The Pledge of Allegiance was led by Councilman Barnes with the invocation given by Councilman Towner. ROLL CALL Present: Mayor Heath, Councilmen Brown, Towner, Barnes, Others Present: Mr. George Aiassa, City Manager Mr. Robert Flotten, City Clerk Mr. Harry C. Williams, City Attorney Mr. Thomas Dosh, Public Services Director Mr. Harold Joseph, Planning Director Absent: Councilman Snyder (to 8.-10 P.m.) APPROVAL OF MINUTES November 28, 1960 - Approved as submitted Mayor Heath indicated that he had been led to believe, from information received, that the use of just the -word "Reverend" relative to the invocation as shown on the Agenda was improper usage and that the proper title for a stipulation such as this would be "The Reverend,, etc." He felt that perhaps this was a matter that might be checked into further so that proper usage is shown. CITY CLERK'S REPORTS ACCEPT SEWER FACILITIES District A111-57-8 APPROVED Insurance Company Bond No. 35 days from acceptance. LOCATION, Ellen Drive and Rowland Avenue. Accept sewer facilities and release the United Pacific B-72920 in the amount of $37,105.89, The City Clerk stated that the Inspector's Final Report had been signed by Mr. Pontow, Mr. Lathrop, and Mr. Burton with the recom- mendation to accept these facilities. Motion by Councilman Barnes, seconded by Councilman Towner, and carried., that sewer facilities in District A111-57-8 be accepted and authorization given for the release of United Pacific Insur- ance Company Bond No. B-72920 in the amount of $37,105.89, 35 days from acceptance. SS-6A - Continued The City Clerk stated that the InspectorPs Final Report had been presented on November 18, 1960 and the Notice of Completion had 4111, been presented November 25, 1960 signed by the City Manager and recorded. Mayor Heath indicated that if this is O.I. by everybody we will just go ahead on this and Councilman Brown stated that since there had been reference made to proper use on the Agenda, Council should follow through using the Roberts Rules of Order. Mayor Heath stated that the items had been grouped, previously, and questioned as to whether grouping them was any more proper than what has been done here. Councilman Barnes indicated that Councilman Snyder was making a study of this and that "we might continue until we hear his recommendations". He is getting suggestions from the Beverly Hills Council Agenda, trying to expedite these matters and perhaps at that time this matter could be considered. Mayor Heath: Can we shorten them in this manner? City Attorney Williams- You can. Roberts Rules of Orden prevails except where you adopt a contrary proceedings and you are then not compelled to follow those, but you do operate under the Robert Rules of Order 'unless you change them. • Councilman Brown- I think Ordinance No. 502 spells out our operating procedure very carefully. Mayor Heath-. In this case we shouldn't shorten it. How about voting on these in groups? City Attorney Williams- The order may be changed with the consent of the Council body... Roberts Rules of Order. So if there is mutual understanding and agreement as to a short-cut, it is legitimate to do it. But if not agreed to by any one member of the Council the proceeding goes back to the rules of order. Mayor Heath- Shall we take these individually or as a group? Councilman. Towner- We will take t.:+re=.r+ individually tonight, but we and interested in expediting these matters and should do everything we can, if properly done, to do it more rapidly. Motion by Councilman. Cortez', Hollenbeck and Vanderhoof.Drive. We accepted these improvements at your last meeting relative to construction.Before.we,,presented this to you at the last meeting we took another-$2,000:00 bond to assure the resurfacing over some of these streets that we are not too sure of. We felt this was the best way to. assure.,against any problems that we might have in the future. Be'caus.e.we have had so, much trouble with 57-5 we asked for a bond to,a.ssure against: laterals settling or any problems.developing.in this.area.,.and we had problems here prior to completion, so this will take r cae of anything in the twelve months period. Councilman Brown. Would you'feel in some cases he did not have the proper time to compact it?,. Mr. Dosh. We believe he did and-we,did the best we could' to inspect..the job. But he had'certain.things.go. wrong and we surfaced as fast as we dared because it was open to the public and he had so many rough holes, so to assure against any possible trouble we took another bond. Mayor Heath. Hearing no objections; we will waive further reading of 'the body of the resolution;, Motion by Councilman Brown, seconded by Councilman Barnes:,, that said resolution be adopted. Deffenderfer and Son, be authorized. • 0 C_C. 12-12-60 ENGINEER'S REPORT ON SIDEWALKS Tract No. 22669 HELD OVER TO NEXT REGULAR MEETING Page Four LOCATION: South side of Puente Avenue, west of Azusa Avenue. The City Manager stated that Council has received copies of this report and.that he would recommend that this matter be tabled until the next regular meeting for Council to review this report and that, if any, or all, members of Council would be interested in taking a field trip relative to this matter it can be done. Motion by Councilman Barnes, seconded by Councilman Towner, and carried, that the Engineer's Report on Sidewalks be held over to the next regular meeting of Council. REVIEW OF PLANNING December 7, 1960. COMMISSION ACTION The City Clerk presented and re- viewed the action of the matters that had been before the Planning Commission as of December 7, 1960. There were no items requested by Council to come before them. However, there was discussion on the non -conforming sign use granted to the motel near Citrus on the south frontage road and the question arose that since the revised sign ordinance had not, as yet, been adopted, would this variance for the sign be in accordance with the new revision of the sign ordinance. Mr. Joseph stated this had been discussed at the meeting and. :that under the new sign provisions a detached sign can be approved by precise plan with 160 square feet permitted, whereas this request is for 143 square feet and would also be removing two signs presently placed at this property and leaving only this one, recently approved, sign. RECEIVING OF GIFTS FROM Councilman Towner: I think the MEMBERS OF THE PUBLIC City Councilmen should adopt some kind of a policy relative to the receipt of gifts from members of the public, and I am wondering if you present would be interested in a resolution to that effect, or if you would prefer to handle it on your own? For an example, if someone gets a gift i.,arapped package of whiskey from somebody with an application: before the City Council, it is my view that it should be returned. I think this same course should apply to other gifts that may be considered material. There is an area where these things become minimal, such as perhaps a pencil with a man's name on it, but we,should have some agreement on this. Councilman Barnes: I think it is a matter for study. Mayor Heath: Councilman Brown: relative to employees also. However, there is a good point made here. I would go along with Councilman Towner. The City of Downey goes so far as to cover this matter • C . C . 12-12-60 Page Five RECEIVING OF GIFTS FROM MEMBERS OF THE PUBLIC - Continued Mayor Heath: This is good and probably should be done, but with care taken and a study as to where to draw the line. If someone takes a City employee out to luncheon while working with him on some matter or other, is this taboo? Where do you draw the line? Councilman Brown: Councilman Barnes. - Mayor Heath: I think it is a matter to handle in a study session and to go into it in more detail. I feel it should be given a more detailed study, also. We are coming into the holiday season and perhaps should make a policy and if not adopted this year put if off to a study session. Councilman Brown: I do not believe that in the past any employee or member of Council has been influenced by anything given to them, so I would see no reason why this holiday season would be any different. SMayor Heath: Should we set it for next week's study session? It was agreeable this be done. Councilman Towner - Councilman Barnes: However , 1 think in the mean - time that each Councilman should be circumspect about these ti (.oYtl'"sautis'tas gifts, We might have the City Manager obtain a copy of the resolution of the City of Downey. Councilman Towner: I have a number of these reso- • lutions of my own which I obtained out of personal. interest in this activity, and I would be happy to draft a resolution for the Council ifthey desire me to do it. Mayor Heath: City Attorney Williams: Mr. Williams, how do we draw the line legally? Motion by Councilman Towner, seconded by Councilman Brown, that award of the bid on City Project No. C-127 be given to Roy Barnett in the amount of $15,093.00, as the lowest responsible bidder, and all, other bid bonds be returned to the unsuccessful bidders. C. 12-12-60 HEARINGS PROPOSED AMENDMENT NO. 46 City Initiated ADOPTED Page Seven Sign provisions of the West Covina Municipal Code. A portion of Planning Commission Resolution No. 973, and the resolution from the West Covina Chamber of Commerce, was read by the City Clerk. Councilman Snyder entered the Chambers at 8:10 P.M. Mayor Heath stated that this is the time and place for public hearing on this matter and that all those desiring to present testimony should rise and be sworn in by the City Clerk. There being no testimony presented, the hearing was declared closed. Motion by Councilman Brown, seconded by Councilman Barnes, and carried, that Proposed Amendment No. 46, City Initiated, be adopted as recommended by the Planning Commission. Motion by Councilman Towner, seconded by Councilman Snyder, and carried, that the Planning Commission and the Planning Department be commended for their diligent and excellent work in developing the new sign ordinance. HEARING OF PROTESTS OR DISTRICT A111-57-7 Sanitary OBJECTIONS TO THE CONFIRMATION Sewer District. OF ASSESSMENTS Vincent Avenue and Puente Avenue Sewer District. Set for hearing this date in the "Notice of Filing Assessment and Diagram" dated November 9, 1960. Mayor Heath: This is the time and place for hearing protests or objections against the assessment for improvement of Vincent Avenue and other streets in the City of West Covina. Mr. City Clerk, do you have the affidavits of Publication, Posting and Mailing relative to this hearing? City Clerk Flotten: I have the affidavits. Mayor Heath: I will entertain a motion to receive and file the affidavits. Motion by Councilman Barnes, seconded by Councilman Brown, and carried, that the Affidavits of Publication, Posting and Mailing be received and filed. Mayor Heatho Mr. City Clerk, have you received any written protests or objections against the assessment, the im- provement as constructed or the proceedings? C . C . 12-r12-60 Page Eight HEARING OF PROTESTS OR OBJECTION TO THE CONFIRMATION OF ASSESSMENT - Continued City Clerk Flottenm We have one communication, 4 although it may not necessarily be considered as a protest, from a Leander Isbel, dated November 211, 1960. He complains of a misunderstanding as to what the total cost would be to him to put in his sewers. This was answered by Mr. Russell, and signed by Mr. Lathrop, explaining the matter and since that time we have not heard anything further from Mr. Isbell, so we would assume he understands and is satisfied with the clarification made to him. We have nothing else in protest. Mayor Heath. Is there anyone in the audience desiring to speak: on this matter? No comments were forthcoming from the audience. Councilman Brown. time as he withdraws the protest. If he has filed a protest it is a protest no matter how many letters we write until such City Attorney Williams. I haven"t seen this document. The communication from Mr. Isbel was presented and read. Mayor Heath. Is this a protest or a request - for clariy'ication`} City Attorney Williams. it isn't clear that it is a protest. City Clerk Fl.otten„ I think 'that the gentleman, ori.g-- inally, compl.et.e misunderstood this matter as the Letter :indicates that he offers to pay $75.00 a month and under the bond system it would be much Less than that. Councilman Barnes: Mr. Rosetti: The total. estimated cost vias $335.00 for this lot, which is very reasonable so far as I am concerned. Iie has 67 Feet. He is in a cul- de-sac with 109-feet- in the rear and 2,01 plus 1.8-' , which is a WT feet, in front. In a cul-de-sac, the four lots at the end, where it terminates, those four lots are given slightly lower frontage than those or, straight frontage because the main sewer is brougixt up to a point and four laterals lead off from it. You do not have to build the same number of feet of sewer that you have in an area of a straight line. Mayor Heath. `That are the feelings on this? Can it be considered a protest? City Attorney Williams: I am inclined to think not, but treat it as if it were and over- rule it. C . Mayor Heath: Since there are no further pro- tests or objections forthcoming, we will. declare the hearing closed. Motion by Councilman Brown, seconded by Councilman Snyder, and carried, that the protest of Mr. .Leander Isbel be overruled in view of the facts as presented. RESOLUTION NO. 1981 The City Clerk presented: Confirming the Assessment "A RESOLUTION OF THE CITY COUNCIL District A'11-57-7 OF THE CITY OF WEST COVINA CON - ADOPTED FIRMING THE ASSESSMENT FOR TIE IMPROVEMENT OF VINCENT AVENUE AND OTHER STREETS. Mayor Heath: This is the time and place for the hearing of protests or ob- jections against the improvements of California Avenue and other streets in the City of West Covina as described in Resolution of Intention No. 1964. Mr. City Clerk, do we have any written protests or objections received against the proposed improvements? We have received no written protests or objections. Walnut Avenue, West Covina, was sworn I am not here to actually protest these improvements but to find out if you can, at the same time, can get in and out of the driveway I am in favor of sewers, but will you Mayor Heath: I think this is a matter other than relating to the sewers and if you would be kind enough to wait until later, perhaps the City staff might answer your question. This matter is not related to the sewers. Mr. Ashbrook: If you put sewers in, why can't you lower the street at the same time? Mayor Heath: This improvement is done under the 1911 Act on sewers only and the street will be put back in the same condition as it was when dug up for sewers. If there is street work to be done, it would have to be done sep- erately. But this matter before us can be for the sewers only, not street work other than that connected with the sewer. There being no further protests or objections, I will declare the hearing closed. PLANNING COMMISSION TENTATIVE MAP OF TRACT LOCATION: Along the east side NO. 24648 of Yaleton Avenue, north of (E. B. Snoddy Corp.) Puente Avenue. APPROVED 1.95 Acres - 10 Lots - Area District I. Approval recommended by the Planning Commission on December 7, 1960. Motion by Councilman Brown, seconded by Councilman Snyder, and carried, that Tentative Map of Tract No. 24648 be approved, subject to the recommendations of the Planning Commission and City Engineer. DISCUSSION RE. Councilman Snyder: The Planning AREA DISTRICT V Commission would like permission or a directive to begin study on the setting up of an Area District V. Councilman Towner: I think that the drafting of an ordinance relative to provisions for an Area V would be wor,h- while, although we do not have any place to put it yet. Is that right? Councilman Snyder: Councilman Broom: Councilman Snyder: Councilman Towner: Mayor Heath: That is correct. It might be necessary for 158. Yes, but there may be reasons that 158 should be excluded from this study. So far as a study of such an ordinance, it would be a fine thing. I think it would be a good idea to get a study on it so that it can be used if and when we are ever ready to use it. • i C. C. 12-12-6o Page Twelve DISCUSSION RE. AREA DISTRICT V - Continued Motion by Councilman Brown, seconded by Councilman Towner, and carried, that the Planning Commission be instructed to proceed relative to a study on an Area District V. Councilman Snyder: Would this apply to any particu- lar area? Councilman Brown: No, it would apply only at such a time as possible applications arise. Mayor Heath: Do you feel there were any actions of the Planning Commission, rel- ative to applications, that should be called up by Council? Councilman Snyder: There was the non -conforming sign at the motel on the frontage road near Citrus. The Commission recommended the sign but not the sidewalks at this time, as recom- mended by the staff. Do you want sidewalks or would you go along with the Commission recommendation? Councilman Brown: Councilman Barnes: Mayor Heath: City Manager Aiassa: I feel the Commission is right in this instance, if you know where Motel 99 is. What is the staff reasoning for wanting sidewalks here? Isn.'t there a development going in east of this where sidewalks will be required? Is this recommendation made relative to a tie-in here? Mr. Dosh: No, it is that it ties in with the master plan of sidewalks and we would ordinarily recommend that even though there are no sidewalks for a couple of hundred feet. But sidewalks here wouldn't be of much use if they were put in, until some future time. Councilman Snyder: There was the point that if sidewalks were put in and then the freeway widening came along they might only have to be torn out. But there was the possibility of a bond if the widening came in to then put in sidewalks. Mayor Heath: Isn't there a development going in east of this, the insurance group? Mr. Dosh: Mayor Heath: They are in the same area. Are there sidewalks required on that? S C. C. 12-12-6o Mr. Dosh: 00 Councilman Brown: are any curbs and gutters and City Manager Aiassa: Mayor Heath: Page Thirteen Resolution No. 567 of the Planning Commission requires that as approved. However, I think this is a different situation. This is already devel- oped and I do not believe there if not we should ask for that first. for this from a new development Councilman Snyder: There are curbs and gutters although I do not believe they are standard. You have to start these things somewhere and while it is not felt to be needed here, we are asking just east of it. Possibly we could call this one up and take a tour of the area in the meantime. City Attorney Williams: I do not see how you could require sidewalks because of the type of variance. The variance is for a larger sign and what connection is there between granting that sign and requiring sidewalks? You can require conditions on a variance, but they have to relate in some way or other to the variance you are granting. Councilman Snyder: How did sidewalks get into the application? City'Manager Aiassa: According to the master plan of highways and sidewalks this area requires sidewalks so anything the Planning Department recommends would be to conform to the requirements of existing ordinance. Councilman Towner: The sign may be in the sidewalk area and this would have an effect on where the sign is to be. Councilman Snyder: The fact there is a difference of opinion here gives the idea this isn't an ideal situation. Councilman Towner: I would make one point which perhaps indicates why we shouldn't call this up and that is, as I understand it, this variance gives them what they would be able to have, automatically, under the new sign ordinance, so I think that we are stretching it quite a bit to ask for sidewalks when they could get this sign without a variance. Councilman Snyder: That's a point and I didn't think of it in that way. City Manager Aiassa: However, I think that Council should seriously consider this sidewalk master plan. We have a physical map completed showing all existing and non -existing sidewalks. It is rather ambiguous for the staff to recommend sidewalks and the Council realizes there would be only one strip of sidewalk constructed in the middle of a block and then ?,naive • C. C. 12-12-60 City Manager Aiassa (Contd.) in making this recommendation. Councilman Brown: City Attorney Williams: Councilman Snyder: Page Fourteen the sidewalk. But we should make some consistent policy, so the staff doesn't look ridiculous We would probably do it by assessment district, eventually, anyway. The 50% stipulation is in the ordinance now. I just thought that this might have been a good time to "jell" our thinking on this. This item was not called up before Council on their request. RECREATION AND PARKS Mayor Heath: There was an invitation extended to attend the Football Awards Dinner Friday night. I have been notified this was in error, and it is for Thursday night, December 15, at the Edgewood High School Cafetorium. If any member of Council desires to attend, they can notify me or the City Manager. ORAL COMMUNICATIONS - None WRITTEN COMMUNICATIONS LETTER FROM THE EAST SAN GABRIEL VALLEY WATER ASSOCIATION HELD OVER Request for payment of dues in the amount of $100.00 beginning January 1, 1961. Mayor Heath: I have a question concerning these dues since this now has Directors, etc. How far can they commit West Covina? City Attorney Williams: You are not in the district, so they can't commit the City so long as you are not in the district. The hundred dollars we pay to belong to the association is for meetings and information and doesn't bind us to'the district. City Attorney Williams: That is correct. You are not bound by being a member of the association and you are not a party to the district and can only be made a party by annexation. C. C. 12-12-60 Page Fifteen LETTER FROM THE EAST SAN GABRIEL VALLEY WATER ASSOCIATION - Continued Mayor Heath: When the association was formed and dues set up, the by-laws stated the money of $20,000.00 was to be used for educational purpose and promotion. This $100.00 we pay now... the education program is over, or may be over soon. City Attorney Williams: I doubt that it is over. Mayor Heath: Councilman Brown: pay for, for members to attend. Mayor Heath: Are we permitted to use this $100.00 to be given to that as dues for the purpose they are going to use the hundred dollars? I see no difference between this and the Bonelli dinner that Council felt was illegal for the City to You feel we shouldn't belong to this? Councilman Brown: Definitely. Councilman Barnes: Don't you feel this is similar to the League of California Cities, to get information? • Councilman Brown: This promotes one purpose ... a water district. Councilman Barnes: You are right, in a way. Councilman Brown: The League of California Cities advises on all isues before legislature and also helps get certain things out of legislation, and that is entirely different because it covers a multitude of things. But this is one item... the promotion of.a water district. We contributed money into this to form a district and then got beat over the head because we wouldn't petition and annex to it. Councilman Barnes: But we get information, what they are doing and the progress along certain lines, which I think the City should be conscious of. In my opinion, a real serious study should be made regarding water since the passage of Proposition 1 on the ballot and we should know and study as to which way we are going to go --this district or some other district. This should be done in a study session, because I think it would be a lengthy discussion. With two major high- ways together, the master plan shows Valinda coming in there also. If there is to be consideration not to have this conflict we must do something with Valinda. City Manager Aiassa: You will have to make one decision now and the Commission should under- take immediately and that is to determine to abolish the one-way section on Glendora or not, and it must be done soon. Councilman Barnes: I feel that this definitely should be studied. But so far as the Valinda extension, it looks like this is far in advance. We can't tell what the traffic pattern will be, or the amount of traffic, until the Vincent extension is cut through and Glendora widened to its full width. We might then have a real problem and need the Valinda extension if these two majors should turn out to carry an extra amount of traffic. But we can't study Valinda at this time. Mayor Heath: I would agree. We can go ahead on Glendora as fast as we can make the study and change it on the master plan. But so far as Valinda I see no relation to this piece of property. Councilman Brown: We are holding up a piece of property on zoning in the Com- mission due to what is done with Glendora and Valinda at points other than the piece of property under consideration. Councilman Snyder-, That is not actually so, as it is in the vicinity and it doesn't have to be front of it to have something to do with the traffic pattern. Councilman Brown: City Manager Aiassa; Councilman Snyder: There is one-way traffic which starts north of this. You definitely will change the pattern when you make Glendora four lanes instead of two lanes at this location. And C-1 there makes a different demand. City Manager Aiassa: It may affect the frontage only, which now belongs to the City % and is part of the bridge betterment. Councilman Brown: This had potential C-1 on it and they now want it firmed up, but we delay it with a long study of the area. C. COUNTY SEWER IMPROVEMENT Delete parcel from original. 2052-M Allwood Street and other rights - of -way. The City Council passed a resolution granting consent and juris- diction to the County in the matter of improvements 2052-M. This involved collection and cost for connection to and using West Covina City sewers insofar as the City was concerned. Since that time there has been a deletion of a section of this improvement as shown on the map and it is now necessary to amend the resolution to conform to the new district boundary which eliminates that area indicated. VINCENT AVENUE Mr. Dosh: We are not going to meet the deadline on this. This has been due to inclement weather and another contractor in the area putting in a sewer line which had been delayed three months by us and which was a poor working oper- ation for the street contractor. However, when he bid the job he knew this and expected possible delays. Also, there is a 12-inch main water line to go in Walnut Creek and Vincent which will take about three days. There were major obstacles to this brought on by a combination of factors and there will probably be a request for a time extension. Mayor Heath: As indicated, the sewer con- tractor was held up by us'but on top of that there could have been better coordination between the groups working in the area. It will be delayed about two weeks? Mr. Dosh: I hope not more than that. The sewer contractor, however, is out of there. Councilman Brown: I think the coordination on this was excellent and the sewer contractor should be complimented as he worked on a day they weren't supposed to by asking permission, and receiving it, from the Union to do so. We will advise what has been done and a copy will be sent to these groups in the light of any changes they might still think of, of -which we will be advised, and if not we will put it up in final form for Council consideration, and if they have any changes they can also indicate them. Personnel and Study session on December 19, 1960 at 7:30 P.M. COUNCIL COMMITTEE REPORTS Councilman Snyder indicated that proposed City seals would be on display December 16th at City Hall and a number of Civic organi- zations have been invited to send a representative to help select one. A report will be presented to Council, M.T.A. MEETING Councilman Snyder stated that he and the City Manager had met with Mr. Gillis of the M.T.A. The rapid transit system had been discussed and plans of the north and south routes along Azusa Avenue. There was also discussed the possibility of alternate routes but there is a necessity of getting the opinion of different studies on this. Specifically discussed was the preliminary drawings of how to bring the bus off at the Sunset Avenue interchange, across Vincent and back on the freeway. Mr. Gillis' opinion was this was not acceptable to the M.T.A.., as it wasn't to us, and the engineer was directed to make up new drawings of a better plan. There was also to be a representative from the M.T.A. sent to the Chamber of Commerce and the City with regard to better schedule of buses and publication of schedules. Also., there was the matter of complaints from people in the area and they will send a representative to discuss this. It proved 6 productive meeting. Mayor Heath: Councilman Snyder: Mayor Heath: Councilman Snyder: Is there any progress or recom- mendations for shortening Council meetings? I have it in a rough draft. Was it their consideration of grouping things together? That is suggested. 0 C. C. 12-12-6o Page Twenty-nine Mayor Heath: I When could this be presented? Councilman Snyder: I could have it ready by next Monday night. Mayor Heath: Include that in the next Monday night discussions then. Councilman Barnes: I attended the meeting of the East San Gabriel Valley Planning Committee at which time the Chief Engineer to Mr. Gillis presented slides to show the new rapid transit system proposed routes. The estimated cost was 529.7 millioft dollars and this was for only four legs of the proposed routes. Slides were taken back in Chicago to show their rapid transit system also. Councilman Snyder: starting to cut the "frills" out. The engineering studies are through. The cost is more than they thought, so they are now The City Manager suggested they form a committee of representatives from each city to meet and approve or disapprove of these routes, and that seemed to be met as a favorable idea. Councilman Towner: The newspaper recently asked for the position of the City on the resolution adopted by other cities opposing the M.T.A. authority to condemn property. We hadn't taken any position on it nor given recommendations on it. They possibly can establish these routes without too much of this but I believe, too, that this metropolitan transit is such an urgent thing that there might be instances that they should have rights to condemn property without getting tied up by some recalcitrant situations. This to include fund transfers in the amount of $52,359-78.
