CITY OF WEST COVINA, CALIFORNIA January 22, 1962 The meeting was called to order by Mayor Heath at 7e45'P.M. in the West Covina City'Hall. The Pledge of Allegiance was led'by.Cour,cil- man Snyder with'the invocation given by the Rev. Henry Kent of'the Community Presbyterian Church. Williams, City Attorney Mr. Thomas Dosh, Public Services Director Mr. Harold Joseph, Planning Director (from 8 p.m.) Absent: Councilman Adams APPROVAL OF MINUTES January 8, 1962 - Motion by Councilman Towner, seconded by Councilman Barnes, and carried, that the Minutes of January 8, 1962 be approved as submitted. City Clerk, Mr. Flotten: In the Minutes of November 13, 1961, Page 26, there is incorrect reference to a reimbursement district which is designated as -District A-11-57-2. This should have been shown as Dis- trict A°11-60-20 ' Motion by Councilman Barnes, seconded by Councilman Snyder, and car- ried, that the Minutes of November 13, 1961 be_amended to read correctly as indicated by the City Clerk. CITY CLERK'S REPORTS PRECISE.PLAN No. 247 REQUEST FOR EXTENSION OF AGREEMENT TIME FROM CHURCH OF JESUS CHRIST OF THE LATTER DAY SAINTS APPROVED LOCATION: Southeast corner of Fern - wood and Mobeck Streets. Staff recommends one year extension to March 6, 1963 with bond to remain in effect until agreement'is termin- ated. Purpose: To install street improve- ments. Motion by Councilman Snyder, seconded by Councilman Barnes, and car- ried, that the request for an extension of agreement time for one year. to March 6, 1963 be approved. C. Co 1-22-62 Page Two City Clerk's Reports - Continued BENCH MARK SYSTEM The City Manager stated that special CITY ENGINEER'S REPORT recommendation should be giveAto the ACCEPTED engineering staff and Harold Johnson's office in putting this together. They used official records of the State and the County and it is the first.time in the history of the City having a full Bench Mark System.' The City also now has. a legal description and survey of City owned property. Motion by Councilman Snyder, seconded by Councilman Barnes, and car- ried, that the report of the City Engineer on the Bench Mark System be accepted. City Manager, Mr, Aiassa: There is also included an item here indicating that at a cost of $5.00 per set of maps and Bench Mark System Report these could be made available for those interested in obtaining them. Motion by Councilman Towner, seconded by Councilman Snyder, and car- ried, that the cost of the Bench Mark System Report, to the public, be in the amount of $5.00 per copy. PROJECT NO. C-155 LOCATION: Northeast corner of Mbrced ACCEPT STREET IMPROVEMENTS and Sunkist Avenues. (William Kirkland) APPROVED Accept street improvements and authorizing the release of Hartford Accident and Indemnity Company Per- formance Bond in the amount of $1,836.48, subject to Notice of Com- pletion Procedure, Inspector's final report is filed and staff recommends acceptance and bond release. Motion by Councilman Barnes, seconded by Councilman Snyder, and carried, that street improvements in Project C-155 be accepted and authorization given for the release of the bond, as noted, subject to Notice of Completion Procedure. TRACT NO. 13867, LOT 32 LOCATION: Southwest corner of ACCEPT STREET IMPROVEMENTS Michelle Street and Lark (Ross -Rogers Construction Co.) Ellen Avenue. APPROVED Accept street improvements (side- walk, curbs and gutter); authorize release of cash bond in the amount of $800.00. In- spector's final report filed and staff recommends acceptance and bond release. Mr. Joseph entered the Chambers. Councilman Snyder, at this time, made reference to a situation brought up at the previous Council meeting in regard to satisfac- tory clean-up work in a sewer district area which had been brought forth by home -owners that were present at said meeting and asked if staff knew if these matters had been taken care of properly and had the h;Ome-owners reported to the City as had been suggested that they doe Mr. Dosh indicated the various works had been taken care of and that to the best of his knowledge the people had made their indications to the City. Councilman Barnes asked if the flood problem had been cleared up at the corner of Azusa and this praticular property. Mr. Dosh indicated that a bond had been presented for all improvements and that staff had been working with the applicant's engineer and the church people to get proper drainage easements across this lot with water to be drained to the rear, westerly to Azusa Avenue from three cul-de-sac°s with probably the easterly cul-de-sac draining into the Wash although as to exact detail, this is still being worked out with the engineers,, Mayor Heath: Hearing no objections, we will waive further reading of the body of the resolution, Motion by Councilman Snyder, seconded by Councilman Barnes that said resolution be adopted. SCHEDULED MATTERS HEARINGS ZONE CHANGE NO. 206 (Larry Sade - Leslie Sugar) HELD OVER TO NEXT REGULAR MEETING r:. LOCATION:. 725 South Glendora Avenue, between Glendora and Cali- fornia Avenues, Request to reclassify from zone R-A to zone R-1 and R-3 denied by Planning Commission Resolution No, 1141. Appealed by applicant on December 22, 1961. Hearing conducted on January 8, 1962. Hearing closed and matter held over to January 22nd for decision pendin&receipt of cost study from City Manager. The City Manager suggested this matter be held over to the first meeting'of Council in February in that Councilman Adams is absent and also as a result of a meeting that,had taken place in my office with Mr. Dosh and Mr,. Joseph at 4:45 p.m. today so that perhaps there could be presented a moke balanced opinion of Planning and Engineer. Mr, Dosh thought;it advisable, also so,that Mr. Joseph might present any dissenting opinions. It would appear that Mr. ..Dosh has given the engineering facts and that Mr. Joseph should give the Planning Department's also, Mayor Heath stated there had been two weeks to do this and that to hold this over again would be a matter of three weeks until the next regular meeting and he felt that possibly if some conclusion could be reached by Council tonight that perhaps they should do so, Councilman Snyder indicated, however, that relative to this report he would have some questions about it and that possibly it put him . in even more of a.quandry and he asked if there weren't supposed to be some block studies on this, too. Mr. Joseph indicated that he had them with him, Mr. Aiassa stated that he had given some indication as to the meeting that had taken place just this afternoon and that quite a discussion had taken place. But Mayor Heath still felt it had been possible to get in all reports with,time,to present some solutions and that al- though: Councilman Adams was absent now there was always the possi- bility that he,` the Mayor, could be absent at the next meeting, Co C. 1-22-62 ZONE CHANGE NO, 206 - Continued Page Nine Councilman Towner felt that it would seem obV ious that some in- formation was missing out of this and what would the cost be in • the light of what the developer asked for. There is a cost per lot on R-1 developments considering the proposed plot plans pre- sented for study purposes, but it doesn't indicate what_it would cost by comparison for other development such as a portion for R-3 or all of it being R-3 or some other factor. Councilman Barnes felt that Councilman Towner had a good point and that possibly Council should have more information than at present and perhaps this should be all R-3 or R-1 or possibly there are some other possiblilites, of 1'/2 R-3 and 1/2 R-1, Councilman Towner felt he was somewhat reluctant to move on a change here on property that is proposed by the consultant and Commission and indicated by the people as all R-1 property, Councilman Snyder said that to him this demonstrates one possible weakness of the general plan in that the general plan just leaves you here. To follow the general plan it indicates it is not ec.o- nomically feasible to put R-1 which demonstrates, again, that planning isn't an exact science and that somewhere you have to compromise the economics of the:°..situAtiom- with what is.the best plan and that he would like to study this from several viewpoints before deciding on it. Mayor Heath asked the applicant if he would be willing to have this held over for three weeks and the applicant indicated that it would be satisfactory to him, Mayor Heath asked as to what information it was felt was needed and the City Manager indicated that block studies could be sent to Council individually Ito.look at, there would be a new anaylsis of the engineering report on street cost and that also he would like to study other property on Glendora Avenue, Councilman Snyder asked if there couldn't be some alternate studies, too, and Councilman Barnes was of the opinion that alternate studies of plans is needed on this type, for review, Councilman Towner felt, however, the alternates are infinite and possibly there should be a line drawn as to what we have in alter- nate solutions. Possibly divide property in quarters and give a solution on that basis as to what it might cost for 1/4 improvement of R-1 and 1/4 o '17'-3 and tik®_. it :from there. .Councilman Barnes stated that we would want to include R-1 along California and Councilman Towner indicated it would appear there was no disagreement on that portion that should'be R-1 on California but Councilman Barnes thought there could be in that there is only single lot depth indicated whereas there is the possibility of ex- tending this (R-1) from California perhaps 3 or 4 lots deep, or more. Councilman Towner stated that because of the tract on Oak Park Place, that lies adjacent to it, there might be a differences Motion by Councilman Barnes, seconded by Councilman Towner, and carried, that Zone Change No. 206 be held over to the next regular meeting of the Council with permission of the applicant, Mr, Leslie Sugar who was present, Im C. Co 1-22-62 Page Ten VARIANCE NO, 366 LOCATION° 730 South Orange Avenue, SHOE CORPORATION between Service and OF AMERICA Richland Avenues, APPROVED • Request to permit a nonconforming identifying sign in zone C-2 denied by Planning Commission Resolution No, 1126. Appealed by applicant on November 6, 1961. Hearing set for December 11, 1961. Held over from December llth to December 26th,and from December 26th to January 8, 1962 at applicant's request. Hearing conducted on January 8, 1962. Hearing closed and matter held over to January 22nd for decision pending receipt of report of recommendations and conditions from Planning Commission. The report of the Planning Commission was read by the City Clerk, Mr, Cairna presented an architectural drawing of the sign being requested which, he stated, had been presented to Council previously but which now had the changes shown as had been indicated in the report of the Planning Commission, The sign had been previously shown with its supports under the sign whereas the Commission had suggested rectangular tubular supports at each side, and this was being shown on the drawing. Councilman Towner asked it it were an interior lighted sign and Mr. Cairns indicated that it was, Councilman Towner then .asked if there were any specifications as to how it was desired to be located and faced and Mr. Cairns indicated there was not, but to be most ad- vantageously located would be,for it to bissect the angle at the intersection of Service and Orange. Mr. Cairns further stated that the Planning Commission were not�any more sure about the situation than' -he was.but believed they covered the matter by stating that so long as there is to be a sign placed it should be at a location that is most advantageous to Scoa to enable the best sighting from both the easterly and westerly directions. Motion by Councilman Towner, seconded by Councilman Snyder, and carried that Variance No. 366 be approved with the following re- strictions: 1. That the height of the sign shall not..be_exce�ading 40-feet, 2, Subject to all the conditions as outlined by the Planning Commission in the memorandum of January 17, 1962. 3. That the sign be located at the intersection of Service and Orange Avenues in.such a manner that is most advan- tageous according to.the applicant's description. Councilman Barnes voted 1PNo", Councilman Barnes: I stated my reasons of objection at the previous hearing. I feel that this type of sign would set a precedent in the Civic Center. I feel that all of the stores now want, or possibly should be entitled, to the same treatment along Service Avenue so they can be seen from the freeway. I feel, also, that Scoa sign as is presently on their building is a very good one and that it can be seen from the freeway almost as advantageously as a larger sign. I do not feel this present sign should be located as shown on this variance. I think it detracts from our Civic Center and is setting a precedent. -10- C o C a 1-22-62 Page Eleven VARIANCE NO. 366 - Continued Councilman Towner: I am still wondering about putting the wording "West Covina Civic Cen- ter" on it because of its location and in so doing it might set it apart from any other sign that came in. It is an entry way to the Civic Center and it would be distinguished from other signs, Councilman Barnes: That may be true but I feel that this isn't the Civic Center and should not be advertised here as such, Councilman Snyder: I would certainly like to entertain the opportunity of including "West Covina Civic Center" in the sign, Also I think, in my own mind, this does not set a precedent for any of the other stores to have similar signs go in down Service Avenue because I think it was clearly demonstrated that this prop- erty boarders the freeway while other properties do not and this would also best advertise the entrance to the Civic Center. Mayor Heath: I do not see the need for the sign designating the Civic Center at this location as it isn't in the Civic Center and if we desire such a sign, we should put it in the Civic Center. Insofar as a precedent, I would rather have this sign a� this lo- cation than on top of the roof of the building, which they can do, and thus set a precedent in that respect which I feel would be more detrimental,,: Councilman Barnes: You think there won't be signs asked for on the old C-R property adjacent to this property? It was then realized that an error has been made in that the hearing had not been opened on this item, Councilman Towner, with the second by Councilman Barnes, then made the motion, which was carried, to rescind the previous motion and vote and that the hearing be opened. At the time that you passed on the realignment of Valinda, we spoke here against'it, stating that we did not agree with your piece -by -piece acceptance of the traffic study you bought from traffic consultants. We wish to again reiterate this, anal again to suggest that you study and act upon these changes in their en- tirety and simultaneously. -12- C. We had an excellent dealer ready to operate the station but because of the uncer- ,� tainity of the City's action he has now decided not to take the. station. We are now finding it difficult to interest other dealers for the same reason, There being no further testimony. the hearing was decl'ared,'closed, Councilman Towner: The comment on the request that we make an over all study on this mat- ter is that we have made an over all study on the traffic pattern in this area and because of the complex problems, we had to adopt'this a piece at a time, but the pieces do fit together and I think it is the best solution to the traffic situation, even though the Mayor disagrees. Councilman Snyder: I think the study clearly demon- strated that this was the best acceptable plan for the welfare of the entire business area, and for the City as a whole, from the standpoint of traffic movement, easy access to all areas of the downtown business area. Councilman Barnes: I am wondering, at the time these gentlemen started building if re- ports were available so that they could have access to them?' „ City Manager, Mr, Aiassa: A report was made and there were several meetings with Council. This also was submitted.to both the County and State Division of Highways for their review and approval because there were gas tax funds involved which were to be used for this project. Councilman Barnes: Were these people aware we were maaking a study of this area? Mr. Dosh: I do not know if they were aware we were making a study on this although there has been discus- sions relative to this at many previous meetings. But they were, we think, aware that this was a temporary alignment and I think the report indicated they were informed this was a temporary alignment and it.was not taken off the maps as temporary alignment. Mayor Heath: What records showed they were aware of this being a temporary plan? Mr, Dosh,: It would have been the report on Project C-60o Councilman Towner: Isn°t it true that this was temporary. on the Master Plan of Street and High- way and is shown as such on the records and available if anyone desired to build on this future street. It was indicated it was, Mayor Heath asked how can a master plan show a temporary alignment and Mr. Aiassa indicated that there was property beyond, that wasn't going to be able to develop and Mr; Hogan would not go beyond the point we have presently completed and it was then shown as a temporary a I lignment of Valinda, across Glendora . Mayor Heath asked if staff feels it has gone over all the Minutes on this matter and Mr. Aiassa indicated that he felt that both Mr. Bandy and Mr. Hogan had been very familiar; with what the prob- lems were to get State gas tax funds and use of those funds. Councilman Towner stated that he felt that Mr. Bandy, certainly, was aware of this and whether he had been inter6sted in passing this on to a buyer he did not know but he was quite sure he knew about it. Certainly insofar as Council is concerned, stated Councilman Towner, they as a majority had considered it as temporary and that is the way it was laid out and intended. What we have here now is a thorough study of the problem and it was brought out what the major- ity of the Council thinks is the best solution. City Manager, Mr. Aiassa: We have given Shell Oil Company all of the records to see what they might do if this so called 'turn' on the temporary connection was removed and I believe they still have that under study as we have not received these records back, as et.. Co 1-22-62 Page Fifteen RECREATION& PARKS Mayor Heath brought`up the matter of having received a telephone 40 call regarding the rmming of an official 1-lower:`for:-the C%ty .of West Covina and inquired if anything was being done on this or had it been dropped, Commissioner Blood, of the Recreation and Parks Commission, who was present'in:the audience indicated that although she had been unable to attend, understood there had been a meeting with the Woman's Club, West Covina Beautiful and the Friendship Garden Club with Commissioner Whitcher and she thought that some under- standing and recommendation had been reached and thought that it had already been presented to Council. Indications were that it had not been presented to Council and it was indicated to Com-' missioner Blood that perhaps she should present the.information to the Commission and have them activate this matter and if pos- sible get some recommendations or report before the Council so that any necessary action or decision might be taken in regard to this; Mayor Heath called a recess. C. 1-22-62 Page.Sixteen CITY MANAGER REPORTS LARK ELLEN HOSPITAL -RADIO The City Manager indicated that 40 Council had received copies re- garding this and that Dr. Mintz is present to answer any questions Council might have. It was indicated by Mr. Aiassa that this does not incur any cost to the City and it would be his feeling that there are no problems here since the City is not involved financially, Rather it would be more of an endorsement accepting this installation as a part of our Civil Defense system, Councilman Snyder: this? Councilman Snyder: Do you think it is necessary to show some justification for spending of Federal Funds for something like if one Tftp.ital does this we would third who would eventually.demand the ow much Federal Funds are involved but It is matching funds, the amount being $14,000.00 with $7,000.00 coming from the Federal Government. I am wondering how useful it would be from the standpoint of the general public to be spending $14,000.00 here? Councilman Barnes asked where the other $7,000.00 comes from and . Mr, Aiassa indicated from the hospital, Mrs, Boschoff: The Federal government has made the statement, keeping in mind the FCC rules and regulations, that they do feel that this is quite justifiable, to tie this into civil defense although there is no such net except a net started in Kansas City and which seems to be working very well and serving as a prototype for the nation as a whole and they feel it is justified in any area. It is open to any hospital, any hospital group that is open on a 24-hour patient service. The Federal government feels that matching funds should be applied toward this and it would fall in the Civil Defense capacity of transmitting directly to these hospitals in time of emergencies. The only stipulation was that if Civil De- fense enters into this, the base station or remote on this net, be at the Civil Defense office, The City would assume responsi- bility of title holder for the net through the Civil Defense Office and make sure the equipment is kept in West Covina, The Kansas City hospital use is more extensive and they have only started the pro- gram, There is no guarantee you will get money allocated but,we feel it should be applied for and the decision awaited, Councilman Snyder: I still have to question the wisdom in Federal Funds for something''which in the'iong run is being used Civil is Defense wise, possibly only once -a year for the annual drill and the rest of the time it would be mostly used by private parties. Councilman Towner asked'if this would be approved and money alloca- ted, who inspects to see it is -'-,available to us at all times, Mr. Aiassa indicated this would be tied in with Civil Defense commun- ications and they must relinguish those units to us, -16- C. Defense agents as a re - Mr. Aiassa stated that we probably would want to intergrate as much as possible outside help as we can through this installation, Mayor Heath stated that this would not cost the City anything, al- though it will cost us through the Federal Government but that if we do not take advantage of it somebody else will, However, Council- man Barnes felt this is an attitude everyone should be careful.of, 'if we do not take,it somebody else will' and that we should stop to think of matching funds by the Federal government because people get to thinking it as something free whereas as it is not free, it is the money of the people of this Country and everybody takes, thinking they are getting something free and we are not, But, Mayor Heath stated, everybody who takes this attitude is going to take it. However, Councilman Snyder indicated, if the.government starts to become irresponsible then it is up to .the citizens to be- come more responsible, and I am not convinced this is necessary, Councilman Towner asked that assuming this program is installed and is made available, of what use and advantage will it be to the City except on the once a year drill? Mrs. Boschoff stated that outside of the regular drill it would be available in case of any natural disasters, epidemics or something that would need direct response • and we could have doctors with these radios sent directly to a hos- pital and immediately. Also in the event of an attack, these doc- tors would be called in immediately. Whether they are with the car at .the time would. not.:conc6rh.-us.-but. that .we .have the car, the radio and some responsible person with it. It is felt that this is a medical service long neglected and now with this being brought for- ward by Dr. Mintz, these doctors can step forward and help and you have a radio net to fall back on as you have no other contact ex- cept by telephone and if that should fail, probably help would be greatly delayed in getting to the people fast enough. Councilman Barnes asked if there were any other hospitals being qualified for this and Mrs. Boschoff indicated that there are two other doctors working on this and it has been suggested that each doctor get busy in his local government and see about setting up these nets. Councilman Barnes asked how many units were being asked for - would it be possibly one unit in each hospital and Mrs. Boschoff stated this.will probably be done because as other hospitals add to this they cannot have a single frequency, they will all go on or be added to this frequency and it would not distrub police, fire or local government frequencies as this would be set aside for special ser- vice by the FCC. . Councilman Towner asked that if Inter -Community wanted up would this be on the West Covina Civil Defense band band and Mrs. Boschoff indicated it would be the same but they could not obtain help through West Covina. to set this or another frequency -17- Co C. 1-22-62 LARK ELLEN HOSPITAL -RADIO - Continued Page Eighteen Mr. Aiassa stated that perhaps the Queen of the Valley Hospital might be an interested hospital and Councilman Barnes felt that • it would be more beneficial if all hospitals in the City could be tied in together on this. Mr. Aiassa then suggested this application be permitted to be applied for and perhaps Mrs. Bos- choff make a summary of what could be done with regard to City hospitals in tying them together on this. Councilman Barnes a base station at 14 or 15 mobiles, Councilman Snyder: asked how many units and Mrs. Boschoff indicated the hospital, a remote at the Civil Defense and communicating, they would munication should be with in a car. I still can't Mayor Heath: I am no expert on this but it is my impression that in the event of disaster, doctors would not be out be at the hospital and the matter of com- somebody else and not a group of doctors conceive of how they would operate. If these doctors have enough interest and.desire..to match $7,000.00 at so much a month it certainly would be an asset to the City and-mo detriment and I can't see all this discussion, Councilman Barnes: It seems we are talking about 14 or 15 mobile units for this hospital and if you have others come in for • the --same amount you are then talking about some 45 units and if you are talking of spending matching funds by government partici- pation, this is not going to be inexpensive. Councilman Towner asked for a brief statement from Dr. Mintz as to how these units would be used, Dr. Mintz stated it would be radio communication between the doctors and their every day work and being available at that time. It is also hoped to expand their civil de- fense program which has not been active by putting other doctors to it. It was indicated that they had a civil defense interest and that there has been a 100 :bed;: field hospital in storage for many months, and this is equipment that the civil defense people are interested in and not necessarily the doctors, per se. However, the doctor uses this equipment in his practical course of work with the hospital every day. He is responsible for keeping the equipment in working order, and the communications system requires a base station at the hospital as well as at civil defense. Dr. Xintz also indicated this wasn't only a matter of matching funds, but also the amount of work that must, -go into this to meet the re- qu�rements of the government such as emergency generators to assure power, and of a certain size and requirement among other things. Councilman Barnes asked it it had been stated these Motorolas.wonld be maintained or taken care of by the doctors and Dr. Mintz indi- cated it would be up to the hospital to maintain them but the doc- tors would be charged the actual cost of use of equipment, Councilman Towner: It is difficult for me, not being that well versed in civil defense activities, as to just how the use of this would operate to the benefit to the City in the event of disaster. I would agree -that getting in contact with doctors is important but I am wondering if this is the best way to do it. Most doctors are not active in their cars in the event of an emer- gency although maybe we would want them there to send them from place to place but I haven't heard it explained that way, -18- 0 Ob 0 C. Co 1-22-62 LARK ELLEN HOSPITAL -RADIO - Continued Councilman Barnes: Mr. Aiassa: Councilman Towner: Mr. Aiassa: Page Nineteen Being realistic about this I could see a base radio at the hospital and also at the Civil Defense buil- ding but I can't see the 15 units use in cars. If anything happened at the central station we could immediately mobilize these units, commandeer their cars. If that is so then perhaps the City would stand to benefit and on that basis I would go along with the rec- ommendations to permit an application to be placed to the Federal govern- ment for matching funds. With the condition they comply with all our Civil Defense program. Motion by Councilman Towner, seconded by Councilman Barnes, and car- ried, that the request for matching funds of the Lark Ellen Hospital for Civil Defense radio use be approved, subject to the condition that in the event the funds are received and installation made, it be subject to regulations of our own City Civil Defense program; Councilman Snyder voting 'no'. HANIFAN PROPERTY (Flood Control) Establishing minimum sales value for parcels to be taken by Los Angeles Flood Control District. Motion by Councilman Towner, seconded by Councilman Barnes, and carried, that the City Manager be authorized to negotiate further with the flood control on the property they want to take for chan- nel widening of the Hanifan property. NEW STREET SIGNS The following is a report from Mr. Thomas J. Dosh, dated January 17, 1962 to be place in the Minutes as directed to the City Manager: "Some months ago I submitted a list to you of street name signs that have been reflectorized with Scotch Lite. This was done on an experimental basis at the following locations: Vincent Avenue and Walnut Creek Parkway Vincent Avenue and Workman Avenue (N. W. Corner) Pima Avenue and Vine Avenue (N. W. corner) Pima Avenue and Cameron Avenue (S. E. corner) Campana Flores Drive and Cortez Street (West) Campana Flores Drive and Cortez Street (East) "I would appreciate it,if we could receive a comment from the City Council or Planning Commission, pro or con, to determine the de- sirability of such street name signs for the City of West Covina. As I mentioned previously, to you, comparative costs are not a great factor since there is not very much to choose between the two methods. The initial cost is slightly cheaper and their use is 5 to 10 years maximum. It was indicated ,this is to be reviewed and the matter again pre- sented at the Council meeting of February 13. It is my understanding that this is under the sole discretion of the Treasurer and the City Council has no control of where money is deposited. Mr, Aiassa: Mayor Heath: Councilman Snyder: That is correct. There has been previous action to deposit in West Covina banks and I believe this was done, Who decides time deposits? Councilman Towner: The City Treasurer does an excellent job but possibly there are areas where the money could be earning more relative to idle funds, and another thing, there is a very large benefit to United California Bank as to other banks within the City and I am not entirely sure this is necessary for City purposes. I am not indicating anything wrong but possibly to spread this on a more favorable basis. Mr, Aiassa: We have money deposited in all our banks, When I first came with the • City most of it was in Covina banks and we have those deposits here in the City now, I will have a meeting with Mrs. Merry and give it another review. We have cer- tain checking accounts on which warrants are drawn and we need a certain reserve. A lot of banks are dubious of time deposits be'' cause by law they must put up collateral and there is the incon- venience of a short time deposit where they have to cover money we deposit with them, Councilman Towner:. Is it, -possible for the City to buy short term government Bonds and get a greater rate of return than time deposit? -21- C. We have run into some difficulty in that Mr. Dugan could not be re- employed and the City personnel thought he could be. It would be all right if he worked say for the City of Covina but he cannot work for the City who is paying him his retirement money. I would like to extend his retirement for at least 30 days longer in order to research this more and have a meeting with Mr, Dugan, • Mayor. Heath asked if the City could contract with Mr. Dugan and Mr. Williams indicated possibly if he is operating a janitorial service business and provides his own materils, supplies, equipment, etc,, but if it is just a subterfuge to employ him, you can't. -22- Co Co 1-22-62 Page Twenty -Three RETIREMENT -MR, DUGAN - Continued Councilman Towner stated that he felt the key is whether or not there could be control of his work and that he could not see working • as a janitor in a building without somebody in authority telling him where to push the broom, Councilman Barnes indicated that you can still control a man as a contractor, But Mr. Williams stated that a contractor doesn't have to perform the work himself but it is his duty to hire people that are his employees although possibly this might be almost impractical as to.accomplishment. BID FOR HANIFAN PROPERTY Mr. Aiassa stated that he would like authorization from Council to place the Hanifan property up for bide However, there is only one catch in that whatever'we set with the flood control we se't_minimum price on the property value and the minimum appraisal is between $1.50 to $1.75 a square foot, Mr. Aiassa indicated he was inclined to stay with the $15� sure foot although we have had a very recent parcel, less than two months, which raises it up to approximately $2.00. I would recommend, said Mr. Aiassa, standing on the $1.50 unless Council feels it might be better to wait until we get an analysis relative to flood control and perhaps raise it. . It was consensus.to hold this until the analysis of flood control is presented. Motion by Councilman Barnes, seconded by Councilman Snyder, and carried, this application be approved, MAYOR'S REPORTS LEAGUE OF WOMEN VOTERS COUNCIL COMMITTEE REPORTS League of Women Voters Meeting February 1, 1962 at 7:30 at the West Covina High School Cafetorium concerning the General Plan, Councilman Snyder: Concerning the library, at a recent regional meeting of all the regional Chairman in Los Angeles, different methods of spreading the tax within the region and through the Coun- ty was explored. These were merely trial balloons of different ways. w Hoever, Plan C, when it is read, would appear to be the most bene- ficial to the City, money -wises -27- C. Councilman Adams RESOLUTION EXPRESSING The City Clerk was instructed to APPRECIATION FOR SERVICES prepare a resolution, RENDERED TO THE CITY BY MRS. VENETIA L. MCKENZIE ORAL COMMENTS Mrs. Van Dame asked if swimming pools were to be placed on the April election ballot or is the matter to wait until November and it was the opinion of Mayor Heath, and also seemed to be the opinion of the rest of Council, that insofar as what had previously been attemp- ted in the City regarding pools that the matter is and will be dead for some time to come, and that it had been pretty well cited by Council that it would be the policy of 'pay-as-you-go' on park • developments, Mrs, Van Dame stated she did not know why Council should feel they have to wait for the opinion of the League of Women Voters to tell Council it was entitled to a:_rAise:'.in..salary, when it is due Council. However, Councilman Snyder felt that Council wanted some expression of the thinking of the people on this and Councilman Towner stated he was not sure, in his own mind, that more money is either necessary or desirable and just so long as Council members do not have to pay everything out of pocket it is about the most Council could ask, However, Mrs. Van Dgme felt that Council is still entitled to more money and Councilman Snyder made the' -facetious remark that"we cant pay enough to encourage higher caliber people and $50.00 more isn't going to do it, Mrs. Van Dame asked why it is that people have so much difficulty in getting a doctor in an emergency and Mayor Heath stated he didn't know why that is and Councilman Snyder indicated that in the yellow pages of the phone book there is listed M.D.s for emergency service. Mr, Douglas Launer. I have some questions here I would like an answer for before I feel • that I am ready to vote on the issue this month, • The first one,is, how can Council guarantee that the precise plan will be enforced on this Zody°s Discount House since we have never had a precise plan court action and if the developer deviates, what guarantee is there they will be prosecuted? Mayor Heath: As a former member of the Planning Commission I believe you have know- ledge of the fact that Council has certain orders in conjunction with precise plans and that we have Mr. Stanford, a special City Officer, who is continually checking on these developments, to see that the plan is followed. He actually -28- Co C. 1-22-62 Page Twenty -Nine ORAL COMMENTS - Continued Mayor Heath - Continued • prosecutes these evaders and just recently Mr. Eichstaedt was taken before the District Attorney in violation of his precise plan. Further, we are getting continuous reports from Mr. Stan- ford every couple of weeks, of plans he has gone through and seen that they are brought up-to-date, and if not, he and Mr. Williams, issue an order and it is taken before the District Attorney. Mr, Launer: The reason I ask this is that Scoa relocated their garden shop and then came in for an amendment. This discount house is the same type of operation and how do you know it won't happen here, too? • Councilman Towner: Councilman Snyder: Councilman Barnes: Mayor Heath: Mr, Launer: However, another example of enforce- ment is the South Hill Realty prop- erty where we had a wall torn down which was in violation of the plan submitted. We could have prosecuted Scoa but it was discussed and it was decided to go along with it. We have a plan checker now which we did not have before, After they have done something and then ask for a variance there is no guarantee they will get it. But the one matter was not viola- tion of a plan but of the building code. It was indicated it was a violation of the plan, Mr, Launer.:` The next question is in regard to the location of shopping facilities in the City. According to the planning consultant the southeast section of the City is lacking in such facilities and what provisions have been made to service that area? Mayor Heath: I do not know if we have any final recommendations -as yet. Councilman Snyder; I do not think we have had any re- quest to be serviced from that area. Councilman Towner: There are entirely different circum- stances between the two areas as -to the immediate existing character of property and areas involved. Mr, Launer: That is true, the area of Zody°s is more than dequa`tely serviced and I am surprised there was no request from the southeast area of the City, if you. -go by waiting for a re- quest to be serviced from the home owners. • 0 C. C. 1-22-62 ORAL COMMENTS - Continued Mayor Heath: Councilman Snyder: Councilman Towner: Page Thirty I think the statement was meant in that no one has requested to obtain zoning in that area. To me, Raplh°s demonstrated clearly before the Council that they had questioned people in that area and it was said they would use such a store when that question was asked of them. You are comparing apples and eggs when.you compare north Azusa Avenue and the southeastern section of the City. Mr. Launer: What is the expense for traffic control, assuming that with a dis- count house operation you will have to from time to time have a police officer there, and car, at Azusa and Puente Avenues. Mayor Heath: I do not know that we will have that at all. You take Von°s at Glendora and is there any other market in this City where we have to have a policeman stationed from time to time? Mr. Launer: There has been no expense contem- plated, then, for traffic patrols of any kind here? Mr. Aiassa: Other than what is normally provided. Councilman Snyder: There is a light already there. Mr. Launer: It may not be adequate. Councilman Snyder: Have we needed traffic control at Scoa? Mr. Aiassa: No. Councilman Towner: At Akron? Mr.. Aiassa: No. Except the right turn off with a signal at their expense. kr.:Launer: We had a traffic problem at Akron at one time because of people tkaveling north- Zody°s uses three=quarter of this other area and I do not think you can hide behind Ralphs. Councilman Towner: We have all been speaking of traffic circulation and this is similar to Akron and we have no question.about traffic control there now. -30- • C. C. 1-22-62 Page Thirty -One ORAL COMMENTS - Continued Mr. Launer: What provisions of cooperation has been made with any neighboring communities insofar as the commer- cial needs are concerned? Is there any joint meetings with neigh- boring cities to speak of commercial needs so as not to try to cut someone else's throat? Councilman Towner: Covina had their plan made by the same consultant that we have had and no doubt there was an over all look. Councilman Snyder: I think it is an established policy that Council is not in the position to dabble into economic need but we have to allow people to compete and not constrict, compete, and I can't see how you can plan something like this between cities. Mayor Heath: Covina has certainly put no curb, nor cooperation, relative to com- mercial. They have put White Front, Morels, WonderFair and would put more than that on our City borders if they could. Councilman Barnes: There is also Gemco to the south. • Mr. Launer: This establishes a needind" . I am wondering what steps have been or could be taken in the direction of cooperation because we do not want any cities in here which would be overzoned fighting one another in commercial enterprises because we could be hurting all the way down the line, even if it isn't us, and without some coordination of effort we can, or some others could, end up in pretty sad shape. Councilman Snyder: Mr. Launer: Councilman Snyder: Mr. Launer: Councilman Snyder: • Mr. Launer: Councilman Snyder: You suggest metropolitan government? No. How would you propose, then, to do.this? I am asking if anything has been done in this direction? We have the Regional Planning Com- mission, the East San Gabriel Plan- ning Commission and I do not know how we can coordinate the compeii- tion of different stores. There is a need in the valley for a maximum number of certain types of use and possibly it could be through coordinated effort. You do not think any of this should be on a competitive basis? -31- • Co Co 1-22-62 ORAL COMMENTS — Continued Page Thirty -Two Councilman Towner: So far as the City Council is con- cerned in making decisions,we have evidence there is a need in this area for this operation and which is not serviced within the City and from our standpoint, and those -4r.e.siding: in the area, there was a reasonable solution to it. Mr. Launer: Being near the area I know there was no request for such an enter- prise, Councilman Barnes: If we intend to have West Covina be the lead City in cultural and com- mercial and governmental uses, which our preamble states, it is good to have good operations come into this City. Possibly business doesn't always go where you want to place it but then we never thought of the May Company as being in Eastland but they did it because they felt it was economically feasible and it was and has been an asset to the City. Mr, Launer: You feel that spotting super -markets and discount houses in saturated area is good? Councilman Towner: It isn't our determiningso That this is not a saturated area has been indicated in that there was a need for it in the area and it was presented in evidence at the time it came before us, Mr, Launer: Within the City, but should we draw from other cities, and then they.go broke, by establishing 15 stores at the boundary of some other city. As a taxpayer and not being a signer'of the petitions for this ref- erendum I would like to state that I certainly object to the expen- diture at this time when you have a municipal election coming up in April and it is money coming out of my pocket, Councilman Towner: It is coming out of my pocket too, and you might state your objection to those people who wanted this referendum, Mr. Launer: Councilman Barnes: Mr. Launer: But it could have been combined in April. It would still have been spending money. But not as much in that there would have had to be no special polling places, etc., if carried on the April ballot, In fact I have now heard remarks of the area north of the freeway referred to as West Coneyvilleo Councilman Towner: Not by anybody on Council, -32- C.
