Mayor Barnes, dated May 3, 1963, signed

Councilman Heath: I talked to the City Attorney about this
and came up with the following: The
Planning Commission did not approve this precise plan, it was approved
by the Council and therefore he would say that it would be the Council's
perrogative to make this minor deviation if they cared to without refer-
ring it back:to the Planning Commission,, They want to put an extension
at the back of the building to form another room 14 by 20. By addition
of this room they will be able to display all the premiums and make this
a headquarter station. They will be within the correct setback. It
will not be a violation of the precise plan!
Mayor;Barnee: This did not come up at Planning Com-
mission levels Due to the late hour
it ha's never been before the Planning Commission; therefore, it could
never be before the Council,
Councilman Heath: This.was on the agenda and it was the
second item.to be brought up at the
time of adjournment,
Mayor Barnes: It would be my advice to go ahead with
the present construction and make
application for the addition.

Councilman Jett: I hate to see us work a hardship on
these people now because they wanted to
add on this little room_, I would like to see it approved and see them
get on with the building, The only question is can we give them
approval to go ahead and add on this room? This I don't know.

Mayor Barnes: No,
Councilman Snyder: I would like to know more about this.
It's my understanding there is a
petition with 6.00 signatures against this and it seems to me Mr.
Houston promised over and over again that they didn't want lube
racks, tire racks and this was part of the reason that some of you
voted for this was that it was going to be a simple filling station,
Councilman Towner: I have no way of knowing what they are
asking for, The letter says they want
modifications but there is no plan filed with us showing what they
are asking for. If they want to make this their premium headquarters,
it is very materially different than what they were approved, I don't
think we are in any position to act on it at this time,
Councilman Jett: I don't think we can act on this tonight.
Move that the Mayor be authorized or
instructed to answer this letter to Mr, Anderson and explain the
situation to him, that we are in sympathy with his request but we
do not have the specific plans proposed before us and there is other
information that the Council needs before there can be a ruling on
this; that the Council will have to refer it to a later meeting or
whatever is necessary and therefore the City Council feels that they
could not take action on it at this time,
Councilman Towner: I think it's perfectly clear that we
are not sympathetic to the request,
You're speaking for the City Council when you speak through the Mayor.
First, we don't know what it is; secondly, there is clearly strong
opposition to this in the City and therefore we can't very well ask
our Mayor or instruct our Mayor to advise him we are sympathetic to
the request,
Mayor Barnes: I think if you said that we can't take
action on it at this time and not
"sympathetic" but we can't do anything,
Councilman Jett: I meant you were to write it in your
own words,
Councilman Towner: I object to the proposed letter sug-
gested by Mr. Jett because it suggests
to the applicant that we would take action contrary to the procedures
provided by law. All that can be told this man is that he follows the
procedures set out by law, follows those and his request will be acted
on accordingly,
• Councilman Heath: Harry Williams made a ruling today that
this is perfectly within the rights of
the Council to make this decision tonight if they care to do so
because the Council is the one who gave the zoning and passed the
precise plan and he would go along with the Council making this
decision tonight if they care to see fit,
Mayor Barnes: I would like to write the letter, if
I mays advising Mr. Anderson that we
cannot take action this evening because we do not have anything before

referred to the City Council;, Is this agreeable? .
Councilman Heath: If he takes a gamble and puts the
.entire slab down and the City Attorney
rules this is not a violation of the precise plans are we going to go
back and.make him take it out?
Mayor Barnes: Is this with the anticipation of
putting a building over the top? I
think the man would be wrong in doing this, Is it ever done?
City Managers Mr, Aiassa: I think the only time it has ever been
done' the applicant has been advised
that he does it at his own risks and maybe faced with.the removal
of the new structure to the existing conditions before improvements.

Mr. Aiassa: I have a copy of the'original res-
olution which the'Council adopted
in 1954 which earmarked the frontage road. (Passed out report re this
matter and explained same.)
I think we should make a request
to the State to provide a cut-off or a link between the present'fron-
tage road and the interchange which would be the loop of the Sunset
Avenue Interchange°
Motion by Councilman Heath, seconded by Councilman Jetty and carried,
that the City Manager be instructed to work with the State on a
method of extending the frontage road in this area to make this parcel
developable and that the storm drain be put underground.

"A Request for a Policy Decision
"It is requested that the City Council make a policy decision on the
matter of City Participation in the construction cost of sanitary
sewers in District A°11-61-10 It will be necessary that the City
Council make this decision as soon as possible so that the 1963-64
Budget can be prepared. The amount of the participation will have
to be determined by the City Council, from the following facts:
"District A°11-61-1 went to the City Council for the first
hearing on October 8, 1962. At that time it was estimated
that the cost of the district would be $367,681 or approx-
imately $5.60 an assessable front foot. A subsequent re-
evaluation of the adverse soil conditions, the general in-
crease in the cost of sewer construction, and the depth as
well as the size of the lines required to serve this district,
increased the cost estimate to $503,553096o This increased
the assessable frontage charge to $7.82.
"At the hearing of the November 13th meeting, the City Council
expressed concern over the high frontage cost, as the highest fig-
ure up to that time, per assessable front foot, was in District
A111-59-1 and 59-3 which amounted to $6.30 a front foot. At the
time these revised figures were presented to the City Council Mr.
Rosetti, of L.J. Thompson's office, submitted a report on cost
and the reasons forthe excessive front foot expense. The over-
sized lines in the district were at that time estimated to cost
$33,342.35. This amount of participation would reduce the
assessable front foot rate to $7.30. Mr. Rosetti°s report also

"indicated that contingencies might be reduced as much as $20,'000.00
and that we could hope for a bid from the contract6rs'that'*6uld'be
some 5% under our estimate and that the Engirieering'',cost-might be
reduced $5,000.00 This in effect would have reduced the dis-
trict"s cost by approximately $45,000,00.. Urifortunately"dontin-
g6ncies are running approximately as estimated. 'The actual bid
for the construction work was 1,46% over our estimate. These
o facts make a reduction of the frontage estimate of $7.82 rather
dim without City participation.
"In addition to the cost of the district itself, the property
owners in District A11.1-61-1 will also have to -pay . a reimburse-
ment imbur§d-
ment charge for the trunk line in Willow Avenue from -the Walnut
Creek Wash to the Freeway. This will increase the cost to the
district by $6,402.23. If the City Council should elect to par-
ticipate for the extra capacity that is necessary to serve this'
district, in other words participation in the trunk line expense
only, the total participation amount would be $22,868.08. This
would pay for their capacity rights in the above -mentioned Wil-
low Avenue line and for the trunk lines in Willow Avenue north of
the Freeway, Pacific Avenue and up Orange Avenue as far as Work-'
man Avenue. These lines are indicated on the attached map which
also shows the three districts that drain into this distrtet.
District A111-62-1, which is the area east of Orange Avenue would
also benefit as they would not have to pay capacity rights in the
trunk lines built in District's A111-59-1 and 61-1.
• "Increasing the constructions cost by 1.46% raises the assessable
frontage cost to $7.94 a front foot. Participation in the amount
of $22,860.08 would reduce this to $7.68 a front foot.
"To summarize: 1) The City Council must make a policy decision
on whether or not to participate in the cost of the sewers in
District P11-61-1.
112) The amount of participation must be determined.
113) The participation amount, if any, will have to be
included in the 1963-64 Budget.
114) Each $6,000.00 of City participation decreases the
frontage assessment approximately 10i a front foot.

Councilman Beath: Isn't the Sanitation District
asked to participate?
Mr. Aiassa: This is one of my recommen-
dations.

that the City Manager be instructed to contact the Los Angeles County
Sanitation District with the proposal that the Sanitation District
accept the cost of any amount over the cost of an eight -inch line
in the trunk as shown on the map.

"Dear Sir:
"Reference is made to your letter of February 1, 1963 regarding
40 right of way standards for Federal -aid Secondary Projects.
"As you state, the desirable minimum for the ultimate development of
a Federal -Aid Secondary route within an urban area is considered to
be 110 feet of right of way. Federal -aid Secondary routes are major
arterials and this width is sufficient to provide for three 12-foot
moving lanes in each directi on separated by an 18-foot median. Res-
ervation is also made for 10 feet on both'sides of the traveled way
to provide for necessary sidewalks and ultility installations.

"Of course, three lanes in each direction can only be achieved by
• banning streetside parking and if it is desired to retain this
feature, additional width would be required. The 18-foot median
is based.on the premise that speeds will be limited to about 25
miles per hours If higher speeds are expected, the median curbs
should be offset 2 feet from the edge of the traveled way, thus
increasing the median width to 22 feet.
"We wish to re-emphasize that the above typical geometric section
is the desirable minimum ultimate development, Each specific pro-
ject must be considered on its own merits. Construction within
100 feet of right of way has been approved under three circumstances,
as follows:
"lo On the basis of stage construction with setback lines es-
tablished for a greater future width. In cases where 110 feet
or more cannot be immediately cleared, the setback method
should always be explored. It seems quite likely that few
encroaching buildings of consequence would be remaining in
good condition beyond the duration of the normal design period
of 15 to 20 yearso
112o By the process of taking access, or by zoning to require
that all buildings face away from the arterial, thus elimin-
ating all entry and exit between street intersectionso Border
areas can then be reduced to five feet in width while main-
taining the desirable 12-fogt lanes and 18-foot median.
"3. The right of way can be reduced to 100 feet by narrowing
the moving lanes to 11 feet and the borders to 8 feet. This
solution is reserved for cases'of absolute hardship, that is,
situations where there is no other course and economic studies
have been made which show without doubt that the additional
expense required to obtain 100 feet is not justified when
weighed against the additional benefits gained by the trav-
eling public.
"Your letter does not suggest a particular project, However,
we assume that the City does have the improvement of Glendora
Avenue in mind, May we, therefore, suggest that in planning
the future development of Glendora Avenue, consideration be
given to providing.a direct connection to the San Bernardino
Freeway via the Vincent Avenue Interchange, Any proposal for
improvement along the present devious routing between some point
southerly of Walnut Creek and Azusa Avenue would be most diffi-
cult to support.
"The massive urban growth in the metropolitan area of Los Angeles
has created many problems in the movement of traffic. Wider
traffic lanes and borders provide more freedom of movement which,
in turn, we believe, better preserves, or even enhances, property
. values. However, economics are an equally important consideration.
We, therefore, would be most happy to discuss with you any specific
proposals which you might have in mind concerning the improvement
of Federal -aid Secondary routes within the City.

Mr. Aiassa: This was sent to me, dated March
5, 1963, signed A. Co Birnie,
District Engineer, by M. L. Buader, District City and County Projects
Engineer.
Motion by Councilman Heath, seconded by Councilman Jett, and-carkidd,
that the City Manager be given permission to submit this report with
the map to substantiate our request to reduce the width of 110 feet
to 100-foot right of way on Glendora Avenue.

concerning a possible lease by the City of State -owned -
property on the north side of the San Bernardino Freeway
adjacent to the Orange -Pacific interchange.
"The plans for widening the San Bernardino Freeway and
reconstruction of this interchange should be completed within
the newt two years, and it will then be possible to dispose of
any excess property within the interchange area.
"It is suggested that the City defer any plans for
utilization of this area for parking facilities until such
time as the State is able to dispose of the property, We
will, of course, keep you informed as our plans develop,

interchange and find one area
that will not be used for wid-
ening for interchange layouts.
Mayor Barnes: I gather that maybe this was not
the right spot or right time to

"As a result of a directive received from the City Manager
on March 19, 1963, this office performed preliminary inves-
tigations for the design of a proposed parking lot on the
Orange Avenue interchange northerly of the San Bernardino
Freeway in the quadrant between Orange Avenue and Pacific
Avenue.
"As indicated on the attached study map, it is conceivable
to provide at least 33 parking stalls on the easterly two-
thirds of the property, Construction estimates are in the
amount of $3,733.18; said estimate includes 10% contingen-
cies. The area would have to be filled considerably to
provide adequate drainage, but this construction is feas-
ible in this area. If additional parking is desired, stalls
could be .added on the westerly one-third of the property.

Councilman Townes I think you would have to
amortize it.
Mayor Barnes-, Until we have something concrete
to go on, I would hesitate to
try to charge the people for all day parking and feel I was going to
amortize out that amount in a two-year period,
Councilman Jett. I don9t see how we can do it at
the present time. We have no
idea how many people would use it. I don't see how we could deter-
mine any way of amortizing it over a period of two years. If we made
an estimate of the number of cars parker, there daily and determined
the amount of charge per month per car o 0 .
Councilman heath-
I think you're going to have
to put the improvements in
and mark it off in terms of
good will or whatever.
Councilman Jett- I don't think we can afford
to go into a program setting
up free parking lots along the freeway. If we set up something
rendering a service, I think people would use it,
Councilman Heath. I think we should ask par-
ticipation from the State.
It would save them policing,
save them that much damage
to their fence,
Councilman Jett-, Why don't we use gravel on this
first one instead of going to
the expense of blacktop?

face area, a few years ago we
were called upon to present a report to the State Division of High-
ways how we would handle several areas along the freeway. At that
time they insisted that these areas be paved.

set back two or three feet from the limits of the parking area

"It is understood that the City will prepare all necessary
plans for construction of these parking areas and that such
plans will be subject to the approval of the Division of
Highways prior to starting any construction.
"In the event that you desire to consider this matter further,
please advise us and we will prepare for your review a rental
schedule based on the lots that you propose to construct,

City Manager, Mr, Aiassa: I would like to have this report of the
Park and Recreation read into the Minutes:
"Attached are two copies of an application and contract for electrical
services at the Little League Field, in Cortez Park. This is for the
night lights which were approved for installation by the City Council,
at the January 28 meeting. (Page 38)
"When the Eidson Company provides electrical service to a piece
of property that does not have permanent dwellings, they must
guarantee a return on their investment; in this case.the amount .
is $939.00. The attached application simply guarantees that the
lights will not be removed from this ball field for the next 6
years. If the lights should be removed within 3 years, the City
would be responsible for the total installation cost. It is a
slide scale downward in the event of removal in the first 3 years.
"It is this Department's feeling that the lights will be in use for
a much longer period than the 6 years and would therefore recommend
that the application be signed immediately so that the Edison Company
can proceed with the installation. An identical type of agreement
was signed by the City Manager for the field lights at Orangewood
Park last year.

doing work on a section of Vine Avenue, Our purpose in asking
for a bid is to undertake this job on an experimental basis.
We have done certain work in the recent past using different
kinds of equipment and -asphaltic paving material. It is our
intention to slurry seal this section of Vine Avenue to -deter-
mine whether -or not we wish to*utilize this method in our sur-
facing program this summer. Our present intentions are:
"ln To resurface certain streets under contract with formal
bidding procedures.
112. To resurface certain streets over newly constructed sewers
without going to formal bids, as we have in the past.
113. To perform Slurry seal resurfacing on those streets
which are not in critical shape but which do need
additional seal coat protection which will extend
the longevity of the street for another five years.
"As you can see, a seal coat costs less than 14 per square foot
and does a similar type sealing job that a rock and oil seal

and Mitchell might be in the best position to give us new ideas. They
are in Los.Angeles, 626 South Spring Street. This amount of money
,suggested by Pete, Maurowit and Mitchell is the maximum amount they
will charge, $3,,200.00. This man is on the committee studying the
1911 bonds and it might be valuable to us; however, if it is being
done with the League of California Cities I imagine it would be
available to us anyway.
Councilman Heath: I think Cotton and Francisco
have only had it for a few
years and I think we ought to give it to them for one more year.

feel where there is an area of distress possibly damaging two, three,
four properties that the City should get in and head this thing off
or channelize it? I would like action from the Council to direct the
staff to go and see Mrs. Pantaleo and see what they can do and help in
every way they can, I think it behooves the City to spearhead some-

dates of the hearings and a copy of the
ordinance be given to them in advance so they have time.to read and
study it and come up with their recommendations,

participation in a program that we are
40 all concerned about and I know of no group of people who will be more
effected than the Board of Realtors in any type of zoning or any
type of zoning ordinance that we pass, I think if the opportunity
presented itself where we could avail ourselves of this cooperation
on the'part of the realtors in them giving of their time and experience
I think we should avail ourselves of it; I think our. Planning Commission
should avail themselves of this opportunity -if necessary, sit down in
a joint meeting,

meeting at the Los Angeles Chamber of
Commerce, The chief of the hillside development for the City of Los
Angeles is going to give a talk on the Santa Monica Mountains and how
it is going to be developed. This is a luncheon,
