The Pledge of Allegiance was led by Councilman Jett, with invocation being given by Councilman Towner. ROLL CALL-. Present-. Identification of the center itself from any direction is of great irnportanc-e-,not only to the merchant, but to the customer who is looking for the center. That comprises seven of the signs that are in question. Six of them are on the main site and have to do with customer parking. The seventh sign is the employee parking which is on the other side of Batelaan Avenue. Under the Planning Commission Resolution:; -the Broadway was allowed three signs on the site, one on each street frontage identifying the center We have asked for signs which are customary in the shopping centers in the area. The other type of sign which is involved:' is strictly an identification for which I will call a tenant. We have a concession with the General --Tire people, it isn't just: tires that we are selling -- they are 'General Tires The Planning Commission, in viewing --- our sign, .-said the sign and size was satisfactory, but on the north side we cannot have the insignia 10Gener-al Ti.re10, Our contractu.ral arrange- ments with General. We are proposing that you approve tonight, if you agree with the Planning Commission and not: us, consider another presentation which is 6 by 386 inches and stands 12 feet high. They are simple metal frame with a pl,ex-i-glass face and interior lighting. The wording is simple block lettering. We agree with Mr . Brewer that the sit signs that were originally designed would be preferable to the six smal- ler signs that Mr. Brewer has ifhdic�at.e&- we might possibly compromise on. • Mr. E. J. Brewer.- We have trees in front of this sign that :are 30. feet high, 25 feet high and 20 feet high and to the top of this building is only 14 feet high. It is the very strong feeling of the design group -of Charles h,uckman. & Associates that this sign is properly designed and properly located on the building' There being no further public testimony, the hearing was closed„ Councilman Towner.- Is the Planning Department decision on -the employee parking sign still in -question? Mr. Ed Thurman. - The employee parking sign is no longer in question. !_Councilman Heath.- I think that in order for a business to .,-be healthy they should have signs and I feel that in many cases our sign Ordinance is a little bit too restrictive. . I like the compromise; it seems a good solution to the problem. I would --propose that we don't bend it the other way so far, give them the thr-�ee signs, but let them go 4 by 8. I can't understand the Planning Go-mmissi.on recommendation of denying that General Tire insignia since it is, still contained roughly within the boundaries of the sign itself; it is practically an overlay on the sign it- self. My feeling would be to grant these people their six signs, a little bit larger than compromised and allow them to _hay.e...the Gene:xal Tire insignia. Councilman Snyder.- I think since they have gone all out: on landscaping they are going to need more ,signs as a matter of identification. I think that pretty much expresses my .,opin- onb Councilman Towner-. I -sympathize with the Planning Commission purpose. I think; this particular develop -m ent stands out and. we should therefore give them the different opportunity on signing. I would go along with every- thing they asked for. Mayor Barnes-. I feel we should bend a little in this case, I- feel they need it because of the distance botw-een the signs. I also feel that they need the Gene-ral. Tire sign within the tire center. I pretty much go along with the rest of the Council;, however, I do see the Commission's concern in regards -to the Civic Center, but I feel that they need a good identification in this location, Councilman Snyder-.- I do feel that the compromise sign is better, It is Lower and. I think it fits in with ,the landscaping. Perhaps we could give them larger ones on Garvey and smaller ones on Bat.eLaan and Suns et. Councilman Towner-. Per.hape. the one on Sunset Avenue and the . two on the frontage road could be t=he_la.rger ones and the three on the interior street of Batelaan we could compromise and make them smaller. Councilman Heath-. I think that is a good solution, Councilman Jett-. That -sounds very good, Mayor Barnes-. I.• agr-.ee with the two on. Garvey, and I don't agree with the one on Sunset. Sunset is directly across from the-- Ci.vic�Center and a smaller sign would serve the same purpose in that area. Councilman Jett.- Sylvan Avenue is a dedicated s41reet and. a-s a dedicated street I 'think any build- ings that; are built on it should face that dedicated street and at the same time provide sidewalks and everything that would be required in any other building. Councilman Snyder.- How wide a walk; are you. putting on Sylvan Avenue? Mr, Shulman.- It is there now, A is six feet, Councilman Snyder.- That unit: next to Sylvan Avenue, is the entrance going to be from Sylvan or from th-e parking lot? Mr, Shulman.- It will have an entrance from the parking lot and -one from Sylvan Avenue. Councilman Snyder.- That sidewalk: in front of the stores, is it continuous with the stores on the east:? Mr. Shulman.- This its _a walk al.l._.ar.o.und f.he__front of it. Councilman Towner.- As far as that portion of it that abuts the street, faces the street, . and, the part that doesn't abut the street: faces the parking lot. This leaves a- blank wall along t:he parking lot of the bowling alley. It is my view that we ought to continue to provide landscaping in this area and enforce it If suitable landscaping were provided around it, I would see no objection to it,. Councilman Heath.- Could this be developed so we can face it on Sylvan? Councilman Jett.- This is one thought that I had,, 'Whether it; can be done or not, it: would probably require working with our Planning De- partment and the applicant. We are deeding this property back to him. Councilman Towner.- The building itself covers only that por- tion of the land which is vacated street and nothing else? Since he owns the property adjacent to this, can we insist or demand that he combine other land with this to make a suitable building. Mr. Williams-, H�e owns- the property to the north. You c.an require setbacks, you. can control the spacing -of building to the extent that you require a uniformity. In you -(judgment you c'*n impose such setback from the property line, among other things, as- would comply with the general, requirements of the City in developing commercial. Councilman Snyder: It is po,asible that because of the build- ing to the east facing on the parking lot that it would be inconsistent to change the facing of the building. CoL4dn°t we r-equire that at least the front to the parking lot line up with the buildings to the east? Mr. Williams-, I.>thin.k you. can. In that case, it would not be built clear to the property line, which..you normally don't do any way, among other reasons for fire reasons. Councilman Snyder: Perhaps conference with our staff. and Mr. Shulman might work out a more satisfactory, plan. Mayor Barnes: I think it might be wise to have the staff. -make a study and recommend to the Council, if you so desire. Councilman Heath: I- think it needs some more study. Councilman Towner: I-_ag.ree,- however, I am a little re- luctant tmo have the staff draw the plans 1--think the staff can work with them'. I am inclined to agree with Mayor -Barnes and would be happy; to hold it over and give the parties an opportunity to work along these lines to see if they can develop something a little mor-e satisfactory. Mr. Aiassa: I. think .it might be a good idea to put Mr. Jett on this committee. City Manager whereby his staff, the developer and s, member of the :Council would work as a Committee to try to resolve these problems., Building setback from the property line-, landscaping-, relocation of the building in relation to adjacent structures. The purpose of my appearing before you again tonight for this last time is to tell you what has transpired and to make a request of you. The Boundary Commission received the communication and they have reported on the annex- ation which we proposed. The boundaries were acted on last Wednesday, June 20th and with a minor revision, they approved them. They found that there are no corridors of unincorporated territory left by the annexation, no county lands. They approved the boundaries as to certainty and preciseness so the matter has been approved now by the Boundary Commission and is sub- ject- to action by the City Council. There are seven property owners involved in this annexation-, six of them want this annexation under the uninhabited territory act This s.ix out of the seven have more than 5116 of the assessed majority of the area. The Covina Ranch property is a bigger portion of the area. In our judgment, the Council could initiate an uninhabited annexation on these seven parcels, set a hearing date and annex the property under the uninhabited act. We have checked with the Registrar of Voters-, there are 11 registered voters • residing within this area, As you know, these uninhabited annexations depend upon the amount of assessed evaluations if the Council wishes to act. In this case, we have the majority of the assessed evaluation as far as six of the seven properties; we cannot be assured that this will be the majority of the assessed evaluation after mid - August.. The City Clerk has received the written communication from the Boundary Commission approving the boundaries. We took the liberty of draft- ing a resolution initiating annexation proceedings. Councilman Heath.- We discussed No. 170 last meeting and the stand I took was we should .a.loz.a No. 1.70 because we were putting ourselves in a very vulnerable position. I. was overruled. The owners of the ranch property stated, to pacify us, that they would not file a protest during the time that this hearing is held open. They did not. say they would not file when the hearing comes up. We have gotten ourselves into a position where we have nothing to bargain with and we are supposed to sit down and talk with Forest Lawn and bargain. If Forest Lawn has applied to the Boundary :Commission for annexation which will be contingent upon the completion.of No-...170 and that can't be completed for another nine or ten days, this still leaves us wide open on the side of that ranch and they have not shown us that they want to protect us on the north side of the ranch. The north side is open to San Dimas. There are other annexations in that area which are being contemplaited which leaves that area wide open. We are still. bargaining and therefore we should not get into a position where we are vulnerable. If we want to bargain, we should have something to bargain with and right now we have nothing. Councilman Snyder.- If we win the appeal. on No. 167 then this proposed annexation of Mr. Matson could not go through. City Attorney, Mr, Williams.- This would be contig,ent on our losing No. 167. Councilman Snyder.- To block the Letson annexation, could Forest Lawn drop their oppositon to our appeal. so that No. 167 would win? Is this legal, to drop their opposition on an appeal? If the Letson-Watson annexation, the Vo. 170-,_.-and _the map that is; now pending for the Covina Highlands area, they -would -come before you for action, you would have a corridor running in County territory not included in the Letson- Watson annexation, not included in the. -No.. 170, not included in the Covina Highlands. These three annexations, if they were approved, would leave an island completely surrounded by the City of West Covina, which is illegal. You have three potential annexations pending which you could not legally carry through with. We filed our application with the City ,of West Covin�', for an unclassified use, for an approval of the precise plan for the development of the cemetary area and for the necessary variances. They were filed today about four o'clock. They will be heard by the Planning Cornmisrsion on the 18th of July That is the first step in trying to resolve this problem. To solve this problem, which is complex, requires mutual understanding, mutual confidence and mutual faith. We have given our wor..d, ..we have kept our word, and we intend to keep our word. . Mayor Barnes: As you know, you can file over annexation. We then can - file immediately on it because it is not protested out. Another fallacy in this, the way .it. -is --now, is the fact that if 170 fails there is nothing. This annexation he is talking about isn't going to come in because 170 is the -•anchor. Mr. Williams-. We considered it and from a legal stand- point think it would be highly inadvisable. Councilman Snyder-. Does the present 15-acre protest pre- clude any annexation in 170 area for one year .even though we drop the proceedings? Mr. Williams: No; . Only if there is a majority protest. If you drop it, you have to permit the filing of anyone who would want to protest anyway. If the protest amounts to more than 5016, nothing can be done for a year. Mr. Glenn R. Watson: Mr.....Blalo-ck stated that if 167 fails that therewoul-d be no contiguity for this annexation-, That is incorrect. The boundary is the City limit of the City -of West Covina as it presently ex- ists; the contiguity is there. There .is� also-:, contiguity along the southerly portion of it. The "Watson-Letson1° annexat-ion is a slight misnomer. I have- property there. We would nest be in here proposing an annexation which we did not sincerely believe to b-e legally sound and complete.
