12-17-1962 - Special Meeting - MinutesSPECIAL MEETING OF THE CITY COUNCIL CITY OF WEST COVINA December 17, 1962 Notices of this special meeting were delivered to all Councilmen and the Mayor on December 14, 1962. Newspapers were mailed notices on December 14, 1962. Mayor Barnes called the meeting to order at 7:55 P.M. PRESENT: Mayor Barnes, Councilmen'Jett, Towner, Heath 'Councilman Snyder arrived at 8:OO P.M. EXTENSION OF CAMERON AVENUE Mayor Barnes read the motion reflected in the Minutes of the meeting of the City Council on November 5, 1962, as follows: "Motion by Councilman Towner, seconded by Councilman Jett and carried, that the City Manager make a preliminary re- quest for extension of Cameron Avenue from California to Glendora on a 48' width for an application for 50% parti- cipation by the County in H. T. Ca funds for 1963--64 and authorize the staff to prepare a preliminary alignment and cost estimates." Councilman Heath referred to Resolution No. 1129 dated May 13, 1957, which granted Unclassified Use Permit No, 18 for a hospital and • attendant facilities on the north side of Cameron, subject to re- commendation of the City Engineer which include street lights, side- walks and sanitary sewers, and that the necessary widening of Glen- dora and Cameron Avenue be deeded to the City. If we could require these improvements at that time, we can do it now. We could ask whoever develops the land to do it. If we do not use this money here, we can use it somewhere else. Councilman Snyder: They had a Precise Plan ready to go Mayor Barnes: We have required subdividers to put in the improvements in the past. Councilman Heath: Mr, Jett, did you not say that the new owner would dedicate? Councilman Jett: I asked him, if he were given R-3 zoning, would he put in curbs and gutters, pave the entire street and dedicatee I made no promises, I only asked him. Mayor Barnes: He could still dedicate and .ask for 48' from the City - this has • been done before. If he knows, he would ask the City to do this. -1- Special Meeting 12-17-62 Page Two CAMERON AVENUE EXTENSION - Continued Councilman Towner: For the record, we are -getting out of line; 'To do this is con-' trary to law and business ethics. We should not commit in-advance'of a public hearing; there may be those who oppose this zoning at the hearing; then the Councilman who'commited would-be subject'to court action. You.may say what you like the pro- cedure is improper. Under due process of law they are entitled to a public hearing and Mr. Jett would be involved, Councilman Heath: Didn't the Council direct the Mayor to contact Mr. Jones re- garding the purchase of the Skelton property and the possibility of zoning if he put in the improvements? Mayor Barnes: I contacted Mr, Jones. If he ' deals with Skelton, it would have to be through escrow; if he got zoning it would have to be through a fair hearing, then he could nego- tiate. I have not heard from Mr. Jones at this time. This would be a hearing before the Planning Commission and Council. Councilman Towner: Consider improper procedure from the point of outsiders who oppose, against the powerful influence of the Council. • Councilman Jett: To clarify, I am fully cognizant of the situation. If I think it is to the benefit of the City to talk to people about zoning, then I will do it, but make no promises. Regarding Cameron Avenue, I told this party he would have to file an application subject to improvements to Glendora, California and Cam- eron. I made that report. I never told anybody we would guarantee zoning, I asked if they would consider putting the improvements in; I have every right to do that'. We lost the Superior Court because we do not pay enough attention to politics. Had you done your job as a politician, we would have gotten the Superior Court for West Covina. Pomona did, and as a result they were successful and got the Court. Councilman Towner: I think it is wrong to set a policy of trading improvements for zoning. It puts you in the position of sel- ling your soul to get improvements. Zoning must be done legally by the whole Council, Councilman Heath: If the City can save $80,000.00 and put in an as to the City, we should. More multiples are coming in. If this area could accomodate R-3 and save $80,OOO.00, it is our duty. If the medical center was going to dedicate, why can't we do • it now? Mayor Barnes: Would you like to hear the letter? Councilman Towner: I understand the application is for the center 4810 -2- Special Meeting 12-17-62 Page Three CAMERON AVENUE EXTENSION - Continued Mayor Barnes read the letter to Supervisor Bonelli: . "The City of West Covina is contemplating the extension of Cameron Avenue between California and Glendora Avenues in the -63-64 fiscal year budget. With the completion 'of this major street through our City, there will be'a`connecting link from the Freeway on the west to Grand Avenue and'Valley Blvd. on the east. In previous request for H.T.C.'funds'on" Cameron Avenue, the Board of Supervisors saw fit"to-grant such funds on a 50-50 basis. This includes $12,000 for -the Cameron Avenue bridge abutments in 1961 and $45,000 for the Cameron bridge and paving improvements in the year 1961-1962. "Since this street,is one of general County interest, our pro- posal would be to construct the center 48' within the limits of the proposed 80' right-of-way, The estimated cost of the project is $78,000, therefore our request for participation is $39,OOO. Construction will include certain modifications at the intersection of Cameron Avenue and Glendora Avenue, as well. The attached map indicates the proposed Cameron Avenue extension. "We would appreciate very much your considering participation on a matching fund basis for the construction.of this highway in West Covina." Mayor Barnes: This would open the street. • Mr. Dosh: We hope the cost will be less than the estimate which is high on pur- pose. Estimate is based on opin- ions, and property owner's statements. The UUP No. 18 for hospital was approved in 1957. Since then, we have zoned a portion of Glen- dora Avenue and built the Queen of Angels Hospital. Councilman Towner: Improvements to Cameron would break loose the traffic circu- lation, Councilman Snyder: I think we should send the letter. Mayor Barnes: This would get traffic through the City and adjacent area and would open up many streets. Councilman Jett: It's a pleasure to hear someone, else talk about traffic circulation. The owner would develop, but not at these prices (referred to estimate). Mr. Dosh: We hope to do a lot of work at Cameron and Glendora. We have no firm design at this intersection. • Mayor Barnes: Estimate if $78,000,00, .City's share $39,000.00. If it is less, so much the better for all concerned. Councilman Jett: County engineers are capable esti- mators. Councilman Towner: We have our staff do it; if County makes a better estimate, what do they do? -3- Special Meeting 12-17-62 (JAM,15"N AVENUE EXTENSION - Continued Page Four Mr. Aiassa: This is only preliminary; we make the estimate high. We also had a` watermain problem, We must -set up' • a project. If we estimate too low and the cost is high-, the County'can- not adjust, and they may not have money.* We must be realistic.' County will review all projects and how much money is available. We must place the application now. • 0 Councilman Snyder: Councilman Towner: Councilman Heath: Councilman Towner: Councilman Heath: Councilman Jett: Roll call on motion to send letter: Motion to send letter, seconded by Councilman Towner. Let the applicant come'in and we will consider the zoning. This may be R-3. We already have enough R-1, we need more development. I am starting a drive for more commercial from high clientele. Rezone - selling - already zoned or conveniently rezoned. We still have problem parcels. R-1 will bring nothing. Indications are of something else. To say you won't give zoning is wrong. Ayes: Councilmen Jett, Towner, Heath, Snyder, Mayor Barnes Noes: None Absent: None Councilman Heath qualified his "yes" vote by saying that he wants Cameron Avenue through:: but in a different manner - that the funds should come from the developer and the money from County used in a different place. FIRE PROTECTION — ANNEXATION 158 Councilman Towner: Mr. Aiassa: Councilman Heath: Mr. Aias.sa: Councilman Towner: Councilman Heath: Is Pickering going ahead with de- velopment? Anticipate improvements; begin model by end of the year. Does protection cover entire Pickering subdivision? Provision is for land as it is now'. County could ask for renegotiation when developed. Apply as is and take over protection. Possibly adjust in March,,more services, more fees. The $500.00 comes from the General Fund. -4- Special Meeting 12-17-62 RESOLUTION NO. 2519 ADOPTED • Mayor Barnes: Page Five The City Clerk presented: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA REQUES- TING THE COUNTY FIRE DEPARTMENT TO PROVIDE AFIRE SERVICES AGREEMENT FOR THE PROTECTION OF THAT PORTION OF THE CITY OF WEST-COVINA LYING WITHIN ANNEXATION 158 FOR THE CAL- ENDAR YEAR 1963" Hearing no objections, we will waive further reading of the body of the resolution. Motion by Councilman Jett, seconded by. Councilman Snyder, that said resolution be adopted. Motion passed on roll call as follows: Ayes: Councilmen Jett, Towner, Heath, Snyder, Mayor Barnes Noes: None Absent: None There being no further business, motion by Councilman Jett, sedonded by Councilman Snyder, and carried, that this meeting be adjourned at 8:40 P.M.
