Williams, City Attorney Mr. Harold Joseph, Planning Director CITY CLERK'S REPORTS PRECISE PLAN NO. 30, SECT, 2 AUTHORIZE RELEASE OF BOND MOHNIKE & BATELAAN DEVELOPMENT COMPANY APPROVED LOCATION: East side of Sunset Avenue, north of Service Avenue Release Pacific�Employers Insurance.Co. bond No, 01-B-50144 in the amount of $8,200.00. This bond to be released because Mohnike & Batelaan have deposited $615.00 with the City to participate in Project C-171; also accepts improvements. . Mr. Aiassa read a report regarding this matter. Mr, Dosh drew a map on the board and explained same, Councilman Towner: If I understand it, we are re- leasing the bond and accepting a deposit of $615 for the southerly improvements and accepting the improvements that are there? City Manager, Mr. Aiassa: Public Services Director, Mr. Dosh: -1- That's right. All the deposits for the curbs and gutters on Walnut Creek Parkway are in. • is C. Co 3/18/63 CITY CLERK'S REPORTS - Continued Motion by Councilman Heath, seconded by carried, that the bond in the amount 'of No, 30, Section 2 be released and that $615.00 to participate in Project C-171 improvements already in on Precise Plan Page Two Councilman Towner, and $89200,00 on Precise Plan the City retain a deposit of and that we accept the No, 30, Section 2, Motion by Councilman Towner, seconded by Councilman Heath, and carried, to approve the plans and specifications in Project C-171 and authorize the City Engineer to'negotiate or call for bids, whichever procedure is required, and that we waive the.$2900040 maximum on purchase orders as required by the City Ordinance in favor of the $29500.00 maximum required by the Government -Coded City Manager, Mr, Aiassa: In our purchasing procedure we have adopted by ordinance at the time we adopted this we had a provision in the City. Code and at that time we were only permitted :informal bids.up to $2,000000, Now they have adjusted the State Code which permits $2,500,00 and I think if I had a motion from the Council directing the City Attorney to provide the necessary amendment to Section 2709 and bring it in at our next meeting, we would no longer be in conflict with the State Code, Mayor Barnes: I think your recommendation is good; however, I.hate to see these informal bids too high. This way we have a pretty good control of it, Councilman Jett: I think this is a reasonable request, Councilman Towner: It saves confusion, Motion by Councilman Towner, seconded by Councilman Heath, and carried, to direct the City Attorney to amend.Section 2709 to conform with the Government Code on maximum bids, PROPOSED "COVINA -RANCH ANNEXATION" TO THE CITY OF WALNUT Councilman Towner: I take it you have reviewed it and are satisfied that the proposed annexation to the City of Walnut --includes everything except the 100 acres in litigation and the 390 or so acres proposed for a cemetery? City Manager, Mr, Aiassa: This is what has been indicated to us. We have not actually scaled out the metes and bounds and actual square footage, If you would like us to do that we can do it, Councilman Towner: I think it would be helpful if we have that information, -2- C,, C. 3/18/63 Page Three CITY CLERK'S REPORTS - Continued . Mayor Barnes: I have had calls from different newspapers in the.area.and.they would like to know some of our comments, our position in regard to this annexation to Walnut and also in regard to the cemetery as far as Forest Lawn is concerned with Los Angeles Countyo Councilman Heath: If we are not going to protest it9 it would be A waste.of time to do anything on the maps. Mayor Barnes: The only one we.have before us is the annexation to.Walnut. We haven't seen the boundaries of the cemetery site as far as Los Angeles County is concerned. Until we get that map, I don't.think we could have any comments. I think we should have that map.for our informationo: Councilman Towner: I think this property is clearly within the area of influence of the City of West Covina and even though we chose not to move to the east for the time being, it appears to me that this should not be completely ignored and forgotten about. It..does effect the destiny of our City and the destiny of the residents of our City. I don't think we have any reasonable ground on which to protest to the City of Walnut in their annexation of this territory. I don't think we have any reasonable ground to protest a cemetery. I think the only thing we can do is study the territory and see if there is something in the best interests of the City of West Covina that can be done,, Mayor Barnes: PROPOSED ANNEXATION NO. 25 TO THE CITY OF LA PUENTE Mayor Barnes: If there is no protest, I'll make the declaration that there is no protest to this annexation. I don't think we have any legal - protest to this. Councilman Towner: A long time ago we reviewed and studied annexations south of Francisquito and decided not to take any more down there. REQUEST OF FRANK C. MARPE.CHAPTER OF DISABLED • AMERICAN VETERANS TO EXCLUDE OTHER DAV ORGANIZATIONS FROM SALVAGE PICK-UP IN THE CITY. Mayor Barnes: -3- Mr. Burke., would you like to speak? C. C. 3/18/63 CITY CLERK.° S REPORTS- 'Continued Page Four • Mr. Shannon Burke I am connected with every 1702 West Swanee Lane veterans organization in the West Covina area. We are asking only that the larger.organization of Ellison, who has paid for a license, who now controls Pomona, Santa Ana, Orange County, Long Beach, Pasadena, Monrovia and Azusa, and who has us completely surrounded, stop attempting to move in. He has a truck with "Disabled American Veterans" on ito He is a. profit -making organizationo He operates on the premise of picking up in certain areas and then paying that chapter that is in that area.a certain stipulated amount of money per month for using the name "Disabled American Veterans". He came in here and bought a license for "Veterans Salvage". Councilman Heath.- I think Mr,, Burke's comments.. have good reasoning; however, I don't know all of the details on this and I wonder if we should take care of it tonight. I think it should be put off and.a study made such as can we stop the man if he has a license; is he profit or non-profit organization. Councilman Jett: In the event we are unable to stop him, I think he should put the City Clerk on notice when his license expires and.then let's reconsider this thing, Councilman Heath.- We also have to take into consideration the legal part of it and talk to.our attorney, whether you can refuse a license or not. Mr. Shannon Burke: The thing we are kicking about more than anything else is the fact that he's picking.up salvage under the name of the Disabled American Veterans,, Councilman Towner: It seems to me there are only two things we can do. One, we can limit Disabled American Veterans pick-up to the local chapter. I think that is legal and possible. The other would be that we can prosecute or whatever is necessary to stop the fraudulent pick-up under the name of the Disabled American Veterans. Beyond that, I don't think there is anything we can legally do. I think these actions seem to be in order and if they are checked out with the City Attorney, I think we could do that. Mayor Barnes: Mr. Flotten, will you check this out with -,Mr. Williams and see what we can possibly do and we will bring this up again? City Clerk, Mr. Flotten: Yes. -4_ C. We have checked into this matter and we have not received the bond and there are a number of other matters that have not been taken care of and this is not shaping -5- • 0 0 C. MAYOR'S REPORTS STATEMENT FOR 1963 $100.00 MEMBERSHIP DUES OF UPPER SAN GABRIEL VALLEY WATER ASSOCIATION City Manager, Mr. Aiassa-, I.think we are overdue now. Councilman`Heath,. I would like to hold this over for at least another meeting. Both the Mayor and I were contacted'by Mr. Jensen from the Metropolitan Water District today and he has set up a meeting and he would like representatives of the Council and the Metropolitan Water District on March 27 at 10:30 in the morning and April 3 at 100.30 in the morning to discuss the historical plan and Carroll Plan and possible annexation of West Covina to the Upper San Gabriel Water District. Mayor Barnes-, Councilman Heath-, Not necessarily. That is what he told me. Mayor Barnes-, I discussed this with Mr. Jensen also. The reason for the two meetings is this,, He feels that one meeting is not adequate for them to be able to come up with the answers to all of our questions. He would like to have full Council participation, if possible,in discussing this. He does want to bring the City of West Covina in, if possible, under this historical plan which we all desire. The second meeting would be to discuss further and so that they would benefit and have the answers for us after the first meeting. Councilman Heath-, W I can make the meeting. Co C. 3/18/63 MAYOR'S REPORTS - Continued Page Seven Councilman Towner: I have trials scheduled on those dates I certainly think attendance by Mr,, Jett, Mr,, Heath and Mro Barnes and.'anybody else who can get there is worthwhile,, I think the picture._has.changed substantially now that the overwhelming four®to-one.vote.indicates that the people are willing to pay the extra.cost in.order_.to insure themselves of water for the coming ten years before.we.get_the State water which is the only reason to go into the Metropolitan Water District that I know of,, Mayor Barnes,, Department attend this meeting with the I would like to request -.-.that at least one of the Engineering Council to..take notes. Councilman Jett: I think it behooves.us_.to join one of those groups who will be in our sphere of influence,, Pomona is going to be over the hill and in a different basin,, I don't go along with this idea .that Metropolitan is the cheapest way. I do feel that we must.do something to get supplemental water and the fact that the indication is'that the easiest program for us to sell would be M,,W,,D,, I think.we would have a rough time selling them State water which I..believe is the best way and the cheapest way,, I don't think we can sell it to..the voter,, Councilman Heath: gabriel Valley Water Association with Metropolitan Water District,, Move we hold over ship dues for the until after our meeting the member® Upper San of March 27 Councilman Towner: We do have a delegate there; Mr. Heath attends the meetings and gets the information and we have reaped some benefit from it so far this year and I am wondering if we just don't have some moral obligation to pay them for continuing along with.this information,, Councilman Heath: I'll withdraw my motion,, City Manager, Mr,, Aiassa: It's in the budget. I told him I didn't see the possibility of.a meeting prior to the Planning Commission meeting of the 20th,, He suggested that perhaps they should request an extension of time in order to have this meeting. I suggested that if we..were`going to have a meeting with the Council or representative of the Council that we should have a representative from'the Planning Commission to give them'"benefit of the thinkingo I also recommended that.Mr. Aiassa and Mro Williams attend this meeting. Councilman Jett: I think this is a meeting that would be uncalled for and going in ahead of the Planning Commission,, I don't believe in stepping in and trying to usurp their power,, I wouldn't be in favor of this, Councilman Towner: I concur with Councilman Jett,, I think that while on some occasions a preview of such things might be helpful, the burden is ultimately on the developer to propose his proposals,, If he wants to go ahead on a proposal that he knows lies across a proposed and essential street and one which has been approved in our Vincent Avenue Interchange then he is going to have to run that risk,, Maybe he can come up with something better but I think he should do it through the normal channels,, Mayor Barnes: If you would like to answer this letter to him, I would so inform Mr. Gendel that the Council has acted in this manner,, City Manager, Mr,, Aiassa: I'll follow up on that,, C. C. 3/18/63 Page Nine MAYOR'S REPORTS — Continued & FIREWORKS ORDINANCE City Clerk, Mr,, Flotten: You directed me to -get-together with the.different.service organizations in town to see what could be done with particular reference to the Fireworks Ordinance. (Explained past action on this,,) Mayor Barnes: It had to be a veterans. -organi- zation but it.didn't say that this veterans organization had to be chartered,, .. Councilman Jett: I was reviewing those. -Minutes the other day and I think we agreed to leave it status quo because there wasn't time.to change it with the possibility of reviewing it this year A lawsuit.has been filed against La Puente and I would like to -see us remain''status quo until this is resolved and we know where we are going,, One of the service organizations filed the suit,, Councilman Heath: I am in agreement -with that,, Motion by Councilman Jett, seconded by Councilman Heath, that the present Fireworks Ordinance be left as is pending the decision regarding the case of a service organization versus the City of La Puente, Motion passed on roll call as follows:. I have a party that I would like to contact with the possibility of recommending, Mayor Barnes: Councilman Towner: Mayor Barnes: We have one vacancy and.we.will have one around the first of May. (Said Bill read by_Mro..Flotten,) Councilman Jett.:... It must be with a search warrant. Councilman Towner: I don't.know why any public agency would.object.to thato What is the problem? Mayor Barnes: I think what they.intend to do, they have been trying -to in the police area.to be able to enter houses without search..warrants, I think -this is infringing on the rights of peopleo Councilman Jett: In my opinion, I.think that a search warrant.is..something that should be required before you violate somebody's residenceo This could be abused. • City Manager, Mr, Aiassa: I would like to check..this down a little bit for youo Councilman Jett: Can we get a run-down from Phil Soto on that? Also keep in mind the fact that even though it's for inspection of wiring and this sort of thing by different departments, this can be abused.;'. I explained to him that we are preparing a master map in the City and we hope to have a report to the City Council.by.April..or Mayo These could be determined by the City_ Council as being necessary or you will have to wait until the petitions are received. That area would be included in one of these districts and the Council would have.to decide whether or not this is a priority district. Councilman Jett: Could we hold this.over and include this on one of our field trips? City Manager, Mro Aiassa: Yes, it iso HOUSTON PROPERTY Councilman Jett: I notice Mr. Houston in the audience this eveningo He asked me a question that I couldn't.answer regarding the sewer on Vincento His original application called for a cesspool and a septic tank and then in our requirements I believe we required that he attach to the sewero The closest point that a sewer comes to his property is down Workman Avenueo I don't know whether we can drain into that going north or noto In the event that we do, how do we handle these things? Page Twelve Did they give you.an answer when you talked to.the City staff? No. We said we would come back tomorrowo Mayor Barnes,. I think either one way or the other, I think Mro..Houston can demand that Mr. Aiassa and Mr. Dosh give him an answer tomorrow on which way he could go, Councilman Jett,. He had another question. Ithink it has been the policy of the Council on streets that are 80 or 100 feet wide that.in those areas of improvement that the owners put in the .curbs and gutters,.sidewalk improvements, dedicate the land and the City excavates and.does the paving of the street. Is this true? City Managers Mr,, Aiassa.- It all depends. Public Services Director, Mr. Dosh,. We wrote a report about a year ago on the different -policies the Council has had on this. The present tendency is to pave the center 24 feet, The only time the City Council has paved the entire street is where the developer has dedicated the entire 80 feet, Councilman Jett, I want to get the policy established once and for all, Every time this comes up I get a different answer. Mayor Barnes, If the applicant makes a request to the Council then it is up to the Council°s Judgment as to which way we act. Councilman Towner,. I think it should be made clear here that there are varying policies applied by the Council in varying circumstances in the past. We do have a basic law which is that the developer put in the entire improvement. If there is hardship shown or special circumstances shown then the Council has varied from that policy. Mayor Barnes,. Would it be satisfactory if we have the staff make a little resume of like areas so that we can have something to go on? Councilman Jett-. • City Manager, Mr, Aiassa,. ®12- Fine, I would like to get this down in writing,. Mr. Pontow made a report of 14 pages on this, I'll give you a Copy, • C. C. 3/18/63 Page.Thirteen ORAL COMMUNICATIONS - Continued CLOSING BUSINESSES ON SUNDAY Councilman Heath.- There are a number.of resolu- tions being passed concerning this closing businesses on Sundays. I feel quite strongly about this,, I am opposed to the bill. Not that I am an atheist or in.favor of blue laws or against blue laws but I think here we have a country.of free enterprise.and a country where a good percentage of our.people..do not observe Sunday as a holiday and I think to require that all.businesses except necessary businesses be closed on Sunday is not fair.to'public enterprise or to the people themselves. I_therefore'would.like to see this Council pass a resolution strenuously objecting to the bill. because I think it is not a good bill. Mayor Barnes: I don't think I.could vote for this because we just -recently passed a law in West Covina opposing the barber shops from staying open on Sunday. Councilman Heath.- That was for.a.particular reason. Councilman Jett.- This could throw,a lot of people out of work. Councilman Heath.- The Chamber passed a resolution in favor of the bill, I beliebe. Mr. Tambe.- The Bill I think he is referring to is Senate Bill 845 intro- duced by Senator Joseph Radigan of Santa Rosa County. It proposes prohibiting the sale of merchandise that would fall in the specific categories raised in the Bill; it excludes certain categories from the provisions of the Bill and some are real estate, auto parts and supplies, recreational items sold in resort areas, restaurants, merchandise necessary for the public health and welfare such as drugs and medicine and things of this sort,, The Chamber of Commerce and Board of Directors at a special meeting held last week did pass a resolution supporting passage of this Bill,, Our resolution had a provision which instructed me to forward copies of this resolution along with a cover letter to all chambers in the San.Gabriel Valley urging them to take similar action. Mayor Barnes.- I would like to have a chance to review this. He has made a request through the Public Services Department that he would like the.Council to complete the curb and gutter all the way around onto Walnut Creek Parkway,, Mr. Dosh, how much more additional money would that take? Reiner '. 2204 Walnut Creek Parkway West Covina $75.00 in paving plus the relocation in sprinklers which is quite costly,, I think it would run about $60. I waited'a year after the job.was...completed for Teichert & Sons"to replace my sprinklers and -replant my lawn. I also wrote a letter Sept. 11, 1962, to them.and forwarded.a copy to the City of West Covina asking your help in'collecting this bill. Mr. T. J. Dosh finally answered Nov..30, 19.62, telling me nothing.could be done, if I wanted it fixed I would have to do it. I went ahead and regraded, replanted and replaced nine sprinklers at a cost of $135.00. iNow less than three months later you want to come in and tear it all up. After all my expense (which now totals $585.00) and trouble to maintain a beautiful corner I think it only proper that the City stand all expenses, which will enc.lude $60.00 to move -sprinklers. Because of sidewalk all twenty seven sprinkler heads will have to be moved in order to get proper coverage and still not wet the sidewalk. Also I stand to lose two trees, one ten inch seven years old -and one two'inch, plus a good seven year old hedge. "Since my home is the only one. involved and if this can not be done properly, I suggest the whole matter be dropped until such time that sidewalks are voted in by the tax payers for the City of West Covina."
