
or not you want to appeal.

Covina Ranch and I think we might as well have the cemetery where
•we want it with reasonable degree of control and I think we can get it
if we are reasonable on our side.

money now and put in the complete
project later on, If you put in asphalt at 13� a square foot it may
be something that will be washed out and not even last that long,

rock would be nominal, The
ditch is full of water now, If we were to grade the shoulders again
and threw in crushed rock it means he wouldn't have a mud hole, he
. would have crushed rock at the bottom of running water. This would
