The regular meeting of the City Council was called to order by Mayor Barnes
at 7:45 p.m., in the West Covina City Hall. Councilman Heath read the
Pledge of Allegiance with the invocation being given by. Councilman Jett..

In the discussion that followed, details and differences in the petitions were
clarified by Mr. Aiassa, who requested that the following memo be read and
spread into the Minutes.'
"CITY OF WEST COVINA MEMORANDUM
DATE: 11-9-62
SUBJECT: Proposed 1911 Act. Sidewalk District
"FROM: _ R. E. Pontow, City Engineer
TO: City Manager and. City Council
"Transmitted herewith, are the signed petition and preliminary
assessment maps for a proposed 1911 Act Sidewalk Assess-
ment District on Rowland Avenue from Vincent Avenue easterly,
on, the north side to Astell Avenue, and easterly on the south
side to just west of Osborn Avenue. (See attached maps.)
All signatures on the petition have been validated with the most
recent tax roll and said signatures represent 6916 of the pro-
perty owners in the proposed district.
"The preliminary estimate of the cost for construction is .
approximately. $6, 985. 00 or approximately- $217. 50 per lot.
In addition to the construction costs, it is estimated that
incidental expenses will amount to approximately, $62. 50
per lot. In 1911 Act Districts, certain ,procedures as re-
quired by law must be adhered to. This necessarily increases
the incidental cost per lot in small districts as opposed to
larger ones,
"This office has always looked favorably on the installation
of sidewalks and is of the opinion that the need for side-
walks does exist. Construction of sidewalks on. Rowland
Avenue is required per the approved Master Plan of Side-
walks as adopted by the City Council on .January 14, 1957.
If the property owners in this proposed district are willing
to pay for the sidewalks and the incidental expenses in-
curred under 1911 Act. Procedure, it would be the re-
commendation of this department that the City Council
authorize the commencement of the necessary 1911 Act
Procedures.
• "As an alternate to having the property owners absorb .
1007o of the right of way clearing costs, the Park Depart-
ment might possibly move or remove parkway trees within
the construction area. Some of the existing trees are of
an undesirable type and will have to be removed regarless.

11It is the intent that the City Engineering Department will
prepare the necessary estimates, diagrams and construc-
tion plans to be reviewed by the Petitioners at the time of
the protest hearing. I If, 'at the time of this hearing, the
proposed district is not considered ec'onom.i:cally feasible by
the property owners involved and is protested out, a mini-
mum amount ,of City funds will have been expended, but
this effort would seem to be justified.

District, Is there anyone who wishes to testify for or against this?
B, S. Matthews I have a question to ask. I was
250 London Avenue present at the last hearing and at
West Covina that time Mr. Rossetti assumed the
cost estimate would be $5.50 a
front assessible foot. Now I understand the estimate has increased
some" $135, 000. 00. Will this increase make that assessment go up?
Mr. Rossetti read the report on. Cost Study for West Covina Sewer Dis-
trict No. A111-61-1 , explained the reason for excessive costs; and ex-
plained that the second report of $7.82 per assessible front foot was
actually higher than they believe the final cost will be. He anticipates
an approximate reduction of $45, 000 from the $135, 000. 00 . The higher
estimate was given in order not to mislead people in the Sewer district.

Mr. Rossetti explained, with the use of the area map, how these trunk
lines would have to be added to the other districts,
Councilman Towner. I now get the full picture of the pro -
cedure and I understand that this is a
reasonable means of proceeding,
Mr. Matthews- I just got a good lesson in your methods
of ass.essment, but I'd like to get an
idea of .what the final figure will be,
Mayor Barnes. Mr. Rossetti can we be safe in assum-
ing this figure to be around $6.75?
Mr. Rossetti. I think so.
Mr. John E. Lawler I would like to object to Sewer Assess-
1842 Ranchero Street ment District. Do you have a copy of
West Covina my letter of protest?
Mr, Flotten- I have the letter before me,
Mr, Lawler- I would like to ask, regarding the letter
in front of you, why aren't we allowed
to connect with existing sewers for
which we have already been taxed?
Mr. Rossetti referred again to the map and explained how the trunk lines
would tie into the main lines,
Mayor Barnes- Does that answer your question, Mr.
Lawler?
Mr. Lawler- What petition was signed to determine
this? I signed a petition a long time
ago, about seven years ago. I thought
if this contained so much discrepancy, I think we have a right to vote on
this.
Mayor Barnes explained this was a more recent petition and requested the
petition
to be presented,

Councilman Towner:
Mr.. City Clerk-, will you read Resolution
No. 1263?
Mr. Flotten read Resolution No. 1263.
Councilman Towner: Hearing no objections the hearing has been
declared closed. . I would like to hear com-
ments from the Council.
Councilman Heath: First, I think that I have indicated quite
clearly in my past statements that I do
not think' this is R-1 property. Also, I
feel that we could use some more R-P. Last night some interesting testi-
mony, on the fact that the "golf club head in red" (referring to the shape of
an area on the map) is being seriously considered for R-3, which would
eliminate a certain amount of commercial; and I am fairly sure that the
people are serious on this R-3 in this area, `and I think we could replace
that with some other commercial. I think the people deserve a decision
at this time, because it has dragged out to such a' point. I feel that this
zone is about as good as any in that area and I can't see any real objec-
tion to it right now.

Councilman Jett: Yes, I think these people are entitled
to an answer tonight on this property
we have studied. I was surprised, at
Monday's meeting, I was surprised when Mr. Joseph told us they had not
looked at any map. I think our problem on Glendora, as far as the pro-
pery is concerned, is how we are going to develop that property, I think
this is going to relieve that problem considering they are requesting C-1.
The uses we have discussed are uses that would be permissible in C-1 or
R-P zoning. Our zone in this case, when a specific zone like C-1 is pre-
sented upon the property, (referring to map) the uses in the zone just ahead
of it are also permissible, that is, the uses permitted in R-P could be per-
mitted in C-1, in the event we approve this property; with the provision
that the R-P uses that could be used in here would set in with it. I can't
see anything objectionable to approving this tonight.
Councilman Towner: For some time the Council has indicated
that we should have a professional study
on this area, I recall at the November 5
meeting Councilman Heath was in favor of a professional study. I think the
application for C-1 zoning is not necessary. We may want something south-
west of Glendora on this property. I would go along with the "Weaver"
property, limited to offices uses only. There it was a very reasonable and

and suitable area because of the parking fulfillments; but in this case, _ it
appears _that since there is no immediate usage, we should defer the matter,
if. the .'.applicant is willing to wait until we have professional study or we
should deny this request tonight because the evidence presented does not
substantiate approval. Indications are that we have over -zoned on C-1. I
am inclined to think we should .not try to resolve this problem tonight.
Councilman Snyder: I think the burden of proof is on the appli-
cant to show a need for C-1 in this area,
I can see some objection at this time, For
one thing, C-1 in this area.would lead to further down -grading of the old
center. It would hinder instead of help the .old center. Without some method
of control or precise plan, this area could very easily degenerate to a strip
type similar to that of Old Valley in Puente. I think the overwhelming weight
of evidence at this time shows we should leave it R-1 unless an expert study
can show it to be something else. I am in favor of either denying or wait
for a study by the experts. We are more or less morally bound to accept
the decision by a professional group. I think we want to do it right,
• Councilman Heath: I would like to add one statement to my
comments. We have had a statement
that we are way over -zoned in commercial.
I have always questioned this. Maybe it's ridiculous to question a professional
but when you look at what we have done since a General Plan was presented
to us, I would say we have often acted in direct violation of what they thought,
Councilman Heath cited several instances where the Council's approval of
additional commercial zonings were successful even though these were against
the advise of the professionals,
Councilman Heath:

was a
need
for more commercial zoning.
I don't
think
they really believe we are
commercially over -zoned,
and by our own
acts
we have proved that we don't
believe it either,
Councilman Snyder: It is true, we have zoned, additional com-
mercial. However, I place no evaluation
on how good our commercial zoning was,
but in my estimation, we zoned it because it set in with the General Plan.
I believe these additional commercial zones were in accordance with the
General Plan and were on the recommendation of the General Plan,
Councilman Heath: I don't believe the statement was made
that that area at the end of Azusa Avenue
was being considered at the time of the

General Plan and that the General Plan was adapted. to put in what was put in
there. . We have evidence indicating there is more need for commercial than
we had before.
Councilman Towner pointed out that consideration should be given to the dis-
tress situations that are becoming apparant in the old West Covina Shopping
Center and at Von's Market on Glendora. He also pointed out the need to
consider both the East and West and the North and the -South traffic circula-
tion.
Councilman Towner: I think we are acting in the dark without
an adequate study. There is sufficient
indication in our study that we do have a
problem area here that need special study. and consideration. There is no
justification shown for making this C-1.
Councilman Heath, as a point of reference, declared he was aware that the
Von's Market area had been called a distress area; but thought that .perhaps
there were other contributing factors to the problem at Von's Market because
ID the little market across the street, a little wooden structure, did not appear
to be affected in any distressed way.
Councilman Snyder: Until we find out, we would be foolish to
approve further C-1 in this area. I don't
think you would solve any problems by
adding commercial. I think it would down -grade the area and create a
problem in the old West Covina Center.
Councilman Jett gave his opinion of what factors he thought had contributed
to the problem in the Von's Market area. He also pointed out that property
at Francisquito and Glendora, which the City had refused to annex, was
annexed to the City of La Puente, and had developed into one of their most
profitable areas.
Councilman Jett:
We don't know whether or not there is
a need for more commercial until the
property owners can find out if tenants
are interested in the
area and
the type of uses they would like to put in.
This is the only way
to determine if we have too much zoning. It was said
we had too much commercial
when the Eastland area was put in. Retail
sales have increased
We are talking about

growing. We are talking about annexing more
homes. There will .be a need
for all types of business that we do not have
at the present time.
I think we should look at these things when we approve
or deny this request.

think these people should have to wait for a

Mayor Barnes: I would like to ask a couple of questions.
Mr. Joseph, is the depth of this property
282 feet?
Mr. Joseph: After the street is taken out, the useable
depth is 270 feet. The length is about
1, 000 feet.
Mayor Barnes:. There are nine parcels in this, and approxi-
mately seventeen people involved, is that
correct?
Mr. Joseph: Yes,
Mayor Barnes: I think we show requirements that there is
a need for some of this type of zoning as
indicated by the Planning Commission and
the City Council. I don't know whether it should be, all- :.C-1 However, I do feel
it is necessary for such a plan as this, where there are nine parcels of
property involved, for further planning; something that will pay to the people
of this City good revenue and tax base. I think this alone tells . us that this
area should have a precise plan for development.
Mayor Barnes discussed the prospects of the area in question being zoned
either together or as separate parcels, stating that the concern should be
toward good development, and he held that a plan should be brought to the
Council by the people involved.
Councilman Heath: I feel that something should be done, but
I would like to see a precise plan, before
we zone the property, with nine ownerships.
Councilman Jett: Is therea staff report on this in the event
zoning was granted.
Mr, Joseph: No. Conditions to change of zone can only
be-adopt.e.d. to a precise plan on the develop-
ment.
Councilman Heath: I have been led to believe that these people
are bound together in a joint venture. If
this is the case, we should have a precise
plan, but the precise plan should be a further indication that they are planning
together as a unit.
Mayor Barnes: Once you give zoning to nine properties
they can still develop separately, is that
correct, Mr. Williams?

I would like to ask if these properties
will be bound together for the purpose
of making one development.
Mr. Graham Ritchie, 1015 West Badillo, attorney for the applicants, stated
that the applicant desired zoning together for the purpose of developing their
property together, and that although they had no special plan at this time,
they would like to know if the zone change could be granted subject to any
conditions.
The various members of the Council consulted with Mr. Williams, the City
Attorney, concerning the conditions under which a zone change could legally
be granted, Councilman Towner made a proposal that action be withheld
until a study could be completed. If the applicants were not willing to defer
action until the study would be completed the only alternative would be to
deny the applicant, Mayor Barnes asked each individual concerned in the
application if he would be willing to wait for 90 days until a study could be
completed, Mr. Larry Sade replied that he had carried this for several
years and wduld like -a decision tonight, and the other applicants individually
concurred with Mr. Sade's statement. Councilman Heath suggested that
action be taken approving Zone Change No, 228 subject to the condition that
the zoning would not become effective until the presentation of a satisfactory
Precise Plan developing the entire area as one unit, and that if any parcel
were left off the plan, that parcel would not be applicable to the zone change.
Mayor Barnes clarified that the "left off" parcel would retain it's present
zone status.
Councilman Jett revealed that he owned property, his home, on Glendora
Avenue in the vicinity, within two or three blocks of the applicant's property.
Councilman Jett asked the City Attorney, Mr. Williams, if ownership of this
property would disqualify him from voting on the zone change.
Mr. Williams replied that having made the revelation, it was a matter en-
tirely within Councilman Jett's own conscience and that he need not dis-
qualify himself from the vote.

PLANNING COMMISSION

PARKS and RECREATION
Dedication of Walnut and Merced Park is set for dedication on November 24,
1962 at 2:00 p.m.
Mr. Aiassa presented a map of the proposed park district and requested the
Council to tentatively approve the layout or at least to accept the trees as
proposed.

Mr, C. C. Cheesebrough, 3424 East Garvey, requested that his area next
to the freeway be considered -for rezoning, Mr. Cheesebrough pointed out

population toward the east. He pointed out also that since the last zoning,
Grand Avenue was put through under the Freeway. He did not request a
particular zoning at this time, but thought the area should be zoned as potential
R-P or Potential R-3.
Councilman Towner informed Mr. Cheesebrough that the General Plan was under
consideration and that this area would be considered. He also informed Mr.
Cheesebrough of the methods and procedures for applying for rezoning through
the City Hall.
Councilman Snyder requested that the General Plan be placed on the Agenda
for the November 26 meeting for adoption and that the resolutions be prepared
in advance for adoption.
CITY MANAGER'S REPORTS
FIRE STATION
Mr. Aiassa requested authorization to start calling for bids for the north
Fire Station. He hoped to receive formal bids within the month. Councilman
Jett thought an intercommunication system was essential and should be consi-
dered for the station and would like to see at least the conduit put in with
the system to be purchased later. He also stated he would like to see three
basins installed in the station.

approve the plans and specifications subject to changes recommended by the
staff and City Engineer and authorizing Mr. Aiassa to start the proceedings
to call for bids.

Mayor Barnes: On November 15, at 7:30 p. m. I would
like to have a study session on items
that we have neglected through not having
enough meetings or enough time. On November 19, I think Mr. Aiassa has
a few items to discuss. Then we will cover the adjourned Council meeting
on Monday on Items we might have missed; and then adjourn to�_-A' per.sonnel
and study session. Can everyone make this meeting on November 19. I
feel it is important for all to be there.
On November 20, I would like:to interview the prospects for the position
of Planning Commissioner. I had one call, and would like one more.
There are five names on the list to date,
Councilman Jett, did you check on that list of traffic con'sultants ?
Councilman Jett replied that he had the list, .but was not quite sure what he
was to tell these people, Mayor Barnes explained that he was asking for a

COUNCIL COMMITTEE REPORTS
Councilman Snyder: On the meeting of October 30, I stated that
Mr. Jett was against the General Plan in
his campaign. Jett said that was a lie.
Now, he said inthat meeting that he was not against the General Plan, I
would like to read a quote on Mr. Jett into the minutes of the meeting. This
is taken from "Candidates' Quotes" compiled by the League of Women Voters
of West Covina when asked his opinion of the proposed West Covina General
Plana
"The West
Covina General Plan is merely
a reflection of the
past thinking
of the Planning Commission,
the City
Qouncil
and certain
minority interests in the City.
It does
not
project into
the future 20 years new ideas
and new
procedures
but merely
takes what has happened in the
past and
puts it in
• a beautifully bound brochure in a compact package. The
various component parts of the plan merely substantiate think-
ing of the Parks and Recreation Commission, School authorities,
etc. , and therefore is like a catalog for them and nothing more.
For the money invested in-thes,e plans and other, I believe it is
a poor bargain for the City of West Covina."
In the light of this statement, I think Mr. Jett's statement "It's a lie"
should be corrected in the Minutes,
Councilman Jett: I was asked my opinion. I gave an
opinion. That does not state that I'm
against the General Plan.
Councilman Snyder: That's a subterfuge, Mr. Jett.
Councilman Jett: I am getting tired of these insinuations
that I am doing something wrong. I
have never said I would kill the General
Plan, and it does not so state, and what you have just read was an express-
ion of my opinion of the General Plan during my campaign.
• Councilman Towner called the meeting to order and informed the Councilmen
that these things could be ironed out at the personnel study.
STUDY OF PARKING REQUIREMENTS
