In discussion with Council, relative to various questions asked, it was indicated that Council had approved an amendment as to required improvements in this area and that this property is now being treated the same as everyone else's on Lark Hill Drive. There are no new con- ditions imposed on this area since that time. PROJECT NO. C-189 LOCATION: Lark Ellen Avenue, from Street Improvements Badillo Street to San Approve Project Bernardino Road. C-189 - Continued In discussion with Council, relative to various questions asked' it was indicated by staff that the main thing involved Here is 24 feet of reconstruction in the center of the street to be required. It is an old County section and will cost approximately $5,500.00, The hos- pital will put in 16 feet of pavement, plus curb and gutter. This -'is - standard improvements the City has had in the paste They will also put in improvements on Badillo Street and they have improvements on San Bernardino Road. There are others outside the City relative to these improvements in this area who have not been contacted. All that is being asked here is for plans and specifications approve in order to negotiate with the people involved. Motion by Councilman Towner,, seconded by Councilman heath,, and carried, that authorization be given to proceed with Plans and Specifications on Project No. C-189 and that the staff be further directed to contact other property owners in order to provide further participation, if it is possible. A diagram was drawn on the board. There was also discussion on the possibility of again approaching those people who were not willing to participate and to attempt to explain and again advise of the difference in added cost as well as the mud problem if they would not participate at this time. It was further indicated that the short form (1911 Act) had no incidental expenses and was not spread over 10 years. Once 50% in any given block or area is in then others not participating can be ordered to put their improvements in. If they do not, the City can put them in and the cost goes on the next year's tax bill. You can force these other people in but it is not under the regu- lar 1911 Act. (S & I) 21,716.00 No Bond It was indicated that the bids were for equipment only and not for instal- lation except on bid. Bids are thoroughly summarized in the report given to Council. It was indicated that evidently the bids do not include installation. Now that there are bids on equipment the City could invite bids from local installers as to installation cost since the main point was to know what equipment might be used. It would appear the supplier and installer are not the same in these matters, although people could be called in and allow them to sub -bid for installation. Council wants an idea of total costa It was suggested that perhaps the bidders would permit sufficient time to get an installation cost on the equipment. It was indicated that written consent should be asked from the bidders to hold their bids long enough to receive bids for installation. It was requested that both California Wholesale Electric and Graybar Electric be asked if we could hold their bids since the over-all pic- ture might present something different as to cost. Motion by Councilman Beath, seconded by Councilman Snyder, and carried that Graybar Electric Company and California Wholesale Electric Company be contacted with the proposal that they give us written consent to hold their bids open for a period of 45 days\ pending receipt of bids regar- ding installation. The question was raised as to whether the other bids can be rejected and it was noted that they are not qualified since the equipment is not up to the standards that are required. Motion by Councilman Towner, seconded by Councilman Heath, and carried, that all other bidders be notified their bids are rejected and that any bid bond or certified check involved be returned. Co 9-24-62 HEARINGS VARIANCE NO, 401 LOCATION.- 825 South Glendora Avenue, Wm- M. & Lorraine F. Weaver between Herring Avenue and and Cameron Avenue • Alscot Development Company APPROVED AS STIPULATED Request to construct and maintain office building in Zone R-A. Denied by the Planning Commission under their Resolution No. 1249 on August 1.5, 1962. Appealed by the applicant on August 25, 1962. Mayor Barnes stated this is the time and place for the public hearing on Variance No. 401 and all those desiring to present testimony should rise and be sworn in by the City Clerk. Page Eight IN FAVOR Glenn R. Watson, 615 South Flower Los Angeles Attorney Mr. Watson stated he represented the owner of the property Mr. Weaver and also in connection with this proceeding the purchaser of the property, the Al - scot Development Company. This is a piece of property lying on Glendora Avenue with a frontage of 200-feet and a depth of approximately 448-feet and after the provision for the widening of Glendora takes place it would be less 20-feet giving a net footage of 428-feet, so there is approximately a two acre parcel of property. The owner is willing to dedicate without cost to the City the necessary footage to widen and improve Glendora Avenue and curb and. gutters along the entire .frontage of the property:, and when the buyer is on his feet you may wish to confirm that. Mr. Watson noted the property has been on the market for years and went to escrow May, 1961 on this particular deal and it is contingent upon permission to construct this building,, an office building. After es- crow was opened on this condition, application for a change of zone to R-P was filed before the Planning Commission August 2, 1961. At that time it was pointed out that in this building not only would there be attorneys but accountants, architects and other professional. uses of that type but in addition the buyer of the Land, Alscot Development, wanted to maintain its administrative and executive office in this building. The City Attorney ruled that the latter use is a heavier use not specifically permitted in the R-P zoning, and I agree with him. Therefore when this came before the Commission and the City Attorney made his statement, the applicant withdrew the zoning application. Following that, you had in the process, your general plan study, so over a number of meetings the property owners and builder waited for the plan to be completed and we have run out of time, The escrow has been extended to October .15, but in the meantime when he thought he had the property sold he stored his personal property and moved into a trailer, preparing his departure. He has been there a year waiting for the procedures to be complete. Some of the Plan- ning Commission spoke favorably of the type of use proposed and one • member even stated that he would like for this building to be there but the Commission expressed that it did not desire to do zoning by variance. But it was pointed out that this particular property lying as it does with R-1 use to the west and south and some to the east, even though the neighbors have voiced no objections to the proposed variance, that a variance would be subject to conditions to a greater degree that might be desired to place upon it. In any event;, the Commission's view, officially in action, was, it be denied, presumably, that they would rather rule on a broader basis than a variance. -8- Co Co 9-24-62 Page Nine VARIANCE NO. 401 - Continued Glenn R..Watson - Continued We did file a zone application also and that is still pending*befor6- the City. We filed for C-1 only because the C-1 is the most restrip"- • Live classification that permit the general, administrative and ex- ecutive offices and but for that one fact we would have filed R-P but that was ruled inadquate for the administrative use so we filed for C-lo That was heard last Wednesday and the Commission denied toat on the ground C-1 permitted too many uses. The first time, the appli- cation wasn't broad enough, eveidently, and too broad on this occasion and there just isn't any place in between. You either have to get C-1 or a variance if the City is going to permit this be constructed at this location. For this reason we have filed an appeal in order to keep it alive until Council can look at it and decide whether they want this building to be there and in what form and under what condi- tions you would -want. An architectural drawing was presented by Mr. Watson. Mr. A. Lava Mr, Lava indicated he was a general 345 Hurst Street partner in Alscot Development Company. Covina The rendering shows the front eleva- tions of the building we`would desire to build on subject property. As to the building itself we proposed a 1U1 shaped building around a center patio area. The building is contemporary in nature. As to use, it is intended primarily for professionaluse but we plan office facil- ities to accomodate doctors, attorneys, architects, engineers and other professional people. In additon to that, we would like facilities in . the building to administrate affairs of the Alscot Development Company which is engaged primarily in residential tract construction and 90 to 95%® of our operations are carried out removed from the Covina -West Covina area and subsequently servicing_. of various receipts and second trust deeds is handled primarily through the mails. There are only two developments in the immediate vicinity which might have people being able to call at this office site itself for making of necessary payment on house mortgages. Consequently the amount of vehicular traffic into the area would be at a minimum. In addition to that, our other activities are normal activities of any developer of residential and commercial properties. In this regard, I would point out the fine distinction that I believe the Commission made in our original request for R-P zoning wasn't that the activities of a devel- oper and builder in any way differed from the effect of purely, let us say, professional use but specifically that the zoning regulations did not include, I believe the word they used was, "general contractor" which is what they would classify as a builder and we feel that the use would be no heavier in the use of the word than any doctor, lawyer or professional user of the building. Mr, Watson- I would point out the plot plan on the board which hasn't been called speci- fically to your attention. The yellow is R-1 but the green is undeveloped area to the north and then to the west you have the two cul-de-sac°s and to the south a dead-end against the property. The plot plan to the left, you can see the building lo- cated within the property lines with a good deep set -back in front pro- viding for parking in front and by the same token the building is set far enough toward Glendora to leave a large open area in the back of the property toward Duff Avenue which presently dead -ends against the south side of the property. I believe there is shown a possible extension of Duff Avenue across the property. While the owners does not desire this to be made, the building is so located that if it was ever made, there would be no interference with the structure or use as presented. -9- C. C. 9-24-62 VARIANCE NO. 401 - Continued Page Ten Mr. Watson went over some of the discussion as brought out in the general plan hearings in regard to this area. He indicated the present traffic of 16,000 cars per day with an estimate of 40,000 per day in the forseeable future. He stated the remarks of the consultant for • this plan, who pointed out the difficulties and inconvenience to ad- jacent residential property as a result of the increase of congestion on Glendora, and although he did not recommend C use nor this requested use, the hardship was pointed out that has been created for residential property owners in relation to their property. Mr. Watson also indica- ted the suggested 50 acres for R-P use recommr.:.nded in the City, with only 22 acres actually in such use, and indicated this was being used because this use is primarily R-P rather than commercial. Mr. Watson also pointed out the noise factor to these properties as well as the very poor and hazardous condition and cut of the street. Also that this area would be, in time, within the influence of two truck routes, Glendora and Cameron, both being so designated. It was also pointed out that both Council and Commission have always generally conceded that R-P use is a good transitional use between R-1 and com- merical use on a boulevard, and it was the feeling of Mr.Watson that the residential -professional type use can be thoroughly controlled by conditions of a variance instead of a general zone change to C-1, since a variance for specific use is of a transitional nature separating R-1 from further development of commercial along Glendora and is good and sound judgment. Mr. Watson went on further to say that if R-P or C-1 is developed to the north of this property, this particular use here, if granted by variance, would abut against R-1 and be under controlled conditions • of any kind that might be laid down by the Council, which would be satisfactory insofar as we are concerned. The plan also indicates a masonry wall along the south and west side of the property to afford additional protection to property owners, there is excellent land- scaping intended and it is attractively designed. Mr, Weaver I think that everything has been 825 South Glendora said that is necessary except for one thing, the people in the area who have been contacted have been in agreement with this type of development and would rather see it than any other type of use. Also from contacting developers and contractors regarding residential use of this property they feel it is impossible unless I wanted to risk the construction of the whole thing myself, no contractor was interested in any proposition of sharing. They stated they weren't in business to lose money but that if I wanted to construct homes and take the risk in full they would build them, but they wouldn't touch it for such use on a,share. basis. I do not think multiple use would be good here either since you would only have the same problem and complaint, that people do not want to live that close to a major thoroughfare. Mr, Watson: I have your zoning map here and you can observe from it the area district line cuts across just to the north of this proposed building. The area to the south of that line is an area requiring 9500 square feet - Area II - and area to the north of line requires 7500 square feet - Area I - so this particular property is in a pocket or class by itself. However', we must realize that be- fore conditions on Glendora Avenue changed to such a great degree, which has put an end to the economic feasibility of homes here, these other areas could be economically developed in residential use but it -10- • L� 0 Co Co 9-24-62 VARIANCE NO. 401 - Continued Page Eleven Mr. Watson - Continued, - is not true now, That back portion of the property isn't adequate for economic use for residential -purposes if one assumes Duff Avenue will be cut through, it would isolate the portion that might be used for residential lots under present zoning but they could not according to Mr. Weaver and Mr. Lava be economically developed back there and he would have to take the full risk himself for no one else will for such use. Since this property is really in a zone area by itself it stands alone with two cul.-de-sacs to the west in an area district requiring 9400 square feet while there is no other area similar and the property is surrounded on other three sides and developed R-1 before circumstances changed both from the standpoint of property. To protect this property we submit, a variance with con- ditions of setback, landscaping, curbs and gutters is an asset. We have no objections presented on this request by other property owners. However, the question was raised as to garage facilities at the back of the property being more than one-story and we would welcome any restriction to one-story. We were also asked if there would be any construction equipment parked in the yard and we stated there would not. This isn°t a Company yard, it is a first-class pro- fessional type building but we would even accept this as a condition of not having anything on the area except regular passenger cars. We may not have presented a compelling case for a variance but we feel we have met requirements and would be better than a zone change. Mr. Jo Blake of 834 South Duff and Mr, L. I have some question as to what con- ditions should be placed on this and perhaps there should be some further study relative to this,. as I am sure such restrictions can- not be lined up here tonight. They should be worked out. Mr, Williams, Wouldn't this be done on the Precise Plan whereas the condition here would be of use granted. The only condi- tion here is as to use then a plan would have to come in before they can use it and usually these things are imposed on the precise plan. The condition as to use would be office use permitted in R-P plus one additional use of this development company having its business admin- istrative office. Mro Joseph, The Commission has denied two appli- cations for zoning of this property and properties to the north. I am against the granting of the variance because I believe it would be better by- R-P zoning with variance. I think since this will set the pattern from.here on north we should wait for a staff study and what any other applications.mlght show. Councilman Heath: So far as depth of the lot, this is true, but to the north it is undev- eloped and is of equal depth or more than is shown here and if it would set a pattern maybe this would be a good pattern in lining up back ends of property. Councilman Snyder: Councilman Heath: Councilman Snyder: Councilman Towner: Councilman Jett: That is the point I am trying to make, we should see what the other applications show, However, I do not think you can hold up a man to wait and see what others are going to do. He has a reasonable development here. I do not think he has a reasonable development and I do not think he has entirely met the requirements of the ordinance. I understand Councilman Jett owns some property in this area and I would like to have it clarified whether this or property adjacent to it is property owned by him. The property that I own would be at 905 South Glendora Avenue. I feel this is the type of development, however,, that we have been talking about along Glendora Avenue. I think it is a start in the right direction. Our talk has been about over all development and how best to develop the entire street now. This is something that has to be solved soon because we have to get Glendora improved in' order to handle the traffic and I think this is a good start, and that it is a good building. If we approved this variance and gave them C-1 R-P or whatever it happens to be, before the precise plan is given to us, it would have gone to the Planning Commission and I feel they will have come up with some ideas at that time so that we can approve a precise plan to fit into the entire pattern. I do not feel we should hold these gentlemen up but let them know and if this is something we want I see no reason to hold them up. Mayor Barnes: I feel that this is the variance type of development and should be Is in R-P with special variance for contractors office. I do not think the C-1 is entirely wanted in regard to the office. However, in light of what Councilman Snyder has brought up, if there are plans coming in on adjacent properties Possibly to better accomplish something, it might be wise to hold this for two weeks, but no longer, because I think we should take action on it. -12- Co Co 9-24-62 Page Thirteen VARIANCE NO. 401 - Continued Councilman Towner: It might be possible to redraft our R-P ordinance to accommodate this use and limit this by his own state- ments, go at it by that technique. It seems that we might grant this subject to conditions which I think we need study on and one of the conditions would be uses be permitted in R-P only and the general office uses as restricted by the applicant. Mr. Williams: One of the possible deterents to this suggestion is that R-P permits apartment houses. Councilman Snyder: I think that is the main reason. I am not necessarily against this but hold it over to think about these conditions. Mayor Barnes: Would you be willing to abide by any conditions laid down? Mr. Lava: So long as it permits the use of the Alscot Development Company as indicated. Councilman Towner: How far does that plot plan show existing building from existing R-1, less than 100-feet? That might require some consideration, Mayor Barnes: I think we should consider the fact that no one is objecting to it. There has been stated, there is too much commercial in the City but we feel this should not apply to our general area because the location of our property seems to be a natural for neighborhood commercial. Al- though there is commercial zoning at Orange and Badillo there is too much industrial and it is not conducive to C-1 and there will be re- zoning regarding such use there. The commercial along the freeway hasn't been good C-1 and this, too, will also probably be rezoned in time. The success cf the Safeway across from our property has proven there is no question as to need for commercial in this area. The stores we proposed would be a drug store, shoe store, and other neigh- borhood stores. This one -stop shopping would cause more people to stop here and create better shopping than now exists and it would strengthen and serve the need of R-3 residents. It was recommended that the 60 x 138 feet north of the Service Station remain R-3o We ask you to review this condition north of the Service Station because we are asked to develop a Piece of property 60 x 138 feet as R-3 which is just separated by an alley and adjacent to the service station and it would be a misfit to the over all pattern. • On the precise plan it was one stall to each 300-feet. This was the previous ratio required two years ago when the over all plan was pre- sented. Since then the parking ratio has changed without our realizing it but I would point out the area along Glendora is more heavily traf- ficked than the general area here and the parking has proven to be adequate. That part that is cut out wouldn't be rezoned into P-B zone. Councilman Heath: It was brought out at the Planning Commission that the legal descrip- tion of the City was not quite cor- rect in that corner and I think the Commission approval was based on the legal description of the applicant. Mr. Williams: As to P-B, you have two overlapping requests. Actually the same issue is before you on this piece of prop- erty, the City inititated one and they initiated one but the City's isn't correct if the compromise is made because the City's descrip- tion squares that corner. There being no further testimony presented, the hearing was declared closed. Councilman Snyder: I feel still that R-3 would be the best zoning here. As the general and land use plans state we have too much commercial in the City.. We have commercial on Orange to the west of ,this, which is mostly vacant at the present time. However, as a matter of expediency I am not greatly against C-1 here and I think the applicant does have reason, with the fire station and service station on west and east. I can't go along with parking variance, however. I would disagree that there is always parking space available on South Glendora because I had a difficult time getting one the other day. I also do not think that the applicant has shown sufficient cause to grant a parking variance in this particular case. Councilman Heath: I think conditions justify commercial in the area. I sat in on this at the Commission meeting and was amazed they required R-3 on that little parcel north of the gas station be- cause it is 60-feet and that would be very small to develop into R-3a I think the parking ratio: is out of order, maybe they can cut down on, the size of the building or something to bring it into line. Actually I was in this area today and looked at the Food Giant, this piece and the Safeway across the street and I am wondering if staff has checked parking at Safeway after these stores might be put in because it didn't look like they had one parking space for each 300 square feet. -15- 0 • 0 Co Co 9-24-62 Page Sixteen ZONE CHANGE NO. 227 - PRECISE'PLAN NO. 231 - Continued Mr, Joseph: The parking ratio of Safeway went in under the old ordinance which is' slightly less than the one we have now. If this property is developed on the north side, the site under the old ordinance requirement would need 141 stalls,'whereas under the new ordinance it would require 149 stalls which is only 8 stalls dif- ference. Actually the "one to 300" is your office requirement ratio. Formerly, on commercial it was so much for the first 5000 feet and so much per square feet after that. Councilman Towner: I am in accord with he action of the Planning Commission and insofar as zoning was concerned I think they were correct that that portion facing on Sunset should be retained as R-3o We certainly owe something to the people across the street to maintain the character of the area. However, if they put in a small building there with parking in front they can use the R-3 area for parking for commercial and thus provide adequate parking. Insofar as zoning, I am 100% in accord with what the Commission acted on. I think the Precise Plan is totally inadequate for many reasons, but one primary reason is that the City is contemplating a.large invest- ment to provide a library and fire station with substantial landscaping and setback and it would be of gross detriment to it if these people next door can go in with nothing but a concrete building and asphalt parking space. They should provide landscaping, adequate access through their own development, with parking on back and limit only to commercial area and no access to R-3 area and they should conform to the present parking ratio. In answer to Councilman Snyder°s question as an ordinance providing 20% landscaping Mr. Joseph indicated this was industrial park only. Councilman Jett: I think we have conditions here that are somewhat different from the usual application. We started out here un- der a proposal to condemn this property and we felt that under condem- nation procedure it would cost us considerably more than what we are thinking about at the present time. I think that by settling this on an amicable basis, and the fact that the City is establishing a fire station and library next to this property, we are somewhat ourselves establishing the uses that should go in here. I have developed bus- iness properties myself and this requirement on parking is difficult to determine. You have no idea at the present time of what the uses will be that will be going into these buildings. This alone will de- termine the necessity for parking, and .it is impossible to do it on a square footage basis. If you have a shoe repair man, for example,,it is quite reasonable to presume he would have no more than two customers at one time, plus his own car, so three parking spaces is all he might need. You have a drug store requiring, perhaps, a few more. So far as parking requirements are concerned I think we are too critical in our requirements with this parking. I think these gentlemen have done a good job that is good for them and good for the.City and is acceptable as proposed. Councilman Snyder: Mayor Barnes': Parking in the rear here is not very likely to be used, who would know it was back there? If it is like most commercial buildings, they will have back doors and customers can go in the back as much as in the front. What is the depth of these -buildings on the property? C. C. 9-24-62 Page Seventeen ZONE CHANGE NO. 227 - PRECISE PLAN NO. 231 - Continued Mr. Joseph: Eighty -feet. Mayor Barnes: Is there a possibility that by cut- ting -down depth to say 70-feet .that • it would require less parking. It might be done. Mr. Joseph: I am not sure it could be done, we '- would have to work out certain designs. Mayor Barnes: I feel there is a possibility of de- veloping this if you cut the square footage back a little bit on the depth of these buildings. I do not think the requirements for across the street were as high as today°s requirements and there has always been adequate parking for the Safeway and other stores. I think this justifies some kind of variance or cutting the buildings down to get the ratio. Councilman Jett: How much cutting to conform? Mr. Aiassa: About half. Councilman Towner: It seems what you are proposing is to redesign the precise plan with several aspects that are inadequate such as traffic circulations, landscaping, how people get access to back parking, etc. I think that insofar as our trust in protecting the interest of our taxpayers is conserned that we would be gravely • remiss if we did not require improvements on this property comparable to improvements we are going to place on our own property adjoining it. Councilman Snyder: I think we have giien enough to obtain this fire station. This is the worst precise plan I have ever seen and if it is granted on Sunset we should change the name back to Irwindale. Councilman Towner: I do not feel there is any grounds to.justify this request and also they should comply to the law.as well as any other people in the City. If they can justify a variance, that is different, but there is nothing presented tonight for this and no basis to vary from City law to accomodate these people. Councilman Snyder asked if Council were to grant a variance without showing justification of variance could any steps be taken by citizens to overthrow that decision. Mr. Williams indicated it can be done by someone who would have not just a general interest as citizens but have property interests adversely affected by such a variance and could question its.validity. Councilman Jett: If I voted something regardless of whose it was, on variance or other- wise, I do not think there is any court of law that would question that. Councilman Snyder: We have an ordinance for a reason, then why have it? -17- C. C. 9-24-62 Page Eighteen ZONE CHANGE NO. 227 - PRECISE PLAN NO. 231 - Continued Councilman Towner: So far as this plan is concerned, I am generally in agreement that there should possibly be commercial zoning permitted on some of it but the primary problem now is what -the -pre • cise plan should be and I think they should be made to conform at least to the minimum requirements as everyone else in the City in matters such as parking, access to parking, landscaping and things of that nature. I see no reason they cant redesign this to conform to the reasonable requirements of the City. Councilman Snyder: I am not too adverse to the possible zoning although after seeing this plan, I certainly could be. I think this zoning on Sunset Avenue is correct but I think these people are still holding out for more and this only means more giving;,into these people, as has been done.right along, in connection with this whole program. There seems to have been nothing but stalling. Mayor Barnes: For the record and for the benefit of the audience there were five sites selected for consideration. This particular Allen and Snell property which is being asked for C-1 zoning tonight was one and another was the Puente Avenue site. This was not the only site considered. Councilman Heath: Mayor Barnes: . Councilman Snyder: There has been insinuation of some- thing extraordinary in the delay in this situation but the former Council, with Mr. Adams, over -ruled this loca- tion. It had to be a three man vote in favor on this. This is the worst plan I have ever seen and it is too much of a`price to pay for this site. Mayor Barnes: I for one pushed this fire station on the north side because it is very important in my particular area of town. There has seemed to be some stalling and I agree with this, but Mr. Thomas of Neptune and Thomas indicates that final plans will be ready by November 4. This fire station is long over due and we are going to have it in there regardless of if we have to go to con- demnation. This is the site selected and the only site left as the other site areas are now built upon and we can't reverse and go back. Councilman Heath: To me 60 x 138 feet is not adaptable to any kind of good R-3 zoning and it can serve the same purpose of parking whether commercial or R-3 and to put R-3 there is absurd zoning: I have made my statement and anyone can charge me in any court they want that in making my statement has been considered by anything but pure common sense. Councilman Towner: Councilman Heath: Councilman Jett: Councilman Towner: These delays have been caused by many reasons, and mismanagement for one. Charge that to the City staff, If there are any charges against anyone get it into the record. However, I feel Councilman Jett that you have not been able to have the entire picture nor background of this matter and are not familiar with it. If it is,for fire purposes we feel a wall, a fire retarding wall, would be ample in this cases IN OPPOSITION Mr. A. Klug I am across the street from this 4014 Irwindale Avenue proposed service station. I just purchased this property and I am one of the owners who is not supposed to be able to see this use across from me. But if that is so I will have to sit with my shades pulled down. We can certainly see across the street. The neighborhood is well kept and I do not want to see anything detrimental to the prop- erties go in there. There are four churches in this adjacent area and that is all. The County and your Planning Commission has already turned this man down for this use. There are gas station in the vicinity and if this street went through there are gas stations at Orange and Badillo and I do not see any .need for one here. Mr. E. R. Sike I would agree with what my neighbor 4008 North Irwindale has said. Anything in the way of a church or a rest home development is, fine but I do not think that a gas station would fit.in this neigh- borhood at all. Mrs. M. Nichale the midst of churches, rest home fumes from a gas station would be plus some noise from repair work noises. I do not think there is IN REBUTTAL Mr; Zachery> I think a gas station is out of place if you are going to have a rest home and would be one commercial spot in and homes. Also I do not think that very good near a convalescent home, that comes from them plus other anything good about this at all. Jett: Badillo Avenue is supposed to be a major highway to continue through Baldwin Park eventually and supposed to carry the biggest snare of traffic in that area. Irwindale Avenue, in West Covina, it is Sunset Avenue, it is a 100-foot major highway - so we have here an intersection of two major highways. When Minneapolis - Honeywell is completed the number of employees there will certainly contribute to the traffic pattern, as well as trucks and other passen- ger cars. The land use shows, along Badillo, no service statioAs other than at Orange Avenue. It is my opinion this corner would be adap- table to such a use and I,do not think it would interfere or.harm any of those.properties that are adjacent to it. I think the plan design is good.' Councilman Snyder: I do not see how by any stretch of the imagination you can see a gas station here as good when the whole section southeast of Azusa doesn't have it. The fumes may not bother people across the street but it would the people in the hospital, as well as the noise, and it would seem very unlikely a good use to put a gas station between churches and a hospital or convalescent home. I cannot see it there. I think it could, rather, be used :for parking for the hospital use but I am absolutely against the gas station on this corner, Councilman Heath: I would agree with Councilman Jett's statement as to reasons for this possible use here and also it seems to come to my mind that Irwindale to the freeway was also to be a truck route. Mr. Dosh: Only by permits. Mayor Barnes: I would see nothing wrong with the Commission's recommendations for the rest home. The service station might be good in the future when the street goes through but I do not see this as a need here right now, although I am not saying this isn't a place for such a use, but not at this time with Badillo not being completed. Dated September • 18, 1962 and addressed to Mr, George Aiassa, City Manager, of the City of West Covina. "Dear George; I am enclosing a copy of the Opinion and Order of the Public Utilities Commission in the matter of the Ap- plication of Suburban Water Systems for an increase in rates and a change of its rate structure. "I feel that you are to be complimented for having kept such a firm check upon the practices and methods of Suburban Water Systems and for having so appropriately recommended to the City Council that West Covina employ James M. Montgomery and oppose this application for a rate increase. "Our efforts have borne fruit. Although the Public Utilities Commission has granted a very minimal increase, it is only an insignificant fraction of the increase that was requested by Suburban. The change in the rate structure for the creation of only two rate districts was denied and for all practical purposes the large increase suggested by Suburban was denied. The slight increase granted will scarcely be felt by the con- sumers as compared to the increase requested, "As a matter of fact, the Public Utilities Commission has sustained everyone of the objections raised by the City of West Covina, and on page 2 of the Opinion the Commission gives credit to the City of West Covina for having raised these points which were later found to be valid. I am quite pleased that each of the objections which I raised in my opening statement has been sustained. For example, Suburban requested increases which would have amounted to $780,000 a year* It was granted an increase amounting to $60,000.00 a year. We urged.on be- half of the City that the relationship between Suburban and its affiliated companies should be scrutinized so that profit could not be drained off through -the affiliated companies, and a reduction from Suburban°s rate base of $808,000.00 was made by the Commission upon this point alone. Altogether Suburban°s statement of assets for rate fixing purposes was reduced more than $2,000,000 because of faulty accounting and procedures. "This decision is most gratifying and certainly justifies your recommendation and the City Council's action in opposing this application resulting in a very substantial annual saving to the water consumers in the City of West Covina.
