Williams, City Attorney ORDINANCE NO. 655 An Ordinance amending certain provisions of Ordinance No. 325 (Amendment No. 38) ADOPTED The City Clerk presented: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA AMENDING CERTAIN PROVISIONS OF ORDINANCE NO. 325'RELATING TO THE USES PERMITTED IN C-2 ZONE; REGULATION OF SERVICE STATIONS; THE CREATION OF A CIVIC CENTER DISTRICT AND REPEALING ALL PROVISIONS RELATING TO C-R ZONING" City Clerk Flotten: We had the first reading of this Ordinance on April 11, 1960. It was given its first reading with the provi- sion that the City Attorney make one correction in Section No. 1307 relative to the Civic Center area created by changing 300 feet to 70 feet, as the easterly line of the boundary. The boundary will read as follows: "All land lying between the center line of the San Bernardino Freeway, - a line 70 feet easterly of the most easterly property line of Sunset Avenue,- a line 350 feet southerly of the proposed southerly property line of Service Avenue 80 feet wide,- and the most westerly property line of Orange Avenue, exclusive of any portion thereof lying south- easterly of the northwesterly line of the Walnut Creek Wash" Motion by Councilman Pittenger, seconded by Councilman Barnes and carried, that further reading of the body of the Ordinance be waived. Motion by Councilman Pittenger, seconded by Councilman Mottinger, that said Ordinance be adopted. Co 4-18-60 ORDINANCE NO. 656 Rezoning certain property (Sugar Construction Co.) ADOPTED Page Two The City Clerk presented: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA REZONING CERTAIN PROPERTY LOCATED AT THE NORTHEAST CORNER OF FAIRGROVE AVENUE AND TONOPAH AVENUE" (Sugar Construction Co,) Motion by Councilman Pittenger, seconded by Councilman Mottinger and carried, that the reading of the body of the Ordinance be waived. Motion by Councilman Mottinger, seconded by Councilman Pittenger, that said Ordinance be adopted. Motion passed on roll call as follows: Ayes: Councilmen Pittenger, Mottinger, Barnes, Mayor Brown Noes: None Absent: Councilman Heath Said Ordinance was given No. 656 RESOLUTION NO. 1811 The City Clerk presented: Setting date of protest "A RESOLUTION OF THE CITY COUNCIL OF hearing - Annexation No, 165 THE CITY OF WEST COVINA DECLARING ITS INTENTION TO CALL A SPECIAL ANNEXATION ELECTION AND FIXING THE TIME AND PLACE FOR PROTEST BY PROPERTY OWNERS'• Mayor Brown: Hearing no objections, we will waive further reading of the body of the Resolution. Councilman Mottinger: This resolution acknowledges the receipt of the petitions?' City Clerk Flotten: That is true. We have petitions re- ceived from Mr. Cheesebrough and Mrs. Hammer on the 9th and it contains 31 signatures. Motion by Councilman Mottinger, seconded by Councilman Barnes, that said Resolution be adopted. Motion passed on -roll call as follows: Ayes: Councilmen Pittenger, Mottinger, Barnes, Mayor Brown Noes: None Absent. Councilman Heath Said Resolution was given No. 1811 RESIGNATION OF FRANK M. TOWNER AS MEMBER OF PLANNING COMMISSION HELD'OVER Councilman Mottinger: City Manager Aiassa: The City Clerk stated that he had a written communication directed to the City Manager from Mr. Frank M. Towner submitting his resignation as a member of the Planning Commission in view of his election to the City Council, Should that be accepted at this time, or not, until there is an opportunity to appoint his successor to the Planning Commission? You could make it effective when he is officially appointed as a member of Council ADJ. Co Ca 4-18-60 Page Three RESIGNATION OF FRANK M. TOWNER - continued Mayor Brown-, I think Councilman Mottinger's-point is that there will only be a 4-man commission, -prior to the appointment of Mr. Towner's successor, if this is accepted at this time. Councilman Mottinger-, It may be a bit difficult for short - period of time to serve in both capaci- ties, but the new Council can determine who his successor is going to be. City Clerk Flotten-, Is it legal to serve on the Planning Commission and Council? Mayor Brown-, I believe the City of Glendora does just that, they have a member of Council on the Planning Commission, Councilman Mottinger-, I do not see how it would not be legal as Council is an elective position and the Commission is appointive. Possibly we could accept it effective upon the date of appointing his successors Mayor Brown; This is an adjourned meeting and actually we are here to take up two spe- cific items only, City Manager Aiassa: This is an adjourned meeting and you can discuss other items, but if it was a special meeting then you could only discuss items particularly designated for that special meeting. CITY MANAGER REPORTS REFUND TO WALKER BUILT This matter is in relation to Mr, Herb HOMES, HERB BRAUN Braun, subdivision Tract No. 21366. Mr. Braun has submitted deposit fees and everything and Council has received copies of the reimbursement of fees and total amount of refunds to be, paid. There was deposited the amount of $8,423.01 and Mr. -.Braun is entitled to a refund in the amount of $7,422.51, There was a fee for inspection, sewer plan check, sewer maintenance fee, sewer inspection fee, street lights, fire hydrant, etc., credited to him giving him a refund of $7,422.51. However, I believe this refund should be predi- cated upon the official abandonment of those streets. Councilman Mottinger-, Where does the school district stand as to streets and making improvements? City Manager Aiassa-, We have a signed letter, signed by the 10 two school districts, as purchasers, and they have agreed in writing to the im- provements as outlined at our last discussion on the matter, and this letter is spread in full upon the Minutes under Tract No. 25679. Councilman Barnes-, They are buying the whole parcel? City Manager Aiassa-, Yes, the whole parcel, and have accepted the 7 conditions as imposed, Mr.... Aiassa read the conditions referred to, ADJ. Co 4-1.8-60 Page Four REFUND TO WALKER BUILT HOMES - continued Motion by Councilman Mottinger, seconded by Councilman Barnes; that authorization be given for the refund in the amount of $7;422o51'to Walker Built Homes, c/o Mr, Herb Braun, subject to the vacating of the streets within the abandoned subdivision. Motion passed on roll call as follows: Ayes: Councilmen Pittenger, Mottinger, Barnes, Mayor Brown Noes: None Absent: Councilman Heath RESOLUTION NO. 1812 The City Manager presented and read: Glendora Avenue Bridge "A RESOLUTION OF THE CITY COUNCIL OF CGlE(ndora Project NooFAS 630) THE CITY ('WEST COVINA, COUNTY OF LOS ADOPTED AS STIPULATED ANGELES, STATE OF CALIFORNIA, REQUEST- ING THE CALIFORNIA HIGHWAY COMMISSION AND THE DEPARTMENT OF PUBLIC WORKS TO APPROPRIATE FUNDS FOR THE CONSTRUCTION OF GLENDORA AVENUE BRIDGE, IN AN AMOUNT EQUAL TO ONE-HALF THE COST OF THE PROJECT Motion by Councilman Pittenger, seconded by Councilman Barnes, that said Resolution be adopted, subject to the City Attorney°s approval, • Motion passed on roll call as follows: Ayes: Councilmen Pittenger, Mottinger, Barnes, Mayor Brown Noes- None Absent: Councilman Heath Said Resolution was given No, 1812 TREASURER REPORT Motion by Councilman Mottinger, seconded" by Councilman Pittenger and carried, that the Treasurer's Report for March, 1960, be accepted and filed for the record. Mrs. Van Dame: $5.00 isn't much more -and they do more than the Parks and Recreation Commis- sion. Mayor Brown: If you just start dropping $5.00 here and $5.00 there, then were do you stop dropping? Mrs. Van Dame: Then bring the Council down to $20.00 a meeting. Mayor Brown: I, for one, would just as soon not receive anything. This money gets me into extra figuring for "Uncle Sam". Councilman Mottinger: As I've indicated before, any money we receive for this only turns out to be headache at the end of the year, REQUEST FOR PERMISSION TO Mr. E. La Belle: I represent the PLACE EMERGENCY DIRECTIONAL Planning CommittEe for the Mt. San Antonio SIGNS RELATIVE TO Relays and have the responsibility to RELAY RACES AT MT, SAN channel traffic into this area and out ANTONIO COLLEGE of it of those who will be attending APPROVED these races. We found it necessary to kecomm6 id to the College that they find two locations near the Freeway where they put up a directional sign to -enable traffic to get off at either Citrus or Barranca Avenues to get to the College. This is a traffic directional sign in the form of a banner which we proposed to have mounted for a period not to exceed 48 hours. One is to be placed under the Plaza sign at the Plaza Shopping Center and another one under the Huddle sign at the north side of the Freeway. These signs will be 4 feet by 12 feet. We have received clearance to place these signs from the Eastland Merchants Association, for the Huddle, and Mr. Shulman for the Plaza. Under your sign ordinance this is not acceptable unless it could qualify as an,-emergpncy directional sign and we feel that they are in this category because there will be people coming from both directions on the Freeway to attend these races. Rather than have them roaming around the streets looking for the location of the College, the designa- tion of these two streets will get them off the Freeway at the proper locations and it will be better for all concerned. We are seeking approval on this basis, but only Council can authorize this temporary use. ' Mayor Brown: Wouldn't it be better for westbound traffic to get off at Barranca? Mr, La Belle: We indicate Citrus on the Huddle sign because by then they have already passed Barranca. The event is on the 22nd and 23rd of April. It is an event of regional importance so far as the Valley is concerned, and we feel that world recor4s will be broken and they will stand in accordance with the books. It is -a sanctioned event of major relays in the United States, and one of the few in California to command as much attention this year. ADJ. C. C. 4-18-60 DIRECTIONAL SIGNS FOR RELAY RACES - continued Page Six Councilman Mottin.ger: I think this is certainly something we should approve. Motion by Councilman Mottinger, seconded by Councilman Pittenger -and carried, that these temporary emergency directional signs -be placed as proposed for a period of 48 hours and subject to the approval of the Traffic Department. CANVASS OF BALLOTS Mayor Brown indicated the canvass of ballots will take place Tuesday, April 19, 1960, at 7:30 P. M. The City Clerk indicated that he would inform the incoming members of Council as to the time, and the absent Councilman. There being no further business, motion by Councilman Pittenger, seconded by Councilman Barnes and carried, that the meeting be adjourned at 8:05 P. M. to 7:30 P. M., April 19, 1960.
