VEHICLE PURCHASE Bids received as advertised at HELD OVER TO NEXT 10:00 A.M. December 21, 1961.in REGULAR MEETING the office of the City Clerk and referred to the Finance Depart- ment for recommendation to the City Council at this meeting. The City Clerk stated that the Division of Finance has requested this matter be held over pending the return of the City Manager from his vacation. -5- Co C. 12-26-61 VEHICLE PURCHASE - Continued Page Six Councilman Barnes stated that three bids had been received. One, Leo Huffman Chevrolet, did not post a bid bond and Mr. Barnes • questioned if this was legal. The Councilman also felt it was important to possibly have more bidders than this and that he did not see any Ford bids included here. Mayor Heath asked that if Council feels they want to discard these bids, could they do so if they saw fit and Mr. Williams indicated that there is no requirement to advertise at all for purchase of vehicles under the State law but only under the City Purchasing Ordinance. Council has the power to waive competitive bidding un- der the ordinance and therefore Council could waive any formality it desired and do as it would wish. This is not a construction project.so there is no State law requiring advertising, Mayor Heath asked if there isn't any bid bond received does that void the bid and Mr. Williams indicated that Council can waive that formality inasmuch as Council can waive bids altogether. But it is a question of fairness more than anything else or else have it held over to have missing bond supplied if it is desired. Councilman Barnes indicated bids had been taken for sedans and sta- tion wagons and since the Fire Chief was present he perhaps could explain why both types were bid. Chief Wetherbee stated that from time to time the Fire Department, by necessity, has to have some type of ambulance service available. During the past three years the rescue u%it had been used for ambulance service and it is felt • that the citizens should have a reasonable secondary ambulance ser- vice. With a station wagon it would be possible to place a stretcher in the back and a Battalion Chief would be available at all times for this unit and supervision of it, So on the basis of the station wa- gon, it would supply two services. It is hoped that the Council will look favorably on the station wagon because of the need of our growing population and in that we are both required and requested by the Po- lice Department to be at the emergency scene with some type of am- bulance service. Councilman Barnes asked if the station wagon could be used as a-G�,J,t line vehicle and the Fire Chief stated yes, responding to all Fire Department emergencies. Instead of having a stretcher that has to be tied down in the Rescue Truck, a station wagon stretcher could be in a more appropriate position to be quickly utilized. Councilman Barnes stated that if we could get additional bids it was. his feeling that this should be done. He did not necessarily mean that the present bids should be rejected but additional bids sub- mitted, although perhaps this is something that could not be donee Mr. Williams asked if the bids had been made public and the City Clerk indicated they had not and then Mr. Williams indicated, that relative to Councilman Barnes' suggestion, it possibly could be done but it might seem a bit unfair to have opened these bids and then get • others. HEARINGS DISTRICT A'11-59-1 Hearing of protests or objections SANITARY SEWER DISTRICT against the confirmation of assess- ments to cover the installation of sanitary sewers in Merced -Willow Avenue Sewer District. Set for hearing this date in the "Notice of Filing Assessment and Diagram" dated December-�5, 1961. -6- Co Co 12-26-61 DISTRICT A111-59-1 - Continued Page Seven Mayor Heath stated that this was the time and place for the hearing of protests or objections against the assessment for improvements • of Merced and Willow Avenue and the other streets in the City of West Covina and asked if the City Clerk had the affidavits of Pub- lication, Posting amd Mailing relative to this hearing, City Clerk, Mr. Flotten: We have the affidavits. Mayor Heath: I will entertain a motion the affidavits be accepted and filed. Motion by Councilman Barnes, seconded by Councilman Towner, and car- ried that the affidavits of Publication, Posting and Mailing be re- ceived and filed. Mayor Heath: City Clerk, Mr. Flotten: Mr. City Clerk, have we received any written protests? We have received seven written protests. (A member of the au- dience presented a written protest which was received by the City Clerk for the record.) Mr. Rosetti indicated that it has been the usual procedure for the Engineering Department of this City to indicate an estimated cost when proceedings are instituted and to estimate the amount as low • as possible based on previous experience with such bids. Up to this particular time the estimates have been very close to the bids re- ceived whereas this one, the lowest bid came in 5% higher than the estimate so the cost was something like $5.80 or $5.90 per front foot when this first appeared whereas now it is about $6.30 per foot and the reason was the high bid on the unit cost. Mr. Williams indicated the bid of a certain sum for this project, which is now completed, was known to be some 5% higher and that this is not the matter before Council. Since a bid is permitted to go to 10% higher and be acceptable without re -advertising, this was in line. The thing before Council is a matter of a question of fairness and equity in spreading of the cost but the amount of the cost is already past and there is nothing that can be done about that. A member of the audience brought up the matter of being made to pay a "reallocation fee" when he hooked up, as he termed it, and that it had been his understanding that in the past the City has assimi- lated that fee out of the taxpayers money but that in this project the landowner was charged. This matter was then discussed by. Council, Mr, Russell and Mr. Rosetti and correctly indicated as a reimbursement agreements It was indi- cated the City had made a contribution here towards the cost of the project, (over -sized pipe) but this district is not paying for the extra pipe as the City is making the contribution to take care of that, Mr. Williams further clarified the matter by indicating that previously this amount had been added to the assessment making that amount larger and the only difference between what has been formerly done, and what is now presently being done, was that in including it in the assessment it could be paid.over a period of 10 years, but now it is paid in a lump sumo The total amount paid is no different under either system. It was indicated that the Courts had ruled that this was not proper incidental expenses and could not be in- cluded in the assessment, as such, under the 1911 Act although the practice as to reimbursement as such has no question attached to it -7- Co C. 12-26-61 Page Eight DISTRICT A°11-59-1 - Continued as to its perfect legality. As to any loss to the City, caused by people not hooking up, it was indicated it would be very little, if any, because eventually everybody and every use will have to hook up to a sewer line and the City will be reimbursed over a period of time. However, there were also some which contained the matter of debris left, pavement jagged and uneven and a deep dip which now holds run water and doesn't run off as before this project went in, apparent raising of level of street. A member of audience indicated he was not going to pay his assessment, until something was done about a 12-foot deep hole, 8-feet long in the City's parkway on his property and underneath the curb you can see this hole, it is just a void. As to the water problem indicated in some of the written protests it appeared that the majority in the audience indicated this had now occurred along Willow Avenue between Merced and Garvey, on both sides. Mr. Netzley one of the attorneys representing Mr. Neff appeared to be satisfied with the explanation of Mr. Rosetti as to the assessment on the lots involved, #29 and #30 - assessments #338 and #339, which was indicated as being 80-feet on°each lot, even though there was 139 and 135 feet in back, respectively, and 42-feet in front. The matter of who was to pay the assessment since a bid was to be accep- ted on this property, was not a matter before Council, and it was indicated that apparently notice of such an assessment and work being forthcoming might have been received prior. It was indicated by Council that the bond still being held should continue to be held to ensure this project being completely satis- factory generally and specifically as to the particular detriments brought out in protest. Councilman Barnes indicating "that possibly two weeks will not even be sufficient and perhaps it should be held for some time." • • Ca Co 12-26-61 DISTRICT A'11-59-1 - Continued Page Nine Owners were to report in two weeks, if the necessary work is to be done or not, to City Clerk. Since there were so many remarks as to the amount of cost that had been quoted by staff to these people involved, in the future, the result of this should perhaps be taken into account and when approached for such information that is not actually available but based on es- timate in relation to other projects it might be well to indicate a wide figure from the least to the highest possible cost. There being no further protests, Mayor Heath closed the hearing. Motion by Councilman Towner, seconded by Councilman Snyder, and car- ried, that the protests be overruled. ZONE CHANGE NO. 204 LOCATION: Garvey Avenue, between (James Jo Santiago) APPROVED Azusa and Baymar Avenues. Request to reclassify from zone R-A to zone R-3 approved by Planning Commission Resolution No. 1128. Hearing closed December 11, 1961, held over for decision to this date. Comments of the Council were stated in that Councilman Towner felt that although Mr. Shatz has indicated he is not in favor of R-3 along the freeway, but has indicated a,highway-commercial along there, this would be less heavy use and possibly would be a better use'arid he would be in favor; Mayor Heath indicated he was not in favor of R-3 along the freeway particularly and Councilman Snyder stated that he didn't understand the thinking of highway -commercial along the freeway as the freeway isn't a highway and doesn't serve this area or area back of the fence, it is a separate entity and that this is something that has been argued against in the old Center with the feeling it is all wrong and now there is suggestion for highway -commercial along the freeways MR Ca Co 12-26-61 Page Ten ZONE CHANGE NO. 204 - Continued The applicant indicated that in the matter of R-3a or 3b he couldn't build a motel under that and maybe R-3 isn't what they wanted, then. • But Mr. Williams indicated this would have to be R-3, that was set for hearing, although some features of a or b might be imposed at the time of the precise plan. OF DECEMBER 20, 1961 REVIEWED -10- Co Ca 12-26-61 Page Eleven RECREATION AND PARKS REPORT RELATIVE TO Motion by Councilman Barnes, TEEN-KAN-TEEN PROJECT seconded by Councilman Adams, • and carried, that the Mayor be authorized to write'a letter to Mr. Van Huppert stating that Council has studied the report and that it appears to be the consensus that it is a satisfactory approach toward the completion of the building, 40 Councilman Snyder to breakfast with Rev. Gunn, and others, December 27. Councilman Adams to act on behalf of the City to welcome the football team from Alpha, New Jersey relative to the Junior Rose Bowl to be held, and present key to the City. GENERAL MATTERS ORAL COMMUNICATIONS Mrs. M. Van Dame: Councilman Snyder: Since Sheriff Pitchess is making such an issue about keeping lights on at night in homes when the owner is absent, can't West Covina do something about more lighting in the City? I agree we need lights but what do we do next, streets, sidewalks, lights? Mr. Dosh: We have spent $27,OOO.00 on lighting without assessment against the people. We have in- stalled lights each year in key locations wherever a serious problem is that may be assessed, other than that we must wait for development to go in, subdivision or commercial. We are not soliciting petitions for lights for sidewalks. Mayor Heath: Maybe the people do not know they have to petition for lights. Mr. Dosh: I can get out a couple of former reports prepared on this item. Mayor Heath: This' is possibly something the newspapers should be aware of and place in the paper relative to the fact that the initiation of this light installation must come from the home owners and they must pay for it. Councilman Barnes: Maybe Mr.. Dosh can give this re- port to the newspaper. No objections Endorsing the location of the County Court House, East Branch, in the City of West Covina Councilman Towner suggested the forwarding of the resolution to Mr. Cowen for copies made for use in Court Report and forwarded to Board of Supervisors and Judges committee. LETTER FROM In essence this letter indicated RALPH VEGA that this gentleman was quite tired of Covina being confused with West Covina and that if there was anything he could do to help with publicity so that West Covina is not confused with Covina and gets its proper credit and relationship as a separate City established he would be more than glad to do so. • It appeared to be the consensus that this offer should, in some way if possible, be utilized. There was also an indication from Council- man Barnes relative to some freeway signs indicating Covina as a mile to the north. There was also some discussion on the possibility of changing the name of this City and to find out the costs. and possible problems involved in doing so. CIVIL DEFENSE MEMORANDUM From Cleo Boschoff Consideration of four items; building code to be used, master plan, joint use of school property and assessment under 1911 Act. Councilman Snyder: I think all her points are well taken. We have been arguing this and we do need a master plan. It makes sense to have a minimum set of standards. Mr'o Dosh: We haven't adopted our own stan- dards, up to this time we have been using O.C.D.M. and County standards, as to building code. Councilman Snyder: An ordinance gives more protection against anyone who might take ad - is vantage of a person in building these fall -out shelters. -14- • Co C o 12-26-61 Page Fifteen CIVIL DEFENSE MEMORANDUM - Continued Mr. Williams. I'feel the -correct approach is that the State provide leader- ship with the specifics recom- •mended by people who knour°.what they are doing so cities can adopt their own procedures. But any time you ask the State to pass'a law for City use you are sacrificing your own power to decide where these might go and how. There is very little in the building code that needs changing. There are possibly a few requirements such as windows, venti- lation, the number of people per square feet and along these lines there possibly could be changes, but you run into the problem in that people are building fall -out shelters which are really rumpus rooms and in drafting dimensions there should be requirements of no dual use, but for exculsive use as shelters As to the 1911 Act, it was amended, but they did not amend the part which says the cost of the project shall be assessed to the property in proportion to benefit to property. Just what is that benefit? It is a benefit to people not property and it requires this amendment before the thing as it is now workable. Councilman Snyder: That is true but I still feel we should not run to the State to ask them to change their building code but that we should adopt our own ordinance or continue study on it. Mr. Williams: We are working on it now. Mr. Dosh: We are not only talking about home shelters but also community shel- ters relative to school sites. Although we have not discussed this matter too much, we are presently concerned with home shelters which we are trying to establish standards for. Councilman Snyder: I think a master plan is important if we get another rush as we had before we are still going to be un- prepared unless we have a master plan and is also the first step in community construction. Mayor Heath: By State or City? Councilman Snyder: City. Councilman Towner: The master plan is, to a large extent, determined by whether we want home or community shelters and in'the community shelter, it is where do we want them and this sort'of thing to my mind needs guidance. It would seem what is necessary is guidance and study and not legis- lative action at this time. Councilman Barnes: I believe there should be guidance and a study made, something for' cities to follow and possibly some coordinated effort between Federal and State Governme.nt.to:'..get.some- thing Concrete for cities to follow. A motion by Councilman Towner, that the City Clerk be directed to draft a petition to the Governor to call a special session to consider just the 1911 improvement act to clarify the means for spreading the assess- ment for fall -out shelter construction, failed for a lack of a second. It was the general consensus that there shall be local control over any shelter construction program and that we are not, at this time, sufficiently informed by defense authorities, State and Federal, as to what is feasible and reasonable. All memebers of Council agreed with this consensus as stated by Councilman Towner, and it was also indicated no public session on • all four counts. LEAGUE OF CALIFORNIA Sacramento - February 1 and 2, CITIES MEETING 1962. Councilman Snyder authorization to attend. In the beginning of this discussion it appeared that members of Coun- cil were in favor of the City Attorney representing the City at this meeting in view of his knowledge and his expression of his ideas on this subject of metropolitan government coinciding with that of Coun- cil. However, Mayor Heath felt that it should be someone from Coun- cil, or the City Manager, in that Mr. Williams possibly did not know entirely the feelings of Council on this matter, particularly if it might involve general discussion and not just a precise statement, and in that there had been occasions when Mr „Williams had been some- what criticized for giving other than what one might term opinions he was now being indicated to give advice and expressions of Council in this matter, which was possibly not being fair to him. Motion by Councilman Towner, seconded by Councilman Barnes, that i Councilman Snyder be authorized to attend this meeting in Sacramento and explain the policy of the City Council on the subject of metro-politan government. Motion passed on roll call as follows: Ayes:: Councilmen Adams, Towner, Barnes, Mayor Heath Noes: None Absent: None Abstaining - Councilman Snyder. -16- ra a Co Co 12-26-61 Page Seventeen SPECIAL ELECTION Re: Obtaining public reaction to fall -out shelters - Supervisor Hahne isCouncilman Snyder indicated that it was thought the public was not informed enough at this time to vote on this and that it shouldn't be put on any early ballot, although possibly if in their judgement this should be done it might go on the general election ballot. TREASURER'S REPORT November, 1961, Motion by Councilman Towner, seconded by Councilman Barnes, and car- ried, that the Treasurer's Report for November, 1961 be accepted and filed for the record. Councilman Barnes: CAMERON AVENUE REPORT Mr, Dosh made a report on Cameron Avenue, and I think all of Council should receive copies. This is in front of the development at the corner of Valinda and Cameron and will cost the subdivider $3500.00 and the City $11,OOO.00 to correct the street in that area. In many other cases we have lowered the street .n a program of this type and corrected these flood hazards in dif- ferent districts and I think this should be done. He included, if done on an over all program from Azusa to Glendora, the cost of $98,000.00 and we could possibly get this from Traffic Safety Funds or from in lieu of gas tax funds. I think that possibly we should correct this while we can get a savings to the City. It was stated that later it would probably cost the City more money and I would see • no reason for putting in a street at a cost of $3500.00 to the sub- divider than in a year the City re -do this at an additional cost. I think we can get this money from someplace and I think we Should do it. Mr. Dosh: Money is not budgeted for this in order to do it would take money from someplace else. We have done this in every case where we had only the center of the street to lower. In this case we have the center of the street and the other side al- ready paved, so you take out the center and north side and in many cases like this it is given up assuming we could come back in 10 years and do it right. However, I am not necessarily in favor of the larger program as we could put 100,000o00.dollars to possibly better use in streets at this time, Councilman Barnes: Are we going to solve the flood control in that area? Mr. Dosh: This would help in the immediate vicinity and the water would stay on Glendora I am sure. No matter what we propose, it would have merit. This was not indicated as a must, but the consideration of a suggestion. Councilman Barnes and Snyder felt there might be some merit in doing this and Councilman Towner also felt this was a favorable idea, particularly in the light, as he remembered it, of a previous plan and what resulted on Azusa Avenue. DEMANDS APPROVED Motion by Councilman Snyder, sec- onded by Councilman Towner, and carried, that Demands in the amount of $127,394.75, as shown on Demand Sheets B-92, C-300 and C-301, be approved. This to include fund transfers in the amount of $82,896.88.
