They are in the County right-of-way. The County Road Department is -going to review this and it will take a little time for them to come back with an answer. We ought to improve it as soon,as we can, I think we owe them the courtesy that we have granted other people for a years extension. My contention is that you can re- solve the tree situation within six months. Motion by Councilman Towner,. seconded by Councilman Adams, and car- ried, to extend the agreement time on Precise Plan No. 202 for one year as recommended, PROJECT C-168 FOR PLANS AND SPECIFICATIONS STREET 'IMPROVEMENTS APPROVED Mr. Flotten. LOCATION. Southeast corner Willow Avenue and Yarnell Street Approve plans and specifications for street improvements. Authorize City Engineer to call for bids. Staff recommends approval and authorization. We received a report from Mr. Lathrop dated April 6. You have copies of that, This is part of Annexation No. 168. Motion by Councilman Towner, seconded by Councilman Adams, and car- ried, that plans and specifications for Willow Avenue and Yarnell Street improvements be approved and the City Engineer be authorized to call for bids. Mr. Aiassa: I would like Mr. Lathrop°s report spread on the Minutes, "On February 8,,1962, this office submitted a report to the City Council and City Manager stating that the property owner on the southeast corner of Willow Avenue and Yarnell Street, Mr. Gerardo Caparoso, was interested in participating in a project for street improvements fronting his property. The City Council at their meeting of February 13, 1962, authorized the City Engineer to.continue negotiations with the.property owner for street improvements on a participation basis. -2- 0 C. Co 4-9-62 Page Three PRECISE PLAN NO. 202 - Continued Mr. Lathrop's report - Continued "Since that date this office has received a deposit from Mr. Caparoso in the amount of $752.72, constituting pay- ment in full for curb and gutter construction on his en- tire property frontage and including $34.00 for the re- placement of asphaltic pavement on Willow Avenue that had been removed for sewer construction. "This office has also proceeded with the preparation of street improvement plans for the property under consid- eration which are completed and are being submitted here- with. "Estimated cost of the project on the part of the City in providing asphaltic pavement is $1,800oOO making a total, estimated cost of the project of $2,500.00. Funds for the pavement construction are available in the Traffic Safety Contingency Fund, "It is the recommendation of this office that the plans and specifications for Project C-168, Willow Avenue and Yarnell. Street Improvements, be approved and that the City Engineer, be authorized to call for bids." One is with respect to the original awarding of the bid and the other is a bid that was opened later and later withdrawn. Do you wish to hear all, the reports on this? Mayor Heath-, I believe we have all the reports before us and we can read it. Mr. Flotten-, The low bidder made an error of about $2,900.00 but since it was late and since the Council did not accept the bid, it can be withdrawn. Mr. Williams: He has demonstrated where the mistake was. He has pointed out that in the extension of figures there was a mistake. I think the action you should take first is to authorize the withdrawal of this bid and exclude it from consideration, then act on awarding the bid after that. Councilman Barnes: Before we award the bid to any contractors, I would like to ask one question. Is this portion on the schoolground 80feet wide? Mr. A,iassa -, Yes Councilman Barnes: How deep is that? This is the reason for my question. In figuring this out, that portion of the bid is approximately a little better than 2 j% of the total price of the sprinkler system.. I wanted to know in what percentage this 80 feet was in respect to the rest of the parka Councilman Snyder: Mr. Aiassa: Mayor Heath: I thought we were going to put this in anyway in return for the use of the lando They are participating. If`they should withdraw from this program later, this system can be sheared off and they can maintain their own section; there will be a shut- off valve for that purpose. Can we award it before the school approves it? We can approve it subject to their approval. They have approved it in the rough draft: and all we need is a formal approval. In the letter from Mr. Eastman of March 23, 1962, doesn't that indi- cate that they will, pay up to $ 1,500.00 on that? They have said yes, but they haven't signed a formal agreement. Motion by Councilman Snyder, seconded by Councilman Towner, and carried, that the bid of the Biltmore Sprinkler Company, in view of.the clerical error, be allowed to be withdrawn and the bid bond returned. . NO. 135-191 - Continued a N ".,Vz 6 Y.01 Mr. Ned Gilbert I must, prior to actually ptesen- 4501 North Sunflower Avenue ting the facts of the Variance Charter Oak itself, present three major reasons which I feel are very pertinent to this case. These reasons are based upon my appeal 'and I feel that the case has been grossly mishandled and the decisions grossly unfair. I will take no more time than is -- necessary., These reasons, before the evening is over, could develope into serious charges which I am prepared to document. Obviously, on an appeal an area of disagreement must exist. This area of disagree-- ment, in my opinion, is based upon (1) the public hearings of March 7 and March 21 indicated that the Planning Commission didn't understand the problem and, in my judgment, their decision should carry no weight with you; (2) the staff report of March 7 was a misleading one; it did not reflect all of the facts which the staff was well aware of; also reference was made to a so-called similar case without any introduction of the case and therefore prejudicial; (3) in the March 7 Minutes my testimony was edited and in part I was misquoted. I want to deal'with each of these statements that I have made and I am prepared to document them. ,Councilman Towner- We are not interested in attacking other people. We are interested im testimony that relates to the Vari• ­ ance application, I think if you present us the facts, Mr'. Gilbert, as to what justifies a variance that that will be relevant and material to the decision that we make. To go into these other matters seems wholly extraneous. Mr. Ned Gilbert: If that has to be the position of the'Council, I cannot proceed be- cause the facts of this case arei based upon having an understanding of the facts. and I don't know any other way to present facts unless they are presented on a basis of a Planning Commission having an understanding of these facts. I claim that they didn't understand it, Councilman Towner: Our problem is not whether the Planning Commission understood what you presen,ted; our problem is to understand it ourselves. Mr. Ned Gilbert; I am in a prejudicial position because you are asked to rule on a Planning Commission deci- sion. These people are representing you and therefore in represeniting you, if this decision has to influence you, certainly you should know the basis on which they are being enforced. If you rule out these statements I have to make, I have to withdraw my case and ask the City Attorney to rule whether or not I am being prejudiced against by being limited in time and not being allowed to present facts which I feel are pertinent to this case. Councilman Towner: I have only made a suggestion to you. Mayor Heath: I see Mr. Gilbert's point. Psycho- logically, in the back of our minds we know this has been denied by the Planning Commission. He feels its denial is not justified'and he is trying to prove why it was not justified. Does the Council agree that since this is on an appeal, we have in the back of our minds'that this has been denied by our staff, namely the Planning Commission and that this man is trying to state why this denial was not justified? _10- Co C. 4-9-62 Page Eleven VARIANCE NO. 377 & M&B SUBD. NO. 135-191 - Continued IN FAVOR - Continued • Councilman Towner- I was only making a suggestion, Let the man go ahead. 40 Mr. Ned Gilbert: 1. believe that I have an understanding of the Planning Commission's obliga- tions in hearing an applicant,and-in order, for you to know that I have that understanding, r base my domplaint against an unjust decision on several premiseso The Planning Commission should ask whether the proposal is reasonable; if it is nonconforming, will it help the applicant, the neighborhood and the City as a whole. These are requests that I feel the Planning Commission should have raised either publicly or privately; what is a net gain or loss to everyone . involved if the proposed improvementis denied; and isn't it the basic intent of the Planning Commission to render intelligent advice to the property owners. We had no opposition, as such; however there was no attempt to mediate, rather, I felt, an attempt was made to foster opposition; and perhaps more importantly, I am sorry to say, I felt the Planning Commission revealed to me that they had a kindergarten knowledge of the language of real, estate and no conception of real estate b development. As far as the staff is concerned, on my second complaint, I am most disappointed in Mr. Joseph. He was present at several different meetings with Mr. Pontow, Mr. Dosh, Mro Lathrop, Mr. Russell, Mr. Klein and Mr. Aiassa. He is well aware of everyone's considered opinion and his report should have been a recommendation in favor because he sat in at these meetings and the indication was that this zone' -case was supposed to have been approved because I complied with every request made by the Engineering and Pub - lie Works Department. He was asked the direct question in my presence, by one of the gentlemen present, "Do you favor this application?" and he said "Yes". Why didn't this reflect in his report? As a property owner in this City, I own as much property as anyone in this room and more than most. We have a right to rely on the reputation of our staff. Mr. Joseph made a reference to a similar case and didn't allow me the opportunity or the background information to comment on this case; simply made a reference and this is about as prejudicial as anyone could do. It wouldn't be recognized as evidence in court. I don't know about a case and have no information. Perhaps more importantly,, Mr. Joseph revealed by mentioning a driveway easement that he didn't have knowledge of what a driveway easement means. I want to quote the difference be- tween the ownership in the Real Estate Owners Book and I wasn't asking for a driveway easement and I think this is the area that; you should be aware that the Planning Commission did not have an understanding of this. "Easement. Granted by right or agreement for a specific purpose an easement is the right or privilege which one party has in the land of another, a right of way." Gentlemen, I said I had the ownership and there is a great difference between fee ownership and an easement. I quote again from the same book., "Fee, An inheritance, an estate of inheritance in real, property." Every one of you gentlemen have a home that has a width of 50 feet or more. You front on.a dedicated street, You have the right of ingress and egress, you own that property. So where we have the conception that if we nar- row down to 40 or 20 feet it becomes an easement, this is not true'. -11- C. C. 4-9-62 VARIANCE NO. 377 & M&B SUBD NO. 135-191 - Continued Mr. Ned Gilbert - Continued: Page Twelve You can have fee ownership of three feet or just wide enough for me' to walk there and I have the basic fundamental right to enter upon my property from a dedicated street because I have fee ownership. - If you have an easement, you have a right over someone else's property and I don't propose any easement and I emphasized that at every one of our meetings. Constant reference is made to easements in the Planning Commission Minutes. Insofar as the Minutes are concerned, and this is my third complaint, on Page 5 of March 7, 1 said "feel' ownership; I didn't say 11threello In the March 7 Minutes an Page 6, 1 urged that the Commission also grant Mr. Nickerson a right to split his property as well as any other person to split the property. This was not reflected in these Minutes. Who edits these Minutes? Do we have to have a public stenographer here to have a public record, If you wZ1.1,1, permit me -to continue, I will state the facts of my case as briefly as I can. Mayor Heath - You. may proceed. Mr. Ned Gilbert: I have maps and photes prepared to delineate that which . I have just told you. I hand you photo- graphs of the subject property which were taken last Friday. I call your attention to the map which shows numbers from the various points from which these photographs were taken. The proposed lot; split, gentlemen, is this colored map here. The subject, house is a substandard house with no garage and is on this property at this point. This is the intersection of Dutch and Ardilla at this point and Willow Lane extends from Willow Avenue from a westerly direction to deadend at this point, This is the manner in which I propose to split the property, This is a very critical intersection; it is 18 feet and 10'inches wide. It is quite difficult for two cars to pass at this corner safely, although it is done. This was not reflected in1he report of the staff. I call. your attention to the map which was the original proposal of the lot split and my proposal. to dedicate this portion; this area was denied and they suggested, this. By complying with the new request, there was considerable added ex- pense to me, which prejudiced against me because the report which you have shows the lot area as considerably under, this particular one had the measurements computed of these lots. No mention was made of the fact that as a citizen I was improving the street at my expense. The fact that Willow Lane has no direct bearing upon the improvement of this property has no bearing at all.. I call. your attention to the fact that this is the property and here is the City of Baldwin Park and as of this afternoon I was told that the minimum lot size in Baldwin Park is 5,000 square feet. Certainly these lots that; I am proposing are in excess of 5,000 square feet and I am not proposing to underbuild the neighborhood; I am proposing to build the equivalent or better. I am proposing to.improve s substandard house. I am not making state- ments that I am not prepared to follow through on. I have drawn plans to take a substandard house and improve it. This has been in my file for months. I also have plans to build two good houses on this prop- erty in addition to improving this house. By my combining these two properties, which you see presently in this manner, I am able to create three still in excess of the general area although under the oversized lots on Willow Lane. Instead the introduction of Willow Lane as a red herring to prevent me from devel- oping this property is all that shows in your Minutes. I am prepared to dedicate. I have no need of Willow Lane frontage. I am willing to improve a substandard house, place two more houses and become a tax payer of a property that presently has no improvements. For this I have two postponments and I have no knowledge, but I am confident in my mind, that no field trip was made as per the request for the first postponmento If it was, there was no mention of it. At this point I am unable to proceed because we have a question of whether a cul-de-sac should run into this property and I have stated before, that, to run a cul-de-sac in excess of 500 feet is contrary to City policies, at least this is what the record shows. If my request is not justifiable then I have only one position to take.- I will leave the property as is; I will make no improvements whatsoever; I will wait the time that • the City feels that thisis a critical point, they can purchase'my property at a fair market price and I will certainly cooperate in any event with the easement, which I,have offered to do in the past, for, sewer and drainage, and to any extent the area can be improved., IN OPPOSITION Mr. Nickerson. - The only thing that I have to say in regards to this is one thing, I feel that if Mr. Gilbert is given the privilege of splitting his lots, making them substandard, that the rest of the people on Willow Lane should have the same privilege, Mr, Harry Hapbrook Mr. Gilbert says the Planning 2314 Willow Lane Commission did not visit; the house, I have my wife's word and a few of my neighbors word that they not only visited but spent quite a bit of time there, If he does this, Willow Lane never will be a dedicated paved street. Be- fore he came, a guy named Reynolds owned this place and we had it all agreed that there would be something done for the draining. Mr. Joseph was going to make up a petition for us to sign. We never did get the petition. How many square feet is Mr. Gilbert going to make his houses? STREET IMRPOVEMENTS Page Twenty -Five You received on April 9, 1962, the major capital improvements on capi- tal outlay items'in 1960-61 which amount to $879,009.00. I think this is something that isn't publicized enough, the excellent financial position of the City since Mr. Walters and Mr. Aiassa have been around. Mr. Aiassa: We have been talking about our major street improvements we completed under the State Highway Committee and showed the deficiencies of streets in all cities and counties of California and West Covina. At the time this report came in, we had a deficiency. We list here in major streets $1,555,200.00; cost and right of way, $251,400.00; secondary, $3,035,800.00 in construction and $271,900.00 in right of way; local streets, $720,700.00 worth of right of way construction to acquire which gives a rough figure of $5,845,OOOo00o This does not include other items such as storm sewers and things like that that will have to be tied in with the construc- tion. I would like to advise the Council this is now pretty precisely reviewed as far as the staff is concerned. We are now undertaking this three and five-year major street improvement program and we would like to know where do you feel our priorty will. be established, on the major or the secondary or,the locals? The fa.c.t6r that is somewhat important is that your secondary streets are the ones that play quite a .roll in the east and west traffic. We would .like to have a little thinking from the Council. Where do you want to start first? Councilman Barnes: Councilman Adams: Councilman Snyder: Mr. Aiassa: Councilman Snyder: I think we should study this in a study session. I think it would be up to the staff to make recommendations on this. Is that deficiency report we have on the streets a couple of years old? That is 1962, I think we would make our best showing in starting on the secondary. Councilman Barnes: We do have some major streets that we should consider improving. Councilman Snyder: I think we ought to have a study session. Mr. Aiassa: We will make a preliminary report. • Counciman Towner: It was my understanding that we were going to have the Planning Commission or some such body make a study of all our capital improvement requirements and give us some thought as to priorities. Streets would be just one aspect of it. I am wondering if anything as yet has been set up on this or whether this is a feasible program. Mr. Aiassa: We have not completed the study. REQUEST AUTHORIZATION TO ADVERTISE FOR BIDS ON FIRE DEPARTMENT STATION WAGON Mr. Aiassa:. I would like you to authorize me to call for bids, Motion by Councilman Barnes, seconded by Councilman Adams,, and car- ried, to authorize the City Manager to call for bids on a 1,962 Sta- tion Wagon for the Fire Departmento SAN GABRIEL WATER COMPANY APPLICATION Mr. Aiassa: We have a request for a hearing on the San Gabriel Water Company appli- cation for authority to increase rates for water service in the El Monte Division. Does this cover anything in West Covina? Councilman Barnes: Yes; a small portion of this property is in West Covina, south of the freeway just east of Puente Avenue. Mr, Aiassa: Does the Council want me to take a stand on it? It is approximately a 157o increase Mayor Heath: I think the City Manager should be instructed .to voice our objec- tion to this. Mr. Aiassa: The hearing will be in May. In the meantime, I might have the City Clerk notify these people and have them there. -26- • n U • Co Co 4-9-62 CITY MANAGER'S REPORTS - Continued AMERICAN LEGION REQUEST FOR OLD FIRE ENGINE Mr. Aiassa- Page Twenty Seven We originally took this thing on the basis that it was to be reconditioned and become part of the Fire Department. All the support and help just didn't follow ups I think what we should do, in fairness to the owner, is to talk to the owner and see if he has any objections if we work something out with the American Legion. I don't think we should do anything until the owner of the vehicle is notified. Motion by Counciman Snyder, seconded by Councilman Adams, and car- ried, to authorize the City Manager to talk to the previous owner of the fire engine as to permitting the American Legion to take over this fire trucks AMENDMENT NO, 427 OF THE MASTER PLAN OF HIGHWAYS FROM THE COUNTY OF LOS ANGELES Mr. Aiassa: We have Amendment No 427 of the Master Plan of Highways from the County of Los Angeles. They were approved and adopted by the Regional Planning Commission of Los Angeles after hearings on August 8, 1961 and the Board of Supervisors. Councilman Snyder- Does this include the Forest Lawn property again? Mayor Heath- According to our City Attorney, we would be mixing two annexations. The only way we can approach this is to consider the annexation of the highlands first as one unit. I think this needs a report from the City Attorney as to the various legal traps. This is a pretty involved subject, I think we should give this to you for a full report. Mr. Williams: I think before the 23rd you ought to have some kind of a meeting and discuss this whole thing because by the 23rd you are going to have to jump one way or the other on 170. You have a meeting with yourselves, not with those people. Mayor Heath; Mr. Joseph: Councilman Towner: Councilman Snyder: We will set up a study session for a week from tonight on the 16tho Can we refer this letter to the Planning Commission so they can get some kind of a study going to report to us? We won't have a chance to report to you by next week. I would suggest we solve the other problems first,, whether or not it is even feasible. My question is something about submitting this to the Boundary Commission Mr. Williams: You could, but of course you would have to have the boundaries.firsto- I think before you start off on a certain direction you had better know where you are going to wind up. This is a political matter and you have to make the determination, what are you going to go after and what are you going to surrender. Mayor Heath: Mr, Williams; Councilman Barnes: You don't think they should recom- mend what area of the highlands we should or should not consider, and what area of the ranch we should or should not consider? Not until you decided After we decide what we would like to do they would then have to cir- culate a petition as to whether or not they wanted to do this? Mr. Williams: Yes, but you will probably deter- mine what you will like to do is annex the ranch with the highlands, I have to qualify what you are going to do with what you can legally do. I think you are going to have to jump to annex the highlands or the ranch, but not both; -28- is • C.
